Democracy must be practised by upholding the law; and human rights are to be uplifted within the framework of laws. Prevalence of law and order and respect to human rights are sound foundations for flourishing of democ- racy. Lack of democracy culture and environment may hinder development. Democracy ensures freedom of expression, peaceful gathering and processing, freedom of forming associations and organizations, rights to vote, stand for election, set up political parties and gathering news from other news agencies apart from government- owned news agencies. Moreover, there must be a human society to enjoy rights and accept responsibilities. There must be tolerance for differences between minority and majority and also cooperation in the command ground so that disunity may not occur. Moreover, democracy is to be practised at home as well as in in- ternational relations. The countries practising democracy at home but not in international relations do not really value democracy. Every nation has sovereignty and territorial integrity. Moreover, the re- spective countries are to ensure development according to public aspiration political, economic, social and cultural systems. The global countries are to practise the principles of co- existence in diversity. Interference in internal affairs of other countries, putting pressure, threats and using forces are activities against democracy. Democracy is created for the rights of all human beings to enable them to participate in public issues. May democracy cultureflourish in Myanmar

Myanmar is a member of global family,having sound foundations for democracy andhuman rights. The Constitution whichguarantees fundamental rights of citizens,democracy and human rights has emerged.

Hluttaws are in session introducingconstitutional reforms to legislative,administrative and judicial sectors. Now, theyare building a new landscape where ‘GoodGovernance and Clean Government’ flourish.

MPs are to focus on public interest inHluttaws in accord with the motto, “People’sVoice is Hluttaw’s (Parliament’s) Voice;People’s Will is Hluttaw’s (Parliament’s) Will;People’s Expectation is Hluttaw’s(Parliament’s) Implementation”.Fundamental, democratic and human rightsare to be translated into reality. In democracy,the minority will have to follow the majority’swill while the majority respects the minority’swill.

Democracy culture unites the society andbrings about the development. Democracyrespects individual’s dignity. Foreign policy iscentred on the prestige of the State. Legislationis the main responsibility of the Hluttaws.Enactment, addition or amendment of lawswill be from the democratic point of view.

MPs are mandated mainly to protectfundamental rights of citizens as well. In thisdemocratic nation, we all need to initiatereforms.

Myanmar is on the right track ofdemocracy. Her people are to march underthe same flag for flourishing of democracyculture and democratic practices in thecountry.

Commencement of Myanmar’s Oral Pleadings over CaseConcerning Delimitation of Maritime Boundary between

Bangladesh and Myanmar in Bay of BengalNAY PYI TAW, 15 Sept—Oral pleadings for the

first round over the case concerning the delimitationof the Maritime Boundary between Bangladesh andMyanmar in the Bay of Bengal is hearing todaybefore the International Tribunal for the Law of theSea ITLOS.

The International Tribunal for the law of the Seacomprises of 21 judges, who are independent andelected in the principle of geographical distributionand is seated in the Free and Hanseatic City ofHamburg, Germany.

-The first round of public hearings forBangladesh began from 8 to 13 September 2011and is beginning for Myanmar today. Dr Tun Shin,Union Attorney-General of the Republic of theUnion of Myanmar, the Agent of Myanmar for theCase Concerning Delimitation of the MaritimeBoundary between Bangladesh and Myanmar in theBay of Bengal made an opening statement as follows:-

This is the first time that Myanmar has taken partin proceedings before the International Tribunal forthe Law of the Sea (ITLOS). Indeed, this is the firsttime that Myanmar has been a party to inter-Stateproceedings before any international or tribunal.The collective decision together with Bangladesh,our friendly and neighbourly State, to submit thiscase to the Tribunal, rather than to arbitration underAnnex VII of the Law of the Sea Convention 1982,is a measure of the confidence that we have in you,the Members of the Tribunal. This is, of course, thefirst maritime boundary delimitation case to comebefore the Tribunal. States with maritime delimitationdisputes, and there are many of them, in all parts ofthe world, will be following this case with greatattention. So the case is a historic one, both for the

parties and for the Tribunal. Myanmar’s decision tosubmit this case to the Tribunal is a measure of theconfidence we have in the Tribunal. It is a functionof our belief that, with your collective wisdom andexpertise, you will reach a decision firmly anchoredin the modern international law of the sea, a decisionthat is firmly anchored in the law on maritimedelimitation as it has developed in the case-law of theinternational courts and tribunals.

Families living in Kenya’s slums are vulnerableto explosions, electrocution, fires, poisoning andother disasters because politicians anxious for voteswon’t enforce city codes, they said.

The three largest slums in the Capital of Nairobi— home to over 500,000 people — are located onland unsuitable for human habitation, according to2008 research by the University of Nairobi, saidPeter M Ngau, a professor in the department ofurban and regional planning at the university.

The report, which was presented to government,had warned that the Sinai slum was built on top of agasoline pipeline and a sewer leading from theindustrial centre. On Monday the pipeline burst agasket, gushing gasoline into the sewer, where itignited as hundreds of slum residents were fetchingit, according to those who survived the fire.

The death toll from the disaster rose to 95 onWednesday as more people died of their injuries, saidPamela Indiaka, an official with the Kenya Red Cross.One person died on Tuesday night and six people diedWednesday in the hospital, she said. Another body wasalso recovered from a river which cuts across the slum.

More than 100 people were hospitalized withburns.

“It’s just disasters waiting to happen,” said Ngau,the professor. “It is just by the grace of God that they(disasters) do not happen more.”

In Kibera, Kenya’s largest slum, residents livein mud-walled, iron-roofed structures dangerouslyclose to railway lines that carry fuel and dangerouschemicals, he said. The international community adopted the Montreal Protocol onSubstances that Deplete the Ozone Layer to protect the earth fromharmful ultraviolet radiation. In more than 24 years of successfulimplementation, the Protocol has been gradually strengthened to coverthe phase-out of nearly 100 ozone-depleting substances. The latestadjustments were adopted in 2007 to accelerate the phase-out ofhydrochlorofluorocarbons, or HCFCs.

HCFCs are both ozone-depleting substances and powerful greenhousegases: the most commonly used HCFC is nearly 2,000 times more potentthan carbon dioxide in adding to global warming. By agreeing to speedup the phase-out of HCFCs, Parties to the Montreal Protocol increasedtheir already-substantial contributions to protecting the global climatesystem.

The level of climate benefits that can be achieved depends on whatchemicals and technologies are chosen to replace HCFCs. The phase-outthus presents countries and industries with a unique opportunity toacquire cutting-edge technologies that not only eliminate ozone-depletingcompounds but do so in a way that lowers energy costs and maximizesclimate benefits. To facilitate this transition in developing countries, theMontreal Protocol’s Financial Mechanism is providing increased funding.

Parties to the Montreal Protocol are now considering furtheramendments, including proposals to bring hydrofluorocarbons, or HFCs,under the Protocol in a manner that would complement existing effortsunder the UN Framework Convention on Climate Change and its KyotoProtocol. HFCs do not deplete the ozone layer but are highly potentgreenhouse gases, and their consumption has been increasing rapidly asthey are being used to replace HCFCs.

I urge Parties and industries to seize the opportunity provided by theHCFC phase-out to leapfrog HFCs wherever possible. Only by limitingglobal climate change can we hope to achieve sustainable development forall.

ZURICH, 15 Sept—Switzerland’s UBS said onThursday it had discovered unauthorized trading bya trader in its investment bank had caused a loss ofsome $2 billion.

“The matter is still being investigated, but UBS’scurrent estimate of the loss on the trades is in therange of $2 billion,” the bank said in a brief statementjust before the stock market opened.

“It is possible that this could lead UBS to reporta loss for the third quarter of 2011. No clientpositions were affected.”

UBS shares immediately tumbled 8 percent atthe open and were trading down 5.8 percent at10.30 francs at 0714 GMT (3:14 am ET), comparedwith a flat European banking sector index.

“It is amazing that this is still possible,” saidZKB trading analyst Claude Zehnder. “Theyobviously have a problem with risk management.Even when the amount isn’t so high it is once morea loss of confidence that casts UBS in a poor light.”

“With this they are losing a lot of credit thatthey had regained with effort,” he added.

UBS had started to see client confidence returnthis year after it had to be rescued by the Swissstate in 2008 following massive losses on toxicassets held by its investment bank. UBS AGannounced last month it is to axe 3,500 jobs toshave 2 billion Swiss francs ($2.3 billion) off annualcosts as it joins rival investment banks in reversingthe post-crisis hiring binge and preparing for atough few years.

Investment banks worldwide have been hit byslow trading due to the debt problems in the eurozone and United States, as well as regulationsaimed at forcing banks to hold more capital toprotect them from future shocks after the 2008global financial crisis.

UBS expects to book a restructuring chargedue to the job cuts of some 550 million francs, andaround 450 million francs of this will be booked inthe second half of the year, with the majorityrecognized in the third quarter.—Reuters

NEW YORK, 15 Sept—A vaccine made of a genetically modifiedbacterium closely related to the bacterium that causes tuberculosis protectedmice against TB, US researchers say. Study leader William R Jacobs Jrof the Albert Einstein College of Medicine in New York says TB, a diseasethat kills an estimated 1.7 million worldwide, is caused by the bacteriumMycobacterium tuberculosis.

A vaccine to prevent TB infection, called bacille Calmette-Guerin, is widelyavailable, but it provides limited protection and can cause severe TB infectionin infants infected with HIV, restricting its use in certain countries, Jacobs says.

Jacobs and colleagues genetically modified M. smegmatis, a relative ofMycobacterium TB that is generally harmless to humans, by replacing a set ofM. smegmatis genes called esx-3 — believed to be important because its DNAsequence is unusually consistent across species — with the corresponding butnot identical set of genes from Mycobacterium TB. TheLabour Organizations Bill draftedwith the assistance of ILO, wasapproved by the Amyotha Hluttaw(House of Nationalities) on 29August 2011. The bill is now undersubmission to the PyidaungsuHluttaw (Union Parliament) for itsadoption. It is expected that this bill

will soon be made into law, inaccordance with Section 24 of theState Constitution.

Likewise, the Ward or Village-tract Administration Bill is now beforethe Pyidaungsu Hluttaw (UnionParliament). This bill, when promulgatedas law, will effectively contribute toMyanmar’s efforts in eliminating thepractice of forced labour in the country.Madame President,

Human rights situation inMyanmar was reviewed by the HumanRights Council’s UPR Working Grouplast January.

During the Working Groupsession, 57 countries contributed190 recommendations on the humanrights situation in Myanmar. Outof these, 74 recommendationsenjoyed our instant acceptancewhile 46 recommendations werebrought back to the Capital forfurther consideration. Seventyrecommendations did not enjoy oursupport.

At the Plenary of the 17th

session of the HRC last June,Myanmar agreed to accept fouradditional recommendations out ofthe 46 recommendations followingtheir consideration at the Capital.The remaining 42 recommendationsreceived either a partial acceptanceor no acceptance at all. It was so,because of the intrusive languageand the ambiguous nature of thoserecommendations.Madame President,

Myanmar is now on track, takingnecessary measures to become a StateParty to some international core humanrights instruments, such as theConvention on the Rights of Personswith Disabilities and the OptionalProtocol to the Convention on the Rightsof the Child on the sale of children, childprostitution and child pornography.

In my view, the UPR processis the most dependable anduncontroversial monitoringmechanism to address and ratifythe human rights situation of allcountries. As such, I firmly believethat country-specific mandates and

resolutions are no longer desiredor required in the Council.Madame President,

In order to effectively promoteand protect human rights of itscitizens, Myanmar established theNational Human RightsCommission on 5 September 2011.The National Commission iscomposed of independent expertsfrom all strata of life; they are wellrespected by the community theyrepresent. Citizens who assume thattheir rights are violated could freelyfile their Complaints to theCommission. Upon receiving acomplaint, the commission willinvestigate it and the findings willbe transmitted to the concernedauthorities for redress. TheCommission will submit its annual reportdirectly to the President of the Republic.Standing itself as an independent humanrights entity, the Commission, whilestriving to promote and protect humanrights in the domestic context, will alsoactively cooperate with internationalorganizations such as the UnitedNations, the Human rights Council, andother regional groupings.Madame President,

The President of the Republic ofthe Union of Myanmar is vested by theState Constitution with the authority togrant amnesties. The President hadexercised his authority for the first timeby issuing an amnesty order on 16 May2011 commuting death sentences to lifeimprisonment and reducing other prisonterms by one year. As a result,approximately 20,000 inmates fromprisons and labour camps werereleased till the end of July 2011.

As a gesture of our renewedcooperation with the ICRC (TheInternational Committee of the RedCross), the latter has been permittedaccess to the prisons with a view toupgrading water and sanitation facilitiesthere.Madame President,

Reaffirming our commitment tothe ongoing cooperation with theinternational community including theHuman Rights Council, the SpecialRapporteur on the situation of HumanRights in Myanmar, Mr Tomas QjeaQuintana, visited Myanmar from 21 to25 of August 2011, his fourth visit, at theinvitation of the Government. Duringthe visit, he was able to observe theparliament (Hluttaws) in session andmeet with high-ranking governmentofficials and other stakeholders. Hewas also received by the Hluttaws(Parliaments) Speakers, the ChiefJustice, the Union Ministers, the UnionAttorney-General, the Chairman of theElection Commission, the Deputy Chiefof Police, the Advisory Group to thePresident, and the parliamentarians. Hemet privately with the seven prisonersat Insein Prison at his request.

But politicalparties, some organizations, some mediasand international organizations madeaccusations that the undertakings areundemocratic, unequal and injust. Amongthem, even the winning Union Solidarityand Development Party made officialcomplaints and made accusations that therewere unequal and unfair cases in theconstituencies they faced defeat. Accordingto the finds, shouts of unfair, unequal andundemocratic emerged when their partiesor their representatives faced defeat.Nevertheless, it is found that organizationsconcerned tried to make correct decisionsthrough reasoning power in accord withthe law.

I dare to say that the Hluttaw fo-cuses on ensuring equality and correct-ness through democratic way. I haveinvited Hluttaw representatives topresent and discuss at any time mattersthey deem undemocratic and unfair,and welcomed criticism and suggestionfrom media public.

Hluttaws received a letter form Inter-Parliamentary Union-IPU in June 2011.The letter said the International Day ofDemocracy falls on 15th September andasked us to hold a ceremony in commemo-ration of the day and asked a question,What do citizens expect from their Parlia-ment?

I set this motto People’s Voice,Hluttaw’s (Parliament’s) Voice; People’sWill, Hluttaw’s (Parliament’s) Will; Peo-ple’s Expectation, Hluttaw’s (Parliament’s)Implementation and implementations arebeing undertaken in accord with the motto.

In Hluttaw, representatives askedquestions what the people want to knowand representatives from organizationsof three branches of power elected bythe people answered the queries.

People’s representatives submittedwills and demands of the people asproposals. People’s representatives andmembers of respective organizations dis-cussed the proposals of which some areput into record by Hluttaw. Sometimes,decision to respond the proposal is passed,policy to do so is adopted and bill isdrafted.

The Section 95 Sub-section (a) and(b) of the Constitution suggest that if a Billinitiated in the Pyithu Hluttaw or theAmyotha Hluttaw is approved by bothHluttaws, it shall be deemed that the Bill isapproved by the PyidaungsuHluttaw; if there is a disagreement be-tween the Pyithu Hluttaw and the AmyothaHluttaw concerning a Bill, the Bill shall bediscussed and resolved in the PyidaungsuHluttaw.

The Section 105 Sub-section (a) statesthat the President shall sign the Billsapproved or the Bills deemed to beapproved by the Pyidaungsu Hluttaw,within 14 days after the day of receipt, andshall promulgate it as Law.

Hluttaw has two main duties. Theseare the duty of legislation and the dutyof reciprocal control, and check andbalance.

The legislation duty includes revok-ing and amending existing laws afterconsideration and prescribing new laws,including budget law.

Legislation is the specific duty ofHluttaws. It means people’s representa-tives on behalf of the people are to dolegislation. In transforming political willto law, the facts to be considered arewhether it protects public interest,whether it protects the interest of thepeople, whether it accords with the Con-stitution, whether it is pragmatic, andwhether it accords with internationallaws, and conventions and treatiesadopted by our country.

People’s representative or Union-levelorganization can submit bill.

The duty of reciprocal control, andcheck and balance means separation ofpowers among Hluttaws, executiveinstitutions and judicial bodies.

Second regular session of first PyithuHluttaw started on 22 August, 2011.

On the first day of the session, he, as aHluttaw Speaker, urged the Hluttaw asfollow: -

“This session would bring questions,proposals and bills for discussion that willcontribute to the nation. Present at thesession are distinguished guests andjournalists apart from the Hluttawrepresentatives who will raise questionsand submit proposals and laws. So, it is fairto say that the session has met all democraticrequirements. They have to acceptsuggestions the media, the people and theinternational community will make.”

They will carry out the tasks inaccordance with the nation’s Hluttawformation, duties and powers of theHluttaw, the Hluttaw committees andcommissions, and bodies in which thePresident exercises the executive powerand the Hluttaw exercises the legislativepower which is different from the processin which the Parliament exercise thelegislative and executive powers.

Learning lessons from the pastevents, they will have to do all whatshould be done with determination andin unity today. Therefore, the Hluttawneeds to be competent and strong. It isalso needed to make the Hluttawstronger. Hluttaw representatives neednot only to improve their skills, but alsoto show mutual respects to consolidateunity. He said that he is pleased to seethat Hluttaw representatives are inaction with the concept of serving theinterest of the people, the Union and thenation without attachment to partyconcerned, dogmatism, localism, racismand regionalism.

In fact, Hluttaws are an organizationthat has all characteristics and essence ofdemocracy and shares powers equally.The laws that serve and protect the inter-ests of the nation and the people need tocome into effect as soon as possible in theprocess Hluttaw representatives submitpublic stances as questions, proposalsand bills for discussions. Similarly,Hluttaws are the major organization thatworks for protection of fundamental,democratic rights and human rights ofcitizens.

These duties are to be shouldered mainlyby Hluttaw committees and commissionsand bodies formed with Hluttawrepresentatives. They are required to havegood volition and qualifications and exertcorrect procedures to have their missionsaccomplished.

Hluttaw representatives are respon-sible for bringing into force the laws thatcan really serve the interests of the peopleand the nation in the pragmatic worldand ensuring the entire people and allorganizations honour the laws, whileassessing the public voices, desires,stances and hopes in all seriousness.

Therefore, all Hluttaw representativeshave to be convinced of and accomplishtheir duties. Only then can they prove theirallegiance to the country and the people. Heseriously urged Hluttaw representatives toact as dutiful and loyal ones.”

Hluttaw Committees were formed inboth Amyotha and Pyithu Hluttaws at thesecond regular sessions. Pyithu Hluttawestablished 19 new committees in additionto four original Hluttaw committees,totaling 23.

Hluttaw is somewhat similar to USCongress. In US, the President is directlyelected by voters. Though in Myanmar, thePresident is elected by the people’srepresentatives. Generally, formation, andduties and rights of Congress and Hluttaware similar to each other.

Duties and rights of each committee ingeneral are:-(a) To help respective Union Minis-

tries and Union Organizations suc-ceed in making their undertaking.

jority is to be followed by all; freedom tomake suggestions, willingness to be sug-gested , and mutual interaction.

If democratic practices are exercisedsystematically, correctly by politicalparties, social organizations, institutionsthat exercise people’s power and otherorganizations keeping disciplines, suchorganizations can be said to already havedemocracy and human rights.

The other part of the world is watchingus and some of international media andMyanmar media are ready to monitor usand make suggestions.

Today, some media at home and abroadare with us in this hall and thus it is a historiclandmark of International Day ofDemocracy in the Hluttaws of Myanmar.

From this milestone of democratiza-tion, all institutions, departments andorganizations in Myanmar have to continuepracticing democracy systematically andfirmly in all fields. It is the historical needand agreeable to the need of circumstancesand time.

MANILA, 15 Sept—ThePhilippine government'sambitious 7-8 percentyearend growth target nowseems unattainable withthe continued decline ofthe country's exportsbrought about by the pro-longed economic woes inJapan and the UnitedStates.

Data released by theNational Statistics Officeshowed that the country'smerchandise exports fellby 1.7 percent in July to4.43 billion US dollarsfrom last year's 4.51 bil-lion US dollars.

This was the third

straight month that Phil-ippine exports registereda decline.

Exports dropped by 3.1percent in May and 9. 4percent in June, the high-est decline for the year.

Analysts are convincedthat the 7-8 percent targetgrowth is now way off themark.

A joint research con-ducted by the First MetroInvestment Corp ( FMIC)and the University of Asiaand the Pacific (UAAP)

showed that the Philippineeconomy can have a full-year growth of only 5. 2percent but this would stilldepend on the economy'sperformance in the sec-ond semester.

In a report titled "Glo-bal Economic Prospects2011" released early thisyear, the World Bank alsoforecast a gross domesticproduct (GDP) growth inthe Philippines of only 5percent this year.

NANCHANG, 14 Sept—The city of Nanchang,capital of east China’s Jiangxi Province, issoliciting names for three newborn South Chinatigers in order to boost public awareness of therare species.

Over a thousand submissions were sent in byThursday, according to Kuang Huaming, aspokesman from the city zoo where the tripletswere born.

The triplets, born to a female tiger nicknamed“Xin Xin” in late May, are made up of twofemales and a single male, Kuang said.

He added that the cubs’ names will be chosenin late September in accordance with a Chinesetradition that states that babies should be namedexactly 100 days after being born.

The South China tiger is the oldest sub-species of tigers and is also the most endangered,with less than 100 of the animals remaining in theworld. All surviving South China tigers havebeen bred in Chinese zoos.

Kuang said that captive breeding is difficultbecause of inbreeding, low reproductivity andgenetic degeneration.—Xinhua

Likewise, the governmentshouldering executive power is to firmlybelieve democratization process forpeace and development.

The UN MillenniumDeclaration in 2000 says that allgovernments in the world are to

uplift democratization process, en-sure rule of law, and value humanrights and fundamental freedom inaddition to development rights.

Judicial bodies, democraticbodies, are to function freely stayingaway from corruption till rule of law indemocratization process is guaranteed.

In conclusion, the UN Chartersays that human rights, prevalence oflaw and order and democratic practicesare interrelated with each other.Observance of International Day ofDemocracy is attributed to theresolution of 62nd UN GeneralAssembly. And he urged the entirepeople in the Republic of the Union ofMyanmar to introduce democraticpractice as a treasure.

regular session of the United NationsHuman Rights Council at Geneva ofSwitzerland on 13 September.

The following is the full text of hisspeech:Madame President,

Today, I am here in your midst tohighlight the importance that theGovernment of Myanmar attaches tothe work of the United Nations HumanRights Council.

As you are well aware, a

constitutional government has beenformed recently in Myanmar. In hisinaugural speech, the President of theRepublic of the Union of Myanmaroutlined the policies and objectives ofthe new government with a view tobuilding a modern and democraticnation. The priorities of the newgovernment are to achieve goodGovernance, clean government,fundamental rights of the citizens, ruleof law, transparency, accountability,fight against corruption, reduction ofincome disparity, creation of aharmonious society, economic reform

and environmental conservation.Immediately after its formation, the

Government has begun launching aseries of economic, social and policyreforms to improve the socio-economiclife of the people.Madame President,

The first step in the implementationof these reforms is the adoption of theNational Rural Development andPoverty Reduction Plan in eight priorityareas. The President has instructed eightgovernment ministries to implementthe national action plan. After thesuccessful implementation of this plan,

the current poverty rate of 26 per centis expected to drop to 16 per cent by theyear 2014-15 in order to meet theMillennium Development Goals by2015.

One of the bold steps taken by theGovernment for the welfare of thepeople is the increase in pensionallowances for retired service personnel,commensurate with the changingeconomic and social conditions of thecountry. As a result, over 815,000retired service personnel are nowbenefitting from this measure.
