The attached plan illustrates the subject property location. The area under discussion is currently proposed to be subdivided by this development application. The Plan of Subdivision will create development blocks which will be subject to future land use planning development approvals (site plan applications). Future site plan application proposals will ultimately require noise impacts to be evaluated with respect to that specific development proposal. As part of the pre-consultation meeting with the Town and Regional staff, an evaluation of the proposed development using the Ministry of the Environment D6 Guidelines was requested. The following noise assessment is provided in response to this request as it was subsequently determined that a full Noise Study will not be required. The subject lands are zoned Light Employment (E1) and Arterial Commercial (C3A) along Upper Middle Road. Development of these lands may pose a noise impact on the nearby residences and institutional uses along Ninth Line and Upper Middle Road unless they are appropriately mitigated during the development of individual parcels. We note that the residences along 9th Line are also designated as Business Employment in the Town’s Official Plan and zoned Light Employment (E1) similar to the subject lands. Major noise sources that could potentially impact the nearby residences could include, but are not limited to, stationary sound sources (e.g. noise emanating from mechanical equipment and activities within the site). On-site stationary sound sources that are normally associated with business uses are typically and predominantly comprised of truck activity and HVAC (Heating, Ventilation and Air Conditioning) rooftop units as well as other more site-specific sources of sound. These noise sources and their associated impacts need to be evaluated when individual site specific uses are developed. Each individual land owner/developer shall be responsible for submitting a detailed noise study for their development proposal in accordance with the site plan application requirements of the Town of Oakville and Region of Halton. Accordingly, a condition of Draft Plan Approval condition may include the requirement for a noise report to be prepared by a Qualified Professional Acoustical Engineer, in order to provide noise attenuation recommendations per the current Ministry of the Environment LU-131 and NPC-205 guidelines and any subdivision or site plan agreement requirements as requested by the Town or Region.

The submitted noise study along with any recommended noise attenuation measures should demonstrate that the site produced sound levels do not cause adverse noise impacts based on the Town of Oakville’s and the Ministry of the Environment’s LU-131 and NPC-205 noise guidelines (and any other relevant future noise guidelines). Investigated noise control measures should include, but are not limited to, acoustical barriers and screening of on-site activities (eg. truck operations, HVAC units, etc).

Finally, the inclusion and/or construction of warranted on-site noise control measures will need to ensure sound level compliance with the Ministry’s and Municipality’s noise criteria and guidelines in order to avoid any future noise disturbances on adjacent noise sensitive areas. Based on the proposed concept plan, and the existing adjacent land uses, it is anticipated that on-site noise control measures implemented at the noise source can be supported on the individual parcels for the overall concept development.

Furthermore, it should be noted that there are no significant elevated noise sensitive areas (eg. high-rise condominiums) identified surrounding the proposed development area, which may overlook the development. As such, most on-site noise sources should be sufficiently mitigated with the incorporation of on-site acoustical barriers and screening at-grade and/or atop portions of the building roofs. In addition, existing ambient road traffic sound levels from mainly Highway 403, Queen Elizabeth Way, Upper Middle Road, and Ninth Line should normally raise existing background sound levels at times during the day and thus lessen some of the noise impacts from the proposed development uses.

In conclusion, the noise impacts along with appropriate noise mitigation measures for the individual parcel sites will be addressed during the site plan application process as part of the development and approvals process for individual parcels.
