Environmental CoreEnvironmental Core Section 202.5. Natural resource planning areas.

There hereby are established planning areas to protect natural resources of countywide significance. The natural resource planning areas consist of lands designated natural resource management area which are governed by the county comprehensive plan on the effective date of this section, regardless of past or future annexation. The county council may reduce the planning areas by ordinance. The county comprehensive plan in effect upon an annexation shall prevail over conflicting municipal plan or ordinance provisions within natural resource planning areas until: (1) the expiration of ten years; (2) an interlocal planning agreement after this section becomes effective; or (3) county council consent to a municipal plan amendment which conserves natural resources. All plan amendments within ten years following an annexation require consent unless such land is subject to an agreement satisfying this section.

Board, and each municipality shall adopt interlocal agreements addressing the following issues on or before January 1, 2008:

a. Community Visions as authorized by law. b. Joint visions for unincorporated areas surrounding cities c. Potential future annexation areas d . Primary and Secondary Urban Service Areas e. Coordinated transportation levels of service f. Public school facilities planningIn the event that agreements cannot be reached on

any/each/all of these areas, then any/each/all of the six areas of Interlocal Planning Agreements outlined above will be decided by the Smart Growth Commission .

Smart Growth Commission. Section 202.3 of the Charter shall be amended to re-authorize the Growth Management Commission as the Smart Growth Commission. It shall consists of seven members consisting of three members of the County Council approved by VCOG, three mayors selected by VCOG and approved by the Volusia County Council, and a member of the Volusia County School Board. The commission shall have the responsibility of resolving conflict in required interlocal planning agreements and in resolving conflicts of consistency among the county and municipalities in Comprehensive Plans.
