attending physician. The coverage for the reconstructive surgeryshall only be required if the reconstructive surgery is performedunder the same policy or plan under which the mastectomy wasperformed. This coverage shall be subject to the same deductible, co-insurance, and copayment provisions applicable to the coverage formastectomy surgery.

(2) The provisions of this Subsection shall not apply toindividually underwritten limited benefit and supplemental healthinsurance policies.

Section 2. R.S. 40:2207 is hereby enacted to read as follows:

§2207. Requirements for reconstructive surgery coverage

A. Every preferred provider organization regulated by this Partwhich provides coverage for mastectomy surgery shall providecoverage for reconstruction of the breast on which surgery has beenperformed and surgery and reconstruction of the other breast toproduce a symmetrical appearance. The coverage required by thisSection shall be subject to the reconstructive surgery or surgerieswhich are part of the treatment plan agreed to by the patient and theattending physician. The coverage for the reconstructive surgeryshall only be required if the reconstructive surgery is performedunder the same policy or plan under which the mastectomy wasperformed. This coverage shall be subject to the same deductible, co-insurance, and copayment provisions applicable to the coverage formastectomy surgery.

B. The provisions of this Section shall not apply to individuallyunderwritten limited benefit and supplemental health insurancepolicies.

Section 3. This Act shall apply to any new policy, contract,program, or plan issued on or after January 1, 1998. Any policy,contract, program, or plan in effect prior to January 1, 1998, shallconvert to conform to the provisions of this Act on or before therenewal date thereof but in no event later than January 1, 1998."

A. The Louisiana's Investment For Today's StudentsScholarship Program is hereby created.

B. Subject to the appropriation of funds for this purpose and tothe extent that such funds are provided, a Louisiana's Investment ForToday's Students scholarship, hereinafter referred to as a "LIFTS"scholarship, shall be redeemable by the recipient attending aLouisiana public or independent college or university or publicpostsecondary technical institute for the total cost of tuition of thepublic institution or, if attending an independent institution, for anamount equal to the highest tuition charged at a Louisiana publiccollege or university or the actual tuition of the independentinstitution, whichever is less. Tuition shall not include any feescharged by the college or university or public postsecondary technicalinstitute that are in addition to the basic course enrollment charge orany costs for the recipient to enroll in a developmental or remedialcourse.

C. For the purposes of this Chapter, "independent college oruniversity" means any regionally accredited member institution of theLouisiana Association of Independent Colleges and Universities.

§3042.42. Redeeming a scholarship award; requirements

A. To redeem a LIFTS scholarship, a recipient shall meet thefollowing requirements:

(1) Shall be a bona fide Louisiana resident as determined byrules established by the Louisiana Student Financial AssistanceCommission.

(2) Shall be a graduate of a Louisiana public or state-approvednonpublic high school, or shall have been issued a high schoolequivalency diploma upon satisfactory completion of the GeneralEducational Development Test, or shall have been enrolled in andsuccessfully completed a state-approved home study program.

(3) Except as otherwise provided by R.S. 17:3042.45(B), shallhave a composite score on the 1990 version of the American CollegeTest or an equivalent concordant value on any subsequent version ofsuch test that is not less than nineteen or have a composite score onthe Scholastic Aptitude Test that is the equivalent to a score of notless than nineteen on the American College Test. A student may takethe American College Test or the Scholastic Aptitude Test more thanone time; however, only one score shall be submitted for adetermination of eligibility for a LIFTS scholarship and the scoreshall be submitted to the administering agency by such date as shallbe determined by the agency by rule.

(4) Shall have been accepted to attend a public or independentcollege or university or public postsecondary technical institute in thestate and shall have registered as a full-time student in the college oruniversity or technical institute.

B. A recipient may continue to redeem a scholarship providedhe:

(1) Continues to attend a Louisiana public or independentcollege or university or public postsecondary technical institute as afull-time student.

(2) Maintains as of the end of each academic year or othercomparable period for attendance at the public postsecondarytechnical institute, a cumulative grade point average of at least 3.0 ona 4.0 scale or its equivalent. The maintenance of this required gradepoint average shall be verified by the college or university ortechnical institute attended.

(3) Earns not less than twenty-four hours total credit during thefall, winter, and spring terms of the preceding award year at aninstitution which requires twelve semester hours or eight quarterhours as the minimum for full-time undergraduate status, unlessgranted an exception for cause by the administering agency of theprogram.

§3042.43. Scholarship duration; requirements; limitations

A. For attendance at a public or independent college oruniversity, the scholarship shall cover the cost of tuition, as providedin R.S. 17:3042.41, for full-time attendance for not more than a totalof ten semesters or, if applicable, fifteen quarters within a period ofnot more than seven years from the month following the month inwhich the scholarship recipient graduates from high school, isawarded the general equivalency diploma, or successfully completesthe state-approved home study program. Tuition for attendance atany summer session shall be included in the scholarship; however,each such summer session shall be counted as a full semester orquarter.

B. For the purposes of this Chapter, "full-time attendance" at apublic or independent college or university means registering for notless than twelve semester hours per semester or eight semester hoursper quarter or six semester hours per summer session or the minimumnumber of hours required by the institution for full-time standing ina specified course of study or the required number of hours neededto complete the undergraduate program during that term.

C. For attendance at a public postsecondary technical institute,the scholarship shall cover the cost of tuition, as provided in R.S.17:3042.41, for full-time attendance. The limitation on the durationof the scholarship for attendance at a public postsecondary technicalinstitute and the definition of full-time attendance at such an instituteshall be established by rule of the administering agency, but shall becomparable to the time periods and definitions established by thisChapter for attendance at a public or independent college oruniversity.

§3042.44. Award ceremony

Each LIFTS scholarship recipient shall be suitably recognizedat the award ceremony or school reception provided by R.S. 17:177for presentations of the Legislative Academic Achievement Award.Members of the legislature representing the district in which ascholarship recipient is located shall be invited to attend theceremony or school reception and may present the scholarship award.

§3042.45. Administration

A. The LIFTS scholarship program shall be administered by theLouisiana Student Financial Assistance Commission which shallprovide by rules adopted pursuant to the Administrative ProcedureAct for all matters necessary to implement the provisions of thisChapter.

B. In the event that funds available for the LIFTS scholarshipprogram for any fiscal year are insufficient to award both new andcontinuing scholarships to all eligible persons as provided by thisChapter, the Louisiana Student Financial Assistance Commissionshall increase the minimum test scores specified in R.S.17:3042.42(A)(3) for those persons seeking an initial award of thescholarship to a score that is sufficient to assure that programexpenditures do not exceed funds available for program purposes.

C. All tuition payments for a LIFTS scholarship shall be madeby the commission directly to the institution to which such tuition isdue.

§3042.46. Louisiana's Investment For Today's Students Fund

A.(1) There shall be established in the state treasury theLouisiana's Investment For Today's Students Fund, hereinafterreferred to as the "LIFTS" fund. Out of the funds remaining in theBond Security and Redemption Fund after a sufficient amount isallocated from that fund to pay all obligations secured by the fullfaith and credit of the state which become due and payable within anyfiscal year as required by Article VII, Section 9(B) of theConstitution of Louisiana, the treasurer shall deposit into the LIFTSfund certain revenues as specified in R.S. 27:270(A)(3).

(2) Notwithstanding any other provision of law to the contraryand only in the event that the sales and use tax exemption suspensionas enumerated in R.S. 47:321(E) is continued beyond June 30, 1997,the state treasurer shall, after complying with the provisions ofArticle VII, Section 9(B) of the Constitution of Louisiana, annuallydeposit an amount not to exceed fifteen million dollars derived fromsuch suspended exemptions into the fund.

(3) Monies in the LIFTS fund shall be invested as provided bylaw and all earnings realized in each fiscal year on the investment ofmonies in the fund shall be deposited in and credited to the fund.Except as provided in this Section, all unexpended andunencumbered monies in the LIFTS fund at the end of the fiscal yearshall remain to the credit of the fund.

B. The legislature annually shall appropriate monies from theLIFTS fund exclusively to pay the costs of the scholarship programcreated by this Chapter.

C. If the balance in the LIFTS fund exceeds one billion dollarsat the close of any fiscal year, all monies in excess of one billiondollars shall be credited to the state general fund.

Section 2. R.S. 27:270(A)(3) and (B) are hereby amended andreenacted to read as follows:

§270. Deposit of revenues; expenditures and investments authorized;transfer of revenues to state treasury; corporation operatingaccount; audit of corporation books and records; audits

(3) Daily, the corporation shall transfer to the state treasury fordeposit into the Casino Gaming Proceeds Fund Louisiana'sInvestment For Today's Students Fund as provided by R.S.17:3042.46 the amount of net revenues which the corporationdetermines are surplus to its needs. Net revenues or proceeds shallbe determined by deducting from gross corporation revenues thenecessary expenses incurred by the corporation in the operation andadministration of the casino gaming operations. This shall includethe expenses of the corporation, the expenses resulting from anycontract or contracts entered into for ordinary and customary business

services rendered to the corporation, and the amount required to betransferred to the state treasury pursuant to Paragraph (2) of thisSubsection.

B. A "Casino Gaming Proceeds Fund" is hereby established inthe state treasury. All funds transferred by the corporation to the statetreasury shall first be credited to the Bond Security and RedemptionFund in accordance with Article VII, Section 9(B) of the Constitutionof Louisiana. Thereafter, the state treasurer shall credit to the CasinoGaming Proceeds Fund the amount of net revenues which thecorporation determines are surplus to its needs, as provided for inSubsection A of this Section. No monies shall be allotted orexpended from this fund unless pursuant to an appropriation by thelegislature in accordance with law.

C. The legislative auditor or person designated by him shall beresponsible for an annual financial audit of the books and records ofthe corporation in accordance with R.S. 24:513. The corporationshall reimburse the legislative auditor for the reasonable costs of anyaudits performed by him. All such audit reports shall be filed withthe governor, the president of the Senate, and the speaker of theHouse of Representatives. All gaming operators and licensees andthe corporation shall cooperate with the auditor or his representativesby giving them access to the facilities and records of the corporationfor the purpose of efficient compliance with their respectiveresponsibilities.

Section 3. R.S. 27:270(C) is hereby repealed in its entirety.

Section 4. This Act shall become effective upon signature bythe governor or, if not signed by the governor, upon expiration of thetime for bills to become law without signature by the governor, asprovided in Article III, Section 18 of the Constitution of Louisiana.If vetoed by the governor and subsequently approved by thelegislature, this Act shall become effective on the day following suchapproval."

conduct a careful and deliberate review of the programs andemployees at the former technical institute and provide for anemployee transition that is consistent with the mission of DelgadoCommunity College and that provides opportunities for an employeeto have a role at the community college at least equivalent to hisposition prior to the merger. Such opportunities shall include but notbe limited to providing such additional training or professionaldevelopment, or both, at no cost to the employee as is necessary toprepare the employee to undertake his role at the community collegesubsequent to the transfer.

(3) A student, faculty member, or other employee of thetechnical institute on the date of the merger with Delgado CommunityCollege shall be entitled to and eligible for all benefits provided bylaw, rule, or regulation for students, faculty, and employees,respectively, of other public two-year institutions of higher educationin the University of Louisiana system.

(4) The Division of Occupational Studies at DelgadoCommunity College shall be headed by a dean. The dean of thedivision initially shall be the individual serving as the director of theOrleans Regional Technical Institute on the date of merger withDelgado Community College. All occupational programs at DelgadoCommunity College shall be under the Division of OccupationalStudies.

C. Prior to July 1, 1997, the Board of Trustees for StateColleges and Universities shall conduct an independent audit of theOrleans Regional Technical Institute to establish the assets, liabilities,and fund balances of the institute.

D. Notwithstanding any provision of law to the contrary,Delgado Community College shall give preference in the operationof vending stands, vending machines, and other concessions operatedon its premises and on the premises of the former technical instituteto blind persons pursuant to programs for such persons administeredby the Department of Social Services. Additionally, no other vendingstands, vending machines, or other concessions shall be operated onthe same premises as the vending stands, vending machines, andother concessions given preference by this Subsection. No blindperson shall be required to pay any fee, service charge, or other costto operate any vending stand, vending machine, or other concessionon the premises of Delgado Community College or on the premisesof the former technical institute and no blind person operating sucha vending stand, vending machine, or other concession on suchpremises shall be adversely impacted in any way in the operation ofsuch stand, machine, or concession without reasonable or just cause.

E. Nothing in this Section shall affect in any way any othervocational-technical education facility under the management,control, and supervision of the State Board of Elementary andSecondary Education other than the Orleans Regional TechnicalInstitute.

F. The Board of Trustees for State Colleges and Universitiesshall submit a written report to the House Committee on Educationand the Senate Committee on Education by not later than December31, 1998, on the effects of the transfer of the Orleans RegionalTechnical Institute. The report shall compare the program with theprogram prior to the transfer with particular emphasis on access bystudents to occupational training programs compared to such accessprior to transfer, including statistics relative to student applications,admissions, and admission refusals.

Section 2. For purposes of this Section, "the communitycollege" shall mean Delgado Community College; "the institute" shallmean the Orleans Regional Technical Institute; "the board" shallmean the State Board of Elementary and Secondary Education; and"the trustees" shall mean the Board of Trustees for State Colleges and

Universities. All unfinished business, references in laws anddocuments, employees, property, obligations, and books and recordsof the institute shall be transferred as provided in this Section. Uponthe merger of the institute with the community college, any pendingor unfinished business of the institute and of the board on behalf ofthe institute shall be taken over and be completed by the communitycollege with the same power and authorization as that of the instituteand the trustees shall be the successor in every way to the board forthe purpose of completing such business. Any reference in laws anddocuments to the institute shall be deemed to apply to the communitycollege and all such references to the board in relation to the instituteshall be deemed to apply to the trustees. A legal proceeding to whichthe institute or the board on behalf of the institute is a party andwhich is filed, initiated, or pending before any court on the effectivedate of this Section, and all documents involved in or affected by saidlegal proceeding, shall retain their effectiveness and shall becontinued in the name of the community college or the trustees on itsbehalf. All further legal proceedings and documents in thecontinuation, disposition, and enforcement of said legal proceedingshall be in the name of the community college or the trustees on itsbehalf, and the community college shall be substituted for theinstitute without necessity for amendment of any document. This Actshall not be construed so as to impair the contractual or otherobligations of the institute, of the board on its behalf, or of the stateof Louisiana. All obligations of the institute, or of the board on itsbehalf, shall be the obligations of the community college or thetrustees on its behalf. The community college and the trustees on itsbehalf shall be the successor in every way to the institute and theboard on its behalf, including all of the obligations and debts of theinstitute. All funds heretofore dedicated by or under authority of theconstitution and laws of this state or any of its subdivisions to thepayment of any bonds issued for construction or improvements forany facility under the control of the institute shall continue to becollected and dedicated to the payment of those bonds, unless anduntil other provision is made for the payment of such bonds. In likemanner, all other dedications and allocations of revenues and sourcesof revenues heretofore made shall continue in the same manner, tothe same extent, and for the same purposes as were provided prior tothe enactment of this Act, unless and until other provision is made forthe payment of said bonds. This Act shall not be construed orapplied in any way which will prevent full compliance by the state,or any department, office, or agency thereof, with the requirementsof any Act of the Congress of the United States or any regulationmade thereunder by which federal aid or other federal assistance hasbeen or hereafter is made available. All books, papers, records,money, actions, and other property of every kind, movable andimmovable, real and personal, heretofore possessed, controlled, orused by the institute are hereby transferred to the community college.

Section 3. This Act shall become effective upon signature bythe governor or, if not signed by the governor, upon expiration of thetime for bills to become law without signature by the governor, asprovided in Article III, Section 18 of the Constitution of Louisiana.If vetoed by the governor and subsequently approved by thelegislature, this Act shall become effective on the day following suchapproval."

He shall employ, appoint, remove, assign, and promotesuch personnel as is necessary for the efficient administration of theoffice of management and finance and the performance of its powers,duties, functions, and responsibilities, in accordance with applicablecivil service laws, rules, and regulations, and with policies and rulesof the department, all subject to budgetary control and applicablelaws. If the required degree or aggregate educationalhours do not reflect concentration in the area of accounting sufficientto satisfy the educational standards and regulations prescribed by theboard, the board may, in its discretion, require an applicant tosuccessfully complete a course in higher accountancy prescribed bythe board. However, any applicant who has attained a baccalaureatedegree prior to January 1, 1992, shall not be subject to any of therequirements of this Part, except that such degree must be conferredby a college or university approved by the board and must have suchadequate concentration in the area of accounting as the board mayprescribe. If the required baccalaureate degree received by theapplicant prior to January 1, 1992, does not reflect concentration inthe area of accounting sufficient to satisfy the educational standardsand regulations prescribed by the board, the board may, in itsdiscretion, require an applicant to successfully complete additionalcoursework as prescribed by the board."

§32.9. Partial birth abortion

A.(1) Partial birth abortion is the performance of a procedureon a female by a licensed physician or any other person whereby aliving fetus or infant is partially delivered or removed from thefemale's uterus by vaginal means, and with specific intent to kill ordo great bodily harm is then killed prior to complete delivery orremoval.

(2) As used in this Section, the terms "fetus" and "infant" areused interchangeably to mean the biological offspring of humanparents.

B. It shall not be unlawful for a licensed physician to performa partial birth abortion where the procedure is necessary to save thelife of the mother because her life is endangered by a physicaldisorder, physical illness, or physical injury, and further provided thatno other medical procedure would suffice for that purpose.

C. As used in this Section, the term "person" shall not includethe female upon whom the partial birth abortion is performed, andshe shall not be subject to prosecution hereunder or as accessory tothe offense or as a co-conspirator thereto.

D. Whoever commits the crime of partial birth abortion shall beimprisoned at hard labor for not less than one nor more than ten yearsor fined not less than ten thousand nor more than one hundredthousand dollars.

Section 2. R.S. 40:1299.35.3 is hereby enacted to read asfollows:

§1299.35.3. Partial birth abortion

A. No licensed physician or any other person shall perform apartial birth abortion on a female unless the procedure is necessaryto save the life of the female because her life is endangered by aphysical disorder, physical illness, or physical injury, and furtherprovided that no other medical procedure would suffice for thatpurpose.

B.(1) As used in this Section, partial birth abortion means theintentional performance of a procedure on a female by a licensedphysician or any other person whereby a living fetus or infant ispartially delivered or removed from the female's uterus by vaginalmeans and then killed prior to complete delivery or removal.

(2) As used in this Section, the terms "fetus" and "infant" areused interchangeably to mean the biological offspring of humanparents.

C. There is hereby created a cause of action against the licensedphysician or any other person who performs a partial birth abortionfor civil damages for survival and wrongful death as more fully setforth in Louisiana Civil Code Articles 2315.1 and 2315.2, except thatsuch causes of action shall only be in favor of the natural orbiological father of the aborted infant or fetus, the mother of theaborted infant or fetus or the parents or guardian on behalf of themother of the aborted infant or fetus if the mother was a minor at thetime of the abortion, unless such person's criminal conduct caused thepregnancy, or the person consented to the partial birth abortion.

Section 3. R.S. 40:1299.35.1(1) is hereby amended andreenacted to read as follows:

§1299.35.1. Definitions

As used in R.S. 40:1299.35.0 through 1299.35.18, the followingwords have the following meanings:

(1) "Abortion" means the deliberate termination of a humanpregnancy after fertilization of a female ovum, by any person,including the pregnant woman herself, with an intention other thanto produce a live birth, remove an ectopic pregnancy, or to remove adead unborn child caused by a spontaneous abortion, missedabortion, or inevitable abortion.

Section 4. If any provision or item of this Act or the applicationthereof is held invalid, such invalidity shall not affect otherprovisions, items, or applications of this Act which can be giveneffect without the invalid provisions, items, or applications, and tothis end the provisions of this Act are hereby declared severable.

Section 5. This Act shall become effective upon signature bythe governor or, if not signed by the governor, upon expiration of thetime for bills to become law without signature by the governor, asprovided by Article III, Section 18 of the Constitution of Louisiana.If vetoed by the governor and subsequently approved by thelegislature, this Act shall become effective on the day following suchapproval."
