Why are we reviewing our Official Plan?

• Orangeville has had an Official Plan in effect since 1985. It has been reviewed and updated periodically since (typically every 5 years)

• Planning Act requires municipal OP’s to be reviewed every 5 years (every 10 years for new OP’s)

• Last OP review was completed in 2010. • Current review started in 2015 but was suspended due to major changes to

provincial policy and legislation• Key provincial changes that have recently occurred:

Purpose of a Public Meeting

In accordance with the Planning Act, a Public Meeting is held for applicants to present their applications to the public and Council, to receive comments, and answer questions that the public and members of Council may have.

Staff and Council will not make a recommendation, decision or take a position on the applications at a Public Meeting. Upon receipt of any comments following the statutory public meeting and the response by the applicant to these comments, a future staff report with additional detail and analysis will be brought forward to Council for consideration.

Existing Site Context The lands subject to these applications are located on the south side of Fifth Avenue, between Second Street and Third Street. The subject lands are municipally known as 71 Fifth Avenue and have a lot area of approximately 0.1 hectares (0.25 acres), with approximately 40 metres (131.2 feet) of frontage along Fifth Avenue. Attachment No. 1 includes a location map of the subject properties. The subject lands are presently developed with a two-storey building previously used as a Masonic Hall. Site photos are included as Attachment No. 2. Existing land uses surrounding the subject lands consist of:

- North: A range of commercial uses including small retail stores, restaurants, service commercial uses, financial institutions and large format retail uses, including a Walmart, Canadian Tire, Leon’s Furniture and Best Buy. The Orangeville Curling Club and various medical clinic uses are also situated on the north side of Fifth Avenue.

- East: A dental office at the southwest corner of Fifth Avenue and Third Street. East of Third Street is the Fairgrounds Shopping Centre which contains retail, restaurants, and entertainment uses, including a Home Depot and Galaxy Cinema.

- South: Low-rise residential uses comprised of single detached, semi-detached and townhouse units.

- West: Low-rise residential uses comprised of single detached and apartment units. Further west are commercial uses, including a medical centre, veterinary clinic and a plaza on the southwest corner of Fifth Avenue and First Street containing retail, service commercial, restaurant and office uses.

Development Proposal

On, April 3, 2020, MHBC Planning Ltd. submitted applications on behalf of LLRT Holdings Corporation to amend the Town’s Official Plan and Zoning By-law to convert the existing building from a hall/private club to an office, including interior renovations and alterations to the façade. No alterations or additions are proposed that would impact the size or location of the building. The surface parking lot is proposed to be expanded to accommodate a total of 19 parking spaces, whereas approximately 12 spaces are currently provided on the site. There is one driveway access to the subject lands from Fifth Avenue.

To permit the proposed development, an Official Plan Amendment application has been submitted to re-designate the lands from “Institutional” to “Neighbourhood Commercial” on Schedule ‘A’ (Land Use Plan) to permit an office use. Consistent with the Official Plan amendment, the Zoning By-law amendment application proposes to rezone the subject lands from “Institutional” (INST Zone) to “Neighbourhood Commercial” (C2 Zone). Additional Applications Required

In addition to the current applications, the following planning approvals would also be required to facilitate the proposed development:

1. Site Plan Approval to consider the exterior elements of the development, including site servicing and construction details, drainage and stormwater management, building materials and landscaping.

Analysis County of Dufferin Official Plan The subject lands are designated ‘Urban Settlement Area’ on Schedule ‘B1’ in the County of Dufferin Official Plan. The County Official Plan identifies urban settlement areas as focal points for growth, which are intended to accommodate a broad range of uses. These areas are comprised of lands that provide full municipal services (i.e. sewage, water and stormwater management) and support a broad range of land uses and densities, including a mix of housing types, affordable housing options and alternative housing forms for special needs groups. Urban settlement areas are to be designed to support walkable communities with opportunities for public transit use. Town of Orangeville Official Plan The subject lands are designated ‘Institutional’ on Schedule ‘A’ (Land Use Plan) in the Town of Orangeville Official Plan (“OP”). Institutional uses are considered to be public and semi-public buildings and establishments, religious institutions, public and private schools, parks, cemeteries, hospitals, medical centers, convalescent homes, and senior citizen homes. The designation of the subject lands as an Institutional use reflects the previous use of the subject lands as a masonic lodge. The existing masonic lodge is a privately-operated club which is not intended to continue its operations.

The OP amendment proposes to re-designate the subject lands as ‘Neighbourhood Commercial’ on Schedule ‘A’ (Land Use Plan). These areas are distributed in various parts of Orangeville, primarily in response to the location of residential uses.

Neighbourhood commercial uses should generally be located on arterial or major collector roads. Permitted uses include a supermarket, drug store, hardware store, service establishments, smaller retail outlets, recreational establishments, a nursery school, business or professional offices and a veterinarian clinic. Residential uses are permitted within upper floors of buildings containing other permitted uses (Section E2.6).

The subject lands are located in an area characterized by a range of general commercial and neighbourhood commercial uses. The subject lands are located on Fifth Avenue which is identified as Minor Collector Road in the OP. Fifth Avenue provides immediate access to First Street, a Major Collector Road, and Highway 10, a Provincial Highway.

Town of Orangeville Zoning By-law No. 22-90

The subject property is zoned Intuitional’ (INST Zone) on Schedule ‘A’ (Map No. B4) to Zoning By-law No. 22-90, as amended. The ‘INST’ Zone permits a range of commercial uses including:

- Assembly hall - Club house - Community centre - Nursing home - Crisis care facility - Day nursery - Government administration

building

- Hospital - Library - Medical centre - Public park - Religious institution or cemetery - Retirement home - School

Consistent with the OP amendment application, the Zoning By-law amendment application proposes to rezone the subject lands to ‘Neighbourhood Commercial’ (C2 Zone) to permit the conversion of the existing institutional building to an office for an insurance brokerage. The ‘C2’ zone permits the following uses:

- Dwelling unit or units on upper floors

- Automobile service station - Business or professional office - Financial establishment - Home occupation - Medical laboratory - Nursery school

- Personal service shop - Recreational establishment - Restaurant - Retail store - Repair, service or rental

establishment - Veterinarian clinic

Site specific provisions are also being requested in recognition of the location of the existing building on the subject lands. The following site specific provisions to the Neighbourhood Commercial (Section 15) standards of the by-law are proposed: Regulation (C2 Zone) Requirement Site Specific Lot Area (min) 800 sq. m. -

In addition, the following site specific provisions to the General Provisions (Section 5.17.7) of the by-law are proposed: Regulation (General Provisions)

Parking Area Location on a Lot

No part of any parking area other than the driveway shall be located within 3 metres of any street line or residential zone, which area shall be landscaped.

North: 0.0 m South: 1.75 m West: 0.0 m

As previously mentioned, a Site Plan application will be required to implement the proposal and allow staff to consider the exterior elements of the development. Comments Received General Public The applications were received on April 2, 2020 and deemed complete by Planning Division staff on April 6, 2020. In accordance with the requirements of the Planning Act, on April 16, 2020, a Notice of Complete Application was:

i. circulated to all property owners within 120 metres of the subject property; ii. advertised in the Orangeville Citizen; iii. published to the Town website; and iv. posted via signage on the subject property.

On June 11, 2020, A Notice of Public Meeting was provided in the same manner as described above. Staff have not received any written submissions from residents with respect to the proposed development. Internal Departments and External Agencies Comments received to-date from the following agencies and Town departments have expressed no concerns with the application:

- Economic Development - Fire Department

Specific comments received to-date from internal departments and external agencies are summarized as follows: - County of Dufferin, Planning Department recommends further consultation occur

among the Town and CVC regarding potential impacts to source water because the subject property is located within the source water protection area.

- Corporate Services, By-law and Property Standards has noted that the Sign By-law requires a permit be obtained for any sign which is erected, altered or repaired.

- Infrastructure Services, Environment Division has requested the inclusion of LID features.

- Infrastructure Services, Building Division has requested additional information regarding spatial distance separation for the proposed new windows on the south wall.

- Infrastructure Services, Transportation and Development noted that a detailed review will be completed at the Site Plan stage.

- Infrastructure Services, Planning Division has requested clarification on floor area details to confirm the parking and loading requirements and provided guidance on additional site specific provisions required.

As of the time of writing this report, there have been no additional comments received from internal departments or external public agencies with respect to this application.
