ello fellow BMHBA members,

February brought us our 39th Annual Home Show. We attracted just under 6,000 people in two days. I want to thank our vendors for participating in the Home Show this year; your time and dedication makes for great event. Next year will be the 40th Annual Home Show - I wonder what our committee will plan for next year?

We have our North Dakota Association of Builders state meeting along with our National Association of Builders Bringing Housing Home events this month. We are very fortunate that our US Senators and US Representative are so willing to meet with us and advocate for the housing industry on Capitol Hill. The meetings will be very important as we ask them to go to battle for the State of North Dakota for such things like Waters of the US, housing finance issues and small business regulations.

The weather is getting warmer and that means spring is right around the corner and that also means the start of the 2016 construction season. I know everyone is ready for spring to get here and bring on summer. Before we can start summer we must take in our Spring Parade of Homes on April 28-May 1 to see what new and exciting things our builders have been working on all winter.

We’re excited to announce that the 39th Home Show welcomed just shy of 6,000 spectators in two days! 2016 was the year of firsts: (1) our first two-day show; (2) our first $50k Saturday; and (3) our first tote sponsor and move-in support.

Friday attendance, which totaled 3,562, was short of the spectacular numbers posted last year with the launch of Free Friday; however, Saturday was up in 2017 by 15% with a count of 2,380. Average

daily attendance was substantially higher in 2016 at 2,971 compared to a five-year average of 2,080.

The 2017 Home Show is scheduled for Feb. 17-18.

Labor is Top Challengefor Builders

TTopping the list of problems builders faced in 2015 and expect to face in 2016 is the Cost/Availability of Labor, an issue for 76% of builders who expect it to increase in 2016 and which has increased in importance the past three years. In 2013, 53% of builders rated labor as a significant problem, followed by 61% in 2014 and 71% in 2015. An expected skilled labor shortage can constrain an improving housing market.

The monthly NAHB/Wells Fargo Housing Market Index often includes a set of “special” questions on a topic of current interest to the housing industry. In January 2016, the special questions asked builders about the problems they faced in 2015 and expect to face in 2016.

The second most significant problem was Cost/Availability of Developed Lots for 59% of builders for 2016. In 2013, the Cost/Availability of Lots was rated significant by 46% of builders who responded to the survey. That share increased to 55% in 2014 and again to 58% for 2015. Both the availability of labor and lots highlight the expected constraints of a recovering housing market.

Federal Environmental Regulations and Policies is expected to remain a significant problem for 51% of builders in 2016. In 2013, the federal environmental regulations and policies was rated a significant problem by 46% of builders, increasing to 53% in 2014 and then 55% in 2015.

Building Material Prices continue to be a problem for builders. In 2013, 68% of builders rated building material prices as a significant problem, but that share decreased to 58% in 2014 and further declined to 42% in 2015. However, 56% of builders responding to the latest survey expect it to be a problem in 2016.

At 55% each, the Concern about the Employment/Economic situation and Impact/Hook-up/Inspection or other Fees are other significant problems expected by a majority of builders in 2016. The Concern about the Employment/Economic situation was a significant problem in 2013 for 60% of reporting builders, the issue dropped in significance to 51% in 2014, and again dropped to 47% in 2015. On the other hand, the Impact/Hook-up/Inspection or other Fees was a problem faced by 46% of builders in 2013, 52% in 2014 and 53% in 2015.

CITY & COUNTY

January 1, 2016 is the start of a new partnership between the City of Lincoln and the Burleigh County Building/Planning/Zoning Department. Burleigh County will be taking over inspections and permitting for the City of Lincoln.

The City of Lincoln will now be a one stop shop for contractors and builders. All building applications will be submitted to the City of Lincoln at their offices on Santee Road. This will include all permits for residential, and commercial building of all types. When the permit application has been reviewed and approved, contractors will be able to pick up the issued permits and documentation at the City of Lincoln City Hall.

Our office will review all building permits sent to us from the City of Lincoln. After our review and pre approval from the City of Lincoln, we will issue the permit and send it to the City of Lincoln for contractor pick up and signature. When you are ready for your first inspection, you just call the Burleigh County Building/Planning/Zoning office at 701-221-3727. It is important to note that Burleigh County will not accept any permit applications for buildings, residential or commercial in our office. All building permit applications must be received by the City of Lincoln.

Plumbing, Mechanical and Septic permits and inspections can be obtained and scheduled through the Burleigh County Building Department by calling 701-221-3727. Electrical permits and inspections will be handled by the State Electrical Board.at 701-202-9390.

It is the City of Lincoln and Burleigh County Building/Planning/Zoning goal to make the transition from the City of Bismarck Building Inspections to Burleigh County Building Department as easy as possible.

Contractors have heard me say this many times over the years, the building code is a set of books of minimum standards, but it allows for many options on how we meet those minimum standards.

There are thousands of great examples of how quality workmanship and materials are being used to meet the intent of the building code. The IRC (International Residential Code) which we have adopted, allows the Building Official to approve alternatives.

R104.11 An alternative material, design or method of construction shall be approved where the building official finds that the proposed design is satisfactory and complies with the intent of the provisions of this code, and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this code.

To sum-up the true intent of the IRC’s nine hundred plus pages into one sentence comes down to this; the intent of the code is to establish minimum requirements to safeguard the public safety, health and general welfare through affordability, structural strength, means of egress, stability, sanitation, light and ventilation, energy conservation and safety to life and property from fire and other hazards attributed to the built environment.

Ok it’s a long sentence but the point I want to make is that as the appointed Building Official

I want quality workmanship . I want to see good materials being used. If you do this you will “generally” meet the intent of the code. Keep in mind, we have our minimum tolerances to meet for life safety provisions and of course wind, structural loads, heights, distances, grades, etc., etc., etc. When I look at the energy code and how these two categories have worked hand in hand to meet compliance it’s truly amazing. Methods and materials have not only inundated new home construction, but look what’s happened to existing homes: adding insulation, replacing windows, high efficient furnaces and water heaters. The energy code is much easier to meet when the industry steps up with the product and the education on installing it the right way.

For home owners thinking of spring projects please consider quality first; it typically last longer and looks better. Find out what the difference is between the highest and lowest price, you have several months yet to do your homework.

On Jan. 19, the North Dakota Department of Commerce – Census Office released its 2016 population projections of the state, regions and counties. In developing their projections, three scenarios (expected migration, high migration and low migration) were presented with each assuming a higher rate of in-migration to the state in the earlier years and a gradual level off in future years.

It should also be noted that these projections are simply an attempt to provide the most likely outcome of population change expected in North Dakota and as such, changing economic conditions can affect the actual population change.

As you can see in the table below, these most recent projections show continued growth for our community in the near and distant future. If you’d like to see the whole report, you can do so http://goo.gl/IctdIj, but these numbers give cause for even more optimism.

And if that’s not enough, this week Job Service released some more great news for Bismarck-Mandan. As of December 2015, all three metro areas in North Dakota reported year-over-year employment gains with Bismarck-Mandan having the highest growth rate at 2.2 percent. Fargo-Moorhead and Grand Forks posted growth rates of 1.0 percent and 0.9 percent, respectively.

January 1, 2016 is the start of another new procedure within the Burleigh County Building/Planning/Zoning Department which will affect the plumbers of Burleigh County. Starting January 1, we will no longer ask for a bid amount when you call for a plumbing inspection.

It has been decided after many months of research and discussion; we will use a permitting system similar to the State Plumbing Board., and have developed a form which is available on our website . All you have to do is download the form, print it, fill it out and fax—701-221-3726 or e-mail [email protected] it to our office. When you are ready for an inspection, just give our office a call and we will schedule the inspection.

NEW POPULATION PROJECTIONS SHOW CONTINUED GROWTH

Summary of Projections (Expected Migration Scenario)

North Dakota Housing Finance Agency (NDHFA) is currently accepting applications for development assistance through the state’s Housing Incentive Fund (HIF).

“NDHFA’s mission is to ensure that everyone in the state has access to housing they can afford,” said Jolene Kline, the agency’s executive director. “The Housing Incentive Fund has proven to be a powerful tool in addressing this need in communities statewide.”

HIF supports the development of multifamily housing for essential service workers and low- and moderate-income households. Approximately $9 million is available; $5 million is set aside for

communities with populations less than 12,500. Rural community populations will be determined using 2010 U.S. Census data.

North Dakota Housing Finance Agency (NDHFA) recognized several of its housing partners as Champions of Affordable Housing during its 25th Statewide Housing Conference.

“The Champion awards recognize and celebrate the work of individuals, non-profit organizations, public agencies, and private sector businesses that make exceptional affordable housing contributions in North Dakota.” said Jolene Kline, NDHFA executive director.

BMHBA members who were honored this year included: Capital Credit Union and Scott Bullinger; and Gate City Bank

NDHFA also recognized real estate agents for the assistance they provided to the agency’s borrowers. BMHBA members Kirstin Wilhelm of Keller Williams Realty and Shirley Thomas of Bianco Realty were honored.

Starion Financial mortgage bankers Kassy Landis and Lindsey Matter were named to the Mortgage Executive Magazine’s Top 1% of Mortgage Originators list for 2015.

Landis, a mortgage banking officer since 2012, is located at the Bismarck branch on N. Washington Street. She joined Starion in 2006 as a teller, advanced to business banking representative in 2007 and became a mortgage underwriter in 2008.

Matter is mortgage banking officer/assistant vice president at the Mandan branch. This is the fourth consecutive year she has been named to the Top 1% list. Matter began her career with Starion Financial in 2005 as a

teller, became a personal banker in 2006, moved into mortgage banking in 2009 and was promoted to AVP in 2015.

Mortgage Executive Magazine annually compiles a comprehensive list of the nation’s top one percent of mortgage originators in the United States. The minimum eligibility criteria are a total personal production of at least $30 million in 2015.

PRESENTATIONS OF THE BURLEIGHGROWTH2015 FINAL

REPORT SCHEDULED The Bismarck-Mandan

Metropolitan Planning Organization (MPO) and Burleigh County, in partnership with their consultant KLJ, have conducted the BurleighGrowth2015 Study, a Future Land Use Plan for select townships in the County. The purpose of the study was to establish preferred types and intensity of land use for areas outside of the cities of Bismarck and Lincoln, and their extraterritorial zoning area. Plan documents are intended to be used by the MPO and its member jurisdictions for planning activities and jurisdictional development review.

The study’s Final Report will be presented to Burleigh County’s governing bodies for final approval/ acceptance. All meetings will occur in the Tom Baker Meeting Room, City/County Office Building, 221 N. 5th Street, Bismarck, ND.

The Burleigh County Planning & Zoning Commission meeting will begin at 5:15 p.m. on March 9 and the Burleigh County Commission will meet on March 21 beginning at 5 p.m.

The 2016 Board of Directors participated in a board orientation and strategic planning retreat in February. Hosted by NAHB’s Affiliate Services Director Donna Oliver, the training included best practices for board operations and a strategic planning session.

The Board broke the 2016 year into four areas of focus including: Membership, Government Affairs, Communications and Operations.

NAHB’s long-standing efforts to make housing a top priority in the presidential election season gained momentum in February when former Secretary of State Hillary Clinton became the first major-party 2016 presidential candidate to address housing issues in a broad policy outline. The economic revitalization agenda she set forth included a number of housing policy goals supported by NAHB.

In an effort to shape the national discussion in this critical election year, NAHB’s government affairs staff and volunteer leaders have met with the policy teams of all the Democratic and Republican candidates seeking the presidency. We have delivered policy briefs on a range of issues important to the residential construction industry, including housing finance, regulatory reform, immigration and workforce issues, and tax reform.

The campaigns have generally been responsive to NAHB’s policy recommendations, but until now none had broadly addressed housing-specific issues. Following the release of

Clinton’s economic revitalization plan other candidates have told NAHB that they also plan to address housing in the near future.

NAHB Does Not Endorse Presidential Candidates

It should be stated upfront that NAHB support for a candidate’s policy proposals should not be viewed as an endorsement of that candidate. The association is non-partisan; its bylaws specifically prohibit endorsing candidates so that the association can work with all elected leaders, regardless of party, on behalf of the housing industry.

In an important sign that NAHB is making progress in moving housing to the forefront, Clinton’s housing proposals draw heavily from specific recommendations that we proposed in meetings with her policy advisers. These include ideas for removing barriers to sustainable homeownership by improving credit availability for consumers. The Clinton plan proposes a match for downpayment savings and the use of a new generation of credit scoring methods. It also recognizes the value of homeownership counseling, which NAHB strongly supports.

Other ideas in the Clinton economic revitalization agenda that NAHB supports include proposals to bolster the supply of affordable rental housing by increasing the supply of Low-Income Housing Tax Credits and by removing local barriers to such housing production. The plan also highlighted the importance of job training and apprenticeships as a path to economic opportunity, which the housing sector has a

tremendous capacity to provide.

While NAHB is pleased to see Clinton acknowledge the significant role that housing plays in our local communities and economy, we will continue to work with her campaign on issues we disagree on. For example, NAHB believes the plan’s emphasis on connecting housing support to economic opportunity in high-poverty communities may limit the economic benefits of the proposals.

NAHB continues to strongly encourage all of the presidential candidates to look closely at our policy recommendations and to present housing proposals that will increase homeownership and rental housing opportunities for all Americans while boosting job and economic growth. NAHB will also keep the candidates “feet to the fire” by pushing for more than just talk and calling on them to implement any meaningful housing proposals put forth.

NAHB MOVES NEEDLE ON LEAD PAINT TRAININGRemodelers who are certified by the Environmental

Protection Agency (EPA) to work on homes that may contain lead paint under the Lead: Renovation, Repair and Painting (RRP) rule now have the option to complete refresher training online, according to an EPA announcement. However, EPA recertifications obtained via an online refresher course will be valid for only three years, versus five years for hands-on training courses, and can only be exercised every other recertification cycle.

“As a longtime advocate for a simplified recertification process, NAHB Remodelers appreciates that the EPA’s changes provide some flexibility, but the limited and convoluted parameters of the online training option are unnecessarily complicated and could affect the number of renovators who opt to become recertified,” said NAHB Remodelers Chair Tim Shigley, CGR, CAPS, CGP, GMB, GMR,

a remodeler from Wichita, Kan. “Whether they choose to refresh their training online or in person, with the March 31 recertification deadline looming for over 100,000 remodelers, and thousands more later in 2016 and 2017, remodelers are left with precious little time to meet their recertification obligations.”

Additionally, certified renovators who were grandfathered in under a HUD or EPA lead-based paint training course before the RRP rule was adopted must attend a refresher course with a hands-on component. The rule also made several streamlining and clarifying changes to RRP provisions that apply to training providers. The EPA’s changes only apply to those states where EPA administers the program; the 14 states that administer their own programs will have to take legislative or regulatory action to adopt the online refresher course option.

the construction industry, half of which work in residential construction. Each year, roughly 38,000 construction injuries are reported, with some 21,000 involving days away from work. Many OSHA standards apply to residential construction for the prevention of possible fatalities.

8 SMALL BUSINESS TAX PREPARATION MISTAKES TO AVOID

Tax time brings with it a sense of urgency and pressure, and mistakes inevitably follow. Tax deductions go unclaimed, paper trails go awry and costly surprises can result.

Here are eight of the most common tax preparation mistakes that small businesses make, plus some tips for mitigating them.

Start a business last year? Write off the expenses

New business owners can write off the expense they incurred before technically opening their doors for business. Don’t overlook this important deduction.

Car deductions

A lot of confusion exists about what constitutes a legitimate business driving deduction. SBA guest blogger Barbara Weltman clears the air in her blog “Driving for Business.” What is business driving? “When you travel from your office to see a customer or vendor, this constitutes business driving. Whether travel from your home to another location is a business trip depends. If you commute from home to your office (and back), this is a nondeductible personal expense. If, however, you work from a home office for which you claim a tax deduction, then travel from home to any business location (and back) is treated as deductible business driving.”

The mileage deduction for tax year 2015 is 57.5 cents per mile.

Another big mistake that business owners make is to limit their deductions to mileage. If you can prove that they are business expenses, you can also deduct other costs including gas

and oil, tires, insurance, lease payments, tolls and parking fees.

Don’t forget the small stuff

Petty cash purchases, magazine subscriptions, educational classes and more. These “small” expenses can add up quickly. Make sure you track all your expenses and check with your tax advisor about what you can and can’t deduct.

Don’t exaggerate your deductions

Your accountant can ensure you don’t overdo or exaggerate your deductions – something that can raise the possibility of an IRS audit. For example, many small business owners mistakenly assume that they can deduct 100% of meal costs while traveling or client gifts. They are actually only partly deductible.

Likewise, if your expenses are a lot higher this year than last or not considered typical for your industry or business type, the IRS may get inquisitive.

It’s not all about the IRS

The IRS is only one piece of the tax pie; don’t forget about your other tax obligations – property, payroll, local taxes, excise tax, self-employment taxes, etc. These can all come back to bite you if you aren’t compliant in a timely manner.

Separate personal and business

Intermingling your personal and business bank accounts is a big cause of confusion around tax time, making it hard to track income and expenses. Furthermore, if you operate a home business, make sure you keep

that space distinct and separate from the rest of the home so that you can correctly claim the home office deduction.

Avoid payroll mistakes

Payroll tax compliance is something that many small business owners struggle with. The financial consequences of getting it wrong aren’t pleasant either. Statistics show that approximately 40 percent of small businesses incur an average of $845 per year in IRS penalties.

Keep your records up-to-date

This is a common problem for small businesses and often leads to missed opportunities for reducing your taxable income for the year. Make sure your expenses are reconciled, tracked and supported with receipts (the IRS requires it). Spend time each week to review your accounts – receivable, payable, credit card transactions, cash flow, etc. if your business is growing, consider accounting software (which synchronizes all your financial transactions and activities in one centralized dashboard) or retain the services of an accountant.

HOW SEASONAL WORKERS AFFECTYOUR ALE STATUS

When determining if your organization is an applicable large employer – which is also known as an ALE – you must measure your workforce by counting all your employees. However, there is an exception for seasonal workers.

If an employer’s workforce exceeds 50 full-time employees for 120 days or fewer during a calendar year, and the employees in excess of 50 who were employed during that period of no more than 120 days were seasonal workers, the employer is not considered an applicable large employer.

A seasonal worker for this purpose is an

employee who performs labor or services on a seasonal basis. For example, retail workers employed exclusively during holiday seasons are seasonal workers.

The terms seasonal worker and seasonal employee are both used in the employer shared responsibility provisions, but in two different contexts. Only the term seasonal worker is relevant for determining whether an employer is an applicable large employer subject to the employer shared responsibility provisions. For this purpose, employers may apply a reasonable, good faith interpretation of the term “seasonal worker.”

The U.S. Department of Labor (DOL) recently issued an Administrator’s Interpretation (AI) to help business owners better understand the concept of joint employment under the Fair Labor Standards Act and the Migrant and Seasonal Agricultural Worker Protection Act.

As workplaces and work arrangements continue to evolve, the traditional relationship of one employer employing one employee is less widespread. DOL specifically cited the construction industry as one where

a worker jointly employed by two or more employers has become more common.

foundation of American Family Life. Housing and construction helps drive the economy for our local areas as well as for the state and nation. Without a healthy housing market our economy will not flourish. The issues that are important to home builders, remodelers and others in our industry are many of the same issues that are important to a thriving economy. We need for our Local, State, and National Lawmakers to work on the areas that are affecting the housing industry. One of these issues is burdensome regulations. We must reduce burdensome regulations at all levels of government. The list of federal, state and local agencies that regulate the housing industry is long. NAHB shows that regulations at all levels of government account for 25% of the cost of a new single-family home. Think about that and how it affects affordable housing. In 2015 more than 81,000 pages of regulations appeared in the Federal Register, which is the highest count ever, and as small businesses like home builders the effects are disproportionate on us and that is the highest count ever. U.S. Small Business Administration found that firms with 20 or fewer employees like home builders pay 40% more in compliance costs per employee than firms with more than 500 workers. By reducing excessive regulatory burdens on small business like home builders and remodelers, it will promote economic growth and job creation while reducing the costs for consumers. Arnold

The BMHBA has been busy following ordinance updates in Bismarck and Mandan, Burleigh and Morton Counties. All are reviewing and updating dated codes. Eyes are currently on permit cost changes and development standards.

A housing analysis conducted by Bismarck and Mandan outlines a need for an additional 7,786 owner-occupied homes by 2030. The HBA is working on a task force to explore implementation of the study’s recommendations.

Members elected a new Builder board member at the Fall GMM on Nov. 24 to fill Past President Vance Vetter’s seat. The 2016 board of directors will be sworn in at the Annual Banquet on Jan. 14.

The 39th Annual Home Show took place Feb. 19-20. The sold-out event featured more than 420 booths and 223 vendors.

The BMHBA participated in the BMDA’s Job Shadow Week in February hosting a University of Mary sophomore.

Executive Officer Dot Frank attended the NDHFA’s Statewide Housing Conference and is working to bring a featured speaker to the BMHBA.

Two BMHBA members are featured in recent editions of US Builders Review – Miller Insulation and Advanced Mechanical.

The BMHBA launched a new logo and website. Check it out at bmhba.com.

Home show plans are continuing to move forward. We currently have 75% of our available space filled. It is coming up fast and we are very excited about it!

For our membership drive this year we are doing a fun contest. We have six different teams recruiting members and the team with the most points at the end wins. The winning team will get a steak dinner while the losing team gets beans! Our membership drive will be going on until the end of April.

We are excited to see our members at our monthly membership meeting, where we have a speaker for the USDA grant/loan program.

Over 130 members and city officials attended the New Year Celebration & City Night Jan. 28. The HBA welcomed special guest North Dakota Secretary of State Al Jaeger and mayors from Dilworth, Fargo, Moorhead and West Fargo with the addition of a councilperson from Horace this year.

28. Over 300 exhibitors participated. This year the HBA of F-M introduced new features like local speakers, mobile application, kids treasure hunt, an expanded Lego homebuilding competition and a beer walk.

The City of Grand Forks offered a stormwater pollution prevention plan workshop for residential and commercial contractors and developers.

Structural Materials is hosting Builders after Hours on March 22nd. They moved to a new location and are anxious to show their new store to our members.

Our Home Design & Garden Show is scheduled for April 1, 2 and 3 at the Alerus Center. We are anticipating another great show this year.
