Systems and Procedures

1.0 Introduction/Background

The Royal Charter, conferred on 13 August 1935 on the Institution of Engineers (India) mandates as follows:

“to grant certificate of competency whether under any Act of the Government of India or Local Governments regulating the conduct and qualifications of Engineers or otherwise howsoever”.

Realising its responsibility under the legal authority of the Charter, The Institution of Engineers (India) (IEI) had in 1995 started certification of Professional Engineers that was overseen by a Committee for Award of Professional Engineers (CAPE) that has made it mandatory to certify only such professional engineers who have shown consistent professional acumen for at least 15 years in their respective profession. During eight years of its existence, only 637 professional engineers could pass through these strict standards. IEI’s role has been internationally recognized for ensuring highest professional standards in engineering.

The competence in IEI encouraged it to stake claim for provisional Membership of Engineers’ Mobility Forum in November 2001 (after making an initial presentation at the EMF meeting in June, 2001 in South Africa). IEI was invited to make its presentation to support its case for Provisional Membership at the EMF Meeting in June 2003 at Rotorua in New Zealand. IEI was conferred the Provisional Membership for India and advised to put in place all systems and procedures in line with international norms and submit its Assessment Statement. Thereafter the Full Membership and authority to operate International register of Professional Engineers will be granted to IEI.

To ensure fulfillment of the obligations presented by IEI to EMF, the IEI shall constitute the following:

i. Board for Certification

ii. National Committees

iii. Board for Ethics

2.0 Organisational Set up for Certification of Professional Engineers

The function of IEI will be to grant appropriate certificate of competence to individuals to practise as “Professional Engineers” and to develop the profession of Engineering and to regulate the profession through a “Code of Ethics”. In furtherance of these functions of the profession, it will be aimed that only a Professional Engineer, either working individually or in an IE(India) Systems & ProceduresRev 09 – Nov 11

organizational set-up will approve designs/drawings/reports/products before these are released for use by the public at large. Such certified Professional Engineers will be designated as Professional Engineer (PE/IntPE).

2.1 Board for Certification

2.1.1 Role

The Board for Certification will identify and create a register of professional engineers whose academic qualifications and experience will be in conformity with the internationally mutually acceptable standards. These professionals will be competent to sign/approve an engineering design or the process and supervise and certify implementation/execution of projects as per laid down standards and will ensure the outcome of engineering activity in the best public and professional interest.

The Board for Certification will ensure the following:

i) To continuously develop and upgrade the standards of engineering profession in the country and making them more ethical by emphasizing on the concept of accountability in the profession.

ii) To ensure certification standards benchmarked against EMF accepted standards so as to facilitate international mobility of individual Indian professionals,

iii) To develop a data base of professional engineers

All certificates of competence of professional engineers shall be approved by this Board, based on the recommendations of the National Committees for the respective disciplines. The National Committees established by various professional associations/institutions as per the norms and approval of Board for Certification, will follow the approved mechanism of conducting assessment and evaluation of a candidate.

2.1.2 Functions of Board for Certification

i) Lay down policy, criteria and standards for grant of professional engineer’s status, including conduct of examinations and interviews at such intervals as necessary for proper professional assessment.

ii) Nominate one or more members to each national committee and approve constituent members of the National Committees to deal with cases of different disciplines of engineering.

iii) Receive applications from engineers seeking recognition as Professional Engineer (PE/IntPE) and to refer the same to concerned National Committee seeking recommendation within a specified period.

iv) Prescribe the application form and fee for initial certification as well as subsequent renewal and also lay down the procedures for processing of applications through concerned member association/institution.

v) Take final decision on granting the status of Professional Engineer.

vi) Review the standards and procedures periodically to ensure continuation of the grant of status for Professional Engineer.

vii) Lay down terms and conditions on the rights and privileges accompanying the status of a Professional Engineer and also the responsibilities and accountability.

viii) Approve issuance of appropriate Certificate to the successful applicant; which shall have a validity of five years only.

ix) Lay down the requirements for renewal of Certificate and the methodology to be adopted for the purpose.

x) Where there is no speciality Association/Institution for any engineering discipline, the Board for Certification will setup a National Committee as required.

2.1.3 Organisational Structure

The Board shall have the following organizational structure:

i) The Board shall consist of a Chairman and six members, out of which one will be a nominee of the Institution of Engineers (India).

ii) The President of the Institution of Engineers (India) shall constitute the Board on advice of his Council and in consultation with other professional associations.

iii) The Chairman and Members of the Board shall be eminent engineers and fulfill the minimum criteria laid down for qualification for recognition as Professional Engineer.

2.2 National Committees

2.2.1 Establishment and Responsibilities

i) IEI, shall constitute National Committees for each specified engineering discipline. Members of the committee shall be suggested/nominated by the identified nodal professional associations/societies. Each National Committee will include one member nominated by IEI and one member nominated by BFC.

ii) Each National Committee shall be responsible for assessing the candidates as per specified Systems and Procedures and recommending certification of the Professional Engineers in specific disciplines of engineering assigned to them. The number of such Committees may be decided by IEI from time to time.

iii) Each National Committee shall consist of one Chairman and 5 members. Chairman of the Committee shall be nominated by the Chairman of the nodal professional association in consultation with the Chairman, BFC and President, IEI.

iv) Each National Committee shall be assisted by one Syllabus & Examination Committee for each discipline of engineering. These Committees together shall be responsible for preparing assessment examination curriculum, syllabus, question bank and conduct assessment. The Syllabus & Examination Committees shall be formed by the nodal professional associations. The Syllabus and Examination procedure shall be approved by the Board and shall be applicable uniformly for all National Committees.

v) In a discipline where there is no recognized professional association /institution, BFC may set up National Committee and Syllabus & Examination Committee directly.

2.2.2 Tenure of Boards/Committees

i) The members of various boards and committees will be appointed for a tenure of three years. Maximum 3 members shall retire at the end of each tenure of the Board/ Committee.

ii) In case of a casual vacancy occurring due to death/resignations or any other reason, such vacancy shall be filled up by the nominating authority of such member for the balance term of the Committee/Board

2.3 Qualification of Professional Engineer

2.3.1 Basic Educational and other Requirements for Certification as Professional Engineer.

i) Bachelor’s Degree Course or equivalent in Engineering approved by a statutory body or Government of India.

ii) Experience of 7 years in engineering practice after acquiring Bachelor Degree level qualification, of which 2 years should be in a responsible position, of significant engineering activity.

iii) Person of good character

iv) Passed the examination and or interview as prescribed

v) Maintained continuing professional development since graduation at a satisfactory level for which documentary evidence is produced.

vi) Undertakes to adhere to the Code of Ethics.

vii) Member of a recognized engineering professional institution / association.

viii) Makes a formal application with prescribed fee.

2.3.2 Requirements of Competence for Professional Engineers

i) Application of engineering theory, standards and practices.

ii) Management of engineering works including personnel & financial aspects

iii) Communication skills

iv) Understanding of broader social and legal implications of engineering profession

v) Continuous development in engineering profession

vi) Demonstrable record of commitment to involvement in sustainability, occupational

health, safety and welfare concerns.

2.3.3 Exemptions for Educational Qualification for Professional Engineer

i) Bachelor’s Degree in Engineering/Technology conferred outside India and as accepted equivalent to that from a University accredited / equivalent programme in India by UGC.

ii) Any other criteria based exemption made by BFC

2.3.4 Exemptions for Experience for Professional Engineer

i) Credit up to 12 months of experience may be given if he/she has a Post Graduate Engineering Degree or equivalent, recognized by AICTE/UGC/MHRD.

ii) Credit up to 24 months of experience may be given if he/she has also obtained a PhD Degree recognized by AICTE/UGC/MHRD.

iii) Maximum exemption for higher education shall not exceed 24 months including Post Graduate Degree and PhD.

2.4 Steps for Processing Application of Professional Engineer

Following steps will be involved:

i) Application on formal application form, along with all the requisite prescribed documents and the prescribed fee, which will have three components, viz., Assessment & Examination fee and Interview fee.

ii) BFC Secretariat shall communicate dates on which Assessment Examination and interview are to be conducted. The interview can be held in person or electronically.

iii) The BFC Secretariat shall compile the results of the examinations as applicable and communicate to the National Committee.

iv) The National Committee shall interview the applicant and consider the application. If considered necessary, additional information may be sought to carry out the assessment.

v) National Committee shall send its recommendations to BFC.

vi) BFC, based on the recommendations of the national committee, will decide on grant of certificate. Data base of such P Eng shall be maintained.

2.5 Application Requirements for Professional Engineer

Applicant desirous of being designated, as a Professional Engineer, must submit, in English, following documents to the Secretary, Board for Certification for consideration of award of Professional Engineer Certificate:

i) Completed and signed application form duly proposed and recommended by three sponsors.

ii) Details of his/her previous 7 years engineering career, detailing the dates and positions held and demonstrating that the applicant has been in responsible capacity for at least two years.

iii) Evidence of current membership of a professional engineering association/institution.

iv) Evidence of academic qualifications.

v) In accordance with 2.6.2 a 1000 word Self Appraisal report in typed format for new applicants and a 300 word Self Appraisal report for renewal applicants giving details of professional career with focus on last 60 month.

vi) Satisfactory evidence of minimum 125 hrs in last 5 years including minimum 24 hours of CPD during last twelve months, prior to the date of application.

vii) Satisfactory achievement of the core training objectives as defined by the BFC.

The applicant will be expected to have obtained certain key knowledge, skills and understanding of the engineering work environment and should be able to demonstrate these through their performance at work. The Board defines these key knowledge, skills and understanding as the core competences for a professional engineer.

The core competencies are divided into the following four sections:

Personal - effective communication and interpersonal skills, leadership and professional commitment;

Engineering – identification and solution of engineering problems and the safe and economic implementation of the solutions;

Management and Economics – efficient procurement and management of resources within economic and regulatory constraints to achieve the engineering objectives.

Environment, Occupational Health and Safety – application of environment, health and safety in engineering solutions and processes.

The Professional Engineer is expected to have achieved these core competences and the process of certification is designed to confirm this.

2.6.1 Engineering Experience

The career progression details, which must be recorded on the Application Form are the applicant’s opportunity to demonstrate he/she has the required engineering experience. He/she should give dates and positions held and should describe the level and limits of responsibility held in each position.

For the purpose of certification, “responsible capacity” is defined as having responsibility for the financial and technical outcome of work of an engineering nature. It is acknowledged that engineering works vary greatly in size and complexity and the Board will not demand complete responsibility for excessively large or complex works. The applicant should have held responsibility for a part of a large work or all of a small works, part of a complex work or all of a straightforward works. The assessors will apply a certain amount of judgment in their decisions.2.6.2 Self Appraisal

The Professional Engineer applicant is expected to possess the following qualities and the self appraisal report should demonstrate the same:

The ability to use relevant existing technology coupled with the ability to locate and use new technologies to benefit his/her work and engineering generally;

The ability to identify and apply appropriate scientific methods to produce alternative solutions to complex engineering problems;

Independent judgment in the application of engineering science and knowledge, particularly in his/her chosen field;

The leadership skills to plan, manage and direct the human, material and financial resources required to solve complex problems, often in multi-disciplinary teams;

A high level of understanding and application of engineering economics;

Commitment to the public interest in all aspects of work, including health, safety, risk, financial, commercial, legal, environmental, social, energy conservation and sustainability;

The report is the main opportunity for the applicant to convince the assessors that he/she possesses and has been consistently demonstrating in his/her work performance, the required competence. It should, therefore, not simply be a narrative of activities carried out by the applicant but must describe the “why and how” of the work activities. It should also indicate the applicant’s involvement and the role he/she played in the process. The report will be expected to demonstrate that the applicant understands the underlying engineering, economic and management principles behind the work activities. Ideally the Self Appraisal would include and center on significant engineering work undertake by the applicant demonstrating his own contribution in meeting the required qualities. The self-appraisal report should be comprehensive and concise. For new applicants, the report is expected to be around 1000 words.

For renewal applications, the applicant should give details of his/her professional activities during 60month period of the last certification. This is in the form of a self-appraisal report and should be written in the same sprit as mentioned above. The self-appraisal report for renewal applications is expected to be around 300 words.

Self Appraisal Report is not intended to be an onerous task for the applicant but it does give the assessors an opportunity to eliminate those who clearly do not meet the requirements of the Board.

2.7 Sponsors

Any application for PE must be supported by at least three sponsors, who are either Fellows of IEI / Fellows of any other recognized professional engineering institution or have been Professional Engineers of IEI for at least 5 years. The sponsors are expected to assess the application as per the requirements of certification. The sponsors must give an undertaking that

they know the applicant personally and be convinced in every respect that he/she is a fit and proper person to be certificated as Professional Engineer.

The sponsors will be required to complete a separate confidential form giving their own impressions of the applicant and reasons why they consider him/her to be a fit person to be certified as Professional Engineer. This confidential document shall be submitted separately to the BFC.

Sponsors’ separate confidential reports are not applicable for renewal of certification.

2.8 Assessment Procedure for Professional Engineer

2.8.1 Assessment shall have following parts:

a. Assessment Examination;

b. Assessment of experience of at least 7 years from the date of acquiring engineering degree status;

c. Assessment of experience of 2 years of significant professional involvement; and

d. Evaluation of continuing professional development.

2.8.2 Assessment Examination :

It measures the ability of the potential professional engineer to practice in prevailing environment. It may cover areas such as industrial and economic trends, social responsibility and ethics, legal and contracting practices, environment laws and technology trends, health and safety responsibilities.

2.8.2.1 The Assessment Examination shall be conducted online at designated places in controlled conditions. The Syllabus & Question Bank for different engineering disciplines shall be prepared by the respective Examination & Syllabus Committee. Module 1 shall be common to all applicants and only on successful passing of Module 1, the candidate can take examination of Module 2. The applicant must obtain minimum 60% marks in each module. The results of Assessment Examination duly certified by Secretary, BFC shall form integral part of assessment of the application by the National Committees.

Any applicant who fails either in Module I or Module II can re-appear either in Module I or Module II with deposition of re-appearance fee amounting Rs. 1000/- per re-appearance. Minimum six month gap is required to be maintained. However, in one calendar year only a maximum of two attempts are permitted.

The syllabus & curriculum shall have approval of Board for Certification.

2.8.3 Interview of PE Applicant

PE applicants need to be interviewed by the National Committee to assess the depth of professional knowledge, critical analysis capability, communication skill etc. The Board for Certification may require to interview the PE applicant, if it feels necessary.

If any applicant either fresh or renewal is not recommended by the National Committee during the interview, he can reappear for interview on completion of one year after submitting applicable video conferencing charges of Rs. 3000 and strengthening their professional knowledge and attaining more practical exposure in their respective field of working.

2.8.4 Exemption from Assessment Examination

A candidate may be exempted from taking the Assessment Examination provided he has already been certified as PE/IntPE and can demonstrate that he continues to retain his status of PE/IntPE. The renewal shall depend on review of CPD status and interview in person or electronically by the National Committee. The certification shall follow the evaluation process as applicable to new applicants.

2.8.5 Evaluation of Competence

The competence of a Professional Engineer defines his/her capability to perform a given function using a combination of general and engineering knowledge and skills to optimize the application of existing and emerging technology.

A professional engineer’s expected level of performance will depend upon his/her field of specialization. Specifically, it may include the following:

Know the systems techniques, practices and procedures followed in management of engineering activities and projects.

Provide technical and commercial leadership in solving and managing engineering problems relating to the field of specialization.

Have proper understanding of management of resources, legal and contractual issues, cost-cutting and efficiency improvement measures, safety, health and environment safeguards, development of human resources and service to the society.

Use effective inter-personnel communication skills to deal with human matters and business issues.

Commit to abide by the established professional code of ethics.

Emphasis shall be on evaluating the relevance of learning to the profession rather than mere knowledge accumulation. The concerned National Committee will carry out the evaluation following the mechanism as detailed at para 4.1.2 generally.

2.8.6 Criteria for Certification of Eligible Incoming Engineers from Overseas

IE (India) shall certify the engineers working overseas as under:

i. Engineers registered as International Professional Engineer by the members of EMF shall be certified in India, through an oral examination / interview at the discretion of BFC / National Committee if they apply for certification as P Eng (India) in the specified form, provide all required data, and pay the agreed fee. They will be exempted from online assessment examination as the have already been examined under an equivalent system. They should have Bachelor’s Degree or equivalent in engineering from an accredited institution and at least seven years experience.

ii. Others with engineering degree from foreign universities will be required to go through all the procedures including examinations as for engineers with Indian degree.

2.9 Data Base

The Database for Professional Engineer shall include the following particulars, namely:

i) Full name and date of birth, nationality and residential address;

ii) Qualifications, the date on which he obtained qualification and the authority which conferred it;

iii) Professional address;

iv) Discipline of Engineering;

v) Date of approval/certification as PE/IntPE;

vi) Such other particulars as may be prescribed by BFC, from time to time.

2.10 Professional Engineer’s Seal

A Professional Engineer shall have a seal of his own as per design approved by the BFC which shall have following information

This seal must be affixed on the drawing/design/report/certification certified by him/her.

PE/IntPE shall be responsible for civil/criminal liability for the losses/damages suffered by the user of his/her services if it is found that the losses/damages have arisen out of wrong certification.

2.11 Redress of Grievances for Denial of Status of PE/IntPE

2.11.1 Grievance in regard to denial of the status of a Professional Engineer (at initial or removal stage), is to be sent by the aggrieved candidate to the Chairman of the Board for Certification along with supporting documents and on payment of prescribed fee for this purpose.

2.11.2 Grievance shall be put before the National Committee and its Chairman, shall constitute a team of three experts chosen by it, (one of the three being member of the original Assessment Committee) to look into the matter. One of the experts shall be designated as the Team Leader.

2.11.3 The aggrieved person, in his letter of grievance, can suggest up to three names of Professional Engineers in the same Discipline and specialization for which the aggrieved party has made application for obtaining the status of Professional Engineer with whom he/she has neither family relationship nor official relationship. The National Committee may decide to invite one such expert to join the team, if it considers necessary.

2.11.4 The Team shall be free to look into the matter in whatever way it considers fit.

2.11.5 The National Committee shall provide all documents needed by the Team and all support that it may require to look into the grievance.

2.11.6 The member of the Team must not divulge the proceedings of the Team to any one personally. The leader of the Team shall submit the report to the Chairman of the National Committee and the decision of the Team shall be final. Chairman, National Committee shall convey the decision of the Team to the Chairman, Board for Certification, who after scrutiny shall intimate the aggrieved party.

2.11.7 The Expert Team may, if they so wish, decide to counsel the aggrieved party.

2.11.8 The Expert Team, apart from giving its decision on the grievances, can also suggest to the National Committee and BFC, any changes, that it considers important, in the procedures adopted, for processing applications seeking status of Professional Engineer. These suggestions are to be communicated to the BFC for the consideration of the Board.

However, these suggestions, as and when accepted by the BFC, shall be applicable in future only and shall not affect the proceedings of the case under consideration.

2.12 Code of Ethics and Disciplinary Action

IEI will constitute a Board for Ethics for Professional Engineers, which will lay down the Code of Ethics and is empowered to recommend removal of a name of Professional Engineer on following grounds:

i. False / incorrect / partially correct information provided by the candidate at the time of filing the application for obtaining the certificate of Professional Engineer.

ii. Willful violation of Code of Ethics.

iii. Violation of the conditions imposed at the time of grant of the status of Professional Engineer.

iv. Other violations as covered in the Code of Ethics.

Details are given in Section 5 on “Code of Ethics”.

2.13 Expiry and Renewal of Professional Engineer Certificate

i) Certificate shall be valid for 60 calendar months and shall become invalid after that date unless renewed.

ii) The Professional Engineer whose certificate is expiring shall apply on the prescribed form along with prescribed fee, which will have 2 components (a) Assessment fee and (b) Fee for Interview.

iii) Renewal of a certificate for further period of 60 months may be effected 6 months prior to and not later than 6 months after the date of expiry of the previous certification under Rules promulgated by the BFC which may specify the criteria for renewal. This may include amongst the other the following:

a) Details of professional activities during the 60 months period of the last certification (see 2.6.2).

b) Time spent in activities related to Continuing Professional Development (CPD). The criteria and methodology for assessment of CPD are covered under Section 4.

iv) The applicants shall be assessed by the concerned National Committee on the basis of the criteria at the time of renewal of certification. This assessment shall be communicated to BFC and the candidate shall be issued fresh Certificate of

PE/IntPE on approval. Those candidates who wish to be placed on the IntPE (I) register will have to apply on the prescribed form along with IntPE (I) transfer fee as applicable at the time of submitting the renewal application, failing of which they will have to be interviewed again if they wish to seek transfer to IntPE (I) Register at a later date.

2.14 1 st Batch of Professional Engineers

IEI has over a decade has been certifying PE/IntPE following stricter criteria for professional experience for its Life members & Life Fellows. Many of them continue to be on roll after 5 yearly renewals of their certificates. All such existing PE/IntPE as certified by IEI earlier, on their application or at the stage of the renewal after expiry of 5 years of existing certificate shall be assessed by the respective National Committee as below:

(a) The evidence of engineering qualification and minimum 15 years post qualification professional experience from the records;

(b) Professional experience & engagement during last 5 years to satisfy continued involvement in engineering profession at senior position through written & supported statement;

(c) Record of CPD for last 5 years to be assessed as per criteria of CPD credit hours:

(d) Continuous unblemished conduct.

(e) Interview

2.15 Fee Structure for the Professional Engineer

The fees associated with initial application for award of PE/IntPE and renewal of PE/IntPE shall be decided by IEI from time to time.

4.0 Continuing Professional Development of Professional Engineers

It is expected that all PE/IntPE will continuously upgrade & update their professional knowledge in the engineering activity in which they are engaged. Further, PE/IntPE shall be encouraged to record and report such activities both to the professional society to which they belong and to the BFC

4.1 Standard for Continuing Professional Development (CPD)

For assessing CPD of a Professional Engineer applicant, the CPD Program shall cover the above topics but it shall not be limited to these.

4.1.2 Mechanism for the Evaluation of the Continuing Professional Development of PE/IntPE .

The Continuing Professional Development programmes include ‘Technical Educational Knowledge Update’ through added qualifications; and ‘Professional Expertise and Management Skills Upgrade’ through additional training. Each of these categories can be further broken down into significant parts and each part can then be assigned ‘weight’ and ‘achievement value’. Quality and quantum of IEI continuing professional development programme shall be assured by the assessment method indicated below. It is the aggregate of credit hours earned in 5-years that will determine as to whether a PE has secured at least 125 credit hours within his/her five years certification validity period or not, necessary for re- certification.

Notes. 1. The number of credit hours will be calculated by multiplying the number of hours actually spent for the CPD activities by a pre-determined weighted factor.

The above assessment methodology including the weightage factors is indicative. The IEI can re-design these, as required and directed by BFC. The National Committee will also undertake a qualitative review of the CPD record.

4.1.3 Record of CPD

Each PE/IntPE shall be required to maintain record of CPD activity in the book supplied on certification. The record shall be signed by the event organizing authority.

4.2 Implementation Mechanism of Continuing Professional Development

4.2.1 Each nodal professional association shall be responsible for facilitating continuing professional development of Professional Engineers as per specified policy and procedures in specific disciplines of Engineering assigned to them.

4.2.2 Each nodal professional association shall maintain a local database of all their members who have obtained certification as Professional Engineers. It may collect report of professional development activities of its certified members and place them before the National Committee for evaluation at the time of renewal, if required. Notwithstanding above, record of CPD in approved format shall compulsorily be submitted by the PE at the time of renewal.

4.3 Renewal of Certification

The certification of only those candidates who fulfill the development assessment criteria will be renewed. The candidate not fulfilling the CPD requirements for renewal can reapply for renewal after fulfilling the necessary requirement through further professional development.

4.4 Redress of Grievances – Appellate Body

Grievance in regard to any design of CPD adversely affecting a candidate is to be sent by the aggrieved Professional Engineer to the President of IEI along with supporting documents and on payment of the prescribed fee for this purpose. The matter will be placed before the Board for Certification.

5.0 Code of Ethics

5.1 Board for Ethics

5.1.1 Role

Board for Ethics (BFE) will be a standing Board for ethics in IEI. It shall be responsible for developing, specifying, interpreting, promoting, enforcing and reviewing Code of Ethics. It shall lay down systems and procedures for this purpose and will be the deciding body for taking action against Professional Engineers for violation of ethical standards. It will be serviced by the secretariat of IEI

5.1.2 Functions of Board for Ethics:

i) Lay down a policy, criteria and standards for ethical conduct of professional work of Professional Engineers.

ii) Frame rules and regulations for the work of the Board.

iii) Receive all complaints regarding violation of ethical standards by Professional Engineers

iv) Decide whether to investigate or reject the complaint.

v) Take decisions regarding punishment in case of defaulters and communicate it to all concerned as per the regulations.

vi) Develop specially designed programmes and encourage Associations/ Institutions to organize these programmes for dissemination of information on ethical standards.

vii) Review code of conduct and ethical standards being followed and recommend changes therein from time to time.

viii) Make recommendations to the IEI on aspects related to the formulation, implementation and review of ethical standards of Professional Engineers.

5.1.3 Organisational Structure

Board for Ethics will have a Chairman and up to six members. All the members, including the Chairman, will be nominated by the President, IEI for a period of 3 years.. No member shall be eligible to continue as Member / Chairman for more than six years. Two members will retire every year but they will be eligible for re-nomination up to the maximum period specified.

5.1.4 Amendment of Code of Ethics

The Code of Ethics may be amended by the Board in consultation with nodal professional associations.

5.2 The Code of Ethics

Engineering is a profession that puts scientific knowledge to practical use. Professional Engineers, in the pursuit of their profession, affect the quality of life of all people in the society and the quality of all sectors of the economy. Therefore, ethics are fundamental to the values of the profession. Accordingly, the services provided by professional and consulting professional engineers should adhere to a Code of Ethics while dealing with the public, clients, employers, employees and the associates.

The IEI ‘Code of Ethics’ aims at maintaining high standards of personal and professional conduct, developing professional competency and integrity and ensuring ethical conduct in fulfilling social responsibility to the society, the nation and the global community. It is mandatory that all Professional Engineers (PE/IntPE) conduct their professional practices and their individual behaviour in an ethical manner, as stated below:

Article 1. Social Responsibility to Uphold Ethical Values of the Society:

1.1 Public Safety: Engineers shall ensure the safety, health and welfare of the public in the performance of their professional duties. Safety of the people must always come first. They should promptly disclose to all concerned the factors that might endanger the public safety or the environment.

1.2 Compliance with Social Order: Engineers shall abide by the laws of the land in which the work is performed, respect the local customs, uphold the human rights, safeguard public property; abjure violence and acts of terrorism.

1.3 Impartiality and Fairness. Engineers shall treat fairly all persons regardless of such factors as race, caste, religion, state, gender or national origin.

1.4 Environment Protection & Sustainable Development. Engineers shall strive to protect and maintain clean, healthy and safe environments, sustainable development and comply with the statutory requirements.

Article 2. Responsibility to Maintain High Standards of Professional Quality.

These professional responsibilities include the following:

2.1 Development of Technical and Managerial Skills: Engineers shall maintain state-of-the-art professional skills, continue professional development and provide opportunity for the professional development of those working under their command.

2.2 Undertake Assignment where Professionally Competent. Engineers shall perform service only in the area of their technical competence.

2.3 Performance Responsibility. Engineers shall seek work through fair and proper methods, and shall take full responsibility for the task undertaken by them.

2.4 Proper Verification of Documents and Production Processes. Engineers shall approve only those designs, which safely and economically meet the requirement of the client and shall not approve any engineering document, design, materials, stages of work which they consider to be unsound.

Article 3. Obligation to Maintain High Standard of Personal Behaviour in a Responsible Manner

3.1 Honesty and Integrity in Professional Dealing. Engineers shall maintain high degree of honesty and personal integrity in all their professional dealings. They shall conduct themselves in a fair, honest and respectable manner.

3.2 Compensation for Services Rendered. Engineers shall not engage in unhealthy competition.

3.3 Professional Opinion. Engineers shall seek and offer honest criticism of technical work, acknowledge errors, and give proper credit for the contribution of others. Where necessary, engineers shall issue public statements in an objective and truthful manner.

3.4 Professional Relationship with the Employer. Engineers shall act faithfully as trustee of the employer / client on professional matters.

3.5 Information Communication with Employers. Engineers shall keep their employer and client fully informed on all matters relating to progress of business including financial aspects, which may affect the assigned work.

3.6 Mutual Obligation & Trust. Engineers shall not, maliciously or falsely, injure the professional reputation of another engineer or organisation.

3.7 Self Promotion. Engineers shall build their reputation based on the merits of services to the customers and shall not falsify or misrepresent their contribution.

3.8 Employers’ Business Secrets. Engineers shall not disclose by any means, confidential information of the employer or client, unless otherwise authorized.

3.9 Personal Conflict. Engineers shall disclose real or perceived conflicts of interest to affected parties and avoid these where possible.

5.3. Violation of the Code of Ethics

5.3.1 All individuals applying for PE/IntPE shall commit themselves to this Code of Ethics. The Professional Engineers must undertake to abide by this Code of Ethics.

5.3.2 In case of any complaint, the Board for Ethics has the power to investigate, and recommend punishment, if considered fit. The Board will frame rules and regulation for this purpose.

5.3.1 Board for Ethics shall have the right to cancel or suspend the membership of a Professional Engineer. Any such person whose name is ordered to be removed from the list of PE/IntPE shall not be eligible for re-certification for such period as may be specified.
