SELECTION OF THE CATERING CONTRACTOR FOR THE CANTEEN FOR THE STUDENT &STAFF OF

GOVERNMENTPOLYTECHNIC, NAYAGARH,ODAGAON.

1.Nature of Work:-

The Government polytechnic Nayagarh,Odagaon shall resort to the process of selection

of a catering contractor for the Canteen for Students, Faculty and Staff in the campus of

Government polytechnic Nayagarh,Odagaon.

2. LAST DATE AND TIME FOR AVAILABLITY OF BID DOCUMENTS:

From 04.07.2014 to 14th July 2014(2.00PM). on working days(10AM to 5.00PM) from the office

of the principal Government Polytechnic,Nayagarh,Odagaon.or can be downloaded from the

website www.governmentpolytechnicnayagarh.org & WEB SITE:-www.nayagarh.nic.in

From 04.07.2014 to 14th July 2014(2.00PM). 3.LAST DATE & TIME FOR RECEIPT OF BIDS:

July 2014(2.00PM).at the office of the principal Government Polytechnic,Nayagarh,Odagaon.

4. DATE TIME & VENUE OF OPENING OF BIDS:

i) Technical Bid:-3.00pm on 14.07.2014.

ii) Financial bid:- 4.00pm on 14.07.2014. the bidders who qualify in Technical bid can only participate

in the financial bid.

iii) Venue of Opening of the bid:- Office of the principal Government Polytechnic,Nayagarh,Odagaon

5. EARNEST MONEY DEPOSIT(EMD): AN EMD of Rs.5000/-(Rupees five thousand)only

deposited in shape of a Demand Draft from any Nationalized Bank drawn in favour of Principal,

GovernmentPolytechnic,Nayagarh,Odagaon.payble at Odagaon .The EMD of the un-successful

Bidder will be returned within two months without intrest from the last date of submission of the tender.

The EMD of the successful Bidder will be kept till the final execution of the tender.

6. PREPARATION AND SUBMISSION OF BIDS:

Tenderers interested in the above mentioned contract are required to submit their EOI

documents in the following manner.

a. Technical bid containing the documents as per proforma given in the EOI document.

b. Financial bid containing the rates/price in the proforma given in the EOI document.

c. The cost of EOI document being Rs.500/(Rupees five hundred ) only should be deposited in

shape of Demand Draft of any Nationalized Bank drawn in favour Principal,

GovernmentPolytechnic,Nayagarh,Odagaon.payble at Odagaon. AN EMD of Rs.5000/-(Rupees five

thousand)only deposited in shape of a Demand Draft from any Nationalized Bank drawn in favour of

Principal, GovernmentPolytechnic,Nayagarh,Odagaon.payble at Odagaon should be furnished with

the Technical bid.

d) Documents relating to Technical bid and Financial bid should be submitted in two separate

envelopes super scribed as “Technical bid” & “Financial bid”. Both the envelopes should be

placed in a third sealed envelopes super scribed as “ EOI for Catering Service (Canteen)” and

must reach the Office of the Principal Government polytechnic Nayagarh,Odagaon .on or before

14.07.2014(2.00pm). SUBMISSION OF TECHNICAL & FINANCIAL BID IN A SINGLE LEAD TO

DISQUALIFICATION.

7.DURATION &TIME OF AWARD & COMMENCEMENT OF THE CONTRACT:-.

i. The contract shall be for a period of six month from the date of award of contract and will be

renewed every six month,extendable upto 03(three) years on mutually agreeable conditions.

ii. The period of acceptance of the bid shall remain valid for a period of 60 days from the date of

opening of the EOI.

iii. The contract shall be awarded after execution of Agreement between the successful bidder

& the Principal Government Polytechnic,Nayagarh,Odagon on 15th July 2014 and the

Catering service work shall commence from 18th July 2014. The dates may shift due to any

kind of unforeseen problems that may occur.

8). GENERAL RULES PERTAINING TO THE DAILY FUNCTIONING OF THE CANTEEN:

I. CANTEEN TIMINGS: :( In all seven week days during the six month of contract)

Lunch : 1:00 PM to 3:00 PM

Dinner : 8:00 PM to 9:30 PM

Menu(within the contract cost of the lunch &dinner) as decided by the Canteen committee(to be

constituted by the principal Government Polytechnic,Nayagarh,Odagaon by officeOrder/ Notification)

will be strictly followed .

9. BRANDS OF CONSUMABLES PERMISSIBLE IN CANTEEN MEANT FOR STUDENTS ,

10. GENERAL STRUCTURE OF THE CANTEEN MENU.

The following is the general structure of the menu. The detailed menu is provided as follows.

Lunch

(Menu-1).Rice (200gm), or four Chapatti (dia 6”,without Ghee),Dal(50 gms),One veg Curry(250

gms), with approximate 70ml quantity of Salad, one veg fry (minimum 120gms) one Papad of

medium size .

(Menu-2). Rice (200gm), or four Chapatti (dia 6”,without Ghee),Dal(50 gms), One special curry

(Paneer or mushroom) (250 gms), with approximate 70ml quantity of Salad, one veg fry (minimum

120gms) one Papad of medium size .

(Menu-3). - Rice (200gm), or four Chapatti (dia 6”,without Ghee),Dal(50 gms) , with approximate

70ml quantity of Salad, one veg fry (minimum 120gms) ,Chicken Curry/ Fish curry of standard

quantity (net 80gms apart from gravy) or Egg Curry (2 Eggs).

Dinner

11) GENERAL CONDITIONS OF CONTRACT

i) The canteen and its premises shall be kept clean and tidy.

ii) The garbage, peel-offs etc. should be disposed of regularly at own cost of the catering contractor.

iii) The Canteen staff of the contractor should maintain personal hygiene.

iv) The kitchen equipments, utensils, dishes, spoons, cups, saucers of durable nature

should be cleaned with good quality cleaning agent.

v) The contractor should follow all statutory law imposed by the Government of Odisha. like labour

laws, EPF regulations, ESI etc.

vi) The staff of the canteen shall be the sole staff of the contractor and no relationship of

employer and employee shall exist between Government Polytechnic,Nayagarh,Odagaon and

such staff.

vii) The manager and staff should be very courteous to the students, Faculties and staff

and extend necessary assistance during canteen time.

viii) The Contractor shall indemnify the Institute in case of any penalty imposed by any

public/Government Authority for violation of any rule or breach of peace.

ix) The space shall be provided for Dinning kitchen & store by the Government

Polytechnic,Nayagarh,Odagaon free of cost.

x) The electricity charges shall be on metred basis.

xi) The water charges shall be on fixed basis.

xii) The Catering Contractor shall arrange all the equipment/materials/furniturelike,dinning table,

dinning chair(branded pvc made),utencils, tray, plates, spoons, glasses, aquagard,cooking gass&

cooking range or any other materials required to run the canteen services as per the terms &

condition laid in the contract document.The principal Government Polytechnic no way responsible

for disruption in canteen services due to non availability of any kind of logistic support.

xiii) The bidders before submitting the EOI should put their signature and seal in all

pages of EOI document.

xiv) The successful bidder shall have to furnish Performance Security amount Rs.50,000/(Rupees

Fifty thousand)only- in shape of TDR/Bank Guaranty of any Nationalised Bank valid for the period

of contract + 60 days without fail or else the award of contract cannot be issued to the successful

bidder.In case of renewal of the contract the TDR/Bank Guaranty will be renewed accordingly.

xvi) The Technical Bid envelope will be opened first. If the Bidder qualifies in the technical Bids,

then the financial bid envelope of that Bidder shall be considered for that opening. The financial Bid

of the unsuccessful bidder shall not be opened and shall be kept in the file with the signature of

the all committee member with a remark “Not opened because of the dis-qualification in the

Technical Bid”.

12. SPECIAL CONDITIONS OF CONTRACT i. The Canteen Committee or any authorised officer shall inspect the food and the

premises of the Canteen at any point of time with or without notice.

ii. Local taxes if any shall be borne by the Contractor.

11) The Principal Government Polytechnic,Nayagarh,Odagaon, reserves the right to cancel the

any or all the EOI without assigning any reason thereof.

13.) Penalty Clause.

The caterer will be fined in case of violation of the following rules

i. Non-availability of complaint register on the counter/discouraging students from

registering complaints would lead to a fine of Rs.2,000/- on the caterer.

ii. Or more complaints of insects and/or foreign object cooked along with food found in

any food item would invite a fine of Rs. 4,000/- on the caterer.

iii. Or more complaints of unclean utensils in a day would lead to a fine of Rs. 4,000/- on

the caterer.

iv. If Canteen committee agrees that certain meal was not cooked properly then a fine of Rs.

4,000/- would be imposed on the caterer.

v. If food for any meal gets over within timings of mess and waiting time is more than 15

minutes for lunch and dinner, then a fine of Rs.2,000/- would be imposed on the caterer. The timing

for that meal will be extended equivalent to delay time.

vi. Changes in menu of any meal without permission of Canteen committee would result in a

fine of Rs. 4,000/- on the caterer.

vii. Fine on any discrepancy (personal hygiene of workers, misbehavior by workers etc.) will

lead to fine of Rs. 4,000/- on caterer for every instance.

viii. For any rules stated in the agreement,

- First violation of the rule implies fine as per the rule.

- Second and subsequent violations of the same rule within 30 days of previous fine will

attract triple the initial amount of fine on the caterer.

ix. Absence of proprietor or his representative empowered to take decision from Canteen

Committee meetings on due invitation (which will be held once every month) will attract a

fine of Rs. 5,000/- on caterer.

x. As and when Canteen Committee proposes a fine it will inform the representative of the caterer

or Canteen manager and fine will be imposed with consent of the Principal Government

Polytechnic,Nayagarh,Odagaon.

xi. Using of brands not mentioned in the contract without prior permission and adulteration

shall invoke a hefty fine beyond the limit of any fine mentioned above and decided by the

Canteen Committee with consent with the Principal Government Polytechnic,Nayagarh,Odagaon.

. and legal action deemed fit will be initiated against the caterer.

xii. Severity of hygiene failure shall be assessed and decided by the Canteen Committee and fined

appropriately. In case of gross failure/negligence a severe penalty will be imposed, which

could be a hefty fine as cash and/or summary termination of the Contract.

13. TERMINATION OF CONTRACT:-

I) The contract is liable to be cancelled with 60 days’ notice if the caterer fails to

maintain the expected quality of food and/or cleanliness and general hygiene in

the mess/kitchen premises.AND VFAIL TO FULFILL THE TERMS&

CONDITION LAID IN THE EOI CONTRACT

II) In case the caterer seeks to terminate the contract, he/she shall give minimum

90 days’ prior notice in writing to the principal. Government

Polytechnic,Nayagarh,Odagaon.

14.LEGAL:-

i. In the event of any dispute arising in respect of the clauses of the agreement the same shall be

resolved through negotiation. Alternatively the dispute shall be referred to the next higher authority

or controlling officer for his decision and the same shall be binding on all parties.

ii. In case either party is aggrieved on the decision of next higher authority, the jurisdiction of the

Court shall be at Nayagarh (Name of Dist H.Q) in the district of Nayagargh, (Name of District)

Odisha. Neither Party shall be competent to bring any case / Suit in regard to the matters covered by

this Agreement before any Court of Law Outside Nayagarh (Name of Dist. H.Q).

the same in conformity with the Provisions of the agreement; And whereas the “Authority” has finalized the rate as per the terms and conditions of the agreement to the “Canteen services”.

ix) The space shall be provided for Dinning kitchen & store by the Government

Polytechnic,Nayagarh,Odagaon free of cost.

x) The electricity charges shall be on metred basis.

xi) The water charges shall be on fixed basis.

xii)The Catering Contractor shall arrange all the equipment/materials/furniturelike,dinning table,

dinning chair(branded pvc made),utencils, tray, plates, spoons, glasses, aquagard,cooking gass&

cooking range or any other materials required to run the canteen services as per the terms &

condition laid in the contract document.The principal Government Polytechnic no way responsible

for disruption in canteen services due to non availability of any kind of logistic support.

xiii) The bidders before submitting the EOI should put their signature and seal in all

pages of EOI document.

xiv) The successful bidder shall have to furnish Performance Security amount Rs.50,000/(Rupees

Fifty thousand)only- in shape of TDR/Bank Guaranty of any Nationalised Bank valid for the period

of contract + 60 days without fail or else the award of contract cannot be issued to the successful

bidder. In case of renewal of the contract the TDR/Bank Guaranty will be renewed

accordingly.

6. SPECIAL CONDITIONS OF CONTRACT i. The Canteen Committee or any authorised officer shall inspect the food and the

premises of the Canteen at any point of time with or without notice.

ii. Local taxes if any shall be borne by the Contractor.

11) The Principal Government Polytechnic,Nayagarh,Odagaon, reserves the right to cancel the

any or all the EOI without assigning any reason thereof.

13.) Penalty Clause.

The caterer will be fined in case of violation of the following rules

i. Non-availability of complaint register on the counter/discouraging students from

registering complaints would lead to a fine of Rs.2,000/- on the caterer.

ii. Or more complaints of insects and/or foreign object cooked along with food found in

any food item would invite a fine of Rs. 4,000/- on the caterer.

iii. Or more complaints of unclean utensils in a day would lead to a fine of Rs. 4,000/- on

the caterer.

iv. If Canteen committee agrees that certain meal was not cooked properly then a fine of Rs.

4,000/- would be imposed on the caterer.

v. If food for any meal gets over within timings of mess and waiting time is more than 15

minutes for lunch and dinner, then a fine of Rs.2,000/- would be imposed on the caterer. The timing

for that meal will be extended equivalent to delay time.

vi. Changes in menu of any meal without permission of Canteen committee would result in a

fine of Rs. 4,000/- on the caterer.

vii. Fine on any discrepancy (personal hygiene of workers, misbehavior by workers etc.) will

lead to fine of Rs. 4,000/- on caterer for every instance.

viii. For any rules stated in the agreement,

- First violation of the rule implies fine as per the rule.

- Second and subsequent violations of the same rule within 30 days of previous fine will

attract triple the initial amount of fine on the caterer.

ix. Absence of proprietor or his representative empowered to take decision from Canteen

Committee meetings on due invitation (which will be held once every month) will attract a

fine of Rs. 5,000/- on caterer.

x. As and when Canteen Committee proposes a fine it will inform the representative of the caterer

or Canteen manager and fine will be imposed with consent of the Principal Government

Polytechnic,Nayagarh,Odagaon.

xi. Using of brands not mentioned in the contract without prior permission and adulteration

shall invoke a hefty fine beyond the limit of any fine mentioned above and decided by the

Canteen Committee with consent with the Principal Government Polytechnic,Nayagarh,Odagaon.

. and legal action deemed fit will be initiated against the caterer.

xii. Severity of hygiene failure shall be assessed and decided by the Canteen Committee and fined

appropriately. In case of gross failure/negligence a severe penalty will be imposed, which

could be a hefty fine as cash and/or summary termination of the Contract.

7. TERMINATION OF CONTRACT:-

I) The contract is liable to be cancelled with 60 days’ notice if the caterer fails to

maintain the expected quality of food and/or cleanliness and general hygiene in

the mess/kitchen premises.AND FAIL TO FULFILL THE TERMS&

CONDITION LAID IN THE EOI CONTRACT

II) In case the caterer seeks to terminate the contract, he/she shall give minimum

90 days’ prior notice in writing to the principal. Government

Polytechnic,Nayagarh,Odagaon.

8.LEGAL:-

i. In the event of any dispute arising in respect of the clauses of the agreement the same shall be

resolved through negotiation. Alternatively the dispute shall be referred to the next higher authority

or controlling officer for his decision and the same shall be binding on all parties.

ii. In case either party is aggrieved on the decision of next higher authority, the jurisdiction of the

Court shall be at Nayagarh (Name of Dist H.Q) in the district of Nayagargh, (Name of District)

Odisha. Neither Party shall be competent to bring any case / Suit in regard to the matters covered by

this Agreement before any Court of Law Outside Nayagarh (Name of Dist. H.Q).
