Pune court transfers Bhima Koregaon case to NIA court PUNE: A Sessions Court here on Friday passed an order in Bhima Koregaon case, trans- ferring all records and further proceedings of the case to Special National Investigation Agency (NIA) court, Mumbai. All the accused in the case will be produced before the special court of NIA in Mumbai on Feb- ruary 28. The NIA had filed a petition in Pune's Sessions Court on Jan- uary 29 last month seeking transfer of the case to the agency's court in Mumbai. Earlier, the Maharashtra gov- ernment, in an application filed before the court, had objected to transferring all the court records, seized articles from the file of this court to an NIA court in Mumbai. A three-judge Bench of the apex court, headed by Chief Justice of India (CJI) Sharad Arvind Bobde passed the order on hearing Kar- ti's plea. He had moved the Supreme Court seeking its direction to go abroad for two weeks to attend a tennis tournament. The news of the new mid- night deadline came soon after the telecom department cancelled an order issued in January that barred officials from taking coer- cive action against the firms. The 23 January order, issued by a desk officer at the ministry, had angered three Supreme Court judges who summoned top exec- utives of the telecom companies and the telecom department on the next date of hearing. “A desk officer in the govern- ment stays a Supreme Court or- der...Is there any law left in the country?,” the bench led by Jus- tice Arun Mishra said. The government, which did not want officials to take any co- ercive action in light of the finan- cial stress in the telecom sector, had reversed its first order soon after. A few hours later, it issued the second order. “With reference to subject cited above, you are hereby di- rected to make the payment of outstanding dues of LF and SUC (license fee and spectrum usage charges) by 14.02.2020, 11.59 pm positively,” the second tele- com order to phone companies said. In October last year, the top court had ended a 14-year-long legal battle to rule in favour of the government which had insisted that companies could not exclude non-telecom revenue to calculate the fee to be paid to the excheq- uer. This implied that the license fee and spectrum usage charges would be calculated on the amount earned from all business dealings, including handset sales and other income. The companies had argued the fee should be based on income from only their telecoms business. AGENCY NEW DELHI, FEB 14 The Supreme Court on Friday issued a notice to the Centre and Jammu and Kashmir ad- ministration on the plea of National Conference leader Omar Abdullah's sister chal- lenging his detention under the Jammu and Kashmir Pub- lic Safety Act, 1978. A Bench headed by Justice Arun Mishra asked Jammu and Kashmir administration to file a reply by March 2. The apex court inquired whether any similar plea filed by any per- son is pending before the High Court. On this, senior lawyer Kapil Sibal, who is ap- pearing for Omar's sister Sara Abdullah Pilot, said "no". Later, while speaking to media reporters, Sara said she has full faith in the judiciary. "We were hopeful that, as this is a habeas corpus case, that the relief would be sooner. But we have full faith in the justice system. We are here because we want that all Kashmiris should have the same rights as all citizens of India and we are waiting for that day," she said. In her plea, Sara, wife of Rajasthan Deputy Chief Minister Sachin Pilot, said the order of deten- tion is manifestly illegal and there is no question of him be- ing a "threat to the mainte- nance of public order". She also said that exercise of pow- ers by authorities under the CrPC to detain individuals, including political leaders, was "clearly mala fide" to ensure that the opposition to the abrogation of Article 370 of the Constitution is "si- lenced". Supreme Court also said in its order that the medical reports stated that Vinay is psychologically fit and his medical condition is stable. The apex court dismissed his peti- tion, finding it de- void of merit. Vinay Sharma, one of the four death row con- victs in the Nirbhaya gang- rape case, had filed a writ pe- tition before the Supreme Court challenging the rejec- tion of his mercy petition by the President of India. On February 1, President Ram Nath Kovind had reject- ed the mercy petition of Vinay Sharma in the case. The mercy petitions of con- victs Akshay Thakur and Mukesh Singh have also been rejected. The Delhi High Court on February 5 granted a week's time to the four convicts to avail of all legal remedies available to them and said that the convicts cannot be hanged separately since they were convicted for the same crime. A Delhi Court had issued a death warrant against the four convicts -- Vinay Shar- ma, Akshay Thakur, Pawan Gupta, and Mukesh Singh -- on January 7 and they were scheduled to be executed on January 22 at Tihar Jail. Lat- er, the execution was sus- pended indefinitely by a Del- hi court. The case pertains to the gang-rape and brutalizing of a 23-year-old paramedical stu- dent in a moving bus on the night of December 16, 2012, by six people including a ju- venile in Delhi. Nirbhaya convict petition challenging rejection of mercy plea dismissed Justice R Banumathi faints during hearing NEW DELHI: Supreme Court Judge Justice R Banumathi fainted during the hearing in the 2012 Delhi gang-rape case in the apex court today. She was hearing the submissions made by the Cen- tre on separate execution of convicts in the case. She was taken into the chamber immediately after she fainted. The bench has adjourned the case and said that the order will be released later. Solicitor General Tushar Mehta said "Justice R Banumathi was having high fever and she still has high fever. She is being examined by the doctors in the chamber.

The process forthe payment of the first two in-stallments of Rs 2000 each (Rs4000) under the scheme has al-ready been started from Febru-ary 7 this year.

Small signboards on path-ways keep reinforcing it. Theonly sound that one hears, be-sides the sound of prayer andsinging of hymns, is that ofbirds chirping. It is the pea-cocks’ scream, even beforeour alarms, that wake us upby four in the morning.

The practice of such si-lence was drilled into us whenwe began the stricter part ofour priestly training — theNovitiate. “It is only throughcalming your mind andthoughts, not just your bod-

ies, and in the depth of innersilence of your heart will youdiscover God’s presence”,was what our novice masterconstantly reminded us. Any-one who broke silence with-out good reason ended upworking an extra hour inplace of sports.

In his book, “I want to seeGod”, Rev. Marie Eugenewrites, “God speaks in si-lence, and silence aloneseems able to express Him.For the spiritual person whohas known the touch of God,silence and God seem to beidentified”.

Again Robert CardinalSarah in his book co-authoredwith Nicolas Diat, “The Pow-er of Silence”, says, “At theheart of man there is an innatesilence, for God abides in theinnermost part of every per-

son. God is silence, and thisdivine silence dwells in man.In God we are inseparablybound up with silence. TheChurch can affirm thatmankind is the daughter of asilent God…”.

While mystics and saintsemphasise the importance ofsilence in one’s search forGod, modern day psycholo-gists suggest silence even astherapy.

For, it is in silence alonethat a person becomes awareof one’s deepest self and theproblems that lie in there, touproot causes of unhappinessand turmoil in the subcon-scious. No wonder then thatJesus, despite being busyteaching and healing peoplewas often found “escaping”into a quiet place to communewith God the Father.

Finance minister Nirmala Sitharaman had recently told Parlia-ment that green shoots in the Indian economy are clearly vis-ible and the steps taken by the Reserve Bank of India would

boost the growth further. In defence of the government’s econom-ic performance, Ms Sitharaman had cited improvement in foreigninflows, industrial growth, forex reserves, performance of the stockmarkets and tax collections under the Goods and Services Tax.

But little more than 24 hours later, another arm of the samegovernment — the ministry of statistics and programme imple-mentation — literally showed the mirror to the finance ministrythrough its monthly data which revealed that industrial growth hasagain shrunk while retail inflation has continued to shoot up to asix-year-high. These two data points show that the Indian economyis still not out of the woods and is firmly in the grip of stagflation.

Though industrial growth in December 2019 has shrunk by 30basis points, the situation would look more disconcerting if onelooks the details of the slowing industrial growth. There has been asecular contraction in all user-based segments except primary andintermediate sectors. The production of consumer durable goods,which is a barometer for consumer confidence in the economy, hascontracted by 6.7 per cent. Shrinkage in the production of consumernon-durable goods — by 3.7 per cent — shows that the people haverediscovered thrift in their lives. The production of capital goods,which has a direct correlation with the economy growth and jobcreation, has contracted by 18 per cent in December. When the pro-duction and demand remain muted, one wonders how the financeminister could expect higher tax revenue. This reaffirms the con-cerns of poor job creation in the country — a profoundly worrisomeprospect for a country of 130 crore people, a majority of whom areyoung. Components that fuelled retail inflation to a six-year-highof 7.59 per cent in January could have a longer lasting impact thanthose that stoked inflation in December. When inflation hit 7.35 percent in the previous month due to rise in vegetable prices, it was notconsidered a grave threat, as vegetable prices would get correctedquickly after higher production. In January, though, higher veg-etable prices remained the biggest contributor; the prices of pulses,meat and fish, eggs, spices, personal care products, transport andcommunication have spiked by more than six per cent. The pricesof some of these products may not decline very soon. A hike in theLiquefied Natural Gas prices, though its impact on consumers wassoftened by a higher subsidy, would also surely impact the govern-ment’s finances. The Narendra Modi government should not takethe economy for granted and let politics take it hostage. As ratingagency Standard and Poor’s said in its assessment, downward pres-sure on India’s sovereign credit ratings could emerge if the coun-try’s average economic growth over the next four years falls belowthe forecasted 7.1 per cent or if the general government deficit (in-cluding the Centre and states) rises or if political developments un-dermine the economic reform momentum. Let’s hope that thePrime Minister is listening.

These excesses are beingamplified by Donald Trump’ssingularly one-sided supportfor anything that Israel’sPrime Minister Benjamin Ne-tanyahu demands.

The general projection ofboth as heartless bullies auto-matically accelerates anti-Semitism. On February 14, 2019,a suicide car bomb at-tack on a CRPF con-

voy on the newly-rolled outhighway from Srinagar toQazigund led to a catastroph-ic loss of 40 Indian paramili-tary personnel returningfrom leave. It was the largestloss by a single act in the 30-year sponsored proxy hybridconflict in Kashmir. Follow-ing its well-established poli-cy of strategic denial, Pak-istan was quick to label theattack a “false flag opera-tion” by India.

The Indian response hadto meet a couple of parame-ters. First, it had to beginwith an action in the militarydomain to meet public senti-ments and political necessity.This was mandatory since alack of response would runhollow to the strategy the In-dian government had adopt-ed following the Uri terrorattack, which led to the sur-face-based surgical strikes ofSeptember 28, 2016.

Second, a diplomatic ini-tiative was necessary to neu-tralise the mounting Pak-istani falsehood which couldrun away with the cultivationof its narrative among the in-ternational community.Third, the escalation had tobe tightly under Indian con-trol. In such a situation, thepolitico-strategic aim of theIndian government appearedto focus upon conveying that

India could see through thenuclear bluff, would employa calibrated kinetic responseat a time and place of its ownchoosing, and display thewill to escalate if necessary.

Detailed deliberations onthe choice of response led tothe selection of a surgicalairstrike against the Balakottraining facility of Jaish-e-Mohammad (JeM), known tohouse a large number of ter-rorists under training, alongwith a seminary.

The strike, 13 days later,was professionally executedby the Indian Air Force.What many observers failedto notice about the strategyunderlying the Indian choiceof target, just as in the case ofthe surface-based surgicalstrikes in September 2016,was the major dilemma it

caused to the Pakistani lead-ership. The targets werepurely terror-related and de-spite intense links betweenthe Pakistan Army and theWest Punjab-based terrorgroups, the Indian responsedid not target any military fa-cility. In the case of the 2016surgical strikes, Pakistan re-sponded with a denial of anysuch strike having takenplace. In the case of the Bal-akot strike, it assiduouslylaunched a disinformationcampaign that there was noimpact of the airstrike. How-ever, with the confirmed en-try of the IAF into Pakistaniairspace, the Pakistani estab-lishment was forced to re-spond. The dilemma for Pak-istan was the choice of tar-gets. Since no sponsored ter-ror facilities exist in India,

the choice was limited to themilitary domain. A messageto the Pakistan public wasnecessary that an adequateresponse to the Indian actionhad been executed. In thebargain, Pakistan chose to doa sham entry by the PakistanAir Force across the LoC inthe Rajouri sector to dropsome munitions. The strate-gy for the sham entry waswell conceived and led to amismatched air battle, lead-ing to the shooting down ofan Indian MiG-21 Bison,with unconfirmed reports ofdowning of a PAF F-16 too.The escalation ended swiftlywith the hasty repatriation ofthe Indian pilot.

The events of February14-27, 2019 led to a spiral ofcontinuing activity that hasplaced Pakistan completelyon the defensive. This shouldbe seen through the prism ofthe political, diplomatic, mil-itary and psychological do-mains. Politically it hugelybenefited the NDA govern-ment in winning a secondterm, while diplomaticallythe measured Indian re-sponse only against terror in-frastructure and drawdownfrom escalation helped inmaintaining moral ascendan-cy. The Indian narrativeabout being one of the oldestvictims of trans-national ter-ror through the Pakistan-sponsored proxy hybrid warin J&K was received much

more positively in importantcapitals around the world.Militarily, the Indian Army’srobust response in SouthKashmir helped clean upseveral modules. All thisgave the Indian governmentthe political will and the con-fidence to take the next stepsin J&K, for which there hadbeen a clamour for long. Ear-ly in its tenure NDA 2.0 de-cided to act upon its long-prepared strategy for a polit-ical initiative.

On August 5, with un-precedented securityarrangements in J&K, thespecial constitutional provi-sions for J&K were legisla-tively annulled and the ad-ministrative setup of the staterestructured to carve out twoUnion territories — Ladakh,and Jammu & Kashmir. Asecond round of diplomacyby India ensured that the ex-traordinary initiative wasseen internationally as In-dia’s internal affair. Themanagement of the securitydomain was ensured throughtough measures. Withpreparatory work havinggone into this, the Pakistanicapability to calibrate its re-sponse to the initiatives waseffectively neutralisedthrough effective targeting ofmultiple networks, leader-ship and communication fa-cilities. In the bargain, Pak-istan was placed on the back-foot. For a change, the Indian

communications strategy forthe external domain ap-peared sound. The mentionof PoK and its re-integrationas the remaining agenda, andthe possible review of India’s“no first use” nuclear doc-trine, succeeded in sendingout a message of far bolderintent.

The continuum into 2020is seeing Pakistan psycho-logically on the backfootwith limited options to re-en-ergise J&K. Two other fac-tors are adding to the cascad-ing effect of the events of2019; first the Financial Ac-tion Task Force (FATF)scrutiny, and second, the rap-idly deteriorating economythat was bailed out in 2019through a $6 billion IMFpackage. The FATF processis leading to Pakistan at-tempting to showcase howmuch it has done in disman-tling terror financing andsponsorship. with actionslike pursuit of the caseagainst Jamaat-ud-Dawachief Hafiz Saeed.

What is working for Pak-istan as a silver lining, how-ever, is the developing situa-tion in Afghanistan, with apotential agreement betweenthe United States and the Tal-iban, brokered by Pakistan.If that happens, and whatev-er be the final long-term out-come, Pakistan will for sometime return to favour with the US.
