HOV Lane

An HOV lane is any preferential lane on a freeway, other highway or street, or independent roadway on a separate right-of-way designated for exclusive use by vehicles with 2 or more occupants for all or part of a day.

HOT LanesHOT lanes are HOV lanes that are modified to allow vehicles not meeting the minimum occupancy requirements to use the lane by paying a fee.- Maintains the commitment made to Carpool and Transit users of the facility

Legislative Authority for HOV and HOT Lanes

• Federal Legislation– 23 CFR, Section 166– HOV Facilities– Definition of an HOV Lane– Allowed Exceptions:

• Motorcycles• Inherently Low Emission Vehicles (ILEV)• Tolls for vehicles with less than the required

occupancy (HOT)• Public Transportation Vehicles (modified by FAST Act

Express Toll Lane• Exclusive lane that provides an actively

managed level of service through variable pricing and requires all users to pay a toll

• More similar to a traditional toll lane but:– It is only a limited number of lane(s) of a

roadway facility– Tolls are variable during the day in

response to roadway conditions• It differs from a HOT lane by:

– Carpools must pay the toll too, although it may be discounted

• Tends to be new capacity, have greater revenue generation, accelerate construction

Legislative Authority for Express Toll Lanes

• Under previous Federal Legislation– Express Toll Lane (ETL) Demonstration Program -

SAFETEA-LU Section 1604 (b)– Value Pricing Pilot Program (VPPP)

• Under FAST Act– ETL are allowed on new capacity: Under 23 U.S.C.

129(a)(1)(C), a new lane that is to be initially constructed may be tolled so long as the total number of toll-free non-HOV lanes, excluding auxiliary lanes, after construction is not less than the number of toll-free non-HOV lanes, excluding auxiliary lanes, before construction.
