It contains the positions and candidates who will appear on the ballot and the dates, times and locations of voting for your unit. This issue also contains state- ments and photographs submitted by candidates. The dates, times and locations of voting for your unit are listed sepa- rately by division—Hawaii, Maui, Kauai, and Oahu—and sorted by unit number. Look up your unit number or company name and take note of the dates, times, and loca- tions indicated for your unit. For most members, THERE WILL BE NO OTHER OFFICIAL NOTICE OF THIS ELECTION. Some units may post this notice on their union bulletin boards, but this is not required for all units. In a few cases, 400 meet in 25th ILWU Local 142 Convention where there is an error or change in this notice, members may receive an updated notice in the mail. However, for all other members, this will be your only notice of this election. Candidate statements All candidates in the upcoming ILWU Local 142 elections had the equal opportunity to submit a photo- graph and statement which would be printed in this issue of the VOICE of the ILWU. The deadline for submis- sion was 4:00 pm, September 30, 2009. The statements were limited to 200 words and those statements longer than 200 words were cut to the last complete sentence. Elections Committee The Elections Committee of ILWU Local 142 is made up of one represen- tative from each Division. They do this by meeting in Convention to decide the policies and programs of the union, set the finances and budget, and make all other rules which govern the union. The Conven- tion is the highest governing body of the union. It is held once every three years in the month of September. This was the 25th Convention and it was held from September 15-18, 2009, at the Sheraton Waikiki Hotel in Waikiki, Honolulu. Approximately 367 rank and file members from ILWU units throughout the State of Hawaii attended the Convention. About 39 fraternal delegates (retir- ees) and guests from Mainland ILWU locals and elsewhere were also in attendance for a total of 406 participants. Maui Division sent the largest group with 95 participants, followed by Oahu with 90, then Hawaii with 67, and Kauai with 35 participants. The theme of the Convention was “Unity, Equality, and Rank & File Democracy.” The work of the Convention took four days of meetings and discus- sions to complete. On the first day, delegates worked in one of four committees: Constitution; Officers’ Report, Organizing, and Resolutions; Contract Administration; and Pro- grams, which included membership services, publicity, education, and political action. On the second day, the Convention adopted 14 constitutional amend- ments and a budget for the next three years. One amendment to the ILWU Constitution creates a long- shore division within Local 142 and another amendment increases dues from 2.0% to 2.5% to help the union get through a financial crisis. On the third day, delegates ap- proved reports on the work of the union and adopted resolutions. On the fourth and last day, delegates nominated the candidates for the three top officers of the union and the industrial grouping members of the local executive board. Isaac Fiesta, Jr. and Jason Medeiros were nominated for the office of Local President; Donna Domingo was nominated as Local Vice President; and Guy Fujimura was nominated as Local Secretary-Treasurer. President Fred Galdones did not run for re-election as he will retire at the end of this year. Kauai Division Director Clayton Dela Cruz will also retire this year. Resolutions honoring the two ILWU leaders were adopted by the Convention. The actions of the Convention must be submitted to the member- ship of the union for their approval. Brothers and Sisters,I am Isaac Fiesta, Jr. I was raised

in the small plantation town ofHonomu, where I continue to livewith my wife and family. In Septem-ber 1968, I started at PepeekeoSugar Company, as a knapsacksprayer ending as garage purchasingclerk.

I am a member in good standingfor over 40 years serving as a chiefsteward, a union safety representa-tive, and Steward Council Chair. InApri1 1991, Brother Bo Lapeniaappointed me as a Hawaii DivisionBusiness Agent. The various units Ifaithfully worked with are: hotels,general trades, supermarkets,healthcare, longshore, and agricul-ture.

I will strive to preserve wages andbenefits under our collective bargain-ing agreements and humbly ask foryour support. If elected, I commit toworking with the LEB, LEC, and theDivisions to strengthen our union.

I served on the Hawaii CountyPlanning Commission for five yearsand the State Land Use Commissionfor eight years.

My experiences includes 18 yearsas Business Agent, administrative,PAC, mobilizing, organizing, repre-senting members for workmancompensation claims and unemploy-ment hearings, and negotiating firsttime and re-opening contracts.Organizing is the blood life of ourunion.

I have been a member of ILWUUnit 4402 Love’s Bakery since 1974,serving as a steward, Unit Chair andChair of the statewide bakerynegotiation committee. I have been adelegate to International and LocalConventions since 1977. In organiz-ing, I have made house calls, writtenleaflets and participated in planning.I have taught classes. I have beenthe Union’s spokesperson in negotia-tions. I am the Local’s PoliticalAction Coordinator and have testi-fied and lobbied at the Legislature.As Secretary-Treasurer since 1985, Iam responsible for our finances andrecords.

I believe that the Union’s strengthis brought forth through our collec-tive leadership, drawing togetherand using the power of our solidarity.Our Convention has adopted aprogressive program. Leadershipmust unite us in implementing ourprinciples and policies.

I’ve been a member for 27 years, Iworked at the Maui Lu Resort unit2502 as a cashier, then a lead FrontDesk Clerk, in the early 80’s I servedas a Steward, Unit Secretary Trea-surer and the Unit Chair, I alsoserved as a Division Trustee, LocalExecutive Board Member, the PACchair for Maui Division, and servedin various committees.

The past three years has given methe opportunity to expand my abili-ties in negotiations, and in theadministration of the Union invarious capacities.

So, with that thought, I don’t havea list of promises, or the solution tothe awful financial mess that the lastfew years have given us. Aloha Everyone,I want to thank all of you for the

opportunity to possibly represent youas a Business Agent for the island ofKaua’i.

My name is Alan King Kimura,and the reason for my nickname is, Iam an Elvis fan, and have been formany, many years.

I come from the North Shore, anemployee of the Princeville Operat-ing Company, where I have beenworking for the past 34 years in theProject Maintenance department.I’ve worked as a bell hop, housekeep-ing, golf course, and maintenance.While in the maintenance depart-ment I started off at the very bottomand worked my way up to First ClassLeadman position.

I have been unit chairman in ourunit for over 20 years. While aschairman I’ve experienced all differ-ent types of situations, andchallenges, growing along the wayboth personally and professionally.

I now feel I am ready to take thenext step, along with new challenges,and new heights of my future en-deavors.

In the past, I served as a Division Representative, Business Agent and ampresently the Maui Division Director. However, the past three years havebeen the most trying times of my 30 years as a full-time officer of the ILWULocal 142. Due to recent economic conditions, the union gave relief to some ofthe companies that we represent. However, we made sure that any assistancewe gave to these companies will be restored to our members over the life ofthe agreement.

It was with the help of the Unit Leadership and Business Agents that wehave been able to negotiate improvements in a majority of the CollectiveBargaining Agreements with companies in Maui and Lanai. We were alsoable to have some non-resort companies join the General Health and WelfareTrust Fund and enroll more hotels into the Health and Welfare Trust Fund.In addition to this, we continue to assist members with their workers compen-sation, Social Security and pension benefits.

Our goal is to ensure that in the long run, we save our members jobs to sowe all have a bright future to look forward too.

I learned the Union values of hardwork and dedication early in life andcontinued the service to the Union asa member of Foodland Super Marketstarting in 1971. I started serving asa Unit officer in 1991 and I partici-pated in every single negotiationsince then. In 2001 I was appointedto serve as Business Agent where Ihave tried to pass on the values I’velearned to those I serviced.

My name is Dillon Hullinger and I have been an ILWU member for thepast 20 years working for Foodland Supermarket. I have taken an active rolein the union for the past 15 years as a steward, a Vice Chair and for the past8 years serving as the Foodland Unit Chair. I participated as a committeemember in the last 4 Foodland negotiations from 1997 and in the 2003 and2007 I served as the Unit Negotiations Committee Chair. I also had theopportunity to attend the International Conventions in 2000, 2003, 2006, &2009 and the Local Conventions in 2000, 2003, & 2009. I have been active atthe Division level participating in the DEB Meetings, PAC activities andorganizing activities. I have learned a lot by participating and being involvedin these union activities.

Division Director Dave Mori is one of the most experienced and knowledge-able leaders in our Union today with over 30 years of dedicated experience.Although Dave is running unopposed in his third-term as Division Director,he gratefully thanks every member for his/her support over the past sixyears.

Dave started his humble beginnings in the ILWU in 1976 as a field workerat Oahu Sugar and quickly moved up to become a journey machinist. He wasfirst elected Unit Secretary/Treasurer in 1978, and served as Unit Chair andDivision Trustee before being elected as a Business Agent in 1991. He hasserved as Division Director since 2004.

Under Dave’s leadership over forty different Units have successfullynegotiated the best possible contracts, many of them newly organized Units.As Division Director he continues to negotiate good contracts and helps toorganize the unorganized by mentoring and educating others.

Aloha, my name is Brandon Bajo-Daniel and I have served as abusiness agent for almost 4 years. Irepresent Air Liquide, Del Monte,Dole, HARC, Links at Kuilima,Mililani Town Association and theSimmons Mattress Company. I amalso a co-coordinator for the UnionSports.

In 1979 I joined the rank and fileand became actively involved in 1984as the union steward for Del Monte,and then as their Unit Chair up untilmy appointment as Business Agent.My other experiences have been as anominated delegate for the Local andInternational Conventions, a mem-ber of the state PAC committee, Sec.and Chairman for the PineappleStatewide Negotiating Committeeand organizer for Dole Tropical.

My focus these past 4 years hasbeen about “integrity of the work-place”; by representing the integrityof the rank and file and the value oftheir work, and by being the re-minder to management about theirpractices. I am optimistic that with hardwork we can pull through thesetough times together.

I became a member in 1990 when Istarted working at Foodland Super-market. I eventually became aGrocery Clerk and served as a ShopSteward and later served as a UnitOfficer. I also served on the LocalExecutive Board from 2000 to 2003.This gave me an opportunity toreally see how the Union works forus. Prior to being elected I served asa temporary Business Agent whichprovided me an opportunity to learnthe basics of the job.

If you were born in another country and arein the U.S. as a lawful permanent resident,you know what a “green card” is. A green cardallows an immigrant to live and work in theU.S. legally. But since 1989, a green cardmust be renewed every ten years.

Unfortunately, some workers are beingreminded about this reality when their ex-pired green cards prevent them fromcontinuing to work. In some cases, it’s be-cause the worker is applying for a new job. Inother cases, it’s because the worker’s currentcompany is being taken over by new manage-ment which requires all employees tore-apply.

By law, all employers are required to com-plete an I-9 form within three business daysof hiring anyone. The form requires theemployer to verify the prospective employee’sauthorization to work in the U.S. by review-ing documents that establish identity andwork authorization. All documents must beunexpired.

If you are not a U.S. citizen but are a lawfulpermanent resident with a green card, checkthe front of your green card to see if it has anexpiration date. You should file an I-90 formto renew your green card six months beforethe expiration date. The fee is $370, includingfingerprinting.

You will not lose your permanent residentstatus if your green card is expired, but youmay have difficulty getting a new job withouta valid green card. Also, you should carryyour green card with you at all times. So besure to renew your green card before theexpiration date.

If your unit voted to participate inthe ILWU VEBA Trust, you shouldhave received a “Benefit Statement”that shows how much was contrib-uted on your behalf for 2005, 2006and 2007.

This is not a bill. It shows you howmuch was contributed and where thegaps in contribution are. If you don’thave at least $36 credited to youeach year, you may want to make apayment to bring your account up todate. Convention adopts policy to promote the VEBA TrustAfter a lively debate, the 25th

Convention adopted a resolution tosupport and promote the VEBATrust for retiree medical benefits.The Trust was started by the unionin 2005.

ILWU units must vote to join theprogram and pay the $3 a monthcontribution on behalf of theirmembers. The $3 comes out of theunit fund. Members are also encour-aged to make additional“supplemental contributions” ontheir own, which will increase theirbenefit when they retire.

Units which have not yet joinedthe program may still vote to join theVEBA Trust.

RCA-1 - Resolution to

promote the VEBA TrustMedical coverage is crucial to

everyone’s well-being. With insur-ance, health care can be affordableand accessible. Without insurance,however, a person must decidebetween getting needed health careand doing without, leading to poten-tially more serious and costlymedical conditions.

ILWU International PresidentRobert McEllrath was one of ninenew vice presidents elected to 52-member AFL-CIO Executive Council.This will give the ILWU a greatervoice in helping to shape our nation'slabor policies at the AFL-CIO.

Delegates to the 2009 AFL-CIOConvention held this September inPittsburgh, PA, also elected RichardTrumka as the labor federation’s newpresident. Trumka was nominatedby outgoing President John Sweeney,who praised his energy and dedica-tion.

women were elected as executiveofficers of the 11.5 million memberAFL-CIO. Arlene Holt Baker waselected Executive Vice President andLiz Shuler was elected Secretary-Treasurer.

UNITE-HERE also announced tothe Convention they would rejoin theAFL-CIO. This should put an end tothe anti-ILWU activities of theHawaii local of Unite-HERE whichcompetes with the ILWU in organiz-ing hotel workers.

Yet for many ILWU members,medical coverage ends just whentheir need is the greatest. Very fewILWU members have medicalcoverage when they retire. Instead,they are forced to purchase medicalinsurance on their own or pay for allmedical expenses out-of-pocket until

they become eligible for Medicare.That is why delegates to the Local

Convention in 2003 took action toestablish a Voluntary EmployeeBeneficiary Association (VEBA)Trust when sufficient numbers ofmembers voted to participate in theprogram. By 2005, after numerousmeetings with members on allislands, the VEBA program was putinto place and contributions to theTrust began. With these contribu-tions, participating members areexpected to receive a benefit towardpayment of expenses for medicalcosts when they retire.

However, the amount that amember may receive when eligible islikely to be small, even with contri-bution investments, because themonthly contribution itself is rela-tively small ($3). That is why theLocal encourages members partici-

pating in the VEBA Trust to increasetheir monthly contributions withvoluntary Supplemental Contribu-tions.

Supplemental Contributions maybe made at any time and in anyamount, but the earlier the contribu-tions are made, the greater thepotential for investment earnings.

NOW THEREFORE BE ITRESOLVED that the 25th Conven-tion of ILWU Local 142 encouragesunits to participate in the ILWULocal 142 VEBA Trust to allow unitmembers to benefit from post-retirement benefits; and

BE IT FURTHER RESOLVEDthat the 25th Convention of ILWULocal 142 also encourages membersof participating units to considerSupplemental Contributions toincrease future benefits.

A. YEARS OF CREDITThe language for the “YEARS OF CREDIT” on Page 12, paragraph1 of your SPD dated April 2007 is revised as follows:

“You will accumulate a Year of Credit for every twelve (12) monthsof Required Contributions or the equivalent of twelve (12) monthsof Required Contributions. Your Years of Credit will be used todetermine when you are eligible to receive retiree benefits under theFuture Retirees Plan (see pages 12 to 14).”

II. AMENDMENT TO RULES & REGULATION FOR FUTURERETIREES PLAN

The Board of Trustees at their meeting on June 3, 2009, amendedArticle VI “Forfeitures” sections 6.2 and 6.3 to add language formember’s “Transferring From One Unit to Another Unit”. NOTE: Thislanguage will also be added to “MAINTAINING ELIGIBILITY” onPages 8 and 9 of your SPD dated April 2007 as follows:

Exception: “The Member’s account shall not forfeit at the end of asixty (60) month continuous period or one-hundred twenty (120)months continuous period, whichever is applicable, when the Membertransfers from one participating unit to another participating unit,due to a change in employment, as long as the Member hascontinued Required Contributions in the new participating unitwithin 30 days of Member’s date of termination or transfer from theformer participating unit.”
