43.0298.001, City of Rock Creek, pay 2019 due a fire on October 16, 2018.

B. Exempt Permit

i. Consider acknowledging the exempt permit application for the Ruffed Grouse Society –

Rum River Chapter to conduct Minnesota lawful gambling on April 25, 2020 at Wing’s

North, 19379 Homestead Rd., Pine City, MN (Pokegama Township)

2. 2020 Budget Adjustment

Consider approval of 2019 budget adjustments and recognition of spending of reserves.

3. Septic Fix-Up Special Assessment Consider authorizing the County Auditor to record a lien satisfaction on the Timothy D. & Vicki A.

Cady property and authorize the county board chair and county administrator to sign Resolution 2020-

02 extending a special assessment to the Timothy D. & Vicki A. Cady property/PID 03.0404.002, the

Kenneth D. & Lisa J. Waletzko property/PID 13.0294.000, and the Kevin Blomker/Janice Johnston

property/PID 28.0566.003.

4. Health & Human Services Contract with Monarch Counseling Service

Consider approval of a contract between Health & Human Services and Monarch Counseling Service

for parent mentor services. The cost is $30/hour for direct contact time, and $5/15 minutes for travel.

The total expenditures shall net exceed $40,000 for 2020. The agreement is from January 1 –

December 31, 2020. Authorize Board Chair and County Administrator to sign.

5. Health & Human Services Contract with Lighthouse Child and Family Services

Consider approval of a contract between Pine County Health & Human Services and Lighthouse Child

and Family Services for community support program services to enable individuals with serious mental

health and co-occurring conditions to maintain stabilization and community living. The services will

not exceed $78,000 annually, which is an annual increase of $9,000. The term of this contract is one

year, January 1 – December 31, 2020 Authorize Board Chair and County Administrator to sign.

6. Lead County Agreement between Health & Human Services and Therapeutic Services Agency,

Inc. (TSA)

Consider approval of the Lead County Agreement between Pine County Health and Human Services

and Therapeutic Services Agency, Inc. for placement services offered by TSA to children in foster care

and need services beyond a regularly licensed county foster home. There is a 2.5% increase in rates;

payment is made only if services are utilized. This contract is effective for the period of January 1,

2020 through December 31, 2020. Authorize Board Chair and County Administrator to sign.

7. Snowmobile Safety Enforcement Grant Program Consider approval of the 2020-2021 Snowmobile Safety Enforcement Grant in the amount of $4,766

for each fiscal year, totaling $9,532 for the full grant period. This grant does not require matching

funds, and is used for enforcement, education, equipment and maintenance. Authorize Board Chair

and County Administrator to sign.

8. Personnel A. Consider authorization of regular employment status for Eligibility Worker Jill Koch, effective

January 9, 2020.

B. Ratify the promotion of part-time Corrections Officers David Ackermann and Brandon Janssen to

full time status effective December 22, 2019. Grade and wage are to remain the same.

9. New Hire

A. Consider approval of the hiring of Social Worker Samantha Maser, effective January 13, 2020,

contingent upon successful background check. Grade 10, step 2, $25.76 per hour.

10. Training

A. Consider RNs Heidi Oehrlein and Toni Jensen to attend the 37th Annual MN Geriatric Care

Conference, March 11, 2020, in Rochester. Registration: $165/person; Lodging: $300/total;

Parking: approx. $24; county car will be used if available. Total cost for both individuals: $654.

Funds are available in the 2020 Health & Human Services budget.

Land and Resources Manager Caleb Anderson to present Certificates of Appreciation to Gary Valvoda

(County Board of Adjustments since 2015), Rick Williams (County Planning Commission since 2016),

plastics recycling program by volunteering his time and skid steer to load plastic on the recycling trucks).

Regular Meeting Tuesday, December 17, 2019 - 10:00 a.m.

Chair Josh Mohr called the meeting to order at 10:00 a.m. Present were Commissioners Steve Hallan,

John Mikrot, Jr., Steve Chaffee, and Matt Ludwig. Also present were County Administrator David

Minke and County Attorney Reese Frederickson.

The Pledge of Allegiance was said.

Chair Mohr called for public comment - there was no public comment.

Approve a license for 2020 for Denham Run Bar & Grill in Sturgeon Lake. A license was

already issued at the November 19, 2019 county board meeting. This licenses is for new owners.

C. 3.2 Off-Sale License

Approve a 3.2 off-sale license for Duquette General Store, Elizabeth Mae Anderson-Bandemer

(new owner).

4. Donations

A. Accept a $50 donation from VFW Post 4258 and designate to Veterans Outreach events.

B. Accept a $700 donation and designate to the Pine County Sheriff’s Office Shop-with-a-Cop

program.

C. Accept a $764 donation from the Night Stars 4-H Club of Pine City and designate to the Pine

County Sheriff’s Office K-9 program.

D. Accept a $300 donation from the Askov Rutabaga Festival and Fair Board and designate to the

Pine County Sheriff’s Reserve Fund.

5. Designate Polling Places

Approve Resolution 2019-57 declaring East Central Public School, Finlayson Elementary School,

Hinckley-Finlayson High School, and Pine City High School as designated polling places for

independent school district elections held in 2020. Authorize Board Chair and County

Administrator to sign.

6. Health & Human Services Contract with Jennifer White for Clinical Supervision Services Approve a one-year contract (January 1, 2020 – December 31, 2020) between Pine County Health

& Human Services and Jennifer White for clinical supervision services to adult mental health case

managers. The cost is $120 per hour, which is no change from the 2019 rate. Authorize Board

Chair and County Administrator to sign.

7. Agreement with Solid Oak Financial Services Approve agreement between Pine County Health and Human Services and Solid Oak Financial

Services, LLC., for providing guardianship services. The term of the contract is January 1, 2020 –

December 31, 2020, with a fee of $130 per month per client. This is an increase of $30/month/client

from 2019. Authorize Board Chair and County Administrator to sign.

8. Contract between Health & Human Services and Therapeutic Services Agency, Inc. (TSA)

Approve an agreement between Pine County Health and Human Services and Therapeutic Services

Agency, Inc. to provide clinical supervision to children mental health case managers ($120 per

hour/no change from 2019) and reflective practice supervision to child protection staff and public

health employees working in the family home visiting programs ($100 per hour for group reflective

practice supervision and $85 per hour for individual reflective practice supervision. This is a

decrease from the 2019 rate of $120 per hour). This contract is effective for the period of January 1,

2020 – December 31, 2020. Authorize Board Chair and County Administrator to sign.

9. City of Hinckley Prosecution Agreement Approve the Agreement for Prosecution Services between the City of Hinckley and the Pine County

Attorney’s Office. This agreement provides for $20,000 annually to the county attorney’s budget.

The term of the agreement is January 1, 2020 – December 31, 2020. Authorize Board Chair and

County Administrator to sign.

10. City of Rock Creek Prosecution Agreement

Approve the Agreement for Prosecution Services between the City of Rock Creek and the Pine

County Attorney’s Office. This agreement provides for $3,500 annually to the county attorney’s

budget. The term of the Agreement is January 1 – December 31, 2020. Authorize Board Chair and

County Administrator to sign.

11. Food Service Agreement – Summit Foods Service LLC

Approve the Food Service Agreement (Amendment #12) between the Pine County Jail and Summit

Food Service reflecting a 3.3% price increase for food service in the jail, effective January 15,

2020. Authorize Board Chair and County Administrator to sign.

12. 2019 Assessment Clerical Corrections List

Acknowledge the list of 2019 assessment clerical corrections.

13. Personnel

Approve regular employment status for Public Health Educator Krista Jensen, effective December

26, 2019.

14. New Hires A. Approve hiring part-time Corrections Officers Tristan Schroeder and Michelle Pickar, effective

December 18, 2019, $19.33 per hour, Grade 7, Step 1.

B. Approve hiring part-time Dispatcher Amanda Morris, effective December 18, 2019, $19.33 per

hour, Grade 6, Step 1.

C. Approve hiring Highway Maintenance Worker Wesley Miller, effective December 18, 2019,

15. Memorandum of Understanding – Pine Technical and Community College Approve the Memorandum of Understanding Amendment No. 1 between the State of Minnesota by and through its Board of Trustees of the Minnesota State Colleges and Universities on

behalf of Pine Technical and Community College and Pine County Sheriff’s Office relating to the

investigation of sexual assault. The amendment extends the term to December 31, 2021.

16. Schedule Special Meeting-Committee of the Whole Schedule Special Meeting-Committee of the Whole (Local Government Officials) meeting for

January 28, 2020, 6:00 p.m., North Pine Government Center, 1602 Hwy. 23 No., Sandstone.

REGULAR AGENDA

1. Health & Human Services Advisory Committee Report

The Health & Human Services Advisory Committee met December 2, 2019; Commissioner Hallan

provided an update at the December 3, 2019 county board meeting. Health & Human Services

Advisory Committee minutes were provided for review only.

2. Facilities Committee Report

Commissioner Ludwig provided an overview of the December 4, 2019 Facilities Committee

meeting. The sound issues at the North Pine Government Center (NPGC), John Wright Room, are

being addressed. Further discussions about space issues at the Courthouse and South Pine

Government Center (SPGC) will take place.

3. Personnel Committee Report

Commissioner Ludwig stated the Personnel Committee met on December 12, 2019 and provided an

overview of the meeting.

Motion by Commissioner Ludwig to approve recommendations of Personnel Committee as follows:

A. Health and Human Services

i. Acknowledge the resignation of Social Worker Carrie Reeves, effective December

13, 2019, and request backfill of the position and any subsequent vacancies that may

occur due to internal promotion or lateral transfer. The position is a Grade 10 with a

minimum starting wage of $24.70/hour (2020 rate).

ii. Acknowledge the retirement of Social Worker (MNChoices Assessor) Joe Kolb,

effective March 9, 2020, and request backfill of the position and any subsequent

vacancies that may occur due to internal promotion or lateral transfer. The position is

a Grade 10 with a minimum starting wage of $24.70/hour (2020 rate).

B. Sheriff’s Office – Jail

i. Acknowledge the resignation of Corrections Officer Brandon Koehnle, effective

November 24, 2019, and request backfill of the position and any subsequent

Chair Mohr distributed a comparison of salaries of county commissioners of counties between

15,000 and 50,000 population. Discussion was held regarding commissioner salary and per diems.

Commissioner Hallan stated the board received a 3% increase in 2016 and prior to that, the last

increase was in 2007.

Motion by Commissioner Chaffee to approve recommendations of Personnel Committee as follows:

Establish the 2020 Board Chair annual salary at $23,044 (unchanged from 2019)

Establish the 2020 Commissioner annual salary at $21,844 (unchanged from 2019)

4. Establish 2020 Board and Committee Per Diems

Chair Mohr provided an overview of Resolution 2019-62 which would establish the 2020 per diem

rates for residents who serve on various boards and committees for the county. (This resolution does

not apply to county commissioners). Chair Mohr expressed appreciation to those who participate as

board and committee members.

Motion by Commissioner Chaffee to approve Resolution 2019-62 establishing a $75 per diem for

the Zoning Board (planning commissioner), HHS Advisory, Pine County Chemical Health Coalition,

Extension Committee, Library, Community Health Advisory, County HRA and Probation Advisory

Committees for 2020. Second by Commissioner Ludwig. Motion carried 5-0.

5. 2020 Pine County Property Tax Levy and Budget

topic.

7. Jail Canteen Fund Assignment

Auditor-Treasurer Kelly Schroeder provided an overview of the jail canteen fund. Schroeder stated

by assigning various accounts to the canteen fund, the county’s unassigned cash balance will be

reduced while creating a fund balance to supplement purchases for the benefit of the inmates.

8. Department of Human Services Overpayment

County Administrator Minke explained the Minnesota Department of Human Services is seeking

reimbursement of $47,639.59 from Pine County. These payments were for Substance Use Disorder

for Institutes of Mental Disease (IMD). The cost share was improperly calculated by DHS from

2014-2018. DHS is seeking to collect a total of $8.8 million statewide from counties.

Motion by Commissioner Hallan to send a letter to the Minnesota Department of Human Services

contesting the repayment of funds. Second by Commissioner Mikrot. Motion carried 5-0.

9. Refugee Resettlement

County Administrator Minke gave an overview of Presidential Executive Order 13888 on Enhancing

State and Local Involvement in Refugee Resettlement. The executive order relates to county

consent to refugee resettlement. Health and Human Services Director Foss noted the State of

Minnesota is currently opted in and no refugees have been resettled in Pine County in the last two

years. Foss stated if no action is taken, the county will be considered opted out. Commissioners

requested additional information and discussion at a future meeting.

10. Wellness in the Woods Agreement

Health and Human Services Supervisor Barbara Schmidt gave an overview of the Wellness in the

Woods program which is currently in place in Stearns County. Wellness in the Woods would

provide peer-to-peer mental health socialization activities for adults in Pine County; the cost of each

event would not exceed $1,100 with an annual cost of $13,200. The term of the contract is

December 2019 through December 31, 2020.

Motion by Commissioner Chaffee to approve an agreement between Health & Human Services and

Wellness in the Woods. Authorize Board Chair and County Administrator to sign. Second by

Commissioner Hallan. Motion carried 5-0.

11. Addendum to Memorandum of Agreement – University of Minnesota Extension

The 2020 Pine County Budget includes the addition of a one-half time agricultural educator.

Motion by Chair Mohr to approve an Addendum to Memorandum of Agreement between the

University of Minnesota and Pine County for providing Extension programs locally and employing

county Extension staff. Motion carried 5-0.

12. Purchasing from Mohr Parts and Supplies Inc.

Chair Mohr is the owner of Mohr Parts and Supplies Inc. in Pine City. Minnesota statute prohibits a

county commissioner from having a direct or indirect interest in business with the county unless the

County Board, by unanimous vote, allows the business transactions and the transactions do not

require a bid under statute. The county commissioners have indicated a desire to consider this

resolution on an annual basis.

Motion by Commissioner Hallan to approve Resolution 2019-60 approving purchasing from Mohr

Parts and Supplies Inc. for 2020. Second by Commissioner Ludwig. Motion carried 4-0 with

Commissioners Hallan, Chaffee, Mikrot and Ludwig voting in favor. Chair Mohr abstained from

13. Facilities Committee – January 2020

County Administrator Minke noted the January 2020 regular meeting of the Facilities Committee

falls on New Year’s Day and recommended the Facilities Committee meeting be rescheduled.

Motion by Commissioner Ludwig to schedule the January, 2020 Facilities Committee to January 8,

2020. Second by Commissioner Chaffee. Motion carried 5-0.

14. Establish Date for 2020 County Board Strategic Planning Session

It was the consensus of the board to schedule a Special Meeting/Committee of the Whole meeting

for strategic planning and discussion of goals and major projects for January 30, 2020 at 9:00 a.m.,

in the Board Room, Pine County Courthouse, Pine City.

15. AFSCME Correction Officer-Dispatcher Collective Bargaining Agreement 2020-2021

County Administrator Minke stated the tentative agreement with the Correction Officer-Dispatcher

unit represented by AFSCME was approved by the bargaining unit.

Motion by Chair Mohr to approve the Collective Bargaining Agreement with correction

officers/dispatchers for 2020-2021. Second by Commissioner Chaffee. Motion carried 5-0.

16. Commissioner Updates Holiday Tree Event: Chair Mohr stated this event went well.

Soil & Water Conservation District: Commissioner Ludwig stated there was discussion on how

often wells should be tested. SWCD will send out tree ordering information soon.

AMC Annual Conference: Chair Mohr, Commissioner Hallan, and Commissioner Ludwig stated

there were very informative presentations and discussions at the conference.

East Central Solid Waste Commission: Commissioner Hallan stated the 2020 budget was set.

East Central Regional Library: Chair Mohr absent due to AMC Annual Conference.

Pine County Chemical Health Coalition: Commissioner Ludwig absent due to AMC Annual

Conference.

Law Library: IT Director Ryan Findell stated a new computer is needed as the current computer

has reached end of life.

Central MN Jobs and Training: Commissioner Hallan stated several legislators were present and

good discussions took place.

Central MN Workforce Development Board: No report.

State Community Health Services Advisory Committee (SCHSAC): Commissioner Chaffee unable

to attend.

East Central Regional Development Commission: Commissioner Mikrot stated a letter of support

for the James Oberstar Trail will be provided.

On behalf of the commissioners, Vice-Chair Chaffee presented Chair Mohr a Certificate in

recognition and appreciation of Commissioner Mohr’s service as Chair of the Pine County Board of

Agency, Inc. to provide clinical supervision to children mental health case managers ($120 per

hour/no change from 2019) and reflective practice supervision to child protection staff and public

health employees working in the family home visiting programs ($100 per hour for group reflective

practice supervision and $85 per hour for individual reflective practice supervision. This is a

decrease from the 2019 rate of $120 per hour). This contract is effective for the period of January 1,

2020 – December 31, 2020.

Approve the Agreement for Prosecution Services between the City of Hinckley and the Pine County

Attorney’s Office. This agreement provides for $20,000 annually to the county attorney’s budget.

The term of the agreement is January 1, 2020 – December 31, 2020.

County Attorney’s Office. This agreement provides for $3,500 annually to the county attorney’s

Anderson provided a summary of the statements from all of the public officials listed in Section 8.03 of the Pine County Subdivision and Platting Ordinance.

• Anderson confirmed that the lot meets all zoning lot dimensional requirements, public road frontage requirements, and SSTS requirements.

• The County Engineer, Mark Lebrun, provided his approval that the road meets specifications listed in the Subdivision and Platting Ordinance.

• The County Surveyor provided technical feedback to the applicant's surveyor, Tyler Kroschel, and the corrections have been made.

• The County Attorney verified that the fee simple title to the platted property is in the sole ownership of the subdivider.

• Dell Grove Township provided a letter that they approve of the road construction provided the road is graded in spring of 2020.

Glattly made a motion that if there was an existing public road easement along the property it should be approved as a minor subdivision. Tyler Kroschel advised that all of the platting work is mostly done and it would be more work to revise the plat as a minor subdivision. Glattly withdrew his motion.

Glattly/Valvoda 6-0 to inform the County Board that the Final Plat conforms to the requirements of this Ordinance.

OLD BUSINESS: Pine County Zoning Ordinance Anderson provided the Board the zoning maps prepared by the City of Denham, City of Kerrick, and Nickerson Township. The Board question the "spotty zoning," aspects of the Kerrick zoning map but agreed to honor the zoning maps as submitted by all three jurisdictions.

Anderson inquired with the Board as to how they would like to proceed with the County Zoning Ordinance. He also advised that the relationship between the Subdivision and Platting Ordinance and County Zoning Ordinance should be more closely looked at. The group requested time to review the County Zoning Ordinance and will consider it at their December 2019 meeting.

Northern has received approval from the Federal Energy Regulatory Commission (FERC) to utilize FERC's pre-filing process. FERC approves the location, construction, and operation of interstate natural gas pipeline facilities, and conducts environmental reviews to ensure impacts are minimized. The pre-filing process allows Northern, to work proactively with stakeholders prior to filing the required application with FERC. The pre-filing process includes the implementation of a public participation plan, which is discussed in more detail below.

Northern's public participation plan includes discussions with affected landowners; conducting public meetings near the proposed facility locations; identifying a single point of contact with Northern; and establishing a dedicated project website to post project information. The contact information is detailed in the final paragraph below. Northern's pre-filing approval and subsequent documents are docketed at PF20-l-OOO. The docket may be accessed through the FERC website at www.ferc.gov. Northern plans to file its application with FERC in July 2020 requesting authorization to construct and operate the facilities. Upon approval of that application, Northern anticipates construction will commence in spring 2021.

This letter has been sent to you because you have been identified as a potential stakeholder, by virtue of being an affected landowner or a public official in the project area; permitting agencies also are receiving letters. Northern plans to hold four or five public open houses within the project areas in February 2020. Once the open houses are finalized, stakeholders willreceive an invitation to the open houses. Details on the open houses will be published in local newspapers. Northern has contacted, and continues to contact, affected landowners during the land survey process.

Beginning in 2016, Pine County has been extending loans to homeowners to upgrade their non-compliant septic

systems through a Cleanwater Partnership Loan from the Minnesota Pollution Control Agency. Two properties

recently completed their septic upgrades. Additionally, one property was done previously through the recording

the lien, however, the property owners are now refinancing, therefore the lien needs to be satisfied and the

remaining balance extended as a special assessment.

Action Requested:

Consider authorizing the County Auditor to record a lien satisfaction on the Cady’s property and authorize the

County Board Chair and County Administrator to sign Resolution 2020-02 extending a special assessment to the

Cady’s property (Parcel 03.0404.002), the Waletzko’s property (Parcel 13.0294.000), and the Blomker/Johnston

property (Parcel 28.0566.003).

Financial Impact:

Grant funds have been utilized to install the systems.

Background information on Item:

On August 20, 2019, the Pine County Board of Commissioners approved a contract between HHS and Monarch Counseling Services for the provision of parent mentor services to at-risk children and families in the East Central School District through the end of 2019. The attached contract seeks to continue parent mentor services in 2020, at a cost of $30/hour for direct contact time, and $5/15 minutes for travel. The total expenditures shall not exceed $40,000 for 2020. The County Attorney's Office has reviewed the contract.

This community-based alternative to placement has reached at least 18 East Central School District families in 2019. In addition to providing parent mentor services to at­ risk children and families in the East Central School District, HHS is looking to expand parent mentor services to one or more other school districts in Pine County in 2020. As the department looks to build upon it's preventative services to placement, this is one service in the continuum of care that allows children to remain with their caregivers, while providing their caregivers with extra support in their own home.

Action Requested:

Authorize Board Chairperson and County Administrator to sign the contract.

Financial Impact:

As noted above, the annual cost of parent mentor services will not exceed $40,000. The 2020 HHS budget includes funding for community-based options like parent mentor services that allow children to remain in their own home when safely able to do so.

CONTRACT FOR PARENT MENTOR SERVICES BETWEEN

The County of Pine, acting through its Health and Human Services Department, 315 Main Street South, Suite 200, Pine City, MN 55063, (Agency), and Monarch Counseling Service, 72351 Pine River Road, Willow River, MN 55795, (Contractor), enter into this Contract effective January 1, 2020, through December 31, 2020, for the provision of parent mentor services.

WHEREAS, Contractor is duly qualified to provide parent mentor services;

WHEREAS, Agency wishes to purchase parent mentor services from the Contractor; and,

WHEREAS, Agency, pursuant to Minnesota Statutes section 256M.60, wishes to purchase such program services from Contractor;

NOW THEREFORE, in consideration of the mutual understanding, and agreements set forth, the Agency and Contract agree as follows:

1. Contractor's Duties

Agency will provide parent mentor referrals to Contractor. Contractor will provide parent mentor services to the referrals. Upon receipt of the referral, Contractor will contact referrals within five business days. The primary purpose of parent mentor services is to provide intensive help and support to parents and families who are involved in the child welfare system. Families with children who are at risk of placement could often benefit from more intensive services provided to them in their own home and community. A parent mentor will work with a referred family from two to six hours per week, depending on the needs of the family as assessed by the referring source and Pine County Health and Human Services. A parent mentor will provide much needed hands-on assistance in getting parents to and from their appointments, providing support to children and families, assist in filling out necessary paperwork, assist the parent in maintaining a safe and sanitary environment for their child, and will also provide other support to parents and children based upon the referral of the assigned social worker. The assigned parent mentor will provide written monthly updates to the assigned social worker. The goal of the parent mentor program is to maintain children in their own home and community, and improve overall family functioning and well-being.

2. Cost and Delivery of Purchased Services

Rates for services are as follows: $30.00 per hour for parent mentor services, and $5.00 for each 15 minutes of travel; the total amount billed to Pine County shall not exceed $40,000 from January 1, 2020 through December 31, 2020.

All parties reserve the right to give a 30-day written notice of termination of this Contract. This is a cash basis fee-for-service Contract, which indicates that payment shall be for services provided during the contract period. Monthly invoices should be sent within thirty days of service to the attention of the Director, Pine County Health and Human Services at 315 Main Street South, Ste. 200, Pine City, MN 55063.

3. Audit and Record Disclosure

Contractor shall maintain records, using generally accepted accounting principles that reflect all revenue received and all direct and indirect costs incurred in performing the Contract; maintain records about purchased services provided, service dates and other information that is required by Agency.

The contractor shall allow personnel of Agency and the Minnesota Department of Human Services access to Contractor's facility at reasonable hours to exercise their responsibility to monitor purchased services and copy such materials as necessary.

Contractor shall comply with policies of the MN Department of Human Services regarding social services recording and monitoring procedures.

4. Safeguard of Client Information

The use or disclosure of client information in violation of any rule of confidentiality provided for in Minnesota Statutes, Chapter 13, (the Minnesota Government Data Practices Act) or for any purpose not directly connected with Agency's or Contractor's responsibility with respect to the purchased services hereunder is prohibited. Contractor is the responsible authority to ensure that they are in compliance with the Minnesota Government Data Practices Act.

All data collected, created, received, maintained, or disseminated for any purposes in the course of Contractor's performance of this Contract is governed by the Minnesota Government Data Practices Act, or any other applicable state statutes, and state rules adopted to implement the Act, as well as federal regulations on Data Privacy, including the Health Insurance Portability and Accountability Act. Contractor agrees to abide strictly by these statutes, rules, and regulations.

5. Compliance with Other Regulations

Contractor further agrees to comply with Minnesota Statutes section 604.202 (Liability of Employer). When applicable, Contractor agrees to comply with the Civil Rights Act of 1964.

6. Indemnity and Insurance

Contractor agrees to defend, indemnify, and hold Pine County Health & Human Services, its employees and officials harmless from any claims, demands, actions or causes of action, including reasonable attorney's fees and expenses arising out of act or omission on the part of Contractor, or any of their agents or employees in the performance of or with relation to any of the work or services to be performed or furnished by Contractor under the Contract, including, but not limited to:

By reason of any service, client's suffering personal injury, death or property loss or damages either while participating in or receiving from Contractor the care and services to be furnished by Contractor under this Contract, or while on premises owned, leased or operated by Contractor, or while being transported to and from said premises in any vehicle owned, operated, chartered or otherwise contracted for by Contractor or anyone whom s/he assigns; or by reason of any service client's causing injury to, or damage to, the property of another person during any time when Contractor or whom s/he assigns, or employee thereof has undertaken or is furnishing the care and services called for under this Contract.

Contractor will furnish an original certificate of insurance as evidence of required coverage to Agency. Insurance should include professional liability coverage acceptable to Agency.

7. Independent Contractor Status

Contractor is to be and shall remain an independent contractor with respect to any and all work performed under this Contract. It is agreed that nothing herein contained is intended or should be construed in any manner as creating or establishing a relationship as agents, partners, joint ventures or associates between the parties, or as constituting Contractor as the employee of Pine County Health & Human Services for any purpose or in any manner whatsoever.

8. Nondiscrimination and Civil Rights Assurance

During the performance of this agreement, the CONTRACTOR agrees to the following: No person shall, on the grounds of race, color, religion, political beliefs, age, sex, sexual orientation, disability, marital status, public assistance status, creed or national origin be excluded from full employment rights in, participation in, be denied the benefits of or be

otherwise subjected to discrimination under any and all applicable Federal and State laws against discrimination.

9. Miscellaneous

It is understood and agreed that the entire Contract of the parties is contained herein and that this Contract supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof. It is understood that Agency reserves the right to monitor Contractor's performance under this Contract by observation or direct service provision to client and/or survey of agencies or individuals purchasing or receiving services.

Background information on Item:

Since the closing of Riverwood Centers, Pine County Health and Human Services has historically contracted with Lighthouse Child and Family Services for the provision of Community Support Program (CSP) services. CSP services are designed to enable individuals with serious mental illness and co-occurring conditions to maintain stabilization and community living.

The attached contract states that Lighthouse will continue to provide one full-time staff to work with referred individuals who reside in Pine County. In addition to providing one full-time staff member to work with referred individuals, Lighthouse will also focus on opening another adult drop-in center in Pine County, preferably in the central or northern part of the county. This service is being explored with Lighthouse after receiving direct feedback from county residents at a May 2019 mental health community conversation held at the Duquette Town Hall.

The attached contract spans the 2020 calendar year. The services provided under this contract will not exceed a cost of $78,000 annually, which is an annual increase of $9,000. The increased rate covers additional expenses associated with a second drop-in center, increased expenses in mileage and the one full-time staff dedicated to serve Pine County residents. The contract has been reviewed by the County Attorney's Office.

Over the next year, HHS will gather consumer feedback regarding the services, especially any feedback associated with the drop-in center.

Action Requested:

Authorize Board Chairperson and County Administrator to sign the agreement.

Financial Impact:

As noted above, the annual cost of CSP services will not exceed $78,000. The 2020 HHS budget includes funding for CSP services. The expenses incurred by providing these services are reimbursed to Pine County through grants and allocations received by the MN Department of Human Services.

CONTRACT BETWEEN PINE COUNTY HEALTH AND HUMAN SERVICES AND

LIGHTHOUSE CHILD AND FAMILY SERVICES

THIS AGREEMENT is made and entered into by and between the Pine County of Pine Board of Commissioners, through Pine County Health and Human Services, (hereinafter referred to "COUNTY"), 315 Main Street 5., Ste 200, Pine City, MN 55063 and Lighthouse Child & Family Services, LLC, (hereinafter referred to as CONTRACTOR), 160 3rd Avenue NW, Milaca, MN 56353.

WHEREAS, the Agency has identified a certain population within the County of Pine who are in need of family preservation and related mental health services; and

WHEREAS, Minn. Stat. §245.461 through §245.486 and Minn. Stat §245.487 through §245.488 establish the Minnesota Comprehensive Adult Mental Health Act and the Minnesota Comprehensive Children's Mental Health Act; and

WHEREAS, the Contractor represents that it is duly licensed, qualified, and willing to perform such services; and

WHEREAS, the agency wishes to purchases such services from the Contractor; and

NOW, THEREFORE, in consideration for the mutual undertakings and agreements hereinafter set forth, the COUNTY, through Health and Human Services, and the CONTRACTOR agree as follows:

I. Term of Agreement The CONTRACTOR agrees to furnish services to the benefit of the COUNTY during the period commencing January 1, 2020, and terminating December 31, 2020 irrespective of the date of signatures/execution below.

II. Services to be Provided and Reporting A. The Community Support Program (CSP) is a full range of services including client outreach, medication

monitoring, assistance in independent living skills, development of employability and work related opportunities, crisis assistance, psychosocial rehabilitation, housing support services and help in applying of government benefits.

1. CSP are community-based services designed to enable individuals with serious mental illness and co-occurring conditions to maintain maximum adjustment and functioning, with the goal of being integrated into the normal living, working, learning, and leisure time activities of the community. Service modality is principally Psycho education, i.e., structured individual and group activity designed to teach functional and copies skills to remediate client specific, disability-related deficits.

2. Lighthouse Child and Family Services will focus on integrating Evidence Based Practices into services, and the CSP staff is expected to be competent in offering the Illness Management and Recovery Program and motivational interviewing skills. Lighthouse Child and Family Services shall operate on a strength-based model with consumers and encourage, support and help develop peer support opportunities.

3. The CSP staff for each County will be a minimum of one Full Time Equivalent (FTE) worker to provide CSP services to 30 - 35 adults with a productivity expectation of a minimum of 20 billable hours of services a week.

4. County Social Service referrals will be given priority, but outside referrals will be accepted as well if caseload/workload allows. Admission to billable services will be determined by Lighthouse Child and Family Services staff based on state medical assistance criteria.

5. The Lighthouse Child and Family Services CSP worker shall maintain the same record keeping standards for CSP services as other mental health services, that is, each clinical chart must contain a current Diagnostic Assessment, Individual Treatment Plan, Functional Assessment and Crisis plan within the first thirty days of service.

6. Lighthouse Child and Family Services will also focus on opening an adult drop-in center in central or northern Pine County, to be offered one to two times per month. Data will be collected and monitored to determine the viability of continuing to operate a drop-in center in future years. The costs associated with facilitating the drop-in center are included in the costs specified in this contract under Section V.

Ill. In partnership, the COUNTY and CONTRACTOR will oversee the eligibility criteria, the referral process, services for treatment, and reporting process.

IV. Community Mental Health Reporting System The CONTRACTOR agrees to report to the Agency or County of Financial Responsibility (CFR) according to specifications of the Community Mental Health Reporting System (CM HRS) and according to other specifications of the Agency or CFR.

V. Cost of the Agreement/Billing Instructions CSP services will be billed monthly by the CONTRACTOR to the COUNTY at a rate of $5,650.00/month, plus mileage billed to the county at the federal mileage rate; costs associated with facilitating a drop-in center (such as supplies, crafts, etc.), will also be billed to the COUNTY with all costs not to exceed $78,000.00 annually. Attached with each monthly invoice, the CONTRACTOR will provide a list of client names and dates of Service to the COUNTY.

VI. Payment for Services Payment for services shall be made direct to the CONTRACTOR within 35 days of COUNTY's receipt of the said invoice, pursuant to Minnesota Statute §471.425, subdivision 2.

VII. Indemnification and Insurance A. CONTRACTOR agrees that in order to protect itself as well as the COUNTY, it will at all time during

the term of this contract keep in force an insurance policy. This liability insurance policy will meet the limits as shown below or be equal to the tort liability limits under Minnesota Statute section 3.736 and 466.04, subdivision 4, whichever is greater. However, should the coverage available to the CONTRACTOR exceed the liability limits, nothing by the way of that level of coverage shall be construed as a waiver of the limits available to the COUNTY. The COUNTY will be sent a current certificate of insurance on an annual basis.

1. Commercial General Liability Insurance a. $500,000 per claimant/ $1,500,000 per occurrence/ $3,000,000 annual

aggregate. 2. Automobile Insurance (if vehicles are used to conduct this contract)

a. Coverage shall be provided for hired, non-owned and owned autos. b. Minimum limits: $500,000 per claimant/ $1,500,000 occurrence/ $1,500,000

annual aggregate. 3. Worker's Compensation and Employer's Liability as required by Minnesota Law. 4. Professional Liability/ Errors and omissions coverage.

a. Per claim limit: $1,500.000 b. Per person: $500,000

5. Bonding: The CONTRACTOR will be required to maintain at all times, during the terms of this contract, a fidelity bond or insurance coverage for employee dishonesty with a minimum amount of $50,000 covering the activity of each person authorized to receive or distribute monies under the term of this contract.

B. Any policy obtained and maintained under this clause shall provide that it shall not be cancelled, materially changed, or not renewed without thirty days prior notice thereof to the COUNTY.

C. Prior to the effective date of this contract, and as a condition precedent to this contract, the CONTRACTOR will furnish the COUNTY with Certificates of Insurance.

D. Insurance shall be place with insurers with a current A.M. Best rating of no less than A VII. If the contractor is self-insured, review of financial information may be required.

E. The CONTRACTOR agrees to defend, indemnify, and hold COUNTY, its employees and officials harmless from any claims, demands, actions or causes of action, including reasonable attorney's fees and expenses arising out of any act or omission on the party of the CONTRACTOR, or its subcontractors, partners or independent contractors or any of their agents or employees in the

performance of or with relation to any of the work or services to be performed or furnished by

the vendor or the subcontractors, partners, or independent contractors or any of the agents or

employees under the agreement.

VIII. Compliance with Laws/ Standards A. The CONTRACTOR shall maintain in good standing, all professional credentials necessary to

provide the services contemplated and set forth herein. B. The CONTRACTOR shall abide by all Federal, State, or local laws, statutes, ordinances, rules and

regulations now in effect or hereinafter adopted pertaining to the contract or to the subject matter thereof for which the CONTRACTOR is responsible.

1. By signing this contract, the CONTRACTOR certifies that it and its principals and its employees: Are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from transacting business by or with any federal, state or local government department or County; and have not within a three-year period preceding this contract:

a. Been convicted of or had a civil judgment rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain or performing a public (federal, state or local) transaction or contract;

b. Violated any federal or state antitrust statutes; or c. Committed embezzlement, theft, forgery, bribery, falsification or destruction of

records, making false statements or receiving stolen property; and 2. Are not presently indicted or otherwise criminally or civilly charged by a governmental

entity for: a. Commission of fraud or a criminal offense in connection with obtaining,

attempting to obtain or performing a public (federal, state or local) transaction; b. Violating any federal or state antitrust statutes; or c. Committing embezzlement, theft, forgery, bribery, falsification or destruction of

records, making false statements or receiving stolen property; and 3. Are not aware of any information and possess no knowledge that any sub contractor(s)

that will perform work pursuant to this contract are in violation of any of the certifications set forth above.

4. Shall immediately give written notice to the COUNTY should CONTRACTOR come under investigation for allegations of fraud or a criminal offense in connection with obtaining, or perforating; a public (federal, state or local government) transaction; violating any federal or state antitrust statues; or committing embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements or receiving stolen property.

IX. Conditions of Contractors' Obligation A. The CONTRACTOR agrees to inform the COUNTY of changes in ownership, organizational

structure, board of director membership, and/or chief operating officers with thirty (30) days after occurrence.

B. It is understood and agreed that in the event the funding to the COUNTY from State and Federal sources is not obtained and continued to an aggregate level sufficient to allow for the purchase of the indicated quantity of Purchased Services, the obligations of each party hereunder shall be terminated.

C. The CONTRACTOR must, within ten (10) days notify the COUNTY in writing whenever it is unable

to, or going to be unable to, provide the required quality or quantity of Purchased Services. Upon

such notification, the COUNTY must determine whether such inability will require modification or

cancellation of said contract.

D. Either party may cancel this contract with or without cause upon sixty (60) days written notice.

Written notice of cancellation by the CONTRACTOR shall be addressed to Director, Pine County

Health and Human Services, 315 Main Street South Suite 200, Pine City, MN 55063.

E. Before the termination date of the contract, the COUNTY may evaluate the contract performance

of the CONTRACTOR and determine whether such performance merits renewal of this contract.

F. The COUNTY will reimburse for services specified in this contract that have been delivered. Any

alterations, variations, modifications or waivers of provisions of this contract shall be valid only

when they have been reduced to writing, duly signed, and attached to the original contract.

G. If the COUNTY determines that funds are not being administered in accordance with the approved

service plan and budget or that services are not being properly provided according to the terms of

this contract, the COUNTY may terminate this contract after notice has been provided to the

CONTRACTOR's designated agent.

X. Independent Contractor A. The CONTRACTOR is an independent contractor and neither the position nor the work of the

CONTRACTOR shall cause the CONTRACTOR to be construed as an employee in any way. The CONTRACTOR shall at all times be free to exercise initiative, judgment and discretion as to how to best perform or provide services.

B. The CONTRACTOR acknowledges and agrees that it is not entitled to receive any of the benefits received by COUNTY employees and is not eligible for workers or unemployment compensation benefits.

C. The CONTRACTOR also acknowledges and agrees that no withholding or deduction for State or Federal income taxes, FICA, FUTA, or otherwise, will be made from the payments due and that it is the CONTRACTOR's sole obligation to comply with the applicable provision of all Federal and State laws.

XI. Data Practices All data collected, created, received, maintained, or disseminated for any purposes by the activities of CONTRACTOR because of this contract is governed by the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, as amended, the Minnesota Rules implementing said act now in force or as adopted, as well as HIPM or other Federal regulations on data privacy.

XII. Records-Availability and retention A. Pursuant to Minnesota Statute§ 16C.05 subd. 5, the CONTRACTOR agrees that the COUNTY, the

State Auditor, or any of their duly authorized representatives at any time during normal business hours and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of the CONTRACTOR and involve transaction relating to the contract.

B. CONTRACTOR agrees to maintain these records for a period of six (6) years from the date of termination of the contract.

C. CONTRACTOR will maintain client and placement records according to business standard practices.

The CONTRACTOR agrees to:

A. At the end of December 2020, the CONTRATOR will provide a financial review of program

expenditures.

B. Maintain all records pertaining to the contract at address of CONTRACTOR for six (6) years for

audit purposes.

XIV. Contractor Qualifications and Training A. The CONTRACTOR agrees to use only qualified personnel to provide any purchased services. If

licensing or certification is a necessary prerequisite for provision of services, the CONTRACTOR shall ensure that personnel are properly licensed or certified.

B. The CONTRACTOR agrees to provide or arrange for staff training as required. C. A copy of the staff training plan shall be provided to the COUNTY upon request. D. A background check satisfactory to the COUNTY will be performed on all employees prior to hire

in accordance with Minnesota Department of Human Services. E. The CONTRACTOR agrees to maintain at all times during the term of the contract, a process

whereby its current and prospective employees and volunteers who will have direct contact with persons served by the program or program services, will consent to a background check for evidence of maltreatment of adults or minors substantiated under Minnesota Statutes§ 626.556.

XV. Subcontracting CONTRACTOR shall not enter in any subcontract for performance of any services contemplated under the contract without the prior written approval of the COUNTY and subject to such conditions and provisions as the COUNTY may deem necessary. With regard to any subcontractors so retained the CONTRACTOR shall be responsible for the performance under this contract and agrees to comply with prompt payment of any and all subcontractors pursuant to Minnesota Statutes §471.425, subd. 4a.

XVI. Nondiscrimination and Civil Rights Assurance During the performance of this agreement, the CONTRACTOR agrees to the following: No person shall, on the grounds of race, color, religion, political beliefs, age, sex, sexual orientation, disability, marital status, public assistance status, creed or national origin be excluded from full employment rights in, participation in, be denied the benefits of or be otherwise subjected to discrimination under any and all applicable Federal and State laws against discrimination.

XVII. Representatives The following named persons are designated the authorized representatives of parties for purposes of this contract. These persons have authority to bind the party they represent and to consent to modifications and subcontracts, except that, as to the COUNTY, the authorized representative shall have only the authority specifically or generally granted to the County Board of Commissioners. Notification required to be provided pursuant to the contract shall be provided to the following named persons and addresses unless otherwise stated in the contract, or in a modification of this contract.

XVIII. Modifications Any alterations, variations modifications, or waivers of provisions of this agreement must be valid only

when they have been reduced in writing, duly signed, and attached to the original of this agreement.

No claim for services furnished by CONTRACTOR not specifically provided in the agreement will be

allowed by the COUNTY nor must the CONTRACTOR do any work or furnish any material not covered by

the agreement, unless this is approved in writing by the COUNTY. Such approval must be considered a modification of the agreement.

IN WITNESS THEREOF, the COUNTY and the CONTRACTOR, each intending to be bound by this agreement,

effective January 1, 2020 irrespective of the dates of the signatures, certifies that the appropriate person

Attached please find the host county contract with TSA (Therapeutic Services Agency) effective from January 1, 2020 through December 31, 2020. This contract is specific to the placement services that are offered by TSA to children who are in foster care and need services above and beyond a regularly licensed county foster home. There is a 2.5% increase in the rates. Payment is only provided to TSA if the services are utilized.

The County Attorney's Office has reviewed the contract.

Action Requested:

Authorize Board Chairperson and County Administrator to sign the lead county agreement with TSA.

Financial Impact:

As noted above, the service rates are increasing by 2.5%. Payment is only provided to TSA for services rendered.

LEAD COUNTY AGREEMENT BE1WEEN PINE COUNTY HEAL TH & HUMAN SERVICES

AND THERAPEUTIC SERVICES AGENCY (TSA, INC.)

The County of Pine, acting through its Health & Human Services Department, 315 Main St S, Suite 200, Pine City, Minnesota, 55063, hereafter referred to as the "Agency", and Therapeutic Services Agency, 220 Railroad Street SE, Pine City, Minnesota, 55063, hereafter referred to as the "Contractor", enter into this Contract effective for the period of January 1, 2020 through December 31, 2020.

WHEREAS, The Contractor is duly qualified to provide social services; and

WHEREAS, The Agency, pursuant to Minnesota Statutes, Section 373.01, and 256M.60 wishes to purchase such program services from the Contractor; and

NOW THEREFORE, in consideration of the mutual understandings, and agreements set forth, the Agency and Contractor agree as follows:

1. Contractors Duties:

a. As specified in the Minnesota Children and Community Services Act, and the 2004 Pine County Service Plan and the attached exhibits, the Agency agrees to purchase and the Contractor agrees to furnish the following:

(1) Placement services that the Contractor is qualified to provide including Shelter, Adolescent Transition Program, Adolescent Treatment Program, Teen Parent and Child, Network Support of Foster Care, Respite Care, and Child Treatment Program

b. Agencies can request the following as they deem necessary when accessing services through the lead county agreement:

(1) An explicit description of the services to be provided; and (2) Billing Policy. The Contractor also agrees to provide upon request:

a. An exposition of the staffing including job descriptions and professional qualifications of personnel; and

b. An organization chart; and c. Program budget

(3) Administrative rate description for the child and adolescent treatment programs.

c. The Contractor shall, in writing within ten ( 10) days, notify the Agency whenever it is unable to, or going to be unable to, provide the required quality or quantity of Purchase Services. Upon such notification, the Agency shall determine whether such inability will require modification or cancellation of said contract.

2. Cost and Delivery of Purchased Services:

a. Refer to attached Rate Sheet. The County of Financial Responsibility will determine the specific units of service to be delivered for each client based on the county assessment of the

need and scope of services.

b. Contractor certifies that the services to be provided under this agreement are not available without cost to eligible clients. The Contractor further certifies that payment claims for Purchased Services will be in accordance with rates of payment which do not exceed amounts reasonable and necessary to assure quality of service. The Contractor certifies that rates of payment do not reflect any program costs assignable to private pay or third-party service recipients.

c. The Agency and Contractor agree that services for which the County are not charged are as follows:

1. Therapeutic Services Agency Supervisor time in activity that facilitates the processing of referrals, case assignments, and supervision of staff relative to agency business in attending to job performance of staff, staff development etc.

2. Expert consultation time not case related, focused on professional development of personnel.

3. Secretarial and bookkeeping time. 4. Any activities by officers of the company in dealing with case

issues or other matters.

3. Eligibility for Services:

The parties understand and agree that the eligibility of the client to receive the Purchased Services is to be determined in accordance with eligibility criteria established by the Agency's Service Plan. The parties agree and understand that the Agency shall determine preliminary and final client eligibility.

a. It is understood and agreed by the parties that, for fee eligible recipients, fees shall be charged and collected in accordance with fee policy and schedules adopted by the county board of commissioners and approved by the Commissioner of Human Services in accordance with the provisions of Minnesota Statutes, Section 256M.60, subd. 6.

b. The Contractor shall not charge any program or service fee to social service eligible clients except in accordance with a. above.

c. When the Agency has determined that the client is no longer eligible to receive purchased services or that services are no longer needed or appropriate, the Agency shall notify the Contractor within five (5) days of the determination.

d. The Contractor shall notify the Agency and the client in writing whenever the Contractor proposes to discharge or terminate service(s) to a client. The notice must be sent at least five

(5) working days prior to the proposed date of discharge or termination, and must include the specific grounds for discharge or termination of service( s ). The Contractor shall not discharge or terminate services to a client prior to the proposed date unless delay would seriously endanger the health, safety, or well being of other residents or service recipients.

e. The Contractor shall establish written procedures for discharging a client or terminating services to a client. The written procedures shall include: ( 1) Preparation of a summary of findings, processes, and plans to be transmitted with the client.

4. Individual Service Plan:

The parties understand and agree that all services provided to eligible recipients under the terms of this contract shall be in accordance with the Individual Services Plan and/or Out of Home Placement Plan developed with, for and on behalf of, the individual client. Performance of the Contractor will be monitored in accordance with client outcomes as specified in the Individual Service Plan goals and objectives. The Agency shall not delegate the Development of the Individual Service Plans (ISP's) and/or the Out of Home Placement Plan (OHPP) to the Contractor.

Purchased Services are to benefit each Eligible Recipient in attaining the goals and objectives specified in the Eligible Recipient's ISP and/or OHPP.

• The Referring County will prepare an ISP and/or OHPP that includes stated short-term objectives having measurable behavioral criteria.

• Upon request, Contractor will assist the Referring County in developing the ISP or OHPP. • Contractor will receive an ISP or OHPP within 30 days after an Eligible Recipient begins

receiving Purchased Services.

5.

Contractor agrees to provide Purchased Services in the type, amount and frequency authorized in writing by the Referring County and in accordance with an Eligible Recipient's ISP or OHPP.

Contractor agrees to submit progress reports on each Eligible Recipient to the Referring County and the Eligible Recipient or legal representative at least quarterly. • Contractor will develop reports with enough specificity to enable the Referring County to

determine progress made in relation to the Eligible Recipient's ISP or OHPP objectives.

Payment for Purchased Services:

a. Certification of expenditures: The Contractor shall, within 90 days following the last day of each calendar month, submit a standard invoice for social services purchased, to the County Social Service Agency. Bills that do not meet internal county deadlines will be paid later. The Invoice shall show: (1) total program and administrative and administrative expenditures for the month, and (2) an itemized account of each social services eligible individual, identifying services to be provided, number of units and cost per unit, including administrative costs

allocated to the provision of purchased services to reimbursement eligible clients.

b. Payment: The Agency shall, within thirty (30) days of the date ofreceipt of the Invoice, make payment to the Contractor for all reimbursement-eligible clients identified on the invoice.

6. Audit and Record Disclosure:

The Contractor shall:

a. Maintain records, using generally accepted accounting principles that reflect all revenue received and all direct and indirect costs incurred in performing this Contract. Maintain records about Purchased Services provided. These records must include the name of the Eligible Recipient served, service type (by Brass Codes), service dates, and other information on an Eligible Recipient that is required by the Agency. Maintain any other records requested by the Agency or a Referring County. Participate in the Minnesota Community Mental Health Reporting System

b. Upon request, Contractor agrees to give the Agency a report containing the following information: 1. All revenue received. 2. All direct and indirect costs incurred in performing Purchased Services. 3. Purchased Services provided, including but not limited to:

a. Number of Eligible Recipients, age, race, sex, and target population served, b. Type of service, and c. Days of service.

c. Upon request, the Contractor agrees to furnish the Agency quarterly reports for financial evaluation, reimbursement, and program management and evaluation purposes.

1. Upon request, Contractor will assist the Agency ( or a Referring County) with documentation needed to complete any form or report for a federal, state, or private agency. 2. Upon request, Contractor will give the Agency ( or a Referring County) information on Eligible Recipient(s) that is needed for effective evaluation purposes, in a format approved by the Agency ( or Referring County).

a. Information will include any reporting requirements included in the Eligible Recipients ISP or ITP, if applicable.

3. Upon request, Contractor will give the Agency a list of all Eligible Recipients and their Referring Counties. 4. The Agency (or Referring County) must receive information within 30 days following request.

d. Allow personnel of the Agency, the Minnesota Department of Human Services, and the Department of Health and Human Services, access to the Contractor's facility and records at

reasonable hours to exercise their responsibility to monitor purchased services and copy such materials as necessary.

e. If the collection of social services fees is delegated to the Contractor, the Contractor shall provide the Agency with information about fees collected and the fee source.

f. Maintain all records pertaining to the contract at 220 Railroad Street SE, Pine City, Minnesota, 55063 or other designated TSA business site intended for file maintenance and storage for three (3) years for audit purposes.

g. Comply with policies of the Minnesota Department of Human Services regarding social services recording and monitoring procedures, as defined in the Department of Human Services Social Services Manual, and the administrative rules of the State Agency.

7. Safeguard of Client Information:

The use of disclosure by any party of information regarding an eligible client in violation of any rule of confidentiality provided for in Laws of Minnesota, Chapter 13, or for any purpose not directly connected with the Agency's or Contractor's responsibility with respect to the Purchased Services hereunder is prohibited except on written consent of such eligible client, the client's attorney or the client's responsible parent or guardian. The program director of the contracting agency is the designated person responsible to ensure that the provider is in

compliance with the Data Practices Act, Minnesota Statutes, Section 13.46, Subd. 10, (a) (4).

All data collected, created, received, maintained, or disseminated for any purposes during the Contractor's performance of this Agreement is governed by the MN Government Data Practices Act, Minnesota Statutes Section 13.01 et. seq., or any other applicable State statutes, any State rules adopted to implement the Act, as well as Federal regulations on Data Privacy, including the Health Insurance Portability and Accountability Act (HIPAA). The Contractor agrees to abide strictly by these statutes, rules, and regulations.

8. Compliance with Other Regulations:

The Contractor further agrees to comply with the following:

a. Section 4, Subdivisions 1, 3 and 6 of the Human Services Licensing Act (Minnesota Statutes 1987, Chapter 245A).

b. Section 3 of Minnesota Statute 604.202 (Liability of Employer).

c. (When applicable) the Contractor agrees to comply with the Civil Rights Act of 1964, Title VII (42 USC 2000e); including Executive Order No. 11246, and Title VI (42 USC 2000d); and the Rehabilitation Act of 1973, as amended by Section 504. Title VI of the

Civil Rights Act of 1964 (Title VI) requires service providers who receive federal funds to take reasonable steps to provide meaningful access to services for people with Limited English Proficiency (LEP). Most county and state funded services must meet LEP requirements. The requirements apply to health care and social service agencies, such as physicians, hospitals, nursing homes, home health agencies, managed care organizations, universities, and private non-profit agencies.

d. (When applicable) the Contractor certifies thats/he has received a certificate of compliance from the Commissioner of Human Services pursuant to Minnesota Statutes, Section 363A.36.

Fair Hearing and Grievance Procedures: The Agency agrees to provide for a fair hearing and grievance procedure conformance with Minnesota Statutes, Section 256.045, and in conjunction with the Fair Hearing and Grievance Procedures established by administrative rules of the Department of Human Services.

Bonding, Indemnity, Insurance and Audit Clause:

a. Bonding: The Contractor shall obtain and maintain at all times, during the term of this agreement, a fidelity bond covering the activity of its personnel authorized to receive or distribute monies. Such bond shall be in the amount of $10,000.

b. Indemnity: The Contractor agrees that it will at all times indemnify and hold harmless the Agency from any and all liability, loss, damages, costs or expenses which may be claimed against the Agency or Contractor.

(1) By reason of any service client's suffering personal injury, death or property loss or damages either while participating in or receiving from the Contractor the care and services to be furnished by the Contractor under this agreement, or while on premises owned, leased or operated by the Contractor, or while being transported to or from said premises in any vehicle owned, operated, chartered or otherwise contracted for by the Contractor or his assigns: or (2) By reason of any service client's causing injury to, or damage to, the property of another person during any time when the Contractor or his assigns, or employee thereof has undertaken or is furnishing the care and service called for under this agreement.

c. Insurance: The Contractor shall purchase and maintain such insurance as will protect the Contractor from claims which may arise out of, or result from the Contractor's operations under the Agreement, whether such operations be by the Contractor, or by any subcontractor, or by anyone directly employed by them, or by anyone for whose acts any one of them may be liable.

Contractor shall secure the following coverage and comply with all provisions noted. Certificate of Insurance shall be issued evidencing such coverage to the County.

liability/cross suits clause for the protection of the County.

d. Audit: The Contractor agrees that within 120 days of the termination date of this contract, either a financial review or an audit of said contract will be conducted by a Certified Public Accounting Firm. Copy of such audit along with the Management Letter shall be provided to the Agency when completed. The Contractor agrees to provide the Agency information on the compensation ranges provided for each class of employee.

11. Conditions of the Parties' Obligations:

a. It is understood and agreed that in the event the reimbursement to the Agency from State and Federal sources is not obtained and continued at a level sufficient to allow for the purchase of the indicated quantity of Purchased Services, the obligations of each party hereunder shall thereupon be terminated.

b. This agreement may be canceled by either party at any time, with or without cause, upon thirty (30) days notice, in writing, delivered by mail or in person.

c. Before the termination date specified in Section I of this agreement the Agency may evaluate the performance of the Contractor in regard to the terms of this agreement to determine whether such performance merits renewal of this agreement.

d. Any alterations, variations, modifications, or waivers of provisions of this agreement, shall be valid only when they have been reduced to writing, duly signed, and attached to the original

of this agreement.

e. No claim for services furnished by the Contractor, not specifically provided in the agreement, will be allowed by the Agency, nor shall the Contractor do any work or furnish any material not covered by the agreement, unless this is approved in writing by the Agency. Such approval shall be considered to be a modification of the agreement.

f. In the event that there is a revision of Federal regulations, which might make this agreement ineligible for Federal financial participation, all parties will review the agreement and renegotiate those items necessary to bring the agreement into compliance with the new Federal regulations.

Subcontracting: The Contractor shall not enter into subcontracts for any of the goods and services contemplated under this agreement without written approval of the Agency. All subcontracts shall be subject to the requirements of this contract. The Contractor shall be responsible for the performance of any subcontractor.

STATE OF MINNESOTA GRANT CONTRACT

This grant contract is between the State of Minnesota, acting through its Commissioner of Natural Resources ("STATE") and Pine County Sheriffs Office, 635 Northridge Drive, Pine City, MN 55063 ("GRANTEE").

Recitals Section 1. Under Minn. Stat. 84.026, the State is empowered to enter into this grant. 2. The State, under Laws of Minnesota 2019, First Special Session, Article 1, Section 3, Subdivision 6(d), is

authorized to provide reimbursement grants to counties to cover costs related to labor and equipment in the enforcement of snowmobile enforcement laws, rules and regulations, as well as holding staff training in the same, and providing local youth training classes, in the manner described in the Grantee's Proposed Budget.

3. The Grantee represents that it is duly qualified and agrees to perform all services described in this grant contract to the satisfaction of the State. Pursuant to Minn.Stat.§16B.98, Subd.1, the Grantee agrees to minimize administrative costs as a condition of this grant.

4. This grant agreement is made in accordance with the provisions in Minn. Stat §84.83 Subd. 3 (3) and (4).

Grant Contract

1 Term of Grant Contract 1.1 Effective date:

July 1, 2019. Per Minn.Stat.§16B.98 Subd. 7, no payments will be made to the Grantee until this grant contract is fully executed.

1.2 Expiration date: June 30, 2021 or until all obligations have been satisfactorily fulfilled, whichever occurs first.

1.3 Survival of Terms. The following clauses survive the expiration or cancellation of this grant contract: 8. Liability; 9. State Audits; 10. Government Data Practices and Intellectual Property; 12. Publicity and Endorsement; 13. Governing Law, Jurisdiction, and Venue; and 15 Data Disclosure.

1.4 Notwithstanding Minnesota Statutes, section 16A.41, expenditures made on or after July 1, 2019 are eligible for reimbursement unless otherwise provided.

2 Grantee's Duties The Grantee, who is not a state employee, will: Comply with required grants management policies and procedures set forth through Minn.Stat.§16B.97, Subd. 4 (a) (1). The Grantee will be reimbursed once annually, for only eligible Snowmobile Safety Enforcement (SSE) Safety Grant activities, including one or more of the following:

• Grantee staff time to participate in SSE activities, including attendance at training classes, also holding local safety training education programs for local participants. Training of Grantee staff working to enforce any SSE related law, rule or regulation is MANDATORY.

• Purchase of snowmobiles for use in patrolling; • Snowmobile maintenance, fuel and enforcement related costs; • Trailers, trailer maintenance and repair (not costs related to towing vehicle repair) • Helmets and other related protective gear (no standard uniforms or equipment); • Purchase other equipment dedicated SOLELY to Snowmobile Safety Enforcement work.

• Submit ANNUAL Performance Reports and Reimbursement Requests for each year of participation in this Program. All needed documents to accomplish this are posted on the DNR website. The Grantee will be responsible for the administration, supervision, management, record keeping and program oversight required for the work performed under this grant contract. Further, the Grantee is responsible for maintaining an adequate conflict of interest policy. Throughout the term of this grant contract, the Grantee shall monitor and report any actual, potential or perceived conflicts of interest to the State's Authorized Representative.

• POST on the Grantee's website, a copy of the two-page performance report, in accordance with 2009 Laws of Minnesota, Chapter 37, Article 1, Section 4, Subdivision 1.

3 Time The Grantee must comply with all the time requirements described in this grant contract. In the performance of this grant contract, time is of the essence.

4 Consideration and Payment 4.1 Consideration.

The State will pay for all services performed by the Grantee under this grant contract as follows:

(a) Compensation The Grantee will be reimbursed up to $4,766.00 in state fiscal year 2020, for expenses incurred between the effective date of the grant and June 30, 2020, and $4,766.00 in fiscal year 2021, for expenses incurred between July 1, 2020, and June 30, 2021, as determined by the grant funding formula.

(b) Total Obligation. The total obligation of the State for all compensation and reimbursements to the Grantee under this grant contract will not exceed $9,532.00.

4.2 Payment (a) Invoices

The State will promptly pay the Grantee after the Grantee presents an itemized invoice for the services actually performed and the State's Authorized Representative accepts the invoiced services. Invoices must be submitted timely and according to the following schedule:

Invoices for state fiscal year 2020 must be submitted before June 30, 2021. Invoices for state fiscal year 2021 must be submitted before June 30, 2022. Only submit ONE invoice for the total expenses incurred during each state fiscal year.

5 Conditions of Payment All services provided by the Grantee under this grant contract must be performed to the State's satisfaction, as determined at the sole discretion of the State's Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations. The Grantee will not receive payment for work found by the State to be unsatisfactory or performed in violation of federal, state, or local law.

7 Assignment Amendments, Waiver, and Grant Contract Complete 7.1 Assignment

The Grantee shall neither assign nor transfer any rights or obligations under this grant contract without the prior written consent of the State, approved by the same parties who executed and approved this grant contract, or their successors in office.

7.2 Amendments Any amendments to this grant contract must be in writing and will not be effective until it has been executed and approved by the same parties who executed and approved the original grant contract, or their successors in office.

7.3 Waiver If the State fails to enforce any provision of this grant contract, that failure does not waive the provision or the State's right to enforce it.

7.4 Grant Contract Complete This grant contract contains all negotiations and agreements between the State and the Grantee. No other understanding regarding this grant contract, whether written or oral, may be used to bind either party.

8 Liability The Grantee must indemnify, save, and hold the State, its agents, and employees harmless from any claims or causes of action, including attorney's fees incurred by the State, arising from the performance of this grant contract by the Grantee or the Grantee's agents or employees. This clause will not be construed to bar any legal remedies the Grantee may have for the State's failure to fulfill its obligations under this grant contract.

9 State Audits Under Minn. Stat. § 16B.98, Subd.8, the Grantee's books, records, documents, and accounting procedures and practices of the Grantee or other party relevant to this grant agreement or transaction are subject to examination by the State and/or the State Auditor or Legislative Auditor, as appropriate, for a minimum of six years from the end of this grant agreement, receipt and approval of all final reports, or the required period of time to satisfy all state and program retention requirements, whichever is later.

10 Government Data Practices and Intellectual Property Rights 10.1 Government Data Practices

The Grantee and State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this grant contract, and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the Grantee under this grant contract. The civil remedies of Minn. Stat. §13.08 apply to the release of the data referred to in this clause by either the Grantee or the State. If the Grantee receives a request to release the data referred to

in this Clause, the Grantee must immediately notify the State. The State will give the Grantee instructions concerning the release of the data to the requesting party before the data is released. The Grantee's response to the request shall comply with applicable law.

11 Workers Compensation The Grantee certifies that it is in compliance with Minn. Stat. §176.181, Subd. 2, pertaining to workers' compensation insurance coverage. The Grantee's employees and agents will not be considered State employees. Any claims that may arise under the Minnesota Workers' Compensation Act on behalf of these employees and any claims made by any third party as a consequence of any act or omission on the part of these employees are in no way the State's obligation or responsibility.

12 Publicity and Endorsement 12.1 Publicity Any publicity regarding the subject matter of this grant contract must identify the State as the sponsoring agency and must not be released without prior written approval from the State's Authorized Representative. For purposes of this provision, publicity includes notices, informational pamphlets, press releases, research, reports, signs, and similar public notices prepared by or for the Grantee individually or jointly with others, or any subcontractors, with respect to the program, publications, or services provided resulting from this grant contract. All projects primarily funded by state grant appropriations must publicly credit the State of Minnesota, including on the grantee's website when practicable.

12.2 Endorsement The Grantee must not claim that the State endorses its products or services.

13 Governing Law, Jurisdiction, and Venue Minnesota law, without regard to its choice-of-law provisions, governs this grant contract. Venue for all legal proceedings out of this grant contract, or its breach, must be in the appropriate state or federal court with competent jurisdiction in Ramsey County, Minnesota.

14 Termination 14.1 Termination by the State

The State may immediately terminate this grant contract with or without cause, upon 30 days' written notice to the Grantee. Upon termination, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed.

14.2 Termination for Cause The State may immediately terminate this grant contract if the State finds that there has been a failure to comply with the provisions of this grant contract, that reasonable progress has not been made or that the purposes for which the funds were granted have not been or will not be fulfilled. The State may take action to protect the interests of the State of Minnesota, including the refusal to disburse additional funds and requiring the return of all or part of the funds already disbursed.

14.3 Termination for Insufficient Funding The State may immediately terminate this grant contract if:

(a) It does not obtain funding from the Minnesota Legislature. (b) Or, if funding cannot be continued at a level sufficient to allow for the payment of the services

covered here. Termination must be by written or fax notice to the Grantee. The State is not

obligated to pay for any services that are provided after notice and effective date of termination. However, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed to the extent that funds are available. The State will not be assessed any penalty if the contract is terminated because of the decision of the Minnesota Legislature, or other funding source, not to appropriate funds. The State must provide the Grantee notice of the lack of funding within a reasonable time of the State's receiving that notice.

14.4 Additional alternate termination language may be negotiated on a case by case basis after the state agency has consulted with their legal and finance teams.

15 Data Disclosure Under Minn. Stat. § 270C.65, Subd. 3, and other applicable law, the Grantee consents to disclosure of its social security number, federal employer tax identification number, and/or Minnesota tax identification number, already provided to the State, to federal and state tax agencies and state personnel involved in the payment of state obligations. These identification numbers may be used in the enforcement of federal and state tax laws which could result in action requiring the Grantee to file state tax returns and pay delinquent state tax liabilities, if any.

(I will specifically highlight LYNX, our free, on-line watershed-wide events calendar we launched late this year www.NorthWoodsAndWatersLYNX.org. ) The work we have done has attracted the attention of Representative Ron Kind (D-WI), who is sponsoring a bill that will designate this area as a nation-al heritage area. Representative Kind is seeking bi-partisan support, and we have interest from both parties. The bill is under final draft right now, and our legislators are waiting for the final language of the bill before officially signing. There are now 55 National Heritage areas in the United States, and citizens throughout this region support designation as an appropriate eco-nomic strategy. We are reaching out to the counties within the St. Croix watershed and ask-ing for resolutions of support. These are, of course, non-binding, as any county, municipality, or property owner can choose to participate or not in any heritage area activity. We’re just in the beginning of our presentations. We submitted resolutions of support from counties and municipalities (as well as chambers of commerce and non-profit organizations) during the time of our 2014 feasibility study and we are reaching out for current resolu-tions now, beginning with Pine County. The St. Croix County Economic De-velopment Commission just unanimously passed a resolution, and the reso-lution will go to the St. Croix County Board in January. RESOLUTION BY THE PINE COUNTY BOARD OF COMMISSIONERS SUPPORTING NORTH WOODS AND WATERS OF THE ST. CROIX NATIONAL HERITAGE AREA - DRAFT

WHEREAS, the region defined by the St. Croix River and its tributaries is a nationally distinctive landscape with shared stories and traditions that contribute to our nation's diverse heritage; and

WHERAS, Pine County has abundant natural, cultural and historic resources that contribute significantly to the national significance of this region,

WHEREAS, a North Woods and Waters of the St. Croix National Heritage Area (NHA) will create opportunities for communities and residents to work together across traditional boundaries for mutual economic and social benefit; and

WHEREAS, an NHA will help residents and visitors better understand, appreciate and experience the region's special stories and places; and

WHEREAS, an NHA will help build a regional economy using our cultural and natural heritage as a foundation; and

WHEREAS, an NHA would foster a sense of regional identity, brand the region for international tourism, and increase our region's competitiveness in seeking grants and attracting private investment; and

WHEREAS, NHAs are community-based efforts that are managed by the local leaders and residents that live in them; and

WHEREAS, NHAs do not acquire regulatory authority over zoning or land use, and do not infringe upon private property rights;

NOW THEREFORE BE IT RESOLVED that the Pine County Commissioners support Congressional designation of the North Woods and Waters of the St. Croix National Heritage Area.

Dear Mr Minke,

Pursuant to the 1936 Supreme Court ruling involving the Brainerd Daily Dispatch, and based on an arrangement of all the newspapers of Pine County to provide an efficient, low-cost way to provide countywide circulation of County Board proceedings, the Pine County Courier submits the following bid for 2020:

To publish the proceedings of the County Board, the delinquent tax listings, the first publication of the financial statement, and such notices as are required by law, the rate will be $8.75 an inch with a 7 point type and 9 lines per inch. The second publication of the financial statement will be in the Hinckley News. As in past years, all notices will go in all four Pine County newspapers. The first run of delinquent taxes will go in the Pine County Courier but the second run goes in all papers. The financial statements will run in the above stated papers only.

We would prefer legal notices emailed to [email protected]. Our deadline is 3 p.m. on Mondays for Thursday publication.
