    BYLAW 5940-2020-5050(381)

    A Bylaw to amend "District of Mission Zoning Bylaw 5050-2009"

    WHEREAS, under the provisions of the Local Government Act, a Council may, by bylaw, divide the municipality into zones and regulate the use of land, buildings and structures within such zones;

    AND WHEREAS the Council of the District of Mission has adopted "District of Mission Zoning Bylaw 5050-2009" and amended same from time to time;

    AND WHEREAS the Council of the District of Mission deems it advisable and in the public interest to amend the Zoning Bylaw;

    NOW THEREFORE the Council of the District of Mission, in open meeting assembled, ENACTS AS FOLLOWS:

    1. This Bylaw may be cited for all purposes as "District of Mission Zoning Amending Bylaw5940-2020-5050(381).”

    2. "District of Mission Zoning Bylaw 5050-2009" as amended, is hereby further amendedby:

    a) rezoning the property located at 7707 Pintail Street and legally described as:Parcel Identifier: 001-210-220 Lot 465 Section 20 Township 17 New Westminster District Plan 61504

    from Urban Residential 558 (R558) Zone to Urban Residential 558 Secondary Dwelling (R558s) Zone; and

    b) amending the zoning maps accordingly.

    To rezone the property to facilitate construction of a coach house.

    OVERVIEW AND STAFF COMMENTS:

    This report details the rezoning application for the property located at 7707 Pintail Street and identifies the necessary amendment to the Zoning Bylaw. The proposal is consistent with the Official Community Plan and the conditions established by Section 464(2) of the Local Government Act.

    Staff support the application moving forward and, as such, have listed the Zoning Amending bylaw under the “Bylaws for Consideration” section of the agenda.

    RECOMMENDATION: Council consider and resolve:

    That the Public Hearing for Zoning Amending Bylaw 5940-2020-5050(381) for the property located at

    7707 Pintail Street be waived.

    PURPOSE:

    To accommodate the construction of a secondary dwelling unit in the form of a coach house.

    RATIONALE OF RECOMMENDATION:

    The proposal is consistent with the Official Community Plan.

    • The subject properties are currently designated Urban Residential in the OCP. The proposal for rezoning to the R558s zone conforms to the Urban Residential OCP designation.

    • The proposal is consistent with OCP Policy 5.1.26, which supports rezoning for secondary dwelling units as a form of infill housing and states that secondary dwelling units may be considered on lots that are large enough to accommodate on-site parking, private outdoor space, a separate entrance that is clearly secondary to the primary dwelling, and that the scale of the secondary dwelling (coach house) must clearly be ancillary to the primary use.

    • The applicant has supplied a site plan that shows adequate off-street parking on the subject properties in conjunction with the location of the proposed primary dwellings. This site plan is included in this report as Attachment A.

    SITE CHARACTERISTICS AND CONTEXT:

    Property Size

    • 7707 Pintail Street is approximately 765 m² (8,235 ft²) in area.

    • This exceeds the minimum lot area for the R558s Zone of 558 m².

    Neighbourhood Character

    • The subject property is located in the Mission Core neighbourhood and is surrounded on all sides by other urban residential parcels developed with single family dwellings. Some properties nearby the subject property have been rezoned to allow for secondary dwelling units.

    Environmental Protection

    • There are no watercourses or protected Environmentally Sensitive Areas on or adjacent to the subject property.

    Parks and Trails

    • No municipal parks exist within close proximity to the subject property, but Christine MorrisonElementary School is located two blocks North.

    Servicing

    • Development of this area will require servicing upgrades at time of Building Permit application.

    REFERRALS:

    Engineering Department: The Engineering Department has no objection to this proposal.

    Building Division: Building permit required. Sprinklers required with a water service upgrade. Rock pit required for storm water management.

    Bylaw Enforcement Division: There are several closed complaints for parking issues on Pintail Street and Williams Avenue, but not for this property in particular.

    Mission Fire Rescue Service: No comment was provided.

    DEVELOPMENT CONSIDERATIONS:

    Tree Management

    In accordance with Council Policy LAN.32 – Tree Retention and Replanting, the applicant will be required to plant a total of two trees on the subject property.

    Development Permit

    Development Permit Area A for Infill development is applicable to secondary dwelling units being constructed on lands designated Urban Residential within the Urban Growth Boundary. This Development Permit is delegated to Staff for approval.

    COMMUNICATION:

    Communication action, as listed below, is in accordance with Council Policy LAN.03 Development Notification Signs, Land Use Application Procedures and Fees Bylaw 3612-2003, and the Local Government Act.

    • The applicant has posted one development notification sign

    • A Notice of Waived Public Hearing will be sent to all occupiers and owners of properties within 152m from the development site notifying them of opportunities to provide comment.

    REQUIREMENTS PRIOR TO FINAL READING:

    Final Reading of the Zone Amending Bylaw will be held until the following have been satisfied:

    1. Planting of two trees on the subject property or a deposit in the amount of $500.00 in accordance with Council Policy LAN.32.

    2. Any other requirements resulting from Council’s consideration of the Bylaw including Public Hearing.
