6. Bid documents can be seen at and downloaded from the website www.jktender.gov.in
bid documents contain qualifying criteria for bidder, specifications, bill of quantities,
conditions and other details.
7. The site for the work as well as funds are available.
8. Work approved in the Works Programme for the 2017-18 and Funds are available.
9. Bids must be accompanied by bid security (EMD) and cost of tender documents as
specified in col. 5&6 of the table payable at Jammu in favour of CP & AO, PDC
Kishtwar. Bid security will have to be in any one of the forms as specified in the
bidding documents and shall have to be valid for at least One year or more after last
date of receipt of bid. The cost of downloaded tender documents in form of DD shall be
in separate envelop with cover marking cost of document.
10. The original instruments in respect of cost of documents, EMD and relevant
technical/Financial bid documents etc must be delivered to the Executive Engineer
CI&D Division Kishtwar on or before 13-10-2017 up to 1500 hrs if the office happens
to be closed on the date of receipt as specified, will be received on the next working
day at the same time and venue.
11. Financial Bids of technically responsive bidders will be opened on 18-10-2017 at
1200 hrs in the office of Executive Engineer CI&D Division Kishtwar and the date of
opening of financial bid shall be communicated to the bidders. If the office happens to
be closed on the date of opening of the bids as specified, the bids will be opened on
next working day or any other convenient day at the same time and venue.
12. The bid for the work shall remain open for acceptance for a period of 120 days
from the date of opening of bids if any bidder / tenderer with draws his bid/tender
before the said period or makes any modifications in the terms and conditions of the
bid, the said earnest money shall stand forfeited.
13. Other details can be seen in the bidding documents.
14. Bidder having an experience of successfully completing civil works during last 07
years having achieved progress in either of the following:-
A) Completed 03 no. civil works each costing not less than the amount equal to 40% of advertized cost. or
B) Completed 02 no. civil works each costing not less than the amount equal to 50% of advertized cost or
C) Completed 01 no. civil works costing not less than the amount equal to 80% of advertized cost.

15. The contractor/firm shall have to execute agreement with department within seven
days from issuance of allotment order. Failure of contractor to execute the agreement
shall not however prevent the contract being enforced against him.
16. All conditions laid down in PWD Form 25 (Double) and special conditions
mentioned herein along with instructions shall apply and govern the contract. These
will finally form part of agreement for the work and bind the tenderers.
17. In case of work under tender, tenderers must quote item rate only, in the Rate List
/ BOQ.
18. Any item of work needed to be executed at site of work (other than advertised/
allotted) and not covered under SSR 2012 shall be analyzed on prevalent market rates
in the vicinity approved by the Chief Engineer and paid accordingly.
19. Any item required/ needed to be executed at site of work (other than beyond
advertised / allotted BOQ) but covered under SSR-2012 shall be paid on the said items
with overall average appreciation / depreciation quoted by the contractor. Items which
are not covered by SSR 2012, shall be got executed and paid as per the analysis of
rates with prevalent escalation on similar nature of works assessed by employer and
accepted by contractor prior to execution of such item
20. The quantities of various items of the work given in the tender document may
increase or decrease up to 25%. The above specified variation in quantities of items of
work to be executed cannot and shall not form basis of dispute regarding the rates to
be paid for or giving rise to any claim for Compensation on any account. Such variation
shall also form part of contract and not invalidate the contract.
21. The Engineer in-charge may without invalidating the contract and without notice to
the contractor, require the contractor to perform extra items or quantities of work not
included in the Schedule of quantities and rates make changes in proposals/
specifications within the general scope of contract or otherwise vary the work. The
contractor shall perform changes and variations in the manner and to the extent
specified in written orders approved by the Engineer-in-charge. Such items of work
shall be paid as per the tendered rate / rates as envisaged above.
22. All taxes duties/levies in vogue during the contract period shall be deducted at
source from the bills of the contractor / firm and any increase or decrease shall be
affected accordingly in the bill. No variation of any sort shall be paid whatsoever.
23. Royalty on account of stone, sand bajri etc utilized on the work shall be paid by
the contractor himself at his own cost to the concerned Corporation or the concerned
lessees as the case may be. All other taxes, duties, municipal taxes toll taxes etc
relevant to contract shall be paid by contractor himself and nothing extra shall be paid.
24. All Cement works depending on the discretion of Engineer in charge of the works
shall be tested in the Government Laboratory for Compressive strength test (cube
testing). The contractor has to make arrangement for such tests and the cost of such
tests is to be borne by him. Under specification works shall not be accepted and
contractor has to rectify such works at his cost. If contractor fails to rectify such works,
the same will be rectified by the department at the risk and cost of Contractor.
25. The Key construction material/ fittings etc to be used for construction shall be of
Standard make and as per the make / specifications given in the enclosed Statement.
26. Any loss or damage to work due to natural calamity or any other reason during
execution of work shall be borne by the contractor.
27. If after opening of tenders, it is found that the rates quoted by the lowest tenderer
are less by 15% than the advertised amount, the contractor shall have to provide
additional security of 05% (Five percent only) of the Estimated/Advertized cost in
shape of the FDR/CDR pledged to CP & AO, PDC Kishtwar at the time of allotment of
work which shall be released after successful completion of the work. (Completion
certificate to be issued by the Executive Engineer concerned)
28. Key construction material to be used and arranged by the contractor for execution
of work shall be given below:-
i. CEMENT: Cement of standard quality branded ISO; JK Cements Ambuja, ACC,
Ultratech, and Ultratech Shri or equivalent.
ii. STEEL OF ALL SORTS: Fe-415 Conforming to IS: 1786-1985 (Latest Version) of SAIL,
TISCO, RASHTRIYA ISPAT, TMT or any other ISI Brand.
29. 10% amount of the running bills due to contractor during execution of work shall be
retained as retention money and shall be released only after satisfactory completion of
work and removal of defects if any and after conducting necessary repairs to the
satisfaction of Engineer in charge and not earlier than 06 months from the date of
satisfactory completion of work. In case of failure on part of contractor to remove
defects or conduct repairs within stipulated period, the same shall be got removed or
rectified by the department and its cost shall be recovered from retention money /
performance guarantee.
30. Any typographical error in respect of nomenclature/rates, the same shall be
corrected and paid as per S.S.R 2012 with contractors quoted
appreciation/depreciation.
31. In case of firm / contractor fails to start the work within the stipulated time, a registered notice shall be sent through special messenger to the firm / contractor or notice through e-mail for non-start of the work that amounts to the breach of the contract and will be sufficient to windup or cancel his contract and CDR will be forfeited without any information
32. Tenderers should study drawing, specifications and local conditions of work at site.
It will be presumed that the tenderers have visited the site of work and tenders are
based on full knowledge of working conditions prevailing at site, availability of material,
water, electricity, labour, transportation facilities, probable site for labour camp and
store go downs and all factors involved in execution of work.
33. If the successful tenderer/ contractor do not execute any item of work felt
necessary at site, the same shall be executed by the department on the risk and cost
of the contractor/ firm. The amount of the work shall be deducted from 10% deposit
deducted from the bills by the Corporation.
34. The earnest money shall be forfeited without prejudice to the right and remedies
available to the corporation in the event of tenderer failing to keep his tender valid and
open for acceptance for and during the period of 120 days reckoned from the date of
opening of tenders and or to execute a formal instrument of agreement governing the
contract or to furnish the requisite additional in case of below quoting contract
performance guarantee equivalent to 5% of value of work under award.
35. The tenderers are required to state their address fully including their e-mail id and
correctly in their tenders. All notices, communications and references deemed as
having been delivered within seven days from the date of these notices are sent by
India Post or through Courier Services or e-mail by the department. Receipts issued by
India Post/Courier Services shall be deemed as sufficient proof for due dispatch of all
such communications.
36. The Engineer-in-charge may from time to time, by directions in writing and without
in any way invalidating the contract, order the contractor to suspend the work or any
part thereof at such time or times and for such reasons as he may consider necessary
and contractor shall not after such directions to suspend the work or any part thereof,
proceed and be entitled to any claim for compensation on this account.
37. In event of such suspension, the Chief Engineer may under the provisions of the
contract extend the time of completion of the work or part thereof, by such period as he
