Article 4 Scope of application

1. 3. The export and import licence or authorization and accompanying documentation together shall contain information that, at a minimum, shall include the place and the date of issuance, the date of expiration, the country of export, the country of import, the final recipient, a description and the quantity of the firearms, their parts and components and ammunition and, whenever there is transit, the countries of transit. The information contained in the import licence must be provided in advance to the transit States.

4. The importing State Party shall, upon request, inform the exporting State Party of the receipt of the dispatched shipment of firearms, their parts and components or ammunition.

5. Each State Party shall, within available means, take such measures as may be necessary to ensure that licensing or authorization procedures are secure and that the authenticity of licensing or authorization documents can be verified or validated.

6. States Parties may adopt simplified procedures for the temporary import and export and the transit of firearms, their parts and components and ammunition for verifiable lawful purposes such as hunting, sport shooting, evaluation, exhibitions or repairs.

Article 11 Security and preventive measures

In an effort to detect, prevent and eliminate the theft, loss or diversion of, as well as the illicit manufacturing of and trafficking in, firearms, their parts and components and ammunition, each State Party shall take appropriate measures:

(a) To require the security of firearms, their parts and components and ammunition at the time of manufacture, import, export and transit through its territory; and

(b) To incre~lse the effectiveness of import, export and transit controls, including, where appropriate, border controls, and of police and customs transborder coopaation.

Article 17 Signature, ratification, acceptance, approva

In that instrument of ratification, acceptance or approval, such organization shall declare the extent of its competence with respect to the matters governed by this Protocol. Such organization shall also inform the depositary of any relevant modification in the extent of its competence.

Instruments of accession shall be deposited with the Secretary-General of the United Nations. At the time of its accession. a regional economic integration organization shall declare the extent of its competence with respect to matters governed by this Protocol. Article 18 Entry into force

I. This Protocol shall enter into force on the ninetieth day after the date of deposit of the fortieth instrument of ratification, acceptance, approval or accession, except that it shall not enter into force before the entry into force of the Convention. For the purpose of this paragraph, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by member States of such organization.

2. For each State Of regional economic integration organization ratifying, accepting, approving or acceding to this Protocol after the deposit of the fortieth instrument of such action, this Protocol shall enter into force on the thirtieth day after the date of deposit by such State or organization of the relevant instrument or on the date this Protocol enters into force pursuant to paragraph 1 of this article, whichever is the later.

I. After the expiry of five years from the entry into force of this Protocol, a State Party to the Protocol may propose an amendment and file it with the Secretary-General of the United Nations, who shall thereupon

de un certificado 0 la anotaci6n en un regi~tro en que se haga constar la desactivaci6n

del anna de fuego 0 Ia. inclusion de una marca a esos efectos claramente visible en eI arma de fuego.

Articulo 10 Requisitos generales para sistemas de licencias 0 aUlorizaciones

de exportaci6n. imporlacion y Iransilo

I. Cada Estado Parte establecenl 0 mantendra un sistema eficaz de licencias

o autorizaciones de exportaci6n e importaci6n, asi como de medidas aplicables al

trans ito internacional, para la transferencia de armas de fuego, sus piezas y

componentes y municiones.

2. Antes de emitir licencias 0 autorizaciones de exportaci6n para la

expedici6n de armas de fuego, sus piezas y componentes y municiones, cada Estado

Parte Sf asegurarfl de que:

a) Los Estados importadores hayan emitido las correspondientes licencias 0

autorizaciones; y

b) Los Estados de tfansito hayan al menos comunicado por escrito, con anterioridad a la expedici6n, que no se oponen 81 trAnsito, sin perjuicio de los

acuerdos 0 arreglos bilaterales 0 multilaterales destinados a favorecer a los Estados

sin litoral.

3. La Iicencia 0 autorizaci6n de exportacion e irnportaci6n y la

documentacion que Ia acompafie contendnln conjuntamente infonnacion que, como

mlnimo, comprenda ellugar y la fecha de emisi6n, la fecha de expiracion, el pals de

exportacion, eI pais de importacion, el destinatario final, una descripcion y la cantidad

de las armas de fuego, sus piezas y componentes y municiones y, cuando haya

trAnsito, los paises de tninsito. La infonnaci6n contenida en la licencia de importacion

debera facilitarse a los Estados de transito con antelacion.

6. Los Estados Parte podran adoptar proced.imientos simplificados para la importacion y exportacion temporaies y para transite de armas de fuego, sus piezas y componentes y municiones para tales como cacerias, pnicticas de tiro deportivo, pruebas, exposiciones 0 reparaciones.

Articulo 11 Medidas de segur/dad y prevencilm

Soluci6n de controversias

1. Los Estados Parte procuranin solucionar toda controversia relacionada

2. Toda. controversia entre dos 0 mas Parte ace rca de la interpretacion 0 la del presente Protocoio que no pueda resolverse

mediante la de un plazo razonable deb era, a solicitud de uno de

solicitud arbitraje, esos Estados no pedido ponerse de acuerdo sobre la organizaci6n del arbitraje, cualquiera esas podra la controversia a la

Corte Internacional de Justicia mediante solicitud conforme af Estatuto de la Corte.
