Ofc Alex McKnight Excellent Police Service Medal Arrest of four individuals on drug charges and recovery of 50 bags of heroin, 19 vials of cocaine, and paraphernalia.
Senior Dispatcher Debra Mahon Meritorious Service Medal Performance during upgrade of Communications hardware, radios, and software related to Dispatch merger between Bernards Township and Long Hill Township PDs.
Ofc Glen Amerman Childbirth Stork Award birth of baby on Coppergate Drive on October 31, 2005.
Dispatcher Mike Mastro (BT) and Dispatcher Mike Smith (Long Hill PD NOT ABLE TO ATTEND) Meritorious Police Service Medal for dispatching and coordinating of resources during busy time period for a baby delivery call.
Ofcs Christopher Hurst and John Neiman Childbirth Stork Award birth of baby on Dyckman Place on December 22, 2005.
Lt Edward Byrnes, Det Jon Burger and Det Sgt Sean Brown (Long Hill PD) Honorable Police Service Medal Performance during the Robbery (Martinsville Road February 2006) investigation, recovery of stolen items, and charging of suspect.
Fatal Condo Fire on Monarch Circle in January 2006:
Sgt Josh Fowler, Ofcs Max Sidoli, Scott Ward, Christopher Hurst, Bill Seiple, and Tracy Alexander (UNABLE TO ATTEND) Unit Citation Efforts to rescue victim and evacuate surrounding units.
Ofc Matt Newschwander (Long Hill PD) Meritorious Police Service Medal Assisting Bernards Township officers in attempting to rescue victim and in evacuating surrounding units. He responded on his own after hearing call on radio.
Chief Marc Friedman and the Liberty Corner Fire Company Unit Citation for their actions in containing fire, attempting rescue of victim, and preserving scene for subsequent police arson investigation.
Office of Emergency Management Operation, performance, and dedication on daily basis as well as during the numerous calls for service. Enthusiastic service by all members.
Lt Dennis Sakos (retired) Coordinator of OEM Chiefs Award for his overall supervision and administration of the unit.
Ofc Michael Shimsky (Deputy Coordinator) and Ofc Christopher Hurst (Assistant Deputy Coordinator) Unit Citation for their tireless assistance to Lt Sakos and dedication to the Department on this additional level.
CPR/Defibrillator Lifesaving Incident at Ridge High School involving a teacher collapsing at their Open House on September 22, 2005. Citizen and police actions to actively revive and save the life of the teacher.
Ofcs Michael Shimsky, Timothy King, and John Neiman Lifesaving Police Service Medal and the American Heart Associations Heartsaver Award Actions as primary responding officers.
Sgt Josh Fowler and Ofcs Eric Geleta and Michael Sweeney Official Letter of Commendation Actions as backup officers.
Citizens: Lou Carlucci, Youngsook Choi-Coburn, Ken Coburn, Marc Roelke, and Pamela Damen-VonBargen (UNABLE TO ATTEND) the American Heart Associations Heartsaver Award actions as the first citizens on scene to render active aid to the victim.

Resolution #060204 - Acceptance of NJDEP Clean Communities Program Entitlement, and Insertion of Revenue Item into the 2006 Budget NJDEP Clean Communities Program - $25,579.90
WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and
WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount, and
WHEREAS, the Township will receive $25,579.90 from the State of New Jersey Department of Environmental Protection for the purpose of funding a Clean Communities Program and wishes to amend its 2006 budget to include this amount as a revenue
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby accept the entitlement of $25,579.90; and

Resolution #060214 - Commendation on Attaining Eagle Scout Designation Landon Zimmerman
WHEREAS, the Township Committee is very pleased to recognize the outstanding personal effort of Landon Zimmerman reaching the rank of Eagle Scout, and
WHEREAS, Landon Zimmerman, a member of Troop 54 of Liberty Corner, has been an active scout, demonstrating outstanding leadership within the Troop, and has contributed many serviced hours to his community during his years in scouting, and
WHEREAS, of the total national enrollment of the scouting program, only a small percentage reach this prestigious rank, which Landon will carry as a badge of honor.
NOW THEREFORE BE IT RESOLVED that the Township Committee offers its best wishes for continued success, and congratulations for a personal achievement that will serve as a reminder of the importance of the pursuit of excellence throughout his life.
Resolution #060215 - Deferred Loan Agreement, Bernards Township Housing Rehabilitation Program, BT# 05-001, Block 178.01; Lot 21.228
WHEREAS, the Township Committee as an element of its substantive certification approval, dated June 7, 2000, with amendment approval date of September 5, 2001, is required to implement a housing rehabilitation program; and
WHEREAS, the Township has authorized Rehabco, Inc. to administer said program; and
WHEREAS, the Owner has submitted an application to Bernards Township Housing Rehabilitation Program for general property improvements and to bring into compliance health and safety issues to the Owners principal place of residence in order to meet The Council on Affordable Housing (COAH) requirements; and
WHEREAS, said application has been reviewed by the Bernards Township Housing Administrators Office and has found the owner to be eligible for assistance through the Bernards Township Housing Rehabilitation Program; and
WHEREAS, the Owner represents that funds are to be used solely to perform rehabilitation work on the property as set forth herein; and
WHEREAS, bids have been received and approved; and
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, that this Deferred Loan Agreement be made between Bernards Township and the Owner(s) whose project number is as follows:
1. 228 Irving Place, Block 178.01, Lot 21.228 for the amount of $14,780.00.
Resolution #060219 - Urging Opposition to S-278, Proposing to Decrease the Size of Drug-Free School Zones
WHEREAS, S-278 would reduce drug free "school zones" and drug free "public property" zones from within 1,000 feet of the property to within 200 feet; and
WHEREAS, under current law, persons who commit drug offenses within these drug free zones are subject to enhanced penalties; and
WHEREAS, under current law, a violation of the drug free school zone law constitutes a crime of the third degree, which is generally punishable by a term of imprisonment of three-five years and a fine of up to $15,000. The current drug free school zone law requires the imposition of a mandatory minimum term of incarceration of one-third to one-half of the sentence, or three years, whichever is greater, for all CDS crimes other than those involving less than one ounce of marijuana, as well as a fine of up to $150,000.
WHEREAS, S-278 would eliminate the mandatory minimum term of incarceration of at least three years but upgrade these CDS crimes to crimes of the second degree. Second degree crimes are punishable by a term of imprisonment of five-to-10 years, a fine of up to $150,000, or both; and
WHEREAS, S-278 also eliminates the drug free school zone mandatory minimum of one year for CDS crimes involving less than one ounce of marijuana, but this crime, as well as crimes involving a CDS listed on Schedule V, would constitute a crime of the third degree.
WHEREAS, the Township of Committee of the Township of Bernards strongly believes S-278 is not in the best interest of the citizens of Bernards Township.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby urge our legislators to oppose S-278; and
NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Committee of the Township of Bernards that a copy of this resolution be forwarded to Assemblymen Bateman and Biondi, Senators Kavanaugh and Benard Kenny, Jr., and the NJLM.
Resolution #060220 Rescheduling the Public Hearing Date for Verizons Application for Municipal Consent to Construct and Operate a Cable Television System in Bernards Township
WHEREAS, on 4/11/06 the Bernards Township Committee adopted Resolution #060199 to appoint a subcommittee and schedule commencement of consent hearing to review Verizons application for municipal consent to construct and operate a cable television system in Bernards Township; and
WHEREAS, publication of the notice for the consent hearing could not be made at least 45 days prior to the public hearing date of 5/23/06 as required by law.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that the public hearing date be changed from 5/23/06 to 6/13/06 at 7:30 P.M. so that proper notice to the public can be made in accordance with the law.
Resolution #060221 - Approval of Special Event Permit Arthritis Foundation Walk-a-Thon April 30, 2006
WHEREAS, William Darrow, representing the Arthritis Foundation, 200 Middlesex Turnpike, Iselin, NJ 08830, has requested a special event permit for April 30, 2006, for the purpose of holding a walk-a-thon within Bernards Township to raise funds for the Arthritis Foundation; and
WHEREAS, the applicant has satisfied the requirements of the Revised General Ordinances of the Township of Bernards 4-4. et. seq.; and
WHEREAS, the Municipal Clerk, Police Chief, Recreation Director, Fire Official, and Risk Manager have reviewed the application and recommend approval; and
WHEREAS, no township personnel are required to support this event.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby approve the Arthritis Foundation Walk-a-Thon on April 30, 2006, at Harry Dunham Park.
Resolution #060222 - Approval of Special Event Permit Womens Association of Morristown Memorial Hospital for Mansions in May April 29, 2006 through May 31, 2006
WHEREAS, Cathleen Biczak, representing the Womens Association of Morristown Memorial Hospital, 100 Madison Avenue, PO Box 1956, Morristown, NJ 07960, the applicant has requested a special event permit from April 29, 2006 through May 31, 2006 for the purpose of holding a house and garden tour entitled Mansions in May within Bernards Township at 135 North Maple Avenue (known as the former Ross Family Farm) for the purpose of raising funds for the Heart Hospital at Morristown Hospital; and
WHEREAS, the applicant has satisfied the requirements of the Revised General Ordinances of the Township of Bernards 4-4. et. seq.; and
WHEREAS, the Municipal Clerk, Police Chief, Recreation Director, Health Officer, Fire Official, and Risk Manager have reviewed the application and recommend approval; and

Resolution #060223 - Approval of Special Event Permit Bonnie Brae, Scottish Festival June 3, 2006
WHEREAS, William M. Reid, Jr., representing the Bonnie Brae, 3415 Valley Road, Liberty Corner, NJ 07938, has requested a special event permit for June 3, 2006, from 8:30 A.M. to 5:30 P.M. for the purpose of holding a Scottish Festival within Bernards Township at Bonnie Brae School for the purpose of raising funds for Bonnie Brae; and
WHEREAS, the applicant has satisfied the requirements of the Revised General Ordinances of the Township of Bernards 4-4. et. seq.; and
WHEREAS, the Municipal Clerk, Police Chief, Recreation Director, Health Officer, Fire Official, and Risk Manager have reviewed the application and recommend approval; and
WHEREAS, the applicant agrees there will be no parking at Pleasant Valley Pool; and
WHEREAS, Bernards Township support personnel are required to assist in this event and the applicant has agreed to reimburse the township for the cost of three police officers in the total amount of $1881.

Resolution #060224 - Authorizing Submission of Grant Proposal to the Somerset County Cultural and Heritage Commission for an Historic Preservation Grant to be Used to Conduct an Archaeological Survey Project at the Kennedy-Martin-Stelle Farmstead and to Install Temporary Roll Roofing on the Cow Shed
WHEREAS, the Township Committee of the Township of Bernards acquired the Kennedy-Martin-Stelle Farmstead as part of an open space acquisition; and,
WHEREAS, the Township Committee of the Township of Bernards recognizes the historical significance of the Kennedy-Martin-Stelle Farmstead and believes it prudent to preserve; and,
WHEREAS, in 2005 the Township Committee of the Township of Bernards leased the Kennedy-Martin-Stelle Farmstead for twenty-five years to the Friends of the Kennedy-Martin-Stelle Farmstead to preserve, develop and operate the property; and,
WHEREAS, the Township Committee of the Township of Bernards believes the Kennedy-Martin-Stelle Farmstead is an excellent candidate for an archaeological survey that will be used to plan the development of the site for public use.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, that it does hereby authorize submission of a grant application by the Friends of the Kennedy-Martin-Stelle Farmstead to the Somerset County Cultural & Heritage Commission for an Historic Preservation Grant to be used as follows: $13,346.00 for an archeology survey plus $900.00 for temporary roofing for the cow shed, totaling $14,246.00.
NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Committee of the Township of Bernards, that the Mayor and Clerk are hereby authorized to sign the grant application on behalf of the township.
Resolution #060225 - Authorizing Subordination Agreements Between Bernards Township and Eastern American Mortgage Company For an Affordable Housing Unit, Located on Block 69, Lot 2, 4 Lee Place, Basking Ridge, NJ
WHEREAS, the home located on Block 69, Lot 2 (the property) in the Township of Bernards is classified as an affordable housing unit; and,
WHEREAS, Bernards Township holds a Repayment Mortgage securing the overpayment should the owner sell for more than the maximum fair market value; and
WHEREAS, Eastern American Mortgage Company, 20 Lower Notch Road, PO Box 1230, Little Falls, NJ 07424, is about to extend a loan in the principal amounts of $4,787 and $37,150 to Steven A. Wisneiski and Nancy L.C. Wisneiski, for the subject property; and,

WHEREAS, the Township Committee as an element of its substantive certification approval, dated June 7, 2000, with amendment approval date of September 5, 2001, is required to implement a housing rehabilitation program; and
WHEREAS, the Township has authorized Rehabco, Inc. to administer said program; and
WHEREAS, the Owner has submitted an application to Bernards Township Housing Rehabilitation Program for general property improvements and to bring into compliance health and safety issues to the Owners principal place of residence in order to meet The Council on Affordable Housing (COAH) requirements; and
WHEREAS, said application has been reviewed by the Bernards Township Housing Administrators Office and has found the owner to be eligible for assistance through the Bernards Township Housing Rehabilitation Program; and
WHEREAS, the Owner represents that funds are to be used solely to perform rehabilitation work on the property as set forth herein; and
WHEREAS, bids have been received and approved.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, that this Deferred Loan Agreement Modification be made between Bernards Township and the Owner whose project number is as follows:

Resolution #060227 - Insertion of Revenue Item Into 2006 Budget NJ Office of Information Technology Enhanced 9-1-1 General Assistance Grant - $32,823.00
WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and
WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount, and
WHEREAS, the Township will receive $32,823.00 from the State of New Jersey Office of Information Technology for the purpose of funding the consolidated E-911 services entered into with Long Hill Township, and wishes to amend its 2006 budget to include this amount as a revenue item, and
WHEREAS, the Township Committee of the Township of Bernards authorized the grant application for, and acceptance of this grant agreement by resolution #050393, adopted on 9/29/05.

Resolution #060238 - Approval to Accept Donation of Funds from The Somerset County Chiefs of Police Association Received from Somerset County Crime Stoppers, and is Being Distributed to each Police Agency in Somerset County to Purchase Equipment
WHEREAS, The Somerset County Crime Stoppers has donated funds to the Somerset County Police Chiefs Association to be distributed to each police agency in Somerset County. These funds are to purchase equipment to be utilized by the Police Agency. The amount cannot exceed $ 1,000; and
WHEREAS, there is no match required; and
WHEREAS, the Bernards Township Police Department will purchase four (4) 17 inch LCD monitors to be utilized in the Police Department. Total cost will be $933.69.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards to accept this equipment donated to the Bernards Township Police Department by the Somerset County Crime Stoppers and the Somerset County Chiefs of Police Association.

Resolution #060188 - Authorization for a Fireworks Display New Jersey National Golf Club July 2, 2006
Motion by Pavlini, second by Carpenter, and unanimously agreed to approve Resolution #060188.
WHEREAS, pursuant to 3-5.31. of the Revised General Ordinances of the Township of Bernards, no person shall set off any fireworks within the township without written permission of the Township Committee; and
WHEREAS, Ed Scott, General Manager of NJ National Golf Club, 579 Allen Road, Basking Ridge, NJ 07920, (the applicant) has requested permission to hold a private fireworks display on July 2, 2006, at their site on Allen Road; and
WHEREAS, the applicant has submitted to the Municipal Clerk the required application, insurance and hold harmless agreement from Garden State Fireworks, Inc., Millington, New Jersey.
WHEREAS, staff has reviewed the application and finds it complete.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby grant permission for the requested fireworks display on July 2, 2006, to NJ National Golf Club conditioned on the following:
1. Applicant to submit to the municipal clerk a hold harmless agreement and a certificate of insurance from the fireworks contractor, Fireworks Concept, Inc., naming the Township of Bernards and NJ National Golf Club as additional insured providing general liability, bodily injury and property damage coverage with minimum limits of liability not less than $1,000,000 for any one occurrence; $3,000,000 limit if alcoholic beverages will be served. Insurance is to be placed with a company rated A- or better by Bests.
2. Applicant to hire a special duty Bernards Township Police Office to monitor motor vehicle and pedestrian traffic off-site of the event
3. Applicant to obtain from the Fire Official a fire safety permit application to discharge fireworks.

1. Chapter XXI entitled Land Development, Section 31 entitled Development Standards Nonresidential, Subsection 3 entitled Commercial (including office) of the Bernards Township General Ordinances is hereby amended as follows (deletion in strikethrough):
No commercial use shall create glare, heat, odor, noise or physical vibrations perceptible at a property line.
2. All other ordinances in conflict or inconsistent with this ordinance are hereby repealed, to the extent of such conflict or inconsistency. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township of Bernards, the provisions hereof shall be determined to govern. All other parts, portions and provisions of the Revised General Ordinances of the Township of Bernards are hereby ratified and confirmed, except where inconsistent with the terms hereof.
3. If any article, section, subsection, paragraph, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect, and to this end the provisions of this ordinance are hereby declared severable.
4. This ordinance shall take effect immediately upon final passage and publication according to law.

WHEREAS, on December 30, 2003, the Bernards Township Committee adopted Resolution #030435 entitled Acceptance of 2003 Open Space Partnership Grant from Somerset County for Block 190, Lot 28 (Mountain Park), Formerly Known as the Pizzo Property in the Amount of $100,000; and
WHEREAS, the Township of Bernards now wishes to rescind Resolution #030435 because of the following conditions of acceptance which they do not find to be in the best interest of the residents of Bernards Township:
1. A Somerset County conservation restriction and/or historic restriction is required on the property.
2. Future lease of the property or improvements to the property will be subject to Somerset County approval.
3. Other Somerset County municipalities will have the right to request use of the soccer and football fields, which would reduce their availability for use by Township residents.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, that we do hereby rescind Resolution #030435 and reject the grant award from Somerset County in the amount of $100,000 for Mountain Road Park.
