Once again this year we are asking permission from the Town of Wytheville to hold a 5K on December 2, 2017. This is for the Department of Social Services to raise money for Santa Shop. We have approval from Wytheville Community College lU ��.e their SK route however, this does go out into the Town limits.

We have scheduled the 5K for December 2, 2017, at 10:00 am and it should be completed no later than

12:00 pm. So we would need some Town Police support during this time.

BUDGET AND FINANCE COMMITTEE REPORT

NOVEMBER 13,2017

1. As we have discussed on several occasions, we have been in the process of

developing regulations that will set standards for picketing and other types of

demonstrations that go on within the corporate limits. In general, these

requirements state that any groups of ten or more people who are planning an

event must go through a registration process with the Town. Thereafter, the

Town is in a position to prepare for activities that may be associated with the

demonstration or picketing activity. Communities throughout Virginia have

recently been adopting such regulations in response to the events that have

occurred in Charlottesville, Virginia, earlier this fall. Later in the meeting, the

Council will consider this ordinance on first reading, and it would be the

recommendation of the Budget and Finance Committee that it be adopted on first

reading.

2. The Wythe County Historical Society has contributed $ 12,000 per year to help

cover the salary and benefits for a museum employee. The funds received by the

Historical Society cover the expenses associated with the employee for two days

per week, and the Town is covering the expenses of the employee for the other

three days. Ms. Frances Emerson, the Director of the Museums, has requested

that the Council adjust her budget to reflect the $ 12,000 donation by the Wythe

County Historical Society. It would be the recommendation of the Budget and

Finance Committee that we authorize Town Treasurer Michael Stephens to

amend the appropriate line item in the budget to reflect the receipt of the

PUBLIC WORKS COMMITTEE REPORT

NOVEMBER 13, 2017

1. Currently, the Town's Brush Collection Guidelines provide that the brush disposal

site be open on the first and third Saturday of each month from 8:00 a.m. to 1 :00

p.m. for residents to deposit a pickup load of brush debris. The current regulations

also provide for a $ 3.00 per cubic yard fee on any brush deposited on those dates.

We believe that it would be beneficial to the Town's citizens to provide this service

on the first and third Saturday of each month without imposing any fee and with no

restrictions on the number of loads that can be brought between the hours of 8:00

a.m. and 1 :00 p.m. It would be the recommendation of the Public Works Committee

that we amend the regulations to eliminate the fee and to not impose any

restrictions on the volumes of debris delivered on these dates.

2. A committee composed of representatives of Downtown Wytheville, Incorporated

and Town staff has been developing a program for December, which will kickoff the

Christmas season, as well as celebrate the completion of the construction in the

downtown area. As everyone can see, the construction in the downtown area and

all of the improvements are rapidly nearing completion. We anticipate that by early

December, the work will be essentially complete. The committee has developed

plans that would include festivities on Friday evening, December 1, 2017, followed

by festivities held on Saturday, December 2, 2017. On Friday evening, the activities

are planned to be held in Withers Park, and there will be a variety of events that will

include carriage rides, music and a tree lighting ceremony. This will also coincide

with the annual festival of trees grand opening that the Wythe Arts Council sponsors

each year. On Saturday, between 10:00 a.m. and 5:00 p.m., there will be a variety

of activities going on in the downtown area such as music, carriage rides, visits by

Mr. and Mrs. Claus and other seasonal activities. At approximately 5:30 p.m., there

will be a ribbon cutting ceremony at the intersection of Main Street and Heritage

Walk to celebrate the completion of the work in the downtown area. Immediately

following the ribbon cutting ceremony, the annual Christmas Parade will commence.

The committee is still formulating all of the details associated with the events

planned for these two days, but it appears that it will be a very fun filled two days

and something that everyone will enjoy attending. We will report additional

information on the events in the near future.

(b} Except as provided in this section 13-27(b ), no person shall place for sale on any street or alley within the town any goods, wares or merchandise, or place any obstruction on a sidewalk, in a street or alley, except such as occurs in loading and unloading goods, wares and merchandise to and from his place of business. A person shall be allowed to place for sale, on the sidewalk in front of his business during business hours, any goods, wares or merchandise, and at such time, the goods,

the Council is aware, this ordinance sets forth the regulations for groups who want to

picket in the Town. There are various regulations in the ordinance, and, among them, it

before picketing; the group must inform the Town if there is any person below the age of

18 expected to participate; and, the picketers must conform to the list of conduct

ARTICLE I. IN GENERAL

DIVISION 3. PICKETING AND DEMONSTRATIONS

Sec. 9-42. Definitions.

(a) The terms picket, pickets and picketing as used herein are deemed to include "demonstrators," persons participating in vigils and any action primarily promoting or objecting to a policy upon those portions of the public rights of way not used primarily for vehicular parking and moving traffic and not constituting a parade.

(b) "Spontaneous event" shall mean an unplanned or unannounced coming together of people, animals or vehicles in a parade or public assembly which was not contemplated beforehand by any participant therein and which is caused by or in response to unforeseen circumstances or events occasioned by news or affairs first coming into public kno�ledge within five days of such parade or public assemply.

Sec. 9·43. Picketing permitted; notice of intent and receipt required.

Peaceful picketing shall be permitted in the town provided the same is done under the following conditions:

(a) No picketing shall be conducted on the public rights of way of the town and no person shall participate in the same unless notice of intent to picket has been given to the Town Manager or his designee, and unless a receipt of such notice has been issued.

(b) A group of fewer than ten (10) persons may give written notice of intent to picket but is not required to do so. A group of ten (10) or more persons shall give no less than forty-eight (48) hours' prior written notice of intent to picket in writing and the notice given shall contain the following information:

(1) The name, if any, of the organization or group sponsoring or proposing to picket unless the group indicates that it intends to picket anonymously, in which case no name is required;

(2) The location or locations in the town where the pickets propose to assemble and demonstrate;

(3) The time of day and the date or dates on which the picketing is to occur;

(4) The name, address, and telephone number of the person and organization giving notice of intent to picket unless the person or organization indicates that it intends to picket anonymously, in which case no name is required;

(5) Whether or not persons below the age of eighteen (18) years are expected to participate; and,

(6) The person or persons to be in charge of the activity and who will accompany it and carry any receipt of notice at all times.

(c) Upon the giving of notice of intent to picket, properly completed as hereinabove set out, the Town Manager or his designee shall immediately issue a receipt of notice. The receipt shall contain all information stated in the notice. If picketing ceases for a period of twenty-four (24) hours or more, then the pickets must provide a new notice and the Town Manager, or his designee, shall issue a new receipt of notice before picketing may resume.

(d) The Town Manager, or his designee, shall be empowered to authorize the conduct of the assembly on a date, at a time, at a place, or over a route different from that proposed by the applicant. An applicant desiring to accept an alternate plan shall file a written notice of acceptance with the Town Manager, or his designee. An alternate notice shalt conform to the requirements of this Division 3 Picketing and Demonstrations.

Sec. 9-44. Standards of conduct.

(a) Picketing shall be conducted only on portions of the public rights of way not used primarily for vehicular parking or moving traffic.

(b) Pickets may carry written or printed placards or signs; however, such written or printed placards or signs shall not at any time nor in any way obstruct, interfere with or block the sidewalk or public right of way.

(c) If pickets promoting different objectives, causes, actions or policies desire to use a sidewalk that is already used for picketing, the Town Manager or his designee shall allot a number of pickets promoting each objective to use such sidewalk on an equitable basis, proportionate to the number of objectives being promoted.

(d) Pickets shall be restricted to the use of the outermost half of the sidewalk or other public rights of way nearest the street and shall not at any time nor in any way obstruct, interfere with or block: persons entering or exiting from vehicles; persons crossing streets or otherwise using the public rights of way; the entrance or exit to any building or access to property abutting the street or sidewalk; or, pedestrian or vehicular traffic.

(e) No person observing, engaging in, or assisting in picketing shall bring to, or allow to remain in, the immediate picketing area any vicious animal.

(f) It shall be unlawful for a group of ten (10) or more persons to picket without filing a notice as required herein.

(g} Pickets shall not use any amplification or loudspeakers.

Sec. 9-45. Interference with picket prohibited; police authority to disperse crowds.

(a) It shall be unlawful for any person to physically interfere with pickets in the use of the sidewalk or to address profane, indecent, abusive or threatening language to or at those pickets which would tend to provoke the pickets or others to a breach of the peace.

(b) Town police officers may, in the event of the assemblage of persons in such numbers as to tend to intimidate pickets pursuing their lawful objective through numbers alone or through use of inflammatory words, direct the dispersal of persons so assembled and may arrest any person who fails to absent himself or herself from the place of such assemblage when so directed by the police.

(c) Whenever the free passage of any street or sidewalk shall be obstructed by a crowd, whether or not the crowd assembles as a result of or in connection with picketing, the persons composing such crowd shall disperse or move on when directed to do so by a police officer. It shall be unlawful for any person to refuse to so disperse or move on when so directed by a police officer as herein provided.

Sec. 9-46. Penalty for violation.

The provisions of this article are mandatory, and not merely directory, and failure to comply with its provisions is hereby declared to be unlawful and punishable as a Class 3 misdemeanor.

Sec. 9-47. Exceptions.

The provisions of this article shall not apply to:

( 1 ) Spontaneous events;

(2) Recreational activities, including jogging or walking, that do not require closing public streets or other public streets or other public rights-of-way and that do not interfere with or have a tendency to interfere with the normal use of any public property in a place open to the general public;

(3) Door-to-door advocacy, including canvassing, pamphleteering, religious or political proselytizing and the distribution of written materials, and similar activities that do not interfere with or have a tendency to interfere with the free passage of pedestrians and vehicles on the public rights-of-way or the normal use of any public property in a place open to the general public;

(4) Door-to-door sales of goods or services, and similar activities that do not interfere with or have a tendency to interfere with the free passage of pedestrians and vehicles on the public rights-of-way or the normal use of any public property in a place open to the general public; provided, however, that any persons or organizations engaging in such activities shall comply with any other applicable requirements of the Town Code;

(5) Funeral processions;

(6) Students going to and from school classes or participating in educational activities, provided that such conduct is under the immediate direction and supervision of the proper school authorities;

(7) The United States army, navy, air force and coast guard, the military forces of the state and the police and fire divisions of the town; or

(8) A governmental agency/agencies acting within the scope of its functions.

(9) Park and recreation areas that are regulated by the town's division of parks andb recreation; or

SUMMARY:

Section 7-113 of the Code of the Town requires that the Council conduct an annual

hearing for the purpose of detennining the number of taxicab vehicles for which

Certificates of Public Convenience and Necessity shall be issued during the next

calendar year. There are several matters that are reviewed by the Council in the course

of renewing a certificate and those include condition of the vehicle(s), appropriate

liability insurance and other general requirements. Guardian Emergency Medical

Services, Incorporated; Richardson Ambulance Service, LLC; 276 Express, LLC; and,

019 Transportation Service, Inc. have been notified by mail as prescribed in the Town

Code. Guardian Emergency Medical Services, Incorporated; Richardson Ambulance

Service, LLC; 276 Express, LLC; and, D19 Transportation Service, Inc. have submitted

the necessary paperwork. To meet the publication requirements for the public hearing,

the earliest the public hearing could be conducted would be December 11, 2017. During

the public hearing, we will present the inspection reports by the Police Department.

MINUTES OF THE REGULAR MEETING OF THE WYTHEVILLE TOWN COUNCIL HELD IN THE COUNCIL CHAMBERS ON MONDAY, OCTOBER 23, 2017, AT 7:00 P.M.

RE: CALL TO ORDER, QUORUM, PLEDGE Mayor Crewe called the meeting to order and established that a quorum of Council members was present. The Pledge of Allegiance was led by Vice-Mayor King. RE: CONSENT AGENDA Mayor Crewe presented the consent agenda consisting of the minutes of the regular meeting of October 9, 2017; the request of Downtown Wytheville, Incorporated to conduct the Downtown Wytheville Christmas Parade on Saturday, December 2, 2017, at 6:00 p.m.; and, the request of the Wythe County Public Schools Foundation for Excellence to conduct a Sandman Extreme Run on Saturday, January 13, 2018, at 9:00 a.m. He inquired of the Council if there was a motion to approve the consent agenda as presented or to somehow be amended. A motion was made by Councilman Hundley and seconded by Councilwoman Taylor to approve the consent agenda consisting of the minutes of the regular meeting of October 9, 2017; the request of Downtown Wytheville, Incorporated to conduct the Downtown Wytheville Christmas Parade on Saturday, December 2, 2017, at 6:00 p.m.; and, the request of the Wythe County Public Schools Foundation for Excellence to conduct a Sandman Extreme Run on Saturday, January 13, 2018, at 9:00 a.m., as presented. Mayor Crewe inquired if there was any discussion on the motion to approve the consent agenda. There being none, the motion was approved with the following voting in favor and there being no opposition: For: Trenton G. Crewe, Jr., Jacqueline K. King, Thomas F. Hundley, Joseph E. Hand, Jr., Beth A. Taylor. Against: None. RE: CITIZENS’ PERIOD – SMITHSONIAN YOUTH ENGAGEMENT AND SKILL-BUILDING GRANT PROJECT TEAM PRESENTATION Mayor Crewe advised that the next agenda item is Citizens’ Period. He noted that this is the reason for most of the citizens attending the meeting. Mayor Crewe remarked that, obviously, the Council thinks that the students attending the meeting have done something special, and he would ask that Ms. Frances Emerson, Director of Museums, come forward and explain to the Council the Smithsonian Youth Engagement and Skill-Building Grant Project. Director of Museums Frances Emerson presented the Council with the video the project team produced named “How Mining and Railroads Shaped the Communities in Wythe County, Virginia.” Director Emerson continued to explain the project to the Council. Vice-Mayor King thanked the project team for attending the Council meeting. Mayor Crewe presented a resolution which read as follows:

RESOLUTION

WHEREAS, the Town of Wytheville Department of Museums applied for a $5,000 grant from the Smithsonian Institution Museum on Main Street Program and received the funding; and,

WHEREAS, the mission of the Museum on Main Street Program is to provide access to

small towns to the Smithsonian Institution to help them provide the youth with educational opportunities, such as research activities for storytelling about their community, and this helps to instill a sense of accomplishment and local pride; and,

WHEREAS, the Department of Museums chose the 4-H Edge Club to participate in this

project and formed the Smithsonian Youth Engagement and Skill-Building Grant Project Team; and,

WHEREAS, the Project Team produced a video named “How Mining and Railroads Shaped The Communities of Wythe County, Virginia”; and,

WHEREAS, this team worked tirelessly to produce this video, which included

researching history, conducting and filming interviews, writing scripts, performing video narrations, selecting the video music and editing the video; and,

WHEREAS, the Project Team is comprised of homeschooled students including

Chase Arnold, Chloe Arnold, Nathanael Beaver, Lucas Corvin, Jackson Denti, Mitchell Denti, Joseph Dye, Joshua Dye, Madison Dye, Matthew Dye, Coyote Edwards, Elizabeth Gravely, Madison Phillips, Aaliyah Reynolds and Kylei Smith; and,

WHEREAS, Ms. Kelsey Grimes, Extension Agent, 4-H Youth Development, worked

closely with the Project Team members and provided great support and encouragement to ensure that they finished this educational and informative video that tells of our community’s history; and,

WHEREAS, the Smithsonian Youth Engagement and Skill-Building Grant Project Team

members, through their display of great academic ability and team efforts, have reflected great credit upon their team, the Department of Museums and the Town of Wytheville.

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Wytheville, Virginia, officially commends the Smithsonian Youth Engagement and Skill-Building Grant Project Team for this outstanding accomplishment.

BE IT FURTHER RESOLVED that copies of this resolution be presented to Ms. Kelsey Grimes, members of the Smithsonian Youth Engagement and Skill-Building Grant Project Team and the news media. In Witness Whereof, I have hereunto set my hand and caused the seal of the Town of Wytheville, Virginia, to be affixed this 23rd day of October in the year of our Lord two thousand seventeen. Mayor Crewe inquired if there is a motion to adopt the resolution recognizing the project team. A motion was made by Vice-Mayor King and seconded by Councilwoman Taylor to adopt a resolution recognizing the efforts of the Smithsonian Youth Engagement and Skill-Building Grant Project Team. He inquired if there is any discussion on the motion to adopt the resolution. There being none, the motion was approved with the following voting in favor and there being no opposition: For: Trenton G. Crewe, Jr., Jacqueline K. King, Thomas F. Hundley, Joseph E. Hand, Jr., Beth A. Taylor. Against: None. Mayor Crewe thanked the project members for attending the meeting. He inquired if any of the project members would like to address the Council at this time. There being none, Mayor Crewe requested the members of the project team to come forward for the presentation of the resolution and to have a photo taken. RE: CITIZENS’ PERIOD Mayor Crewe advised that no one attending the meeting had signed up to speak during Citizens’ Period, therefore, he would proceed with the agenda. RE: OLD BUSINESS Under Old Business, Assistant Town Manager Moore reported the following: 1. There will be no Council Work Session held on Tuesday, October 24, 2017. He noted that the next scheduled Council Work Session will be held on Tuesday, October 31, 2017, at 7:00 a.m., in the Council Conference Room.

2. The Homestead Advisory Board will meet on Thursday, October 26, 2017, at 10:00 a.m.,

in Conference Room A.

3. The Joint Governing Bodies meeting scheduled for Monday, October 30, 2017, has been canceled. He noted that the next meeting will be held on Monday, January 29, 2018.

4. W&L Construction is scheduled to begin paving tomorrow evening, October 25, 2017, at approximately 5:00 p.m., weather permitting.

5. Halloween is Tuesday, October 31, 2017, and children 12 and under are permitted to trick-or-treat. He noted that the curfew begins at 9:00 p.m. on this evening.

6. Mayor Crewe stated that several months ago, Mr. A. J. McCoy inquired of the Town Council if he could perform an Eagle Scout Project to build a shelter over an existing concrete slab which is located on Town property. He noted that this would be installed at no expense to the Town. Mayor Crewe explained that the Council has never granted Mr. McCoy permission to perform the project. Mayor Crewe inquired if there is a motion to approve Mr. McCoy’s request to perform his project. A motion was made by Vice-Mayor King and seconded by Councilman Hand to approve Mr. A. J. McCoy performing an Eagle Scout Project to build a shelter over an existing concrete slab on Town owned property located between the Wytheville Presbyterian Church and the Wythe County Rescue Squad building. Mayor Crewe inquired if there is any discussion on the motion to approve Mr. McCoy’s request. There being none, the motion was approved with the following voting in favor and there being no opposition: For: Trenton G. Crewe, Jr., Jacqueline K. King, Thomas F. Hundley, Joseph E. Hand, Jr., Beth A. Taylor. Against: None.

RE: BUDGET AND FINANCE COMMITTEE REPORT

Vice-Mayor King, reporting for the Budget and Finance Committee, stated that Town Treasurer Mike Stephens advises that he now has all of the information from the Commissioner of the Revenue on personal property taxes, i.e. vehicles. She noted that as the Council knows, several years ago, the State changed the law with regard to procedures where car taxes were eliminated, and then the State reimburses communities a certain percent. Vice-Mayor King explained that when the budget was adopted this past year, the reimbursement that was established in the budget document was 55.70 percent, and, as the Council knew at that time, it was an estimate until the Commissioner actually provided the Town with all of the data for the year. She commented that it has now been determined that the reimbursement percentage from the State will need to be established at 61.30 percent. Vice-Mayor King advised that Town Treasurer Stephens would request, and the Budget and Finance Committee would recommend, that the Council take an action to establish the reimbursement percentage at the above described amount. A motion was made by Vice-Mayor King and seconded by Councilwoman Taylor to establish the Personal Property Tax Relief Act percentage rate at 61.30 percent. Mayor Crewe inquired if there was any discussion on the motion to establish the rate at 61.30 percent. There being none, the motion was approved with the following voting in favor and there being no opposition: For: Trenton G. Crewe, Jr., Jacqueline K. King, Thomas F. Hundley, Joseph E. Hand, Jr., Beth A. Taylor. Against: None. Vice-Mayor King, also, reported that October is Fire Prevention Month, and the Council has asked the Town’s Fire Department to implement programs that will institute a new opportunity to provide free smoke alarms for citizens who cannot afford them. She noted that according to the National Fire Protection Association, three out of five home fires happen from fires in homes with no smoke alarms or no working smoke alarms. Vice-Mayor King stated that smoke alarms save lives, and, if properly installed and maintained, this equipment plays a vital role in reducing fire deaths and injuries. She explained that the Town of Wytheville Department of Public Safety wants to help prevent these situations by assisting citizens who may not have the financial ability to purchase a smoke alarm or obtain this piece of equipment for their homes. Vice-Mayor King remarked that, additionally, the Council has asked the Fire Department to have available literature and other planning tools that can be used by families to create an awareness of fire safety. She stated that if someone is a Town of Wytheville citizen who needs such assistance, please contact the Department of Public Safety at (276) 223-3300 for more information about this free program. A copy of the Budget and Finance Committee report is attached and made part of these minutes. RE: PUBLIC WORKS COMMITTEE REPORT Councilman Hundley, reporting for the Public Works Committee, stated that, given the circumstances that are occurring around the country, many communities, including the Town of Wytheville, are drafting and implementing policies to deal with picketing and demonstrations. He explained that this is a topic that the Council discussed in September, and, since that time, the Council has drafted language that would be included in the Town Code. Councilman Hundley stated that as the Council explained before, it is important to know that the Town in no way wants to develop regulations that infringe on anyone’s rights or their freedom of speech, but the Council also realizes that these activities must be held in an orderly fashion and in a manner that does not endanger the demonstrators or the citizenry in general. He noted that the Council has asked Town Attorney Christopher Menerick to continue to review the draft of the ordinance and to identify standards that are being imposed in other Virginia communities. He advised that the Council anticipates that an ordinance regulating picketing and demonstrations will be on the November 13, 2017, agenda.

Councilman Hundley, also, reported that earlier in the meeting, the Council approved a request of Downtown Wytheville, Incorporated to conduct the annual Christmas Parade on Saturday, December 2, 2017, at 6:00 p.m. He stated that given that the construction activities in the downtown area are nearing completion, it seems that this may be a good opportunity to celebrate the completion of the construction to showcase the downtown area prior to the annual Christmas Parade. Councilman Hundley explained that Downtown Wytheville, Incorporated and Town staff are looking at programs that might occur on an annual basis, such as the lighting of the Christmas tree in Withers Park. He remarked that there are a number of activities being considered that will provide a fun filled evening, which will include the Christmas Parade. Councilman Hundley noted that the Public Works Committee will have more information about this program as it moves forward. He advised that there is no action required by the Council at this time, but the Council would like to invite everyone to participate in these downtown programs. A copy of the Public Works Committee report is attached and made part of these minutes. Mayor Crewe stated that on behalf of the Town Council, he would like to congratulate Downtown Wytheville, Incorporated on their successful 2017 Zombie Run event and the Zombie Bash. RE: ORDINANCE NO. 1329 Mayor Crewe presented Ordinance No. 1329, an ordinance amending and reenacting Chapter 13, Streets, Sidewalks and Improvements, Article II. Signs, Awnings, Etc., Over Sidewalks, Etc., Section 13-27. Signs, Awnings, Etc., Having Supports Implanted in Streets, Etc., of the Code of the Town of Wytheville, Virginia, on second reading. A motion was made by Councilman Hundley and seconded by Councilman Hand to approve Ordinance No. 1329, an ordinance amending and reenacting Chapter 13, Streets, Sidewalks and Improvements, Article II. BUDGET AND FINANCE COMMITTEE REPORT

OCTOBER 23, 2017

As the Council knows, several years ago, the State changed the law with regard

to procedures where car taxes were eliminated, and then the State reimburses

communities a certain percent. When the budget was adopted this past year, the

reimbursement that was established in the budget document was 55.70 percent,

and, as the Council knew at that time, it was an estimate until the Commissioner

actually provided the Town with all of the data for the year. It has now been

determined that the reimbursement percentage from the State will need to be

established at 61.30 percent. Town Treasurer Stephens would request, and we

recommend, that the Council take an action to establish the reimbursement

percentage at the above described amount.

2. October is Fire Prevention Month, and we have asked the Town’s Fire

Department to implement programs that will institute a new opportunity to provide

free smoke alarms for citizens who cannot afford them. According to the National

Fire Protection Association, three out of five home fires happen from fires in

homes with no smoke alarms or no working smoke alarms. Smoke alarms save

lives, and, if properly installed and maintained, this equipment plays a vital role in

reducing fire deaths and injuries. The Town of Wytheville Department of Public

Safety wants to help prevent these situations by assisting citizens who may not

Council also realizes that these activities must be held in an orderly fashion and in a

manner that does not endanger the demonstrators or the citizenry in general. We
