Re: Application of Charter Section A8.526-3(d) to Pre-November 6, 1996 Retirees

Dear Mr. Huish:

As the City Attorney informed the Members of the Retirement Board and other City officials in a memorandum dated July 15, 2016, the City Attorney's Office retained outside counsel to provide legal advice on Proposition C, enacted by the voters in November 2011. Outside counsel is preparing a legal memorandum on the applicability of the "full funding" requirement in Charter Section A8.526-3(d) to system members who retired prior to November 6, 1996. I expect to receive that memorandum in a few weeks. When available, I will share the memorandum with the Retirement Board and other City officials. in the meantime, please keep me informed on the schedule for implementation of the Board Resolution to exempt the pre-November 6, 1996 retirees from Section A8.526-3(d). I understand that no payments to retirees based on the Resolution are imminent. However, I would like to be sure that we have an opportunity to share the legal memorandum with the Board before any further action is taken.
