After a 7-year hiatus, AREA returns to Reno,

Nevada for its 2014 Annual Conference,

‘Foundation and Integration – How not to

gamble with the bottom line – your opinion.’

In the words of Stephen Stills, “There’s battle lines

being drawn. Nobody's right if everybody's wrong.”

Foundation: The introductory evidence

necessary to establish the admissibility of other

evidence. Foundations are the preliminary proof

required to admit evidence. An objection to

foundation tests the legal sufficiency of the proof

offered to qualify the evidence for admission.

Such a well focused foundation objection is

necessary to allow the judge to evaluate the

merits of the disputed evidence, and to allow the

opponent a reasonable opportunity to correct the

insufficiency.

Integration: An act or instance of combining into

an integral whole, pertaining to, or belonging as a

part of the whole; constituent or component:

integral parts; necessary to the completeness of

the whole; consisting or composed of parts that

together constitute a whole.

Gamble: To lose or squander by taking a chance;

venture; risk.

About “AREA”

American Rehabilitation Economics Association

Established in 1989, AREA has pursued two

missions: bringing recognition to the combined

use of vocational rehabilitation and economic

loss assessment as a distinct discipline, and

providing a peer-exchange forum for vocational,

economic and rehabilitation experts who practice

within this growing field. Our role is to determine

the nature and extent of any loss, from a

vocational and/or economic perspective. This, in

turn, helps the Court in its assessment of

damages. AREA supports professional growth by

offering opportunities for continuing education at

its Annual Conference. AREA also participates in

conference sessions held with other vocational,

economic and rehabilitation organizations to

encourage the sharing of knowledge among

related forensic professionals.

This intermediate boot camp will focus on preparing the

earnings analyst to understand and present the essential

components of basic, science-based economic loss reports.

Emphasis is on using available economic and vocational

evidence to construct a solid loss assessment report. The

boot camp emphasizes report preparation, beginning with

identification of all resources relied on, the basis for an

earnings outlook, the preparation of damage spreadsheets,

the calculation of present value, the explanatory narrative,

and an effective presentation.

returns to extrapolate demonstrated earnings in self-

information to application of (1) demonstrated self-

employment earnings versus (2) earning capacity in the open

and competitive labor market. The audience will participate

interactively, while being guided through the process of

clinical judgment in electing base-line assumptions,

compilation of supporting evidence for the assumptions and

methodology, and application to present value tables for both

(1) and (2). Time permitting there may be discussion

Vocational evaluation is a complex process requiring

assessment not only of the individual, but also of the labor

market. Within the interaction between the person and the

labor market rests the unique vocational potential that each

individual possesses. In forensic vocational evaluation,

conclusions regarding this interaction must have an

adequate foundation that can be testified to within a

“reasonable degree of vocational certainty.” This program

will link forensic vocational evaluation methodology with

essential elements for building a solid foundation to support

forensic conclusions. The presentation will provide a brief summary

of the evaluation models that have been published for this purpose.

The issue of variability in vocational assessment and research

conducted to identify key variables for assessment will be

discussed. The lecture will round out with a discussion of the

Vocational and Rehabilitation Assessment Model (VRAM) which is

an empirically derived structural model of vocational assessment.

Attendees will be provided multiple handouts to include the VRAM

model, research bibliography, and research abstract of findings.

There are two types of tracing methods that can be performed in

family law cases. Direct tracing involves the basic concept of

“following the money.” The objective is to track one asset to

another, searching for any concealed assets and identifying all

assets in a marital estate. The other tracing method involves

dividing a comingled account into separate funds (i.e., a separate

inheritance deposited into a joint checking account used for

community property expenses). Both forms of tracing require

accumulating, analyzing and presenting large amounts of data in a

comprehensive, compelling and concise format. This presentation

will demonstrate the various methods and techniques utilized in

order to uncover hidden assets or trace separate property in a

comingled account.

George A. Barrett is a practicing forensic economist and vocational evaluator in the Charleston, West Virginia office of Brookshire Barrett & Associates LLC. In his forensic practice, Mr. Barrett calculates economic damages and provides expert testimony in a wide variety of civil litigation cases in numerous jurisdictions across the nation. Primarily, these cases include lost earning capacity, lost household services, and cost of future medical care valuation appraisals in personal injury and wrongful death cases. As a forensic vocational evaluator, Mr. Barrett is qualified to conduct client interviews and vocational testing related to the assessment of post-injury earning capacity in personal injury litigation. During his practice, Mr. Barrett has provided expertise in several notable cases, including Virginia Richardson, a/k/a Tammy Wynette v. Marsh, et. al., U.S. District Court for the Middle District of Tennessee at Nashville, Patricia Bragg, et. al v. Col. Dana Robertson, et al. (Mountaintop Mining), U.S. District Court for the Southern District of West Virginia at Charleston, and the Sago mining cases. Mr. Barrett's research on incremental cost issues of life care planning, medical monitoring, punitive damages, and other aspects of forensic vocational economics has been published in numerous peer-reviewed journals and textbooks. Mr. Barrett is currently an adjunct professor of Rehabilitation Counseling at Minnesota State University, Mankato and has previously served as an adjunct instructor of Economics at West Virginia State University.

Mr. Barrett graduated magna cum laude from West Virginia State University, earning a Bachelor of Arts (BA) Degree in Economics. He then went on to earn a Master of Business Administration (MBA) Degree from Marshall University. Mr. Barrett completed the Master of Science in Rehabilitation Counseling (MSRC) Degree from West Virginia University and achieved the professional designation as a Certified Rehabilitation Counselor (CRC) and Certified Vocational Evaluation Specialist (CVE). Mr. Barrett serves on the board of referees for the Journal of Forensic Economics and the Journal of Legal Economics. He also served on the Board of Directors of the

American Rehabilitation Economics Association and was Editor for a time of that organization's peer reviewed journal, The Earnings Analyst.

Neil Bennett has more than 30 years’ experience assessing and evaluating persons involved in the receipt of disability management benefits. He is a graduate of The Evergreen State College and Western Washington University with a Masters’ of Education in Counseling; he is both a Certified Rehabilitation Counselor and a Certified Disability Management Specialist. He has served as Director and President of IARP, Commissioner of CDMSC and is currently an active direct service professional at OSC Vocational Systems, performing vocational assessments and wage earning capacity evaluations, including economic damages evaluations, in the Longshore and Harborworker, State of Washington Worker’s Compensation and civil litigation jurisdictions, as well as for the Social Security Administration and Veterans Administration. He became interested and involved in the American Rehabilitation Economics Association in 2011 joining and beginning presenting in Seattle, WA. He has recently served on the Ethics Committee involved in the development of the Ethics Complaint Appeals process. He is the current AREA VP-Internal, responsible for Ethics and Conference.

Constantine M. Boukidis is a partner with the economic consulting firm of Vavoulis, Weiner & McNulty (“VWM”). Located in downtown Los Angeles, VWM provides corporate and legal professionals with expertise in forensic accounting, business investigation and financial forecasting and analysis. Mr. Boukidis has provided expert testimony on business litigation and commercial damages, personal injury, wrongful death, employment matters, wrongful termination/failure to promote, construction defect, marital dissolution, lost profits, wage and hour claims, future cost of care, pension valuation and disability benefits. He has testified in over 150 depositions and 100 trial and arbitrations working on behalf of both the plaintiff and defendant. Prior to joining the firm in 1997, Mr. Boukidis practiced law in the greater Los Angeles area, starting his career with the Law Offices of David M. Harney representing plaintiffs, primarily in the medical negligence area. Thereafter he had his own law practice, again representing plaintiffs in the personal injury/wrongful

death area, primarily involving cases of medical malpractice. He was lead counsel on numerous cases during the 12 years he actively practiced. Mr. Boukidis graduated from Northwestern University in 1981 with a BA degree in economics. He earned his juris doctor degree from Loyola Law School of Los Angeles in 1984 and his MA degree in economics from California State University, Los Angeles in 2003. Jon Herbert Burkman received his Ph.D. in economics from the University of Pittsburgh in Pittsburgh, Pennsylvania. Over the past 35 years his work has included academic research and teaching at several colleges and universities, employment as an economic analyst for two large corporations, and, for the past 25 years, serving as an expert witness in economics. In 1987 he founded his economics consultancy, J. Herbert Burkman and Associates, in Dallas, Texas, to provide insight into economic issues for attorneys seeking expertise in damage assessment and loss analysis. He has testified in federal and state courts on more than 250 occasions.

Since 2004 he has been an Adjunct Professor of Economics at Southern Methodist University, where he currently teaches courses in Cost-Benefit Analysis and Monetary Policy. These courses cover a variety of topics, including effective forecasting, determining present value, and the macroeconomic determinants of interest rates and the money supply. Additional current research includes examining issues in corporate responsibility, business behavior and ethics, and economic growth. Earlier research has included a study of the history of the role of the textile industry in the post-World War II development of manufacturing in Japan and Hong Kong, and the impact of vocational training programs on persons seeking entry to the labor force. As he began his career at the University of Pittsburgh, Dr. Burkman was a National Defense Education Act (NDEA) Fellow. His NDEA Fellowship led to his Ph.D. in Economics and a Graduate Certificate in Asian Studies, including four years of instruction in Mandarin Chinese and an additional 24 credit hours in Asian economic development, Asian politics and culture, anthropology, and history.

In his career Dr. Burkman has also taught courses in economic theory, statistics, money and banking, public policy, and international economics. He is a member of several professional organizations, including the American Rehabilitation Economics Association, National Association of Forensic Economics, and the American Economics Association. He is currently a member of the World Affairs Council of Dallas-Fort Worth and the Rotary Club of the Park Cities (Texas).

He and his wife, Alicia, have lived in Dallas for the past 30 years, where they raised their two children. Dr. Burkman and his wife are long-term supporters of the Dallas Opera and the Dallas Opera Guild, the Dallas Symphony, the Dallas Arts Museum, the Nasher Sculpture Center, and the Kimbell Art Museum (Fort Worth). In his leisure time he enjoys traveling with his wife, attending lectures and concerts, and reading about contemporary economic issues and world affairs.

Ms. Clapp has worked in the vocational rehabilitation industry since 1990. She holds an MA in Professional Clinical Counseling with a Certificate of Advanced Graduate Studies in Professional Counseling from Ottawa University-Phoenix, Arizona, and a BS in Communications from Northern Arizona University with a minor in Economics. She is responsible for the supervision of other rehabilitation professionals including one Bilingual Employment Specialist and one Employment Specialist/Labor Market Consultant in Phoenix, Arizona. She has been a vocational consultant, labor market consultant and expert witness with her corporation since April 1999, specializing in counseling, assessment, evaluation, and

job placement services of individuals with diminished capacity to compete in the labor market as a result of accident, illness or environmental conditions, and maintains an ongoing caseload of clients. She provides the above-cited services to employers, insurance carriers, attorneys, physicians, governmental agencies, and private individuals. She also participates in the evaluation of economic consequences of disability related to a variety of situations, being dually certified to perform both the vocational and economic components of earning capacity analysis. Ms. Clapp has been qualified as a vocational expert before Federal and Superior Court and Industrial Commissions of Arizona and California from 1991 to present.

Outside of the profession, Ms. Clapp is an avid equestrian and enjoys horseback riding and outdoor activities in the desert hills and mountains of north Phoenix and Carefree, Arizona.

He has operated as principal of his company, SPC Consulting, Inc., since December 2005, providing personal and small business accounting services and advice. Concurrently, Steve has functioned as the office and financial manager for Arizona Vocational Consulting & Forensic Services, Inc. Steve is an avid mountain and trail bicyclist, and enjoys regular workouts at the gym. He and his wife Lisa have two adult sons.

Edward Foster is Professor emeritus of Economics at the University of Minnesota, where he taught from 1961 to 2008 and held several administrative posts. He served on the Minnesota Council of Economic Advisers (advisory to the Minnesota Commissioner of Finance) from 1984 to 2013. Consulting clients have included the Office of Tax Analysis of the U. S. Treasury Department, the U. S. Bureau of the Budget (now Office of Management and Budget), the

Federal Reserve Bank of Minneapolis, the U. S. Attorney’s office (Minneapolis), the Minnesota Attorney General’s Office, the Twin Cities Metropolitan Council, private attorneys (for about 2,000 cases in Federal and state courts), corporations and trade associations. Current research and consulting are focused on litigation support for plaintiffs and defendants relating to personal injury (including life care plans), wrongful death, employment issues, and lost profits.

Dr. Foster received his Ph.D. in economics from MIT following a year of graduate study in actuarial science at Occidental College, Los Angeles. Most of his research and publications have been in the application of economic theory to issues of public policy and in forensic economics. He is past president of the National Association of Forensic Economics. Other involvement with forensic economic associations has included membership in AAEFE and AREA, manuscript reviewer for the association journals and participation in FE conferences as presenter, discussant, and co-organizer.

Anthony M. Gamboa, Jr. is a Senior Vocational Economic Analyst for Vocational Economics, Inc., a forensic vocational economic consulting company. He received his Ph.D. from The Ohio State University, specializing in vocational counseling. He completed postdoctoral study in vocational rehabilitation and the economics of disability at the University of Cincinnati, University of Louisville, Purdue University, and University of Nevada at Las Vegas. In addition, he completed post-doctoral study at The University of Chicago where he was awarded an MBA.

Dr. Gamboa has worked for over 30 years as a vocational counselor, researcher, tenured professor at the University of Louisville, vocational expert with the U.S. Department of Health and Human Services, and vocational economic analyst. He is the author and co-author of numerous scholarly articles published in a variety of refereed journals. He is a frequent speaker to professional groups interested in the economics of disability.

Dr. Gamboa pioneered work in the area of assessing loss of earning capacity for infants, children, and persons with mild traumatic brain injury. In 1987, while on sabbatical as a professor at the University of Louisville, he developed the first worklife expectancy tables for persons with a disability. The New Worklife Expectancy Tables are in their seventh revision. The most recent revision of the Tables are titled The Gamboa Gibson Worklife Expectancy Tables and were published by Trial Guides in 2010. In addition, he developed Vocational Assessment of Lost Earnings (VALE), a computerized vocational information system comprised of government data, to assess earning capacity in cases of disability. He has provided Vocational Economic Assessments

Sonia Paquette trained in occupational therapy both at the bachelors and doctoral level (McGill University 1987, Rocky Mountain University of Health Professions, 2007) and as an ergonomist (Industrial engineering school, Polytechnical Institute of Montreal, 1993). In Canada, where she lived most of her life up until 2005, she was providing expert consultation services in return to work capacity especially as it pertained to job-match, as well as in product-related causal injury relationship. In the United States, she learned how to expand her services to include vocational potential and earning evaluation through multiple conferences attendance and obtaining a graduate certificate in forensic consultation in rehabilitation (Minnesota State University of Mankato) in 2010. A non-traditional occupational therapist since 1987, she was certified as a professional ergonomist by the BCPE in 1996, as a diplomate member of ABVE in 2007, and became a professional member of AREA in 2010. She came standard with a curious spirit, which has not killed her yet, but then again, she is not a cat.

Dr. Rick Robinson has over 15 years’ experience providing vocational, and disability consultation in both litigated and non-litigated settings. He has extensive experience as an expert in both civil and administrative settings, having provided expert testimony in several hundred hearings, trials and depositions. Dr. Robinson is nationally certified in rehabilitation counseling, vocational evaluation, and life care planning. He is board certified by the National Board for Certified Counselors and as a Diplomate by the American Board of Vocational Experts. He is state licensed in Florida as a Mental Health Counselor. He holds a doctoral degree in Rehabilitation Science from the University of Florida, and a masters degree in Business Administration from Regis University. His research interests are focused on forensic rehabilitation analysis, methodologies, and models. He has published over a dozen peer reviewed articles related to forensic vocational rehabilitation services. He is also the editor of the 2014 textbook Foundations of Forensic Vocational Rehabilitation. He is the president of Robinson Work Rehabilitation Services Co., a private vocational and rehabilitation consulting firm in Jacksonville, FL. He is also the lead faculty instructor for the University of Florida’s post-graduate certificate program in forensic vocational rehabilitation.

Taxicabs and Limousines: The Airport is within a 10-minute cab or limo ride of all the major hotels in the area. Taxi and limousine services are provided by these companies and are available to customers on-site. The passenger waiting area for taxis and limousines is located outside of the D Doors located North of Baggage Claim.

Airport Shuttle: Paid Shuttle Service is provided by these companies. The Airport Mini Bus counter can be found inside the A and B Doors located West of Baggage Claim. North Lake Tahoe Express is near Door C and South Tahoe Express is located adjacent to Door D in Baggage Claim. Complimentary Hotel Shuttles run every 15 minutes to the Silver Legacy and stop along the curb, outside the D Doors located North of Baggage Claim, to pick up passengers. When you see your shuttle, please approach the vehicle and board. Be advised the shuttle may not stop in front of you.

City Bus: Service is provided by RTC Ride between the airport and downtown Reno. The city bus pick-up and drop-off location is at the north end of the center curb, outside of Baggage Claim. Please follow the directional signs posted. Bus Route 19, which includes a stop at the Reno-Tahoe International Airport, operates Monday through Friday. The bus schedule to and from the airport, is posted at the bus stop, as well as in baggage claim, adjacent to the Regional Information Booth. T he husband of our own Chris Hughes of DeVinney and

Dinneen, Greg Gardella, was born and raised here in Reno.

Greg and Chris brainstormed together to share some pointers with

our attendees as to location ideas and easy (quick) access for

lunches and nighttime dinner/entertainment (aside from what is in the

Silver Legacy and surrounding Casinos – the Silver Legacy is huge!).

“For example, there’s a lot of good dining/entertainment closer to the

Silver Legacy than the Nugget, but it might be a matter of what’s

playing/going on during that time. “I think one of the best restaurants

still in town is the Steakhouse at Harrah’s (but pricey) which is

closer.

“Our newly renovated area of town not far from the Silver Legacy,

MidTown, is really booming right now and has some great places to

shop and eat, especially during the summer as they have a lot of

outdoor seating (we have cool high desert nights here in Reno –

dress in layers). It’s just minutes from the Legacy.

In 1859, Charles Fuller built a log bridge across the

Truckee River and charged a fee to those who passed

over it on their way to Virginia City and the gold

recently discovered there. Fuller also provided gold-

seekers with a place to rest, purchase a meal, and

exchange information with other prospectors. In 1861,

Myron Lake purchased Fuller's bridge, and with the

money from the tolls, bought more land, and

constructed a gristmill, livery stable, and kiln. When the

Central Pacific Railroad reached Nevada from

Sacramento in 1868, Lake made sure that his crossing

was included in its path by deeding a portion of his

land to Charles Crocker (an organizer of the Central

Pacific Railroad Company), who promised to build a

depot at Lake's Crossing. On May 9, 1868, the town

site of Reno (named after Civil War General Jesse

Reno) was officially established. Lake's remaining

land was divided into lots and auctioned off to

businessmen and homebuilders.

The Lake Mansion is one of Reno's oldest surviving

homes. Built in 1877 by William Marsh and purchased

by Lake in 1879, the Lake Mansion originally stood at

the corner of California and Virginia Streets. In 1971, it

was moved to save it from demolition and today the

Lake Mansion serves as a small museum on the

corner of Arlington Avenue and Court Street.

At the turn of the century, Nevada Senator Francis

Newlands played a prominent role in the passage of

the Reclamation Act of 1902. The Newlands Reclama-

tion Project diverted Truckee River water to farmland

east of Reno, prompting the growth of the town of

Fallon.

The residence of Francis Newlands, built in 1889, is

one five National Historic Landmarks in Nevada.

Because Nevada's economy was tied to the mining

industry and its inevitable ups and downs, the state

had to find other means of economic support during

the down times. Reno earned the title "Sin City"

because it hosted several legal brothels, was the

scene of illegal underground gambling, and offered

quick and easy divorces.

Nystrom House, built in 1875 for Washoe County Clerk

John Shoemaker, is also significant for its role as a

boardinghouse during Reno's divorce trade in the

1920s. The Riverside Hotel, designed by Frederic

DeLongchamps, was built in 1927 specifically for

divorce-seekers and boasted an international

reputation.

In 1927, in celebration of the completion of the Lincoln

Highway (Highway 50) and the Victory Highway

(Highway 40), the state of California built the California

Building as a gift for the Transcontinental Exposition,

held at Idlewild Park.

The Mapes Hotel was built in 1947 and opened for

business on December 17th of that year. It was the

first high-rise built to combine a hotel and casino,

providing the prototype for modern hotel/casinos. The

building went vacant on December 17, 1982, 35 years

to the day after it opened. The Reno Redevelopment

Agency acquired the property in 1996, and sought a

developer to revitalize the building. After four years of

failed attempts to find a cost-effective way to save the

structure, the Mapes was demolished on January 30,

2000.

This brief history of Reno highlights only a few of the

many treasures that make up the unique history of

"The Biggest Little City in the World." To own an

historic property is to own a piece of a shared

history. Because the craftsmanship and fabrication

processes that created them are no longer available,

historic structures are nonrenewable resources and

rely upon the efforts of their owners to ensure they

survive into the future.

a CEA and/or CRE must attend at least one (1) AREA

conference every three (3) years in order to recertify. Upon

written request, CEAs and CREs may ask for a one-time

one-year extension of this requirement for a fee of $100.

AREA’s History and Purpose

Established in 1989, AREA has pursued two missions: bringing

recognition to the combined use of vocational rehabilitation and

economic loss assessment as a distinct discipline, and providing

a peer-exchange forum for vocational, economic and

rehabilitation experts who practice within this growing field.

Currently, AREA is the only international certifying body that has

the unique blend of professions in loss assessment. Additionally,

it is the first to establish a Registry of both Forensic Vocational

and Forensic Economic Experts.

As forensic experts, AREA members offer opinion and testimony

in a wide variety of cases. Often they involve some type of injury,

which has resulted in an alleged loss of earnings or loss of

earning capacity.

Our role is to determine the nature and extent of any loss, from a

vocational and/or economic perspective. This, in turn, helps the

Court in its assessment of damages.

Economic and vocational experts identify what the person could

have earned prior to the incident, compared to what they are

likely to earn following the incident. Economic experts calculate

the value of those earnings over time, so the difference, if any,

between the two income streams is clearly understood. Those

who act as vocational/economic experts blend the two disciplines,

and offer testimony in both arenas.

Personal injury, medical malpractice, product liability, wrongful

death, wrongful termination, and discrimination in employment

form the bulk of the cases evaluated for vocational and economic

loss by AREA members. Life care planning, marital dissolution,

Social Security disability, maritime, railroad, ADA, and workers

compensation casework are additional member specialties. www.a-r-e-a.org

A REA members generally hold at least a Masters

degree in a vocational, economic or related field

(not required for Associate membership or Student

membership). The majority of members have several

national certifications and/or state licenses in their

specialization. Most are active in other forensic

organizations, and many have published or taught in

vocational/economic fields.
