CALL TO ORDER The mayor called the meeting to order at 7:30 PM in the Municipal Building, 1 Collyer Lane, Basking Ridge, NJ
07920. Those assembled saluted the flag and the mayor read the open public meetings statement in accordance with
the law.

EXECUTIVE SESSION – Resolution #2013-0157 Motion by Pavlini, second by Malay, and unanimously agreed that Resolution #2013-0157 be amended to include a
discussion on various other board vacancies, and that the amended resolution be approved. The meeting temporarily
adjourned to executive session at 7:32 PM.
WHEREAS, NJSA 10:4-12 allows for a public body to go into closed session during a public meeting; and
WHEREAS, the Township Committee has deemed it necessary to go into closed session to discuss certain matters
which are exempted from the public; and
WHEREAS, the regular meeting of the Township Committee will reconvene.
NOW THEREFORE BE IT RESOLVED, that the Township Committee will go into closed session for the
following reason(s) as outlined in NJSA 10:4-12; and
NOW THEREFORE BE IT FURTHER RESOLVED, that the Township Committee hereby declares that the
discussion of subject(s) may be made public at a time when the Township Attorney advises the Township
Committee that the disclosure of the discussion will not detrimentally affect any right, interest or duty of the
Township or any other entity with respect to said discussion. That time is currently estimated as the time of said
matter.
NOW THEREFORE BE IT FINALLY RESOLVED that the Township Committee, hereby declares that the
public is excluded from the portion of the meeting during which the discussion(s) shall take place and hereby directs
the Municipal Clerk to take the appropriate action to effectuate the terms of this resolution.

REPORTS Resolution #2013-0162 - Acceptance of Basking Ridge Fire Company, 2012 Annual Report, Adoption of the 2013 By-Laws, and Acknowledgement of 2013 Membership Roster

WHEREAS, pursuant to §2-14 of the Revised General Ordinances of the Township of Bernards the volunteer Fire
Department of the Township of Bernards shall consist of the Basking Ridge Fire Company #1 and the Liberty
Corner Fire Company, Inc.; and
WHEREAS, the Fire Department shall furnish annual reports, in writing to the Township Committee; and
WHEREAS, the Fire Department shall be governed by the rules and regulations adopted by resolution of the
Township Committee.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards as follows
regarding the BRFC:
1. The BRFC 2012 annual report is accepted as submitted.
2. The BRFC 2013 By-Laws are adopted as submitted.
3. The BRFC 2013 Roster of members is acknowledged as submitted.
Joint Task Force on RHS Traffic – Report and Recommendations Timko presented the Task Force’s preferred Option 9: Creating a new ingress and egress separate and apart from
the traffic signal on N. Finley Avenue was the best way to solve the problem. Specifically, Concept Plan #9 was the
best overall solution because it created two non overlapping ingress/egress traffic loops. Concept plan # 9 can be
constructed with little or no infringement on private property owners. The ingress can function as a right hand turn
in only for vehicles travelling north on Finley Avenue (a left hand turn in, while convenient, would not be
constructed). Exiting vehicles will turn right only to head North on Finley Avenue. During the morning rush the
exiting vehicles would be restricted to buses only. In the afternoon the current practice would prevail: vehicles
exiting lots C and D can do so through the health department (north bound) or through the oval and traffic signal.
The existing ability to leave the oval through the health department drive would be eliminated with little impact
since vehicles can easily proceed to the signal to turn north.
The committee agreed with the Task Force’s decision. Motion by Spitzer, second by Malay, and unanimously
agreed to amend the agenda to add Resolution #2013-0173 to the agenda under New Business for formalize their
support for the Board’s decision.

FIRE & RESCUE APPOINTMENTS Resolution #2013-0156 – Appointment to Membership in Township of Bernards Volunteer,Liberty Corner Fire Company, Junior Member - Neil Farley Motion by Malay, second by Pavlini, and unanimously agreed that Resolution #2013-0156 be approved.
WHEREAS, pursuant to §2-14.1 of the Revised General Ordinances of the Township of Bernards, the volunteer
fire department consisting of the Basking Ridge Fire Company #1 and the Liberty Corner Fire Company, Inc., are
hereby made the fire department for the Township of Bernards; and
WHEREAS, the Liberty Corner Fire Company is recommending Neil Farley, 24 Cameron Ct., Basking Ridge,
NJ, for appointment as a Junior member.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that Neil
Farley is hereby appointed as a Junior Member of the Liberty Corner Fire Company effective this date.
Resolution #2013-0181 - Appointment to Membership in Township of Bernards Volunteer Basking Ridge Fire Company #1 and First Aid Squad of the Basking Ridge Fire Company #1 – Robert K. Fullagar III Motion by Pavlini, second by Carpenter, and unanimously agreed that Resolution #2013-0181 be approved
WHEREAS, pursuant to §2-14.1 of the Revised General Ordinances of the Township of Bernards, the volunteer fire
department consisting of the Basking Ridge Fire Company #1 and the Liberty Corner Fire Company, Inc. are hereby
made the fire departments for the Township of Bernards; and
WHEREAS, § 2-16.1 of the Revised General Ordinances of the Township of Bernards, there shall be a first aid
department known as the "Township of Bernards First Aid and Emergency Department" consisting of the First Aid
Squad of the Basking Ridge Fire Company No. #1 and the Liberty Corner First Aid Squad, Inc.;
WHEREAS, Robert K. Fullagar III, 122 Spencer Road, Basking Ridge, NJ, has been recommended by the
Basking Ridge Fire Company #1 and the First Aid Squad of the Basking Ridge Fire Company #1 for appointment.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that the
applicant is hereby appointed as a member of the Basking Ridge Fire Company #1 and
First Aid Squad of Basking Ridge Fire Company #1 effective this date.

Ordinance #2230 - An Ordinance Authorizing and Approving the Township of Bernards’ Vacation of the Public Right-Of-Way Identified as a Portion of Brook Avenue – Public Hearing Planning Board Report The clerk read the ordinance by title, the committee acknowledged the Planning Board’s report finding the
ordinance consistent with the Master Plan, and the mayor opened the public hearing. There were no comments and
the hearing was closed.
Motion by Malay, second by Carpenter, that Ordinance #2230 be adopted and advertised as required by law.

WHEREAS, it is the recommendation of the Director of Parks & Recreation and Purchasing Agent to award this

Resolution #2013-0160 - Tax Exemption Approval for Barry Taylor WHEREAS, the owner for Block 8101 Lot 2 has filed an application for total exemption on taxes due to a total and
permanent disability, and
WHEREAS, the owner is entitled to the exemption as a result of the total and permanent disability per NJSA 54:4-
3.30, and
WHEREAS, the Tax Assessor has approved said application in the year 2013 and every year the applicant is
qualified.
NOW THEREFORE BE IT RESOLVED, the Tax Collector for the Township of Bernards recommends that the
taxes on Block 8101 Lot 2, otherwise known as 240 Stonehouse Rd, currently owned by Barry Taylor & Sharon

Resolution #2013-0163 - Approval of Independent Agreement with Central Jersey Housing Resource Center (CJHRC) at a cost not to exceed $53,160.00 (Funding for this Contract is not from General Revenues, but from Funds Contributed by Developers to the Development Fee Account Pursuant to Section 21-76.16 of Revised Land Use Ordinances of the Twp of Bernards) WHEREAS, Central Jersey Housing Resource Center (CJHRC) is a nonprofit collaboration of businesses, financial
institutions, social service agencies, public officials and housing advocates who work to increase the accessibility
and availability of affordable housing in Central New Jersey; and
WHEREAS, CJHRC currently operates a centralized housing resource information center in Somerset County and
is a HUD certified agency specialized in the state and federal housing regulations; and
WHEREAS, CJHRC proposes to enter into an agreement with Bernards Township to provide such services as an
Affordable Housing Coordinating Agency for existing low and moderate income rental and purchase units pursuant
to Uniform Housing Affordability Controls, N.J.A.C. 5:80-16.18 -4i-viii; and
WHEREAS, should the State Legislature or Governor adopt legislation or executive orders that eliminate COAH or
no longer require the Township to hire the services of CJHRC, Bernards Township may terminate this Agreement
on sixty days written notice and pay CJHRC for the services rendered up to the termination date; and
WHEREAS: this contract was awarded without public advertisement as defined in N.J.S.A. 19:44A-20-7 and
pursuant to the provisions of N.J.S.A. 19:44A-20-4; and
WHEREAS, the Chief Financial Officer has certified funds are available in the Affordable Housing Trust Fund line
item appropriation or ordinance account #3-13-56-055-COA; and
WHEREAS, funding for this contract are not derived from general revenues but from monies contributed by
developers to the development fee account pursuant to Section 21-76.16.
NOW BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby approve
an agreement at a cost not to exceed $53,160.00 with the Central Jersey Housing Resource Center (CJHRC)
effective May 1, 2013 through April 30, 2014.
NOW THEREFORE BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the
Determination of Value be placed on file with this resolution.

Resolution #2013-0164 - Authorizing Submission of a Grant Proposal by the Friends of The Kennedy-Martin-Stelle Farmstead to The Somerset County Cultural And Heritage Commission for an Historic Preservation Grant In The Amount of $249,646 to Prepare the English Barn for Three Season, ADA-Compliant Occupancy Including Specifically, an ADA Access Ramp, a Weather Tight Emergency Egress Door Inside the North Sliding Barn Doors and Electrical Service and Lighting for the Barn, to Repair and Stabilize the Basement Foundation of the Fireplace Which is Located in the Dining Room of the Farmhouse, to Provide a Tarp for the Roof of the Cow Shed, to Preserve and Restore the Ice House and to Provide for an Historic Marker WHEREAS, the Township Committee of the Township of Bernards acquired the Kennedy-Martin-Stelle Farmstead
as part of an open space acquisition; and,
WHEREAS, the Township Committee of the Township of Bernards recognizes the historical significance of the
Kennedy-Martin-Stelle Farmstead and believes it prudent to preserve; and,
WHEREAS, the Kennedy-Martin-Stelle Farmstead is a community landmark that reflects the rich heritage of
Bernards Township, and
WHEREAS, Bernards Township acquired the property with municipal open space funds in 1999; in 2001 appointed
a task force to preserve the Farmstead; and undertook successful preservation grant requests totaling $839,657; and
WHEREAS, the Township Committee has entrusted the Friends of the Kennedy-Martin-Stelle Farmstead to be
stewards of the Farmstead Property; and
WHEREAS, it is the mission of the Friends of the Kennedy-Martin-Stelle Farmstead to preserve and operate the
Farmstead, which is listed on the New Jersey and National Registers of Historic Places, as Farmstead Arts, a non-
profit center for fine, performing and practical arts; and
WHEREAS, the Friends of the Kennedy-Martin-Stelle Farmstead were awarded a 2010 grant for $ 176,483 from
the Garden State Historic Preservation Trust to prepare the interior of the English Barn for public use, including the
elevation of two transverse beams that limit use of the west end of the barn, installation of a concrete slab and
partial wood floor; and a weather-tight emergency-egress door on the south side of the barn; and
WHEREAS , in order to have the English Barn eligible for a certificate of occupancy, additional work must be
completed including the installation of an ADA access ramp, weather tight doors over the sliding barn doors and
electrical service and lighting for the barn; and
WHEREAS, the Friends of the Kennedy-Martin-Stelle Farmstead believe it is imperative to complete the requested
work on the English Barn as soon as possible to generate revenue to support the entire Farmstead project; and
WHEREAS, the Friends of the Kennedy-Martin-Stelle Farmstead were awarded a 2011 grant for $118,504 for
basement structural support, main room floor repairs, the installation of a stone stoop at the south entry door,
insulation of the attic and box sill, repair & repainting of all windows, repair of the southern exterior door and
rebuilding a screen door, installation of a door for the A/C closet, building of sidewalks on the north and south side
of the Farm House, restoration of the well house, a preservation plan for the cow shed, and repair of one of the
beams in the English Barn; and
WHEREAS, the Friends of the Kennedy-Martin-Stelle Farmstead believe the repair and stabilization of the
basement foundation of the dining room fireplace is essential for the stabilization of the entire Farm House, and that
the tarp on cow shed roof is in need of replacement to prevent further deterioration of the cow shed, that the Ice
House is in need of restoration as it contributes to the unique historic assemblage that makes the Farmstead such a
valuable resource for historical education, and an Historic Marker is important for historic tourism and historic
education relating to the site; and

WHEREAS, the requested funds will enable preparation of the English Barn for three season, day and evening use,
ADA compliant public use, will stabilize the foundation of the Farm House, stabilize the Cow Shed, restore the Ice
House and allow for the installation of an Historic Marker for the property; and
WHEREAS, fine and performing artists and practical arts practitioners have expressed keen interest in use of the
English Barn, and these same people are already intensively using the Farm House for fine and performing arts
programming; and
WHEREAS, the English Barn and Farm House at the Farmstead have been preserved and restored with generous
assistance from Bernards Township, Somerset County, the Historical Society of the Somerset Hills, the New Jersey
Historic Trust, the Bernardsville Rotary Club, the Bona Fides of Basking Ridge, members of the Friends of the
Kennedy-Martin-Stelle Farmstead, foundations, and over 140 local volunteers; and
WHEREAS, the Friends of the Kennedy-Martin-Stelle Farmstead undertook successful preservation grant requests
totaling $618, 838 and successfully managed the use of these grants; and
WHEREAS, the Township Committee of the Township of Bernards believes this property is an excellent candidate
for a grant from the Somerset County 2013 Historic Preservation Grant Program.
WHEREAS, there are no Township of Bernards matching funds required.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, that it does
hereby authorize the Kennedy-Martin-Stelle Farmstead to submit a grant application to the Somerset County 2013
Historic Preservation Grant Program.

compliance with N.J.S.A.19:44A 20-4 et seq., and that the principals of the said companies, have not made any
reportable contributions to a political or candidate committee in the Township of Bernards in the previous one year,

and that the contract will prohibit the principals of said companies from making ANY contributions through the term
of the contract pursuant to Bernards Township Ordinance # 1854 adopted on February 28, 2006, that would prohibit
any business entity or professional that procures goods, services or contracts from the Township without the formal
bid process from making “any” contribution whatsoever in the prior calendar year.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Bernards, Somerset
County, New Jersey that the Purchasing Agent is hereby authorized to issue purchase orders to the vendor listed
above to maintain continuity and facilitate the ordering process through December 31, 2013.
Resolution #2013-0187 - Awarding Professional Services Contract for Legal Services Farmland Rollback Appeal Attorney (Block-7301, Lot-42.03 Q-Q0078 and Block-7301, Lot-42.05, Q-Q0078) to Emil Philibosian of the firm Hoagland, Longo, Moran, Dunst & Doukas, LLP - In the Not to Exceed Amount of $600 WHEREAS, the Township of Bernards requires services for Professional Farmland Rollback Appeal Attorney; and
WHEREAS, Emil Philibosian of the firm Hoagland, Longo, Moran, Dunst & Doukas, LLP , has submitted a
proposal dated April 1, 2013 outlining legal services for Farmland Rollback Appeals to the Township; and
WHEREAS, section N.J.S.A. 40A:11-5 of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) exempts such
professional services from competitive bidding; and
WHEREAS, the Chief Financial Officer has certified funds are available in account name (Legal Fees and
Compensation) line account # 3-01-20-155-20C line item appropriation or ordinance.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Bernards that a
professional service contract be awarded to Emil Philibosian, of the firm Hoagland, Longo, Moran, Dunst &
Doukas, 40 Paterson Street, New Brunswick, NJ 08903, as follows:
1. The contract will encompass services as outlined in the submitted proposal dated April 1, 2013.
2. The contract term is from April 9, 2013 through April 8, 2014 for Professional Special Counsel Farmland
Rollback Appeals at the hourly rate of $160.00, at a not to exceed amount of $6,000.00.
3. Billings must be rendered by the contractor within 30 days of service delivery.
4. Any modification to this contract shall be in writing and signed by both parties and upon obtaining said
signatures shall immediately become part of the contract.
5. No payments in excess of the “not to exceed” contract amounts will be approved, unless such
services/expenditures are negotiated and agreed upon in advance of service delivery.
6. As required by law, the parties to this contract agree to incorporate into this contract the mandatory affirmative
action language promulgated by the Treasurer pursuant to P.L. 1975, c.127, which is attached to this resolution as
Exhibit A.
7. This contract shall, for all purposes, be deemed a NJ Contract and any provisions of this contract shall be governed
and interpreted with the Laws of the State of New Jersey.
8. The contractor shall report directly to David Centrelli, Assessor, who will be the chief contact for the Township of
Bernards on this project.
NOW THEREFORE BE IT FINALLY RESOLVED, by the Township Committee of the Township of Bernards

WHEREAS, Senate Bill S2 sponsored by Senators Sweeney, Kyrillos, and O'Toole, was adopted by the NJ Senate
on November 29, 2012; and WHEREAS, said legislation provides for a loss of State Aid in order to force municipalities and autonomous
agencies to share services.
WHEREAS, if the Local Unit Alignment, Reorganization and Consolidation Commission certifies that a shared
service will benefit a municipality, the municipality would be required to adopt the shared service or to place it before
the voters unless objected to by the Legislature. If the municipality fails to implement the shared service, it could

result in a loss of State Aid equal to the amount of the estimated savings as determined by the Local Unit Alignment,
Reorganization, and Consolidation Commission and certified by the State Treasurer; and WHEREAS, the Township Committee of the Township of Bernards is of the opinion that while shared services may
be beneficial, a decision to implement a shared service must be made on a case by case basis evaluating all factors
relevant to the particular shared service; and WHEREAS, local governing bodies, and not a State Appointed Commission, should be responsible for determining
whether a shared service initiative makes sense and should be implemented; and WHEREAS, State Aid should be determined based upon a long term evaluation of the distribution of Energy
Receipt Tax, municipalities' tax rate, tax levy, service demands and management approach and not by directing
such activities such as a shared service; and
WHEREAS, this legislation has been referred to the New Jersey State General Assembly as A1171. NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Bernards, in Somerset

WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit municipalities
in sound fiscal condition to assume the responsibility, normally granted to the Director of the Division of Local
Government Services, of conducting the annual budget examination; and
WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and
WHEREAS, pursuant to N.J.A.C. 5:30-7.2 through 7.5, the Township of Bernards has been declared eligible to
participate in the program by the Division of Local Government Services, and the Chief Financial Officer has
determined that the local government meets the necessary conditions to participate in the program for the 2013
budget year.
NOW THEREFORE BE IT RESOLVED, by the governing body of the Township of Bernards that in accordance
with N.J.A.C. 5:30-7.6a & 7.6b and based upon the Chief Financial Officer’s certification, the governing body has
found the budget has met the following requirements:
1. That with reference to the following items, the amounts have been calculated pursuant to law and
appropriated as such in the budget:
a. Payment of interest and debt redemption charges
b. Deferred charges and statutory expenditures
c. Cash deficit of preceding year
d. Reserve for uncollected taxes
e. Other reserves and non-disbursement items
f. Any inclusions of amounts required for school purposes.

N.J.A.C. 5:30-4 and 5:30-5.
4. That pursuant to the Local Budget Law:
a. All estimates of revenue are reasonable, accurate and correctly stated,
b. Items of appropriation are properly set forth
c. In itemization, form, arrangement and content, the budget will permit the exercise of the
comptroller function within the municipality.
5. The budget and associated amendments have been introduced and publicly advertised in accordance with

40A:4-5 shall not prevent such certification.

Director, Division of Local Government Services is on file with the Township Clerk and are available for public
inspection.

WHEREAS, in November of 2012 the Bernards Township Board of Education and the Bernards Township
Committee agreed to form a joint task force to provide a recommendation to the respective governing bodies for a
safe traffic flow for the morning arrival to Ridge High School that includes traffic patterns for pedestrians, school
buses, and private vehicles; and
WHEREAS, over the period of four months, numerous solutions were evaluated with equal consideration to
develop pros and cons for each, and public input was solicited; and

WHEREAS, a final report containing analysis of the pros and cons of each solution was produced by the task force
in consultation with the Township Engineer Thomas Timko, PE and an independent Traffic Engineering firm of
Dolan and Dean Consulting Engineers; and
WHEREAS, on April 8, 2013, the Bernards Township Board of Education discussed the final report and concluded
that Option 9 is the most desirable to pursue; in summary Option 9 states:
Creating a new ingress and egress separate and apart from the traffic signal on N. Finley Avenue was the best way
to solve the problem. Specifically, Concept Plan #9 was the best overall solution we could devise because it created
two non overlapping ingress/egress traffic loops. Concept plan # 9 can be constructed with little or no infringement
on private property owners. The ingress can function as a right hand turn in only for vehicles travelling north on
Finley Avenue (a left hand turn in, while convenient, would not be constructed). Exiting vehicles will turn right only
to head North on Finley Avenue. During the morning rush the exiting vehicles would be restricted to buses only. In
the afternoon the current practice would prevail: vehicles exiting lots C and D can do so through the health
department (north bound) or through the oval and traffic signal. The existing ability to leave the oval through the
health department drive would be eliminated with little impact since vehicles can easily proceed to the signal to turn
north.
WHEREAS, on April 9, 2013, the Bernards Township Committee discussed the final report.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do
hereby acknowledge and agree that Option 9 should be implemented by the Board of Education.
NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Committee of the Township of Bernards
that we do hereby direct staff to prepare the necessary ordinances and easements to effectuate Option 9.
