Comment A summary of incoming correspondence received by Council is as follows: 1. O’Connell Community Picnic and Dance – request to provide public toilets for the

O’Connell Community Picnic and Dance to be held on Saturday 5th May 2012 at St Thomas’ Church, O’Connell. Council allocated a provision for in kind assistance in its 2011/12 Donations Budget.

2. Arts OutWest Annual General Meeting to be held on Sunday 29 April 2012. Council’s delegate Fran Charge attended the AGM on behalf of Council.

3. Division of Local Government Circular to Councils – Ban on Political Donations by Corporations and Other Entities. The purpose of the circular is to advise Councils and other stakeholders of changes to the Election Funding, Expenditure and Disposals Act 1981. The changes will apply to political donations made to candidates standing at the September 2012 Ordinary Elections of Councils.

4. Invitation to attend the 2012 LGMA National Congress and Business Expo in Perth, 20 – 23 May 2012.

5. Barry Stubbs in relation to current water allocation from the Fish River Water Supply and the implications of stormwater collection.

6. Division of Local Government Circular to Councils – 2012 Councillor Development Strategy. The Division will be conducting a series of Councillor Induction Workshops following the September 2012 Elections. In addition the Division will be providing resources to assist Councillors in their role, including the Councillor Induction and Professional Development Guide for Councils ad the Councillor Guide.

7. Minister for Police and Emergency Services inviting Council to attend the NSW Local Government in Emergency Management Conference 2012.

8. Cr Ray Donald, President, Shires Association of NSW providing an update regarding ‘One Association’. On Tuesday 17 April 2012, the Shires Association Executive held a Special Meeting to consider the documents that needed to be approved to progress One Association. The Executive resolved to proceed with the amalgamation process.

9. Local Government and Shires Associations of NSW (LGSA) – Media Release. The LGSA are calling on NSW Government to reject many of the recommendations of the Livestock Health and Pest Authority review. The review proposes to abolish the regional boards made up of local people with local knowledge and replace them with a single state-wide LHPA governed by a board appointed by the Minister.

11.01.02 STATUS REPORT – ACTIONING COUNCIL DECISIONS File No: Governance/Meetings/Ordinary Author: Alan Cairney, General Manager

Summary The Report Item provides details of the status in actioning Council decisions, and includes all decisions with reference to the actual Resolution Number as shown in the Minutes for each Council Meeting. Recommendation That Report Item 11.01.02 is received as information. Comment The ATTACHED 14 page document contains 70 separate Council “decisions”, which includes some requests by Councillors for information and/or actions not made by Resolution. Previously there were separate Report Items presented through each Director (Corporate, Development and Engineering) and more recently including the Community & Customer Services Manager (CCSM). The Executive Assistant prepared a draft Report Item for completion by the respective Director/Manager. It is noted that many of the updated “status” details are that the issue in pending, no further action taken at this time, awaiting response etc. To improve reporting, initially to the General Manager and then to Council, one updated status report is prepared and over time will be limited to providing details of “outstanding items” only. An internal document will be prepared with details of the timing and actioning of Council decisions, as an accurate performance measure for each Director/Manager and the General Manager. For Councillors information the Executive Management Team (EMT – consisting GM, 3 Directors and CCSM) will meet the day after the Council Meeting to reaffirm Council decisions and determine priorities for actioning these decisions. There will be a clear focus on carry out the decisions of Council, communicating these decisions to staff and issuing relevant Media Releases. With respect to the ATTACHED document there are 18 decisions from the 17 April 2012 Council Meeting (although Resolution Number 34170412 contains 14 separate actions) and of these 10 have been completed, with comments provided for the remainder of these. It should be noted however that due to the preparation of the Business Paper and finalising Report Items that some of the “outstanding items” may now have been completed. Therefore a verbal update will be provided to the Council Meeting. Actioning of decisions will be included as comment within the Monthly Activity Report for each Director and CCSM.

11.01.03 MONTHLY ACTIVITY REPORT – GENERAL MANAGER File No: Governance/Meetings/Ordinary Author: Alan Cairney, General Manager

Summary The Report Item summaries the main activity for the General Manager for the month of May 2012 and includes issues such as Staff Matters, Workplace Health & Safety, Economic Development & Tourism, Council Committees, Regional Matters and Meetings Schedule. Recommendation That Report Item 11.01.03 is received as information. Comment 1. Staff Matters – since commencing on Monday 2 April the following activities relating to

staff matters has been undertaken.

a. Executive Management Team (EMT) – initial meet and greet on 2 April over lunch. Initial Meeting held on 16 April and an outline of 4 key objectives for EMT reviewed and with regular weekly meetings now established for each Tuesday. First Meeting 26 April.

Minutes/Notes of EMT meetings provided to the Mayor and copies placed on staff noticeboards. Weekly “one on one” sessions with the 3 Directors and Manager Community and Customer Services have been implemented and these are held on Monday and Tuesday (2 each day). I have also met with the Mayor during his regular days in the Administration Office.

b. Staff General – discussions with other direct reports to establish reporting mechanisms and the structure for regular meetings. This will be implemented in May. Regular weekly visits during April to the Visitor Information Centre and regular discussions with Executive Assistant and Human Resources/Special Projects Officer.

c. Staff Salary System – review of salary system results for EMT staff then implement revision for next staff level down, then for all of Council staff.

d. Other Staff Issues & Meetings

i. 4 April - GIS Review and update meeting

ii. 5 April – met with staff to discuss staff request/issue on placement of screens in the Administration Office.

iii. 5 April – Internal Audit Committee meeting – discussion on IAB role.

2. Integrated Planning & Reporting / Community Strategic Planning (CSP) See also 5. below with details of Council and other Committees/Workshops etc. As Council will appreciate this has been a priority during April, and additional work has been required from staff to “catch-up” so that a draft CSP and other plans and strategies can be presented to Council to enable the formal public exhibition process to occur. At this time work has progressed on the development and preparation of the Resourcing Strategy (Long Term Financial Plan, Workforce Management Plan, and Asset Management Plan (Strategy and Policy). The draft CSP document and the Delivery Program and Operational Plans are a high priority for the EMT to finalise.

11.01.04 LOCAL GOVERNMENT MANAGEMENT AUSTRALIA (LGMA) – REGIONAL ROAD SHOW 26 APRIL 2012

Summary The General Manager and Director Corporate Services attended the LGMA Regional Road Show held in Parkes on 26 April 2012. This Report Item provides a summary of the main issues presented which included a training session on “Corruption Prevention for Managers” by a representative of the Independent Commission Against Corruption (ICAC). Recommendation That Report Item 11.01.04 is received as information. Comment The Regional Road Show was facilitated by the Mitchell and Orana groups of the NSW LGMA and was attended by around 30 persons, mainly staff from Council’s in the region. This was one of 8 Regional Road Shows held throughout regional NSW. Topics presented were:

• Division of Local Government – update on the draft Model Code of Conduct, Integrated Planning & Reporting, and the dual roles of Councillors.

• A Destination 2036 information session and workshop. o Both sessions presented by Deputy Director of DLG, Steven Orr.

• A regional Focus Session presented by Less Finn from Parkes Shire Council providing an update on the LGAM group activities for Mitchell and Orana as well as NSW LGMA recent activity and planned workshops, and training opportunities.

• Corruption prevention for Managers, presented by a representative from ICAC. o This was an interactive session and provided a very good overview of ICAC’s

investigative power and the processes required by managers to identify and prevent corrupt activities through greater knowledge and awareness of corruption risks. The session provided examples of corrupt activity and provided details of prevention strategies and reporting systems.

o Some Councillors attended this session as it provided first hand information from an ICAC investigator, with the Question and Answer component at the end of the presentation proving to be an avenue for some robust debate.

• Asset Valuation – this session presented by David Edgerton principal of Valuers & Asset Management, a company specialising in asset management systems (and software solutions) for local government.

The Regional Road Show was very worthwhile to attend and the information presented will be shared with appropriate staff by the General Manager and Director Corporate Services.

11.01.05 QUARTERLY REVIEW OF MANAGEMENT PLAN 2011/2012 File No: Corporate Management/Management Plan/Management Plan 2012 Author: Alan Cairney, General Manager

Summary The Report Item provides details on completing actions in the current Management Plan 2011/2012 for the January to March Quarterly Period. Recommendation That Report Item 11.01.05 is received as information. Comment In accordance with the requirements of the Local Government Act 1993, the Quarterly Review of the Management Plan has been completed for the period January to March 2012. This Quarterly Review incorporates the current Social and Community Plan and also a report on the progress of actions required in response to the Internal Audit Committee Action Plan reports and recommendations. A number of the comments are that information is not readily available and in future action will be taken to ensure that appropriate KPI’s are developed. The Quarterly Review is ATTACHED as a separate document. In response to a decision by Council at the 21 February Council Meeting, in considering the Quarterly Review for the period ending December 2011 (refer Minute 24210212) further information is now provided regarding the “proposed deleted items” being identified and addressed at the appropriate Committee meeting. The comments in the Report Item considered at the February Meeting was “The former General Manager and Executive Management Team have undertaken a review of the content of previous quarterly reports with the result that this report highlights numerous items that it is considered should be deleted from future reports. Those items are marked with a line placed through the text to indicate that the item will not be included in future reviews.” It appears the above comments were made for the reasons that (quoted from Feb. Report Item):

• Information already provided in monthly staff reports to Council meetings; • Information provided in quarterly budget reviews; • Items that have been previously dealt with or completed and therefore no longer

relevant; • The measure or target is not realistic or quantifiable; and • Items where relevant data is not available

These proposed deleted items are included and comments made in the Quarterly Review document reflecting some of the above reasons. There are no further recommendations concerning any budgetary adjustments as this will be made in the Report Item for the Quarterly Budget Review Statement (to be presented to the proposed Special Meeting).

Recommendation That Report Item 11.01.06 is received as information. Comment 1. Oberon Visitor Information Centre (OVIC) - Tourism Monthly Report FOLLOWS

During the month of April the Centre experience dry weather, Easter and school holidays as well as ANZAC Day. For this time to last year there is a decrease by -9.6% April‘12 to April ‘11, reduced Public Holiday centre operating hours played a large part of decrease in visitor’s numbers. The extra public holiday hours imposed, equated to 10 opening hours less then last year. General Manager’s Note: I have made enquiries regarding the collection of statistics relating to the number of visitors and enquiries. Staff use a check sheet to collect the data, which includes details of the type of inquiry. I am satisfied with the accuracy of the collection of this data and will use this information (and additional data) to liaise with staff to improve the effectiveness of the OVIC in providing information services.

2. Tourism Events Mayfield Garden Open Weekends For the last three weekends of April Mayfield Garden had been opened for all visitors to see the family garden. Overall Mayfield Garden experienced a 10% increase in visitor numbers from this time last year. The middle weekend was the busiest weekend and now visitors and fans are able to join the Mayfield Garden journey on Facebook. 3. Topical Tourism  Central West ABC located at Orange requested to film in Forest NSW for a mushroom story. Film Central requested film locations within Forest NSW for print advertisements. Lithgow Tourism received substantial dollar funding from Motor Accident Authority initiated by staff of Lithgow Council, to develop an A5 booklet on Motorcycle safety, things to do, road safety and touring route. This booklet will include drives from Lithgow to Jenolan Caves up to Oberon, O’Connell and across to Tarana. The booklet is in early stages of development. Oberon Council has initiated contact with State Water to explore possible ways forward to increase the recreational use on Oberon Dam. A meeting has been schedule later this month with State Water Manager Asset Strategy & Research to discuss these opportunities. 4. Marketing – Publications Nil 5. Marketing – Media Oberon advertised in the This Month Discover the Blue Mountains, Central West and Hawkesbury. 6. Marketing – Consumer Shows The Rosehill Caravan & Camping 10 day Expo was during April 21 to 29. Oberon was represented as the LOB (Lithgow Oberon Bathurst) region, with main tourist destinations represented such as Jenolan Caves. Oberon council worked from Monday lunch to Thursday Lunch on the stand, sharing with Lithgow and Bathurst Council to cover 9 days at the expo. The final attendance for 2012 Caravan and camping show was 77,321. The daily break-down is in the table below, with comparisons from the previous 4 years:

11.01.08 TRANSFER OF GARBAGE CONTRACT File: Waste Management/Service Provision/Domestic Collection Author: Jaclyn Burns

Summary The current garbage contractor, Mr Murray Fenton has advised Council in writing on the 1 May, 2012 of his intention to transfer the contact to the proposed purchaser of Oberon Sand and Gravel. In accordance with condition 2.9 of the Garbage Contact the Contractor is obliged to acquire the written consent of Council prior to transfer. Recommendation That Report Item 11.01.08 is received as information. Comment On the 3 August, 2009 the Deed for the contract condition for the garbage service was signed by Mr Murray Fenton. In accordance with this Deed, Condition 2.9 of the contract requires the following in respect to the transfer of the contract: 2.9 No Assignment The Contractor shall not at any time during the term of the Contract assign or transfer any part of the Contract or by any act or deed procure this Contract or any parts thereof to be assigned, transferred or put into the possession of any other person without the prior written consent of the Council, which can be refused in the Councils discretion. The parties agree that before the Council will consider granting its consent, the following terms shall apply:

a) All money due or payable by the Contractor to the Council shall have been paid and there shall not be any existing unremedied breach of the covenants, conditions or terms of this Contract;

b) The proposed assignee must be a reputable, responsible and solvent person, firm or company, possessed of sufficient financial resources to meet the obligations of the Contractor. The Contractor shall bear the onus of providing such facts to the satisfaction of the Council;

c) The Contractor must pay to the Council all proper costs, charges and expenses incurred by the Council incidental to any enquiries which may be made by or on behalf of the Council as to the respectability, responsibility, solvency, fitness and suitability of any proposed assignee;

d) The instrument effecting such assignment shall be prepared by the Councils solicitors and the Contractor shall be responsible for payment of all legal costs and expenses incurred by the Council in relation to the same.”

In accordance with the condition Council staff have requested the provision of additional information from the proposed contractor to satisfy subsections b, c and d of the contract as well as other relevant conditions. Upon recept of all appropriate information the document will be transferred. Should the request for the abovementioned information not satisfy Condition 2.9 then the matter will be referred to Council for suitable action.

Summary The following information is presented for Councillor’s information and is reflective of the period 1 April 2012 to 30 April 2012. Recommendation That Report Item 11.01.09 is received as information. Comment 1. General Fund Dog Rocks Road Further earthworks and drainage are continuing on the unsealed section of Dog Rocks Road as resources permit. Road Maintenance Repair works following the wet weather in March are continuing. A contractor has been engaged to clean out blocked culverts. Gravel Resheeting Some gravel resheeting has been carried out on Swatchfield Road. Caravan Park The resealing of the internal roads at Jenolan Caravan Park has been completed. 2. RMS Works O’Connell Avenue Reconstruction of O’Connell Road through the avenue is nearing completion. Some stabilisation works, and the bitumen seal should take place during May. Abercrombie Road Work on the 700m section of Abercrombie Road through Black Springs has been slightly delayed due to uncertainty about the location of optic fibre cables. It will commence shortly.

Edith Road Curve Widening Construction of curve widening’s on Edith Road between Bastard Point Road and Kanangra Walls Road is complete. This includes full width reseals, guardrails, wire rope barriers, and line marking. Reseals Remedial works in the rutting of the wheel paths near Wisemans Creek on O’Connell Road has been completed. The final seals on the heavy patches have been completed. Abercrombie Hill The RMS has advised of funding in 2012/13 for some road safety improvements on Abercrombie Road, down the hill on the approach to Abercrombie River. This will mostly be curve widening and safety barriers. It may also include some works in Upper Lachlan Shire. An inspection is scheduled for 3 May. Oberon Mount Speed Zone The permanent 80km/h speed zone at The Mount has now been approved. Signs have been ordered and will be installed during May.

3. Town Improvement Fund Glyndwr Avenue Drainage Construction of stormwater drainage through the properties on the eastern side of Glyndwr Avenue is continuing. 4. Sewer Fund Nil

Oberon 2025 Community Forum 13/07/2012 Approximately 55 people in attendance, with great participation from all involved. Youth Week 20/04/2012 Approximately 200 people in attendance, with numerous activities, beverages, ice creams, sausage sandwiches and balloons provided. The events was a combined effort by all departments of Council and included many volunteers from the families of staff members including the Swannell’s, Youman’s and Beasley’s.

5. Library

The Library has supported many themes of regional interest in displays such as ANZACs, Earth Day, and Youth Week along with our ongoing promotion of the National Year of Reading.

Story Time and Craft themes have included Easter, ‘Catch a Falling Star’, ‘Baa Humbug’ and Earth Day. The Library provided a School Holiday Craft Flyer to the local schools for inclusion on noticeboards and in newsletters to advertise our program. Attendance at the craft activities was high. There was one volunteer for craft activities from the community.

Staff are continuing discussions with eResources supplier OverDrive as to integrate the eBook system with our Web presence. The current plan is to have OverDrive operational in late May. Staff will be continuing a monthly story and craft session with both the Black Springs play group and the public school in this coming school term. A story and craft session with the Burraga Bugs has been scheduled for 30th May to assess how this will fit in with the play group’s operations.

6. Pool

Pool surveys were sent to all registered users of the Pool Complex (season passes/dolphin swim school) where the Complex was rated on several competencies including Cleanliness, Service, Programs, Kiosk and Supervision. Feedback was positive with all areas performing at an average to above average standing.

7. The Robert Hooper Community Centre

The Robert Hooper Community Centre has been utilised extensively in the month of April by various social and community groups. A Users handbook will be provided to those groups in the near future.

8. Community Technology Centre (CTC)

The CTC continues to host community classes run by volunteers. These are the Family History Group (Mondays) and Computer Classes (Wednesdays).

9. HACC

The new wheelchair accessible vehicle (Kia Carnival) has been ordered from Clancy Ford (Bathurst) who will arrange for Freedom Motor Vehicle alterations to convert. This could take up to ten (10) weeks. The current vehicle has been used 18 times over April.

10. Grants

Staff are investigating the feasibility of applying for grants in the following areas:- a) Coca Cola Amatil grant providing up to $10,000 for a ‘one-off’ project involving youth.

Communications have been sent to the Regional Office of the SES to potentially offer a bush survival/training program over the school holidays. This would possibly encourage membership for the SES whilst engaging our youth. The funding is only available to a DGR status organisation.

b) Matana Foundation for Young People Grant Program. The Grant provides up to $10,000 for projects benefitting youth in the areas of education, arts and culture, employment and training, housing and accommodation. Communications have been sent to the Bathurst PCYC to gage interest. Funding is only available to a DGR status organisation.

c) The NAB Schools First Program is offering from $15,000 to $30,000 to bring students, teachers, parents and community members together to improve student outcomes. Staff are conversing with Oberon High as to the possibility of a ‘study hall’ program that would provide afternoon tea for students followed by ‘study’ help sessions with volunteers to provide guidance to students that may need help with school work.

12 Reports for Decision 12.01.01 OBERON 150 YEAR CELEBRATIONS File No: Community Relations/Ceremonies Author: Alan Cairney, General Manager

Summary To present to Council a proposal to form a Steering Committee to assist in making arrangements to celebrate Oberon’s 150th Anniversary. Recommendation That:

1. Council establish a Steering Committee for the purpose of making arrangements to celebrate Oberon’s 150th Anniversary;

2. The Mayor to invite members of the community to form the Steering Committee and

that the Committee report to directly to the Council through the General Managers Report Items;

3. Council through the Community Strategic Planning process and the Delivery Program

and Operational Plans, allocate funding to enable appropriate celebrations and activities planned for this event.

Comment At a recent meeting of the Heritage Committee it was mentioned that Oberon will be 150 years old in 2013. Preliminary investigation indicates that the village of Oberon was proclaimed in 1863. In the publication “Thematic History of Oberon Shire” by Phillippa Gemmell-Smith, it is stated “The Oberon town area was originally known as Bullock Flat, after a flat on the Fish River Creek, now opposite the water treatment plant. The village, elevated to higher country adjacent, was proclaimed in 1863, and the name also elevated”. Further investigation will determine the exact date of the proclamation. And in the meantime a Steering Committee is suggested as an appropriate way for Council to work with the community to firstly determine and then implement a range of community and civic activities to mark the event. It is anticipated that the Steering Committee will meet regularly to discuss activities and liaise with individuals and community groups to coordinate activities. It is expected there will be many, many suggestions from individuals and community groups across the whole of the Oberon Local Government Area. At this time it is proposed to include a nominal amount of $10,000 in the Delivery Program & Operational Plan for 2012/2013 to facilitate the celebrations. Administrative support services will be provided to the proposed Steering Committee through appropriate staff including

tourism, heritage and community services. As General Manager this is a project where I will be personally involved. With the Local Government Elections to be held in September 2012, it is considered that the current Mayor make arrangements to invite selected members of the community to form the proposed Steering Committee, with these arrangements to be reviewed after the Elections, including the Election of Mayor for Oberon Council. The Oberon Shire Council was first formed at a public meeting in March 2006.

A copy of the plan of subdivision is ATTACHED. In approving the subdivision a number of conditions were imposed including Condition 13 Restriction to user which states as follows:

Zone: Rural 1(a) Summary Council is in receipt of a Development Application 10.2011.67.1 for the proposed construction of a new dwelling and two associated detached garages on land described as Lot 4 DP 1108123, being known as 1172 Mutton Falls Road, O’Connell. The proposed development is not in compliance with clause 18(b) of the Oberon Local Environmental Plan 1998; Clause 18(b) states “the dwelling is not erected within, or within 100 metres of the high water mark of, a water body listed in Schedule 1”. Recommendation That Council determine Development Application 10.2011.67.1 in accordance with the recommendation outlined in the attached Section 79C report. Comment Council is in receipt of a Development Application 10.2011.67.1 for the proposed construction of a new dwelling and two associated detached garages on land described as Lot 4 DP 1108123, being known as 1172 Mutton Falls Road, O’Connell. The applicant has applied under State Environmental Planning Policy (SEPP) 1 to vary clause 18(b) of the Oberon Local Environmental Plan 1998 which requires that a dwelling not to be erected within 100m of the high water mark, in this case the Fish River. The proposed dwelling is 92.6m from the Fish River, thus a reduction of 7.4% is requested by the applicant.

The variation to the development standard is less than 10% thus Council can assume the concurrence of the NSW Department of Urban Affairs and Planning as advised in Clause 12 of Circular B1 dated 17 March 1989. Lot 4 DP 1108123 is considered a vacant original holding as per clause 18(a)(i) of Councils current Local Environmental Plan 1998 and as such the proposed development is permissible subject to development consent. The proposed development is considered permissible subject to Clause 18 of Councils current Local Environmental Plan 1998, and subject to the approval of a State Environmental Planning Policy (SEPP) 1 application to vary the development standard setback requirement of 100m to 92.6m. The requirements of clause 8 (concurrence) of SEPP 1 have been considered and it is felt that approval of the proposed variance is appropriate in this instance. The proposed development will not raise any matter of state or regional significance, nor is there any public benefit to maintaining the 100m setback from the Fish River. Clause 8 has been satisfied through the use of the NSW Land and Environment Court ‘five part test’ to consider when assessing SEPP 1 applications. The objective of the 100m development standard within the clause 18(b) of LEP can be directly linked back to ensure achievement of the zone objectives within clause 9 of the LEP. In particular the 100m setback is intended to “protect, enhance and conserve water resources and preventing the pollution of water supply catchments” which is quoted in clause 9(a)(vii). Whether the dwelling is located 100m or 92.6m as proposed in this instance will not change the proposed developments ability to “protect, enhance and conserve water resources and preventing the pollution of water supply catchments” because the impact upon the Fish River will still be minimal whether the dwelling is 92.6m or 100m as there is sufficient distance to ensure protection of the water resource. The applicant has supplied a geotechnical report which also notes hydrogeomorphological information to satisfy clause 18(c) of the current LEP. The geotechnical report proposes a mound effluent disposal system which is currently the most advanced and frequently used effluent systems for difficult sites. The geotechnical report states “even though the system will be within 200m of the Fish River there will be no detrimental effect on the river”. The geotechnical report proposes the effluent disposal area to be located directly in front of the dwelling, which will mean it is approximately 85m from the edge of the Fish River, a condition of consent will request that the effluent disposal area is relocated outside the 100m water mark to ensure compliance with Australian Standard 1547 and also to minimise any potential perceived impact of the effluent disposal area. The application has been neighbour notified to adjoining surrounding neighbours, which closed on 26 April 2012, at that time no submissions had been received by Council. 12.01.04 GOLF CLUB EFFLUENT REUSE File No: Property/PO47.107 Author: Aruna Wickramasinghe

Summary Council, at its March Ordinary Meeting resolved to request a complete project plan for the completion of Golf Club effluent reuse project. The estimated cost for the approval process has increased substantially and at least another $50,000 has to be spent on the approval process before it is known whether the project can proceed. The total estimated cost to complete the project is $436,700. Recommendation That :

1. Council note the contents of this report and not proceed with the Golf Club Effluent Reuse project.

2. Council continue to work with the Golf Club to seek alternate opportunities for water

saving measures. Comment At the March meeting the Council resolved to request for a complete project plan for the completion of Golf Club effluent reuse project. The purpose of this report is brief the Council about the total estimated costs and all the outstanding works to complete the project, before any further work is undertaken. Thus far the following work has been undertaken for a cost of approx. $37,000.00

In accordance with the S60 of the Local Government Act further approvals should be obtained from NSW Office of Water to supply treated sewage to a third party. This is in addition the EPA approvals. NSW Office of Water requires a risk assessment and recycle water management plan for the project using the framework in the Australian Guidelines for Water Recycling (AGWR). The AGWR uses a preventative risk management framework which focuses on process and onsite controls and public health aspects whereas the EPA guidelines sets out compliance values for quality and quantity effluent applied, run off boundaries etc.

Preliminary comments from NSW Office of Water have indicated that trickling filter treatment plants would find it very difficult to consistently achieve the desired effluent quality. Therefore Chlorination and UV disinfection may be required. Irrigation practices may have to be planned for off peak hours. A consultant with expertise in this area will have to be engaged to conduct risk management workshops to overcome issued related to the NSW Office of Water approval process. Considering all the project requirements, the estimated costs to complete the project are detailed below. Current expenditure - $37,000 Risk assessments associated with S60 approval - $50,000 EPA license variation - $10,000 Finalise the Review of Environment factors - $20,000 Construction of Pump station and Pipeline - $160,000 Supply and installation of disinfection system - $100,000 Costs of verification and validation of the system - $20,000

$397,000 Contingencies (10%) $39,700 Total estimated cost $436,700

Council has reduced the previous annual contribution, provided to the Golf Club, by $10,000 and putting it towards the sewer fund to offset the Capital cost of the proposed project. Therefore Council will take at least 43 years to recoup the capital cost. From the water balance model prepared by Geolyse, Golf Club would use 50 ML/ day (for both Greens and Fairways) out of 365 ML/year of effluent produced by Oberon Sewer Treatment Plant Historically 15ML/ year each has been sourced from both Oberon Dam and the existing bore although this has not been the case during drought times due to water restrictions and bore running dry during the watering season. From the current supply of raw water Council does not make any profit as the charge out rate to the Golf Club is very similar to the purchase price of raw water from State water. In addition there’ll be operational costs for pumping and the disinfection system resulting from the proposed effluent reuse project. Financial Implications Council has only allocated $110,000 towards the cost of the project and additional funding is required to proceed with the project. Risk/Other Implications There is a risk that this project may not proceed if approval and licensing cannot be obtained from NSW Office of Water and EPA respectively. At least another $50,000 (Total project cost of approx. $90,000) has to be spent before the outcome of the approval process is known.

12.01.05 HANRAHAN’S LANE – ACQUISITION FROM FORESTS NSW File No: Roads/R58 Author: Matilda Dwyer

Summary Council currently owns and maintains approximately 2.9kms of Hanrahan’s Lane. Council has been approached by adjoining landholders to acquire a further 0.5kms (821.8m2 total) from Forests NSW to provide dedicated road access to adjoining landholders. Forests NSW have been granted the approval of the Minister for Council to compulsorily acquire the land. A Council resolution is required to initiate the application process. Recommendation That Council make application to the Minister and the Governor to compulsorily acquire 821.8m2 of land from Forests NSW for the purpose of public road. Comment Council currently owns and maintains approximately 2.9kms of Hanrahan’s Lane off Abercrombie Road. Council has been approached by an adjoining landholder to acquire a further 0.5kms from Forests NSW to provide access to adjoining landholders as the existing road alignment does not extend to the property accesses. Forests NSW have been granted the approval of the Minister for Council to compulsorily acquire the land. A copy of the road map FOLLOWS. A Council resolution addressing the requirements of the Department of Local Government is required to initiate the application process. Once the application process has been completed, the road will then be gazetted and added to the existing alignment of Hanrahan’s Lane. The adjoining landholder will be required to upgrade the remainder of the road to meet Council’s road specifications before the maintenance responsibility is taken over by Council. All costs associated with the land acquisition and transfer costs will be borne by the adjacent landholders.

12.01.06 MAIN STREET TREES/SECURITY CAMERAS File: Laws and Enforcements/Notifications/Security Author: Matilda Dwyer Summary Council resolved at the February meeting that more information was required to make a recommendation for the improvement of the main street security system. Recommendation That Council note the information provided in report 12.01.06 and continue the current practice of pruning the trees. Comment The following options are proposed for consideration • Option 1 - A quote has been received from the supplier for moving the cameras further

up the poles. They have advised they could move two cameras per day – they would require two Council staff on site for assistance. The supplier has stated that there is no guarantee that the quality of the picture will not be affected once the cameras are moved as the camera will be further away from the subject.

Estimated Cost Boom lift hire (1½ days) - $750.00 Quoted $950.00 ex GST per camera - $2,850.00 Two workers (1½ days) - $840.00

This option is not preferred as it is not a permanent solution as cameras may have to be relocated in the future depending on the growth of trees. This figure appears quite expensive and alternate quotes would be sought if Council were to pursue this option.

• Option 2 - The removal of the trees and replacing with smaller variety. The existing trees are a variety of Oak tree which can grow up to 30 metres in height. The trees would be removed and smaller variety planted to replace existing.

Estimated Cost Four Parks and gardens staff – 2 days approx. $2,240.00 Three new trees – approx. $300.00

Advice has been received that the Oak trees in Oberon Street were selected via a committee established by Council and the removal of these trees would require consultation with the community and/or members of that committee (no longer active).

• Option 3 – Current practice Continue to trim the trees annually – allocate funds within the annual financial budget to cover these costs.

This is the current maintenance practice which can be affordable under the current budgets however this method of pruning is not very aesthetically pleasing. This option is the preferred option; however advice from a horticulturalist would need to be obtained to ensure correct procedures are in place to preserve the health of the trees.

The suggestion as raised of using other businesses’ security cameras. Business owners were approached and they either didn’t have security cameras installed or do not give footage out, it was only for private use. Financial Implications Funds are allocated within the current financial budget for the maintenance of street trees or the maintenance of cameras.

12.01.07 REQUEST FOR FINANCIAL ASSISTANCE – RSL MEMORIAL PARK WALL

Summary Correspondence has been received from the Oberon RSL Sub-Branch requesting that Council waive the Development Application fees associated with the building of a niche wall in the memorial park. Recommendation That Council donate the $359 Combined Development Application, Construction Certificate, Inspection and Occupation Certificate Fees for the memorial park niche wall and make provision in the next 2011/2012 Quarterly Budget Review Statement.

Comment Correspondence has been received from the Oberon RSL Sub-Branch requesting that Council waive the $359 Combined Development Application, Construction Certificate, Inspection and Occupation certificate fees associated with the building of a niche wall in the memorial park. The Sub-Branch paid the $297 Combined Development Application, Construction Certificate and Inspection Fee, and the $62 Occupation Certificate Fee on the 9th March 2012. The financial assistance budget for 2011/2012 has been fully expended, therefore should Council resolve to waive these fees; a vote for additional funds will also be required.

• Council needs to lodge an application to the Oberon Multipurpose Centre each time it wishes to use their bus and it would then be decided whether or not it would be made available for Council use.

• Adopt a Grandparent program has been forwarded to schools in the Oberon Local Government Area and accepted with enthusiasm. Council has received positive feedback from Hathaway Cottages and the Robey Centre. It was suggested that Council correspond with parents via the schools and see if any parents are willing to take school students to visit the elderly on week-ends.

• The Committee agreed to retain the existing Charter that was endorsed on 19 April 2011.

Council resolved at its 17 April 2012 Ordinary Meeting that the General Manager be requested to undertake discussions with the executor of the estate of the late Leath Johnston for the purpose of securing the funds for aged care.

Schools are concerned about the students visiting the elderly and suggested that writing letters will be a good start. The Committee suggested that we correspond with parents via the schools to ask if parents and students would be willing to visit the elderly after hours and possibly on weekends. Draft Basis for the Operation of Oberon Council’s Seniors Welfare Committee (see attachment from Graeme Parker) Committee agreed to retain the existing Charter that was endorsed on 19 April 2011. Establishment of an Entity from Leath Johnson Estate ($100,000) Discussions are still underway regarding the possible establishment of a mechanism to capture donations and bequests to benefit seniors’ welfare in the Oberon Local Government Area. Advice has been received from Bird Legal with regard to the setting up of an Entity and the approximate cost would be around $5,000. Recommendation That the General Manager be requested to contact the Executors for the late Leath Johnson to ascertain the rules of the will in regard to the $100,000 donation by Leath that was to be used for Aged Care in Oberon. Carried Sue Loudon raised the issue of protecting our natural Environment and asked if that is something that would come under this committee as Oberon has many National Parks and pristine areas. The Director of Development advised that Council does not have a tree preservation order on private land however the road reserves are protected. Ewen Stewart presented to the committee a list of buildings in the Burraga area that may be suitable for inclusion on the draft Land Use Strategy. The Director of Development will contact the owners to see if they are keen to list their properties. Laurie McMahon asked if the Hackney Graves at Burraga has been listed as a potential Heritage item on our proposed draft Land Use Strategy. Laurie advised that “Meranda” the chief of the Burra Burra tribe was buried near Granite Hill and this should be recorded somewhere or could it be marked on a map showing the Historical buildings and locations of other areas of Historical significance in the Burraga Area The Chair offered to contact Belinda Hackney to see if they have sold their property before any further action is taken. Christo Aiken advised that the request to Council for funds for the Local Heritage Fund and the Heritage Signs has been referred to the Council’s next estimates meeting. He indicated that he is still looking for further information regarding the proposed conservation area at O’Connell and would appreciate any assistance. Philippa suggested that there may be some information stored at Council which Staff will investigate. He has also had a meeting with the new part owner of Macquarie, Mr Paul Hennessey who is very keen to operate the farm and conserve the buildings working towards a possible State Heritage listing. Lindlegreen Christo advised that the Ashlefords (the owners of Lindlegreen) have agreed to proceed with the nominations of the Cobb Barn at Lindlegreen as a State Heritage item. They can proceed with the draft nomination, however if the task is to onerous they can back out if they wish.

APOLOGIES: Apologies were received and accepted from Mr John Brien, Ray McMahon, Laurie McMahon, Stella Cotton, June Evans, and Dietmar Torner. As there were insufficient numbers for a quorum those present held general discussions on the following items: The Director of Development suggestion that if the signs where larger they would be able to take more information, which in turn would save us from editing the information presented to the committee by Mr Col Roberts. The size would be approximately 1200 x 1200 and therefore the Committee may not need to produce the Brochure. (Col Roberts joined the meeting at 5.05 pm) Clr Sullivan indicated that the Brochures needed to be produced as it would allow for material to be up-dated from time to time. Col Roberts indicated that he was keen to have a hard copy in the form of a brochure available at the Visitors Information Centre with the information on the interpretive boards in bullet point format. The committee agreed that 600 x 900 was a good size for the signs and that a master plan would give the committee some formal direction. Mr Peter Harper enquired if the committee intended to still have some old machinery on display and had the Committee decided on the exact location of Timber Heritage Walk. The Chair said that it is intended to display old machinery and that we may be able to obtain some from the logging contractors. The Timber Heritage Walk is intended to run from the railway station down to the old Timber Industries and Pyneboard site. It was suggested through the Chair that the committee needed to develop a master plan and recognise that these signs are stage one of the overall project. The old machinery could be displayed in conjunction with the Oberon Tarana Heritage Railway Inc. and fit in with their existing layout and plan. The Director of Development in consultation with Councils Heritage Advisor will work on sorting through the information gathered by Mr Roberts and will also present to the next meeting a conceptual master plan with aerial maps and steps taken to achieve each stage of the Timber Heritage Walk.

The Director of Development advised that the Oberon Timber Complex have agreed to donate $3000 towards the project, and Council’s Community and Customer Services Manager Ms Peta Heffernan is looking at the possibility of any grant funding that may be available. The Director will also contact the forestry contractors for any funding. Mr Roberts advised that Mrs Stella Cotton has a number of photos that could be used on the interpretative signs and he is happy to approach Mrs Cotton to see if we could obtain some copies of relevant photos. A copy of the minutes FOLLOWS for Council’s information. Items discussions were as follows:

• Council has been advised that the application to the Department of Sport and Recreation for improvements to the Oberon Sporting Fields was unsuccessful. The Committee requested feedback in relation to why the application was unsuccessful and how Council can pursue alternative funding for this project.

• Council has received funding under the Community Building Partnership Fund for the installation of an Ablutions Facility at Cunynghame Oval.

• Discussion was held in relation to the requirement for bookings for Sporting Facilities to be available on the website. The committee agreed that bookings for the facilities would continue to be made through the Engineering Administration Assistant and a calendar showing the times that the sports facilities have been booked will be added to Council’s website. All maintenance issues will also continue to be reported through the Engineering Administration Assistant.

Discussion was held in relation to the cost of providing this facility and the Committee requested alternative costing be investigated prior to proceeding. On-line Bookings for Sporting Facilities – Update Councils Information and Communications Officer, Carolyn Hendry has been in contact with Energetica (the website creators) regarding having this built into the system. There has been no further progress as they have been busy getting other Councils websites up and running and testing existing features. Discussion was held in relation to the requirement for this to be available on the website. The committee agreed that bookings for the facilities would continue to be made through the Engineering Administration Assistant and a calendar showing the times that the sports facilities have been booked will be added to Council’s website. All maintenance issues will also continue to be reported through the Engineering Administration Assistant. This matter can now be removed from the agenda for future meetings.

Australian Sports Foundation – Tax Advantage for Sports Fundraising

The Oberon Junior League and Oberon Senior League are looking for grant funding to build and fit out a canteen at the Oberon Leagues Club. Peta Heffernan is investigating possible tax advantages for people who donate to projects such as this and possible sources of grant funding for the project. The committee is currently working on costing for the project. General Business Ian Christie-Johnston and Peter Gascoigne asked about garbage collection following major events. Ian Tucker advised that this is normally done as part of the daily routine. Line marking at the Junior and Senior League Fields is currently being done quite frequently. The committee is happy to assist with line marking where possible. The committee requested the costs for providing lighting at the Recreation Ground be tabled at the next meeting. Discussion was held in relation to damage to the Junior and Senior League Fields during the Highland Steam and Vintage Fair. Ian Tucker commented that a protocol needs to be established for activities that have the potential to damage the sporting fields. Discussion will be held with the organisers of the fair with a view to minimizing the damage to the fields at future events. Ian Christie-Johnston asked about the progress of applications made to Council for donations in the 2012/13 budget. The Oberon Senior League has applied for financial assistance to install fencing around the Senior League field. Council will consider the budget within the next couple of weeks.
