Run-off elections may be held tonominate candidates for Local 142titled officers and executive boardmembers on September 18, 2009.

The Local 142 Constitution andBylaws requires a run-off election ifmore than two candidates are nomi-nated for each office.

Declared candidates for theseoffices have the right to inspect thelist of Convention delegates betweenAugust 15 and September 15, 2009.

An election by secret ballot is being conducted by mail to determine the selectionof ILWU Titled Officers, International Executive Board members, and, for Long-shore Division locals only, Coast Committeemen. The mail ballot procedure is theonly method being used for voting in this election.

The election is being conducted pursuant to the ILWU Election Rules and Procedures adopted atthe April, 1994 Convention and as subsequently amended. No later than Monday, July 27, 2009ballot packets will have been mailed out to all ILWU members listed on the Voter Eligibility List.

a new Friendship and Solidarity Agreement which calls for both unions to

take all legal action to support each other.

Local 142 members from each industrial group meet to nominate their del-

egate to the International Executive Board (IEB). The IEB meets three times a

year and is the second highest policy making body of the International Union

between the Conventions. Local 142 has 6 delegates on the IEB—one from

each industrial group and the Local 142 President.

The ILWU Convention rotates toone of the seven areas of the ILWUevery three years. The last Conven-tion was held in 2006 in Vancouver,Canada. The next Convention in2012 will be held in Southern Cali-fornia. Hawaii will host theConvention in 2015. The Conventionwill be held in Oregon in 2018, inNorthern California in 2024, and inCanada in 2024.

A total of 317 delegates attendedthe Convention. The delegates areelected by the members of ILWUlocals in California, Oregon, Wash-ington, Alaska, Hawaii and Canada.Local 142 Hawaii sent 117 delegates.In addition, there were 31 fraternaldelegates from ILWU pensionergroups and women’s auxiliaries.

Maui Division was the largestgroup in Local 142 with 52 delegates.Oahu Division had 38 delegates,Hawaii Division sent 14 delegates,and Kauai had 13 delegates.

The business of the Conventionkept the delegates working hard forfive days and a few evenings. TheConvention approved a budget forthe next three years, adopted 7constitutional amendments, 5program policies, and 30 resolutions.All actions of the InternationalConvention take effect upon adoptionby the Convention.

Officers nominated

On June 12, the last day of theConvention, delegates nominatedcandidates for the union’s titledofficers and executive board. Interna-tional President Robert McEllrath,International Vice President, Ha-waii, Wesley Furtado andInternational Secretary-TreasurerWillie Adams will run for re-electionto their offices. Incumbent VicePresident, Mainland, Joe Radisichwill not seek re-election—he nomi-nated Ray Familathe to run for

International Vice President, Main-land. All four candidates are runningwithout opposition.

The following candidates werenominated to represent Hawaii onthe International Executive Board:Sam Kaaihue (Longshore grouping);Francis Kamakaokalani (GeneralTrades grouping); Cyrus Kodani(Tourism grouping); and AuroraRaposas (Sugar grouping). DouglasCabading and Harold Gouveia were

nominated to represent the Pine-apple grouping and will face arun-off election to determine thewinner.

Other ILWU areas also nominatedtheir candidates for the InternationalExecutive Board, but those candidateswill not appear on the Hawaii ballot.The International Election is con-ducted by mail and Hawaii membersshould receive ballots for the Interna-tional Election in July.

ILWU democracy is unique among American unionsin that rank-and-file members make the policies thatdirect the work of their International union. They dothis once every three years at a five-day Conventionwhich was held this year in Seattle, Washington fromJune 8 - 12, 2009.

On the first day of the Convention,Local 142 President Fred Galdonesrequested that the Convention bededicated in memory of Ah QuonMcElrath, who passed away onDecember 11, 2008. The delegatesunanimously approved the requestand stood for a moment of silence inrespect for Ah Quon’s lifetime ofdedication and contribution to theILWU, the union movement, and allhumanity.

International Solidarity

International solidarity was atheme repeated throughout theweek. On the second day of theConvention, the ILWU and the AllJapan Dockworkers Union(Zenkowan) renewed the SolidarityAgreement between the two unions.

Akinobu Itoh, President of the AllJapan Dockworkers unionZenkowan, recalled the 50-yearspecial relationship between theILWU and Zenkowan and how bothunions took action to support eachother.

More recently, President Itoh tooka leading role in building extraordi-nary support among Japaneseunions for ILWU members of thePacific Beach Hotel in Waikiki. Thehotel draws most of its business fromJapan and Local 142 has called for aboycott to put pressure on the hotelowners, HTH Corporation. ILWUmembers have been fighting forunion recognition and a fair contractat the hotel for seven years. The

hotel owners have violated numerouslabor laws and recently fired 31workers who were strong unionsupporters and members of the rankand file negotiating committee. SeeResolution R-26 thanking Zenkowanand Rengo for their support of thePacific Beach Hotel workers.

Paddy Crumlin, National Secre-tary of the Maritime Union ofAustralia (MUA), challenged theILWU to take the lead in building anew, progressive society. “An injuryto one is an injury to all” is some-thing that goes far beyond industrialrights and into the area of humanand civil rights and lies at the verycore of this union,” Crumlin said.“You built a union of political inde-pendence and progress, that stands

on an understanding of your indi-vidual and collective sell-worth anddignity...That is the hope for thefuture and that’s the hope for work-ers here and everywhere,” Crumlinconcluded.

Russell Mayn, the AssistantGeneral Secretary of the MaritimeUnion of New Zealand, spoke abouthow international solidarity helpedthe workers of Port Naproxen, a verysmall port in New Zealand.

The employer were trying to breakthe union just before the Christmasholidays and workers were afraidthey would have no food for Christ-mas or money to buy gifts for theirchildren.

Mayn appealed to the MaritimeUnion of Australia and the Austra-

lians came up with $20,000 to helpthe members of Port Naproxen getthrough Christmas.

The workers won and now the Portis 100 percent unionized with 80 full-time workers.

Foreign Affairs and

International Issues

The ILWU has never shied awayfrom taking positions on worldaffairs. As Harry Bridges said to the1947 Convention: “There are manywho hold to the belief that in mattersof foreign concern of foreign policy weshould let well enough alone. Thereare plenty who think a union shouldnot speak out, fight for or criticizethe foreign policy of our government;that it should be a matter of ourgovernment, right or wrong, inmatters of foreign policy. We have

Star Medeiros told the Convention how her mother, Edwina Smythe, was thefirst woman elected to the International Executive Board in 1981. Gender biascontinues to create a glass ceiling which holds women back on the job.

Commitment to Organizing

Organizing will remain an impor-tant commitment of theInternational union. To allow moreflexibility to deal with economicemergencies, the Convention ap-proved a change that will allow theInternational union to spend up to 30percent of the union’s income onorganizing.

The previous policy required theInternational union to reserve 30percent of the union’s revenues fororganizing. This money could not beused for any other purpose except fororganizing. There is sufficient moneysaved in the organizing fund to takecare of the needs of the organizingprogram for the immediate future.

The change in policy will allow theInternational Union to build up areserve fund, take care of otherprograms such as education andinternational solidarity, and stillspend up to 30 percent on organizingif needed.

ILWU Leaders Set Example

A long line of speakers paid tributeto retiring ILWU leaders RichardCavalli, John Tousseau, and JackWyatt, Sr. The democratic, rank-and-file, and progressive culture of theILWU has produced many great andexceptional union leaders. Thespeakers spoke about the commit-ment, integrity, class, dedication,knowledge, and sacrifice of theseveteran leaders who dedicated alifetime to the ILWU. They told theConvention how they learned about

never adhered to that belief. And thereasons are simple: the question ofour welfare, our own interests, ourown existence.”

The Convention called for thewithdrawal of troops from Iraq andAfghanistan, the end to the Israelisiege of Palestinians in Gaza, freethe Cuban 5, normalization ofrelations with Cuba.

Health Care for All

Health care reform was a big issueand the Convention approved fourdifferent resolutions dealing withchanging the U.S. health caresystem. Resolutions called for

building a mass movement to supporta single payer system like Canada,support of House Resolution 676 foran “Expanded and Improved Medi-care for All”, universal coveragewhere health care is a right of allpeople, and looking at all alternativessuch as the health care systems inGreat Britain, Germany or France.

Political Action

The need to continue union politi-cal action, reverse the damage of theBush Administration, restore civilrights taken away in the name offighting terrorism, vacate the anti-labor policies of the Bush labor boardwere some of the political goalsadopted by the Convention.

The passage of the Employee FreeChoice Act by the US Congress mustbe a major political priority for theILWU. Members were urged tocontinue their voluntary contributionsto the ILWU Political Action Fundand to work with their political actioncommittees and district councils.

Equality and Civil Rights

Equality and advancing humanrights remain core values of theILWU. The country has come a longway in fighting discrimination andprotecting civil rights, but much moreneeds to be done.

Equal rights for women, immigra-tion reform, worker privacy andabolishing identification cards, abol-ishing the death penalty were some ofthe civil and human rights issues thatcame before the Convention.

The Union Budget

The Convention adopted a budgetwhich recognizes the difficult eco-nomic times faced by all sections ofthe union. The budget maintainsexisting programs of the Interna-tional at the same levels with smallincreases to account for expectedinflation. It includes a modestincrease in per capita dues of $.50and $.75 cents in 2009, ten cents in2010, and no increase in 2011. The$.75 cent increase is on those localswhose members earn more than$90,000 a year.

The increase in the International’sper capita dues will not be passed onto members of Local 142 Hawaii.Local 142 pays the International percapita dues directly out of its generalfund.

The Convention approved anincrease in the Titled Officers’salaries, but due to the financialhardships faced by all ILWU locals,the Titled Officers (president, vice-presidents Hawaii and Mainland,and secretary-treasurer) havesuspended their May 1, 2009 salaryincrease.

The ILWU Constitution providesthe officers with an annual wageincrease based on the averageincrease in the pay rate of longshore,Northern California warehouse, andLocal 142’s major hotel agreements.

C-1 Convention Locations -updates the rotation of the Conven-tion to the seven areas of the ILWU:Southern California Area - 2012;Hawaii Area - 2015; Oregon/Colum-

bia River Area - 2018; NorthernCalifornia Area - 2021; ILWUCanada - 2024; Washington/PugetSound/Alaska - 2027; SouthernCalifornia Area - 2030.

C-2 Political Action Fund -revises language referring to the“diversion” as that language is nolonger appropriate. This is a house-keeping amendment and will have noeffect on how the fund is currentlyoperating.

C-3 Titled Officers Salaries -updates titled officers salaries whichis based on the average of the per-centage increase in the base rate ofpay in the ILWU’s three majorindustries— Longshore, NorthernCalifornia Warehouse, and Local142’s major hotel agreements.

My name is Wesley “Wes” Furtado and I amseeking re-election as your ILWU International VicePresident-Hawaii.

RANK AND FILE EXPERIENCE - As a rank-and-file union member of the Longshore industry Igained experience as a shop steward and negotiatingcommittee member. It was these experiences thatignited my passion for unionism and helping fellowmembers.

ORGANIZER - From the 1980s to 2000s we helpedorganize large numbers of workers into our union.Those workers were employed at hotels, golf courses,agriculture companies, transportation companies,maritime companies and more. Working with a lot ofdifferent people from all different backgrounds andcultures taught me a lot about my fellow unionmembers. As part of the Hawaii organizing depart-ment, we led many organizing campaigns andassisted with first campaigns and contract renewalsin tourism, general trades, agriculture companiesand the maritime industry. Although my personalrole has changed over the years (from organizer, toBusiness Agent, to International Representative, toInternational Vice-President) my passion tostrengthen expand our union remains strong.

HAWAII ORGANIZING - As International VicePresident Hawaii, we have worked hard to adaptand improve how our union operates. In Hawaii wehave adopted a strategic organizing strategy thathas greatly improved our success and efficiency.This triennium has yielded high success rate fororganizing campaigns and achieving first contractsfor newly organized ILWU members. I personallynegotiated agreements to organize new units in themaritime industry and assisted with a hotel organiz-ing campaign and setting the tone for the firstcontract negotiations.

LONGSHORE NEGOTIATIONS - Over the last 12months I was directly involved with the Hawaii Long-shore Division Committee contract negotiations withLongshore and Inter-island Barge operation employ-ers. Hawaii Longshore agreements covers Longshore,Clerks, Mechanics and CFS-CY. Interisland Bargeagreements cover Longshore, Clerks, Mechanics, andOffice Clerks.

POLITICAL ACTION - In addition to grass rootseducation and mobilizing we lobby elected officials onnational and local levels and educate them on theinterests of working people and the Labor movement.Grass roots efforts of union members in home districtsmakes our political action program effective. I can tellyou that the contributions and efforts of individualmembers makes government officials truly listen whenwe meet them face-to-face to discuss issues with them.

If re-elected I will do my best to continue fightingto protect the gains that we have earned togetherand to organize new members into our union.

Brothers and Sisters of the ILWU:I am honored and proud to have the opportunity

to serve a second term as your InternationalPresident. I truly appreciate the support I havebeen given and the confidence that the membershave placed in me. The ILWU has been a part of mylife since I was young when my father got hisregistration. I was fortunate to get into theLongshore Division in 1969 and I have never lookedback.

During the 134-day strike in 1971, I learned tobe prepared in case we needed to strike again andthat this preparedness is another strength of ourunion. I attended the union meetings, workedwith and listened to the “Old Timers,” and learnedthe principals and history of our union. I countmyself fortunate to have met and heard our founder,Harry Bridges, when he spoke at meetings duringmy younger years.Being elected caucus delegate in the mid-‘80s, Ihave been at every convention and caucus since,watching our ILWU history unfold. I have servedthe union as a Coast Committeeman for four years,and been the International Vice-President for sixyears, before being elected President three yearsago.

I was elected to Small Port Negotiator for theLongshore Master Agreement in 1993 and again in1996. In 1999 as a Coast Committeeman, I waselected Co-chair for the negotiating committee,and in 2002 as Vice President of the Internationalwas Co-Chair of the Contract Bargaining, and in2008 as the ILWU president I was the NegotiatingCommittee Chairman. I also chaired the ShipboardGrain and In-House Grain Negotiations in thePacific Northwest, and assisted in the All AlaskaLongshore Negotiations and the Local 5 Powell’sBook negotiations. I served as an officer underthree of the five presidents the ILWU has had in its75-year history, giving me the experience and theknowledge to lead this union through the termahead.

Our nation is in a recession nearly as deep asthe Great Depression, and employers are usingthis as an opportunity to try and whittle at thenegotiated gains in all sections of our union. I canassure you I will lead based on my experience, mysense of right, and with input from the rank andfile. We must continue to build our Internationalrelationships as well as being a strong voice forlabor in the United States. We must be fair andright within our union, treat Locals equitably andminimize anything that divides us and weakensthe structure of our organization.

We need to educate our members to understandand maintain our history and loyalty as opposed toforcing the union to spend countless hours andhuge sums of money fighting within. My goal is tokeep our union strong, clean, and focused on thegreater good for the greater number of ourmembers. Again, I thank you for your support. Aninjury to one is an injury to all.

I am proud to say this is my 21st year in theILWU. For the last 16 years I’ve worked throughoutthe world expanding our international relationsand solidarity. I currently serve as InternationalAffairs Director for the Longshore Division andInternational. I have worked under the direction ofInternational Presidents David Arian, BrianMcWilliams, James Spinosa, Robert McEllrath,and the International Executive Board. During the2002 and 2008 Longshore contract negotiations Icoordinated our solidarity efforts worldwide withthe International Transport Workers Federation(ITF) and International Dockworkers Council (IDC)which helped our Longshore division on themainland secure successful contracts. But beforeall this, I began my career working at a railyardfacility in Southern California.

In 1987 the ILWU had just won an organizingdrive at the newly built $54 million ICTF railyardin the ports of Los Angeles and Long Beach. The175 workers overwhelmingly elected for ILWUrepresentation. I was hired shortly after the electionin 1988. The workers were excited about the futureand their new contract with Local 13’s AlliedDivision. In 1989 I was elected Business Agentrepresenting this unit which had grown from 175to 300 workers. I experienced many challenges tobuilding this unit which required the need toeducate shop stewards on grievance handling andarbitrations to better serve the membership. Inlate 1991 Southern Pacific Railroad, still bitterover the ILWU securing jurisdiction a mere fourmiles from the ports of Los Angeles and LongBeach, used their power and influence along withthe city, state, and federal politicians to justifytheir “Lockout” of the ILWU workforce. Thisstruggle received tremendous support from theentire ILWU family but was unfortunately lost. Iam proud to say that many workers that enduredthis struggle have moved up in the ILWU ranks invarious divisions/units and are our leaders today.

Having worked for many years as a casuallongshoreman I was registered to Class B Longshorestatus in 1995 with Local 13. Since then I havebeen elected to the Executive Board, Caucus/Convention Delegate and Business Agent. I alsoworked with the ILWU’s Organizing Departmentto organize the LAXT Coal Terminal in the Port ofLos Angeles.

My passion for organizing workers comes fromworking with the ITF Flags of ConvenienceCampaign fighting for the rights of seafarers thatcome from developing countries who are exploitedby ship owners. I get excited reading our richhistory written by great leaders and organizerslike Harry Bridges, Lou Goldblatt, Jack Hall andAh Quon McElrath.

I have worked with most all of the locals/divisions of the ILWU and Canada. I believe weneed strong local unions and a strong nationallabor movement, but the key to all this in the globaleconomy is having an international program andnetwork. I have helped to build the ILWU’s for 16years. My work has prepared me to take the nextstep by asking for your vote for International VicePresident, Mainland.

With my extensive knowledge and years of hardwork and dedication, it would be an honor andprivilege to be elected as an International ExecutiveBoard Member, to represent all Longshore workersin the State of Hawaii, and all my brothers andsisters of the ILWU.

Brothers and Sisters of the ILWU:With great honor and humility I’m seeking my

third term as International Secretary-Treasurerof this great union. I’m looking forward to talkingwith and seeing our membership as I hit thecampaign trail, and calling upon all ILWU membersthat we must recapture our spirit of enduranceand optimism. It is the struggle that shapes us,and it is the struggle we must shape. I’m very clearthat my work is still not complete, and the fire stillburns in my guts and the passion in my soul.

My varied ILWU experience includes LongshoreCaucus delegate for 10 years; four times conventiondelegate (2000, 2003, 2006, 2009); Chairman ofthe Coast Jurisdiction Committee; member of theCoast Legislative Action Committee with 10 yearsof service in Washington D.C.; member of theInternational Executive Board and IEB trustee;and for the last six years, I’ve served as yourInternational Secretary-Treasurer.

On the world stage on behalf of the ILWU Ihave traveled to Australia, Brazil, Holland,Germany, Belgium, South Africa, Vietnam,Singapore and Cuba. I have rolled up my sleeves,and have worked with all divisions of our union. Ihave worked without rest pounding the pavementin Washington D.C. to continue to buildrelationships with key players in both parties toraise the profile of the ILWU and to give our unionmore clout. I have devoted my time and energy toeducation programs, knowing we are nurturingour next generation of leaders who will take useven further. I also feel that we must do all withinour might to raise the bar in organizing becausethe ILWU and labor movement must survive andgrow; there is no other option.

Many of our members are hurting today. We’reexperiencing job losses, layoffs, and less work atthe ports, so all of us are in some kind of pain. Theeconomic recession is giving us a wakeup call. It’sclear that as members of the ILWU, we need toreach beyond the anxiety and the depression of thelast eight years and get back to our strengths. Wemust be adept at finding opportunity in adversity.The threats to our very existence, and consequently,that of our families, are the driving force behind usrebuilding our union to make it even stronger. Andtoday, Brothers, Sisters, the present stands sideby side with history; 75 years later we’re still here.

Mega Tips #11:Use tip trays with credit card insignaRestaurants often post signs informing customers thatcredit cards are accepted. These signs and other displays ofcredit card insignia can be seen on restaurant doors, windows,counters, menus, table tents, tip trays, and cash registers.Although it is not clear why, research has found that simplyseeing these insignia increases consumers’ willingness tospend money. So, whenever possible, you should use those tiptrays and folio booklets with credit card logos.

Michael McCall and Heather Belmont tested the effectsof following this suggestion at two establishments—a familyrestaurant and a cafe—in upstate New York. The presence orabsence of credit card insignia was manipulated in theseestablishments via tip trays, one set of which had credit cardemblems on them while the other did not. These tip trayswere randomly mixed, and servers were instructed to taketrays as needed from the top of the stack. At bothestablishments, customers tipped significantly more when thebill was presented on a tip tray containing a credit cardemblem. Tips increased from 16 percent to 20 percent of pre-tax bills at the restaurant and increased from 18 percent to 22percent of pre-tax bills at the cafe. This effect was not due toan increased use of credit cards to pay the bill. In fact, all ofthe cafe’s customers paid cash. Simply seeing the credit cardinsignia on the tip trays caused customers to tip an additional22 percent!

In light of these results, you should ask your manager tomake sure that all the tip trays or folio folders have creditcard emblems. These tip trays can be obtained at little or nocost from credit card companies and using them will increaseyour tips.

Mega Tip #10:Draw something on the check

Occasionally, waitresses will draw a “smiley face” on the

backs of checks. Perhaps, you or servers whom you know have

done this. These drawings are likely to have any of three effects

on consumers. First, they may personalize you to customers and

increase their empathy for you as a person. Second, drawings of

smiley faces may communicate to customers that you were

happy to have served them, which would ingratiate you to the

customer. Finally, seeing “smiley faces” drawn on checks may

simply make customers smile themselves and, thereby, improve

their moods. All of these potential effects suggest that drawing

a smiley face on the backs of checks will increase tips.

Bruce Rind and Prashant Bordia tested this possibility in a

study conducted at an upscale, Philadelphia restaurant. They

had a waiter and a waitress at the restaurant conduct this

study on lunch customers. Half of these customers received a

check on which the server had drawn a smiley face and half

received a check without the drawing. The decision about

whether a table received a smiley face or no smiley face was

made randomly at the end of the customer’s meal, just as the

server was about to deliver the check.

This manipulation significantly affected the waitress’ tips,

but had no statistically reliable effect on the waiter’s tips. The

waitress received an average tip of 28 percent when she drew

nothing on the check, but received an average tip of 33 percent

when she left a smiley check. Thus, drawing a smiley face

increased the waitress’s tips by 18 percent! In contrast, the

waiter’s tips averaged 21 percent when he drew nothing on the

check, but only 18 percent when he left a smiley check. This

decrease in tip size was not statistically significant, but it

suggests that drawing a smiley face may actually backfire for

waiters. The study didn’t explain why this was so, but

apparently smiley faces don’t seem normal coming from

waiters.

Based on the results of this study, I suggest that

waitresses can improve their tips by drawing smiley faces on

their checks. Waiters may still be able to personalize their

checks with drawings, but they will need to choose a different

object to illustrate. Perhaps waiters at an upscale seafood

restaurant could make a simple line drawing of a lobster on the

backs of checks. Alternatively, waiters could try drawing a

picture of the sun. Indeed, when Nicolas Gueguen tested this

idea at a bar in France, he found that drawing a picture of the

sun on checks increased the percentage of customers leaving a

tip from 21 percent to 38 percent. The drawing also increased

the average size of the tips that were left from 19 percent of the

bill to 26 percent.

The lessons from research are clear. You do not need to be

Picasso to draw larger tips front customers. So pick up a pencil

and start doodling!

—PROCEDURES—NOMINATION—September 1-15, 2009Nomination Petitions (ILWU-E-Form 14) signed by 25 members in good standingmust be submitted to the Local Secretary-Treasurer between September 1 andSeptember 15, 2009, inclusive. The Local President, Vice President, Secretary-Treasurer, and members of the Local Executive Board At-Large from theIndustrial Groupings shall be nominated from the floor at the Local Convention.

PRIMARY ELECTION (IF NECESSARY)—Nominations and primary election ofthe Local President, Vice President, Secretary-Treasurer and members of theLocal Executive Board At-Large from the Industrial Groupings shall be held on thelast day of the Convention (September 18, 2009).

ELECTION—November 14-20, 2009, to conclude 4 p.m. Friday, November 20,2009, but not to exceed five (5) days. The specific date for the election in your Unitwill be printed in the VOICE of the ILWU.

RUN-OFF ELECTION (IF NECESSARY)—December 7-11, 2009, to conclude 4p.m. on Friday, December 11, 2009.
