Vereinbarung zur Weitergabe von lebendem Pflanzenmaterial durch

den Botanischen Garten der Universität Düsseldorf(1)

Seit Inkrafttreten des Übereinkommens über die Biologische Vielfalt( CBD, Rio de Janeiro, 1992 ) ergibt sich für Botanische Gärten undvergleichbare Einrichtungen, besonders im Zusammenhang mit demAustausch von pflanzlichem Material, die Notwendigkeit zur Beachtunginsbesondere des Artikels 15 der CBD (Zugang zu genetischenRessourcen).Der Garten ist bestrebt, die Erhaltung, Nachhaltigkeit der Nutzung undErforschung der Biologischen Vielfalt zu fördern. Er erwartet deshalb vonseinen Partnern bei der Aufnahme, Bewahrung und Weitergabe vonpflanzlichem Material, das sie stets im Geiste der CBD und desÜbereinkommens über den internationalen Handel mit gefährdeten Arten(CITES) sowie unter Beachtung aller relevanten Konventionen undGesetze zum Schutz der Biologischen Vielfalt handeln.Vor diesem Hintergrund wird nur solchen Personen und InstitutionenPflanzenmaterial aus der Sammlung des Gartens ausgehändigt, dienachstehende Bedingungen anerkennen:1. Das ausgehändigte Material steht auf Grundlage dieser Vereinbarungfür das Gemeinwohl, insbesondere für wissenschaftlicheUntersuchungen, Bildungszwecke sowie Belange des Naturschutzes, zurVerfügung.2. Mit der Übernahme des Pflanzenmaterials verpflichtet sich derEmpfänger, die mit dem Material verbundene Information angemessen zudokumentieren und zu bewahren.3. Für den Fall, dass mit dem bereitgestellten Material wissenschaftlichePublikationen erarbeitet werden, erwartet der Garten, dass auf dieHerkunft des Materials hingewiesen und ihm diese Schriftenunaufgefordert zugesandt werden.4. Kommerzielle Nutzungsinteressen des Empfängers sind in dieserVereinbarung nicht erfasst. Eine Nutzung zu kommerziellen Zwecken istGegenstand einer separaten Vereinbarung mit dem Ursprungsland. Sieunterliegt den Bestimmungen der CBD, das heißt, der Nutzer ist zu einerVorteilsbeteiligung des Ursprungslandes verpflichtet und hat der mit derUmsetzung der CBD beauftragten Stelle relevante Informationenmitzuteilen.5. Der Garten wird relevante Informationen über die Weitergabe des

Materials der mit der Umsetzung der CBD beauftragten Stelle(2)aufAnfrage mitteilen.6. Die Weitergabe des Pflanzenmaterials ist nur auf Grundlage und unterVerwendung dieser oder entsprechender Vereinbarungen möglich.

Mit der Samenbestellung werden die obengenannten Vereinbarungenakzeptiert.

Agreement on the supply of plant material by the Botanic Garden of

Düsseldorf University(1)

Since the Convention on Biological Diversity (CBD, Rio de Janeiro, 1992)came into force, it has become necessary for Botanic Gardens to complyin particular with Article 15 of this convention (access to geneticresources), especially in connection with the exchange of plant material.Accordingly, the garden only passes on plant material to others under thecondition that the recipient acts in the spirit of CBD.The garden is dedicated to conservation, sustainable use and research ofbiological diversity. With regard to the acquisition, maintenance andsupply of plant material, the garden therefore expects its partners to act ina manner that is consistent to the letter and the spirit of CBD, theConvention on International Trade in Endangered Species (CITES) and incompliance with any other relevant conventions and laws relating to theprotection of biological diversity.Consequently, only those persons and institutions will recieve plantmaterial from the garden`s collection who accept the following conditions:1. On the basis of this agreement, the material is intended to serve thecommon good, particularly scientific study, education and the interests ofenvironmental protection.2.Upon accepting plant material from the garden, the recipient is oblidgedto document and preserve information relating to the materialappropriately.3. If scientific publications result from studies on the plant materialprovided, the origin of the material is to be cited. In addition, thesepublications are expected to be sent the garden automatically without anyfurther request.4. Intended commercial use by the recipient is not covered by thisagreement. Any commercialisation is the object of a separate agreementwith the country of origin. This agreement underlies the provisions ofCBD, i.e. the user is oblidged to share benefits with the country of originand to forward relevant information to the authority instructed with theimplementation of CBD.5. The garden will on request forward information on the material supply

to the authority instructed with the implementation of CBD.(2)

6. Plant material may only be supplied to others on the basis and underthe conditions of this or a corresponding agreement.
