ITEM NO.1: PUBLIC COMMENTS - NON-AGENDA ITEMS - REqUEST TO SIGN GUEST LIST: Chair Josi welcomed everyone and reminded them to sign the guest list. There were no public comments at this time. ITEM NO.2: PUBLIC WORKS UPDATE: Liane Welch said she and Jennifer Purcell met with the Department of Environmental Quality (DEQ) staff at the Boge sites last week. Both Maryann Boge and Randy Boge are making progress on their solid waste violations. Ms. Welch said Johnson Bridge will be closed on September 21 st for three (3) weeks. There will be notice in the paper. She asked if the commissioners were on the radio, to please announce it. Ms. Welch reported the contractor started removing the Boulder Creek culvert on Friday. Commissioner Hurliman said we have an old issue with a farmer on Blankenship Road who has been farming in the right-of-way and manure ends up on the road. Staff has been out to talk with him but nothing has been resolved. At some point we need to tell him if he does not clean it up we will clean it up and charge him. Commissioner Hurliman suggested a court injunction if they could not collect from him. Ms. Welch said people are calling and coming to see her. She agreed the next step is code enforcement. She will go and visit him.

ITEM NO.1: PUBLIC COMMENTS - NON-AGENDA ITEMS - REqUEST TO SIGNGUEST LIST: Chair Josi welcomed everyone and reminded them to sign the guest list.There were no public comments at this time.

ITEM NO.2: PUBLIC WORKS UPDATE: Liane Welch said she and Jennifer Purcellmet with the Department of Environmental Quality (DEQ) staff at the Boge sites lastweek. Both Maryann Boge and Randy Boge are making progress on their solid wasteviolations.

Ms. Welch said Johnson Bridge will be closed on September 21 st for three (3) weeks.There will be notice in the paper. She asked if the commissioners were on the radio, toplease announce it.

Ms. Welch reported the contractor started removing the Boulder Creek culvert onFriday. Ms. Welch reported they are continuing to do the in-stream work project on GiengerRoad and are fixing Lewis Creek Bridge on Slab Creek Road.

al CONSIDERATION OF CONTRACT FOR GOODS WITH NORSTAR INDUSTRIES,INC. FOR PURCHASE OF CHEMICAL INJECTION SPRAYER: Ms. Welch said sheasked Dave Schrom to do a cost analysis on the weed spray program for CommissionerHurliman.

Dave Schrom referred to the Vegetation Control Cost/Benefit Analysis (see attached)and explained how he determined the cost for chemicals per mile. He talked with staffat Polk County to get their feelings on contracting out. With a staff of ten (10) theycontract out everything that they can. It is working well for them.

Mr. Schrom said there is a raw financial savings to contract out the work. Thependulum swings to keep the program in-house with customer service. Polk Countyisn't getting complaints but they do not have face-to-face contact with citizens. This is aservice that is not quantifiable but public works is working diligently to overcome a poorpublic image and this is one of best programs we have to do that.

Mr. Schrom stressed that they want to continue handling vegetation management in­house. It is a valuable community outreach and public relations tool and a necessarymaintenance function. Our staff is more than up to the charge to do it and there aresignificant benefits for having the truck for dust control, watering and washing signs.They can apply the rental charges towards the purchase of the truck.

Ms. Welch introduced Mike Wynands, vegetation manager. She complimented him onhis work and said she would definitely like to keep the program in-house.

Mr. Wynands said he has noticed that the number of organic producers is increasing.Staff has talked about using the truck for de-icing this winter.

Commissioner Hurliman asked if we have the same capability as the contractor who cantell what kind of spray they should use by area, by GIS and the weather forecast. Mr.Wynands said everything is noted down strictly on paper. Every road is noted for themileage sprayed with the type and amount of chemical and weather condition. The newtruck is set up to be able to take the same GIS equipment to which CommissionerHurliman referred. He hopes to be able to download the truck's information to the officecomputer so that the log will be available at the end of the day.

Commissioner Hurliman said he thought the job they are doing is great. Whateversystem we go with, recordkeeping needs to be kept in mind. We need to change ourpolicy around organic farming. He thought the program could be run from inside thecounty but the community wants to see more contracting.

Chair Josi asked Commissioner Hurliman and Vice-Chair Labhart if they would supportthe purchase. Commissioner Hurliman said he would not.

Vice-Chair Labhart verified the contract includes the Twelve Thousand ($12,000)Dollars we spent to rent it. He estimated it costs about Fourteen ($14) Dollars more permile to spray versus going to contract. With mowing brush and grass they would spendSeven Thousand One Hundred Sixty-Eight ($7,168) Dollars more on average if theywent in-house. In answer to a question Ms. Welch said their budget is Two Million($2,000,000) Dollars. They can use the equipment for other things such as a watertruck.

Vice-Chair Labhart said the group felt strongly that the program should continue in­house. He thanked Mr. Schrom for his work and analysis.

Mr. Wynands asked who would visit the farmers and others if it was contacted out. Mr.Schrom said they do most of the work at night. They would need one (1) year workingwith Mr. Wynands to program all the information into their computer system and talk tothe no spray people. Ms. Welch said if there is a complaint she would have to tell thepeople to talk to the contractor, which she did not like.

Vice-Chair Labhart said philosophically he liked contracting and then explained why hewould support the staff's request. Chair Josi agreed with Vice-Chair Labhart and listedhis reasons for supporting the request.

A motion was made by Vice-Chair Labhart to approve and sign the Contract for Goodswith Norstar Industries, Inc. to purchase the chemical injection sprayer. The motion wasseconded by Chair Josi. The motion carried with two (2) aye votes. CommissionerHurliman voted nay. The commissioners signed the contract.

ITEM NO.3: DISCUSSION AND CONSIDERATION OF OUT-OF-STATE TRAVELREQUEST FOR LT. ANDY LONG TO ATTEND THE NATIONAL INSTITUTE OFJUSTICE CORRECTIONS TECHNOLOGY INSTITUTE IN BALTIMORE, MARYLAND:Andy Long said he entered this competitive process and won. There is no cost to thecounty. He wants to apply the technology to shorten the audit process and make it aweb based audit for the jail.

A motion was made by Vice-Chair Labhart to approve the Out-of-State Travel Request.Commissioner Hurliman seconded the motion and verified there was no car rental orother expenses involved. The motion carried with three (3) aye votes. Chair Josisigned the request form.

ITEM NO.4: DISCUSSION AND CONSIDERATION OF SUBMISSION OF GRANTAPPLICATION FOR TRANSIENT ROOM TAX ALLOCATION FUNDING TO THE CITYOF TILLAMOOK: Gordon McCraw said it costs us about Twenty Thousand FiveHundred Sixty ($20,560) Dollars per year for the river gauges. This year there is a littleover Ten Thousand ($10,000) Dollars budgeted. He is trying to come up with ideas onhow to close the gap. The Tillamook Estuary Partnership and the Tillamook BayHabitat and Estuary Improvement District have given some money. Two (2) partneragencies brought this idea to his attention.

Chair Labhart said he was not going to support it because transient room tax funds aresupposed to be used for tourism, promotion and advertising. There is a veryacrimonious discussion occurring in the city on how to use this tax money. He supportsthe river gauges and appreciated Mr. McCraw going after grant money.

Mr. McCraw agreed with Chair Labhart that it is a stretch. Commissioner Hurliman saidpeople expect safety when they come to the coast. He verified that this is notsomething the county is telling the city to do and did not see anything wrong in askingfor the money.

Commissioner Josi said he understands the huge political fight that has been going on.He wondered if we get thrown into it, will we get any of the negative matter falling on usand if by not applying we would jeopardize the grant funds from the partner agencies.Mr. McCraw said the parties that suggested it were heavy contributors this time.

There was a discussion on how the city benefits from the river gauges.

A motion was made by Commissioner Hurliman to support the grant application fortransient room tax allocation funding to the City of Tillamook. The motion wasseconded by Chair Josi. The motion carried with two (2) aye votes. Vice-Chair Labhartvoted nay.

ITEM NO.5: DISCUSSION CONCERNING AMENDMENT #1 TOINTERGOVERNMENTAL AGREEMENT #3967 BETWEEN STATE OF OREGONDEPARTMENT OF CORRECTIONS AND TILLAMOOK COUNTY FORTRANSITIONAL SUPPORT SERVICES: Jana McCandless said this biannualagreement has been coming for several bienniums for funds to support people comingout of prison to get acclimated back into to the community. She will explain how theprogram works at the Wednesday meeting. This item will be moved forward to theWednesday meeting.

ITEM NO.6: DISCUSSION CONCERNING MODIFICATION #1 TO LEASEAGREEMENT #3941 WITH TILLAMOOK FAMILY COUNSELING CENTER FOROFFICE SPACE FOR THE CHILD ABUSE MULTIDISCIPLINARY INTERVENTION(CAMII PROGRAM: Lt. McCandless said she has been writing this grant for the pasttwelve (12) or thirteen (13) years. It funds an interview room to investigate child abuse.The interviews are taped. It changes the lease for two (2) years, the length of the grant.The amount did not go up. This item will be moved forward to the Wednesday meeting.

ITEM NO.7: DISCUSSION CONCERNING THE APPOINTMENT OF JENNY BURTTO THE COMMISSION ON CHILDREN AND FAMILIES: Marlene Putman said this isin anticipation of some terms expiring in December. The Commission interviewed Ms.Burt and would like to have her. This item will be moved forward to the Wednesdaymeeting.

ITEM NO.8: DISCUSSION CONCERNING ORDER DECLARING A KONICA 7020COPIER SURPLUS AND DONATING IT TO CASA OF TILLAMOOK COUNTY. INC.:Ms. Putman said she does not remember where this copier came from and how long wehave had it. Court Appointed Special Advocates (CASA) has borrowed it for a fewyears. This Order would donate it officially. This item will be moved forward to theWednesday meeting.

ITEM NO.9: DISCUSSION CONCERNING THE 2009-2011 GRANT AGREEMENTWITH THE OREGON STATE BOARD OF HIGHER EDUCATION ON BEHALF OFTHE UNIVERSITY OF OREGON FOR THE UNIVERSITY OF OREGON SCHOOL OFLAW FOR COMMUNITY DISPUTE RESOLUTION PROGRAMS: Ms. Putman said thiscontract is for Twenty-Seven Thousand Five Hundred Sixty-Three ($27,563) Dollars.We have had a contract with them for several bienniums to provide conflict resolutionfor the county. This item will be moved forward to the Wednesday meeting.

UNSCHEDULED: Ms. Putman reported that the State Commission on Children andFamilies proposed a new funding allocation for Healthy Start that reduces our amountby fifty-six (56%) percent for this biennium. We were successful in working with thecounseling center to find billable services through the program that will offset the twenty

(20%) percent reductions, but we were not ready for a fifty-six (56%) percent reduction.She requested that Vice-Chair Hurliman send a letter from the commissioners to thestate commission explaining the impact of the cuts and what we are doing locally to tryto off set the cost.

Vice-Chair Hurliman said they wouldn't get anything without writing the letter and theymight get something if they do. Ms. Putman said she will have the letter ready fortomorrow's meeting.

ITEM NO. 10: COMMUNITY DEVELOPMENT UPDATE: al PERMIT REPORT and blSANITATION REPORT: Butch Parker said building permit numbers are staying up.We are meeting our target budget. Commissioner Hurliman asked about the five (5)investigations. Mr. Parker said he can find out what the particulars are for thecommissioners.

The commissioners have two (2) orders tomorrow to complete their actions in thedecision on vested rights for the Iseri and Kuntz properties.

Mr. Parker said there was a discussion with some people about the Short Term RentalOrdinance so he thought we are on the right track. Andy Neal wants him to write acommentary for their realtor newspaper that will go out before the October i h hearing.Chair Josi said he thought Mr. Parker did a good job on the "Think Out Loud" program.

Mr. Parker said a former employee was at the Oceanside Citizen's Planning AdvisoryCommittee (CPAC) on Saturday and talked about Goal 1 citizen involvement and ageohazard report that they have been having trouble with. Sarah Absher was at themeeting; he was not. He felt it is wrong for a former employee to show up at a CPACmeeting and talk about things that affect the county but recognized that anyone canshow up and give testimony. He asked for guidance.

Commissioner Hurliman felt this was very serious and he would probably check withCounty Counsel and then have a chat with the individual. Vice-Chair Labhart agreedthat it is extremely inappropriate but we don't have control over a former countyemployee. The individual should have said this is a county issue and if they haveconcerns to bring it up with county staff. Commissioner Hurliman said he wanted toknow what the next step would be. Chair Josi suggested visiting the individual and seeif they can come to an understanding.

After further discussion Mr. Parker said he would talk to the individual, the CPAC Chairand keep the commissioners updated.

ITEM NO. 11: HUMAN RESOURCES UPDATE: Dave Dickman and Mona Hamblenwere present. Ms. Hamblen said she had a requisition for a fulltime fee collectorposition for the parks department. The employee in the position left and the parksdepartment decided not to fill this position until the end of the year. Melissa Harmontook over the duties of the position. They want to recruit for this position so Ms. Harmoncan continue in the office manager position.

Del Schleicher! said they felt it made good sense until the hectic summer period hadpassed to train someone new to take reservations. Now they have six (6) months tofind and train someone before the next busy May through September season.

Vice-Chair Labhart verified that it is a budgeted position. There was consensus toapprove the requisition.

After a discussion with Mr. Dickman, the Board decided to have an executive session atthe end of this meeting regarding library and health department issues.

ITEM NO. 12: DISCUSSION CONCERNING RESOLUTION PROCLAIMING THEMONTH OF SEPTEMBER AS "PAIN AWARENESS MONTH" IN TILLAMOOKCOUNTY: Commissioner Josi said Christy Vail requested this resolution. This item willbe moved forward to the Wednesday meeting.

ITEM NO. 13: FACILITIES, FLEET AND CONTRACTS DIRECTOR UPDATE: Mr.Levesque had no items to report.

ITEM TAKEN OUT OF ORDER ITEM NO. 15: BOARD CONCERNS - NON-AGENDAITEMS & ANNOUNCEMENTS: Vice-Chair Labhart reported the State Fair ended lastnight. He asked the commissioners to sign a letter to Dale and Jackie Buck, CliffJensen, Harold Strunk and Kitty Poore who played significant roles in putting the countybooth together. The commissioners agreed it was impressive. Vice-Chair Labhart willprepare a letter for signature on Wednesday.

ITEM NO. 14: STAFF UPDATE/CALENDAR REVIEW & SCHEDULING/AGENDAREVIEW/SUGGESTION BOX/INTER-OFFICE MATTERS: The Board reviewed andapproved the agenda with the addition of the two (2) letters previously mentioned.

Sue Becraft announced the next staff meeting on Tuesday, September 15 and verifiedthat there would be a quorum. The evening meetings begin in October. Thecommissioners decided not to have an evening meeting in November.

Ms. Becraft said we are recruiting for one (1) position on the Parks and RecreationAdvisory Committee. In addition, David Plawman's term is expiring. Consensus was tore-appoint Mr. Plawman.

Ms. Becraft said Fr. Ray Ferguson has resigned from the Northwest Oregon HousingAuthority (NOHA). The commissioners decided to put an ad in the newspaper andindividually recruit for the position.

Ms. Becraft said the commissioners' budget for workshop and conferences is down toOne Thousand ($1,000) Dollars, not enough for the Association of Oregon Counties(AOC) Conference. After some discussion, Commissioner Hurliman said he will notattend, Vice-Chair Labhart said he can drive back and forth from Portland and ChairJosi could probably stay with relatives in Portland.

Ms. Becraft said there were no suggestions in the suggestion box.

ITEM NO. 16: PUBLIC COMMENTS: There were none. Chair Josi asked JohnGettman if he would like to serve on the NOHA Board. Mr. Gettman said he would thinkabout it.

Chair Josi recessed the meeting at 10:20 a.m. to go into executive session pursuant toORS 192.660(2)(f) to consider information of records that are exempt by law from publicinspection.

Chair Josi reconvened the meeting at 10:32 a.m. after the executive session. Hearingno further business Chair Josi adjourned the meeting at 10:32 a.m.

BOARD MEETINGS AND ANNOUNCEMENTS

LABOR DAY is an observed holiday for Tillamook County, as well as the Circuit Court. All of the offices inthe Courthouse will be closed on Monday, September 7,2008.

The Commissioners will hold a Workshop on Monday, September 21, 2009 at 1:00 p.m. to discuss coastalerosion issues in the Neskowin area. The Workshop will be held in the Neskowin Fire Station at 48000Highway 101, Neskowin, Oregon.

Commissioners' Staff Meetings are held on Monday except for the second week each month when it is heldon Tuesday. The second Tuesday, Staff Meeting schedule through December 2009 is as follows:

RE: Vegetation Control Cost 1 Benefit Analysis

Purpose: To analyze the difference between providing roadside vegetation control "in house"verses hiring a contractor to perform the work. The analysis compares the workcurrently being performed by Tillamook County, and the work being performed forPolk County by Washburn Contract Services.

Outcome: Justification for purchase of a new spray truck to facilitate continuation of "in-house"Vegetation Control

Cost per Mile:This is a somewhat difficult comparison to draw. What cannot be directly accounted for are thedifferences in weather conditions, width of area being sprayed, product being applied, anddensity of the application. For analysis purposes, the average cost 1 lane mile Tillamook Countyspends on chemicals will also be used for Polk County, and the same chemical cost per lanemile will be used for brush control and for grass control.

Tillamook County sprays an average of 512 lane miles per year. Of those lane miles, 169(33%) are sprayed for brush control, and 343 (67%) are sprayed for grass control.In 2009 we spent 300 man hours spraying 560 lane miles. A wage mix of $40 1hour producesan average raw labor figure of $21.421 mile - however brush spraying takes about 34% more

labor per mile than grass spraying. For calculation purposes, we will use a labor cost of $24.00/ mile for brush spraying and $18.00/ mile for grass spraying. The truck we want to purchasehas a value of $50,000 and a life span remaining of a minimum of 15 years. This adds $3,334 /year, or $6.51 / mile. We are also assuming maintenance, fuel, insurance etc. adds anadditional $3.25/ mile. This brings our labor and equipment costs to approximately $33.76/mile for brush control and $27.76/ mile for grass control. Add in the chemical costs of $32.20 /mile and it is a total cost per lane mile of $65.96 for brush control and $59.96 for grass control.

Polk County sprays an average of 700 lane miles per year for brush, and 500 lane miles a yearfor grass. In 2009 the contract price with Washburn Services was of $20.00 / mile for brushcontrol and $13.50/ mile for grass control. Add in the chemical cost and the total cost per lanemile is $52.20 for brush and $45.70 for grass.

Performing the spraying in house costs approximately 20% more per lane mile for brush and25% more per lane mile for grass control.

Next, an analysis of the tasks included in this process should be evaluated.

Simply summarizing tasks, there appears to be some advantage to contract out the work, Asstated earlier, we spent 300 man hours spraying this year, and those hours could be spentdoing other jobs. There is also reduced liability associated with contracting out the work.

Where the advantage tends to swing towards County forces performing the work center aroundcustomer service. Public Works is working very hard to build an improved image and level ofaccountability with the public we serve, We are fortunate to have a person on staff that hastaken on ownership of the spray program, and demonstrated great personal pride in the work heperforms. He has coordinated with all of the no-spray people on a yearly basis, confirming theirdesires. He has worked closely with the organic farmers who are very sensitive to sprayapplications. He interacts with the adjacent property owners in a professional and helpfulmanner, and takes any extra time necessary to accommodate their specific needs. A monetaryvalue quite simply can not be assigned to this good will, and this value must be consideredwhen making this decision.

Tillamook County Public Works wants to continue handling vegetation management "in-house".It is a valuable community outreach and public relations tool we need to continue to utilize, It isalso a necessary maintenance function, and our skilled staff is more than up to the task ofperforming it. In order to best continue this program, we need to seize this opportunity to applythe rental charges we have incurred towards the purchase of this new spray truck.

On behalf of the U.S. Department of Justice (U.S. DOJ), I am pleased to inform you thatyou have been selected as a participant for this year's U.S. DOJ, National Institute ofJustice Corrections Technology Institute presented by NIJ's Office of Science andTechnology (NIJIOST). We congratulate you on your selection as a participant in thisyear's Institute. The selection process was very competitive; numerous applicants wereconsidered for the available positions. We are confident that the Institute will be aninteresting and highly beneficial educational experience for the attendees and that manynew professional contacts and resources will be developed through your participation.

The Institute will begin at 6:00 p.m., Sunday, September 20, 2009, and end at 12:00p.m. on Friday, September 25, 2009. The InterContinental Harbor Court Baltimore Hotel,located at 550 Light Street, Baltimore, Maryland, 21202, has been selected as the hostsite. Enclosed is the tentative agenda for the entire week of the Technology Institute(subject to change). Please note that you are required to attend the entire Institute.

Your travel, lodging, and per diem expenses will be paid for while you are participating inthe Technology Institute. Air travel and lodging expenses will be billed to a masteraccount to be paid by NIJ (see details in following paragraphs). Meals, groundtransportation and incidental expenses must be paid by the attendee, but will bereimbursed in compliance with the Federal Government per diem guidelines. Meals andincidental expenses will be reimbursed at the rate of $59 per day. the Wilson, Trask, and Tillamook Rivers routinely contribute to the flooding in the Cityof Tillamook. This flooding can and has adversely affected tourism by discouragingvisitors when conditions are expected to cause flooding, and by negative experienceswhen these tourist are already here, but significantly impacted by unexpected adverseweather conditions. To help mitigate some of these negative effects, the county hasentered into an agreement with the USGS to install and maintain several river monitoringgauges, which assist in research, modeling, and forecasting the flood events frequentlyimpacting the county and specifically the City of Tillamook. Within the next year, raingauges will be added to these gauge sites which will add more tools to the forecaster'stoolbox when making forecast, as well as provide additional data to the research andmodeling used by the different agencies to better recommend additional changes tofurther mitigate the flooding often experienced in the area. The improved forecasts alonewould provide better and more accurate planning and preparation abilities for all of thetourism businesses in Tillamook. This translates to maximizing tourism potential whileensuring their safety while here.

The above gauges and agreement costs the County, $20,560 annually and we hope youcan partner with the county by assisting with the cost of these gauges through the awardof this grant. Others already supporting the County include the Tillamook EstuaryPartnership and the Tillamook Bay Habitat Estuary Improvement District.
