  • MATTERS ARISING FROM THE MINUTES

    HEYTESBURY ESTATES The winterbourne water drainage ditch in Park Lane Heytesbury is blocked by

    leaves and debris, and some residents are sweeping leaves into the drainage ditch near the Park Street

    entrance. The residents of Park Lane are worried because if the water flow is blocked it could cause

    flooding as it did last winter 2014/15. I wrote to Heytesbury Estates three times last year (2015) and

    they assured me that the problem would be dealt with. The last letter I sent dated 27 Nov 15 was also

    copied to Wilts Council Danny Everett. The Chairman, Cllr Perry also asked Danny Everett if Wilts

    Council/Highways were responsible for the culvert under the bridge which runs from Salisbury Plain,

    under the A36 and into Park Street and then into Park Lane. His reply dated 2 Dec 15 as follows:

    Quote...I have spoken to Highways England and they are going to look at their culvert on the A36 It

    may be blocked due to the ditches and watercourses in the area being block and it will scour out when

    the work is done upstream and downstream. They hopefully will get back to me next week. Regards

    Cllr Buttenshaw reported the Winterbourne water course was blocked at the Slaters Farm Bridge with

    apples and leaves. Cllr Girard volunteered to speak to the residents of Park Lane/Park Street to clarify

    the situation regarding dumping garden waste into the watercourse. Clerk to write to Heytesbury

    Estates again and to Danny Everett of Wilts Council. Also Clerk to write to Wilts Council regarding the

    culvert under the A36 bridge as Cllr Girard stated the watercourse on the Salisbury Plain side of the

    village is getting blocked with fallen trees and debris.

    Cllr Buttenshaw stated the dog waste bags were full outside Peter Firth’s house but the others

    throughout the village were empty. Cllr Perry to speak to Cllr Dale regarding replacing the bags.

    HEYTESBURY DIFIBRILLATOR GUARDIANS GROUP RAISING MONEY FOR THE

    DEFIBRILLATOR Cllrs discussed the future raising money for the Defibrillator. Cllrs Agate and

    Sturmey agreed to investigate sources of funding for the future costs of the village defib. Cllrs also

    discussed the Parish Council could make a donation in the future too.

    Cllr Perry stated she has a possible supply of speed restriction stickers for residents to put on their bins

    or gate posts to kindly remind drivers of the 30mph speed limit throughout the village.

    HORSES IN RAILWAY FIELD See email Q below. Parish Councillors received an email from a

    parishioner complaining of the overzealous horses in the Railway Field. Cllr Buttenshaw reported that

    she too had been charged at on Mon 11 Jan 16 by the same horses whilst walking across the field. Cllr

    Perry to contact WC regarding public rights of way and safety. Cllrs agreed to do nothing until the

    Chairman had sought advice from WC. Clerk is to write to the owners of the field after the Chairman

    has been advised by Wilts Council.

    LET’S CLEAN FOR THE QUEEN from (m) correspondence

    We’d love to have the support of your council and your communities in the biggest ever clean-up of the

    country, which will be taking place in March 2016. In the run up to The Queen's 90th birthday on 21

    April 2016, ‘Clean ForThe Queen’ aim to inspire a million people to take action and enjoy a few hours

    together litter-picking to make the places where we live more beautiful. For Her and for us all, they

    want to attack the blight of litter and reclaim our beautiful countryside, our fabulous cities, our world

    class parks, our wonderful beaches and waterways. All of the litter charities across the country have

    come together in support of this campaign together with a growing range of companies, land managers

    and associations. There will be ‘Clean for The Queen’ litter blitzes throughout the UK in January,

    February and March, and the most monumental of all litter clear-ups from Friday 4 to Sunday 6 March

    2016.‘Clean For The Queen’ love to have your support in making this event truly spectacular. They will

    shortly be sending through a downloadable resource pack for your council to use. It’d be great if you

    could encourage as many local community groups as possible across your wards to sign up to organise

    a clean-up through the ‘Clean for The Queen’ website. Furthermore, it would be fantastic if your council

    could stage its own local clean-up to allow individuals to come together and clean up a local grot

    spot.Lots more will be announced over the coming weeks and months, as it builds a head of steam.But

    it’d be great if you could respond to [email protected] indicating your willingness to

    engage in the campaign – and they will be back in touch shortly with more details. Clerk to reply Cllrs

    Cllr Sturmey reported the Chitterne junction again to WC Jacqui Abbott as she did not receive a reply

    from last time. Cllr Sturmey also reported the very muddy footpath between Heytesbury & Knook. Cllr

    Sturmey also stated there seemed to be discrepancies on the Wilts Council TPO (Tree Preservation

    Order) site as it was not clear which trees in the village had TPOs on them. Cllr Sturmey to request

    information from WC to clarify the position.

    Cllr Agate stated he was keen to nominate ex Parish Councillor Tim Reynolds for attendance at the

    Queen’s Garden Party. Cllr Agate to start the application process

    Cllr Buttenshaw enquired about the progress on SHLAA (STRATEGIC HOUSING LAND AVAILABILITY

    ASSESSMENT "SHLAA site" – Heytesbury Sports field nominated for building land by Trustees of GT

    Sassoon Trust). See also minutes of Extraordinary Meeting 6 Aug 15. Cllr Perry stated no decision had

    been made yet

    Cllr Buttenshaw reported the poor state of the footpath 7 near the river on the Mantles Lane side of the

    village. Cllr Perry agreed to ask Cllr Dale to possibly obtain some gravel and fill in the muddy footpath

    with the help of Cllr Bond and Cllr Agate

    Cllr Agate stated he is concerned about the lack of response by Wilts Council regarding the broken

    window in the bus shelter outside Heytesbury School.

    Cllr Sides reported there are lots of old discarded road signs littering the banks of the A36. Cllr Girard

    suggested they both pick them up together.

  • Cllr Sides produced a leaflet with information on contacts for residents who wish to complain about

    vehicles parked in their street and blocking access for emergency services. Cllr Perry to scan the

    document to all Cllrs.

    Cllr Girard stated her concerns regarding accessibility of the sandbags. Cllr Perry replied she had a

    supply of empty bags and sand could be obtained by the Flood Warden Cllr Dale.

    VISIT BY ANDREW MURRISON MP. Cllrs were very willing to meet up with Andrew Murrison, but so

    far the Clerk has not been able to secure a date for the meeting. March 29 2016 was refused because

    of the Easter holidays. Clerk to contact Andrew Murrison’s Secretary to request another meeting date

    for Tues 26 April 2016.

    MATTERS ARISING FROM THE MINUTES

    SOCIAL MEDIA In accordance with WALC; social media can be used by all Councillors but only if

    agreed on unanimously at the meeting.

    DR ANDREW MURRISON MP has agreed to attend the Parish Council meeting on 30 August 2016

    HEYTESBURY ESTATES The winterbourne water drainage ditch in Park Lane Heytesbury remains

    blocked by leaves and debris. I have sent another letter dated 15 Jan 2016 to both Heytesbury Estates

    and Danny Everett and await their response.

    BUS SHELTER OUTSIDE HEYTESBURY SCHOOL Cllr Perry contacted WC regarding the broken glass

    in the bus shelter which has been reported on numerous times. Imogen Dallimore of Wilts Council

    replied.....Quote “Unfortunately, as Wiltshire Council does not replace broken bus shelter glass, I am

    unable to provide a cost for the repairs. Although the bus shelters are owned by Wiltshire Council, if the glass is damaged, the Community

    Team will only remove the glass and make the area safe. Wiltshire Council will not replace damaged

    glass, if the Parish Council wish to do so, you may request a quote from an independent contractor and

    organise the repairs”.....unquote. Parish Councillors discussed Wiltshire Council’s policy above and

    agreed they would like to proceed with getting quotes from 3 independent contractors. Cllr Dale and

    Cllr Bond agreed to obtain the quotes.

    FRACKING/COAL BED METHANE EXTRACTION. Currently there are four applications pending for

    exploratory licences for Coal Bed Methane Extraction in Wiltshire from Codford to Trowbridge.

    Cllr Bond reported street light no 23 in Park Street was working intermittently and stated he would

    report it to Wilts Council

    Cllr Bond stated Mill Lane is very muddy with slurry across the road. Cllr Perry agreed to contact the

    Environment Agency as it could be a health hazard.

  • Cllr Bond was asked by local residents if they could put a bench on the verge near the entrance to the

    Railway Field in memory of a relative. Cllr Bond agreed to contact Wilts Council with regard to who

    owns the verge

    Cllr Bond was asked by a Heytesbury resident if the trees that overhang Newtown at the St John’s end

    of the road could be pruned back as they scrape taller vehicles as the pass. Cllr Gould agreed to put it

    on Wilts Council website as a work request.

    Cllr Frost reported the WC had not fixed the broken Westlands sign. Cllr Bond agreed to have a look

    and fix it.

    CLEAN UP DAY Cllr Frost stated Heytesbury Imber & Knook Parish Council had registered for Clean for

    the Queen campaign, but cannot get the equipment. Cllrs agreed for Cllr Frost to organize another

    village clean up day in the near future and Wilts Council will supply the equipment free of charge. Date

    to be confirmed.

    Cllr Frost reported there were 3 large tyres discarded in Park Street near Unicorn Cottage. Cllr Gould to

    report it to WC

    Cllr Sturmey stated the Chittern Junction problem (faded white lines and missing road sign) was still

    not fixed. Cllr Sturmey agreed to send pictures of the junction to the Chairman who will contact CATG

    to request it is put on their agenda.

    Cllr Sturmey reported the rusty leaning fence railings in Park Street were dangerous. Clerk to contact

    Sassoon Estates

    Cllr Sturmey reported the overgrown Ivy plant smothering the clothes bank.

    Cllr Sturmey stated WC had filled in the pot holes in Knook but the road surface was still poor. Cllr

    Sturmey to report again to WC.

    Cllr Gould reported the pavement was very bumpy and uneven from the bus stop outside Heytesbury

    School to the village shop. Cllr Gould to report to WC

    Cllr Gould also reported the hedge alongside the same pavement was overgrown and encroaching on

    the right of way. Clerk to write to owners of the hedge.

    Cllr Sides reported the hedge in Tytherington Road had been cut and left in the water drainage ditch

    alongside the Railway Field. Clerk to write to the owners of field.

    Cllr Dale stated there were no river bank issues with spreading some gravel on the muddy footpath (7)

    along the river bank approaching and leading into the Mill Farm Water meadow (Mantles Lane side of

    village). Chairman to contact Cllr Agate regarding completing the job

    Cllr Girard stated her concern about the expired MOD temporary planning application over the tank

    crossing bridge in the wood near Heytesbury Park, and also the debris in the Winterbourne water

    course on Salisbury Plain. Chairman to enquire

    Many thanks to Cllr Frost taking on the task “Clean for the Queen” and all her volunteers who did a

    splendid job around the village picking up vast amounts of rubbish. Vote of Thanks to those who took

    gates near the river.

    Parish Clerk: Catherine our Parish Clerk has rescinded her notice and wishes to continue in her post as

    Parish Clerk and Responsible Finance Officer.

    Emails: I get over 150 emails a month relating to the PC, some are REPLY ALL (10)+; I will reply to

    any email addressed to me directly; an email addressed TO ALL I will reply if relevant, but not TO ALL.

    have a good working relationship and wish this to continue.

    HEYTESBURY ESTATES Clk wrote to Gemma Chandler of Savills on 1 and 2 March 2016 regarding

    the ongoing problem of the winterbourne water drainage ditch in Park Lane Heytesbury, her reply is on

    the last page.

    Letter from resident of Park Lane; copy sent to all Cllrs;

    QUOTE

    Thank you for your letter HEY/GCC/LF dated 4 March 2016 in which you informed me of an increasing

    amount of garden rubbish being dumped on the bank adjacent to the winterbourne. You mentioned

    that you have carried out inspections and that you cannot identify the source of the garden debris,

    although by asking me to “desist from tipping any garden waste onto the bank” you imply that I am,

    at least in part, to blame.

    You do not mention when your inspections were undertaken but I respectfully suggest that they may

    have been only cursory. The so-called garden waste is in fact an accumulation of the leaves and other

    detritus that has resulted from the apparent lack of grounds maintenance along the bank in Park Lane

    over a number of years. Moreover, had you looked above head height into the trees you would have

    seen:

    a. A large (and presumably heavy) branch that has become detached and is hanging

    precariously by the entrance to Bourne Cottage. I suggest this is potentially dangerous

  • and needs urgent attention before possible death or serious injury is caused to

    someone passing by.

    b. Branches of the trees opposite 120 and 121/122 Park Lane are now overgrowing the road

    and the two properties. The branches shed a significant amount of leaves and other debris

    in the autumn requiring frequent sweeping/ blowing to keep driveways and yards free from

    the nuisance that they are.

    I am aware from Heytesbury Parish Council Meeting minutes that the problem in Park Lane has been in

    issue for at least the last 12 months. I write to propose that, rather than attempting to load the blame

    for flooding in Park Lane on its residents (dumping garden waste on the bank of the winterbourne), in

    your capacity as agents for the Heytesbury Estate you address the issue by asking the land owners to

    maintain their property just as we residents are required to in order to live harmoniously as good

    members of the Heytesbury Community.

    I am copying this letter to the Chair of Heytesbury Parish Council for their information. UNQUOTE

    OVERGROWN TREES IN NEWTOWN. Clk contacted Adrian Hampton of WC on 1 March 16 and his

    reply ......Quote I will get the area inspected. Sadly if council maintained we have just finished the

    annual winter programme. If a safety issue it will be cut, but if not it will be scheduled for the next

    OVERGROWN IVY OUTSIDE HEYTESBURY SCHOOL AND NEAR THE CLOTHES RECYCLE BINS

    Clk contacted Selwood about the overgrown Ivy on 1 March 16 and their reply.....Quote We have

    The Ivy has been cut back from the bins and is now resolved

    Clk sent Letter dated 9 Mar 16 to the owners of the hedge in Tytherington Road which had been cut

    and left in the water drainage ditch alongside the Railway Field. There has had no response to date

    and the problem seems to have worsened as the owners have done further hedge cutting and the ditch

    is now full to the top with cuttings. Agreed by all to wait and see if owners clear out the cuttings after

    the works have been completed.

    BUS SHELTER approve estimate received from Warminster & Frome Glass for £194.57. The company

    have requested payment by BACS. All Cllrs agreed the Chairman will pay this amount via her Bank

    and the Clerk issues a cheque to the Chairman. Cllr Buttenshaw agreed to cover this issue in the

    Parish News especially noting that parish residents have in effect paid for the replacement themselves.

    Cllr Sturmey agreed to include the piece written by Cllr Buttenshaw on the Heytesbury Hub.

    EMAILS – sent to all Cllrs: No longer applies in accordance with WALC Clks Training Day.

    Chairman’s comments: In view of the large volume of email correspondence between

    ITEMS FOR REPORT

    WC ANNUAL TOWN & PARISH COUNCIL INVOLVEMENT EVENING 12 APRIL 16 Cllr Frost and

    Cllr Sturmey will both attend the annual town and parish council involvement evening for West Wilts

    on April 12 2016. Topics to be discussed this year will be the new highway contract and

    arrangements; contact arrangements following the split in services; parish and town council

    involvement initiatives and public convenience policy. Cllr Frost and Cllr Sturmey asked Cllrs to forward

    any questions they wished us to ask at the involvement evening on the 12th April so we could compile

    a list

    MINUTES Clk asked if Cllrs could email any items for report before the meeting if possible and to

    include their actions/solutions/proposals where necessary. If the issue arises too late to email their

    report could they (if the subject is large and convoluted) write it down so there is no confusion as to

    what is to be recorded in the minutes

    Cllr Bond stated the mud and slurry at Mill Lane has still not been resolved. Cllr Perry to contact the

    owners of the land

    Cllr Perry reported a parishioner had complained about the mud by the kissing/gate/style. This is on

    the path from Knook to Heytesbury. It looks as if people have cut the wire to avoid this muddy area

    and are walking in fields they should not be in! It just requires a load of rubble to be spread on the

    area. Cllr Perry to contact the owners of the land.

    FOOTPATHS Cllr Sturmey requested that footpaths are put on the next agenda so Cllrs could see if

    the ramblers association could help with the muddy problem reported to WC in the last 2 years. The

    chairman has agreed to write to the land owner of the field as a courtesy

    Cllr Frost reported the dangerous loose metal sheets on the Dutch barn in Mill Lane. In a high wind the

    sheets of metal could come off and seriously hurt someone. Cllr Perry to include it in the above agreed

    letter to the landowner

    Cllr Frost reported to WC on 27 March 16 the tree on the Tytherington Road over the stream. The tree

    was and still is very unstable, split and leaning as if it is going to fall down.

    The minutes of the last APM meeting May 2014 were confirmed and signed by the chairman.

    MATTERS ARISING FROM THE MINUTES

    PARISH ACCOUNTS AND ANNUAL RETURN

    A copy of the annual accounts was given to each member in attendance. Approval of the

    accounts, Annual Return and Statement of Assurance was proposed by Cllr Buttenshaw

    seconded by Cllr Frost and agreed by all. The clerk reported that the Charibond account stood

    at £163,862.61 at 31 March 2015, the HSBC village hall fund at £NIL at 31 March 2015 and

    Current account balance was £5377.65 as at 31 March 2015 and the Deposit account stood at

    £10,771.38 as at 31 March 2015.

    RISK ASSESSMENT

    A copy was given to each member in attendance and approval was proposed by Cllr Sturmey,

    seconded by Cllr Gould and agreed by all (to include retention of the level of fidelity guarantee

    at £2,000).

    FINANCIAL REGULATIONS

    Cllr Perry went through the Financial Regulations document for audit purposes and the

    appropriate financial amendments were agreed by all.

    CHAIRMAN’S REPORT

    Thank you all for attending and giving up your time to serve our community. It can be a

    thankless task but occasionally we do get a ‘thank you’ and I reiterate ‘thank you’.

    During the last year three new Cllrs have joined Cllrs Girard; Gould and Sides.

    Last year I was thanking villagers and Cllrs for all their work in assisting with flooding in and

    around the village, we must all remain vigilant, ensure all the watercourses are maintained and

    remind others. Ensure the water meadows are not built on or the rivers and watercourses

    interfered with. Thanks also to Catherine for sending letters to landowners, at least some have

    complied.

    We have had 10 members of public during the year.

    Thank you to all Cllrs for all your input, advice and dedication over the last twelve months it has

    been a pleasure working beside you all.

    Reminder it is quicker for Cllrs to go on Wiltshire Web and report issues rather than wait until

    the next meetings. In order to keep a paper trail remember to mention these at meetings.

    A sad farewell to Tim Reynolds who has served as a Cllr for twelve years, he will be missed, his

    feature in the Parish Newsletter I know was well read and the one of the favourite pieces in the

    newsletter. Special thanks to Tim for all his input, his wit and professionalism.

    Thank you Catherine for taking the Minutes and keeping the coffers in order.

    FRACKING

    Update from Cllr Sides and Cllr Girard. Cllr Sides stated 4 licences had been produced for coal bed

    methane extraction and sent to South West Energy to approve. Then planning applications will be put

    Cllr Girard stated that methane gas extraction is extremely toxic to the environment and suggested if

    WILTSHIRE TOWN & PARISH INVOLVEMENT MEETING

    Cllr Sturmey attended the Wiltshire Council Town & Parish Involvement Meeting on Tues 12 Apr 16.

    Cllr Sturmey stated the general consensus seemed to be that Wilts Council are underfunded and many

    issues throughout the parish will possibly have to be paid for by the Parish Council budget; unless it’s

    a matter of safety and Wilts Council will be responsible for repairs/maintenance. Report attached on

    last page.

    The broken window in the bus stop outside Heytesbury School has finally been fixed.

    Cllr Sturmey stated the overgrown Ivy near the recycle bin which she reported to WC has been cut

    back.

    SOCIAL MEDIA No policy required, Cllrs all agreed to use their discretion

    MUDDY FOOTPATHS Cllr Sturmey would like to find out if the Ramblers Association could help with

    the muddy problem reported to WC in the last 2 years. Cllr Perry stated she is still awaiting a response

    from Mr Pottow regarding her correspondence about the muddy footpath, (see below) Cllr Perry

    agreed in the meantime to contact the Ramblers Association to inquire about possible

    assistance

    Cllr Perry emailed Mr Pottow regarding the path from Knook to Heytesbury; Looks as if people have

    cut the wire to avoid this muddy area and are walking in fields they should not be in! It requires a

    load of rubble to be spread on the area. Are you aware? The Ramblers Association have money in

    their kitty (apparently), and would you object to the Parish Council approaching the Association for

    funds? Cllr Perry awaiting a reply

  • ANDREW MURRISON VISIT on 30 Aug 16 will be in the school assembly hall. Parish Council meeting

    will be held on 23 Aug 16. Notices for Dr Murrison’s visit will be put on social media nearer the time,

    and Cllr Frost volunteered to produce some posters to place throughout the village (to be confirmed

    next mtg). Cllrs agreed to list their concerns and email to Clerk to collate them.

    in the wind and causing a disturbance to the neighbours. Cllr Sides stated he had reported the

    problem to Wilts Council

    Cllr Gould stated the dog waste bin at Tytherington Bridge is in poor condition, as are the railings on

    the bridge

    BENCHES

    Cllr Sturmey reported she had cleaned the Knook Village bench

    Cllr Buttenshaw reported a parishioner had mentioned the poor state of the benches situated at the

    Tytherington triangle and by the west door of the church

    Cllr Dale also reported a parishioner had pointed out some of the benches need attention again. It

    tends to be those that face the Sun all day i.e. the Tytherington triangle and those on the way out to

    the Cotley hill roundabout. Cllr Dale proposed we replace one bench with a plastic one and he will

    renovate the others using the materials from the replaced one. All Agreed, Clerk to order new bench

    Cllr Dale stated the dog waste bags were being taken to excess again, and therefore he will be putting

    out fewer bags in future to avoid the problem. Also can all dog walkers please put used waste bags in

    the bins provided and not throw them in the verges

    Cllr Gould stated the school children will be making the dog waste posters within the next few weeks

    and prizes for best poster will be donated by the Parish Council as agreed by all Cllrs in 20 Oct

    2015 meeting

    Cllr Gould reported the problem with the uneven surface of the pavements was a danger to some

    parishioners. The pavement outside the shop, school and pub is very bumpy and uneven and could

    cause an accident. Cllr Gould to report the problem to WC

    Cllr Sturmey stated the bend in the road outside St John’s is a hazard when people park their cars on

    the corner as it causes visibility problems for drivers on the road. Cllr Perry to write to the

    Administrator of St John’s to request people not to park there

    Cllr Buttenshaw stated she had reported to Wilts Council the missing litter bin lid on their bin opposite

    the Mill on Footpath 7.

  • CLOSING MEETINGS TO THE PUBLIC

    We have recently had a number of queries about closing meetings to the public. See below for some

    guidance.

    Under the requirements of the Public Bodies (Admissions to Meetings) Act 1960, a council meeting

    must be open to the public. This includes committee meetings but not necessarily subcommittee

    meetings (where a sub-committee is named as such in the context of being a committee of a

    committee). Indeed, some sub-committees may continuously deal with confidential matters or

    concern individuals (e.g. a staffing sub-committee of a personnel or HR Committee) or always consider

    sensitive information which is not in the public interest. If this is the case then it is not desirable for

    the public to be permitted to attend its meetings.

    If, at a full council or committee meeting, there are items of a confidential or sensitive nature which

    may either breach the council’s obligations of the Data Protection Act 1998 or is not in the public

    interest to disclose, then the meeting may only be closed for this particular reason.

    It will be necessary for a councillor to move a motion to exclude the public from the meeting during

    the relevant agenda items and it must be done by resolution. It should appear on the agenda

    although care should be taken not to give any confidential information away.

    The power to exclude is not exercisable generally but only for specific reasons, of which there are few.

    Acceptable reasons include:

    • engagement, terms of service, conduct and dismissal of employees • terms of tenders

    and proposals and counter-proposals in negotiating contracts • preparation of cases in

    legal proceedings, and • the early stages of a dispute

    Even if there is only one item on the agenda of a full council or committee meeting and the meeting

    will be closed for the public to deal with that item, the notice of the meeting must be displayed, the

    meeting must be open to the public and then a resolution passed to exclude the public and press. The

    chairman of the meeting should give a broad reason as to why this is occurring without divulging any

    confidential or sensitive information. This will help those members of the public present to accept the

    reason for being excluded. It should also be explained that resolutions made in the closed session will

    be minuted but will not include confidential or sensitive information.

    Minutes, by their very definition, are open to the public. They are a public record of the decisions of a

    council, are kept forever and can be used as evidence in a court of law. Therefore any minutes of

    confidential or sensitive items should not disclose any of this information but rather a broader

    description of the resolution.

    Principal authorities have a statutory ability to prepare a “confidential minute” but parish and town

    councils do not have the same ability. If any supporting notes are taken, they are notes not minutes

    and it is recommended that such notes are destroyed once the minutes have been approved by the

    council as a true record of the meeting.

    WILTSHIRE TOWN & PARISH INVOLVEMENT MEETING: REPORT BY CLLR STURMEY

    1) HIGHWAY CONTRACT 2016/17

    The new contract will see WC working with 3 companies, TLG (The Landscape Group), and Tarmac

    working with WC since Sept 2015 as sub-contractors to Balfour Beatty and a new company Ringway

    replacing Balfour Beatty. Ringway has 2 months from the 1st April to fully be mobilised.

    The highway contract of 15-20 million has been boosted this financial year with an extra 3 million to

    the budget but this figure will still not meet expectations. TLG and Tarmac will be providing minor

    services and Ringway the major services, our A roads are checked every month, B roads every 3

    months and C roads every 6 months.

    2) WILTSHIRE COUNCIL APP

    Wiltshire council recognise there has been an issue in the past of a lack feedback for people using the

    app but encourage members of the public to report in this way and not just town and parish

    councillors, as from the 1st April works co-ordinators and Imogen is the Warminster Area co-ordinator

    will be responding to online App reports only and for this financial year 2016/17 Wiltshire council will

    only be carrying out works where there is a safety issue, where the issue is not a matter of safety the

    reporter will be informed why the work will not be carried out, to put things in perspective WC has one

    2 man masonry gang in the whole of West Wilts dealing with curbs and pavements etc, WC has 59,000

  • Gullies and these will only be emptied once this year, rural roads with curbs will get one sweep and

    rural verges will get one schedule cut this year, Visibility splays may be cut more often if it is found to

    be a safety matter through the WC discretionary App service.

    Wiltshire Council has an Emergency line in extreme circumstances, where there's an immediate threat

    to health and safety (out of our office hours) call: 0300 456 0100 24/7 call centre

    3) PARISH STEWARD SCHEME

    The Warminster Area will get 2 parish stewards they will be fully operational in October 2016, although

    it is hoped to get a partial service running before then, each parish and town council will appoint a

    councillor as parish steward contact and they or the clerk will be sent a monthly works form to be filled

    out with 5 top priorities of work to be done, this may include works reported through the App and not

    found to be a matter of safety so parishioners should be encouraged to report these matters to their

    council in order for the work to be added to the parish stewards work sheet, depending on the size of

    our area will depend on how much time we are given from ½ a day to 3 days per month, it was

    explained that if we do not use the parish steward me may lose him, he will be able to take on small

    tasks like trimming / strimming, cleaning signs, drains / potholes, leaves and weeds etc

    Wiltshire council spends 2.5 million on litter collection including bins on the A36 and A303, they have

    30 to 40 litter pickers and will take away litter collected from community areas, they said the clean for

    the queen campaign had been a great success, they will also clear away fly tipped rubbish from their

    land, if rubbish is dumped on farmland though that is not their responsibility but they would like any

    evidence of who fly tipped as they will prosecute if they can.

    Grass cutting by the end of April WC will have made 3 cuts then it will go to a monthly cut and WC is

    encouraging asset transfer of play areas and amenity land to save money.

    MATTERS ARISING FROM THE MINUTES

    FRACKING Cllr Sturmey reported on fracking: I recently went to the WC Scrutiny committee meeting

    on 24th May where Hydrocarbon Extraction was on the Agenda, a planning member gave a

  • presentation on the process to the committee and explained that although WC has a mineral core

    strategy they do not have a policy on Hydrocarbon extraction usually known as fracking.

    He explained 159 licenses (blocks) had been awarded nationally in Dec 2015 and 75% represent Shale

    Gas, the 4 licenses in our area give exclusive rights for exploratory extraction subject to the necessary

    consents, he said surveys and exploratory testing of use by a Thumper truck which uses a large sledge

    hammer to hit the ground and record it's resistance could be permitted development and anything

    more will need planning permission, he was not expecting any applications soon, the testing stage

    could take 2-6 months and 8-12 months before we get to a planning application. The appraisal stage

    could take 2 years where they will test the grounds capacity by intrusive drilling, the actually

    extracting / production stage could last 20 years and then there is the abandoning stage, restoring the

    well heads by filling them in with concrete.

    The Planning representative said the government has a dim view of authorities who do not proceed at

    pace, but public consultation is required, safety and the environment remain paramount, no one

    benefits from uncertainty by fast tracking an application it will take 16 weeks approx. They took

    detailed questions from the KWIFF (Keep Wiltshire Frack Free) group and will take expert advice, look

    at the planning guidance and NPPF, if they find a gap they will produce a new policy and briefing notes

    for councillors, they aim to bring this back to the scrutiny committee in September or sooner if an

    application comes in.

    Cllr Sturmey enquired if there was any response from the Ramblers Association regarding the muddy

    footpath, and any response from Mr Pottow, Cllr Perry stated she is still awaiting a response from both

    Cllr Sturmey reported the leaning rusty fence in Park Street had been secured

    Cllr Sturmey asked about the posters Cllr Frost had agreed to make regarding Dr Murrison’s visit. Cllr

    Buttenshaw stated Dr Murrison’s visit had been put in the Parish News with a request for members of

    the public to contact the Clerk with any concerns they wish to discuss

    Cllr Sturmey asked if the Clerk could contact CATG regarding the dangerous Chittern B390/A36

    Junction and request it is put on their agenda

    Cllr Sturmey asked if Cllr Perry had received a reply from St John’s about their residents parking and

    obstructing the visibility on the bend of the road outside St John’s. Cllr Perry has had no response yet

    Cllr Agate stated in an email sent to all Cllrs that unfortunately Tim Reynolds was unsuccessful in the

    "lottery draw" to receive an invitation to the recent party held by The Queen in her garden at

    Buckingham Palace but was still "chuffed" to receive our nomination to be "in the hat".

    PARK LANE There have been numerous correspondences between the Parish Council and Savills

    dating from 11 Aug 2014 regarding the excess leaves and debris in the watercourse and from 27 Nov

    2014 regarding the overgrown trees in Park Lane obstructing the telegraph wires. The last letter

    received from Savills dated 1 March 2016 stated Savills are not responsible for Slaters Farm Bridge

    which they believe is the cause of the flooding problem because the water backs up in the very narrow

    openings. They did however, state they are going to carry out remedial works to the trees along Park

    Lane and where appropriate but have not given any specific dates. Clk to write to Savills again

    NEW BENCH FOR TYTHERINGTON TRIANGLE

    The new bench was delivered to Heytesbury on Tues 3 May 2016. Cllr Dale met the delivery lorry and

    fitted the new bench in place that morning. Cllrs wish to say a big Thank You to Cllr Dale for his hard

    work and dedication.

    It was reported on 10 May 2016 that No 68, High St, Heytesbury, a Grade 11 listed house, English

    Heritage ID 313295; was having brand new red roof tiles put on. The Parish Council was not informed

    of a planning application and has contacted Wiltshire Council. Wiltshire Council replied on 12 May 16

    stating they will be investigating the matter. Cllr Perry to contact WC again

    Mr Ronning’s resignation (with effect from 31 May 2016). Cllr Bond to contact Neat & Tidy garden

    A Thank You email was sent to the Chairman on 9 May 16 from Anne Bennett-Shaw.......quote I know

    Thank you it seems at last, the Heytesbury Estate are going to take action over the trees in Park Lane.

    The rubbish referred to is all the old apples that are thrown in, and Slaters are always keeping their

    bridge clear of debris and this is not causing flooding further down.

    I wonder if the Farmer concerned will take action, those pieces of metal have been hanging for years,

    why does he not take it down?? The slurry has been particularly bad this year, and it is not water

    CHAIRMANS ANNOUNCEMENTS I have read through the Internal Auditors report and uploaded

    everything they requested onto the web. Many Thanks to our Clerk/RFO for her diligence on the

    financial aspect of the job and of the successful audit.

    I was saddened to hear of the malicious pointless vandalism to Heytesbury Cricket Club. The Cricket

    Club works tirelessly for the young people during school holidays with training sessions. There are not

    many activities available and we as a parish should act to preserve what we have. If you have any

    information get in touch with the police

    MATTERS ARISING FROM THE MINUTES

    B390/A36 CHITTERN JUNCTION Cllr Andrew Davis brought the Knook/Chitterne junction problem

    to the attention of CATG on 31st May and they are proposing a directional arrow on the carriageway.

    As requested the Clk contacted CATG on 1 June 16 regarding Cllr Sturmey’s concerns about the

    dangerous junction and to ask if it could be put on their agenda. Their reply on 1 June 16 was as

    follows: This junction did come up for discussion at yesterday’s Warminster CATG meeting. Cllr

    Andrew Davis was aware of a number of recent concerns and brought them to the attention of the

    group. One issue in particular relates to reports that traffic travelling westbound on the B390 is

    incorrectly using both lanes to exit onto the A36 (i.e. one lane for left turning traffic, one lane for

  • right). One option currently under consideration are minor amendments to the road markings to

    ensure drivers are in no doubt the junction is ‘two way’. Looking at the bigger picture, larger scale

    improvements to the junction, similar to those at Upton Lovell, would be promoted by ‘Highways

    England’ as the managing agents for the A36. Wiltshire Council does of course have responsibility for

    the B390. I’m not aware of any current proposal for the Knook junction, although I will make contact

    with Highways England in due course to ask. In the meantime if the PC did want to raise their

    concerns re. the junction they can do so via the online issue system. Please see the link below.

    68 HIGH STREET Wilts Council acknowledged Parish Council correspondence “Thank you for your

    email. The enforcement case for 16/00411/ENF has now been closed with no further action being

    taken.” Cllr Buttenshaw stated she had received a call from the Wiltshire Council Enforcement Officer

    who stated the home owners were not aware they needed planning permission.

    PARISH STEWARD Cllr Frost was confirmed as the designated contact. Cllr Frost stated she may

    have limited access to IT facilities in the future and therefore could have a problem carrying out the

    role of designated contact. Cllrs discussed they can contact Wiltshire Council themselves via the

    website if necessary.

    ST JOHNS BEND Cllr Sturmey reported the faded lines on the road bend outside St John's

    Heytesbury. WC replied sites where there have been injuries, accidents or other identified problems

    are treated as priority and all other sites are dealt with as resources permit. Cllr Perry stated she had

    written to Mr Richards of St John’s regarding residents parking on the bend and he replied the

    residents don’t park there, but customers of the pub and other people often do.

    MOD PLANNING APPLICATION W/09/01076/FUL Cllr Perry stated she had written to WC again

    on 20 June 16 and is awaiting a reply.

    FRACKING Cllr Sides stated there is a meeting on 5 July 16 to force Wiltshire Council to update their

    minerals policy. He also stated he has a map of known coal methane areas in the county.

    COUNCILLOR VACANCY Cllrs discussed the Councillor vacancy and Cllr Sturmey suggested

    advertising on the Heytesbury, Knook and Tytherington notice boards

    VILLAGE HALL Cllrs received a copy of the Raymond Hall Trust fund, see last page.

    DR MURRISON’S VISIT Cllrs again discussed and agreed the Clerk will collate their concerns to be

    raised with Andrew Murrison MP and Cllrs agreed all queries/concerns would be sent in by 16 Aug. Cllr

    Frost agreed to make some posters to place around the village (Cllr Sturmey volunteered to put them

    up in Knook and Tytherington) to inform residents of the Andrew Murrison’s visit on Tues 30th August

    at 7.15pm in Heytesbury School and request they send their queries/concerns to the parish Clerk by

    16 August 2016

    PARK LANE Clerk sent letter sent to Savills on 15 June 16 requesting a proposed schedule of works

    for Park Lane and is awaiting a reply.

    MR RONNING replacement. Cllr Bond sent an email to ‘Neat and Tidy’ gardening services to discuss

    terms but had not had a reply. Cllr Bond stated he will pursue the matter. Cllr Gould said she would

    also contact ‘Neat and Tidy’ gardening services. Cllr Sturmey stated the footpaths were overgrown

    especially on the Knook to Corton and Knook to Upton Lovel paths. Cllr Sturmey requested the Clerk to

    write to the Clerks of both these parishes.

    FOOTPATHS UPDATE

    FOOTPATHS Cllr Sturmey requested that footpaths are put on the next agenda so Cllrs could see if the

    ramblers association could help with the muddy problem reported to WC in the last 2 years. The

    chairman has agreed to write to the land owner of the field as a courtesy [Wrote to Mr Pottow on 3rd

    April as agreed]

  • MUDDY FOOTPATHS Cllr Sturmey would like to find out if the Ramblers Association could help with the

    muddy problem reported to WC in the last 2 years. Cllr Perry stated she is still awaiting a response

    from Mr Pottow regarding her correspondence about the muddy footpath, (see below) Cllr Perry

    agreed in the meantime to contact the Ramblers Association to inquire about possible assistance

    Cllr Perry emailed Mr Pottow regarding the path from Knook to Heytesbury; Looks as if people have

    cut the wire to avoid this muddy area and are walking in fields they should not be in! It requires a

    load of rubble to be spread on the area. Are you aware? The Ramblers Association have money in

    their kitty (apparently), and would you object to the Parish Council approaching the Association for

    funds? Cllr Perry awaiting a reply.

    Robert replied 2nd June, copy of his email as been sent to the Ramblers Association as Robert is very

    explicit in his requirements. Hopefully they can communicate with each other and agree a solution.

    Subject: Re: Knook to Heytesbury footpath 8

    Hello Ann

    The fence was cut a couple of years ago, it is not the only damage we have had from walkers not

    respecting the countryside. If the ramblers want to put stone in the footpath I would have no objection

    but it would have to be done correctly. If the new surface is not constructed deep enough as soon as

    any cattle congregate on that area it will become mud again, bear in mind that the field is water

    meadow and the water table is often very close to the surface. Rubble will not be the correct product

    to use I would not want anything that can cause damage to the cows feet. Oolitic Limestone has no

    sharp edges and is very good. I do also have to be careful of any changes I make regarding foot paths

    and field boundaries as it does effect some of the regulation I have to abide by, I would need to check

    on this before anything is done.

    If you can find out anything from the ramblers please let me know what they have to say before

    The latest correspondence from the Ramblers Association dated 20 June 16 regarding

    footpath 8

    Dear Mrs Perry

    I have received your email and string from our Secretary, Penny England. It is true that we have

    circulated the Parishes within our Group area – the old West Wilts District Council area – to the effect

    that we have funds available to help local footpath improvement projects. However, this a ‘one off’

    offer, and our contribution would, by necessity, be limited to a maximum of £200/300 or so. As we

    would envisage it, your PC would pay half the cost, and the Ramblers would pay the other half.

    However, looking at the message from Mr Pottow below, it does seem to us that the scope of the

    problem you have is likely to require rather more funds than we would be able to allow you.

    If your PC feels unable to meet this cost themselves, we do know that Area Boards in the recent past

    have been sympathetic to requests for assistance in funding this kind of project, usually on the basis of

    50% matching funding being found by the Applicant. I am sure that Warminster and Villages

    Community Partnership would try to help. There may also be funding on the same basis available from

    Wiltshire Council, Rights of Way Dept, through their Path Improvement Grant Scheme (PIGS).

    Paul Millard is the Senior Rights of Way Warden at Wiltshire Council responsible for your Parish. West

    Wilts Ramblers provide a volunteer working party each Tuesday morning which works under the

    auspices of the Rights of Way Dept of Wiltshire Council and Paul sets its programme. Our volunteer
