CALL TO ORDER The mayor called the meeting to order at 7 PM. Those assembled saluted the flag and the mayor read the open public meetings statement in accordance with the law. ROLL CALL Present: Carpenter, Chaudry, Kelly, , Pavlini Absent: Malay Also Present: CFO/Administrator McArthur, Attorney Belardo, Municipal Clerk/Assist.

Admin. Szabo AMEND AGENDA Motion by Carpenter, second by Kelly, and unanimously agreed to amend the agenda to include an executive session discussion regarding land acquisition, Block 164, Lot 6; and a discussion on personnel, 2008 appointments. EXECUTIVE SESSION - Resolution #070546, Land Acquisition Motion by Carpenter, second by Kelly, and unanimously agreed to adopt Resolution #070546 and at 7:02, the meeting temporarily adjourned to executive session. WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231 P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards, County of Somerset, State of New Jersey, as follows: 1. The public shall be excluded from discussion of an action upon the specified subject matter. 2. The general nature of the subject matter to be discussed is as follows:

Land Acquisition Block 76, Lots 5.01 & 6 Block 164, Lot 6

Personnel 2008 Appointments 3. It is anticipated that the minutes on the subject matters of the closed session will be made

public upon conclusion, dismissal or settlement of litigation; or final resolution of agreements on personnel matters; and in any event, when appropriate pursuant to N.J.S.A. 10:4-7 and 4-13.

4. The committee will come back into open session and may take further action. 5. This resolution shall take effect immediately. The meeting resumed in open session at 7:30 P.M. 11/01/2007 - Combined Agenda/Regular Meeting – Exec. Session By unanimous consent, these minutes were approved for content only. FIRE & RESCUE APPOINTMENTS None. CORRESPONDENCE None. REPORTS None. PUBLIC COMMENT Todd Edelstein Drive, Riverside Drive, advised the committee that Channel 15 was not scrolling community announcements. TOWNSHIP COMMITTEE/STAFF COMMENTS Committee and staff members reported on their recent activities. UNFINISHED BUSINESS None. NEW BUSINESS Consent Agenda The items listed within the consent agenda portion of the meeting have been referred to the Township Committee for reading and study, a copy placed on the bulletin board of the meeting room and are considered routine and will be enacted by one motion of the Township Committee with no separate discussion. If separate discussion is required, the item may be removed from the agenda by township committee action and placed on the regular agenda under new business. Motion by Chaudry, second by Carpenter, that Resolutions # 070537, 070548, #070553 and #070560 be removed from the consent agenda, and that the remaining items be approved. Resolution #070536 - Authorizing Hunting within 450 Feet of the Bernards Township Engineering Services Building in Conjunction with the 2007-2008 Community Based Deer Management Program in Bernards Township WHEREAS, the Bernards Township Deer Management Program has now been operated safely and effectively under the direction and supervision of the Bernards Township Police Department and the Bernards Township Deer Management Administrator for the past six seasons, and WHEREAS, pursuant to Resolutions #07287 adopted by the Bernards Township Committee on May 29, 2007, the Township authorized a 2007-2008 Deer Management Program; and WHEREAS, pursuant to N.J.S.A. 23:4-16d “No person, except the owner or lessee of the building and persons specifically authorized by him in writing, which writing shall be in the person's possession, shall, for the purpose of hunting, taking or killing any wildlife, have in his possession a loaded firearm or nocked arrow while within 450 feet of any occupied building in this State, or of any school playground”; and WHEREAS, the Deer Management Advisory Committee has requested that their authorized hunters be granted permission to hunt at one or more sites within Tract 2 which are less than 450 feet from the Bernards Township Engineering Services Building at 277 S. Maple Avenue in Basking Ridge; and WHEREAS, the Bernards Township Engineering Services Building is owned by the Township of Bernards. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby grant permission for authorized hunters of the 2007-2008 Deer Management Program to hunt within 450 feet of the Bernards Township Engineering Services Building at 277 S. Maple Avenue in Basking Ridge Tract 2; and NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Committee of the Township of Bernards that we do hereby direct that each authorized hunter be directed to carry on his person, a copy of this resolution when hunting Tract 2; and NOW THEREFORE BE IT FINALLY RESOLVED, by the Township Committee of the Township of Bernards that we do hereby direct the Deer Management Administrator to provide written notification to the Township Engineer, DPW Director and Construction Code Official of hunt dates at Tract 2 at least 24 hours in advance of scheduled hunting.

Resolution #070540 - Authorizing the Discharge of the Mortgage made as part of the Bernards Township Housing Rehabilitation Program by Lucille Conklin WHEREAS, Lucille Conklin is the owner of property designated as Lot 6-167 in Block 178.01 on the Tax Map of the Township of Bernards, in the County of Somerset, State of New Jersey, commonly known as 167 Irving Place (the “Property”); WHEREAS, Lucille Conklin received monetary assistance in the form of a forgiveable loan through the Bernards Township Housing Rehabilitation Program for the purpose of correcting housing defects and bringing them up to the housing code standards, WHEREAS, as part of the terms of such monetary assistance Lucille Conklin entered a Mortgage on October 10, 2001, in the amount of Four Thousand Nine Hundred Sixty Five ($4,965.00) Dollars for the Property to The Township of Bernards, which Mortgage was recorded or registered in the office of the Somerset County Clerk on October 12, 2001, in Mortgage Book 5049, Page 2734, Instrument No. 2001365540; WHEREAS, the terms of the forgivable loan, consisting of the requirement to own and occupy the Property as a primary residence for a six (6) year period, have been met by Lucille Conklin; WHEREAS, Donald Davis, Township Housing Administrator, has confirmed that the six (6) year housing affordability control period has expired and there are no further monies owed by Lucille Conklin in connection with the Mortgage of the Property to the Township of Bernards; and WHEREAS, based on the above, Lucille Conklin has met the obligations for and is entitled to a Discharge of the Mortgage; NOW, THEREFORE, BE IT RESOLVED THAT the Township Committee of Bernards Township, County of Somerset, hereby authorizes the execution of the attached Discharge of Mortgage and recording of the same with the Somerset County Clerk.

Resolution #070542 - Personnel Appointment, Katherine Hutchinson – Per Diem Smoke Detector Inspector, Fire Prevention Bureau WHEREAS, the Per Diem position of Smoke Detector Inspector is was approved in the 2007 budget process; and, WHEREAS, the Fire Official, Township Administrator, and Human Resources Manager have deemed it necessary to fill this position; and,

Identify Billing Errors and/or Discrepancies: Com-Logic shall audit circuit invoices for the primary purpose of identifying errors and discrepancies, including, but not limited to overcharges, tariff contract discrepancies, and discrepancies between the invoice audit and physical audit. Com-Logic shall implement cross reference processes to compare actual invoices with BERNARDS TOWNSHIP service records, contracts, rates, tariff inventory from physical audits and any other elements that may result in significant cost savings. Report on Recommended Recoverable Amounts: Com-Logic shall provide a report of recommendations for recovery to BERNARDS TOWNSHIP for their review and approval prior to pursuing recovery from respective service provider(s). Tax Audit Limitations: For tax purposes, Com-Logic’s engagement shall be limited to errors or discrepancies proportionately and directly related to service charge reductions as a result of overcharges in services or incorrect service usage coding. Additional tax offerings are available upon request. Site Inspection & Audit Validation: Com-Logic shall perform a physical audit of BERNARDS TOWNSHIP voice and data circuits at site locations identified and approved by BERNARDS TOWNSHIP for the primary purpose of providing BERNARDS TOWNSHIP a complete and accurate inventory of end-to-end circuit information with validation against the completed invoice audit records. The minimum requirements of the physical audit, shall include, but not be limited to: Physically inspect each site to identify all circuits (whether in service or out of service) and compare against invoice audit information, BERNARDS TOWNSHIP service records and/or any other information provided by BERNARDS TOWNSHIP or service provider(s). Circuit Identification and Documentation: Identify all circuits coming into the building(s) point of presence (“POP”) or point of termination (“POT”), trace to equipment termination point and provide the following information in the required circuit database format.

Identify all non-working circuits. Identify all circuits in service, but not in use. Verify cross-connect to BERNARDS TOWNSHIP equipment. Provide punch-down block, jack and pin information for each circuit. Identify rack, shelf, port, model and serial number of BERNARDS TOWNSHIP equipment

for all circuit terminations. (Optional) Optimization Strategies: As a result of the review, conversion and/or physical audits, Com-Logic will provide strategies that would result in current and future cost savings for BERNARDS TOWNSHIP. BERNARDS TOWNSHIP shall have the right to accept or reject any optimization recommendations provided by Com-Logic. The minimum requirements of the optimization recommendations, shall include, but not be limited to:

Improved service provider rates, disconnects of unused circuits preventing future billing, identifying billing discrepancies, and/or optimization of existing circuits. Implementation of Approved Strategies: As a result of any and all approved strategies, Com-Logic will use all reasonable efforts to work with BERNARDS TOWNSHIP to implement such strategies in an expeditious manner; whereas a technology or carrier change may take place. In such case(s) by which a simple billing change needs to occur, Com-Logic will spearhead that change on its own. All strategies will be validated through a follow up billing review.

Circuit Inventory Database: Com-Logic shall develop a circuit inventory database that provides a complete and accurate inventory of all circuits, either originating or terminating, at a BERNARDS TOWNSHIP facility or other certified BERNARDS TOWNSHIP facility for which they are being billed (based on the contracts, BERNARDS TOWNSHIP service records and/or invoice and physical audits). Com-Logic will deliver the circuit database to BERNARDS TOWNSHIP in either Excel format, or other agreed upon format. An example of the Circuit Database format and information required is attached hereto as Exhibit D. BERNARDS TOWNSHIP reserves the right to include additional fields, but must be agreed to in writing by both parties. the waitlist for membership. 3. Re-Initiation Fees are charged when notification of a temporary move out of the Township of

5 years or less is received and accepted. Upon resumption of residency they must reapply for membership, will be moved to the top of the waitlist and will be charged the appropriate initiation and membership fee.

4. Deadlines and Late Fees: o Late fees are in addition to the appropriate membership and initiation fees and charged

according the dates listed in this fee schedule. Deadlines for new offers will be set according to when they were mailed. A minimum of two weeks (including weekends) will be given to return a new offer. Senior Memberships will not be charged late fees.

o Membership renewals will be accepted with the appropriate late fee until opening day for the season. Renewals received after opening day will be returned and the family/individual will be placed at the top of the waiting list for the following season. If membership is not renewed the following season, the family/individual will be required to submit a new application to be placed on the waitlist.

o Membership offers will be accepted after their deadline with the appropriate late fee only if memberships are available. If there are no available memberships the applicant will be placed at the top of the waiting list for the following season. If a membership offer is not accepted the following season, the family/individual will be required to submit a new application to be placed on the waitlist.

5. Waving of Fees and Waitlist Procedures: o Each season Fire Company & First Aid Squad Volunteers will each receive one

complimentary punch pass redeemable for up to five family visits to the pool regardless of membership status. Volunteers interested in membership to the pool will be placed at the top of the waitlist.

o The families or individuals recognized by the Township who lost an immediate family member in the September 11th tragedy are eligible for a pool membership with all membership fees, initiation fees and activity fees waived. Children of eligible families may have a free individual membership up to the age of 23. If the surviving spouse re-marries then annual membership fees will be assessed, per type of membership. Free membership to the pool will be extended to the eligible families as long as they meet the requirements for membership to Pleasant Valley Pool, i.e. remain a resident of Bernards Township. Guest fees will the responsibility of the family.

WHEREAS, the Bernards Township Deer Management Program has now been operated safely and effectively under the direction and supervision of the Bernards Township Police Department and the Bernards Township Deer Management Administrator for the past six seasons, and WHEREAS, pursuant to Resolutions #07287 adopted by the Bernards Township Committee on May 29, 2007, the Township authorized a 2007-2008 Deer Management Program; and WHEREAS, the Township of Bernards has now acquired two additional properties which have been inspected by the Bernards Township Deer Management Administrator and deemed suitable and worthwhile for inclusion in the Township’s deer management program, namely: Block 122, Lots 1, 5, 21, 22, and 23, totaling 186.75 acres, south of Whitenack Road, between Mine Brook Road and Annin Road (and formerly known as the Cangiano property), and Block 104, Lot 10, comprising 10.72 acres north of Whitenack Road and south of Canoe Brook Road (and formerly known as the Gerhart Farm), both as depicted on the accompanying Tract Map, NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Bernards that we do hereby authorize inclusion of the aforementioned municipal properties in the Township’s deer management program, and NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Committee of the Township of Bernards that an Amendment to the Township’s 2007-2008 Community Based Deer Management Plan be submitted to the New Jersey Division of Fish and Wildlife requesting these tracts’ addition to the 2007-2008 CBDM Permit issued August 14, 2007 to Bernards Township. Discussion of Cablevision’s Franchise RenewalIn July 2010 the franchise will expire. The ascertain period is imminent. The municipality can determine the past performance of cablevision and ascertain the needs of the community. Unlike Verizon, Cablevision is still regulated by local ordinance. The committee agreed to appoint a Cable TV Task force at the 2008 Reorganization meeting to begin the process of renewal. Discussion of Land Use Ordinance Amendment Revising Definition of Lot Width The committee discussion the proposed amendment such that the method of calculating lot width is the same for all lots, including cul-de-sac lots or pie-shaped lots. On all lots other than cul-de-sac/pie-shaped lots, lot width is currently measured along the front yard setback line, without exception. However, the current ordinance provides that, on cul-de-sac lots or pie-shaped lots, lot width may be measured at the actual location of the dwelling. Thus, if a lot does not provide the minimum required width at the front yard setback line, the developer may shift the dwelling further back on the lot to a location where the minimum required width is achieved. This scenario invites incompatible relationships among dwellings and yards on adjoining lots. For example, where one dwelling is constructed at the front yard setback line and an adjacent dwelling on a cul-de-sac lot is constructed further back in order to satisfy the lot width requirement, the result can be a “front yard vs. back yard” arrangement, where one resident’s front door faces another resident’s accessory uses. This ordinance is intended to promote consistent and compatible lot widths and dwelling locations, and to maintain harmonious relationships among adjoining dwellings and yards.
