ORDINANCE NO. 13-306

ADOPTING THE ANNUAL APPROPRIATIONS

BE IT RESOLVED that the County Board of Kane County, State of Illinois, hereby adopts theschedule of appropriations as detailed in the 2014 DRAFT Budget (as of 10/25/13) for all corporatepurposes for the fiscal period beginning December 1, 2013 and ending November 30, 2014; and

BE IT FURTHER RESOLVED that:

1. The schedule of appropriations is intended to cover all expenditures to be made by theCounty of Kane for the said fiscal year.

2. All expenditures made during said fiscal year are hereby limited to the amounts specifiedin said schedule of appropriations.

3. All unexpended balances may be expended in making up any deficiency for the samegeneral purpose as was appropriated.

4. The appropriate account number shall be shown on each purchase order and checkdrawn on the County Treasury.

5. The Finance Director shall keep an accurate account of the financial status of eachspecific fund.

6. The County Clerk and County Treasurer are authorized and required to sign andcountersign all checks drawn on the County Treasury in payment for services andmaterials purchased, other than those set out in paragraph 7 (a) and (b) herein.

7. The County Clerk and County Treasurer, individually, are authorized to sign checks drawnon the County Treasury, which are expenditures for (a) Personal Service appropriationscontained within said schedule of appropriations, and (b) all contractual obligations asauthorized by the Finance Director.

8. The County Auditor may approve for payment bills for items or services which he/shedeems appropriate for payment that (a) the funds have been appropriated herein, (b) thecost for such goods or services does not exceed Thirty Thousand Dollars ($30,000), and(c) the payment of such bills does not violate any other provision of the law.

The Crane Road Estates Levy is a separate levy for repayment (by the Crane Road Estates SSA) of bonds secured by theCounty on behalf of the Crane Road Estates Homeowners Association and St. Charles Township Road District.

AMENDING COUNTY CODE CHAPTER 2, ARTICLE II, SECTION 2-48(A)(3) REGARDINGAUTHORITY TO SET KANE COUNTY EMPLOYEE SALARIES

WHEREAS, the language of Kane County Code Chapter 2, Article II, Section 2-48(A)(3) relatesto the method of determining the individual salaries of Kane County employees; and

NOW, THEREFORE, BE IT ORDAINED that County Code Chapter 2, Article II, Section 2-48(A)(3) is hereby amended by the following insertion and deletion in Section 2-48(A)(3):

The following paragraph is inserted following the paragraph defining the term "Executive Directors:"

The appointment of all Executive Directors is to be initiated by the County BoardChairman with a task force formed by him/her for advisory and transparency purposesconsisting of the County Board Chairman, Director of Human Resources Management, andchairman of the standing committee to which the Executive Director reports for oversight. Thetask force will be charged with reviewing and amending as needed the job description, salaryrange as it fits with the current budget, and the initial review of applicants. The finalistsselected by the task force will then be reviewed by an interview group consisting of thechairman of the standing committee, an ad hoc member of the County Board chosen by theBoard Chairman to be preferably another member of the standing committee, the County BoardChairman, the Director of Human Resources Management, and either the Board Vice Chairmanor Chairman of the Finance Committee. The final selection for appointment by the BoardChairman with consensus advice from the interview group will be sent to the full board forconsent.

The following underlined and strike-through material is deleted:

To the extent not set by operation of State statute or other sections of this Code, thea ppointment of all de partment heads, and the adjusting of their salaries is to be initiated by theCounty Board Chairman with the advice and consent of the standing committee to which thedepartment head reports, and with the advice and consent of the Executive Committee, and then withthe approval of the County Board. Except that the appointment of the Executive Director ofFacilities. Development and Environmental Resources, and the adjustin g of his or her salary isto be initiated by the County Board Chairman with the advice and consent of the DevelopmentCommittee, and with the advice and consent of the Executive Committee, and then with theapproval of the County Board. The compensation of employees whose compensation is governed bycollective bargaining agreements shall be set by the County Board in a manner as set forth in thisCode. AUTHORIZING A LICENSE AGREEMENT WITH THE KANE COUNTY BAR ASSOCIATION FORUSE OF SPACE IN THE JUDICIAL CENTER

WHEREAS, the Kane County Bar Association (the Bar Association) desires to utilize certainspace located in the Judicial Center for the purposes of operating a Children's Waiting Room byentering into a License agreement, and there is sufficient available space in the Judicial Center toaccommodate the Bar Association's desire in this regard; and

WHEREAS, the County of Kane has the authority to enter into this License agreement, and thisLicense agreement would serve a public purpose and benefit; and

WHEREAS, the initial term of the agreement would be one year, and the Judiciary supports thisLicense; and,

WHEREAS, the Bar Association would pay the County of Kane Twelve Thousand Dollars peryear for the use of this space.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereofis hereby authorized to enter into a License agreement with the Kane County Bar Association for theuse of space at the Judicial Center to operate a Children's Waiting Room for an annual fee of twelvethousand dollars ($12,000), a copy of which is on file with the County Clerk's office.

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF ILLINOISWORKER'S COMPENSATION COMMISSION FOR USE OF SPACE IN THE

THIRD STREET COURTHOUSE

WHEREAS, the State of Illinois Worker's Compensation Commission desires to utilize certainspace located in the Third Street Courthouse for purposes of hearing cases by entering into anIntergovernmental Agreement with Kane County, and there is sufficient available space in the ThirdStreet Courthouse to accommodate the Worker's Compensation desire in this regard; and

WHEREAS, the County of Kane has the authority to enter into said IntergovernmentalAgreement as authorized by the 1970 Illinois Constitution, (Article VII, Section 10) and theIntergovernmental Cooperation Act, 5 ILCS 220/1 et sea, and this lease would serve a public purposeand benefit; and

WHEREAS, the initial term of the agreement would be one year, and the Judiciary supports thisIntergovernmental Agreement; and.

WHEREAS, the Worker's Compensation Commission would pay the County of Kane TwelveThousand Dollars per year for the use of this space.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereofis hereby authorized to enter into an Intergovernmental Agreement with the State of Illinois Worker'sCompensation Commission for the use space at the Third Street Courthouse, a copy of which is on filewith the County Clerk's office.

SUMMARY: The U.S. Bankruptcy Court utilizes a courtroom at the 3rd Street Courthouse. This courtroom (Room 240) has no jury boxand is utilized approximately six times per month by the Bankruptcy Court. This room is available for general usage by theJudiciary when not utilized by the Bankruptcy Court. A formal agreement (Memorandum of Understanding or MOU) for theuse of this space is desirable for both parties. The use of this space is beneficial for the residents and businesses of KaneCounty as it provides a local bankruptcy courtroom. The Judiciary supports Bankruptcy Court utilizing this space.

THE THIRD STREET COURTHOUSE

WHEREAS, the U.S. Bankruptcy Court for the Northern District of Illinois wishes to utilizecertain space located in the Third Street Courthouse for purposes of hearing cases by entering into aMemorandum of Understanding (MOU), and there is sufficient available space in the Third StreetCourthouse to accommodate the Bankruptcy Court's desire in this regard; and

WHEREAS, the County of Kane has the authority to lease the above-referred space to the U.S.Bankruptcy Court pursuant to 50 ILCS 605/3.1 and this lease would serve a public purpose and benefit;and

WHEREAS, the initial term of the agreement would be one (1) year, and the Judiciary supportsthis MOU, and

WHEREAS, the U.S. Bankruptcy Court would pay the County of Kane Five Thousand Dollars($5,000.) per year for the use of this Courtroom.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereofis hereby authorized to enter into a Memorandum of Understanding with the U.S. Bankruptcy Court forthe Northern District of Illinois for the use of a Courtroom at the Third Street Courthouse, a copy ofwhich is on file with the County Clerk's office.

SUMMARY: This resolution is to approve bids (Bid opening scheduled for October 18, 2013 @ 2:00 PM.) to demolish three (3) residentialstructures. The unsafe structures will be demolished, the property graded and restored, and the parcels potentially madeavailable for the future construction of affordable housing or for open space as a park. These blighted properties havesignificant negative health, safety, environmental and economic impacts on neighboring homes and neighborhoods.

Court orders have been applied for and granted for these three (3) blighted structures. Riverboat Funds approved earlierthis year to create a "Blighted Structures Demolition" line item in the Environmental Management Fund to pay the costsassociated with the demolition, repair or enclosure of dangerous and unsafe buildings within the County.55 ILCS 5/5-1121 authorizes the County to recover the costs related to the demolition, repair, enclosure, or removal incurredby the County, including court costs, attorney's fees, and other costs related to the enforcement. All recovered costs relatedto the demolition, repair, enclosure, or removal incurred by the County, including court costs, attorney's fees, and all othercosts will be reimbursed to this fund when the liens are paid off to pay for future demolitions, repairs, and enclosures.

APPROVING BIDS FOR THE DEMOLITION OF THREE RESIDENTIAL STRUCTURES

WHEREAS, 55 ILCS 5/5-1211 authorizes the County of Kane to apply to the circuit court for anorder to demolish, repair, or enclose or cause the demolition, repair, or enclosure of dangerous andunsafe buildings or uncompleted and abandoned buildings within the territory of the county, but outsideof the territory of any municipality, and to remove or cause the removal of garbage, debris, and otherhazardous, noxious, or unhealthy substances or materials from those buildings; and

WHEREAS, Court orders have been applied for and granted for two blighted structures; and

WHEREAS, Riverboat Funds have been allocated and are available in the "Blighted StructuresDemolition" line item in the Environmental Management Fund to pay the costs associated with thedemolition, repair or enclosure of dangerous and unsafe buildings within the County; and

WHEREAS, bids have been solicited and received for the demolition the following threeresidential structures, located at 316 Parkside, Aurora Township, 440 Woodlyn Dr., Aurora Township,35W090 Forest Drive, Dundee Township; and

WHEREAS, Mollenhouse Environmental, Inc., 3S080 Talbot Avenue, Wheaton, Illinois, 60555,was the lowest responsible bidder for these three structures (440 Woodlyri Drive, Aurora Township, 316Parkside, Aurora Township, and 35W090 Forest Drive, Dundee Township) at a cost of $44,400.00dollars for said demolition and removal as per bid specifications.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman of theBoard is authorized to enter into a contract with Mollenhouse Environmental, Inc., 3S080 TalbotAvenue, Wheaton, Illinois, 60555, for the demolition and removal of 440 Woodlyn Drive, AuroraTownship, 316 Parkside, Aurora Township, and 35W090 Forest Drive, Dundee Township, at a totalcost forty-four thousand four hundred dollars ($44,400.00). $18,200.00 to be paid from theEnvironmental Management Budget. 650.670.670.50650., Blighted Structures Demolitions, and$26,200.00 to be paid for from KDOT's Budget 556.520.556.74010.

AN ORDINANCE ESTABLISHINGTHE 'THE PRESERVE ON CRANE ROAD' SPECIAL SERVICE AREA

(or SPECIAL SERVICE AREA NO. 36) KANE COUNTY, ILLINOISAND PROVIDING FOR THE LEVY OF TAXES FOR THE PURPOSE OF PAYING

THE COST OF PROVIDING SPECIAL SERVICES IN AND FOR SUCH AREA

WHEREAS, a Final plat of subdivision has been approved by the County of Kane, Illinois (the"County"), for the 'The Preserve on Crane Road' Subdivision (the "Subdivision"); and

WHEREAS, in accordance with the Kane County Stormwater Ordinance, the Subdivision will beimproved with a stormwater drainage system, and may also include special management areas, all ofwhich will be conveyed to the 'The Preserve on Crane Road' Homeowners' Association (the"Homeowners' Association"), a duly incorporated homeowners' association; and

WHEREAS, the Homeowners' Association is obligated to maintain the stormwater drainagesystem and special management areas and to impose an assessment upon the owners of all of the lotswithin the Subdivision to provide for the maintenance of such stormwater drainage system and specialmanagement areas; and

WHEREAS, the Kane County Stormwater Ordinance requires, as a condition of approval of theapplication for a stormwater management permit for the Subdivision, the establishment of a specialservice area pursuant to 35 ILCS 200/27-5, et seq., either as the primary means of providing for thelong-term maintenance of the stormwater drainage system and special management areas, or as aback-up vehicle in the event the Homeowners' Association fails to adequately carry out its duties; and

WHEREAS, pursuant to the provisions of Article VII, Section 7, Part (6) of the 1970 Constitutionof the State of Illinois (the "Constitution"), the County of Kane is authorized to create special serviceareas in and for the unincorporated areas of the County; and

WHEREAS, pursuant to the "Special Service Area Tax Law", 35 ILCS 200/27-5, et seq. (2003),the County is authorized to levy and impose taxes upon property within special service areas for theprovision of special services to those areas and for the payment of debt incurred in order to providethose services; and

WHEREAS, it is in the public interest to establish the area hereinafter described and designatedas the 'The Preserve on Crane Road' Special Service Area (or Special Service Area No. 36 ) (the"Area") as a special service area of the County for the purposes set forth herein as a back-up vehicle toprovide for the long-term maintenance of the stormwater drainage system and special managementareas of the Subdivision; and

WHEREAS, the Area is contiguous and totally within the boundaries of the unincorporated areaof the County; and

WHEREAS, the purpose of establishing the Area is to provide certain special governmentalservices (the "Services") to the Area, which are unique and in addition to the services generallyprovided to the County as a whole, in the event the Homeowners' Association fails to adequately carryout its duties to maintain the stormwater drainage system and special management areas. TheServices to be provided on a back-up basis may include, but are not limited to, the following: theoperation, maintenance, repair, rehabilitation, replacement and reconstruction of any stormwater

detention and/or retention area, drainageway, ditch, swale, storm sewer or other stormwater facility;costs of design, engineering and other consulting services, surveying and permits, public liabilityinsurance, and all administrative, legal and other costs or expenses incurred in connection therewithand with the administration of the Area, including the repayment of any loan or debt incurred for theprovision of any of such Services, all of the Services to be in and for the Area; and

WHEREAS, it is in the public interest that a direct annual ad valorem tax upon all taxableproperty within the Area be levied for the purpose of paying the costs of providing the Services, whichare to be provided only in the event the Homeowners' Association fails to adequately carry out itsduties; and

WHEREAS, the revenue from such tax shall be used solely for Services for which the County isauthorized under law to levy taxes or special assessments or to appropriate funds of the County, all ofthe Services to be in and for the Area and all of any necessary construction and maintenance to be onproperty accessible to and by the County, as more fully described on the plat for the Subdivision; and

WHEREAS, said direct annual ad valorem tax shall be levied upon all taxable property withinthe Area for an indefinite period of time beginning for the year 2014, at a rate sufficient to producerevenues required to provide the Services, and such rate shall not exceed an annual rate of 0.50%($0.50 per $100) of the equalized assessed valuation of each tax parcel within the Area, and shall be inaddition to all other taxes permitted by law; and

WHEREAS, the establishment of the Area was proposed by the Board of the County of Kane(the "County Board") pursuant to Ordinance No. 13-212, entitled:

PROPOSING THE ESTABLISHMENT OF THE 'THE PRESERVE ON CRANE ROAD'SPECIAL SERVICE AREA (OR SPECIAL SERVICE AREA NO. 36) OF KANECOUNTY, ILLINOIS AND THE LEVY OF TAXES FOR THE PURPOSE OF PAYINGTHE COST OF PROVIDING SPECIAL SERVICES IN AND FOR SUCH AREA

(the "Proposing Ordinance"), duly adopted on July 9, 2013 and was considered at a public hearing (the"Hearing") held by the County Board on September 10, 2013; and

WHEREAS, notice of the Hearing was given by publication at least once not less than 15 daysprior to the Hearing in Kane County Chronicle, the same being a newspaper of general circulationwithin the County (a copy of the notice and affidavit of publication is on file with the County Clerk asExhibit A and is incorporated herein); and

WHEREAS, mailed notice of the Hearing was given by depositing notice in the United StatesMail, not less than 10 days prior to the time set for the Hearing, addressed to the person or persons inwhose name the general taxes for the last preceding year were paid on each lot, block, tract or parcelof land lying within the Area, and in the event taxes for the last preceding year were not paid, the noticewas sent to the person or persons last listed on the tax rolls prior to that year as the owner or owners ofsaid property (a copy of the notice and the affidavit of mailing is on file with the County Clerk as ExhibitB and is incorporated herein); and

WHEREAS, at the Hearing, all interested persons, including persons owning taxable realproperty located within the Area, were given the opportunity to be heard regarding any issue embodiedwithin the notice, including the establishment of the Area and the levy of taxes, and to file with theCounty Clerk written objections to the same (a copy of the transcript of the hearing [and the writtenobjections, if any,] are on file with the County Clerk as Exhibit C); and

WHEREAS, the County Board does hereby determine that it is in the public interest and in theinterest of the County and the Area that the Area be established and the taxes described herein belevied;

NOW, THEREFORE, BE IT ORDAINED by the County Board of the County of Kane, Illinois, asfollows:

§1. Incorporation of PreamblesThe preambles of this ordinance are hereby incorporated into this text as if set out herein in full.

§2. Final Adjournment of HearingThe Hearing was finally adjourned on September 10, 2013.

§3. Establishment of Area(a) The 'The Preserve on Crane Road' Special Service Area (or Special Service Area No. 36) of KaneCounty, Illinois is hereby established in and for the County and shall consist of the territory legallydescribed in Exhibit D on file with the County Clerk and made a part hereof.

(b) Said territory consists of approximately 26.111 acres lying north and west of the intersection ofBolcum and Crane Roads in Kane County, Illinois. An accurate map of the Area is on file with theCounty Clerk as Exhibit E and made a part hereof.

§4. Purpose of the Establishing the AreaThe purpose of establishing the Area is to provide the Services to the Area, which Services are uniqueand in addition to the services generally provided to the County as a whole, in the event theHomeowners' Association fails to adequately carry out its duties to maintain the stormwater drainagesystem and special management areas. The Services to be provided on a back-up basis may include,but are not limited to, the following: the operation, maintenance, repair, rehabilitation, replacement andreconstruction of any storm water detention and/or retention area, drainageway, ditch, swale, stormsewer or other stormwater facility; costs of design, engineering and other consulting services, surveyingand permits, public liability insurance, and all administrative, legal and other costs or expenses incurredin connection therewith and with the administration of the Area, including the repayment of any loan ordebt incurred for the provision of any of such Services, all of the Services to be in and for the Area.

§5. Tax LevyThe cost of the Services, which are to be provided in the event the Homeowners' Association fails toadequately carry out its duties, shall be paid by the revenue from the levy of a direct annual ad valoremtax upon all taxable property within the Area for an indefinite period of time beginning for the year 2014and shall not exceed an annual rate of 0.50% ($0.50 per $100) of the equalized assessed valuation ofeach tax parcel within the Area, and shall be in addition to all other taxes permitted by law.

§6. FilingThe County Clerk is hereby directed to file and record a certified copy of this ordinance, including adescription of the territory and an accurate map of the Area, in the office of the Kane County Clerk andin the office of the Kane County Recorder within 60 days after its adoption and approval.

SUMMARY: The Kane County Board is the fiscal agent for the Mill Creek Special Service Area (MCSSA). The Mill Creek Special Service Areawas created as part of the long term maintenance and service program for the select areas within the Mill Creek Subdivision.The responsibilities of the MCSSA include, among other things, the snow plowing and salting of select areas in the Mill CreekVillage Center for the MCSSA.

Bids have been solicited and received for the snow plowing and salting of selected areas within the Mill Creek Subdivisionfor the Mill Creek Special Service Area District in accordance with the County's Procurement Ordinance. Maple Park Trucking,50W363 IL. Route 64, Maple Park, IL. is the lowest responsible bidder for providing the snow removal and salting of theselected areas in the Mill Creek Subdivision for the MCSSA.

No general funds will be used for the contract. Services will be paid per occurrence not to exceed Forty-Five ThousandDollars ($45,000.00) from the Special Service Area Fund 520.690.730.52020. for the MCSSA.

SUMMARY: This ordinance authorizes submitting a referendum question on the March 18, 2014, election asking voters inunincorporated Kane County whether the County should pursue an electric aggregation program on behalf of residents andsmall commercial retail customers (excluding unincorporated Aurora and Dundee Townships, those residents havesuccessfully approved aggregation at the ballot). Electric aggregation authorizes the County to enter into an electric supplycontract for these residents and businesses and secure a lower rate for electric service, reducing power bills and saving theseresidents and businesses money.

The ordinance walks through the process of pursuing an electric aggregation program. The ordinance also contains theexact language to be included on the ballot.

This ordinance was drafted in accordance with guidelines set forth in the legislation which enables municipalities andcounties to pursue electric aggregation for residents and small businesses.

HAVE NOT OPTED OUT OF SUCH PROGRAM

WHEREAS, the Illinois Power Agency Act, 20 ILCS 3855,(Hereinafter referred to as the "Act")includes Section 1-92 entitled Aggregation of Electrical Load by Municipalities and Counties (asamended by Public Act 098-0404), which authorizes county boards to adopt an ordinance under whichit may aggregate residential and small commercial retail electrical loads, located within theunincorporated areas of the county where no electrical aggregation ordinance has been adopted, andfor that purpose, may solicit bids and enter into service agreements to facilitate for those loads the saleand purchase of electricity and related services and equipment; and

WHEREAS, Under the Act if the County of Kane ("County") seeks to operate an aggregationprogram under the Act as an opt-out program for residential and small commercial retail customers,then prior to adoption of an ordinance to establish a program, the County must first submit areferendum to its residents to determine whether or not the aggregation program shall operate as anopt-out program for residential and small commercial retail customers. If the majority of the electorsvoting on the question vote in the affirmative, then the County Board may implement an opt-outaggregation program for residential and small commercial retail customers; and

WHEREAS, an aggregation program would give the County the authority to enter into anelectric supply power contract on behalf of residents and small businesses in unincorporated KaneCounty who have not opted out of said program with the intent to secure a lower rate for electricservice, yielding reduced electric bills for its residents and small businesses; and

WHEREAS, Kane County would offer the referendum and conduct the aggregation programonly in the townships in unincorporated Kane County where aggregation programs have not alreadybeen established. Specifically, the unincorporated townships included in this aggregation program areHampshire, Burlington, Virgil, Kaneville, Big Rock, Rutland, Plato, Campton, Blackberry, Sugar Grove,Elgin, St. Charles, Geneva, and Batavia. The Townships of Aurora and Dundee are excluded as theypreviously passed electric aggregation through referendum; and

WHEREAS, as of November, 2013, Four Hundred Sixty Six (466) Illinois municipalities,townships and counties have affirmatively voted to adopt a municipal aggregation program, and ofthose who have secured power supply contracts, an average electric rate reduction of 25% has beenrealized for their residents and small businesses; and

WHEREAS, the Kane County Board hereby finds that it is in the best interest of the County ofKane to operate the aggregation program under the Act as an opt-out program and to submit thequestion to the electors in a referendum pursuant to the Act.

NOW, THEREFORE, BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF THE COUNTYOF KANE, ILLINOIS, AS FOLLOWS:

1. The facts and statements in the preamble to this Ordinance are hereby found by the Countyof Kane to be true and correct and are hereby incorporated as a part of this Ordinance.

2. It is in the best interests of the County of Kane to operate the aggregation program underthe Act as an opt-out program.

3. The County Clerk is directed to certify and submit the following question to be placed on theballot for the next general election allowable by law, in the following form:

Shall the County of Kane have the authority to arrange for the supply ofelectricity for its residential and small commercial retail customers who have notopted out of such program?YES NO

6. The County will create a Plan of Governance and Execution, coordinating with the IllinoisCommerce Commission, Illinois Power Authority, Attorney General's Office, Local Utility(ComEd) and Suppliers both at a local and national level.

WHEREAS, the County of Kane has undertaken a program to collect delinquent taxes and toperfect titles to real property in cases where the taxes on the same have not been paid pursuant to 35ILCS 200/21-90; and

WHEREAS, pursuant to this program the County of Kane, as trustee for the taxing districtsinvolved, has acquired an interest in the real estate described on the attached exhibit; and

WHEREAS, it appears to the Kane County Board that it would be to the best interest of thetaxing districts of Kane County to dispose of this interest in said property.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereofbe and hereby is authorized to execute a deed of conveyance of the County's interest or authorize thecancellation of the appropriate certificate of purchase, as the case may be, on the real estate describedin the attached exhibit for the sums shown and to be disbursed as shown and according to law.

SUMMARY: This is the annual resolution authorizing the County Board Chairman to enter into contracts for health, dental and visioninsurance. The wellness program continues for 2014. New this year is verification of eligibility for dependents enrolled inthe County's plans. Additional cost containment measures include plan design changes that incorporate increases inphysician co-pays, deductibles, out-of-pocket maximums and prescription drugs.

The other change is that the County is changing its method of funding insurance. In the past, the County was fully insuredwith Blue Cross, meaning the County paid monthly premiums to Blue Cross without regard to actual claim amounts. In yearswhere claims did not exceed premiums, this allowed Blue Cross to retain the excess premiums over claims as profit. Basedupon an analysis of the past 4 years of claims vs. premiums, the County's health insurance brokers at Global recommendedthe County self-fund its claims, allowing Kane County to retain any savings.

Due to ongoing union negotiations, an employee/employer contribution schedule has not yet been determined. Whenrates have been set, the schedule will be brought through the Committee structure.

AUTHORIZING CONTRACTS FOR 2014GROUP HEALTH, DENTAL AND VISION PLANS

WHEREAS, the County has reviewed its medical plans in order to provide group health, dentaland vision coverage for its employees; and

WHEREAS, BlueCross/BlueShield of Illinois, Delta Dental and Pro-Tec offer plans that are themost responsive to the needs of the County and its employees; and

WHEREAS, Premium costs for health and dental insurance are shared by eligible employeesand the County through payroll deduction. Eligible part-time employees pay the full premium for allplans for coverage; a Section 125 Plan is available at the time of enrollment that allows employees topay their share of the insurance premiums with pre-tax dollars and to set aside funds through a flexiblespending account; and

WHEREAS, the county believes it continues to be is in everyone's best interests to engage incost containment measures by continuing a bona fide HIPPA-qualified wellness program consisting of ahealth risk assessment and blood draw that allows employees and covered spouses to reduce theiremployee contributions through their voluntary participation in the wellness program; and

WHEREAS, employees will have until December 31, 2013 to complete both the health riskassessment and blood draw in order to receive the applicable wellness rate; employees failing tocomplete these activities by December 31, 2013 will be charged the applicable non-wellness ratesretroactive to January 1,2014;

WHEREAS, the county believes it to be in everyone's best interests to hold dependentverification services in conjunction with o pen enrollment activities to verify that onl y eligible dependentsare enrolled in the County 's health, dental and vision plans;

WHEREAS, the county desires to change its method of funding health insurance claims withBlue Cross/Blue Shield to self-funding from premium-based funding;

NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Kane County Board isauthorized to enter into contracts with Blue Cross/Blue Shield of Illinois, Delta Dental and Pro-Tec toprovide for group health coverage, vision and dental coverage for the period of January 1, 2014 throughDecember 31, 2014. SUMMARY: $1,400,000 of excess revenue over expenditures was set aside at end of fiscal year 2012 to pay off the net pensionobligations of the IMRF and SLEP pension plans. $1,220,000 is the net pension obligation of the Regular pension plan and$180,000 is the net pension obligation of the SLEP pension plan. This $1,400,000 was transferred to the IMRF/SLEP SpecialRevenue Fund where it is being held until November 2013, at which time it will be deposited into the County's account withthe Illinois Municipal Retirement Fund (IMRF). The reason it was held until November is that IMRF credits our account withinvestment earnings based on the the year-end balance. Therefore there is no advantage to depositing the additionalpayment with IMRF any sooner than year-end. However, if we held the payment until year-end, the County would continueearning interest on it. This resolution authorizes the Treasurer to issue this payment to IMRF in November, and authorizesthe appropriate budget adjustments.

SUMMARY: The Making Kane County Fit for Kids campaign began in 2008 to address the issue of childhood obesity. Chronic diseaseswere identified as the #1 threat to the health of Kane County residents causing more illness and premature death than anyother cause. Obesity is a large contributor to most chronic diseases. In 2011, the Fit Kids 2020 Plan was released. Thisdocument was created by over 80 community residents from various sectors and provides strategies that can beimplemented to increase physical activity and improve nutrition in Kane County. The Kane County Board formally adoptedthe Fit Kids 2020 Plan in April of 2011.

A key element of the Fit for Kids intervention is the private-public Funders' Consortium that was formed to raise money andprovide funding for interventions. The Community Foundation of the Fox River Valley is the Consortium's fiscal agent.

The Health Department has supported a coordinator for this initiative with outside grant funding since 2009. The currentgrant funding is coming to an end and the Funders' Consortium has authorized an award of $75,000 to go to the HealthDepartment to support a coordinator for the 2014 fiscal year. This resolution authorizes the health department to acceptthis funding.

WHEREAS, Kane County administers Federal funding provided by the Illinois Department ofCommerce and Economic Opportunity (DCEO) under the Workforce Investment Act for a three-countyarea, including Kane, DekaIb, and Kendall Counties; and

WHEREAS, additional grant funds were recently awarded to Kane County through a competitiveprocess under DCEO's federally-funded Rapid Response Program to deliver an early interventionservice for workers impacted by a layoff event in the three-county region using On-the-Job Training(OJT) as a placement mechanism;

WHEREAS, Kane County's program model incorporates the utilization of a qualified entity withexperience in developing and managing business partnerships that will result in the placement of 45dislocated workers in permanent employment by facilitating the job matching process and OJTassistance; and

WHEREAS, the procurement of business and employer services was performed through acompetitive bid process overseen by the Kane County Purchasing Department and resulting in therecommendation of a qualified entity.

ACCEPTING CHILD PROTECTION DATA COURTS GRANT

WHEREAS, Kane County on behalf of the Sixteenth Judicial Circuit, Kane County, incollaboration with the Administrative Office of the Illinois Courts agree to participate in theimplementation of the Child Protection Data Courts project; and

WHEREAS, The Child Protection Data Courts project was created as part of the OmnibusBudget Reconciliation Act of 1993 which provides a portion of federal funds to state court systems toconduct assessments of their foster care and adoption laws and judicial processes, and to develop andimplement a plan for system improvement; and

WHEREAS, The Kane County Judiciary has been notified by the Administrative Office of theIllinois Courts that one hundred percent of the cost of the project, $15,330.00 (fifteen thousand threehundred and thirty dollars) will pass through Kane County and are to be disbursed to the appropriatevendors conducting the study; and

WHEREAS, The budget amounts need to be reflected in revenue and expense General Ledgeraccounts for fiscal year 2013; and

WHEREAS, Receipt of said grant will require an amendment to the Judiciary Department FiscalYear 2013.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereofand hereby is authorized to accept the Child Protection Data Courts grant and authorize the necessaryexpenditures to implement the project. The Judiciary Department 2013 budget is to be amended asfollows:

SUMMARY: This employee has been on a workers compensation leave since April 2011. During the leave he has received 24 months oftemporary disability benefits. AUTHORIZING ANEMPLOYEE DEPENDENT VERIFICATION AUDIT

WHEREAS, health insurance costs for Kane County employees are the single largestexpenditure from the County's General Fund, projected to be in excess of $12 million in FY 2013; and

WHEREAS, Kane County has implemented measures to contain the costs of insuranceexpenditures, including plan design changes and wellness screenings; and

WHEREAS, studies have shown the in extreme cases as many as 15 percent (15%) ofemployee dependents are ineligible for coverage because of age, marital status, or failure to qualify asa legal dependent, and that a dependent verification audit will identify ineligible dependents that couldbe removed from coverage; and

WHEREAS, Kane County has determined that a dependent verification audit is a prudentadditional measure to implement to preserve health insurance benefits for eligible employees and theirdependents; and

WHEREAS, AFLAC, an approved County vendor, has agreed to a conduct dependentverification audit without cost to Kane County.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that AFLAC is authorized toconduct an audit of dependents on Kane County health plans during open enrollment activities.

BE IT FURTHER RESOLVED by the Kane County Board that employees enrolled in KaneCounty's health plans are required to cooperative in the audit to verify the eligibility of their enrolleddependents.

WHEREAS, Kane County's yearly Motor Fuel Tax (MET) maintenance program for the KaneCounty Highway System is referred to by KDOT as Section #14-00000-00-GM; and

WHEREAS, professional services are necessary for technical support of the County of Kane'sGeographic Information Systems (GIS) including software, hardware and applications therefor(hereinafter the "Project"); and

WHEREAS, it is necessary to retain the services of a professional geographic informationtechnology firm to provide technical support for the Project; and

WHEREAS, the Kane County Board, pursuant to Resolution No. 12-256, the County of Kaneentered into a contract with GIS Solutions, Inc., 2612 Farragut Drive, Springfield, IL 62704 for technicalsupport (hereinafter the "Contract") and also appropriated Fifty-Seven Thousand Dollars ($57,000.00)therefor; and

WHEREAS, the Contract has an option to extend the term thereof for one (1) year untilNovember 2014; and

WHEREAS, the County Board believes it to be fiscally responsible and in the best interest of theCounty to exercise the Contract term extension option, thereby extending the term of the Contract withGIS Solutions, Inc.

SUMMARY: FY2014 Purchase of Ice Control Salt

For the 2013-2014 winter season, the Division of Transportation will be using salt for ice and snow removal on the CountyHighway System. From past winters, staff estimates that we will use approximately 11,000 tons of salt.

As in previous years, KDOT will purchase our salt from the State bid. This year the State bid came in at $51.31 per ton and thechemical application (enhanced) to the salt will be $15.00 per ton for a total of $66.31 per ton. This is $1.56 lower than lastyear. The low bidder was Cargill Incorporated Salt Division and the salt contract allows for a minimum purchase of 7,200 tonsand a maximum purchase of 10,800 tons of salt.

The proposed FY2014 Budget for salt is $745,200.00 based upon previous year expenditures. Staff is proposing an initialappropriation of $716,148.00, which allows for the purchase of up to 10,800 tons of enhanced salt.

APPROVING THE 2014 PURCHASE OF ICE CONTROL SALTKANE COUNTY DIVISION OF TRANSPORTATION

MAINTENANCE DEPARTMENT

WHEREAS, bids have been solicited and received for the annual supply of ice control salt for theMaintenance Department of the Kane County Division of Transportation through the State of Illinois JointPurchasing Program, Bulk Rock Salt Contract; and

WHEREAS, KDOT utilizes a pre-mixed deicing rock salt (ice control salt) for winter roadwaymaintenance, which necessitates a chemical application to the ice control salt; and

WHEREAS, it is estimated that the Kane County Division of Transportation (KDOT) will purchaseapproximately nine thousand (9,000) tons of ice control salt for the 2013-2014 winter season and the Stateof Illinois Bulk Rock Salt Contract allows for the purchase of up to ten thousand eight hundred (10,800)tons of rock salt; and

WHEREAS, the State of Illinois Bulk Rock Salt Contract for 2013-2014 winter season will beeffective September 1, 2013 and provides for a cost of $51.31 a ton for rock salt with an additional $15.00per ton for the chemical application thereto for the ice control salt.

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes the purchase ofrock salt through the State of Illinois Bulk Rock Salt Contract from Cargill Incorporated Salt Division ofNorth Olmsted, OH in the amount of Fifty One and 31/100 Dollars ($51.31) per ton plus Fifteen Dollars($15.00) per ton for the chemical application to the rock salt to create ice control salt for a total price ofSixty Six and 31 /1 00 Dollars ($66.31) per ton.

BE IT FURTHER RESOLVED that the Kane County Board authorize the FY2014 purchase of ninethousand seven hundred ninety (9,790) tons of ice control salt to be paid from the FY2014 Budget, CountyMotor Fuel Tax Fund #302, Line Item #60390 (Rock Salt) in the amount of Six Hundred Forty NineThousand One Hundred Seventy Four and 90/100 Dollars ($649,174.90) and one thousand ten (1,010)tons of ice control salt to be paid from County Matching Fund #303, Line Item #60390 (Rock Salt) in theamount of Sixty Six Thousand Nine Hundred Seventy Three and 10/100 Dollars ($66,973.10) for a totalpayment not to exceed of Seven Hundred Sixteen Thousand One Hundred Forty Eight Dollars($716,148.00).

APPROVING ADOPT-A-HIGHWAY PROGRAM PARTICIPATION APPLICANTS

WHEREAS, the Illinois Highway Code of the Illinois Compiled Statutes (605 ILCS 120/1 et seq.)provides for the establishment of Adopt a Highway Programs by Counties and various units ofgovernment throughout the State of Illinois to support anti-litter efforts by allowing groups of privatecitizens to adopt a segment of highway for the purpose of litter and refuse collection; and

WHEREAS, the County has enacted and otherwise established pursuant to Kane County BoardOrdinance No. 13-267, the Kane County Adopt-A-Highway Program in conformance with the IllinoisHighway Code, which program is intended to assist the County in its efforts to remove refuse and litterfrom County highway right of way and otherwise beautify the County Highway System; and

WHEREAS, those groups whose names are set forth in the Exhibit attached hereto (a copy ofwhich is on file in the office of the Kane County Clerk) have submitted applications for participation inthe Kane County Adopt-A-Highway Program; and

WHEREAS, each of the groups' applications have been reviewed and approved by the CountyEngineer of Kane County and have been subsequently been approved by the TransportationCommittee of the Kane County Board; and

WHEREAS, the approval of the applicants for participation in the Kane County Adopt-A-Highway Program will facilitate the County's litter collection efforts on County highways and will aid inthe beautification of all County highways whether in urban or rural areas of the County.

NOW, THEREFORE, BE IT RESOLVED by the County Board of Kane County that eachapplicant for participation in the Kane County Adopt-A-Highway Program that is set forth on the Exhibitattached to this Resolution is hereby approved.

BE IT FURTHER RESOLVED that the County Engineer of Kane County is hereby directed tonotify all new applicant(s) of the approval of their application and to execute, on behalf of the County ofKane, the Kane County Adopt-A-Highway Program Agreement with said new applicant(s).

SUMMARY: The Village of Sugar Grove continues to coordinate with the County, the Illinois State Toll Highway Authority and the IllinoisDepartment of Transportation (IDOl) regarding the proposed 1-88 at Illinois Route 47 interchange expansion improvement.

In response, the Illinois Department of Transportation has drafted a Letter of Intent (LOl) that describes their costparticipation. The LOI will assist in moving the Phase I Engineering forward and will serve as the basis for the development afuture Intergovernmental Agreement amongst all of the governmental entities for the remaining phases of the proposedimprovement.

The current cost estimate for the project is $19,700,000. IDOTs cost participation is anticipated to be $4,925,000 or 25% ofthe total project cost. Based on the Tollway's current Interchange Cost Sharing Policy the Tollway will contribute 50% of thetotal project cost. It is anticipated that the Village of Sugar Grove will coordinate further with Kane County to address theremaining 25%.

WHEREAS, Kane, Sugar Grove, Tollway, and IDOT desire to enter into a Letter of Intent (acopy of which is on file with the County Clerk's Office) in order to serve as a basis for the developmentof a future Intergovernmental Agreement for the Project.

NOW, THEREFORE, BE IT RESOLVED that the County of Kane enter into a Letter of Intentwith the Village of Sugar Grove, the Illinois State Toll Highway Authority, and the Illinois Department ofTransportation and that the County Board Chairman is hereby authorized to execute said Letter ofIntent.

SUMMARY: The Regional Transportation Authority (RTA) provides Technical Assistance through their Community Planning GrantProgram for planning projects that benefit the community and the regional transit system. During the recent call forprojects, KDOT submitted an application to develop a Long Range Sustainability Plan for the Ride in Kane Program. The Ridein Kane Program has been in operation since 2008, and has been successfully providing an average of 12,000 rides permonth to eligible low income, disabled and senior residents of Kane County. Declining federal awards to fund the program,combined with an ever-increasing demand for the Ride in Kane service prompted the need to study the operation of theexisting program to plan for future operation.

The RTA has awarded a grant to Kane County for this study. The components of the study will include an analysis of theexisting program operations, developing a growth management plan, and establishing and encouraging linkages to theexisting ADA Paratransit and Fixed Route Systems operated in the region. The RTA has established a $75,000 budget for thisgrant, $60,000 is provided by the RTA and the local Kane County match is $15,000. It is anticipated that Kane County will beselecting a qualified consultant to perform the study via the QBS process early in 2014, with completion of the study withinone year.

WHEREAS, the County and the RTA desire to cooperate among themselves to conduct a longrange sustainability plan for the Ride in Kane Paratransit Program (hereinafter the "Project") and theCounty desires to apply to the RTA for a grant to fund said Project; and

WHEREAS, the RTA is authorized by law to expend funds for use in connection with the Projectand is also authorized to make and execute all contracts and other instruments necessary orconvenient to the exercise of said conferred powers; and

WHEREAS, the County and the RTA have determined a mutually satisfactory allocation ofresponsibilities and costs for said Project; and

WHEREAS, the grant of any funds for the Project to the County by the RTA will impose certainfinancial obligations upon the County of Kane in the amount of 20% of the not to exceed Project budgetto be determined by the Authority and 100% of any amount that exceeds the not to exceed Projectbudget.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that:

a) the Chairman of the Kane County Board is authorized to execute and file grant applicationson behalf of Kane County with the Regional Transportation Authority for the Project (the Ride in KaneParatransit Long Range Sustainability Plan); and

b) the County Board Chairman is authorized to furnish such additional information, assurances,certifications and amendments as the Regional Transportation Authority may require in connection withthe Ride in Kane Paratransit Long Range Sustainability Plan grant application; and

c) the County Board Chairman is authorized and directed on behalf of the County to executeand deliver grant applications, grant agreements and all subsequent amendments thereto between

WHEREAS, a vacancy exists in the position of Kane County Animal Control Administrator; and

WHEREAS, the Illinois Animal Control Act, 510 ILCS 5/3, requires the County Board Chairmanto appoint an Animal Control Administrator with the consent of the County Board; and

WHEREAS, the Animal Control Administrator position has been vacant for 18 months which hascreated a loss of a full time leader at the Animal Control Department; and
