PUBLIC HEARING MINUTESENGLISH
---Minutes of the Public Hearing in respect of the proposed Quartz Sand
Project of Mis C.V.Mahadik, Mouje Kasarda, Tal.Kankavali, Dist.Sindhudurg
The Public Hearing in respect of the proposed Quartz Sand Project of Mis C.V.Mahadik, Mouje Kasarda, Tal.Kankavali, Dist.Sindhudurg was arranged on 13.10.2015 at l l.00 O'Clock at Karale Mangal Karyalay, Mumbai Goa Highway, Mouje Kasarde, Tai. Kankavali, Dist.Sindhudurg. At this hearing the
following Government officials/delegates were participated.

First of all, the information about the Public Hearing in respect of the
environment was given and being the arranger, reception of the present
delegates was made by Maharashtra Pollution Control Board. Being the
promoter, this Public Hearing related to environment has been conducted as per
the Notification of September, 2006 published by Environment and Forest
Ministry, New Delhi. 'The presentation of the project will be made by the
project proponent. After this presentation, the objections, if any, will be
registered and will be submitted to Environment and Forest Ministry, New
Delhi for further action. For further implementation, the Chainnan of this
Public Hearing Shri. Khutwad, Additional District Magistrate will be addressing
to the meeting.
The Chairman of this Public Hearing Shri. Khutwad told that the said
public hearing related to environment about the said proposed project may be
taken as per the Declaration of Environment and Forest Ministry, New Delhi.
Also if there are any objections related to the environment about this project,
and being the Chairman, those objections will be registered and forwarded to

---------------···-·..., Environment and Forest Ministry, New Delhi as it is. Also the Video Shooting
clips and C.D. will be submitted. Firstly, the presentation will be made by the project proponent of the proposed project and thereafter, you will raise your doubts if any. Saying thus, the project proponent was asked to present their
presentation.
The presentation of the said Quartz Sand Project was made by the project
proponents.
After the presentation, the Chairman Shri.Khutwad asked the participants
to present their doubts, suggestions or objection along with their names and
addresses and note the same.
Shri Raju Rathod, Alp Kankavali :- When he raised the point of
rehabilitation, the project proponent replied that there is no residence of any
person at this place, and hence the question of rehabilitation will not arise here.
On this, Shri Sanjay Patade told that he is residential farmer here and the
mining of C. V .Mahadik is running here since the year 1997. No question of rehabilitation is arose here and the rehabilitation will not be necessary in future.
Shri Shailesh Bhogale, Alp Kankavali :- He said that the minutes of the said public hearing be noted and the Dy. Regional Office, Maharashtra Pollution
Control Board, Ratnagiri has published the public notice in the Marathi and English Newspapers, but it has not made available on the website of
Maharashtra Pollution Control Board. Also the inadequate documents are
uploaded on the website of District Collectors Office, Sindhudurg. Besides he
raised the point that today is the day of the Ghatsthapana festival and hence the
local residents could not participate this public hearing. Also the project
proponent has given false notes in the report submitted by them. The first issue
of this is that they have not read the names of 48 villages within 1 O KM. area.
They should read the names of these villages and he further raised the point that only 49 employments will be generated through this project.
On this, the project proponent read the names of 48 villages within 1 O KM. radius.
On this, Shri Bhogale told that the village Wagade at Sr.No.41 does not comes within 10 KM.radius. He registered this objection and told that the said
report is erroneous. Besides, in this report no numbering i~, made and the project proponent and administration is knowingly doing this effort. The project proponent has mentioned in the report that they have made plantation of 3116 trees for T.0.R. in mining lease, which is wrong. Shri Bhogale told that while running the mining project it should be made environment friendly. Besides the issue of project affected persons is the important issue here. He also pointed that in the Environment Impact Assessment (EIA) Report, the existence of school, educational institution, health centers are purposely avoided and hence this will make adverse affect on the school going children and other people. Also it is not mentioned in this report that from where and to where the conveyance of the dumpers will be made for this project. The excavation will make pollution in air and adverse effect of this will be made on the health of local residents and school children. This also is avoided to mention in this EIA report. He also said that it is nowhere mentioned that when and where the washing plant will be made. The participant persons told that only Shri Bhogale is raising the points and they quarreled and asked the Chairman to give them the chance to represent them.
Shri Sanjay Dattaram Patade, A/p Kasarde :- He told that he and other local residents have not constrained to rehabilitate due to the said project. He said that there is no need of rehabilitation due to the said proposed project and C.V.Mahadik has catered their need of Anganwadi and school in view of social responsibility. Therefore, we the villagers have decided to help them. Also the project proponent should prepare the road upto Health Centre. Thus the problems of health will be solved. The workers in the near vicinity are working here and C.V.Mahadik is giving good facilities to them. Therefore, C.V.Mahadik has given good participation to our Kasarde in view of health, water and environment. We have gathered here to hear that what benefits will be made to this Gavthan due to this project and what additional benefits more than earlier benefits will be made available.
Shri Shailesh Bhogale, Alp Kankavali:- When he was raising his points, the
Chairman Shri. Khutwad asked him to allow other people to present their issues. On this, Shri Bhogale told that I will present my issues and there is no limit of age to the environment related public hearing. In reply, the chairman asked him to present his issues.
Shri Sanjay Desai, Alp Kasarde :- He told that Hon. Collector should inform that how many villages out of the villages in l O KM. radius are eco-sensitive. On this, the Chairman Hon.Khutwad told that there are 37 villages in Kankavali

Taluka. Also Shri Desai told that there is a village Dhareshwar near Avaleshwar and the distance between them is hardly 1 KM. the borders are adjacent to each other. The land admeasuring 700 to 800 hectares is a forest land. On this, the chairman told that your objection will be noted.
Shri Sanjay Sambhaji Patade, Alp Kasarde :- He told that he is agreed to some of the points raised by Shri Bhogale and Shri Desai. I am also agreed with the positive and negative solutions given by the project proponents. Some issues are especially avoided from this report. The classification of this project has not been mentioned. The plantation must be made as has been shown in the report. Also the period when the density of sound decibel was taken is wrong. Therefore, the density of sound decibel must be counted when the mining activities are running. Hundreds of workers are working in the mining project. The facility of toilets for them is very inadequate. We try to make our village is Hagandarimukta Gav, but actually it cannot be implemented. Also the renovation of road is necessary, whereby the sound and air pollution can be avoided. While performing the work of mining, the large stones are scattered here and there, which should be arranged neatly. The care also should be taken that the underground water flow should not be stopped. While starting the mine, dewatering is being made and therefore the water level of the wells in near vicinity is deepening, which should be managed. I also congratulate to Maharashtra Pollution Control Board and the concerned project officers and participant villagers and give my thanks for giving me an opportunity to present my opm1on. I insist that this project must be implemented whereby the employment can be generated.
The chairman Hon. Khutwad asked to raise their hands who wish to present their opinion. At that time Shri. Sudhakar Rawale asked to explain about the Quartz Sand Mine Project and C.V.Mahadik and he asked that for whom this public hearing has been conducted. Chairman Hon. Khutwad replied that this hearing is for the project. On this, Shri Rawale told that he has not heard the name Quartz Sand Mine. Chairman Hon. Khutwad replied that Silica
means Quartz Sand.
Shri Prakash Parkar, Alp Kasarde :- He said that if this project is for welfare of the village, I will definitely welcome this project. But at the same time, the educational and communication sources also should be considered. But these should not make any adverse effect on the group of villagers. He said that in this year, while Ganesh Visarjan occasion, we could not drawn the Ganpati Idol of hardly 2 feet height in the stream. He asked that the condition of the stream
should be made as it was herebefore.
Sbri Sanjay Mundale, Alp Kasarde:- He paid his thanks to the delegates on the platform and Smt.Mahadik and presented his say that the government collect thousands of rupees in the form of royalty from Sand Mine projects, but the funds for repairs of road has not been given by the government, which is the fact. Who is responsible for this? If you are taking royalty, you must give part of that royalty. Why this rule is overruled, he requested the Chairman to give answer of this question. On this, the Chairman Hon. Khutwad replied that this public hearing is related to the environment and it does not concern to the royalty. On this, Shri. Bhogale told that the district level committee should be formed for this and when the situation became disturbing, the chairman appealed for the peace. On this, when it was told that the answer of royalty will be given to the office, Shri Mundale requested to give the answer here only.
Shri Shailesh Bhogale, Alp Kankavali:- He told that the inadequate provision for health and road has been made by the project proponent in the report submitted by them. When the situation became noisy, the Tahasildar Kankavali told the mob that Hon. Chairman has arrived here for hearing your grievances, you should present your opinion peacefully. On this, Shri. Mundale requested the Chairman to form the district level committee for the royalty comprising of and the existing Sangh and society should be included in this ·committee. On this the Chairman Hon.Khutwad told that this issue is not related to the public hearing, but I will let this know to District collector.
Shri Dattaram Jadhav, Alp Kasarde :- He asked that when the survey of this
project was made? And whether it is known to the villagers or not? Besides, he told that the alternative road should be made for the existing mines business.
We will remain firm for the welfare of our people. We will not allow anybody to ply their vehicles on this road.
Shri Shailesh Bhogale, Alp Kankavali:- He asked that why all the issues
presented were not included in the report? He asked to prepare new roads. And
why all the decisions were not recorded in the report? It should be made and
new report should be submitted after cancelling this report.
Shri Jagannath Bhikaji Patade, Alp Kasarde :- He told that the mine owners
have helped us from time to time and made available the road to us. The road
leading to the village from the main road is prepared by the mine owner at their
own cost. In this case, we will have no objection to give our lands for the road.

Shri Prakash Krushna Patade, Alp Kasarde :- He told that our farm is
adjacent to the mine and till today no adverse effect is made on our agriculture.
He also gave assurance that the mine owner will prepare the road from mine to
the highway at their own cost.
Adv.Harshad Gawade, Alp Kankavali :- He asked that when the survey of the problems of garbage, environment, plantation, blasting etc. was conducted?
He also asked that you have noted all the problems submitted by the participant
citizens. What remedies on these problems will be initiated by you? On this,
the Chairman Hon.Khutwad told that all of your objections have been noted.
Shri Shailesh Bhogale, Alp Kankavali:· He requested for taking new public hearing, this report is false. On this, Shri Sanjay Patade told that the election
should be taken to determine whether the public hearing may be taken again or not. He told that we the local resident wish that the project should be
completed. As has been said by Adv. Harshad Gawade, the project proponent should explain as to how they will extend their cooperation to us. But we local farmers are not agreed to the statement that we oppose to this project. But the
facilities of water and road must be made available in the village.
Shri Sanjay Desai, Alp Kasarde :- He told that he is agreed to the points raised by Shri Sanjay Patade. But all the discrepancies in this report should be
complied with, otherwise we will present the Writ Petition.
The mine owner Smt. Kashmira Chandrashekhar Mahadik told that when
the lease will be implemented, the first issue will be the work of road and
second issue will be that no resident will be affected adversely. Besides for the assurance of the villagers, I am ready to give on Bond Paper in writing that we will prepare the road, but please do not haste (Hullad) and speak that we will
not allow to run this project. On this, the mob took objection on the word
'Hulladbaji' and they told that we are arrived here for presenting our questions and not for making 'Hulladbaji'. Therefore one should talk with due respect.
On this, Smt. Kashmira Mahadik withdrew her words. She also told that
whatever I will do, will be done by taking into consideration the welfare of the
land owners and whatever facilities are expected, one should contact me directly, I will extend my cooperation.
Shri Shailesh Bhogale, Alp Kankavali:- He told that the compensation
payable to the land holders and project affected persons should be declared in this public hearing.

Shri Sanjay Desai, Alp Kasarde: - He said that the point raised by the mine owner is very good. This issue should be given for proceeding barring the word 'Hulladbaji ', whereby we will not be needed the Bond Paper. On behalf of our village, I congratulate them and the facilities which were not made available in past years, should be revealed. On this Smt. Kashmira Mahadik give her thanks to all the participants.
Chairman Shri. Khutwad said that if there are any more objections of anybody, they can ask. On this Adv.Harshad Gawade asked that what about the question presented now? On this, Chairman told that all the objections have been noted and they will be submitted for further action to Forest and Environment Ministry, New Delhi.
To conclude, Shri. Khutwad told that if there are any more questions of the participant persons and if so, they should ask that. But nobody from the present mob presented · any question and therefore Hon. Chairman gave his thanks to the participant mob and declared that the Public Hearing Related to the Environment is concluded.

Compliance report of the proceedings for Public Hearing for proposed Silica Sand Mine (63.26 Ha) of Kasrade Silica Sand Mine (M/s C.V. Mahadik Mine) at Village - Kasrade, Taluka-Kankavali
District - Sindhudurg, Maharashtra Public Hearing for the project Kasrade Silica Sand Mine (M/s C.V. Mahadik Mine) measuring an area of 63.26Ha of Smt Kasmira C. Mahadik at Village - Kasrade, Taluka Kankvali, District - Sindhudurg, Maharashtra was conducted on 13.10.2015 from 11.00 AM onwards at Karale Mangal Karyalay, Mumbai Goa Highway, Mouje Kasrade, Tal-Kankavali, District Singhdhudurg, Maharashtra. A/p Kankavali He wanted to know what steps are taken to rehabilitate the locals from the mining area
The project proponent replied that there is no residence or building in the mining area hence rehabilitation is not applicable. Project proponent is paying agreed compensation to all land owners falling with in lease area. Another local Shri Sanjay Patade supported the contention of project proponent and told that since 1997 when the mining was started, rehabilitation was never an issue and in future too this will not be an issue.
2 Shri Shailesh Bhogale, A/p Kankavali
Public Notice was not made available in the MPCB website. Inadequate documents have been uploaded on the website. Name of 48 villages within 10 Km area should also be read. He registered his objection regarding village Wagade Sl No. 41 which does not come within 10 Km radius. He also informed that figure of plantation mentioned is not correct. Mr. Bhogale informed that the mining projects should be environment friendly and pointed out that existence of school, educational institution, health centers have been purposely avoided in EIA report. 3 Sri Sanjay Dattaram Patade, A/p Kasrade
He supported the project and informed that rehabilitation was never an issue and that C.V. Mahadik has always given good facilities to locals and have catered their need of Anaganwadi and school as part of social responsibility. He requested that the project proponent should prepare the road up to the Health Centre. We have gathered here to hear that additional benefits more than earlier benefits.
The project proponent thanked for the support by Sri Sanjay Dattaram and informed him that road to the health center will be made by her once the operation of mine commences. For the road and other welfare measures capital budget provision of Rs 24 lakhs and recurring budget of Rs 9 lakhs have been made in the EIA report.
5 Sri Sanjay Desai, A/p Kasrade
He informed the chairman that Village Dhareswar is only 1 km from Village Awaleshwar. The land measuring 700 to 800 Ha near this village is forest land.
Chairman noted his point. Project proponent informed that no mining is proposed in the forest area. All the land in the lease area is private land. EIA will address all the issues concerning environment and directions if any of MoEF&CC will be followed.
6 Sri Sanjay Sambhaji Patade A/p kasrade
He supported the project and wanted that project shall be implemented at the earliest so that employment can be generated. However he raised following points:
a) The classification of the project has not been mentioned
b) Plantation must be made as per EIA report
c) Sound decibel as shown is wrong as it has not been taken during the mining activity.
The classification of the project is 1(a) which is already mentioned in the EIA report. P.P. commits that the plantation will be made as per Environment Management Plan approved by MoEF&CC. Since presently no mining activity is going on hence sound level cannot be measured during the mining operation. Under the environmental monitoring head of the EIA report it is proposed hat regular monitoring of noise level will be done once the mining commences. Additional

For the renovation of the road a capital budget of Rs. 10Lakh and recurring budget of Rs. 2Lakh have been made. Fragmentation study is proposed to be conducted for optimum blasting and to avoid scattering of stones. No mine dewatering is proposed in the present project as the mining is planned above the water level. Therefore the water level will not be affected because of mining in proposed project.
7 Shri Prakash Parkar, A/p Kasade
He supported the project. However mentioned that educational and communicational sources shall be considered and there should be no adverse effect on the villagers. He also asked that the condition of the stream should be made as it was a year before.
P.P. thanked Shri. Prakash and assured him that under CSR a capital budget provisioning of Rs. 25 Lakhs and recurring expenses of Rs. 9 Lakhs has been made in the EIA report towards the welfare activities. Since the mine will be operated above the water level therefore the activity will not have any adverse effect on the stream.
8 Shri Sanjay Mundale, A/p Kasrade
He inquired from the Chairman that why the roads are not been repaired even though royalty is being collected from the mine owners.
The Chairman informed him that this P.H. is for Environmental clearance of the mine of P.P therefore this matter shall be raised separately to the administration.
9 Dattaram Jadhav, A/p Kasrade
He wanted to know when the survey of this project was made. He also wanted that alternative road should be constructed for the mine and welfare of the people shall be given priority
Baseline study of the EIA was done from Dec 2014 to Feb 2015. PP informed that new road will be constructed for the mining purpose and welfare of the people will be given priority. Under CSR a capital budget of Rs. 25Lakhs and recurring budget of Rs. 9lakhs has been made which includes expenditure on road as well as health matters.
10 Shri Jagnnath Bhikaji Patade, A/p kasrade
He informed that the mine owner helped them from time to time and made available the road for

He told that his farm is adjacent to the mine. No adverse effect on the agriculture is noticed. He also demanded to construct road from mine to highway.

12 Adv. Harshad Gawade A/p Kankavali
Asked about when survey was done and proposed remedies on the problems of garbage, environment, plantation, blasting etc.
Survey was conducted during Dec 2014- Feb 2015. Impact on environment by all the activities of the project has been analyzed and mitigation measures have been proposed in the EIA report.
13 Shri Shailesh Bhogale, A/p Kankavali
Mr. Sanjay wanted a new public hearing but he was opposed by Sri Sanjay Patade and other participant who wanted that the project must be completed. Mr.Harshad Gawade wanted to know as to how project proponent will extend their cooperation to locals. Local farmers supported the project and wanted that water and road facilities shall be made available to them.
P.P. thanked the participants for the support to the project and committed to improve the facilities of road and water as incorporated in the EIA report.
14 Shri Sanjay Desai, A/p Kasrade
Agreed with Sri Sanjay Patade that all the discrepancies in this report should be complied with.
PP thanked him for support and committed that all the discrepancies will be removed and compliances will be made in true spirit. P.P. Smt. Kashmira Mahadik informed that once the mining starts the first issue will be work of road and second issue will be that no resident will be affected adversely and for this she is ready to commit in writing if required by the villagers. She told that she will do everything by taking into consideration the welfare of the land owners and whatever facilities are expected from her.
15 Shri Shailesh Bhogale, A/p Kankavali
Asked that the compensation payable to the land holders and project affected persons should be declared in this public hearing.
The compensation payable to the land owners will be mutually settled as has been done in the past.
16 Sri Sanjay Desai, A/p He said that the point raised by Project proponent thanked Sri.
Kasrade the mine owner is very good and congratulated the P.P. and wanted that facilities which were not made available in the past should be made.
