IN CASE OF A RAID

The Department of Homeland Security has announced raids targeting recent arrivals from Central America but we are all at risk. It is very important for all

immigrants to know their rights in case of a raid.

1) DO NOT OPEN THE DOOR ICE cannot come in without a signed warrant. Tell them to pass the warrant under the door. If your name is not on the warrant you do not have to open.

2) REMAIN SILENT ICE can use anything you say against you in your immigration case so claim your right to remain silent. Do not answer any questions other than your real name and do not lie.

3) DO NOT SIGN Don’t sign anything ICE gives you. You might be signing your voluntary deportation. Demand to speak with your attorney.

4) REPORT THE RAID TO OCAD AT 1-855-435-7693 Take pictures, video, and notes: badge number, number of agents, vehicles and exactly what happened.

5) FIGHT BACK! Get a trustworthy attorney & join an organization to explore all options to fight your case.

ICE Raids: How to Protect Your FamilyIs my family at risk?

The U.S. government has begun arresting and detaining men, women, and children who fl ed to the United States from violence and persecution in Central America, and were subsequently ordered deported.

Many people may have deportation orders without knowing it. In many cases, the U.S. government failed to provide proper notice of immigration court hearings. If you were scheduled for a deportation hearing and you did not attend, the judge may have entered a deportation order in your absence.

How do I know if I have a deportation order?

Call 1-800-898-7180 and enter your nine-digit A-number (numbers only). A recorded message will tell you whether you have been ordered deported.

If you have a deportation order, contact an attorney immediately. Call the National Immigrant Justice Center (NIJC) at (312) 660-1370 or email immigrantlegaldefense@heartlandalliance.org to make an appointment in Chicago or Indiana. The Immigration Advocates Network maintains a national list of legal service providers at www.immigrationadvocates.org/nonprofi t/legaldirectory.

I called the 800-number and I’m still not sure.

If you were stopped by immigration when you entered the United States, or approached an offi cer to ask for help or asylum, talk to an attorney as soon as possible.

I know I have a court hearing scheduled. What do I do?

Attend the hearing and fi nd an attorney to accompany you. If you do not attend, the judge may order your deportation in your absence.

Visit NIJC’s help desk at the Chicago Immigration Court on Tuesdays and Wednesdays for information on immigration benefi ts and referrals to immigration attorneys.

I know I have a deportation order. What do I do?1. If you have a deportation order, create a safety plan for child care, speak to an attorney, and establish a contact who will advise your attorney if you are detained. To locate a detained family member, use the detainer locater at www.ice.gov/locator. Contact NIJC by phone at 312-660-1370 or email immigrantlegaldefense@heartlandalliance.org for assistance.

2. If immigration comes to your home, ask to see a warrant. ICE may not enter your home without a warrant signed by a judge. You do not need to open the door. Ask for the warrant to be slipped under the door. If immigration has a warrant that allows them to search your property, you must let them in, but you do not have to speak.

3. If you are arrested, ask to speak to an attorney. Do not sign any documents or answer any questions without an attorney. If you fear returning to your home country, express that fear to an immigration offi cer.

4. If you are detained, ask to participate in a legal orientation program and for a list of phone numbers to contact attorneys. Call the NIJC Detention Project on Tuesday from 11:00 a.m. to 2:00 p.m. Central time. Detained immigrants may call collect at (312) 263-0901; all others should call (312) 660-1370.
