APPRAISAL CASES

1.Tukda(Miyani) Bauxite Mine,(Lease area: 5.66.56 Ha),Viilage: Tukda(Miyani), Tehsil:Porbandar,Dist: Porbandar.

It is an existing bauxite mine. Project proponent applied for EC on 03-12-2014 and additional information was sought immediately after the presentation in the meeting of SEAC held on 03-12-2014. Subsequently project proponent submitted additional information on 31-03-2015. Project proponent called for presentation for appraisal on 27 May 2015. Proposed rate of mining is 36,800 MTPA. Project proponent has mentioned that for the said project,clearance under the Forest(Conservation) Act, 1980,The Wildlife (Protection) Act 1972 and The CRZ Notification, 1991 is not applicatble. Project proponent has submitted land use plan of mine lease area incorporating preoperational, operational and post operational phases As there is absence of anynala/river, mining process will not affect the natural drainage in the nearby area.Project proponent has submitted approved mining plan including progressive mine closure plan.As per the mine closure plant, it is mentioned that mining will go by semi mechanized opencast menthod. During mining plan period, 14300 Ha additional land will be degraded and 1961 Sq. Meter area will be backfilled upto original ground level.The overburden and waste will be backfilled into the voids and soil will be spread to the backfilled area. The rest part of the degraded land will be used as water reservoir.The fencing around the plantation and working pit will be carried out during third and fourth year of mining plan. There is no permanent surface water body. The water table in the area is 12 m below the ground level. There will be in intersection of ground water due to mining. Drinking water will be brought from Palakheda village. Water consumption will be 2.4 KLPD.Water table will not be encountered during mining.For control of vibration, anti vibration devices will be provided to vibrating tools and equipments to be used by workers during mining.For control of fugitive emission, water tanker with suitable sprinkling system will be deployed along haul roads.The vehicles used for transportion will be covered with tarpaulin and development of green belt /plantation around roads, lease area will be made. Project proponent has proposed periodic medical examination of workers. The project proponent has set out CSR activities which includes supply of free medicines to primary health centres, charitable dispensaries falling under study area, supporting education to the underpriviledged children and meritorious students especially girls by providing financial assistance for books,stationaries etc., conducting vocational training to the students and unemployed youths for upgradation of technical and employment skills, promotion of agro based activites.

After detailed deliberation, the committee unanimously decided to recommend the above project for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non sand mining as approved in 232nd SEAC meeting held on 15th April 2015. .

2. Ashapura Perfoclay Limited Survey no.167, Village: Ler, Near bhujodi, Anjar Bhuj highway,Bhuj, District - Kutch

Project / Activity No.: 2(b)

M/s: Ashapura Perfloclay Limited (herein after Project Proponent – PP) has submitted their application to MoEF, New Delhi for this expansion project.

The proposal is for enhancement of production of bleaching clay (Mineral

beneficiation plant) from 0.072 million TPA to 0.12 million TPA. The throughput will be 0.13 million TPA.

TOR issued by MoEF in the 13th meeting of the Reconstituted Expert Appraisal Committee held on 12th November 2013.

MoEF&CC has transferred this case vide F.no. J-11015/91/2012-IA-II(M) dated 13/02/2015 considering category B project as per amendment to EIA Notification, 2006 vide SO 1599 (E) dated 25.06.2014. As per the said amendment of EIA Notification 2006, Mineral beneficiation {Category 2(b)} project having production < 0.5 MTPA throughput is category ‘B’ project.

Project proponent had requested to MoEF for amendment in ToR which was considered by MoEF in the 19th EAC meeting held during 29-30, 2014 and committee recommended for the amendment in ToRs for the Bleaching clay production from 0.072 million TPA to 0.144 million TPA and Bentonite throughput from 0.094 million TPA to 0.156 million TPA.

Public hearing was carried out by Gujarat Pollution Control Board on 16/12/2014.

EIA Report was submitted on 10/03/2015.

The project falls under Category B of project activity 2(b) as per the schedule of EIA Notification 2006.

Plot area is approx 149733.45 sq.m. Unit has proposed 9145.88 sq. m area for green belt development. Total green belt area after proposed expansion will be 46093.62 sq. m. Estimated cost of proposed expansion is Rs. 60 Crores. Fresh water requirement after proposed expansion will be increased from 650 KL/day to 188 KL/day (8 KL Domestic and 830 KL Industrial) which will be supplied by the GWIL (Gujarat Water Infrastructure Ltd.) Wastewater generation after the expansion will be 688 KL/day [682 KL/day industrial + 6 KL/day domestic]. Industrial effluent (from processing, reactor washing and from utilities) after expansion will be treated in

existing ETP comprises of primary treatment followed by Reverse Osmosis (RO) system. Treated effluent from RO plant (permeate) will be reused in the process and used for gardening. RO reject water will be discharged to the Evaporation Pond for its solar Evaporation.

Requirement of F.O. as a fuel in Rotary Dryer will increase from existing 171 Lit./Hour to 321 Lit./Hour after the expansion. Coal to the tune of 76 MT/Day will be used as a fuel in the Boiler after the expansion. Hazardous waste to be generated after expansion will be ETP waste 220 Kg/Annum, Evaporation residue 1 MT/Annum, Spent Acid 5500 MT/Month, Used oil 100 Liter/Annum and Tar waste 8.5 MT/Annum. ETP waste and evaporation residue will be disposed to the TSDF. Used oil will be reused within plant or sold only to the registered recyclers. Spent acid will be sent to IFFCO unit for use as a raw material for SSP manufacturing. Tar waste will be sent to cement manufacturing company M/s: Sanghi Cement for co-processing of the waste. Gypsum (4500 MT/Month) will be generated as by product and it will be sold to cement/brick industry.

Observations/Discussions:

Technical presentation during the meeting also included the details like general information regarding the project, location of the project & lay out map, Point wise ToR compliance including technical details, CSR, Public hearing action plan etc. The study period considered for EIA was December 2013 & January-February 2014 Air quality monitoring was carried out at eight stations. During the study period concentrations of PM2.5, PM10, SO2, NOx and CO were well within prescribed limit at all locations. Seven ground water and four surface water samples from study area were collected and analyzed. The analytical results of parameters of ground water analysis like chloride, calcium, magnesium, alkalinity and fluoride have exceeded the standards as per the desirable limit but within permissible limits in the absence of alternate source. The result of surface water quality analysis indicates that the surface water quality results are well within the limits. The soil analysis result shows that the soils are Clay in texture and neutral in nature. The nutrient and organic matter contents are medium and the soil is normally fertile. Estimation of emissions from the plant has been made by Industrial Source Complex (ISC3) model developed by USEPA. As per dispersion modeling studies, the resultant ground level concentrations of PM10, PM 2.5, NOx and SO2 at various locations are well within the prescribed NAAQS. During the meeting, issues raised in the public hearing / consultation were discussed in detail. On asking by the committee, PP informed that they have provided adequate height of stack for control of SO2 from Rotary dryer. Committee suggested to provide CEMS (Continuous Emission Monitoring system) for flue gas stacks. During the meeting after detailed discussion it was decided to further appraise the project only after submission of the following:

1. Detailed mass balance and water balance (including reuse-recycle, if any) along with qualitative and quantitative analysis of the each waste stream to be

generated from the process.

2. Characteristics of untreated and treated wastewater. A detailed effluent treat ability study vis-à-vis the adequacy and efficacy of the treatment facilities proposed for the wastewater to be generated along with adequacy and efficacy report. The characteristic on which treatability is based shall also be stated.

3. Treated effluent management plan during monsoon season when utilization of treated effluent for gardening & plantation purpose is not feasible. How it will be ensured that treated effluent/sewage won't flow outside the premises linked with storm water during high rainy days. Detail on provision and capacity of a tank for storage of treated effluent during high rainy days when treated effluent disposal by irrigation is not feasible. Percolation rate of the land available for gardening & plantation.

4. Specific details of (i) Details of the utilities required (ii) Type and quantity of fuel to be used for each utility (iii) Flue gas emission rate, emission from each utility (iv) Air Pollution Control Measures proposed to each of the utility along with its adequacy. Give complete line diagram of APCM. (v) List the sources of fugitive emission along with its quantification and proposed measures to control it.

5. Details regarding provision of CEMS to be provided for flue gas stacks.

6. Compliance of ToR no. 38 i.e. Public hearing points raised and commitment of the project proponent on the same along with time bound action plan.

7. Compliance of ToR no. 41. i.e. Compliance report by the Regional Office of MoEF of earlier EC accorded.

8. Certificate of accreditation issued by the NABET, QCI to the environmental consultant for category 2(b) of EIA Notification 2006.

3.Kanaiya Industries( HADMATIYA BAUXITE MINE), S NO: 121,(Area: 24 Ha),Village: Hadmatiya, Ta: Kalyanpur, Dist: Jamnagar

It is a existing Bauxite mine( 25.1412 Ha) at S NO: 121/P,Vill: Hadmatiya, Ta: Kalyanpur, Dist:Devbhoomi Dwarka.The lease was originally issued in year 1979-80 to M/s Western Abrasive Industries Pvt Limited which ws transferred to M/S Kanaiya Industries in 1997. Project proponent applied for Environmental clearance on 17-06-2013 and TOR was issued on 25-09-2014.Public hearing was conducted on 17-02-2015.Final EIA report was submitted by the project proponent on 24/02/2015.Project proponents were called for presentation on 27-05-2015 for appraisal.

During presentation, project proponent mentioned that it is an existing Bauxite mine with proposed rate of mining of 60,000 MTPA of output and propable life span of mine will be 16-17 years depending upong the mined out mineral quantity.Around 90 persons will be employed. Project proponent mentioned that there are no National

parks, Sanctuary or heritage site wihin 10 Kms radius.Nearest village is Hadmatiya which is located at 500 meter away from the project. Land use plan of mine lease area includes water reservoir, back filled area of mine,statutory barrier of 7.5 meter green belt,village road, haulage road. Final EIA report includes mitigation measures for Soil environment which includes use of small charges for mining and restricting the number, frequency and area of movement of heavy machinery, installation of underground drainage structure helps to reduce sediment loads.Drilling and blasting are not proposed by the project proponent. Face cleaning, excavation, manual sizing,sieving and sorting of Bauxite will be done as part of production. Transportation of the mined out bauxite is proposed to be transported through covered vehicles.It is proposed that regular maintenance of the transport vehicle, avoiding overloading of tippers,trees plantation on both sides of the road to arrest dust. Periodical water sprinkling on the roads will be carried out. . Excavation operation would be suspended during period of very strong winds. Ambient air quality monitoring will be conducted on regular basis.Water requirement at mines is limited to water sprinkling on haul roads, water of plantation and domestic activities. Water consumption for dust suppression will be 6.0 KLPD,Domestic water consumption will be 4.0 KLPD, water consumption for green belt development will be 5 KLPD. Water stored in mined out pits will be used for dust supression and green belt development.The rain water pits shall be developed for adequate holding capacity to store the water for utilizing throughout the year.For domestic purpose, water will be supplied from nearby village through tankers.Ground water is not proposed to be extracted during mining operations.There will not be generation of waste water from mining operation. The activities which contribute noise generation include excavation, loading, sorting/sizing and transportation.Mitigation measures to curb the noise suggested are provision of ear muffs to the workers,peridocal preventive maintenance of the mining and transportation equipments.Mitigation measures to reduce impact on bio diversity include the mined out area will be back filled and reclaimed with dense polyculture plantation with the local species.Water reservoir will be created in abandoned mine pit that will increase the water availability on the plateau.Total six water recharge ponds are proposed( 2 nos X 6250 KL,2NOs X 4000 KL, 2NosX 2250 KL). It is also proposed to make six recharge pits.( 2 Nos.X 75 KL, 2 Nos.X 60 KL and 2 Nos.X 45KL).

Prime factors of occupational health in mine are fugitive dust and noise.It is proposed to provide rewt shelters for mine workers with amenities of water, fans and toilets etc., provision of personal protective equipments, periodical medical examinations, rotation of workers exposed to noisy areas, dust suppression onn haul roads and availability of first aid in mining area.Project proponent has proposed development of green belt with trees to be planted which are Mango, Neem, Teak, Banyan, Karan and casuarinas.

As part of CSR, it is proposed to arrange Samuh Lagna for the villages in vicinity, donating domestic applicances,provision of uniform,education kit,sponsoring sports

and recreation activities in school/colleges,sponsoring construction of toilet blocks in primary schools, assisting construction /renovation of religious places in the region and gaushala etc.

After detailed deliberation, it was decided by the committee to ask the project proponent to submit the following. Upon submission of the details, further decision will be taken up in one of the ujpcoming SEAC meeting.

(1) Satellite image showing exact aerial distance of the nearest house from periphery of the lease area of the project.

(2) Resolution passed by Shree Hadmatiya Gram Panchayat showing no objection of villagers for coming up of this project.

(3) A time bound action plan addressing all the issues which were raised during public hearing shall be submitted including all the commitments assured by the project proponent.

FIRST HEARING CASES

1. M/S Saurashtra Calcine Bauxite & Allied Industries(Area 02.99.47 Ha), S.N.(Private) ,208 & 407 paiky, Vill: Mevasa,Tehsil:Kalyanpur,Dist: Devbhumi Dwarka, Gujarat.

The project proponent has applied for their bauxite mine located at 208 & 407 paiky,Vill: Mevasa,Tehsil: Kalyanpur,Dist: Devbhumi Dwarka The mine lease area is 02.99.47 Ha and proposed rate of mining is 11,340 TPA. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B.

The technical presentation of the project included introduction & backgroung of the company, sitelocation, google image of site & surrounding, site photographs, details of lease, land use of leasearea, reserve, production & life of mine with no blasting, quantity of OB & waste, year wise backfilling and plantation, mining method, electricity & fuel, working depth and ground water, water requirement,important features surrounding the mine, etc.

After detailed deliberation, considering the scale of project, it was categorized as B2 and following additional information was sought for appriasal of the project.

1. Project site specific details such as distance of the project site from the nearest (1) Village (2)Water Body : River / Creek / Nallah / Lake / Pond / Reservoir / Canal (3) National Highway(4) State Highway (5) Railway line (6) Heritage site (7) National Park / Wild Life Sanctuary /Reserve Forest / Protected Forest. A map indicating the aerial distance of the lease area from these entities.

2. Copies of all requisite permissions including permissions from District Collector, Commissioner, Geology & Mining, Indian Bureau of Mines, GPCB etc.

3. Land use plan of the mine lease area should be prepared to encompass pre-operational,operational and post operational phases.

4. Approved mining plan including progressive mine closure plan.

5. Details of peripheral drains to arrest the inflow of surface runoff in the quarry area and garlanddrains for arresting run off from the overburden / reject dumps. Specific measures to ensurethat contaminated runoff from mine terrain will not lead to the rivers / natural drains / adjoining farms, in any case.

6. Technical justification for no requirement of blasting. Notarized undertaking stating that no blasting shall be carried out for entire period of mining.

7. Impact due to fugitive emissions including that because of transportation activities and the mitigation measures thereof need to be elaborated.

8. Dust suppression measures & control measures at worker level & proposed PPE to workers.

9. Detailed overburden and mine rejects management plan.

10. Detailed write up and drawing of mine closure plan. Water reservoirs to be constructed afterclosure of mine should be in proper shape and having proper fencing.

11. Details on back filling system of the exhausted mine. Details on compaction of back filling layer.

12. The reclamation plan, post mine land use and progressive green belt development plan along with year wise financial outlay shall be included.

13. The water requirement for the project along with the source and availability as well as necessary permissions from the competent authority for drawl of groundwater, if any.

14. Details of the water conservation measures proposed to be adopted in the project should be highlighted.

15. Information on site elevation, working depth, ground water table should be provided. Based on actual monitored data, it may clearly be shown whether working will intersect groundwater.

16. Check list of flora and fauna in the study area and impacts of the project on the same along with mitigation measures.

17. Occupational health impact of the project especially during manual operations in the work area and the mitigation measures proposed along with the commitment of the project proponent for implementation of the mitigation measures.

18. Plan for periodic medical examination of the mine workers.

19. Details of the basic amenities, infrastructure facilities, PPEs etc. to be provided to the mine workers.

20. Detailed Mitigation Plan and the Environmental Management Plan with respect to all likely impacts of the project activities. Total capital cost and recurring cost/annum earmarked for environment pollution control measures.

21. An action plan showing list of the activities along with the fund allocation shall be submitted based on the socio-economic profile of the surrounding villages and need base field assessment.

22. Details regarding existing green belt development activity carried out during past years. A detailed future greenbelt development plan including type of species, number of trees, budgetary allocation, etc.

23. Details of fencing, tree plantation done in the existing mined area.

24. Any litigation pending against the project and / or any direction / order passed by any Court of Law against the project, if so, details thereof.

25. (a) Does the company have a well laid down Environment Policy approved by its Board of Directors? If so, it may be detailed. (b). Does the Environment Policy prescribe for standard operating process / procedures to bring into focus any infringement / deviation / violation of the environmental or forest norms / conditions ? If so, it may be detailed.

26. What is the hierarchical system or administrative order of the company to deal with the environmental issues and for ensuring compliance with the EC conditions. Details of this system may be given.

27. Does the company have a system of reporting of non compliances / violations of environmental norms to the Board of Directors of the company and / or shareholders or stakeholders at large? This reporting mechanism should be detailed.

The project shall be appraised after submission of above cited additional details.

The project proponent has applied for their bauxite mine located at 154 paiky,Vill: Mevasa,Tehsil: Kalyanpur,Dist: Devbhumi Dwarka The mine lease area is 01.35.57 Ha and proposed rate of mining is 8125 MTPA. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B.

The technical presentation of the project included introduction & backgroung of the company, sitelocation, google image of site & surrounding, site photographs, details of lease, land use of leasearea, reserve, production & life of mine with no blasting, quantity of OB & waste, year wise backfilling and plantation, mining method, electricity & fuel, working depth and ground water, water requirement,important features surrounding the mine, etc.

The mine lease area is 11.89 Ha and proposed rate of mining is 1,00,000 TPA.The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares and as per Office memorandum of MOEF dated 24 december 2013, project falls under category B.

The technical presentation of the project included introduction & backgroung of the company, site location, google image of site & surrounding, site photographs, details of lease, land use of leasearea, reserve, production & life of mine with no blasting, quantity of OB & waste, year wise backfilling and plantation, mining method, electricity & fuel, working depth and ground water, water requirement,important features surrounding the mine, etc.

After detailed deliberation, considering the scale of project, it was categorized as B2 and following additional information was sought for appriasal of the project.

Proposed production is 50 MTPM of China Clay. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification,2006 and as the lease area is less than 50 Hectares, it falls under category B.

The project proponent represented the project with background of the company, site location and surrounding, site photographs, details of lease, land use of lease area, reserve, production & life of mine, quantity of OB & waste, year wise backfilling and plantation, mining method, electricity & fuel, working depth and ground water, water requirement,important features surrounding the mine, proposed TOR etc. After deliberation on various aspects of the project, following additional TORs were prescribed apart from standard TORs prescribed by MOEF&CC, New Delhi for project category 1(a) for the EIA study to be done considering 10 Km radius from the periphery of the mine lease area. 1. The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification,2006 and as the lease area is greater than 50 Hectares ( i.e. 76.35.00 ha), it falls under category A. The project proponent was advised to approach Expert Appraisal Committee (EAC) at MoEF&CC for getting Environmental Clearance for the proposed project.

The technical presentation of the project included introduction & backgroung of the company, site location, google image of site & surrounding, details of lease, land use of lease area, reserve, production & life of mine with no blasting, quantity of OB & waste, year wise backfilling and plantation, mining method,mining method, electricity & fuel, working depth and ground water, water requirement,important features surrounding the mine, etc.

After detailed deliberation, considering the scale of project, it was categorized as B2 and following additional information was sought for appriasal of the project.

Project site specific details such as distance of the project site from the nearest (1) Village (2)Water Body : River / Creek / Nallah / Lake / Pond / Reservoir / Canal (3) National Highway(4) State Highway (5) Railway line (6) Heritage site (7) National Park / Wild Life Sanctuary /Reserve Forest / Protected Forest. A map indicating the aerial distance of the lease area from these entities.

2. Copies of all requisite permissions including permissions from District Collector, Commissioner, Geology & Mining, Indian Bureau of Mines, GPCB etc.

3. Land use plan of the mine lease area should be prepared to encompass pre-operational,operational and post operational phases.

4. Approved mining plan including progressive mine closure plan.

5. Details of peripheral drains to arrest the inflow of surface runoff in the quarry area and garlanddrains for arresting run off from the overburden / reject dumps. Specific measures to ensurethat contaminated runoff from mine terrain will not lead to the rivers / natural drains / adjoining farms, in any case.

15. Information on site elevation, working depth, ground water table should be provided. Based on actual monitored data, it may clearly be shown whether working will intersect groundwater.

16. Check list of flora and fauna in the study area and impacts of the project on the same along with mitigation measures.

17. Occupational health impact of the project especially during manual operations in the work area and the mitigation measures proposed along with the commitment of the project proponent for implementation of the mitigation measures.

19. Details of the basic amenities, infrastructure facilities, PPEs etc. to be provided to the mine workers.

The mine lease area is 04-00-00 Ha and proposed rate of mining is 8500 MTPA.The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares project falls under category B.

Table Agenda

SEIAA has received requests for various proposals on different matters and the same have been transferred to SEAC Gujarat along with the list of projects (for which the requests were made) vide their letter no.SEIAA/GUJ-GEN/08-2015 dated19/05/2015. The individual request letter was discussed during the meeting and project wise details of request made by the project proponent and decision taken by the committee is described below:

Lava cast Pvt. Ltd., S.No.31,32,33,34, Village:Barola, Ta: Kalol, Dist:Panchmahal: Request for change in the land area of the project.

The Project have been accorded environment clearance from SEIAA, Gujarat vide office letter no. SEIAA/GUJ/EC/3(a)/158/2014 on 08/09/2014 formanufacturing of castings for automotives-65,000 MT/A.

It was mentioned in the letter that as per the original project details submitted at the time of making an application for obtaining EC for the project (i.e. On 04/07/2012), the land area for the proposed project was @ 21,530 sq. m. and the same is being reflected in minutes of the SEAC meeting.

However, due to availability of possession of some of the adjoining plots of the project site in the year 2013 subsequent to the receipt of TOR, total land area for the project had increased from the original of @ 21,530 sq. m. to @ 58,614 sq. m. Intimation in respect of change in land area of the project was submitted to SEAC vide letter dated 10/05/2013. EIA study report for the project mentions information in respect of the changed land area of the project.

They have requested to consider the revised details in respect of land area for the project and issue them the amended Environment Clearance Certificate.

Decision: The matter was discussed during the meeting and it was unanimously decided to recommend the project for granting the amendment in the EC order dated 08/09/2014 with respect to the land area of 58,614 sq.m. replacing the land area of 21,530 sq.m. in the original EC order.

Gunatitay Infrastructure Pvt. Ltd., “Balaji Wind Park”, at S.No. 510,526,529,532, F.P.No.82/2, T.P.S.No.63, Khoraj, Dist:Gandhinagar: request for amending the EC amendment order dated 17/11/2014.

The project was accorded EC vide order no. SEIAA/GUJ/EC/8(a)/101/2011 dated 30/05/2011 which was further amended vide orders no. SEIAA/GUJ/EC/8(a)/207/2011 dated 29/09/2011 and SEIAA/GUJ/EC/8(a)/275/2014 dated 17/11/2014. It was mentioned that while submitting the application for amendment as well as during the presentation in the SEAC meeting held on 13/06/2014 they have mistakenly shown built up area as 64,453.87 m2 and 268 residential units which is actually 64,897.75 m2 and 269 residential units. It was requested to amend the order dated 17/11/2014 for the built up area of 64,897.75 m2 & 269 residential units.

The matter was discussed during the meeting and It was unanimously decided to recommend to amend the EC order dated 17/11/2014 for built up area of 64,897.75 m2 & 269 residential units.

Aphrodite Infra Pvt. Ltd., “77 Avenue”, at F.P.No.77, T.P.S.No.2, Moje:Vesu, Dist:Surat : request for amending the EC order dated 22/02/2013.

The project was accorded EC vide order no. SEIAA/GUJ/EC/8(a)/22/2013 dated 22/02/2013 for the built up area of 26,150 m2 and 68 residential units. Now the project proponent requested to amend the EC order dated 22/02/2013 for built up area of 28,771.24 m2 and 69 residential units. The reason for change in built up area is increase in basement area from 3,818.73 m2 to 6,332.45 m2 and addition of one residential unit. The project proponent has submitted revised project plan showing the built up area of the project as 28,771.24 m2 and basement area of 6332.45 m2.

The matter was discussed and it was unanimously decided to recommend the project for amendment of the Environmental Clearance order dated 22/02/2013 for built up area of 28,771.24 m2 and 69 residential units.

BASF India Ltd., at P.No. 4B, GIDC Dahej, Ta:Vagra, Dist:Bharuch: Request to change the condition of EC order.

The project was accorded EC with the conditions including the following one at sr. no. 29.

“Sulphuric Acid [98%] to be generated as by-product shall be sent to BASF Thane plant for its reuse and in no case it shall be sold outside.”

Now the project proponent requested to change the condition and to allow them to sell the sulphuric acid (98%) to be generated as by product to the end users i.e M/s

The matter was discussed during the meeting and it was decided to recommend the project for amending the EC order dated 12/04/2012 in following respect:

Condition no. 29.

“Sulphuric acid (98%) to be generated as by-product shall be sold only to the actual end users. Records of the same shall be maintained and submitted to SEAC/SEIAA/GPCB on regular basis.”

Essar Oil Township, M/s Vadinar Properties Limited, at S.No.138.139/1,141,143,146-152, 157-160, Vadinar, Dist:Jamnagar: Request for EC validity extension.

The project was accorded EC vide order no. SEIAA/GUJ/EC/8(b)/104/2008 dated 25/09/2008 for Township & Area Development Project with land area of 9,06,506 sq.m. and built up area of 2,19,846 sq.m. It was mentioned in the letter that the project was not completed due to severe financial crunch and now vide letter dated 31/07/2014 they have requested to extend the validity of the EC order dated 25/09/2008 for another 5 years.

The matter was discussed during the meeting and it was unanimously decided to recommend the proposal for extending the validity period of EC.

Tirupati Askruti Greenz, at F.P.No.130,112/1,115,126, T.P.S.No.36 (Chharodi), R.S.No.222,229/A, 232,243/B, Village Chharodi, Ta:Dascroi, Ahmedabad:

The project was considered during the meeting of SEIAA held on 02/09/2014 and it was decided to grant Environmental Clearance with all the conditions recommended by SEAC only after submission of the following:

“A certificate from the structural engineer that the existing structure is capable enough to accommodate the load of additional floors.”

The project proponent vide their letter dated 13/02/2015 submitted a certificate from structural engineer stating that the existing building is capable enough to accommodate the load of additional floors to be added due to proposed expansion.

The committee took note of the above certificate and found it satisfactory.

Shyam Shukan Residency, Block No. 429,430,433,434, O.P.No.1/1+1/2+4+5, F.P.No. 1+ 4+5, Sub Plot No.1 of Draft T.P.S.No.:03, Village: Kudasan, Dist: Gandhinagar,:

The project was taken up in the meeting of SEIAA held on 23/06/2014. During the meeting of SEIAA held on 23/06/2014, it was decided to consider the project only after a criminal case has been filed by the GPCB against the said project as they have constructed the whole building after giving a notarized undertaking and had continued violation.

The committee took note that as per the letter of Regional office Gandhinagar of GPCB, dated 05/03/2015 submitted to SEIAA Gujarat, a legal case has been filed against the violation taken place vide case no. 8395/2014 dated 10/10/2014.

Sai Heights, at B.No.64/2, F.P.No.39, draft T.P.S.No.73, Moje-Utran, Dist:Surat:

The project was taken up in the meeting of SEIAA held on 23/06/2014 and during the meeting held on 23/06/2014 it was decided to grant Environment Clearance only after getting the confirmation from the GPCB that no further civil work has been done at site after the last visit of project site by GPCB officials.

GPCB’s Regional Office Surat vide their letter dated 26/02/2015 submitted a visit report to SEIAA Gujarat.

Based on the visit report of R.O Surat of GPCB, the committee found that the construction work of the project has already been completed, all the residential units are allotted and people are residing in some of the residential units. The committee decided to bring the matter to the notice of SEIAA for the further decision.

Rushivihaar Township, at T..S.No.109 to 113, F.P.No.2, T.P.S.No.19(Parvat Magob), Magob, Ta:Choryasi, Dist:Surat:

The project was taken up in the meeting of SEIAA held on 23/06/2014. During the meeting of SEIAA held on 23/06/2014, after detailed discussion, it was decided to grant Environmental Clearance to the project after verifying whether sewer line existing at about 200 m distance from the project site leading to the STP of the SMC after crossing Kakara Khadi bridge as claimed by the project proponent.

Committee found that as per the letter dated 12/05/2015 from Regional office Surat of GPCB submitted to SEIAA Gujarat, the project is already having underground drainage connection. Further it was also noticed by the committee that as mentioned in the letter, the drainage line of the area crosses the Kakara Khadi and meets to the Magob pumping station which further lead to Dindoli STP.

Based on the above observant it is found that the underground drainage line is available to the project and is crossing the Kakara Khadi bridge as claimed by the project proponent.

Marion Residency, R.S.No.105, F.P.No.93, T.P.S. No. 81(Dumas), Village: Dumas, Ta:Choryasi, Dist:Surat:

The project proponent had applied for obtaining Environmental Clearance and submitted that the project site is 493 m away from bank of river Tapi. Considering that the project site is at a distance of 493 m (i.e >100 m) from the bank of river Tapi, the project was recommended by SEAC vide letter no. EIA-10-2012-1229-E/1248 dated 26/11/2012 and based on the recommendation of SEAC, the SEIAA Gujarat has granted Environmental Clearance to the project vide SEIAA/GUJ/EC/8(a)/383/2012 dated 30/11/2012.

Now as per the Site visit report of Regional Office Surat of GPCB, distance of the project site from HTL of river Tapi is 50 m only and hence construction of the project has been carried out within CRZ area of 100 m distance from the bank of river Tapi receiving saline water.

The case was referred to SEAC by SEIAA and the case was discussed during the meeting. During the course of discussion, it was found that the project proponent has given false information to SEAC during the appraisal of the project and tried to hide the facts about the location of the project site with reference to its distance from the bank of river Tapi. It was decided to recommend the proposal for cancellation of the Environmental Clearance granted vide SEIAA/GUJ/EC/8(a)/383/2012 dated 30/11/2012 in view of submission of false data during the appraisal of the project.

The request letters for the following projects were received at the office of SEAC. The individual request letter was discussed during the meeting and project wise details of request made by the project proponent and decision taken by the committee is described below:

Khyati Realities Limited: Request to re-open the file.

The project proponent had applied for building construction project with plot area of 16,115.55 sq. m. and the proposed built up area of 31,943.59 sq. m. The project was taken up in the SEAC meeting held on 20/07/2013. During the meeting held on 20/07/2013, the committee found that the project location is within 10 Km aerial distance from the Thol bird sanctuary and hence the project proponent is required to submit their application for clearance from Standing Committee of the National Board for Wildlife, before coming for environmental clearance. It was decided to advise the project proponent to apply for wildlife clearance from Standing Committee of the National Board for Wildlife before and to close the file and delist the project proposal from the list of pending applications seeking prior environmental clearance.

Now the project proponent has requested to re-open the file in view of final Notification of GOI on Eco Sensitive Zone of Thol Bird Sanctuary according to which the project site is outside the Notified Eco Sensitive Zone of Thol Bird Sanctuary.

The matter was discussed and It was decided to inform the project proponent to apply afresh and the processing of the application for obtaining EC will be started de novo..

Shahlon Textile Park: Request for withdrawal of the application.

The project proponent applied for getting EC for textile park as the construction area of the project is greater than 20,000 m2. But now the project proponent requested for withdrawal of the application in view of the latest Office Memorandum of MoEF&CC dated 22/12/2014 & 05/03/2015.

The matter was discussed during the meeting. The committee unanimously decided to close the file of the project and drop the project from the list of applications pending with SEAC.

Ocean Colina: Request for withdrawal of the application.

The project proponent applied for getting EC for the building construction project with built up area of 21,638.60 m2. Now they have trimmed down the project and built up area will be 19,992 m2 after revised planning. It was requested to withdraw the application as the provisions of EIA Notification-2006 is not applicable to the project with Built up area less than 20,000 m2.
