We can see lot of agitations in Andra pradesh after 2018 budget announcement by central Govt(by FM Sri Arun Jaitly).

During Andra Pradesh bifurcation, Central govt had promised that it would support Andhra pradesh financially by providing special package(not special status)

And, PM Sri Narendra Modi and FM Sri Arun Jaitly also told many times that they would assist Andhra Pradesh financially.

So that I would like to know how mach money has been granted/assisted by Central Govt to the state Andra Pradesh(not for Telangana) after bifurcation as a special package. ie„ from 2014 to till date.

Please provide the details with date and sector wise.

Sorry if I ask a wrong question but as a common man, I want to know in which direction India is going whether forward direction or backward direction.

Information under Right To Information Act. 2005

Point (1) to (11)

The Central Government has directed the State Government to establish DMF for the interest and benefit of persons, and areas affected by mining operations in such manner as may be prescribed by the State Government. The composition and functions of District Mineral Foundation shall be such as may be prescribed by the State Government under Section 9B of MMDR Act 1957.

The Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) is required to be implemented by the District Mineral Foundations (DMFs) of the respective districts using the funds accruing to the DM under the directions issued section 20A of MMDR Act on 16.09.2015 to all States to incorporate the 'Pradhan Mantri Khanij Kshetra Kalyan Yojana' into the rules framed by them for the District Mineral Foundations.

The copies of the Govt. of India Gazette notification and order are enclosed.

Further, it is informed that the DMF is to be funded by Statutory contributions from holders of mining lease. Rules specifying rates of contribution to DMFs have been notified on 17.09.2015. The contribution to DMF has been made effective from 12.1.2015 i..e. the date from which the Mines & Minerals (Development and Regulation) Amendment Act, 2015 has come into force.

The DMF is to be funded in the following manner:

(a) 10% of royalty in respect of mining leases granted on or after 12.1.2015 and (b) 30% of royalty in respect of mining leases granted before 12.1.2015.

The Hon'ble Supreme Court has delivered its judgment on 13.10.2017 in Transferred Case (Civil) No. 43 of 2016- Federation of Indian Mineral Industries vs. Union of India and others, wherein effective date of contribution to be made by the holder of a mining lease or a prospecting-cum-mining lease in respect of minerals other than coal, lignite and sand for stowing and in the case of coal, lignite and sand for stowing has been changed in the following manner:

(a) 10% of royalty in respect of minerals other than coal, lignite and sand for stowing with effect from 17.09.2015: and 10% of royalty in respect of coal. lignite and sand for stowing with effect from 20.10.2015 or with effect from the date on which DMF was established by the State Government by a notification,

whichever is later (for the mining leases or prospecting-cum-mining leases

granted before 12.01.2015).

(b) 30% of royalty in respect of minerals other than coal, lignite and sand for stowing with effect from 17.09.2015; and 30% of royalty in respect of coal, lignite and sand for stowing with effect from 20.10.2015 or with effect from the date on which DMF was established by the State Government by a notification, whichever is later (for the mining leases or prospecting-cum-mining leases

granted after 12.01.2015).

2. The information sought by you with reference to the details of all DMF is not maintained centrally. You are advised to approach the State Government

ORDER

WHEREAS in terms of the provisions of sub-section (1) of section 9B of the Mines and Minerals (Development and Regulation) (MMDR) Act, 1957 (67 of 1957), the State Governments shall, by notification, establish a District Mineral Foundation in every district in

the country affected by mining related operations.

AND WHEREAS mining related operations largely affect less developed and very remote areas of the country, and vulnerable sections of the population, especially Scheduled Tribes, therefore, it is especially necessary that special care and attention is devoted, in an organized and structured manner so as to ensure that these areas and affected persons are benefitted by the mineral wealth in their regions and are empowered to improve their standard of living.

AND WHEREAS in terms of sub-section (3) of section 9B, the rules for the functioning of the District Mineral Foundations are to be prescribed by the State Governments.

AND WHEREAS the Central Government, on a careful consideration of the matter, is of the opinion that the national interest requires that all District Mineral Foundations should implement a development programme for the mining affected areas that includes a certain minimum provision for the social and infrastructure needs of the population and area, and the Central Government has, accordingly, framed the Pradhan Mantri Khanij Kshetra Kalyan Yojana to be implemented by the District Mineral Foundations from the funds accruing to

them in terms of the MMDR Act, 1957.

NOW THEREFORE the Central Government in exercise of the powers conferred under section 20A of the MMDR Act. 1957. in the national interest hereby directs the concerned State Governments to incorporate the "Pradhan Mantri Khanij Kshetra Kalyan Yojana' (the details of which are annexed herewith) into the rules framed by them for the District Mineral Foundations and to implement the said Scheme.

(6) Notwithstanding anything contained in sub-sections (2). (3) and sub-section

(4). the period of lease granted before the date of commencement of the Mines and Minerals (Development and Regulation) Amendment Act, 2015, where mineral is used

for other than captive purpose. shall he extended and be deemed to have been extended up to a period ending on the 31st March. 2020 with effect from the date of expiry of the period of renewal last made or till the completion of renewal period. if any. or a period of liftsyears from the date of grant of such lease. whichever is later. subject to the

(7) Any holder of a lease granted, whew mineral is used for captive purpose.

shall have the right of first refusal at the time of auction held for such lease after the

expiry of the lease period.

(8) Notwithstanding anything contained in this section, the period of mining

leases. including existing mining leases, of Government companies or corporations

shall he such as may be prescribed by the Central Government.

(9) The provisions of this section, notwithstanding anything contained therein.

shall not apply to a mining lease granted before the date of commencement of the

(6) The holder of a mining lease granted before the date of commencement of the Mines and Minerals (Development and Regulation) Amendment Act., 2015, shall, in addition to the royalty. pay to the District Mineral Foundation of the district in which

the mining operations are carried on. an amount not exceeding the royalty paid in terms

of the Second Schedule in such manner and subject to the categorisation of the mining leases and the amounts payable by the various categories of lease holders, as may be

prescribed by the Central Government.

2, 3 and 4 Only Govt. of Rajasthan and Andhra Pradesh have submitted their action plans on 16.01.2018 and 19.12.2017 respectively. Copy of the same is attached.

5. Govt. of Andhra Pradesh vide their letter dated 19.12.2017

(copy attached) has respond to the said DO letter and provided the Action plan as per above row.

With regard to point no-(1)

Section 15 of the Mines and Minerals (Development and Regulation) Act,1957

empowers the State Governments for making rules for regulating the grant of quarry leases, mining leases or other mineral concessions in respect of minor minerals and for purposes connected

therewith.

With regard to point no-(2-3)

Section 15(g) of the Mines and Minerals (Development and Regulation) Act,1957 empowers the State Governments for the fixing and collection of rent, royalty, fee, dead rent, fines or other charges and the time within which and the manner in which these shall be payable. Therefore you are requested to approach the public authority concerned of the State Government.

I would like to inform you that my own Khasra No 11 and 12 is located in Revenue Village Bhagwanpur Tehsil and District Meerut whose total area is 17 Kaccha Begha approx Apco Infrastructure Limited is constructing National Highway No 235 inni-5-7------cririage one Years ago Apco Infrastructure Limited took on lease my farm khasra number 11 and 12 60000 rupees per kaccha bigha to lift the soil and with the company it was decided that after lifting the clay the company would level my farm and pay 60000 rupees per kaccha bigha according but today even after passing a year the company did not level my farm And no payment has been made till date today and When I say to the employees of the company to level my farm They behave indecently with us Sir the big pit has been made in my farm by the company and did not level my farm by the company till now due to which I have not been able to grow any crop from a year


Q1 If a construction company leases a land of a farmer to lift out the soil and after lifting the soil upto depth of 2 meters the company did not level the farmars land And no payment has been made till date In this situation who is responsible for leveling fanners land •

Q2 In this situation Farmer can file a lawsuit against the construction company under which section of the Mining Act

Q3 In this situation please clarify the responsibility of the mining department to protect the interests of the farmers • .•

Q4 If a company takes a farmers land to get 20000 cubic meters of ordinary soil then according to the mining act how much money will be paid to the farmer by the company
