Purpose of Presentation To make a Board of Health endorsed recommendation to City of Windsor Council on Smoke Free Outdoor Space Policy Adoption. Reference: Council Report (C 54-2016)

Recommendation – Option 2WECHU is strongly recommending that council support Option 2:• Prohibit smoking in the following additional locations: all areas

prohibited under O. Reg. 48/06 of the SFOA, as well as City parks, beaches, trails, bus shelters, boat ramps/marinas, recreation centers, conservation areas, and community gardens.

• Expand the definition of “smoking” to include e-cigarettes, water pipes, and any other lighted or heated equipment used to smoke or vaporize any tobacco or non-tobacco product.

• Expand the responsibility for the enforcement of the by-law to include the Windsor Essex County Health Unit (WECHU) through its Tobacco Enforcement Officers (TEOs).

Overview of Current LegislationSmoke Free Ontario Act (SFOA) & AmendmentsO. Reg. 48/06 enacted on May 31, 2006:• Prohibited smoking in enclosed workplaces and public spaces.

O. Reg 206/14 effective Jan 1, 2015:• Prohibits smoking on all bar and restaurant patios• Prohibits smoking on playgrounds, and within 20 metres• Prohibits smoking on sporting areas and spectator areas, and within

20 metres (includes municipally or provincially owned sports fields and post secondary education campuses)

• The sale of tobacco on post-secondary education campuses.• The SFOA is enforced by WECHU’s Tobacco Enforcement Officers

Overview of Current LegislationElectronic Cigarettes Act, 2015 • Defines e-cigarettes as those with or without nicotine;Prohibits:• The sale and supply of e-cigarettes to persons who are less than 19

years old;Requires:• All persons selling e-cigarettes to post signs regarding age-based

sales restrictions;• Tobacco Enforcement Officers enforce this legislation.

City of Windsor Bylaw (#113-2006) Prohibits smoking in indoor spaces similar to the SFOA with the addition of a prohibition of smoking within 9 metres of municipal buildings entrances and exits.

Impact of Policy (Option 2)ECONOMIC HEALTH COMMUNITY

Ontario Tobacco Research Unit Study (2015) at local fairs & festivals determined:• Patrons were 2 X more

likely to attend than not attend as a result of SF policy

• Over 3/4 (76.4%) indicated that it did not affect their decision to attend the event at all

• 35% of respondents who smoked indicated that the regulations made them more likely to quit smoking or reduce the number of cigarettes they smoke

• Further reduction in second hand smoke exposure

• Denormalization of tobacco use

• Supportive environments to promote quit attempts and support those who have successfully quit (avoid relapse)

• Reduced litter• Supports other healthy

community initiatives like Healthy Kids Community Challenge, community gardens

• Provides healthy environment for fitness oriented activities like FINA, Children’s Games

• Positive influence that supports changing social norms around smoking behaviors –smoke free generation
