1 INTRODUCTION 1.1 In September 2008, Brookbanks Consulting Ltd was appointed by Hallam Land Management, to complete a

Geo-Environmental Desk Study for a proposed urban extension to the north of Nuneaton. 1.2 The objective of the study is to research the likely geotechnical and chemical characteristics of the soil and

ground water environment.

2 BACKGROUND INFORMATION Location & Details 2.1 The site lies on the northern urban fringe of Nuneaton. The A444 bounds the north east of the site beyond

which is farmland. Residential development consisting of the existing urban fringe of Nuneaton fronts the south eastern boundary of the site. South west of the proposed development runs the River Anker flowing from east to west, finally, to the north west of the site a dismantled railway which is now part of the Weddington country walk bounds the land.

2.2 The proposed development is presently in agricultural usage and is thought to be historically undeveloped. The

site location and boundary is shown indicatively on Figure 2a, below.

Development Criteria 2.3 It is proposed to develop a sustainable urban extension over a gross area of approximately 13.9ha. The project

will consist of a residential end use of circa 326 dwellings with a doctors surgery and associated ancillary development.

Sources of Information 2.4 While completing the study, the following records were obtained:

• Historic Ordnance Survey Mapping • Environment Agency – soil, ground water and land use registers • Natural England - land use registers • Local Authority – soil, ground water and land use registers • British Geological Society – Published geology and land use registers

3 HISTORICAL SITE USES In appraising the site history, published Ordnance Survey maps have been reviewed dating from the late 19th century up to the present day. A list of historical maps used in this report is contained within the appendix. 3.1 Inspection of the Ordnance Survey maps has revealed the following information relating to the former uses of

the site and immediate evrions.

Pre 1900 The site comprises entirely agricultural land with a small pond identified in the centre. The River Anker borders the south western edge of the site. Generally surrounding these three sides of the site, beyond the immediate boundary, is undeveloped agricultural land. To the south east of the site St James’ Church and Rectory Farm can be identified bordering the site. Beyond these buildings, to the south east, a substantial amount of woodland can be identified. Within this woodland approximately 500m south east of the site Weddington Castle can be observed. With the exception of the current urban extent of Nuneaton (approximately 1km to the south) the majority of the surrounding area is undeveloped agricultural land

1904 No significant changes can be observed on-site. Weddington Castle has now become

Weddington Hall and the northern edge of Nuneaton has undergone a small increase in residential area. No other significant changes can be seen in the surrounding environment in comparison to the previous mapping.

1921 - 25 No significant changes can be observed within the site boundary. A small drainage ditch along

with a small number of extra residential properties can be observed on the south eastern border of the site, the ditch flows north east to south west to link with the River Anker. Approximately 500m west the River Anker appears to have been channelised leaving oxbow lakes either side of its new banks. No other changes appear to have taken place.

1938 - 46 No significant changes can be observed within site boundary. Nuneaton has undergone a

significant increase in size with residential developments and associated services including schools and allotment gardens observed to the south east stretching from the south (approximately 800m from the site) up to 250m from the site boundary.

1955 No significant changes can be observed within site boundary. A small number of residential

properties can be observed to the north of the site. A Residential expansion can be observed on the northern boundary of Nuneaton next to the Trent Railway line. Between 250 and 500m south of the site a sewage treatment works can be observed along with an increase of residential developments within this area. Within the grounds of the rectory on the south eastern boundary two ponds appear to have been created. No other changes appear to have taken place.

1965 – 68 No significant changes can be observed within site boundary. The sewage treatment works to the south of the site appears to have been removed; the area which it occupied is identified as an area of parkland called Sandon Park. On the south eastern boundary of the site next to the existing residential development an Oak Nursery can be identified. To the north east the road bounding the site has now been identified as Weddington Lane. No other changes appear to have taken place.

1974 – 75 No changes can be observed on-site. The rectory land now contains a small residential area

removing the two ponds previously situated here. There has been a slight residential increase along the northern boundary of Nuneaton however no significant changes can be observed within 500m of the site boundary.

1989 – 94 No changes can be observed on-site. The railway line on the north western boundary appears

to have been dismantled and now has a public footpath in its place. The oxbow lakes left by the channelisation of the River Anker are no longer marked on the map suggesting they have dried up or been infilled. No other changes appear to have taken place.

1999 On-site the pond is no longer labelled suggesting it is no longer present. No significant changes

can be observed within 500m of the site boundary. 2008 No significant changes appear to have taken place on-site or within 500m of the site boundary.

4 RECENT & CURRENT SITE USAGE 4.1 The site is currently in agricultural use. The historical map search suggests that the land is previously

undeveloped.

Geology 5.1 Published geology, obtained from the British Geological Survey, reports the bedrock at the site to be of the

Mercia Mudstone formation, as shown in figure 5a below:

5.4 The site is not reported to be in a Coal Mining Affected Area.

Radon

5.5 The site lies within an area where less than 1% of homes are above the action level and as such is not considered to be affected by radon.

5.6 It is reported that no radon protection measures are necessary for new developments in this area.

Flooding 6.1 The proposed development site lie outside the envelopes of the 1 in 100 (1%) and 1 in 1,000 (0.1%) year fluvial

floodplains of the nearby main rivers as shown in the Environment Agency’s Flood Zone Plan, shown in figure 6a below.

Discharge Consents

6.2 No discharge consents have been granted within the site boundary. 6.3 Two discharge consents have been granted within 250m of the site boundary. Both were granted for water

company sewerage discharges from the Severn Trent pumping station in on 16th March 1973, both were subsequently revoked on 27th March 2000. Both permits consented discharge into the River Anker.

6.4 Within 250m to 500m of the site boundary two discharge consents have been granted. These consents were

for the discharge of unspecified sewage and cooling water. Discharge was into the freshwaters of the River Anker and Caldecote Brook. The discharge consent relating to cooling waters entering the Caldecote Brook was revoked on 23rd September 1998.

6 HYDROLOGY

Water Quality

6.5 The Environment Agency currently monitor 40,000km of river length in England, to help protect these areas each stretch of river is monitored and given a river quality grade. This is based upon the chemical quality of the water. The rivers are then graded from A to E with A representing a river with very good water quality and E, a river with very poor water quality.

6.6 There is one recorded river quality grade sampling point near to the site boundary. In 2000, the stretches of the

River Anker from Change Brook to Nuneaton Sewage Treatment Works achieved a GQA River Quality Grade B – Good.

6.7 Within the site boundary there are no river quality chemistry or biology sampling points. 6.8 To improve the quality of water bodies, new European legislation known as the Water Frame Directive (WFD)

has been introduced to promote a new approach to water management through river basin planning. One aim of the Water Frame Directive is to improve the ecological health of inland and costal waters and to prevent further deterioration. A requirement has been placed on nearly all inland and coastal waters to achieve ‘good status’ by 2015.

6.9 The River Anker has been identified by the WFD to be at risk from point source pollution along with diffuse

source pollution and physical or ‘morphological’ alteration. 6.10 Point Source Pollution refers to a single localised source of pollution to that can be identified on a map as a

single location. 6.11 Diffuse Source Pollution refers to pollution dispersed from a number of point sources.

Groundwater Vulnerability 7.1 The site is reported to lie within an area of Minor and Major Aquifer as shown in figure 7a below;

Non Aquifer

Search Buffer (250m, 500m) 7.2 The majority of the site is underlain by a Non aquifer however the southern section of the site can be seen to be

overlying a Minor Aquifer of high leaching potential. Minor Aquifers comprise of potentially fractured rock formations or formations of variable permeability.

7.3 The Minor Aquifers surrounding the site vary in leaching potential from high to intermediate. The leaching

potential of a soil relates to how readily the soil can transmit liquid discharges. The higher the potential the greater the range of possibility for the transmission of liquid discharges and an increase in potential for contamination of groundwater resulting from contaminated soils. Groundwater Abstractions

7.4 No ground water abstraction licenses granted within the site or within 500m of the site boundary. 7.5 There is one groundwater abstraction granted approximately 800m from the site boundary for the processes of

general mineral washing. 7.6 There are no source protection zones within 500m of the site boundary. 7.7 It has been reported that the pond, recorded on-site until 1999, was subject to extractive industries activity, it is

noted that this took place in 1952.

8.1 No Pollution Incident to Controlled Waters have been recorded within the site boundary. 8.2 Two Pollution Incident to Controlled Waters have been recorded within 250m of the site boundary, one

occurring in 1995 and one in 1996. Pollutants included; diesel along with unknown oils. Both of the incidents involved pollutants entering the River Anker, one being classified as Category 3 – Minor Incident. The incident in 1996 was classified as Category 2 – Significant Incident, this reportedly took place at Caldicott Hall.

8.3 There is one Substantiated Pollution Incident Register within 250m of the site. This relates to a Category 1 –

Major Incident event on the waters of the Upper Trent catchment. This incident has been reported to have taken place in 2002 and is noted to involve storm sewage.

8.4 One Historic Landfill Site can be observed within 250 – 500m from the site boundary. This landfill is reported

to generally have taken household wastes however no opening or closing dates have been supplied. 8.5 There are no records of the following on or within a 500m radius of the site;

• Control of Major Accident Hazards Sites (COMAH) • Explosive Sites • Notification of Installations Handling Hazardous Substances (NIHHS) • Planning Hazardous Substance Consents • Planning Hazardous Substance Enforcements

8.6 There are two recorded Contemporary Trade Directory Entries within 250 - 500m of the site, one active and

one inactive. The processes involved relate to the following;

• Construction of blinds, awnings and canopies • Printers

8.7 None of the following are recorded with 500m of the site:

10.1 Guidance has been published by the Department of the Environment, Transport and the Regions (DETR

Circular 02/2000) 'Environmental Protection Act 1990: Part 11A -Contaminated Land (20th March 2000) which promotes the 'suitable for use approach'. The DETR note 'The "suitable for use" approach focuses on the risks caused by land contamination. The approach recognises that the risks presented by any given level of contamination will vary greatly according to the use of the land and a wide range of other factors, such as the underlying geology of the site. Risks therefore need to be assessed on a site-by-site basis.

10.2 The "suitable for use" approach consists of three elements:

• Ensuring that land is suitable for its current use - in other words, identifying any land where contamination is causing unacceptable risks to human health and the environment, assessed on the basis of the current use and circumstances of the land, and returning such land to a condition where such risks no longer arise ("remediating" the land): the new contaminated land regime provides general machinery to achieve same.

• Ensuring that land is made suitable for any new use, as planning permission is given for that new use -

in other words, assessing the potential risks from contamination, on the basis of the proposed future use and circumstances, before official permission is given for the development and, where necessary to avoid unacceptable risk to human health and the environment, remediating the land before the new use commences; this is the role of the town and country planning and building control regimes.

• Limiting requirements for remediation to the work necessary to prevent unacceptable risks to human

health or the environment in relation to the current use or future use of the land for which planning permission is being sought - in other words, recognising that the risks from contaminated land can be satisfactorily assessed only in the context of specific uses of the land (whether current or proposed), and that any attempt to guess what might be needed at some time in the future for other uses is likely to result either in premature work (thereby risking distorting social, economic and environmental priorities) or in unnecessary work (thereby wasting resources).

10.3 Also addressed within the DETR guidance is the issue of 'contaminated land'. 'Before the Local Authority can

make the judgement that any land appears to be Contaminated Land on the basis that Significant Harm is being caused, or that there is a Significant Possibility of such harm being caused, the authority must therefore identify a Significant Pollutant Linkage.

10.4 This means that each of the following has been identified:

• A Contaminant • A Pathway • A Receptor

and that:

• The Contaminant is causing Significant Harm to that Receptor. or

• There is a Significant Possibility of such harm being caused by the Contaminant to the Receptor. 10.5 Where any of the three elements of the SPR are not present, there is no risk and therefore land cannot be

classified as ‘statutory contaminated land’.

10.6 In terms of controlled waters, DETR Circular 02/2000 notes the following: “A.35 Section 78A(9) defines the pollution of controlled waters as: 'The entry into controlled waters of any

poisonous, noxious or polluting matter or any solid waste matter'. A.36 Before determining that pollution of controlled waters is being, or is likely to be, caused, the local

authority should be satisfied that a substance is continuing to enter controlled waters or is likely to enter controlled waters. For this purpose, the local authority should regard something as being "likely" when they judge it more likely than not to occur.

A.37 Land should not be designated as contaminated land where: (a) A substance is already present in controlled waters; (b) entry into controlled waters of that substance from land has ceased; and (c) it is not likely that further entry will take place. A.38 Substances should be regarded as having entered controlled waters where: (a) They are dissolved or suspended in those waters; or (b) if they are immiscible with water they have direct contact with those waters on or beneath the

surface of the water. A.39 The term "continuing to enter' should be taken to mean any entry additional to any which has already

occurred.” 10.7 At Phase I stage, it is common to outline a preliminary conceptual site model of possible pollutant linkages,

which are summarised as Table 10a, below. At this stage, the conceptual model is prepared without site specific soils, groundwater or gas testing and as such, the findings should be treated only as first and general indications of possible SPR linkages.

10.8 The potential sources of contamination at the site are primarily:

On-site: Contamination relating to historical agricultural usage Off-site: Groundwater from historical sewage treatment works Off-site: Contamination from historical railway line

10.9 The potential receptors at the site are:

• End users / site occupiers • Adjacent users / occupiers • Controlled waters • Flora and fauna

11.1 A review of readily available site environmental data, including historical mapping and statutory registers does

not identify any former land uses that are potentially contaminative or likely to be prohibitive to the planned development. The contaminative risk at the site is considered to be low.

11.2 It is possible that being so close to the site boundary the historical railway line may have caused some level of

contamination from oils, coolants and diesel to the surrounding area. No such incident has been reported or suggested and therefore the probability of contamination associated with this is considered low.

11.3 No potential contaminative risks have been identified that are likely to be prohibitive on development.
