INTERNATIONAL CONVENTION ON ARREST OF SHIPS, 1999

The States Parties to this Convention,

Recognizing the desirability of facilitating the harmonious and orderly development of world seaborne trade,

Convinced of the necessity for a legal instrument establishing international uniformity in the field of arrest of ships which takes account of recent developments in related fields,

Have agreed as follows:

Article 1 pefinitions

For the purposes of this Convention:

1. ~Maritime Claim- means a claim arising out of one or more of the following :

(a) loss or damage caused by the operation of the ship;

(b) loss of life or personal injury occurring, whether on land or on water, in direct connection with the operation of the ship;

Ic) salvage operations or any salvage agreement, including , if applicable, speCia l compensation relating to salvage operations in respect of a ship which by itself or its cargo threatened damage to the environment;

(d ) damage or threat of damage caused by the ship to the environment, coastline or related interests; measures taken to prevent, minimize, or remove such damage; compensation for such damage; costs of reasonable measures of reins tatemen t of the environment actually undertaken or to be undertaken; l oss incurred or likely to be incurred by third parties in connection wi th such damage; and damage , costs, or loss o f a similar nature to those identi fied in this subparagraph (d);

(e) costs or expense s relating to the rais ing, removal, recovery, destruction or the rendering harmless of a ship which i s sunk, wrecked, stranded or abandoned, including anything that is or has been on board such ship, and costs or expenses r elating to the preservation of an abandoned ship and main tenance of its crew;

(f) any agreement relating to the use or hire o f the ship, whe ther contained in a charter party or otherwise;

(g) any agreement relat ing to the carriage of goods or passengers on board the ship, whethe r cont.ained in a charter party or othen"ise;

(h) loss of or damage to or in connection with goods (incl~ding luggag2) carried on board the ship;

(j) towAge;

(k) pilotage;

(1) goods, materials, provisions, bunkers, equipment (including containera) supplied or aervices rendered to the ship for its operation, management, preserVAtion or mAintenance;

1m) construction, reconstruction, repair, converting or equipping of the ship;

tn) port, canal, dock, harbour and other waterway dues and charges;

(0) wages and other sums due to the master, officers and other members of the ship's complement in respect of their employment on the s hip , including costs of repatriation and social insurance contributions payable on their behalf;

(p) disbursements incurred on behalf of the ship or its owners ;

(q) insurance premiums (including mutual insurance calls) in respect of the ship, payable by or on behalf of the shipowner or demise charterer;

(rl any commissions, brokerages or agency fees payable in respect of the ship by or on behalt of the shipowner or demise charterer:

(a) any diapute as to ownership or possession of the ship;

(t) any dispute between co -owners of t he ship as to the employment or earnings of the ship;

(u) a mortgage or a ~ hypoth~que· or a charge of the same nature on the ship;

(v) any dispute arising out of a contract for the sale of the ship .

2. "A.rreflt" means any detention or restriction on removal of • ship by order of a Court to secure a maritime claim, but does not include the seizure of a ship in er.ccution or satisfaction of a judgment or other enfor ceable instrument.

3. "Person" means any individual o r partnership or any public or p!'i'late body, whe ther corporate or not, including a State or any of its constituent subdivi~ions.

4. "claimant" means any person asserting a maritime claim.

5 . "Court" means any competent judicial authority of a State.

Article 2 powers of arrest

1 . A ship may be arrested or released from arres~ only under the au~hori~y of a Court of the State Party in which the arrest is e ffected.

2. A ship may only be arrested in respect of a maritime claim but in respect of no other claim.

3. 1\ $hip may be arrested for the purpose of obtaining security notwi ths tanding that, by virtue of a juri$dict ion clause or arbitration clauoe in any rt!levant contract, or otherwise. the maritime claim i n respect of which

the arrest is effected i s to be adjud i c ated in a State other than the State where the arrest is effected, or is to be arbitrated, or is to be ad j udicated s ubj ec t to the law of another State.

4 . Subject to the provisions of this Convent i on, the procedure rel a ting t o the arrest of a ship or its release shall be governed by the law of t he S t a t e in which the arrest was effected or applied for.

Article 3 Exercise of right of arrest

1 . Arrest is permissible of any ship in respect of which a marit ime c l aim is asserted if:

(a) the person who owned the ship at the time when the maritime c laim arose i s liable for the claim and is owner of the ship when the arrest is effected; or

(b ) the demise charterer of the ship at the time when the maritime claim arose is liable for the claim and is demise charterer o r o wner o f the ship when t he arrest i s effected; or

(cl t.he claim is based upon a mortgage or a "hypo theque" o r a cha rge of the same nature on the ship; or .

(d ) the claim relates t o the ownership o r possessio n of the ship ,' or

(e ) the claim is aga ins t the o wner, de mis e chartere r, ma nage r or operato r of the ship and is s e c ured by a marit i me l i e n which is granted or arises under the l aw o f t he St ate where the a rrest is app lied for .

2. Arre s t is a lso permi ssib l e o f any othe r ship or s hips wh i ch, when t he a r res t i s effec t e d, i s or a r e own ed by t he pe r son who is liable for the marit ime cla im a nd who was , when t he claim aro se;

(a) owner o f t h e ship in respect of wh ich the maritime claim aro se; or

(b ) demis e cha r tere r , time chartere r or voyage charterer 0: that sh ip.

This provision does not app ly t o claims i n r espect of ownership o r possession o f a ship.

3 . Not Hichsta ndi ng the provisions of paragraphs 1 and 2 o f t h i s art ic l e, the a r rest of a ship which is no t own ed by t he person liable f o r t he claim shall be p e rmissible on l y i f , under the law of the Sta te whe r e the a r r est is appl i ed f or, a judgment i n respect o f that c l aim can be en f orced agains t that ship by j udi c i a l o r f o rce d sale o f t hat s hip .

Art i cle 4 Re lea se from ar rest

1. A ship which ha s been arre sted sha l l be r e l eased when suffic ie!1t s e curity has b een prov id~d i n a satisfac tory form, save in cases in which a s~ip has b e en a rrested in respect of any of the maritime claims enumerated i r. a rticle 1, p aragraphs 1 (s) and (t) In s uch cases , the Court may permit the p e rson i n possess i o n of the s h ip to cont i n ue trading the shi p, u pon such p e rson providi ng su f ficien t s e cur i ty, or may otherwise deal with the operation of t he ship duri ng the per i od o f the at-rest.

2. In the absence of agreement between the parties as to the sufficiency and form of the security, the Court shall determine its nature and the amount thereof, not exceeding the value of the arrested ship.

3. Any request for the ship to be released upon security being provided shall not be construed as an acknowledgement of liability nor as a waiver of any defence or any right to limit liability.

4. If a ship has been arrested in a non-party State and is not released although security in respect of that ship has been provided in a State Party in respect of the S8me claim, that security shall be ordered to be released on application to the Court in the State Party.

s. If in a non-party State the ship is released upon s atisfactory security in respect of that ship being provided, any security provided in 8 State Party in respect of the 88me claim shall be ordered to be released to the extent that the total amount of security provided in the two States exceeds :

(8) the claim tor which the ship has been arrested, or

(b) the value of the ship,

whichever is the lower . Such release shall, however, not be ordered unless the security provided in the non-party State will actually be available to the claimant and will be freely transferable.

6. Where, pursuant t o paragraph 1 of this article, security has been provided, the person providing such security may at any time apply to the Court to have that security reduced , modified. or cancelled.

Article 5 Right Qf rearrest and multiple arrest

1. Where in any State a s hip has already been arrested and released or security in respect of that ship has already been provided t o secure a maritime claim, that ship shall not thereafter be rearrested or arrested in respect of the same maritime claim unless:

(a) the n ature or amount of the security in respect of that sh:p already provided in respect o f the same cla im i s inadequate , o~ co~dition

that the aggregate a mount of security may not exceed t he va lue of the ship; or

(b) the person who ha s already provided the security is not, 0= is unl ikely to be, able to fulfil some or all o f that person's obligations; or

(c) the ship arrested or the security previously provided ..... as =eleased either:

(b l the provisions of paragraph 1 (hi or (c) of this article are applicable.

3. "Releage~ for the purpose of this article shall not include any unlawful release o r escape from arrest.

Article IS Protection of owners and demise charterers of arrested ships

1 . The Court may as a condition of the arrest of a ship, or of permitting an arrest already effected to be maintained, impose upon the claimant who seeks t o arrest or who has procured the arrest of the ship the obligation to provide security of a kind and for an amount, and upon such terms, as may be determined by that Court f o r any loss which may be incurred by the defendant as a result o f the arrest, and for which the claimant may be found liable, inc luding but not restricted to s uch los s o r damage as may be incurred by that defendant in consequence of :

(a ) the arrest having been wrongful or unjustified; or

(b ) exc essive security hav ing been demanded and provided .

2. The courts o f the State in which an arrest has been effected ahall have jurisdiction t o determine the extent of the liability, if any, of the claimant for loss or damage caused by the arrest of a ship, including but not res tri c t e d to s uch loss or d a mage a s may be caused in cons equence o f :

(a) the arr e s t having be en wrong ful or un j ustified, o r

(b) excessive secur i ty ha ving been demanded and provided.

3. The liabi lity, if any, o f the cla i mant i n accordance with paragraph 2 of t h is a rticle s hall be de termi ne d by appl ica tion of t he law o f t he State whe r e the a rrest was e ffe cted .

4 . If a court i n anothe r State o r a n arbit r a l t ribunal is to de te rm ine t he merits of the c a se in accordance with the provision s of article 7, then p roceedings r elat ing to the liabili t y of the claima nt i n acco r dance with paragraph 2 of this article may be stayed pending tha t decision.

s. Where pursua nt to paragra ph 1 of this article security ha s been provided, the person providing s uch security may at any tim~ apply to the Court to have that security reduced, modi f ied or cancelled .

Article 7 J ur isdiction o n t he me ri ts of the c a 2e

1. The Cou r t s o f t he State in which an a rres t has been effected o r secur i ty provided to obtain the re l ease of t he s hip shall have jurisdiction to determin e the case u pon its me r its , un les s t he part i es v a l idly agree or have va l i d l y agreed to submit the d i spu te to a Court o f a no the r S t ate which a ccepts jurisdiction, or t o a r bi tra tion.

2. Not~lithstanding the provi sions of paragraph 1 of this article, the Courts of the State in which an a rrest has been effected, or security provided to obtain the release of the ship, may refuse to exercise that jurisdiction where t hat refusal is permi t ted by the law of that S t a t e and a Cour t of another S t ate accepts jurisdiction .

3. In cases where a Court of the Sta te where a n arrest has bee n effe cted OJ:"

(a) does not have jurisdiction to determine the case upon its merits ; or

(b) has refused to exercise jurisdiction in accordance with the provisions of paragraph 2 of this article,

such Court may, and upon request shall, order a period of time within which the claimant shall bring proceedings before a competent Court or arbitral tribunal.

4. If proceedings are not brought within the period of time ordered in accordance with paragraph 3 of this article then the ship arrested or the sec u r ity provided shall, upon request, be ordered to be released .

5. If proceedings are brought within the period of time ordered in accordance with paragraph 3 of this article, or if proceedings before a competent Court or arbitral tribunal in another State are brought in the absence of such order, any final decision resulting therefrom shall be recognized and given effect with respec t to the arrested ship or to the sec urity pro vided in order to obtain its release, on condition t hat :

(a) the defendant has been given reasonable notice of such proceedings and a reasonable opportunity to present the case for the defence; and

(b) such recognition is not against public policy (ordre public) .

6. No thing c onta ined in the provis i o ns of paragraph 5 o f this article shall re s t ric t any f u rthe r effect given to a foreign judgment or arbitral award under the law o f t he S t ate where the arrest of the ship was effected or s ecurity prov ide d t o obtain its release.

Article 9 Non-creation of maritime liens

Nothing in ~his convention shall be construed as creating a maritime lien .

Article 10 Reservations

1 . Any State may, at the time of signature, ratification , acceptance , approval, or acceasion, or at any time thereafter , reserve the right ~o exclude the application of this Convention to any or all of the following :

(al ships which are not seagoing;

(0) ships not flying the flag of a State Party ;

(e ) claims under article 1 , paragraph 1 ts).

2. A State may, when it is also a State Party to a specified treaty on navigation on inland waterways, declare when signing, ratifying, accepting, approving or acceding to this Convention , that rules on jurisdiction. recogni tion and execution of court decisions provided tor in such treaties shall prevail over the rules contained in article 1 of this ConVention.

Article 11 Depositary

This Convention shall be deposited with the Secretary-General of the Un i ted Nations .

Art.icle 12 Signature. ratification. acceptance, approval and accession

1 . This Convention shall be open for signature by any State at the Headquarters of the United Nations , New York , from 1 September 199 9 to 31 August 2000 and shall thereafter remain open for accession,

2. States may express their consent to be bound by this Convention by:

(a) signature without reservation as to ratification, acceptance or approval; or

(b) signature subject to r a tifica tion, acceptance or approval, followed by ratification, acceptance or app roval; or

(c) accession.

), Ratifica t ion, acceptance, approval or accession shall be effected by the dep08i~ ot an instrument to that effect with the depositary .

Article 13 States with more than one system o f law

1. If a State has two or more territorial units in which different systems of law are appl i cable in relation to matters deal~ with in this Convention, it may at the time of signa ture, ratif ication, accepcance, approval or accession dec lare that this Convention shall extend to a ll its territorial units or on l y to one 0[' more of them and may modi fy this declaration by submitting anothet· declaration a~ any time.

2. Any such declaration shall be notified to the depositary and shall state expressly the territorial units to which the Convention applies.

3. In relation to a State Party which has two or more systems of law with regard to arrest of ships applicable in different territorial units, refe rences in this Convention co the Court of a State and the law of a State shall be respectively construed as referring to the Court of the relevant territorial unit within that State and the law of the relevant territorial unit of that State.

Article 14 Entry into force

1. This Convention shall enter into force six months following the date on which 10 States have expressed their consent to be bound by it.

2. For a State which expresses its consent to be bound by this Convention after the conditions for entry into force thereof have been met, such consent shall take effect three months after the date of expression of such consent.

Article 15 Revision and amendment

1. A conference of States Parties for the purpose of revising or amending this Convention shall be convened by the secretary-General of the united Nations at the request of one third of the States Parties.

2. Any consent to be bound by this Convention, expressed after the date of entry into force of an amendment to this Convention, shall be deemed to apply to the Convention, as amended.

Article 16 Denunciation

1. This Convention may be denounced by any State Party at any time after the date on which this Convention enters into force for that State.

2 . Denunciation shall be effected by deposit of an instrument of denunciation with the deposi t ary.

3. A denunciation shall take effect one year, or such longer period a s may be specified in the instrument of denunciation, after the receipt of the instrument of denunciation by the depositary.

Article 17 Languages

This Convention is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.

Considerant qu' il est sounaitable de facilitcr Ie developpement harm o­

nic lix et ardonne du commerce marit ime mond ial,

Co nvainc us de la necessite d ' un instrument j uridique ctublissant une

uni formite inlernalionaie dans Ie domaine de la sa isie conserv81oire des

navires, qui lienne compte de revolution recente dans les domaines cannexes,

Sont con venus de ce qui suit:

Article premier

DEFINITIONS

Article 2

POUVOIRS DE SAISIE

I . Un navire ne peut eIre saisi, ou libere de celie saisie, que par decision

d'un tribunal de I'Etat Partie dans lcque\ la saisie est pratiquec.

2. Un navire ne petll eire saisi qu'en vertu d'une creance maritime, it

Article 4

MAINLEVEE DE LA SA ISlE

sufIisant et sous une forme sati sfaisante a ete constituee, saur dans Ie cas ou

la saisie est pratiquee en raison des creances maritimes enumerees aux alineas

s) et t) du paragraphe I de "article premier. En ce cas, Ie tribunal peut

permettre I'exploitalion du navire par la personne qui en a la possession, lorsque celle-ci aura constitue une surete d'un montan l suffisant, ou regler de

toute autre fa~on la question de la gestion du navire pendant la duree de la

saisie.

2. Si les parties inleressees ne parvicnnent pas it un accord sur I'impor·

tance et la fomle de la surete, Ie tribunal en detemline la nature et Ie montanl,

qui nc peut exceder la valeur du navire saisi.

3. Aucune demande tendant.i la liberation du navi rc contre la constitution

6. Toute personne qui a constitue une sure le en vertu des disposi tions du

paragraphe I du present article peut, it tout moment, demander au tribunal de

rM uire, modifier ou annuler cette sllrete.

Article 5

DROIT DE NOUVELLE SAISIE ET SAISIES MULTIPLES

1. Lorsque, dans un Etm. lin navire a deja etc saisi et libere au qu'une

Article 6

PROTECTION DES PROPRlETAIRES ET AFFRETEURS EN DEVOLUTION DE NAVIRES SAISIS

3. La responsabilitc evcntuelle du cH:ancier, visce au paragraphe 2 du

present artic le, est determinee par appli cat ion de la loi de l'Eta! au la saisie

a ele pratiquee.

4. All cas au Ie litigc est, conformement aux dispositions de l'article 7,

soumis it l'examen au fond d'un tribunal d 'lIn 3lltre Etat ou d'un tribunal arb itral, In procedure relative a la responsabiliu! du creaneier prevue au

paragraphe 2 du present article pClIt etre suspendue dans I'attente de la

decision au fond.

5. TOllte personne qui a constitue une surete en verl ll des dispositions du

Article 7

COMPETENCE SUR LE FOND DU LlT IGE

3. Lorsqu'un Iribunal de l' Elal dans lequel une saisie a ele pnniquce ou

une surele constitute pour obtenir In liberation du navire :

a) N'es! pas competent pour slatuer nu fond sur Ie litige; au

b) A decline sa competence en verlu des dispositions du

paragraphe 2 du present article,

ce tribunal peut et, sur requete, doit fixer au crcancier un delai pour engager In procedure au fond devant un tribunal competent all une juridiction arbitrale.

4. Si, au terme du delai fixe conformement au paragraphe 3 du present

article , la procedure au fond n'a pas etc engagee, la mainlevee de la saisie ou

de 18 surele consliluee est, sur requete, autorisee par ordonnance.

5. Si la procedure est engagee avant Ie lerme du delai fixe conformement

au paragraphe 3 du prescnt article, ou si la procedure devant un tribunal

competent au un tribunal arbitral d'un autre Etat cst cngagee en !'absence de

fi xation d ' un de lai, toute decision definitive prononcee a !' issue de ceUe

procedure est reconnuc el prend clIet n J'egard du navi re sa isi ou de !a surete

Article 8

APPLICATION

1. La presente Convention est applicable a tOllt navire relevant de la

juridict ion d' lIn Etat Partie, queJ qu'U so it, et battant au non pavilion d'un

Etat Partie .

2. La presente Convention n'est pas appl icable nux navires de gucrre,

navi rcs de guerre auxiliaires et autres navires appartcnant a un Etat ou

expioites par lui ct exclusivement affectes, jusqu'A nouve l ordre, a un service

public non commercial.

3. La presente Convention ne porte atteinte a aucun des droits ou

pouvoirs, devolus par line convention internationale, line loi au reglementation

interne a un Etat all it ses administrations, it un etablissement public ou it line

au torite portuai re, de reteni r lin navire ou d 'en interdire Ie depart dans Ie

ressort de leur juridiction.

4. La prescnte Convention ne porte pas 8ueinte au pOllvoir d' un Etat Oll

tl'iblumi de r~ndre des ordorumnces applicables a la totali te dll patrimoin~ d'lIn

debiteur.

SIGNATURE, RATIFICATION, ACCEPTATION, APPROBATION ET ADHESION

I , La prcsente Convention est ollverte a la sig nal~lrc des Etats au Siege

Han conveni do en 10 aiguiente:

Articulo 1

Detinicign"

n) Los derechos y gravAmenes de puertos, canales, muelles, radas y otras vias navegables:

0) Los sueldos y otras cantidades debidas al capitAn, los oficia1es y demas miembros de la dotaci6n en virtud de su enrol ami en to a bordo del buque, inc1uido5 los gastos de repatriaci6n y las cuotas de la seguridad social pagaderas en su nombre;

pI Los deaembolsos hechos par cuenta del buque 0 de sus propietarios;

q) Las primas de seguro (inclu idas las cotizaciones de seguro mutuo), pagaderas p~r el propietario del buque 0 e1 arrendatario a casco desnudo, a por au cuenta, en relaci6n con el buque:

r) Las comisiones, corretajes u honorarios de agencias pagaderos par el propietario del buque 0 el arrendatario a casco desnudo, o por au cuenta, en relaci6n con el buque;

5) Toda contravers i a relativa a 1a propiedad 0 a la posesi6n d~l buque;

t ) Toda controversia entre los copropietarios del buque ace rca de su ut ilizaci6n 0 del producto de 5U explot.aci6n;

u ) Una hipoteca, "mortgage" 0 gravamen de la misma naturaleza sobre el buque;

v) Toda controversia resultante de un cantrato de compraventa del buque.

2 . Par "embargo" se entiende toda inmovilizaci6n 0 restricci6n a la salida de un buque impuesta por resoluci6n de un tribunal en garantia de

un cr~dito marit imo, pero no comprende l~ retenci6n de un buque para la ejecuci6n de una sentenci~ u otro instrumento ejecutorio .

3 . Por "persona" se entiende toda persona f1aica 0 jurIdica 0 t oda entidad de derecho publico 0 privado. est~ 0 no conatituida en sociedad . inclusive un Estado 0 cualquiera de sus subdiviaiones politicas .

4. Por "acreedor" se entiende toda persona que alegue un cr~dito marItima.

5. Por "tribunal" se entiende toda. autoridad judieial eompetente de un Estado.

Articulo 2

Potestad para embargar

1. 5610 se podr~ embargar un buque 0 levantar au embargo por resoluci6n de un tribunal del Es tado Parte en e1 que 8e haya practicado e1 embargo.

2. 5610 se podr~ embargar un buque en virtud de un cr~dito maritimo, pero no en virtud de otro cr~dito.

3. Un buque podr~ ser embar gado a los efectos de obtener una garantia aunque, en virtud de una clAusula de jurisdicci6n 0 una cl~usula de arbitraje contenida e n cualquier contrato ap1icable a de otra forma, e1 cr~di to maritimo por e1 que se haga e1 embargo deba some terse a 1a jurisdicci6n de los tribuna1es de un Es tado distinto de aque1 en que se practique el embargo 0 a arbitraje 0 deba re9irae por la l ey de otro Estado.

4. Con sujeci6n a 10 dispuesto en el presente Conven io , el procedimiento relativo a1 embargo de un buque 0 al l evantamiento d~ ese embargo se reg ira por 1a ley del Es tado en que se haya solic itado 0 practicado el embargo.

Articulo 3

Ejerci cio d~l derecho de embargo

1 . El embargo de t odo buque con respec t o a l cua l se alegue un c r ed i t o maritima procedera:

a) 5i la persona que era propietaria del buque en el momento en que naci6 el credito maritimo esta obligada en virtud de ese credito y es propietaria del buque a 1 practicarse el embargo; 0

b) 5i el arrendatario a casco desnudo del buque en el momento en que naci6 el cr~dito maritimo est~ obligado en virt ud de ese cr~dito y es arrendatario a casco desnudo 0 propietario del buque al practicarse el embargo; 0

c) 5i el cr~dito se basa en una hipoteca, "mortgage" 0 gravamen de la miDma naturaleza sobre el buque; 0

d) Si el cr~dito se refiere a la propiedad 0 1a posesi6n del buque; o

e) Si el cr~dito es contra el propietario, el a rrendatario a casco desnudo, el gestor 0 el naviero del buque y esta garantizado por un privilegio maritimo concedido por 1a legislaci6n del Estado en que se solicita el embargo 0 en virtud de eaa legislaCi6n.

2. ProcederA tambi!n el embargo de cualquier ot r o buque 0 buques que, a l practicarse el embargo, fueren pr opiedad de la persona que est~ obligada en virtud del cr~dito maritimo y que, en el momento en que naci6 el cr~dito, era:

a) Propietaria del buque con respecto al cual haya nacido el cr~dito marItimo; 0

b) Arrendataria a casco desnudo, fletador por tiempo 0 fletador por viaje de ese buque.

La presente disposici6n no se aplica a los cr~ditos relativos a la propiedad 0 1& posesi6n de un buque.

3. No obstante 10 dispuesto en 108 p&rratos 1 y 2 del presente articulo, el embargo de un buque que no sea propiedad de la persona obligada en virtud del cr~dito 5610 ser& admisible si, conforme a la ley del Estado en que se solicita el embargo, Be puede ejecutar contra ese bugue una sentencia dictada en relaci6n con ese cr~dito, mediante 8U venta judicial 0 forzosa.

Arttculo 4

Levantamiento del embargo

1. Un buque que haya sido embargado sera liberado cuando se haya prestado garantia bastante en forma satisfactoria, salvo que haya sido embargado para responder de cualquiera de los creditos maritimos enumerados en los apartados s) y t) del parrafo 1 del articulo 1. E:l estos casos, el tribunal podra autorizar a la persona en posesi6n del b'.lque a sC!guir explot&ndolo, una vez que esta persona haya pres ta:::io garantia suficiente, 0 resolver de otro modo la cuesti6n de la operaci6n del bugue durante el perfodo del embargo.

2. A falta de acuerdo entre las partes sobre la suficiencia y la forma de la garantia, e l tribunal determinara su naturaleza y su cuantia, que no podr' exceder del valor del buque embargado.

3. La solicitud de levantamiento del embargo del bugue previa consti tuci6n de garantIa no se interpretara como reconocimiento de responsabilidad o i como renu~cia a cualquier defensa 0 al derecho a limitat: la reoponsabilidad.

4. Si un buque hubiera sido embargado en un Estado que no sea parte, y no hubiera sido liberado pese a la garancia prestada en relaci6n can ese buque en un Estado Parte respecto del mismo cr~dito, se ordenar~ la cancelaci6n de la garantia previa solicitud ante el tribunal del Estado Parte.

5. si un buque hubiera side liberado en un Estado que no sea parte por haberse prestade garantia suficiente, toda garantia prestada en un Estado Parte en relaci6n con el mismo cr~dito se mandar~ cancelar en la medida en que la cuant~a t otal de 1a garantia prest ada en los dos Estados exceda :

a) Del valor del credito por el que se hubiera embargado el buque; 0

b) Del valor del buque;

de ambos e1 que sea menor. Sin embargo, no se ordenara dicha liberaci6n a menes que la garantia prestada en el Estado que no sea parte est~ efectivamente a d i sposici6n del acreedor y Ie sea 1ibremente transferible.

6. La persona que haya prestado una garantia en virtud de las disposiciones del parrafo 1 del presente articulo podrA en cualquier momento solicitar a l tribunal su reducci6n, modificaci6n 0 cance1aci6n.

Articulo 5

Derecho de reembargo y pluralidad de embargos

1. Cuando en un Estado un buque ya hubiera sido embargado y libe rado, 0 ya se hubiera prestado garantia respecto de ese buque en relaci6n con un cr~dito maritimo, e1 buque no podra ser reembargado 0 embargado por el mismo credito, a menos que:

a) La natural eza 0 la cuantla de la garantia respecto de ese buque ya prestada en relaci6n con ese credito sea inadecuada, a condic i 6n de que la euantla total de la garantia no exceda del valor del buque; 0

b) La persona que haya prestado ya 1a garantia no pueda, 0 no sea probable que pueda, cumplir total 0 parcialmente sus obligaciones; 0

cl Se haya liberado e1 buque ernbargado 0 se haya cancelado 1a garantia pres t ada anteriarmente, ya sea:

i) a i nstancias 0 con el cansentimiento del acreedor, cuando actue por motivos razonables, 0

ii) porque el acreedor no haya podido, media nte 1a adopci6n de medidas razenables, impedir tal liberaci6n 0 cancelaci6n.

2. cualquier atro buque que de otro modo estaria sujeto a embargo per e1 mismo credito maritimo no sera embargado a menos que:

a) La naturaleza 0 la cuantia de la gar anti a ya prestada en relaci6n can el mismo cr~dito sean inadecuadas; 0

b) Sean aplicables las disposiciones de los apartados b) 0 c) del parrafo 1 del presente articulo .

3. A los efectos del presente"artfculo, la expresi6n "liberaci6n" excluye toda salida a liberaci6n ilegal del' buque.

Articulo 6

Protecci6n de los orooietarloS y arrendatarios a casco desnudo de bugues emba rgados

1 . El tribunal podra, como condici6n para decretar el embargo de un bugue 0, hecho este, para autorizar su mantenimiento, imponer al acreedor que solicite 0 que haya obtenido el embargo del buque 1a obligaci6n de pres tar garantfa de la clase, por la cuantia y en las condiciones que determine el tribunal para responder de los perjuiciOs que puedan irrogarse a l demandado como consecuencia del embargo, y de los que se pueda tener como responsable al acreedor, en particular, pero no exclusivamente, la perdida 0 el dano que puedan ocasionarse al demandado:

a) Por ser ilicito 0 no estar justificado e1 embargo; 0

b) Por haberse pedido y prestado una garantia excesiva.

2. Los tribunales del Estado en que se haya practicado un embargo seran competentes para determinar el alcance de la responsabilidad del acreedor, cuando hubiere incurrido en ella, por la perdida 0 el dano causados por el embargo de un buque, en particular, pero no exclusivamente, los que se hubieren causado:

a) Por ser ilicito 0 no estar justificado el embargo; 0

b) Por haberse pedido y prestado una garantia exces iva.

3. La responsabilidad en qu~, en su caso , hubiere incurrido el acreedor a tenor de 10 dispuesto en el parrafo 2 del presente articulo se determina r a por aplicaci6n de 1a ley del Estado en que se haya practicado el embargo.

4. 5i un tribunal de otro Estado 0 un tribunal arbitral :uviere que resolver sabre el fondo del l itigio de conformidad can el articulo 7, la sustanciaci6n del procedimiento relativo ·a la respansabilidad del a creedor a tenor de 10 d ispuesto en el parra f o 2 del presente articu l o podra suspenderse hasta que recaiga decisi6n sobre el fondo.

5 . La persona que haya prestado una garantia en virtud de las disposiciones del parrafo 1 del presente a rticulo podra en cualquier momento solicitar al tribunal su reducci6n, modificaci6n 0 cancelaci6n.

Articulo 7

1. Los tribunales del Estado en que se haya practicado un embargo 0 s e haya prestado garantia para obtener 1a liberaci6n del buque serAn competentes para resolver sobre el f ondo del litigio, a menoa que vA l idamente l as Par tes acuerden 0 hayan acordado aometer el litigio a un tribunal de otro Es tado que se declare competente 0 a arbitraje.

2. No obstante 10 dispuesto en el parrafo 1 del presente articulo, los tribunales del Estado en que se haya practicado un embargo 0 se haya prestado garantia para obtener la liberaci6n del buque podrAn declinar BU competencia s1 la ley naeional les autoriza a ello y el tribunal de otro Estado se declara competente.

3. Cuando un tribunal del Estado en que s e haya practicado un embargo 0 se haya prestado garantia para obtener 1a liberaci6n del buque:

a) No t enga competencia para resolver sobre al fondo del litigio; 0

h ) Haya declinado su competencia de conformidad con el parrafo 2 del presente articulo,

ese tribunal podra de of i cio, y debera a ins tancia de parte , fijar un plazo para que el acreedor entable .la demanda ante un tribunal de justieia competente 0 ante un tribunal arbitral.

4. Si no se en tabla la demanda dentro del pla zo fijado de conformidad con el parrafo 3 del presente articulo, se decretar! a instancia de parte la liberaci6n del buque embargado a la cancelaci6n de 1a garantia prestada.

s. si se entabla la demanda dentro del plaza fijado de conformidad con el parrafo 3 del presente art iculo 0, de no haberse fijado ese plazo, si se entabla 1a demanda ante un tribunal competente 0 un tribunal arbitral de atro Estado, toda resoluci6n definitiva dictada en ese procedimienta sera reconocida y surtir! efecto con respec to al buque embargado 0 a la garantia prestada para obtener la l iberaci6n del buque, a condici6n de que:

a) Se haya comunicado la demanda a1 demandado con suficiente antelaci6n y S~ I e ofrez~an oportunidades razonables para defenderse; y

b) Ese reconocimiento no sea contrario al orden publico.

6. Ninguna de las disposiciones del parrafo 5 del presente articulo limitara otros posibles efcctos que 1a ley del Estado en que se haya practicado el embargo del buque 0 se haya prestado garantia para obtener su 1iberaci6n, reconozca a una sentencia 0 a un laudo arbi tral extranjeros.

&rt!culQ a

Aplicaci6n

1. E1 presente Convenio se aplicara a todo buque que navegue dentro de la jurisdicci6n de un Estado Parte, enarbole 0 no el pabel16n de un Estado Parte.

2. £1 presente Convenio no se aplicara a los buques de guerra, a las unidades navales auxi1iares y a otros buques pertenecientes a un Estado 0 explotados por ~l y destinados exclusivamente, en ese momento, a un uso pUblico no comercial.

3 . El presente Convenio no afectar~ a los derechos 0 facultades que, con arreglo a un convenio internacional 0 en virtud de una ley 0 reglamento internos, correspondan a la Administraci6n del Estado 0 a a19uno de sus 6r9aoos, los poderes pUblicos 0 a la administraci¢~ portuaria para retener un buque 0 impedir de otro modo que se haga a la

· mar dentro de BU jurisdicci6n.

4. El presente Convenio no menoscabara la facultad de un Estado 0 tr i bunal para decretar medidas que afecten a Is totalidad del patrimonio de un deudor.

5. Las disposiciones del presente Convenio no afectar'n a la aplicaci6n en e l Estado en que se practique un embargo de los convenios internacionales que establezcan una limitaci6n de responsabilidad 0 de la ley interna dictada para darles efectividad.

6. Las disposiciones del presente Convenio no modificar!n las normas juridicas en vigor en los Estados Partes, ni afectaran a su aplicaci6n, relativas al embargo de un buque que se encuentre dentro de la jurisdicci6n del Estado cuyo pabel16n enarbole, practicado a instancias de un~ persona que tenga su residencia habitual 0 su establecimiento principal en ese Estado 0 de cualquier otra persona que haya adquirido un c rhdito de esta por Bubrogaci6n, cesi6n 0 cualquier ot r o medio.

Articulo 9

No c reaci6n de un privilegia maritima

Las disposiciones del presente Conveni o no se interpretaran en el sentido de que crean un privilegio maritima .

Ar ticulo 10

Reservas

1. En el momento de la firma, ratificaci6n, aprobaci6n 0 aceptaci6n de l presente Convenio 0 de la adhesi6n a el, 0 en cualquier momento posterior, todo Estado podra reservarBe el derecho de excluir de su aplicaci6n a algunas 0 todas las categorias siguientes:

2 . En el momento de la firma, ratificaci6n, aprobaci6n 0 aceptaci6n del presente Convenio 0 de la adhesi6n a 61, todo Estado que aea tambi~n Parte en un determinado tratado sobre vias de navegaci6n interior podr' declarar que las normas sobre competencia, reconocimiento y ejecuci6n de sentencias judiciales de ese tratado prevalecen sobre las disposiciones del articulo 7 del presente Convenio.

Articulo 11

El presente convenio quedar! depositado en peder del Secretario General de las Naciones Unidas.

Articulo 12

Firma, ratificaci6n, aceptaci6n. aprobaci6n y adhesi6n

1. El presente Convenio estara abierto a la firma en la Sede de las Naciones Vnidas , en Nueva York, desde elI - de septiembre de 1999 hasta e l 31 de agosto del afto 2000 y despues quedari sbierto a 1a adhesi6n .

2. Los Estados podrin manifestar su consentimiento en obligarse por el presente Convenio mediante:

3 . La ratificaci6n, acep taci6n, aprobaci6n 0 adhes i6n se efe~tuaran mediante el dep6sito de un instrumento a ta l efecto en poder del depositario.

8 rt1cu l o 14

Entrada en v i gor

1. El pre sente Convenio entra r i e n v i gor se i s meses despues de la fecha en que diez Es tados hayan manifestado su consentimiento en ob1igarse par ~l .

2. Respecto de un Estado que mani fieste su consentirni ento en obligarae por e1 presente Convenio despues de que se hayan curnplido los r equisites pa r a su entrada en vigor, ese consentimi ento surtira efecto t r es mes e s despues de la f echa en que haya side manifestado.

Articulo 15

Revisi6n y enmienda

1 . El Secretario General de las Naciones Unidas convocara una eonf erencia de los Es t ados Partes para revisar 0 enmendar el presente Convenio, si 10 so l icita un tercio de los Estados Partes.

2. Todo eonsentimiento en obligarse por el presente Convenio mani festado despues de la techa de la entrada en vigor de una enmienda a1 presente Convenio se entendera que se aplica al Can ven i a en su forma enrnendada.

ArtIculo 16

Denuncia

1. El presente Convenio podra ser denunc iado por eualquier Estado Parte en cualquier momento despu~s de 1a fe cha en que haya entrado en vi gor r es pecte de ese Estado.

2. La denuneia se efectuara mediante el dep6sito de un instrurnento de denuneia en poder del depositario .

Idiomas

El presente Convenio se consigna en un solo original , cuyos textos en arabe. chino, espa~ol. franc es. ingl~s y ruso son igualmente autenticos .
