3.1.1. Orange Shirt Day - Around the District Jerome Beauchamp, Director of Instruction (Education Services) outlined activities that would be happening on September 30th in recognition of Orange Shirt Day.

3.2. Scheduled Delegations 3.2.1. Ivor D. Myers - School Naming

Ivor Myers addressed the Board regarding the changing of the name of Columneetza Secondary School. Heather McKenzie also spoke to the issue. Both were dismayed at losing the name of Columneetza and the historical First Nation significance. Trustee Boehm gave notice of motion that at the next meeting of the Board of Education she would make a motion, "THAT the Board of Education revisit the naming of the Lake City Secondary School campus names of Carson and Western."

Williams Lake Studio Theatre - Alcohol Exemption O2013.09.24-05: It was duly moved and seconded: THAT the Board of Education override the provisions in its policy 3513 Community Use of School Facilities regarding alcohol being served in school buildings, and allow Williams Lake Studio Theatre to serve alcohol and waive the liquor surcharge fee, while the Theatre group is the sole

leasing occupant of the closed Glendale School and as long as the School District does not occupy any other portion of the school.

4.3. Learning Improvement Fund The Assistant Superintendent of Schools presented this year's allocation of the Learning Improvement Fund. O2013.09.24-06: It was duly moved and seconded: THAT the Board of Education receive the Learning Improvement Fund spending plan and that it be submitted to the Ministry of Education by 31 October 2013.

4.4. Audited Financial Statements O2013.09.24-07: It was duly moved and seconded: THAT the Board of Education receive the 2012-2013 Audited Financial Statements and submit the Statements to the Ministry of Education, as presented.

4.5. Unexpended Aboriginal Education Amount O2013.09.24-08: It was duly moved and seconded: THAT the Board of Education write to the Minister of Education and request permission to under spend the District's 2012-2013 targeted Aboriginal education funding in the amount of $74,214.00 as per section 106.4(2) of the School Act.

4.6. Committee Appointments O2013.09.24-09: It was duly moved and seconded: THAT the Board of Education, on the recommendation of the Board Chair, approve the appointment of trustees to Board Committees as follows:

Education Committee: Trustee Boehm, Committee Chair; Trustee Austin; and Trustee Pettman;

Business Committee: Trustee Guenther, Committee Chair; Trustee Neufeld; and Trustee VanOsch.

4.7. District Parent Advisory Committee O2013.09.24-12: It was duly moved and seconded: THAT the Board of Education write to all SD27 Parent Advisory Councils letting them know that the Board values the work of PACs and the DPAC and that input from parents on Board Committees is invaluable and that the Board will assist in any way possible to help PACs form a working DPAC.

4.8. Meetings with Other Elected Officials Trustees requested that District Staff confirm with the City of Williams Lake a meeting with the Board for either Wednesday November 6 or 27, 2013. Trustees also requested a further invitation be extended to other local elected officials requesting a meeting with the Board (District of 100 Mile House, Cariboo Regional District, MLA's, First Nation Chiefs).

5. Discussion Items 5.1. Upcoming Meetings and Conferences

5.1.1. Orange Shirt Day - September 30

The Board acknowledged that Orange Shirt Day - Every Child Matters, is recognized on 30 September 2013.

5.1.2. Northern Interior Branch Meeting: October 4/5 Quesnel Trustees attending the NIB in Quesnel October 4 and 5, 2013: Trustees Guenther, Cooper, Austin and Superintendent and Secretary Treasurer.

5.1.3. Meeting Dates for Planning Session The Board called a Planning Session for October 1, 6:00 pm, immediately following the Education Committee.

5.1.4. Calendar of Events - October 2013 The Board of Education reviewed the schedule of upcoming meetings and conferences.

6.1.1. Superintendent of Schools The Superintendent of Schools provided an enrolment update: 100-150 decline from last - but is better than what was predicted. Rural schools appear to be declining quicker than predicted. Trustees would like to tour Secondary schools during school time.

6.2. Outstanding Motions and Directions The Board of Education reviewed the list of outstanding motions and directions. Trustee Boehm requested that the topic of Student Trustee be placed on the next Board agenda.

6.3.3. First Nations Education Committee Trustee Guenther provided an update from the FNEC. Trustee Guenther advised that FNEC was in the initial stages of considering a student voice on FNEC. Trustee Guenther was asked to advise if it was necessary to change the Board's policy to add students (such as the role models) as non voting members.

6.4. Board Liaison Committee Reports

6.4.1. BCSTA Provincial Council Trustee Guenther advised that the BCSTA Provincial Council will meet at the end of October.

6.4.2. BCPSEA Trustee Boehm advised that she would be attending October 24-25 BCPSEA meetings.

Dear Board of Directors, School District #27

We are currently in the middle of another year of our Grade 6 Fall

Education program at the Gavin Lake Education Centre. We anticipate

bringing another 29 classes from 100 Mile, Williams Lake and Quesnel

areas this year.

There have been a number of changes to our program this year

including a camping 101 course to encourage an outdoor lifestyle as

well as a “Wetlands” module that teaches the importance of wetlands

as water reserves, pollution filters and wildlife habitats. If you would

ever like more details about the school program I would be more than

happy to make a presentation to your Board sometime.

At this point however, I would like to formally request the approval

of a bussing credit of $3500 for the program from School District #27.

Gavin Lake Forest Education Society is committed to keeping this

program free and therefore accessible to all classes and students

regardless of their financial situations. Every bit of help we get with our

fundraising is much appreciated and goes directly towards a better

experience for our students.

PERFORMANCE REWVIEW OF THE SUPERINTENDENT OF SCHOOLS

Policy No. 4117

DRAFT: 15 October 2013 Effective: October 2006

Initial Adoption: January 1991 Preamble The Superintendent is the Chief Executive Officer of the Board of Education.

Therefore, it is critical that there bea regular, thorough performance review process which involves input from a variety of stakeholders.

Policy The Superintendent of Schools will be evaluated by the Board of Education

through a performance review. This performance review must include a process of self evaluation an evaluation by the Board, and the provision of a reasonable amount of time to address any concerns that result from the performance review.

Regulations 1. A formal performance review shall take place either: a. in the first year of the Superintendent’s contract and every second

year thereafter; b. at the discretion of the Board with a 2/3 majority vote of the Board;

or c. as per the individual contract of the Superintendent. 2. The performance review shall be based on: a. A written set of goals and objectives developed by the Board in

consultation with the Superintendent b. The criteria used to hire the Superintendent 3. As part of the performance review, the Board and Superintendent will

agree upon how input will be received from a variety of stakeholders including, but not limited to, the Board, district staff, and principals and vice principals.

4. Board consensus regarding the performance review findings shall be put

in writing, signed by the Board Chair and provided in draft form to the Superintendent.

5. Indications by the Board of any performance areas that are deficient or in

need of improvement shall include discussion on how improvement might be made.

6. The Superintendent shall be provided with an opportunity to discuss a

draft performance review summary with the Board prior to finalization. 7. The written final performance review shall be discussed with the

Superintendent by the Chair, and subsequently discussed in a closed meeting attended by only the Trustees and the Superintendent if desired by the Superintendent or the Board.

8. All performance review meetings and documents will be considered

confidential. 9. No later than one month following receipt of the final written performance

review report by the Board, the Superintendent will provide in writing to the Board, in a closed session, activities planned to correct any deficiencies noted (if any) or improvement recommended by the Board, as well as a description of those factors which may limit improvements.

COMMUNITY USE OF SCHOOL DISTRICT FACILITIES

Policy No. 3513

DRAFT: 03 October 2013 Effective: October 2008 Initial Adoption: February 1984

Preamble The Board of Education develops school facilities and grounds primarily for

student use. It recognizes that use of school facilities by the community may provide additional opportunities and activities for students. Because of these mutual benefits, the Board believes in joint use arrangements with communities. It believes, also, that any joint-use arrangement should not put the district in competition with private business and other organizations in providing facilities for commercial and private users. In arranging joint-use and community rental agreements the Board recognizes the value of community involvement for students and acknowledges the many community groups who donate money and equipment to schools.

Policy The Board believes in joint use arrangements with communities. It

believes, also, that any joint-use arrangement should not put the district in competition with private business and other organizations in providing facilities for commercial and private users. In arranging joint-use and community rental agreements the Board recognizes the value of community involvement for students and acknowledges the many community groups who donate money and equipment to schools. Subject to the availability of facilities for educational purposes, the Board of Education will make school facilities available for public use on a basis that provides priority to youth activities or other activities that give support to activities that enhance community needs and services.

Regulations A. GENERAL 1. Persons or organizations renting or using school facilities must

comply with all Municipal Fire Regulations and Bylaws; seating capacity; exit and fire lane clearance; and parking regulation.

2. By law, Ssmoking is not permitted in or on any School District property, at any time.

3. All vandalism must be reported to the School District employee on duty or to the police immediately.

4. All facilities are to be rented “as is”; the renter must accept the said facilities at his/herthe renter’s own risk. Persons or organizations renting/leasing school facilities shall agree to hold the Board blameless from any and all liability resulting from bodily injury or

damage to personal property by signing a Waiver of Liability in the form of the Rental Agreement. A tenant must agree to maintain at its own expense public liability insurance in such amount and upon such terms and in such companies as may be reasonably satisfactory to the Board, insuring against claims for personal injury, death, or property damage occurring upon, in or about the rented premises. Upon request tenants must provide the Board with a copy of any and all insurance policies. The renter will be held responsible for any damage whether to persons or to property including the exterior of all school buildings, grounds, fields and fences.

5. No alcoholic beverages shall be brought to or consumed in or on school buildings/grounds, without the prior approval of the Superintendent of Schools or delegate. Requests for such approval must be in writing and provide the following assurances:

a. That the group submitting the request shall restrict attendance to the proposed function in accordance with a temporary liquor license permit.

b. The Superintendent or delegate must be satisfied that there has been adequate planning for control of the function.

Any group failing to comply with the foregoing requirements, or being deemed guilty of any misuse of Board permission, shall be refused further use of school buildings/grounds.

6. A principal may designate a responsible employee of the District to

be responsible for security and clean up for community functions where liquor is NOT served. Custodians shall have the right to deny access to any individual or group not presenting a completed and approved rental agreement.

7. The principal, vice-principal, or any member of the custodial staff on

duty are fully empowered to act as the Board’s representatives in directing the conduct of a rental to ensure that regulations are followed and that no damage is done to Board property.

8. All groups using school facilities or playing fields shall provide

adequate adult supervision to be responsible for the admission, actions and behaviour of all participants and/or spectators. It is the responsibility of the supervisor(s) to confine participants and spectators to the area indicated on the rental agreement. The Board reserves the right to evaluate supervision. The supervisor must:

a. Make himself/herself known to the custodian on duty in the building, if applicable.

b. Enforce all Board regulations concerning the use of school facilities and playfields.

c. Supervise entrance and adjacent area to prevent unauthorized

persons from entering the building. d. Limit activities and participants to the area assigned to the

group. e. Ensure that specified days and times are adhered to as stated

on the Rental Agreement. 9. The Board will require the attendance of a custodian to assist any

group in carrying out the above conditions when renting school buildings. The cost of the custodian’s time will be added to the rental charge, if outside the normal custodial hours. Custodial staff may or may not be on duty during a rental of school fields.

10. Persons attending any function in a school must obey all reasonable

directions of the School Board employee in charge of the school building. Profane or insulting language shall not be permitted.

11. The use of any school equipment will be at the discretion of the

principal of that school, who may specify equipment used, and an operator where applicable. The school may charge the user for the use of the equipment separately from the Rental Agreement and at their discretion.

12. Persons or organizations renting school facilities are to ensure all

requirements such as bleachers, chairs, etc. are specified when requesting a booking.

13. The time allotment indicated on the permit will include setting up

time, changing, showering, and taking down/dismantling time. 14. The Board reserves the right to cancel or revoke any permit at any

time with or without cause and no claim may be made against the Board for damages or reimbursement on account of any loss, damage or expense except for rental fees already paid. In the case of a labour dispute, strike, or lockout resulting in the closure of schools, all rentals will be suspended.

15. The Board is not responsible for any property left or lost on school

premises. 16. The holding of games of chance, including lotteries, raffles or bingos

on School Board premises is permissible, subject to the applicable persons or organization obtaining the appropriate permits and copies of said permits are attached to the Rental Agreement upon application to use the school premises.

17. No connection to electrical panels will be permitted without prior

authorization from the School District Supervisor of Facilities and

Transportation. The permit holder will incur all costs. All requests for electrical connections must be made at the time of the permit request for use of facilities. No alterations, installations or fastening shall be permitted on any building. Any damages will be assessed to the client, repaired to District standards at District labour rates and billed to the client.

18. The Board reserves the right to restrict the use of any school facility

or field due to weather conditions or required maintenance agreements.

19. Vehicles are NOT allowed on playfields at any time. 20. Any District employee who makes application to use District facilities

for private purposes must follow normal procedures for access to facilities and shall be subject to normal rental rates. No employee may volunteer services for an individual or organization using the facilities where it would contravene any part of these regulations.

21. Telephone service will not be made available to parties using

facilities, except where a payphone is already provided. 22. When an event necessitates overtime duty by a School District

employee, the rate charged will be in accordance with the salary schedule in effect at that time. No direct payment to School District personnel is to be made by the persons or organization renting the facilities.

23. No advertising for commercial purposes may be done through the

school nor can advertising be attached to the outside of the school unless expressly approved by the Principal. All proceeds resulting from such advertising must go directly to a School Fund.

24. Keys to any School District facility will only be issued to members of

the community at the discretion of the Manager of Facilities and Transportation or designate, and with receipt of a key deposit in advance.

25. In facilities where an intruder alarm system is installed, it is the

responsibility of the renter to assure upon entering or leaving the building that the District employee in charge is made aware. Any costs incurred by the District for security call outs due to the renter group activating an alarm will be billed to the user group at cost.

26. Janitorial supplies and equipment will not be made available to

renters;, however, renters may, if they wish, assist custodial staff members following a rental in removing tables, chairs, equipment

and garbage in order to keep their costs down., but iIn NO CASE may a renter do actual cleaning. Such work MUST must be done ONLY only by School District #No. 27 custodial staff. Where a renter requires custodial staff to set up and/or take down tables and chairs the renter make this request upon application for the rental and will be billed the applicable rate for the custodial time.

B. USE OF PLAYING FIELDS School playing fields are open for use by the community at times other

than those required by Schools; the District; or joint use and community use agreement holders. Priority will be given to organized groups and the Board has the right to restrict the type of game or activity.

1. Applications for the use of school playing fields, together with schedules if applicable, should be made to the booking clerk no later than 1 one calendar month prior to the beginning of the scheduled function.

2. No rental fee will be charged but costs for any damage to fields will

be invoiced to the user group as indicated on the rental agreement. 3. Because of the potential danger to children and adults, and the

possible damage to school buildings, golf shall not be permitted on any school playing fields.

4. The Board shall not grant permission to anyone wishing to use

School school playing fields or lawns for the grazing and/or housing of livestock, except as required for school agricultural programs or other educational uses.

5. Use of playing fields or parking lots as campsites for overnight

accommodation shall not be permitted. 6. When field conditions are inferior, the Manager of Facilities and

Transportation or the Grounds Lead Hand, on behalf of the Board, shall reserve the right to cancel all activities by closure of any or all fields. Only prepaid rental charges will be reimbursed.

7. Unless prior arrangements have been made, users are not permitted

inside the school buildings for any purpose. Field users are strictly prohibited from urinating or defecating on school grounds. Rental agreements will be revoked immediately.

8. Field users are welcome to have on-site portable toilets from

commercial providers and maintained at their own expense. The School District will be required to approve the location of such portable toilets.

FEES Specific information relating to daycare and child care programs is provided under Policy 3515 Child Care Providers. All user groups require a copy of the Rental AgreementApplication for Use or Rental of School Facilities and Playing Fields from the School District;. District employees may ask to see the agreement Agreement prior to allowing entry into the facility. All bookings shall be made through the Booking Clerk at the Administration Offices, 350 North 2nd Avenue, Williams Lake, BC V2G 1Z9, in accordance with the following procedures:

1. With the exception of Daycare/After School Care programs and Election Polls, school facilities shall be available to responsible organized groups after 5:00 pm on regular school days. Not in session days and weekends will be at the discretion of the Secretary Treasurer or designate. Facilities must be vacated by 11:00 pm on regular school days and 2:00 am on weekends. Any extensions of these times will only be approved by the Secretary Treasurer under very exceptional circumstances.

2. School principals shall indicate to the Booking Clerk, by June 30 of

each year, the nights the school or field is to be reserved for K-12 school educational activities during the following school year. Other times throughout the year may be requested no later than 15 calendar days prior to event and will only be approved if other users can be accommodated elsewhere.

3. Joint Use ;and Community Use Agreement holders and

Daycare/After School Care providers shall have first claim on all facilities not reserved for K-12 school use in accordance with paragraphs 1 and 2 above, and subject to existing contracts with other community groups. Once they have liberated their historical need, it will revert to Joint Use for first right of refusal.

4. Private Daycare/After School Care providers may operate within

School District facilities provided that: a. The daycare has been licensed by the Ministry of Health; b. Proof is provided to the Board that appropriate insurance

coverage is in place; c. Persons operating the daycare or the people who are hired to

assist them can produce an approved criminal record check satisfactory to the Board and Ministry of Health upon request by the Board;

d. Operation of the daycare is subject to review by the Board for any reason, and permission to operate the daycare may be withdrawn with 30 days notice given by the Board;

principal; and g. The daycare/after school care program and operator have the

express approval of the Principal. 5. Prior to June 30th of each year, Joint Use and Community Use

Agreement holders shall advise the Booking Clerk of the facilities required to offer their Community Service program for the following school year. Other times throughout the year may be requested no later than 15 calendar days prior to event and will only be approved if other users can be accommodated elsewhere.

6. Schools shall be available for use by physical education groups,

other municipal recreation groups or other community groups, only after the needs of the school district, including the day schools and the Joint Use and Community Use Agreement holders, have been satisfied in accordance with paragraphs 1, 2, and 3 and 4 above. All bookings must be made 15 calendar days prior to the function.

D. RENTAL RATES AND/OR USER FEES 1. ALL fees and/or deposits must be made no less than 5 days in

advance of the function. 2. A Cancellation fee of $10.00 shall be charged on cancellations of

less than 2 days (48 hours) notice. 3. ALL functions with an expected attendance of 100

participants/visitors or more shall be subject to a $200.00 refundable security deposit. Refunds will be paid within 30 days after the function. If additional costs are incurred over and above those covered in the user or rental fees as determined below, said costs will be deducted from the damage deposit, an accounting of which will be stated upon the payment of said deposit to the user.

4. There will be a LIQUOR alcohol surcharge of $0.50 per person,

based upon the submission of the users liquor permit for ALL all functions where liquor alcohol will be served.

Group A – Schools; District; Joint Use; Community Use; Day or After School

Care Providers There will be NO RENTAL charge for the following activities, provided that

the activity adheres to the time and area stated on the rental agreement. However, as stated above damage deposit and/or custodial fees may be necessary dependent on the size of the function.

1. Schools: a. All co-curricular and extra-curricular use of school space.

by the student council or School and community organizations. 2. Parent Advisory Committee (PAC): All PAC meetings and other

activities including fairs, bazaars, and activities that support the learning outcomes of students, etc.

3. Cariboo-Chilcotin Teachers Association (CCTA): Regular meetings

of the CCTA membership. 4. International Union of Operating Engineers Local 959 (IUOE):

Regular meetings of the IUOE membership. 5. Education: All workshops, meetings and in-service training. 6. Community Use Agreements and not for profit Registered Youth

Groups (proof of Agreement, Not for Profit and Society status is required): All activities for youth 18 years and under.

7. Day & After School Care Providers: On regular school days and Pro-

D days only (see below for summer and Not In Session days) 8. Joint Use Agreements: On regular school and Pro-D days only (see

below for summer and Not In Session days) 9. Playing Fields and Parking Lots Use of Facilities for Not In Session (NIS) Days – Group A

This section is with respect to Day and After School Care providers and the Joint Use Aagreement

a. There will be no rental fee for NIS days. b. There will may be a minimum of 2 hours custodial time charged

for clean up at the end of each weekly session of NIS days in or around November and March, if deemed necessary by the Secretary Treasurer.

Summer Use of Facilities - Group A

This section is with respect to Day and After School Care providers, Joint Use and Community Use agreement holders.

a. All summer users must vacate the premises no later than one week prior to the beginning of the school term.

b. All summer functions are subject to summer custodial and gymnasium floor refinishing schedules.

c. One time use will be at a cost of $35.00. d. Weekly use will be at a cost of $50.00 per week. There may

be custodial time charged for clean up at the end of each weekly session of NIS days in or around November and March,

if deemed necessary by the Secretary Treasurer.Plus an additional fee of a minimum of 2 hours custodial time to be scheduled at the end of August.

Group B – Non Not for Profit Groups (ie: service clubs, churches, non

registeredsocieties groups) Proof of Not for Profit or Society status is required at the time of application.

The following rental rates will be in effect for these groups., cCustodial fees may also be applicable if the function is outside the normal working hours of the custodial staff.

1. One Time or Once per Monthly Use: Classroom $20.00 per use

Cafeteria, Library or Small Gymnasium $30.00 per use Medium Gymnasium $40.00 per use Large Gymnasium $50.00 per use

Group C – Commercial and Private Use (including Political Parties): All commercial or private functions will require custodial staff to be on duty

at all times. Clean up of all functions will be carried out by District custodial staff. Any custodial time outside of their regular working hours will be billed to the user at the current custodial rate.

administrative and utilities costs. Custodial opening and closing fee of $50.00 will be charged for summer rentals. Any additional custodial clean up costs will be billed on a per use basis.

E. OTHER RENTALS 1. Kitchen and Lunchroom Facilities

Except as indicated below, requests for use of kitchen facilities, home economics rooms and kitchen equipment must be made at the time of the rental application.

a. Use of Columneetza Cafeteria kitchen is prohibited without the express consent of the Principal and the Secretary Treasurer.

b. Use of cutlery, dishes, fryers, freezers, grills and other equipment is prohibited.

c. Use of refrigerators and stoves will be granted only with the permission of the principal.

2. Shower Facilities

Shower facilities Mmust be requested at the time of application., aAll shower facilities will be at a rental rate of $10.00 per day plus applicable custodial clean up costs.

3. Dormitory

The dormitory may be rented after the 2nd week of July and must be vacated no less than 2 weeks prior to school re-opening in September. Rates will be determined by the Secretary Treasurer dependant on intended use, number of occupants and any maintenance scheduling.

4. Equipment

The use of any school equipment is at the sole discretion of the

Principal of the school. The Principal, who may specify equipment to be used and an operator where applicable. A rental fee may also be charged and would beis payable directly to the school, not to the Board for said equipment.

5. Other Grounds Use (Not Playing Fields)

This section includes, but is not limited to, parking lots, surfaced courts, breezeways and similar areas. These areas must be requested at the time of application and will be at a fee of $20.00 per use. Use of parking lots as campsites for overnight accommodation shall not be permitted.

BACKGROUNDER

Provincially: Past Ministry of Education philosophy was that schools should be used by the community and daycares free of charge. To this end many Community Schools were identified. Over the past several years, this philosophy has been eroded with the initiation of Neighbourhoods of Learning facilities on a cost neutral basis to boards. The Board of Education, in June 2011, adopted a policy to this effect (Policy 3512 Neighbourhood Learning Centres). Further trends that support the change to the Ministry’s position is the change in School Act legislation that directs boards to promote child care programs in schools and allowing direct and in-direct costs to be charged. In 2010 the Minister’s of Education report on the Vancouver School Board stated:

“Generating more revenue by increasing rental rates. The Vancouver School Board has kept rental rates artificially low to support community and educational groups. The lost revenue through this subsidy would otherwise be available to support the Vancouver School Board’s educational services. Rate increases will need to be gradual to manage the effect on users.”

Locally: Under the phase of Community Schools, many user groups have accessed schools for use: Guides, Scouts, Wrestling Clubs, Karate Instruction, Photography Clubs, Men’s Floor Hockey, Daycares etc. With the revision to the Board’s policy In October 2008, District Staff were charged with bringing user groups into alignment with the Policy. The Policy in itself, can stand on its own. What doesn’t work, is that user groups are still of the opinion the school in a sense belongs to the community and use should be for free. The Board policy states: “The Board of Education develops school facilities and grounds primarily for student use. It recognizes that use of school facilities by the community may provide additional opportunities and activities for students.

“The Board believes in joint use arrangements with communities. It believes, also, that any joint-use arrangement should not put the district in competition with private business and other organizations in providing facilities for commercial and private users. In arranging joint-use and community rental agreements the Board recognizes the value of community involvement for students and acknowledges the many community groups who donate money and equipment to schools. “Subject to the availability of facilities for educational purposes, the Board of Education will make school facilities available for public use on a basis that provides priority to youth activities or other activities that give support to activities that enhance community needs and services.” The Board’s policy sets rates for different groups:

1. Group A: Schools: District: Joint Use: Community Use; Daycare – for youth under 18 (no charge during year; may be charges during summer and NIS days)

2. Group B: Not for Profit Groups: service clubs, churches etc. (nominal charges for daily, weekly use and summer use)

3. Group C: Commercial and Private Use: includes political parties (competitive rates charged on a per use basis.

What the current policy does not differentiate between is those organizations using school facilities for profit (would be Group C) but benefits youth under 18 (would be Group A). Currently Group A is assigned as “community use” and these users use the facility free of charge. Other examples of policy issues examples:

• Drop in floor hockey, badminton, volleyball: have not been assessed Group C

• A birthday party for children; is assessed a Group C activity and is charge a user fee

QUESTIONS:

1. If it is the City’s portfolio to provide community recreation, could some of these user groups be provided for under Joint Use? And liability issues would then fall to the City.

2. What would happen to user groups, in this instance, in rural communities with no Joint Use Agreement?

3. Could user groups apply to PAC’s for sponsorship? Liability would then fall to the District. Could users be asked to provide their own liability?

4. Does the Board want to differentiate between for profit and not for profit users for youth under 18?

5. Could Joe Citizen use space to provide music lessons (his business) to youth under 18; should he have to pay?

6. How does the Board balance what is fair in one community to the other.

COMMUNITY AND COMMERCIAL USE OF FACILITIES AND GROUND – CHILD CARE PROVIDERS

Initial Adoption: Preamble The Board of Education recognizes that our its primary obligation is to provide

school- age educational programs.; hHowever, the Board may permits licensed child care programs to use the following district District assets: vacant school facilities; space within operating schools; and space within temporary portables or modular facilities.

Policy The Board of Education, as per School Act section 8685.1 promotesshall

provide licensed child care providers the use of Board property, ensuring that the usage does not disrupt or otherwise interfere with the provision of educational activities and that revenue obtained is not more thant the direct and indirect costs (overhead) incurred by the Board as a result of making that use available.

Regulations 1.

Definitions: a. Board Property: in relation to a Board, means Board-owned land

or improvements in the Board’s school district that are or have been used, or are intended for use, for educational activities

b. Business day: means any day that is not a Saturday, Sunday or a holiday

c. Care program: has the same meaning as in the Child Care Licensing Regulation, B.C. Reg. 332/2007

d. Educational activities: means the provision of educational programs and includes early learning programs and extracurricular school activities

e. Licensed child care provider: means a person who is licensed under the Community Care and Assisted Living Act to provide one or more of the following care programs:

• Group Child Care (Under 36 Months), being a program that provides care to children who are younger than 36 months old;

• Group Child Care (30 Months to School Age), being a program that provides care to preschool children;

• Preschool (30 Months to School Age), being a program that provides care to preschool children who are at least

i. 30 months old on entrance to the program, and ii. 36 months old by December 31 of the year of

entrance;

• Group Child Care (School Age), being a program that provides, before or after school hours or during periods of school closure, care to children who attend school, including kindergarten;

• Occasional Child Care, being a program that provides, on an occasional or short-term basis, care to preschool children who are at least 18 months old;

• Multi-Age Child Care, being a program that provides, within each group, care to children of various ages.

2. The Board authorizes the Secretary Treasurer to enter into agreements with licensed child care providers only. There are four types of agreements available:

a. License Agreement i. Less than 4 year term ii. 12 month operations iii. Generally vacant school facilities b. Rental Agreement – Full Day i. Annual term ii. 10 month operations iii. Full day use iv. Generally within active school facilities, in consultation with

the principal c. Rental Agreement – Before/After School Care i. Annual term ii. 10 month operations iii. Before and/or after school care – school age students Within active school facilities, in consultation with the principal d. Joint Use Agreement i. Agreement between the Board and any or all of the following:

• City or District

• Regional District

• University or College

2.3. School populations are dynamic and, therefore, it is difficult to accurately assess the short and long-term enrolling space needs in of schools. It is may also be difficult to find alternative accommodation for child care programs in the short term. For these reasons, unused classroom space, in schools should be availableused for licensed child care programs, will be on an annual basis. The greatest care and notice will be given to child care programs if the space becomes necessary by the school.

4. If the needs of the school require the occupied space, as much notice as possible will be given to the child care program provider.

25. Policy 3513 Community Use of School Facilities: Regulations, Section A, applies to all child care program providers. General Regulations as laid

36. Hours of operation must be on business days between the hours of 7 a.m. and 6 p.m.

4. Types of agreements required:

• License Agreement (1-5 years) 12 month operations

• Rental Agreement (Annual) Group child care programs, 10 month operations

All agreements must be agreed to by the Principal and Secretary- Treasurer or designate.

57. Liability and Responsibility:

a. The Board has no legal liability for the operation of the child care program. The operator shall maintain, at its own expense, liability insurance as follows:

i. Comprehensive General Liability insurance (including bodily injury and property damage) on an occurrence basis with respect to the program activities at the site.

ii. The limit of such insurance shall be at least $5,000,000 inclusive per occurrence.

iii. This insurance shall name the Board as an additional insured with respect to liability or damage arising out of the use or occupancy of any Board property by the operator.

iv. It shall include a cross liability clause and tenant’s legal liability insurance in the minimum amount of $2,000,000.

b. A certificate of insurance must be provided to the Secretary Treasurer annually.

c. The school Board has no legal obligation in the area of the supervision or financial matters of the child care program. Responsibility for children who become ill during the day or are not picked up from the child care program in the evening lies with the Licensed Child Care Providerchild care program operator.

68. Rental and License Fees:

a. License Agreement - 12 Month Operation i. Indirect costs, the base rate for fees, will be an annual ratewill

be set and reviewed periodically by the Board. This amount will cover all indirect (overhead) costs. ; tThis fee will be charged on a twelve (12) month annual basis.

ii. Direct costs will be added on an individual basis determined by the Secretary Treasurer or designate. These costs shall include custodial fees and/or utilities and/or equipment fees.

be set and reviewed periodically by the Board. This amount will cover all indirect (overhead) costs. ; tThis fee will be prorated for a 10 month term.

ii. Direct costs will be added on an individual basis authorized by the Secretary Treasurer. These costs shall include custodial fees and/or equipment fees.

c. Rental Agreement – Before/After School Care i. Indirect costs, the base rate for fees, will be an annual rate set

and reviewed periodically by the Board. This amount will cover all indirect (overhead) costs. This rate will be calculated to an hourly rate based on the normal space area used.

ii. Direct costs will be added on an individual basis authorized by the Secretary Treasurer. These costs shall include custodial fees and/or equipment fees.

d. Joint Use Agreement i. Conditions as set out in the Agreement.

9. Any Group Licensed Child Care Provider program operating under a

Rental Agreement, that wishesing to move in to a summer program must first obtain may do so with the express permission of the Principal and Secretary Treasurer or designateSecretary Treasurer. A new rental agreement will be required. Direct costs will be assessed and added to the base rate for use of schools through July and August.

10. Licensed child care providers, within active schools Group child care programs may, at no extra cost, use their school space for full day programs on school Not In Session (NIS) days with the express permission of the Principal. These days are Pro-DNon Instructional dDays; Fall, break; Christmas break,; and Spring breaks.

11. Proof is must be provided to the Board that the child care program has

been licensed by the proper Provincial authority.

13. Persons operating the child care program or the people who are hired to assist them must be able tocan produce an approved criminal record check satisfactory to the Board and the proper licensing authority upon request by the Board, for any child care program provided in an active school.

14. Operation of the child care program is subject to review by the Board for any reason, and permission to operate the child care program may be withdrawn with 30 days notice given by the Board.

16. An Emergency evacuation plan, for child care programs operating in an

active school must be is in place and approved by the principal.

17. Prior to June 30th of each year, child care providers shall advise the Booking ClerkSecretary Treasurer of the facilities required to offer their Community Service the child care program for the following school year. TRUSTEE REMUNERATION and EXPENSES

Policy No. 1161

Initial Adoption: October 2008 Preamble The Board of Education recognizes that the role of a school trustee is that of a

public servant and is not a paid position. However, not all meetings that trustees are required to attend occur outside of normal working hours. This can cause loss of gainful employment to a trustee or cause a trustee not to be employable. The Board of Education does not want this to be a deterrent for any potential candidates to run in a trustee election.

Policy The Board of Education believes trustees should receive remuneration in

recognition of service to the School District in the discharge of their duties. Generally meetings and activities that trustees choose to do in their role as trustee are covered by the stipend, while activities that are required (such as committee and board meetings) may have legitimate expense claims for out of pocket expenses.

Regulations A. Remuneration 1. Pursuant to section 71 of the School Act, the Board shall authorize

annually, remuneration to trustees to include stipend, expenses incurred in the discharge of their duties and travel expense allowance for one regular meeting per month. In recognition of the additional responsibilities of their roles the Chair and Vice Chair of the Board will be allotted a higher annual stipend than that of a regular trustee position.

2. Pursuant to the section 81 of the Income Tax Act the stipend shall be divided into two parts for tax purposes. 2/3 shall be taxable remuneration. 1/3 shall be non-taxable and considered as a non-accountable allowance for expenses incurred in the performance of trustee duties.

3. Stipends shall be paid by electronic funds transfer on a monthly basis, with a mid-month advance.

4. Annual base stipends shall be paid based on the following: a. Chair $16,000 b. Vice Chair $13,500 c. Trustee $12,500 d. Board Committee Chair (no

additional remuneration provided where a trustee is Chair for more than one Board Committee.)

Any trustee, who serves as Acting-Chair on Board Day, in the absence of the Chair and Vice-Chair, shall be compensated.

5. Remuneration for attendance at meetings, other than regular board

meeting days will be as follows: a. Special Board and Board Committee Meetings (including Planning

Sessions and Committee of the Whole meetings) Board Appointed Liaison Committees, Board Appointed Representative Committees:

i. Greater than 4 hours - $120.00 ii. Less than 4 hours - $75.00 b. Where more than one meeting is held on the same day and the

combined duration of the meetings exceeds 4 hours, the meetings are remunerated at the greater than 4 hour rate.

c. Where a trustee leaves a meeting before adjournment, the meeting

shall only be eligible for remuneration at the partial day rate. The Chair may waive this requirement where extenuating circumstances exist. If a trustee will be receiving the lower rate of remuneration pursuant to this clause, the Chair will advise the Secretary Treasurer of the same.

d. Where a trustee attends a meeting by means of electronic

communications, remuneration shall be at the normal rate for that meeting.

e. Remuneration for meetings not listed above must be approved by the

Board. For new committee appointments, the Board will determine remuneration at the time appointments are made.

6. Remuneration will be paid as per A.5.a. to attend the following meetings/conferences:

a. BCSTA Annual General Meeting b. BCSTA Academy c. BCSTA New Trustee Orientation d. BCSTA Provincial Council Meetings e. BCSTA Northern Interior Branch Meetings f. BCPSEA AGM and Required Meetings There will be no remuneration paid for trustees to attend special interest

conferences, unless special recommendation is made by the Board of Education.

7. Remuneration for Travel Time a. Travel time remuneration shall apply to:

Board of Education. ii. Travel by trustees to meetings/events outside the trustee’s

electoral zone authorized by the Board of Education. iii. Travel by trustees outside the trustee’s electoral zone for which

remuneration for attendance is paid.

b. Travel time remuneration is $0.20 per kilometer driven in any one day.

c. Commercial travel remuneration is $20.00 per hour to a maximum of $120.00 per day calculated from the time of departure (usually from home) to the time of arrival at destination, and the reverse for the return trip. For clarity, travel by personal vehicle to the airport is calculated on a per hour basis rather than a per kilometer basis.

8. Time Sheet a. A time sheet for remuneration must be submitted to the Secretary

Treasurer’s office on a monthly basis, on a date to be determined for payroll purposes. Late claims will not be considered.

B. Expenses Trustees will be reimbursed for reasonable expenses incurred while discharging

the duties of office in accordance with rates established in Policy 4133 Employee Travel and the following:

1. a. A travel allowance shall be established and paid with the trustee stipend on a monthly basis equivalent to one round trip kilometrage from the trustee’s home to the Administration Office, located at 350 North 2nd Avenue, Williams Lake, BC, times the current mileage rate as prescribed in Policy 4133 Employee Travel

b. This travel allowance will also be subject to section 81 of the Income Tax Act and shall be 1/3 non-taxable.

c. Payment of the above allowance will be pursuant to trustee attendance at the regular open and/or closed meetings each month.

d. Attendance by telephone or web cast is NOT considered “in attendance” for the purposes of clause B.1.c.

e. Kilometrage will be provided to the Secretary Treasurer immediately after the trustees’ inaugural meeting each term.

2. Transportation Costs a. Whenever practical, trustees are encouraged to travel by the most

direct route and use the most economical means of transportation, taking into consideration the travel time involved as well as associated

ground transportation costs. b. Personal vehicle expenses will be paid on a per kilometer rate set by

Board Policy, for the use of the trustee’s personal vehicle for travel as per the following:

i. It is recognized that electoral areas vary geographically throughout the District. For trustees visiting schools, attending PAC meetings or events in the trustee’s electoral area (limited to once per month) for distances exceeding 30km per round trip, personal vehicle expenses may be claimed. For clarity if the trip from the trustee’s normal residence to a school is 100 km return the calculation would be 100 km – 30km = 70 km claimed.

ii. To attend meetings that remuneration for attendance is paid.

iii. To attend other meetings or conferences as authorized by the

Board of Education.

iv. It is expected that trustees be familiar with all schools in the District. Travel expenses to visit schools outside of trustee’s electoral area will be paid on the basis of one trip to each school within the three-year term. Visiting schools should be limited to a specific purpose and, wherever possible to reduce costs, travel should be coordinated with a staff member or other trustees visiting the school(s).

3. Accommodation Costs a. Trustees shall be reimbursed for the actual cost of commercial

accommodation to attend any approved meeting or conference for which remuneration is paid. Original receipts are required.

b. Trustees who utilize non-commercial facilities for overnight

accommodation will be paid a private accommodation rate as per Board Policy.

4. Meal Expenses a. Expenses for meals will be paid as per Board Policy 4133.

b. Meal expenses may only be claimed for times when a trustee is

attending an activity or meeting were remuneration is paid for attendance. Where meals are provided, no meal expense may be claimed unless extenuating circumstances occur (i.e. food allergies).

5. Other Expenses a. The $6.00 incidental rate for out of District travel (as per Policy 4133,

applies to days in excess of ½ a day.

times when a trustee is attending an activity or meeting where remuneration is paid to attend and immediate family (spouse or older sibling) is not available to tend to child(ren). Original receipts are required.

c. Technological Costs A $50.00 per month expense reimbursement will be given to each trustee to compensate for any extra expenses incurred for technology such as internet and cell phone costs.

i. A school district cell phone is provided to each trustee; therefore phone charges may not be claimed. Personal use, within reason, is allowed. Trustees wishing to forward their school district phone number to their private phone number must inform the Secretary Treasurer and return the district phone. Out of country use of the school district cell phone will be considered on a pre-approved case by case basis.

ii. A laptop computer is provided to each trustee and is to be used for Board business. Personal use, within reason, is allowed. It is expected that trustees have internet access in their normal residence. However, if internet access is not available in their resident area and special satellite equipment is required, the Board will assist in the one-time costs associated with the purchase and installation of such equipment to a maximum of $250.00. Original receipts are required.

d. Expenses for paper, ink, home office equipment etc. is considered part of the tax-free portion of the stipend and should not be claimed.

6. Expense claim forms are to be submitted to the Secretary Treasurer’s office on a monthly basis.

Initial Adoption: August 1984 Preamble The Board recognizes that much of the daily work in a school district is carried out

by a variety of committees. The School Act authorizes the Board to establish committees and to specify the functions and duties of those committees.

Policy The work of committees is valued by the Board of Education and

considered to be a key element in a decision-making process which considers the input of all stakeholder groups. The following regulations are designed to clarify committee roles, jurisdictions and membership.

Regulations 1. The Board shall establish committees and appoint liaison representatives

which are required to expedite the business of the Board, and shall specify the structure on how each committee shall be formed and outline its terms of reference. There are three (3) types of Committees.

a. Standing: This committee type has an advisory role to the Board and is established by the Board. A trustee will be named chair to each of these committees and the committee is the main sources of

information to the Board. These will be known as Board Committees.

b. Liaison and Representative: These committees provide a liaison function and deal with advancing information and processes, which may

facilitate different organizations working more effectively together. Board representatives on these committees will report to a standing committee or directly to the Board.

c. Working Groups/Committees: Committees may be struck from time to time by the standing committees or the Board. They are formed to perform a specific function and may be advisory or reportive in nature. Upon completion of the specific work these committees fold.

2. The Board Chair shall appoint representatives to committees each year

following the inauguration meeting or when Executive Officers of the Board are elected as per the Board’s Procedural Bylaw. The Board Chair is member ex-officio of all Board Committees

3. Board Committee meetings will normally be held on Tuesdays that are not

regular Board meeting days or as agreed to by each Committee. The date, time, and agenda items will be announced prior to the meeting day.

4. Board Committee meeting draft minutes will be included, as information, on

the Board’s next open agenda. 5. All Board Committee meetings are open to the public; however, there may

be items identified as in-camera and for those items, public members will be excused and only board members and officers of the board will remain.

6. No action of any committee of the Board shall be binding on the Board until

Responsibility: 1. To identify, examine/review and advise or recommend to the Board

policies or actions on educational issues pertaining to: a. achievement accountability; b. educational goals and programs; c. student services; d. schools; e. environmental education and impacts; and f. all other matters as referred by the Board 2. To share knowledge regarding research and policy related to public

school education. 3. To establish opportunities for stakeholders to participate in the

discussion of educational issues. 4. To consider the impact on students of major local and provincial

program decisions. 5. Quorum will consist of a majority of named committee members of

which two (2) must be trustees. This meeting is normally open to the public. Voting will be by simple majority of the quorum in attendance at the meeting.

6. Agenda preparation: a. Chair and Superintendent will establish the agenda b. Future agenda recommendations may be identified in

committee. 7. Education committee will normally meet once a month.

8. The Board Committee Chair will assign trustees of the committee the

responsibility of reporting each item back, where necessary, to the Board at its next open meeting. This assignment will be noted in the committee minutes.

policies or actions on business issues pertaining to: a. financial accountability; b. business services; c. long range facilities and capital planning; d. Board bylaws; e. environmental education and impacts; and f. all other matters as referred by the Board 2. To share knowledge regarding research and policy related to the

business administration of public school education. 3. Development of goals, objectives, plans, programs, and control

procedures for all financial matters. Review of operating and capital budgets and the processes for preparing them. Review the financial statements and recommend appointment of auditors.

4. Deal with policy recommendations from the Board, groups or persons according to "Policy Development" guidelines (Board Policy 1120.4). Periodically review policies on a five (5) year rotating basis.

5. To share knowledge regarding research and policy related to

sustainability issues as are applicable to meeting legislative requirements and are seen to be part of a responsible corporate citizen..

6. To establish opportunities for stakeholders to participate in the

discussion of business issues 7. To consider the impact on students of major local and provincial

business decisions. 8. Quorum will consist of a majority of named committee members of

which two (2) must be trustees. This meeting is normally open to the

First Nations Director and Coordinator 10. a non-voting recording secretary General Responsibilities: The First Nations Education Council is established to advise the Board on

all First Nations issues and to work with the Board to allocate First Nations target funding. It is understood that both the Council and the Board must each approve programs and expenditures of funds from the First Nations Target. For all matters requiring informed consent of targeted funding, voting will be restricted to representatives from the Three Nations (Carrier, Chilcotin and Shuswap) and a representative from the Cariboo Chilcotin Métis Association.

Specific Responsibilities: 1. Develop and annually review a First Nations Education Mission

statement. 2. Review delivery of existing programs and make recommendations. 3. Report and highlight accomplishments. 4. Receive and review new proposals for new initiatives and make

recommendations based on criteria. 5. To establish criteria for First Nations funding and program proposals. 6. To set funding and program priorities within the First Nations target

funding. 7. To review other areas of interest to the Council as they affect the

education of First Nations students. 8. To discuss general personnel issues that affect First Nations

students, including First Nations involvement in staffing. 9. To communicate recommendations to Bands and other stakeholders. 10. To review annually the Council membership. 11. Establish sub-committees as needed.

BACKGROUNDER

Motions Previously Made:

O2013.05.28-16: It was duly moved and seconded: THAT the Board of Education name the school campus formally known as Columneetza Secondary School, Columneetza Campus and the school campus formally known as Williams Lake Secondary School, WL Campus.

DEFEATED O2013.05.28-17: It was duly moved and seconded: THAT the Board of Education name the school campus formally known as Columneetza Secondary School, Western Campus and the school campus formally known as Williams Lake Secondary School, Carson Campus.

CARRIED Trustee Boehm opposed

1. Board Procedural Bylaw B2702, 5.c:

No motion other than to postpone consideration of a question, or a procedural motion, shall be repeated during the calendar year except by the reconsideration process.

2. Robert’s Rules: Renew If a motion was made at a previous meeting and the motion failed, the group took no action. Therefore there is nothing to Rescind or Amend Something Previously Adopted. If the group would like to take an action on that issue, Robert’s says that you simply renew the motion. It cannot be made at the same meeting that the original motion failed. Its use may also be restricted by the groups own rules. In SD27 Procedural Bylaw as noted in 1. above applies.

3. Robert’s Rules: Reconsideration Process: The motion to “Reconsider” can be made only by a member who voted on the prevailing side. So if the motion passed, you had to have voted aye on it to move to Reconsider it; if the motion failed, you had to have voted no to move to reconsider it. The whole idea is that at least one person in the group has to have changed his or her mind before the entire group should have to go back and consider this motion again. The motion to Reconsider can be made only on the day that the original motion was made (with the exception if the meeting carries over multiple days.)

4. Robert’s Rules: Rescind a Motion:

This motion is used to cancel something that the voting body did at a previous meeting. The rules to rescind a motion differ than to Reconsider:

i. A motion to rescind can happen at any meeting ii. No restrictions of vote on original motion iii. Must be considered at the time the motion is made iv. Vote must either be 2/3 majority at time motion is made OR

majority vote if previous notice is given.

5. Robert’s Rules: Amend Something Previously Adopted: Same rules apply as to Rescind. There are two differences. First, instead of canceling a previously adopted motion, this motion changes it. Second, you must include how you propose to change the previously adopted motion in the motion to Amend Something Previously Adopted, just as you would in any other motion to Amend.
