December 21, 2017. Commissioner Cummings made the motion to approve this item, seconded by Commissioner Brinkley. The motion was approved 5-0.

Chair Wensowitch made the motion to approve the Certificate of Design Compliance, subject to final staff review. The motion was seconded by Chair Wensowitch. The motion was approved 5-0.

2. Deliberation and possible action in regard to a request for a Certificate of Design Compliance for a new sign located at 569 Main Street. Chair Wensowitch made a motion to approve the Certificate of Design Compliance pertaining to the sign, with a suggestion to add the address to the sign. Commissioner Ellis seconded the motion. The motion was approved 5-0.

H. STAFF REPORTS The Historic Preservation Commission may discuss any of the items under Staff Reports, but no formal action will be taken. • Update on Historic Preservation activities within the city limits and Extraterritorial

SUBJECT: DELIBERATION AND POSSIBLE ACTION IN REGARD TO A REQUEST FOR A CERTIFICATE OF DESIGN COMPLIANCE FOR DEMOLITIONS LOCATED AT 200 WEST GOFORTH ROAD. 1. BACKGROUND/HISTORY

This is the regular agenda item (action item) for a Certificate of Design Compliance (CDC) application for a demolition of three buildings at 200 W. Goforth Road.

2. CURRENT STATUS The applicant is proposing to demolish three houses on the site. All three houses are one-story frame structures located on the lot and addressed as 200 or 202 West Goforth Road. The applicant proposes the demolition in order to redevelop the site as an office building.

The largest house structure is set back approximately 37 feet from West Goforth Road. This house is a wood structure with vertical wood siding and appears to date from the 1960s or 1970s. This structure is in poor repair, showing misaligned windows and roof lines, leading one to believe the structure’s foundation is not stable. This stricture has been used as a rental house. This structure is not included in the 1992 Buda Historic Resources Inventory, indicating it was not and is not considered a contributing structure to the historic district. A second house is located behind the 200 Goforth House and house had a wood exterior of vertical board & batten siding, and is estimated to date from the 1960s or 1970s. Review from distance seems to indicate it is also in poor condition, with rotting boards and missing windows and doors. At the same time, the limited visibility of the structure from the street limits the public interest in preservation. Staff did not have full permission for property access. This property is also not listed in the historic resources inventory, indicating it was not and is not considered a contributing structure to the historic district. The third structure is visible from Goforth Road, and has a sign indicating its address as 202 Goforth Road. This structure is setback more than 100 feet from the property line. This structure is a two-room style with a covered porch on the west side of the building and appears to date from the late 1950s. This building also shows signs of misalignment. This structure was not included in the 1992 Buda Historic Resources Inventory, or any subsequent listing of historic properties. The owner is working on a concept for new construction on the property based on the F4H zoning, which will involve construction of an office building with the appearance of a large residential

structure. The owner is taking inspiration from Antebellum architecture due to its emphasis on outdoor porches and scalability to office design (plantation homes & mansions). Likewise, Antebellum architecture draws heavily from Neo-classical, and Greek Revival style, which is represented in the historic district and throughout the Central Texas region. The owner is only beginning the design process, and may seek some feedback from the Commission at this meeting in preparation for a more robust discussion & approval at a future meeting.

4. ACTION OPTIONS/RECOMMENDATION Staff recommends approval of the request to demolish the three buildings, as they do not contribute to the historic district. The proposed replacement office building would be designed in a manner that could strengthen the value and appearance of the Goforth Road corridor. The proposed office building would have to both meet the requirements of the F4H form-based code district and receive a Certificate of Design Compliance from the Historic Preservation Commission.

CERTIFICATE OF DESIGN COMPLIANCE APPLICATION

The Historic Preservation Commission meets on the first Thursday of every month. All applications require a public hearing and a publication in the newspaper fifteen (15) days before the public hearing; therefore, ALL APPLICATIONS MUST BE COMPLETED AND SUBMITTED TO THE CITY NO LATER THAN FORTY FIVE (45) DAYS BEFORE THE FIRST THURSDAY OF EVERY MONTH.

A Certificate of Design Compliance from the Historic Preservation Commission is required for all changes (other than ordinary maintenance and repair) to local historic landmarks, and to the exterior and appurtenant features of structures in the local historic districts. NO CONSTRUCTION, ALTERATION, AND/OR ERECTION SUCH AS A SIGN CAN TAKE PLACE UNTIL THE APPLICANT HAS RECEIVED AN APPROVED CDC CERTIFICATE SIGNED BY THE HPC CHAIRMAN.

Please contact the City of Buda Development Services with questions regarding the application process.

Consider the following conditions and plan accordingly. Your Certificate must be approved before you will be issued a building permit. Regardless of the need for a permit, a Certificate of Design Compliance is required before altering features in a historic district or of a local landmark. If the work is not started within one year of approval, the Certificate will expire and a new application must be made. Once the work is started, the Certificate is valid for twenty four (24) months from the date it was issued. If the approved work is not completed within twenty four (24) months, a new Certificate must be obtained to continue the work.

Appropriateness, the Building Official and Historic Commission shall review and decide the appropriateness of the proposed alterations of the following with regard to:

1. Removal, Addition or Modification of Architectural Detail. The distinguishing historic

qualities or character of a building structure, or site and its environment shall not be destroyed. Removal or modification of any historic material or distinctive architectural features may be accomplished upon issue of Certificate of Appropriateness; however, this should be avoided when possible. Architectural features include but are not limited to exterior wall materials, windows, railings, decorative woodwork, masonry, or stone elements.

2. Paint Color Application. Traditionally, the base colors of Buda’s buildings have been soft

muted shades of greens, blues, whites, and tans. In order to continue the historic integrity of the buildings in the district, these colors continue to be acceptable today, and do not require review or issuance of a certificate. Base colors such as vibrant or “hot” shades, dark deep shades, and black shades are not acceptable. If one wishes to use these colors, a Certificate of Appropriateness must be granted. The painting of existing historic buildings composed of materials such as unpainted stone or unpainted masonry is prohibited.

3. Scale of New Construction in Historic Districts. The Commission will review all new

construction plans within Historic Districts in order to ensure visual compatibility with the surrounding buildings and environment in relation to height, gross volume, proportion, and setback.

Chapter 3 Applications and Permits, Section 3.9 Development Related Applications of the Unified Development Code for the City of Buda: (8) Certificate of Design Compliance (HPC Approval)

a. Applicability (i) A certificate of design compliance is required for development within the following

areas of the City: 1. Any Historic Overlay District 2. The Central Business Overlay District

(ii) A certificate of design compliance from the HPC is required in the following

circumstances before the commencement of development within or work upon any building or structure located within the above designated areas of the City: 1. Whenever such work or development requires Site Plan Review or a building permit

issued by the City (including sign-related building permits); 2. Whenever such work includes the erection, movement, demolition, reconstruction,

restoration or alteration of the exterior of any structure or site, except when such work satisfies all the requirements of ordinary maintenance and repair as defined in Appendix B Glossary.

(iii) No building permit shall be issued by the City for any structure or site located within a

Historic Overlay District or other applicable Overlay District until the application for such permit has been reviewed by the HPC and a certificate of design compliance has been approved.

(iv) Certificate of Design Compliance for Demolition

No building or structure within any Historic or other applicable Overlay District shall be demolished or removed unless such demolition is reviewed and approved by the HPC and a certificate of design compliance for such demolition has been granted.

b. Criteria for Approval - General

The Historic Preservation Commission shall determine whether to issue a Certificate of Design Compliance based on the criteria set forth for Zoning Changes, Historic District Designation (Section 3.7(6)) and the following criteria:

(i) The development complies with any design standards of this Code.

(ii) The development complies with any adopted Design Guidelines specific to the

applicable Historic or Overlay District.

(iii) The integrity of an individual historic structure is preserved.

(iv) New buildings or additions are designed to be compatible with surrounding historic properties.

(v) The overall character of the Historic or applicable Overlay District is protected.

(vi) Signs that are out of keeping with the character of the site or landmarks within the Historic or applicable Overlay District in question will not be permitted;

(vii) The value of the Historic or applicable Overlay District as an area of unique interest

and character will not be impaired.

(viii) The following may also be considered by the Historic Preservation Commission when determining whether to recommend issuance of a certificate for design compliance: 1. The effect of the proposed change upon the general historic, cultural and

architectural nature of the site, landmark or district. 2. The appropriateness of exterior features, including parking and loading spaces,

which can be seen from a public street, alley or walkway. 3. The exterior features of the building or structure and the relation of such factors to

similar features of buildings or structures in the district, contrast or other relation of such factors to other landmarks built at or during the same period, as well as the uniqueness of such features, considering the remaining examples of architectural, historical and cultural values.

c. Supplemental Demolition Criteria

In determining whether to recommend issuance of a certificate of design compliance for demolition, the Historic Preservation Commission, and, on appeal, a court of competent jurisdiction, shall consider the following criteria, in addition to the criteria specified above.

(i) The uniqueness of the structure as a representative type of style of architecture,

historic association or other element of the original designation criteria applicable to such structure or tract.

(ii) The condition of the structure from the standpoint of structural integrity and the extent of work necessary to stabilize the structure.

(iii) The economically viable alternatives available to the demolition applicant, including:

1. Donation of a part of the value of the subject structure or site to a public or nonprofit agency, including the conveyance of development rights and facade easement.

2. Possibility of the sale or relocation of the structure or sale of the site, or any part thereof, to a prospective purchaser capable of preserving such structure or site.

3. The potential of such structure or site for renovation and its potential for continuing use.

4. The potential of the subject structure or site for rezoning in an effort to render such property more compatible with the physical potential of the structure. The ability of the subject structure or site to produce a reasonable economic return on investment for its owner may also be considered, provided however, that it is specifically intended that this factor shall not have exclusive control and effect, but shall be considered along with all other criteria contained in this section.

(iv) Status of the structure under the City of Buda’s Dangerous Building Code.

d. Responsibility for Final Action

The Historic Preservation Commission is responsible for approval of a Certificate of Design Compliance based on the criteria specified in this Section
