No. N-10/9/2013-PPC - In exercise of the powers conferred by section 9 and sub-section (5) of section 11 read withclause (d) of sub-section (2) of section 33 of the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (25 of1990), and in supersession of the Prasar Bharati (Broadcasting Corporation of India) Recruitment of Officers andEmployees of the Corporation Regulations, 2016, in so far as they relate to the posts of Engineer-in-Chief, SeniorAdministrative Grade, Junior Administrative Grade, Senior Time Scale and Junior Time Scale posts in Prasar Bharati(Engineering) Service, except as respects things done or omitted to be done before such supersession, the PrasarBharati (Broadcasting Corporation of India), with the prior approval of the Central Government, hereby makes thefollowing Regulations, namely:-

1. Short title and commencement.- (1) These Regulations may be called the Prasar Bharati Broadcasting(Engineers) Service Regulations, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these Regulations, unless the context otherwise requires:-

(a) "Act" means the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (25 of 1990);(b) "Corporation" means the Prasar Bharati (Broadcasting Corporation of India) as defined under the Prasar

Bharati (Broadcasting Corporation of India) Act, 1990 (25 of 1990);(c) "Controlling Authority" means Prasar Bharati Board;(d) "Departmental Promotion Committee" means a Committee constituted to consider promotion and / or

confirmation in any grade;(e) "duty post" means any post specified in Schedule I;

(f) "examination" means any competitive examination conducted by the Prasar Bharati Recruitment Board or anyother agency authorised by the Prasar Bharati Board for recruitment to the posts in the service;

(g) "Government" means the Government of India;(h) "grade" means a grade of the service;(i) "media" means Akashvani and Doordarshan;U) "recruitment year" means a calendar year in which the examination is conducted by the Prasar Bharati

Recruitment Board;(k) "regular service" in relation to any grade means the period or periods of service in that grade rendered after

selection and appointment thereto at the initial constitution of the service; or (ii) during which an officer wouldhave held a duty post in that grade on a regular basis but for being on leave or otherwise not being availablefor holding such post;

(I) "schedule" means a schedule appended to these regulations;(m) "Scheduled Castes" and "Scheduled Tribes" shall have the meanings as assigned to them respectively in

clauses (24) and (25) of article 366 of the Constitution;(n) "Service" means the Prasar Bharati Broadcasting (Engineering) Service constituted under regulation 3.

(2) Words and expressions used herein and not defined in these regulations but defined in the Act shall have themeanings respectively assigned to them in the Act.

3. Constitution of Service.- (1) There shall be constituted a service known as the Prasar Bharati Broadcasting(Engineers) Service consisting of persons appointed to the Service under Regulations 6 and 7.

(2) The benefits of organised Group-'A' service namely Non-Functional Selection Grade, Non-FunctionalUpgradation shall not be applicable to the members of the Service.

4. Grades, scale of pay and sanctioned strength.- (1) The duty posts in the various grades of the Service, theirnumber and scale of payor pay band and grade pay on the date of commencement of these Regulations shall be asspecified in Schedule I.

(2) After the commencement of these Regulations, the sanctioned strength of the duty posts in various grades shallbe such, as may from time to time, be determined by order, by the Corporation.

(3) The Corporation may, in consultation with the Government, include in the Service allied posts (other than thoseincluded in Schedule- I) or exclude from the Service a post included in the said schedule.

(4) The Corporation may appoint an officer whose post is included in the Service under sub-regulation (3) to theappropriate grade of the Service in a temporary capacity or in a substantive capacity, as may be deemed fit and fixhis seniority in the grade after taking into account his continuous regular service in analogous grades.

5. Members of the Service.- (1) Persons appointed to duty posts under Regulations 6 and 7 shall be the members ofthe Service.

(2) A person appointed under Regulation 6 shall, on such appointment, be deemed to be member of the Service inthe appropriate post or grade applicable to him in Schedule I, as the case may be, from the date of initial constitutionof the service.

(3) A person appointed under Regulation 7, shall be a member of the Service in appropriate post or grade applicableto him in Schedule I, as the case may be, from the date of such appointment.

6. Initial Constitution.- (1) Subject to provisions of regulations 2, 3 and 4, all persons recruited after 5.10.2007 andholding posts listed in Schedule I on regular basis shall, from the date of commencement of these Regulations, bedeemed to have been appointed to the corresponding posts and grades in the Service:

Provided that nothing in this sub-Regulation shall apply to the employees appointed on or before05.10.2007 on regular basis and serving Prasar Bharati on deemed deputation basis till retirement, if they heldeither on the date of commencement of these Regulations or on any subsequent date, the posts listed inSchedule I as members of Indian Broadcasting (Engineers) Service.

(2) (a) The regular continuous service of persons appointed after 05.10.2007, shall count for purposes ofpromotion and confirmation.

(b) To the extent, the Controlling Authority is not' able to fill the sanctioned strength of various grades in theService in accordance with the provisions of this regulation, the same shall be filled in accordance withRegulation 7.

7. Maintenance of the Service.- (1) The number of posts in each grade is the total number of the posts sanctioned forthat grade and at any time shall not exceed the aggregate number of posts occupied by the Government servants ondeemed deputation to the Corporation and the officers and employees of the Corporation covered under theseRegulations.

(2) Any vacancy in any of the posts or grades specified in Schedule-I, shall be filled in the manner, namely:-

(a) 50% of the vacancies in Assistant Director (Engineering) posts in the media shall be filled by promotion ofofficers of feeder grade possessing the minimum qualifying service as specified in the appropriate columnsin Scheduled Ill;

(b) 50% of the vacancies in Assistant Director (Engineering) post in the media shall be filled by directrecruitment on the basis of competitive examination conducted by the Prasar Bharati Recruitment Board orany other agency authorised by Prasar Bharati Board in accordance with any scheme of examination thatmay be notified by the Corporation from time to time.

(3) Appointments to the posts under the Service by direct recruitment shall be made in the manner specified inSchedule 11.

(4) Promotion of officers to various grades of the Service shall be made in the manner specified in Schedules IIIand IV.

(5) To facilitate suitable decision on placement in one of the media in respect of the persons found suitable forappointment by direct recruitment or by promotion to any post in the Service, the Prasar Bharati Board shallconstitute a Selection Committee with the Chairman or a Member of the Prasar Bharati Board as Chairman andnot more than two representatives each, to be nominated by the Director General, Akashvani and DirectorGeneral, Doordarshan. The said Committee shall deliberate on the matter and submit a list of officers consideredsuitable for placement in any of the media to the Prasar Bharati Board for approval.

Explanation:

The absence of a Member other than Chairman or a Member of Prasar Bharati Board shall not invalidate theproceedings of the Selection Committee.

(6) The decision of the Prasar Bharati Board in this regard shall be final. The Prasar Bharati Board may, however,consider to revise its own decision, in matters recommended by the Director General, Akashvani or Director General,Doordarshan, as the case may be.

(7) (a) Notwithstanding anything contained in this Regulation, officers referred to in sub-Regulation (3) shall beincluded in the Service when vacancies in concerned media are available;

(b) such persons who are included in the Service at a later date will rank en-bloc junior to the personsinducted in the service at its initial constitution.

8. Seniority.- (1) The relative seniority of members of the Service appointed to any grade in accordance withRegulation 6 at the time of initial constitution of the Service, shall be governed by their relative seniority occuring onthe date of commencement of these Regulations.

(2) The officers who join the service in any grade after its initial constitution including those mentioned in sub-regulation (3) of regulation 7, shall rank below to those appointed to the service in that grade under Regulation 6 orthe employees appointed on or before 05.10.2007 on regular basis and serving Prasar Bharati on deemeddeputation basis till retirement, if they hold the posts specified in Schedule I as members of Indian Broadcast(Engineers) Service on the date of commencement of these Regulations.

(3) The seniority of persons recruited to the Service after the initial constitution shall be determined in accordancewith the general orders and instructions issued by Department of Personnel and Training in this behalf from time totime.

(4) The seniority of any person, not covered by sub-Regulations (1) and (2) of this Regulation, shall be determinedby the Director General, Akashvani or Director General, Doordarshan in consultation with the Prasar Bharati Board.

9. Probation.- (1) Every person appointed to the post of Assistant Director (Engineering) of the Service by directrecruitment or by promotion shall be on probation for a period of two years.

(2) The Corporation may extend or curtail the period of probation in accordance with the orders and instructionsissued by the Corporation in this behalf from time to time.

(3) On completion of the period of probation or any extension thereof, such officers shall, if considered fit for regularappointment, be retained in their appointment on regular basis and be confirmed against the post, if not alreadyconfirmed in the entry grade.

(4) If, during the period of probation or any extension thereof, as the case may be, the Corporation is of the opinionthat an officer is not fit for regular appointment, it may, -

(a) if, he was appointed by direct recruitment, discharge him from service in that post;

(b) if, he was appointed by promotion, revert him to the post held by him immediately before such promotion.

(5) Every person on appointment to the Service by direct recruitment, shall be required to undergo an inductiontraining of at least two weeks' duration in the probation period as per the syllabus to be prescribed by theCorporation. Successful completion of the induction training shall be a pre-requisite for satisfactory completion ofprobation.

(6) During the period of probation or any extension thereof, the officer may be required to undergo such courses oftraining and instructions in addition to induction training specified in sub-Regulation (5) above and pass suchexamination and test (including examination in Hindi), as may be considered necessary, as a condition to thesatisfactory completion of probation.

(7) As regards other matters relating to probation, the members of the Service shall be governed by the instructionsissued by the Corporation from time to time in this regard.

(8) In the case of an officer placed on probation on any post in the Service, the said officer concerned, onsatisfactory completion of the period of probation, shall be considered for confirmation.

10. Appointment to the Service.- All appointments to the posts in the Service shall be made by the Corporation.

11. Liability for Service in any part of India and other conditions of Service.-

(1) Officers appointed to the Service shall be liable to serve anywhere in India or outside India.

(2) The conditions of service of the members of the Service in respect of matters for which no provision is made inthese Regulations, shall be the same as are applicable from time to time to officers of the Corporation ingeneral.

12. Disqualifications.- No person -

(a) who, has entered into or contracted a marriage with a person having a spouse living,or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the service:

Provided that the Corporation may, if satisfied that such marriage is permissible under the personal lawapplicable to such person and the other party to the marriage and that there are other grounds for so doing, exemptany person from the operation of this Regulation.

13. Power to relax.- Where the Corporation is of the opinion that it is necessary or expedient so to do, it may, by order,for reasons to be recorded in writing, and in consultation with the Prasar Bharati Board, and with the prior approval of theCentral Government, relax any of the provisions of these Regulations with respect to any class or category of persons.

14. Saving.- Nothing in these Regulations shall affect reservation, relaxation of age-limit and other concessionsrequired to be provided for persons belonging to the Scheduled Castes, the Scheduled Tribes, ex-servicemen and otherspecial categories of persons in accordance with the orders issued by the Government from time to time in this regard.

Note - 3: The sanctioned strength of the posts in various grades shall be allocated to the two media from time to time, insuch numbers as may be determined by the Corporation.

Note - 4: There will be complete mobility of officers between the two media as there will be common seniority list. Afterinitial appointment and allocation of media, inter-media transfers would be made, depending upon functionalconsiderations, with the approval of the Chief Executive Officer, Prasar Bharati. Such officers would, however, be givenan orientation training, if required, before such a transfer is effected.

(ii) passed Section A and B of Institution Examinations of the Institutions of Engineer(lndia); or(iii) obtained a Degree or Diploma in Engineering from foreign university or college or institution as may be

recognised by the Government for the purpose from time to time; or(iv) passed Graduate Membership Examination of the Institute of Electronics and Telecommunication
