15. Invert Crossing An invert crossing must be constructed in accordance with Council’s Standard
Drawing No. PA3-773 and Council Policy 024 for access to Carlyle Street. 16. Electricity and Telecommunications Services The approved development must be provided with electricity and
telecommunications infrastructure. 17. Stormwater Drainage Stormwater from the site (including roofwater) shall be collected within the
property boundaries and discharged via an underground system to Council’s stormwater system in Carlyle Street. The legal point of discharge is the Alfred Street Trunk Drainage System.
18. Ponding and Diversion of Stormwater Ponding of stormwater resulting from the development must not occur on
adjacent sites and stormwater formerly flowing onto the site must not be diverted onto other sites. The site shall be graded so that it is free draining.
The applicant is to demonstrate compliance with this condition in the application
for Operational Works approval. 19. Underground Car parking – drainage A pump system must be installed in the basement to pump all collected water to

21. Connect to water services The developer is to upgrade existing 100mm dia main located on the eastern
side of Carlyle Street to a 150mm dia main from the existing 375mm dia water main located in Gordon Street, to the southern boundary of subject site.
Alternatively, a new 150mm dia main may be constructed on the western side of Carlyle Street, with a connection to the existing 100mm dia main on the eastern side of Carlyle Street.
Separate water meters required for potable water and fire fighting supply.
Two new 150mm dia water services are required for the development. 21A. Water Sub Metering
Queensland State Legislation (the ‘Standard Plumbing and Drainage Regulation 2003’, Section 8B) requires compliance with the Queensland Plumbing and Wastewater Code. In particular, the QPW Code requires that ‘The water supply to a meterable premises must be fitted with a device (water meter) to measure the amount of water supplied to the premises’. ‘Meterable premises’ means (amongst other definitions) each lot within a community title scheme, including the common property, in a water service provider’s area. a) Individual meters (Sub-meters) must be installed to each meterable
premises (ie. each lot including common property areas). b) A Master Meter must be installed to the development. c) Sub-meters and Master Meter must be fitted with Automatic Meter
Reading (AMR) technology. AMR technology consists of a Meter Interface Unit (MIU) fitted to each meter (including the master meter), a Data Concentration Unit (DCU) and the equipment necessary to provide connectivity between the MIU’s and the DCU.
d) The Master Meter and the DCU must be located together in a lockable Cupboard (termed ‘Meter Cupboard’) located at the front of the development such that accessibility to the meter cupboard from outside the development is maintained at all times.
The developer is responsible for the installation of sub-meters, master meter, AMR technology hardware, meter cupboards and the supply of all equipment and materials to the satisfaction of Mackay Regional Council. Meters are to be supplied by Mackay Regional Council.

22. Sewer Main Plans The development is to connect to the existing sewer line in accordance with the
requirements of Mackay Water & Waste. The development is not permitted to be built over the existing sewer main
running along the western boundary of the site. The sewer main must be replaced for the length of the site, the detailed design and construction requirements of Mackay Water & Waste are attached. The applicant is to demonstrate compliance with these requirements at the time of lodgement of Operational Works application.
23. Sewer Disconnection The existing house drain must be disconnected. A Sewer Disconnection form is
to be submitted to Mackay Water with the appropriate fees for approval. 24. Sewers Policy All building work is to comply with Council’s Policy MW02 – “Building Over and
Adjacent to Sewers”. 25. Landscape Plan Required
A detailed site and footpath landscaping plan must be prepared by a qualified Landscape Designer and must be submitted with Operational Works Approval application. The plan must show for all areas identified on the approved plan of development the following:
Landscape specification of sufficient detail so that landscape works are to be carried out;
Plant schedule detailing number of plants, species, pot size and height at planting;
Details of soil and mulch types, including depths, areas or turf, garden edges and paving finishes;
the details of the irrigation system; and details of the footpath materials, street furniture and street trees (should
be generally in accordance with Council’s Standards for CBD Footpath Treatment and Tree Planting (copies attached)).
Any proposed landscaped works within Council’s Road Reserve must comply with Planning Scheme Policy No.11 – Landscaping.

26. Maintenance for Landscaping within Road Reserve
All landscaping works undertaken within Council’s Road Reserve must be maintained for a 12 month period. An inspection of the landscaping works will be undertaken at this time to determine if landscaping works are acceptable to Council. If the works are acceptable then the landscaping works are to handed over to Council. If the landscape works completed is unsatisfactory then the maintenance period will be extended.
27. Completion of Landscaping
All of the landscaping works shown on the approved plan must be completed before the commencement of the use on the site.
28. Waste Storage Area
The waste storage area must be provided in the location shown on the approved plan and must comply with the following;
a) contain an impervious surface a) contain sufficient storage space for the storage of four 1,100 litre flat lid
commercial bins; and b) be screened from view from Carlyle Street.
29. Deleted 30. No Nuisance to adjoining properties
All service equipment, lightning and air-conditioning units shall be located so as not to cause a nuisance to neighbouring properties.
31. Screening of Storage / Service Area
The storage of any equipment or material and any service area shall be aesthetically screened so as not to be visible from Carlyle Street.

32. Awning Required
An awning must be provided in Carlyle Street for the full frontage of the subject site (excluding driveway). The awning must comply with the following: continuous weather protection for pedestrians (continuos lining or soffit); is setback at least 300mm from the kerb at a minimum height of 3 metres
above the kerb but not higher than the floor level of the first floor; is constructed of non-combustible materials (except timber battens for
fixing linings); is impervious to water and drained to avoid water dropping onto the
footpath; has a fascia depth of not more than 600mm; and is of a cantilever design or has non-load bearing ornamental posts or
columns. 33. Screening
Screening must be provided on the balconies on the western elevation. The design of the screening must be approved by the Manager, Development Assessment – Planning prior to the issuing of the Building Approval.
34. Minimum Car Parking Spaces
The car parking area must be constructed, sealed, linemarked and drained for a minimum of 80 car parking spaces in accordance with the approved plan and maintained thereafter. The carparking is to be designed in accordance with Australian Standard AS/NZS2890.1 : 2004 and 2890.6 : 2009. Grade transitions along the ramp are to be verified using ground clearance templates (refer Section 2.5.3 (e) and Appendix C of AS/NZS 2890.1). Vehicle turn path diagrams are to be provided to verify compliance with Section 2.5.2 (c) of AS/NZS 2890.1 (Intersection Areas). Particular attention is to be paid to the entry/exit from the entry ramp to the first aisle of the basement carparks.
35. On-Street Car Parking
Redundant driveways must be removed and kerb and channel reinstated to match adjoining sections. A plan detailing new on-street car park linemarking which details the amendments to the existing car parking arrangement is to be submitted with the Operational Works application.

37. Parking Signs
A sign/s to the satisfaction of the Council must be provided directing drivers to the area(s) set aside for car parking and must be located and maintained to the satisfaction of the Council. The area of each sign must not exceed 0.3 m².
38. Loading / unloading
The loading and unloading of vehicles and the delivery of goods to and from the premises must at all times be undertaken entirely within the site and be so conducted as to cause minimum interference with other vehicular traffic.
39. Use of Carparking areas
The areas set aside for parking, vehicle manoeuvring and loading and unloading, must not be used for the storage or placement of goods or materials.
40. Lighting of Carpark areas
Install and maintain a suitable system of lighting to illuminate car parking areas. The car park lighting system and any other outdoor lighting, must comply with Australian Standard no. AS4282 – Control of the obtrusive Effects of Outdoor lighting.
41. Building Height
The ceiling of the uppermost habitable level must not exceed a height of 33.25m AHD.
42. Floor Level
The minimum habitable floor level of the proposed development must be RL 5.95m AHD as shown on the approved Ground/Site Plan (Drawing No. SK12, Issue P7) prepared by Loucas Zahos Architects (attached).
The minimum level at the crest of the carpark entry ramp is to be RL 5.4m AHD.
43. Demolish Remove Existing Structure(s)
All existing building/s currently situated on the subject site must be demolished or removed from the subject site prior to the commencement of the use. A Building approval is required for demolition and should be issued by a Private Building Certifier.
44. Waste Storage Area
The location and design of the waste storage area must be located so as not to cause a nuisance to neighbouring properties in accordance with the relevant provisions of the Environmental Protection Act and Regulations.

45. General Amenity Provision

46. Acid Sulphate Soils
The proposed works and development trigger the application and implementation of SPP 2/02 Planning and Managing Development in Acid Sulphate Soils. A site Based Acid Sulphate Soil Management Plan must be prepared by a suitably qualified professional and submitted to Council for approval at the time of submission of the Operational Works application.
ASSESSMENT MANAGER’S ADVICE 1. Local laws
The approved development must also comply with Council’s Local Laws under the Local Government Act 1993 from time and other controls.
2. Hours of Work
It is the applicant/owner’s responsibility to ensure compliance with Section 6W of the Environmental Protection Regulation 1998, which prohibits any construction, building and earthworks activities likely to cause nuisance noise (including the entry and departure of heavy vehicles) between the hours of 6:30pm and 6:30am from Monday to Saturday and at all times on Sundays or Public Holidays.
3. Dust Control
It is the applicant/owner’s responsibility to ensure compliance with Part 2A – Environmental Nuisance of the Environmental Protection Regulation 1998 which prohibits unlawful environmental nuisance caused by dust, ash, fumes, light, odour or smoke beyond the boundaries of the property during all stages of the development including earthworks and construction.
4. Sedimentation Control
It is the applicant/owner’s responsibility to ensure compliance with Section 32 of the Environmental Protection (Water) Policy 1997 to prevent soil erosion and contamination of the stormwater drainage system and waterways.

5. Noise during Construction and Noise in General It is the applicant/owner’s responsibility to ensure compliance with Section 6S
General Emission Criteria and Section 6T Noise Emission Criteria of the Environmental Protection Regulation 1998.
6. General Safety of Public during Construction It is the principal contractor’s responsibility to ensure compliance with Section
31 of the Workplace Health and Safety Act 1995. Section 31(1)(c) states that the principal contractor is obliged on a construction workplace to ensure that work activities at the workplace are safe and without risk of injury or illness to members of the public at or near the workplace.
It is the responsibility of the person in control of the workplace to ensure
compliance with Section 30 of the Workplace Health and Safety Act 1995. Section 31(1) (c) states that the person in control of the workplace is obliged to ensure there is appropriate, safe access to and from the workplace for persons other than the person’s workers.
7. Contaminated Land
It is strictly the applicant/owner’s responsibility to source information regarding contaminated land from the Department of Environment and Resource Management, Contaminated Land Section as Council has not conducted detailed studies and does not hold detailed information pertaining to contaminated land.

Mackay Water requirements for construction adjacent to sewer main – DA-2007-515/B Prior to approval, Mackay Water and Waste require proof that the following conditions have been met, both physically and materially. 1) A CCTV condition report of sewer line 25 from MH 1/12 to MH 2/12 (undertaken at the developers expense) is to be conducted at the completion of piling to confirm the condition of the new sewer main after piling works. 2) A new manhole is to be constructed 2.0m from the southern boundary of the development. Between this new manhole and the existing downstream manhole a new 225mm dia main is to be 3) The existing rear allotment property connections are to connect to the new main with uPVC pipe and fittings at the developers’ expense. Reconnection of the 100mm dia house drains to the new sewer points must be undertaken at the developers’ expense. The existing sewer and property house drains are to remain operational at all times during construction, provide a method statement detailing how this will be achieved to Mackay Water and Waste. 4) The dwelling house at 54 Carlyle Street is to have the existing house drain diverted and connected to the new manhole at developers expense. 5) Show the connection point for the approved development. 6) Any DICL pipe penetrating the building walls for any reason shall have a flexible fitting placed inside and outside the penetration. 7) The developer is responsible for the sealing of all the penetrations into the building. 8) Show in detail all penetrations in “for approval and construction drawings”. 9) All waste fittings below the invert of the main are to be DICL or suitably protected to ensure damage cannot occur. 10) The developer is required to obtain written permission to enter other properties to undertake any construction work. 11) Civil construction works carried out within the building site that may affect the integrity of the sewer shall include a method statement showing how this will be mitigated. 12) A Building Over and Adjacent to Sewer indemnity form signed and supplied to Council at the completion of the sewer main construction. 13) Indemnify Council with respect to all damage claims resulting from failure of the works. Note. The developer is to be aware that the sewer main can operate in a surcharged condition during wet weather and failure to maintain the integrity of the line will result in a spill. Direct connection to the sewer main of fixtures below RL 3.000 is not permitted. This is to protect against backup during surcharge conditions.

Sustainable Planning Act Appeals Chapter 7 Part 1 Planning and Environment Court:
Division 8 – Appeals to court relating to development applications 1) An applicant for a development application may appeal to the court against any of the following - (a) the refusal, or the refusal in part, of the development application; (b) any condition of a development approval, another matter stated in a development approval and the identification or inclusion of a code under section 242; (c) the decision to give a preliminary approval when a development permit was applied for; (d) the length of a period mentioned in section 341; (e) a deemed refusal of the development application. (2) An appeal under subsection (1)(a), (b), (c), or (d) must be started within 20 business days (the applicant’s appeal period) after- (a) if a decision notice or negotiated decision notice is given-the day the decision notice or negotiated decision notice is given to the applicant; or (b) otherwise-the day a decision notice was required to be given to the applicant.
462 Appeals by submitters - General (1) A submitter for a development application may appeal to the court only against- (a) the part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) the part of the approval relating to the assessment manager’s decision under section 327 (2) To the extent an appeal may be made under subsection (1), the appeal may be against 1 or more of the following- (a) the giving of a development approval; (b) any provision of the approval including- (i) a condition of, or lack of condition for, the approval; or (ii)the length of a period mentioned in section 341 for the approval. (3) However, a submitter may not appeal if the submitter- (a) withdraws the submission before the application is decided; or (b) has given the assessment manager a notice under section 339(1)(b)(ii) (4) The appeal must be started within 20 business days (the submitter’s appeal period) after the decision notice or negotiated decision notice is given to the submitter.
463 Additional and extended appeal rights for submitters for particular development applications (1) This section applies to a development application to which chapter 9, part 7 applies. (2) A submitter of a properly made submission for the application may appeal to the court about a referral agency’s response made by a prescribed concurrence agency for the application. (3) However, the submitter may only appeal against a referral agency’s response to the extent it relates to- (a) if the prescribed concurrence agency is the chief executive (fisheries)-development that is- (i)a material change of use of premises for aquaculture; or (ii)operational work that is the removal, damage or destruction of a marine plant. (4) Despite section 462(1), the submitter may appeal against the following matters for the application even if the matters relate to code assessment- (a) a decision about a matter mentioned in section 462(2) if it is a decision of the chief executive (fisheries); (b) a referral agency’s response mentioned in subsection (2)
464 Appeals by advice agency submitters (1) Subsection (2) applies if an advice agency, in its response for an application, told the assessment manager to treat the response as a properly made submission. (2) The advice agency may, within the limits of its jurisdiction, appeal to the court about- (a) any part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) any part of the approval relating to the assessment manager’s decision under section 327. (3) The appeal must be started within 20 business days after the day the decision notice or negotiated decision notice is given to the advice agency as a submitter. (4) However, if the advice agency has given the assessment manager a notice under section 339(1)(b)(ii), the advice agency may not appeal the decision.

Chapter 7 Appeals, offences and enforcement – Part 1 Planning and Environment Court – Division 10 Appeals to court about other matters Section 478 Appeals about particular charges for infrastructure (1) This section applies to a person who has been given, and is dissatisfied with—
(a) an infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges notice or regulated State infrastructure charges notice; or
(a) a negotiated infrastructure charges notice, negotiated regulated infrastructure charges notice, negotiated adopted infrastructure charges notice or negotiated regulated State infrastructure charges notice
(2) The person may appeal to the court against the notice. (3) An appeal against a notice mentioned in subsection (1) must be started within 20 business days after the day the notice is given
to the person. (4) An appeal under this section may only be about—
(a) whether a charge in the notice is so unreasonable that no reasonable relevant local government, State infrastructure provider or coordinating agency could have imposed it; or
(b) an error in the calculation of the charge. (5) To remove any doubt, it is declared that an appeal under this section can not be about the methodology used to establish an
adopted infrastructure charge or the charge in a relevant infrastructure charges schedule, regulated infrastructure charges schedule or regulated State infrastructure charges schedule.
Chapter 7 Appeals, offences and enforcement – Part 2 Building & development dispute resolution committees - Division 7 Appeals about particular charges 535 Appeals about charges for infrastructure (1) This section applies to a person who—
(a) has been given— (i) an infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges notice or
regulated State infrastructure charges notice; or (ii) a negotiated infrastructure charges notice, negotiated regulated infrastructure charges notice, negotiated adopted
infrastructure charges notice or negotiated regulated State infrastructure charges notice; and (b) is dissatisfied with the calculation of a charge in the notice.
(2) The person may appeal to a building and development committee about an error in the calculation of the charge. (3) An appeal about a notice mentioned in subsection (1)(a) must be started within 20 business days after the day the notice is given
to the person. (4) To remove any doubt, it is declared that an appeal under this section can not be about the methodology used to establish an
adopted infrastructure charge or the charge in a relevant infrastructure charges schedule, regulated infrastructure charges schedule or regulated State infrastructure charges schedule.
Chapter 8 Infrastructure – Part 4 Changing notices 675 Definition for pt 4 In this part – relevant appeal period, for a person who has been given an infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges notice or regulated State infrastructure charges notice, means the period within which the person may appeal against the notice to the court or a building and development committee under section 478 or 535. 676 Application of pt 4 This part applies to a person who has been given an infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges notice or regulated State infrastructure charges notice only during the person’s relevant appeal period. 677 Representations about notice The person may make representations about the notice to the entity that gave the notice. 678 Consideration of representations The entity that gave the infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges notice or regulated State infrastructure charges notice must consider any representations made to the entity under section 677. 679 Decision about representations (1) If the entity agrees with any of the representations, the entity must give to the person—
(a) for representations about an infrastructure charges notice—a new infrastructure charges notice (the negotiated infrastructure charges notice); or
(b) for representations about a regulated infrastructure charges notice—a new regulated infrastructure charges notice (the negotiated regulated infrastructure charges notice); or
(c) for representations about an adopted infrastructure charges notice—a new adopted infrastructure charges notice (the negotiated adopted infrastructure charges notice); or
(d) for representations about a regulated State infrastructure charges notice—a new regulated State infrastructure charges notice (the negotiated regulated State infrastructure charges notice).
(2) The entity may give only 1 negotiated infrastructure charges notice, negotiated regulated infrastructure charges notice, negotiated adopted infrastructure charges notice or negotiated regulated State infrastructure charges notice.
(3) The negotiated infrastructure charges notice, negotiated regulated infrastructure charges notice, negotiated adopted infrastructure charges notice or negotiated regulated State infrastructure charges notice— (a) must be given within 5 business days after the day the entity agrees with the representations; and (b) must be in the same form as the notice previously given; and (c) must state the nature of the changes; and (d) replaces the notice previously given.
(4) If the entity does not agree with any of the representations, the entity must, within 5 business days after the day the entity decides not to agree with any of the representations, give a written notice to the person stating the decision about the representations.
680 Suspension of relevant appeal period (1) If the person given the infrastructure charges notice, regulated infrastructure charges notice, adopted infrastructure charges
notice or regulated State infrastructure charges notice needs more time to make the written representations, the person may, by written notice given to the entity that gave the notice, suspend the person’s relevant appeal period.
(2) The person may act under subsection (1) only once. (3) If the written representations are not made within 20 business days after the day written notice was given to the entity, the
balance of the person’s relevant appeal period restarts. (4) If the written representations are made within 20 business days after the day written notice was given to the entity—
(a) if the person gives the entity a notice withdrawing the notice under subsection (1)—the balance of the person’s relevant appeal period restarts the day after the entity receives the notice of withdrawal; or
(b) if the entity gives the person a notice under section 679(4)—the balance of the person’s relevant appeal period restarts the day after the person receives the notice; or
(c) if the entity gives the person a negotiated infrastructure charges notice, negotiated regulated infrastructure charges notice, negotiated adopted infrastructure charges notice or negotiated regulated State infrastructure charges notice (the negotiated notice)—the person’s relevant appeal period starts again the day after the person receives the negotiated notice.
