Discussion/Possible Action: Resolution Z2017-01-01, 2035 Plan Amendment and Rezoning, John Repinski:

It was moved by Dennis Kay and seconded by Ray Werhand to approve resolution Z2017-01-01,

recommending amendment of the Land Use Plan Map (Low Density Residential to Country Estates) and

rezoning (R-1 to CES-10) of Repinski’s property at 2331 Decorah Road. Voting in favor: 5. Opposed: 0.

Discussion/Possible Action: Resolution Z2017-01-02, 2035 Plan Amendment and Rezoning, August Fechter Jr.

and Sally Lewin:

It was moved by Dennis Kay and seconded by Jerry Carmody to approve resolution Z2-17-01-02,

recommending amendment of the Land Use Plan Map (Country Estates to Rural Density Residential) and

rezoning (CES-10 to CES-5) of Fechter’s property at 5742 CTH M and Lewin’s adjoining property at 808

Discussion re: Current Shed Ordinances, All Zoning Districts:

The current shed ordinances were discussed. Barb Davies said she had asked for this discussion to get some

input from the Plan Commission prior to the start of the 2017 spring building season. Prior years have brought

increasing numbers of permit applications for sheds. The current size of an outbuilding is 800 square feet

maximum in R-1 and R-2 zoning. The Plan Commissioners felt this was an adequate size on a 1-acre lot. An

attached garage can be unlimited in size. Dennis Kay stated that a garage must share an existing wall with the

principal structure to qualify as attached. Davies will ask Tim Schoonenberg about how to add that language to

the ordinances, if it needs to be added. Permitted height of a shed was also discussed. The Commissioners

asked Davies to get some input from Building Inspector Walt Groteleuschen and to check and see if the Towns

Association might have anything.

Reports:

Barb Davies reported that Lee and Jim Merkel have finalized plans on a lot division and will appear at the

February 14 Plan Commission Meeting.

Dennis Kay expressed concern that a proposal to donate land for a Town Park had been presented to the Town

Board rather than the Plan Commission. Discussion followed. Kay said that he would be absent from the

February and March Plan Commission Meetings.

Discussion/Possible Action re: Final Preliminary Review, Land Division and Rezoning, Foursome Management

Inc.:

Foursome Management has submitted its final land division Certified Survey Map. The Public Hearing is

scheduled for March 14, 2017 at 7:15 P.M. as the land division requires a 2035 Plan Amendment and rezoning.

The Plan Commission will consider the amendment and the rezoning at the March 14, 2017 Plan Commission

Meeting.

Discussion/Possible Action re: Architectural Approval, New House, 6740 Jamestown Drive:

It was moved by Scott Schweizer and seconded by Jerry Carmody to approve the house colors and design

submitted for a new residence at 6740 Jamestown Drive. Voting in favor: 4. Opposed: 0.

Discussion/Possible Action re: Response to SEWRPAC Request, Options to Update the Town’s 2035 Plan:

The four options presented by SEWRPAC were discussed. It was moved by Ray Werhand and seconded by

Scott Schweizer to recommend option 2 to the Town Board. Option two is offered at a cost of $1000 to $2500

and includes: work to develop revised population and employment projections; a sample adopting resolution

and ordinance; and an updated land use plan map. Voting in favor: 4. Opposed: 0.

Update re: County Multi-Jurisdictional Comprehensive Plan Update:

Dennis Kay has agreed to serve as the Town’s representative as the County updates its comprehensive plan.

Ray Werhand has agreed to serve as the alternate.

Reports:

Barb Davies reported on a possible upcoming rezoning.

Joe Gonnering reported that the DPW employees have been working in several areas of the Town cutting

brush.

Town Board Supervisors Present: Chairman Joe Gonnering

Plan Commissioners Present: Joan Baumgartner, Jerry Carmody, Ray Werhand

Chairman Gonnering called the Public Hearing to order at 7:15 P.M.

Gonnering read the Notice of Public Hearing called to consider the petition of Foursome Management

Inc. and Outdoor Specialists Inc. to amend the Land Use Plan Map to change the land use designation

under the Town’s 2035 Comprehensive Plan of a 3.820-acre parcel to be created/split from Tax Key T11-

00428-00Y from Recreational to Commercial; and to conform the zoning of two one-acre parcels, T11-

0428-00C and T11-0428-00D, currently partially zoned Commercial, to complete Commercial. A rezoning

of the 3.82-acre parcel to be created from P-1 Park to B-2 Highway Business District; and a rezoning of

the portions of the two 1-acre lots not currently zoned B-2 Highway Business District from P-1 Park to B-

2 Highway Business District has also been requested.

Zoning Administrator Barb Davies explained that the 3.82-acre parcel bordering Highway 33 will be

offered for sale. The two one-acre parcels are currently in use as commercial sites.

Gonnering asked three times for any additional questions or comments.

There were no other questions or comments.

Gonnering closed the Public Hearing at 7:20 P.M.

Discussion/Possible Action re: Certified Survey Map Recommendation – Foursome Management Inc.:

Engineer Burt Naumann has proposed the following corrections: marking of the soil borings on the lot; and

marking the current zoning on the map. The Commissioners agreed to waive the soil borings requirement as

this is a commercial parcel. Davies will forward the zoning requirement to the surveyor. It was moved by Joan

Baumgartner and seconded by Jerry Carmody to recommend approval of the map to the Town Board. Voting

in Favor: 4. Opposed: 0.

Plan.

The map has been submitted to Engineer Burt Naumann for review. It was moved by Scott Schweizer and

seconded by Dennis Kay to recommend approval contingent on the results of Burt Naumann’s review. Voting

in favor: 5. Opposed: 0. Abstain: 1.

Local 2035 Plan Update Procedures, Benjamin McKay, SEWRPAC:

Ben McKay introduced himself to the Commission. The Town’s 2035 Plan was adopted in 2009. State statutes

require an update at least once every 10 years, but what constitutes an “update” is not really defined. McKay

discussed SEWRPAC Options 1 and 2; the Town Board and Plan Commission have expressed interest in Option

2, updating the 2009 map for the 11 amendments passed since 2009. A new map will be prepared,

incorporating those changes. McKay will prepare a contract and submit it to Barb Davies for review.

Reports:

Barb Davies reported several applications for large sheds.

The realtor sign on the northeast corner of Oak & Paradise will be moved this week to comply with the

setback requirements.

Joe Gonnering reported that wood chipping work is almost done.

Ray Werhand asked about the old schoolhouse on Rusco Road – it is in very bad condition.

Dennis Kay reported that the state of Florida actually posts a sign on property that is to be rezoned prior to the

rezoning.

Chairman Gonnering called the Public Hearing to order at 7:20 P.M. Gonnering read the Notice of Public

Hearing called to consider the petition of Kathleen Seiler, Personal Representative of the Estate of Gary

Filo, to rezone a parcel of approximately 1.956 acres located at 1181 Decorah Road from R-1 Single

Family Residential and C-1 Conservancy to R-2 Single-Family Residential. The 1.956 acre parcel is being

created by merging several existing parcels with different zoning classifications.

Davies explained that the rezoning is requested to allow merging of several smaller parcels into one

parcel of approximately 1.956 acres; that parcel will be offered for sale.

Chairman Gonnering asked three times for any questions or comments. There were no questions or

Minutes from Public Hearing #2 – Town of Trenton

Date and Time: May 9, 2017, 7:25 P.M.

Location: Town of Trenton Town Hall, 1071 STH 33 East, West Bend, WI 53095

Town Board Supervisors Present: Jeff Esselmann

Plan Commissioners Present: Joan Baumgartner, Ray Werhand, Jerry Carmody, Scott Schweizer,

Chairman Joe Gonnering, Zoning Administrator Barb Davies.

Chairman Gonnering called the Public Hearing to order at 7:25 P.M.

Gonnering read the Notice of Public Hearing called to consider the petition of Jay and Dawn Koenitzer to

rezone a 4.004 acre parcel quit-claimed to Koenitzers in 2009, and a 3.755 acre parcel to be quit-claimed

to Koenitzers in 2017. Neither parcel creates a buildable site. Neither parcel has Town road access. Both

parcels will be joined to property already owned by Koenitzers. The zoning applied for is: C-1

Conservancy for the 3.755 acre parcel; CES-10 Country Estates for the 3.755 acre parcel. The zoning that

Preliminary land Division Discussion – Robert Schmidt, Wallace Lake Road:

The Plan Commission reviewed the preliminary plan and advised Schmidt to move forward with preparation of a

Certified Survey Map.

Preliminary Land Division Discussion - Bruce Resnick:

Resnick explained his plans to possibly divide his current parcel on CTH Y into two parcels. Resnick added that

Washington County has told him that it will not grant permission for another driveway on CTH Y at that location. Resnick

would need a shared driveway for a certain number of feet from the centerline of CTH Y. Discussion followed. Town

Board approval would be needed for the shared driveway. Resnick was advised to discuss that possibility with the Town

Board.

Reports:

Joe Gonnering reported that the ISO Fire Station report is virtually the same as last year. Dead tree cutting continues

throughout the Town.

Barb Davies reported that the SEWRPAC contract for update of the 2035 Plan has been signed and returned to

SEWRPAC. The results of a survey of shed sizes permitted in neighboring towns were handed out.

access at that point. It was moved by Jerry Carmody and seconded by Scott Schweizer to direct Resnicks to move

forward with preparation of a Certified Survey Map for the land division with the following addition: the map is to

reference the county driveway permit/resulting shared driveway access as being the only access allowed to serve the

Preliminary Land Division Review, Bryant Sengpiel:

Sengpiels have a preliminary agreement to purchase land from a neighbor. The land is contiguous to their property and

would be merged with their current property. The Commissioners directed Sengpiels to proceed with preparation and

Architectural Approval, New House, 6984 Barney Court, Lynn & Suzanne Voeks:

Consideration of revised wording to include addition materials, Section 380-107, (2)(d) and (e):

The Commissioners discussed the wording of the current ordinance sections regarding acceptable materials for

outbuilding construction. Metal sheds are not allowed in many zoning districts. Discussion followed on whether the list

of prohibited materials should be expanded to included canvas, plastic, resin, and others.

Reports:

Barb Davies reported on several Public Hearings expected on August 8, 2017.

Joe Gonnering reported on Trading Post roadwork. It is possible that a cemetery with graves of Civil War veterans is

located in Trenton (in addition to the cemetery on the southeast corner of Wallace Lake Road and Trenton Road).

Progress Update, Washington County Multi-Jurisdictional 2050 Comprehensive Plan Advisory Committee:

Dennis Kay reported on attendance at recent meetings. One section of the final report will be set up just to reference

the changes made to the previous Comprehensive Plan in the 2050 Comprehensive Plan. A copy of the handouts from

the meetings will be on file at the Town Hall. Over 500 recommendations have been received. The goal will be to try to

County population may double within 20-30 years

Low income housing has been discussed, but not housing for older people

Will try to highlight growth expected in certain areas

If a municipality sees a change in use by 2050, it would be good to include that change in the municipality’s

comprehensive plan now

Dennis Kay added the following observations:

The County is looking to have more input in the Towns’ changes

Subdivisions should be consistent with the County plan

The County does not like using the terminology “substantial agreement”

before the August 8, 2017 Plan Commission Meeting. The Hearings begin at 7:15 PM.

Jerry Carmody asked about a recent Town Board agenda item relating to culverts.

Newburg Village President Mike Heili expressed appreciation for the Town’s cooperation in the working out of the use of

the Town’s chipper.

Ray Werhand reported on a good article in the West Bend News on Bob Roden, his daughter, and “Barnyard

Adventures”.

Dennis Kay reported on a suggestion for shed materials to be added to the list of shed topics to be discussed in the

future.

Gonnering noted the receipt of one written comment received from Eugene and Sharon Sterr. Sterrs

asked that their comments be read into and made a part of the Town’s Public Hearing record. Sterrs are

the owners and residents at 1930 Cecelia Drive, Lot 17, immediately adjacent to the east side of Lot 18,

subject of the Public Hearing. Gonnering read Sterrs’ entire letter aloud. Sterrs seek better maintenance

of the lot, pointing out that the lawn care has been lacking; ask for trees to be planted along the

northeast lot line adjacent to their deck; a smaller park sign; a perennial flower bed at the base of the

sign instead of the rocks that are now there; some input into the park equipment that is to be installed;

and a posted display of the park rules.

two lots. The requested R-2 zoning conforms to the zoning specified in the Town’s 2035 Comprehensive

Plan.

Gonnering noted receipt of one letter from Gary and Jackie Wilde, 5875 CTH Y, Town of Trenton. Wildes

oppose the rezoning request, noting that when they purchased their lot in 1984, the Town was very

specific in stating that only one driveway and one home would be allowed on the remaining 18-acre

parcel owned by Eunice Safford and Jeannette Jelovnik. Wildes also question how a lot with lower

wetlands identified on it can be rezoned to R-2 Residential. Wildes note that access onto CTH Y is

dangerous and oppose the proposal for a shared driveway.

Discussion re: Ben McKay, Southeastern Wisconsin Regional Planning Commission, Presentation of Updated Land Use

Plan Maps, Town 2035 Comprehensive Plan, Second Edition of the Town of Trenton Comprehensive Plan 2050:

Ben McKay presented the large-scale comprehensive plan map, updated for the changes made since the comprehensive

plan was originally adopted in April 2009. The Commissioners reviewed the map, noting one parcel that was designated

partially for one use, partially for a second use. The designation will be changed to the same category, Country Estates,

for the entire parcel. Barb Davies will review the proposed map to be sure that all previously adopted changes are

included.

State statutes require public participation in creation and amendment of the Town’s comprehensive plan. When the

Comprehensive Plan for the Town of Trenton 2035 was adopted, several open houses were held prior to a public hearing

and Plan Commission and Board approval. McKay pointed out that the Town Board could choose by resolution how it

planned to address the public participation requirement for minor plan revisions. McKay will forward a template to be

used by the Town Board in identifying whether or not a particular revision will be preceded by an open house, for

example. A public hearing is required. Discussion followed on various aspects shown on the updated map, including

wetlands, floodplain boundaries, and environmental corridors.

Discussion/Possible Action re: Set Public Hearing date for Approving the Updates to the Town Comprehensive Plan:

The Plan Commissioners were in agreement that the Public Hearing should be set for November 14, 2017, prior to the

November Plan Commission meeting. The October date would have placed it before a Town Board Meeting.

Discussion re: Progress Update, Washington County 2050 Comprehensive Plan Advisory Committtee:

Ray Werhand brought in the packet of topics and information from the meeting of August 24, 2017. The next meeting of

the County Plan Advisory Committee is scheduled for October 19, 2017.

Reports:

Barb Davies reported on permit applications. Joe Gonnering reported that Trading Post road should be open

Wednesday for vehicle traffic. Linestriping should be done this week. Gonnering has received a request for a culvert off

CTH M to a farm field.

Questions and comments:

Barb Davies reported that a property owner has made an appointment for the October 10, 2017 Plan Commission

meeting regarding a possible land division.

Ray Werhand said that garbage collection starts earlier than 7:00 AM in his neighborhood; Dennis Kay has noted the

same thing.

Discussion re: Preliminary Development Plans, Property located at 988 Knollwood Road, Michael Wirth:

Michael Wirth introduced himself to the Plan Commissioners. Wirth handed out preliminary drawings for a possible

development of a 64.26-acre parcel located at 988 Knollwood Road. A home, pool, and several outbuildings are

currently located on the parcel. Wirth said that he was exploring the possibility of splitting the 64+ acre parcel into four

or five lots. The plans also incorporate an existing separate 7.25-acre parcel adjoining the 64+ acre parcel. The 7.25-

parcel has been listed for sale previously. Wirth said he was looking for an initial impression from the Plan Commission.

A road built to town standards will be required to access any lots to be created as the existing 64+ acre parcel has only

101 feet of frontage on Knollwood Road. Substantial delineated wetlands exist on the property. There is a minor stream

on the property as well. These factors will complicate a proposed division of the property. No soil test work has been

done on any sections of the property that are not wetlands/lake/stream. Wirth will return to the Plan Commission

meeting of November 14, 2017 with a more detailed proposal.

Discussion re: Permitted Outbuilding/Shed Sizes, Jeff Stockhausen:

Steven Stockhausen introduced himself to the Plan Commissioners. Stockhausen owns a 10-acre lot on S. Oak Road.

Stockhausen said he felt this was a great location with reasonable property taxes, but felt that the permitted size of an

outbuilding was too small at the 1600 square feet allowed by ordinance.

Stockhausen said he was hoping to change the maximum permitted size of an outbuilding to something larger than 1600

square feet. Stockhausen referenced the Town’s current ordinances and pointed out that an attached garage of

unlimited size can be a fire hazard. The ordinances allow limited livestock on 10-acre parcels, but a 1600-square foot

building is not large enough for the livestock and personal storage.

Stockhausen made the following proposals:

Option 1) Proposing 1% of lot square footage as the maximum size of an outbuilding would allow about a 4000- square

foot building on a 10-acre lot

Option 2) The Town of Barton allows a 2.25% cap on the size of an outbuilding, which would allow an even larger

outbuilding

Option 3) Use section d), Town Code of Ordinances, Section 380, Appendix, CES-10: allow an accessory building equal to

the square footage of the dwelling living area

Marcus Gee, owner of a 10-acre lot on CTH I, asked how he could make an attached garage bigger than his house and

have it look good.

Discussion followed. Vice Chairman Schweizer advised Stockhausen that the Plan Commission would not consider a

change in the ordinances to increase the permitted size at this time.

Discussion re: Progress Update, Washington County 2050 Comprehensive Plan Advisory Committtee:

The next meeting of the County Plan Advisory Committee is scheduled for October 19, 2017.

Dennis Kay pointed out that the County has not yet removed the Sand Drive Sanitary District as an existing entity from

the Plan Update. Barb Davies said that she had received a voicemail requesting copies of the dissolution papers.

Attorney Schoonenberg will follow up with Clerk Cindy Komro to get the requested copies to the County.

Reports:

Barb Davies reported that the Public Hearing on the update to the 2050 Comprehensive Plan is scheduled for November

14, 2017 at 7:30 P.M. One agenda appointment for 11/14/17 has been made by a property owner with a parcel on STH

33.

Questions and comments:

Dennis Kay asked about a new barn going up on Rusco between Maple and Oak. Davies will ask Walt Groteleuschen to

check it out – a zoning permit is required.

Chairman Gonnering called the Public Hearing to order at 7:30 P.M. Gonnering read the notice of Public

Hearing called to consider amendment to the Town of Trenton’s Comprehensive Plan (2035 Plan). State

statutes require that the Plan Document be updated at least once every ten years. Only changes already

approved by the Plan Commission and adopted by ordinance by the Town Board are being considered as

amendments and updates to the Town’ Comprehensive Plan.

A draft Comprehensive Plan Map was posted in the meeting room. Zoning Administrator Barb Davies

explained the significance of the map and the incorporated changes.

Chairman Gonnering asked for any questions or comments. Dennis Kay asked why Woodfield Farms, a

private owner of property, has been labeled on the map. Davies will request deletion of that label on the

final map.

Gonnering asked three times for any additional questions or comments. There were no additional

questions or comments. Gonnering closed the Public Hearing at 7:40 P.M.

Discussion re: Report on Accessory Building Sizes Permitted, Towns of Jackson, Barton, Farmington:

Barb Davies sent out a summary of the permitted sizes in residential 10-acre zoning for the three townships.

Jackson and Barton allow application for a larger shed size through a “special use/conditional use” permit. Joe

Gonnering suggested consideration of an allowed size, currently 1600 square feet in CES-10 zoning, and

allowing application for a larger shed through the conditional use permit process. The CUP size could be

capped, for example, at 3,000 square feet or the living area of the home, whichever is less. Lengthy discussion

among the Plan Commissioners followed. The Commissioners asked Barb Davies to contact the three

townships to find out how many oversize buildings there are; how many problems there have been; and how

conditional use permit violations are enforced. Davies will report back at the 12/12/17 Plan Commission

Meeting.

Discussion re: Progress Update, Washington County Multi-Jurisdictional 2050 Plan:

Dennis Kay reported that the group had reviewed inventory. The next meeting will be held in February or

March 2018.

Reports:

Barb Davies reported on a previously presented land division proposal. There may be some changes made to

the current laws on variances.

Joe Gonnering reported that the town trucks are ready for snow. Tree work and cutting of dead trees

continues.

Ray Werhand asked Jeff Esselmann about a couple of County stop sign replacements.

Questions and comments:

John Jansen, 5939 Wausaukee Road, said that he appreciated the careful deliberation of any change on the

permitted size of sheds. Jansens’ zoning is CES10. Val Jansen added that they had checked the surrounding

municipalities before buying in the Town of Trenton.

Discussion re: Preliminary Development Plans, Steve Awve, 1386 STH 33:

Steve Awve explained that he would like to put up a commercial building on the property to house some of the

equipment currently parked there. Awve would like to keep the barn that stands on the southwest side of the

property. Discussion followed on the possibility that the barn is in the road right-of-way, as well as the

possibility of delineated wetlands on the property. Awve expressed frustration with the number of authorities

involved in getting a project approved: Washington County Land Use, the City of West Bend (airport

restrictions), and the Town. Dennis Kay asked Awve to return with some type of drawing(s) or plans for what

he would like to do as far as constructing a building so the Commissioners have something to review. Awve will

return with the requested plans. Awve said he would like to place his building as close to STH 33 as Paradise

Gardens’ recently constructed building is. Barb Davies will ask Walt Groteleuschen about the road setback at

the Paradise Gardens project.

Discussion re: Report on Accessory Building Sizes Permitted:

Barb Davies had mailed out copies of summary information obtained on accessory buildings constructed with

Conditional Use Permits. Many of the bordering municipalities have some type of process for obtaining a

conditional use permit – with negotiated conditions – for a larger building. Lengthy discussion on the topic

followed. Dennis Kay said he felt that people don’t research what is allowed and just assume they can do what

they want. Kay pointed out that the Commission had spent a lot of time on the current ordinance and

suggested leaving it as is. Two Plan Commissioners have been excused from tonight’s meeting. Chairman

Gonnering asked the four commissioners in attendance for individual opinions. Jerry Carmody favors doing

whatever is in the best interest of the Town; Bob Roden would support a CUP process allow a larger building,

capped in size at the living area of home or a maximum square footage to be determined; Joe Gonnering

agreed with Roden; Ray Werhand and Dennis Kay favor staying with the current ordinances. The

Commissioners expressed an interest in hearing the opinions of the two excused commissioners. Discussion

will continue at the 1/9/18 Plan Commission meeting.

Discussion re: Progress Update, Washington County Multi-Jurisdictional 2050 Comprehensive Plan Advisory

Committee:

Dennis Kay reported that the Town Board approved the changes to the Town’s 2035 Plan – now known as the

2050 Plan- in November 2017. The next meeting of the County Committee will be February 22, 2018.

Reports:

Barb Davies reported that there may or may not be a January 2018 meeting depending on agenda items

submitted.

Joe Gonnering reported a telephone call regarding construction of a 6-8 family rental property. The project

would need city sewer and water, so a sanitary district would be needed. Gonnering reported very few deer

kills on Town roads so far this year. Gonnering said he thinks that the cutting of brush and trees in the road

right-of-way has helped increase visibility.
