INSTRUCTIONS TO THE TENDERERS

1. Only such firms/contractor need tender who themselves are capable to undertake the job and can produce satisfactory evidence that they have necessary resources and organization set up for the same.

2. The tenderers are requested to submit the price schedule/Annexure “A” duly filled in item by item as required in these specification to facilitate the Board to prepare comparative statement. Failure to do so may prevent the tender from being considered.

3. Tenderers should state the earliest completion period for the work from the date of receipt of full instructions as to enable them to proceed with the work.

4. Any portion of the terms and conditions as laid down in the condition of contract form which is not clear to tenderer should be got clarified before submission of tender. Tenderers are requested to adhere to all clause of the contract form to facilitate finalization of contract.

5. The Price quoted should be after deduction/discount etc. and should be firm during the currency of the contract and no variation should be allowed for any reason whatsoever.

6. The Corporation does not pledge to accept the lowest rates or any tender and reserve the right to accept the whole or any portion of any tender as they may think fit without assigning any reason for non acceptance or selection whatsoever. The Corporation also reserve the right to order to increase or decrease the quantity of work in accordance with the conditions of Form ”A” of UPPCL/DVVNL. The quantity mentioned in the Quantity and Price schedule is tentative, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the competent authorities.

7. The earnest money amounting to Rs. 5,000 /- (Rupees Five Thousand only) in shape of FDR/Call deposit of a scheduled Bank payable at Agra, should be submitted in a separate envelope along with tender in favor of Superintending Engineer, Electricity Dist. Circle, Agra failure to do so may prevent tender from being considered.

8. A security/performance guarantee @ 10% of the value of contract shall have to be deposited by the Tenderer, of the contractual amount in the form of FDR/CDR/Bank Guarantee duly pledged in favor of Superintending Engineer, Electricity Dist. Circle, Agra, otherwise the same shall be deducted from the Contractor’s bill itself. The security and performance guarantee so deposited/deducted, whatsoever or in any manner, as per terms of agreement shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the Contract and subject to the condition that nothing has been found outstanding as Misc. against the contactor. However, the condition of Form ”A” of UPPC/DVVNL shall prevail in this direction.

9. The tender should be made valid for a period of 180 days from the date of opening of tender.

10. The successful tenderer shall be required to pay all legal charges that may have to be incurred for vetting the Contract documents and also the stamps, form etc. for the execution of agreement.

11. Any action on the part of tender to revise the price/prices and or to change the structure of price/prices at his own instance after the opening of tender may result in rejection of the tender and also debarring him from submission of tender to the Corporation atleast for one year.

12. The tenderers are required to submit the details of their past experience in connection with the execution of such work executed by them in past or in present in UPPCL/DVVNL or in any other similar public works department on the following Performa:-

13. The tenderer should enclose the list of experienced Engineer/Workers available with them for the purpose / job giving all full particulars about experience of the above

14. The work tender in question shall be completed within 30 days from the date of last issued of the material

15. Clearance of site shall also be given to the successful contractor by the supervising engineer well in advance but any delay in giving the same shall also not be counted in completion period and the delay on this account shall also be confirmed by the supervising engineer in writing so that relief may be granted accordingly.

16. Any work which may not have been specifically mentioned in the specification, but which in usual or necessary in the efficient working of work shall be deemed to have been included in the scope of work under the specification.

17. All the work shall be carried out as per RESPO specification and in accordance with Indian Electricity Rules 1956 or any revision thereof which may be issued during the currency of the Contract and the requirement of any other regulation in Act in India to which the work may be subjected.

18. The Contractor shall provide and arrange all necessary arrangement for safety of staff / labour /employees employed by him at site of work. The Purchaser Engineer of the Department shall not be in any way responsible for any accident, minor or fatal to any person at the site of work.

19. All disputes and claims shall be subject to Agra Court.

20. Payment for the work shall be made in accordance with the provisions as laid down in Form”A” of UPPCL from O&M/ Deposit/Section-5 /System improvement funds, by the Executive Engineer concerned. All the taxes applicable on work contract shall be deducted from the Contractor’s bill itself.

21. In case of delay in completion of work, the penalty @ of ½% per week and maximum 10% of Contracted value of remaining work shall be charged.

22. The Tenderers prior to submitting Tender shall ensure that all the relevant papers being submitted are properly signed & stamped.

23. The Contractors are required to mention their postal address complete in all respect where desired in the tender specification for correspondence purposes or any other legal purpose, whatsoever in any manner and if there is any subsequent change in the address takes place in future, in that event the same should invariably be intimated under registered cover in writing mentioning the Tender and its due date.

Special Terms & Conditions of Tender Specification No. 218/EDCA/2015-16 of Electricity Distribution Circle, DVVNL, Agra for the work of bifurcation of 11 KV Oocha feeder, 11

KV Sudrai feeder and 11 KV Umretha feeder against passed package No. 198, 199 and 201/2015-16 under jurisdiction of Electricity Distribution Division-III Fatehabad

SCOPE OF WORK

The Tender is for the work of bifurcation of 11 KV Oocha feeder, 11 KV Sudrai feeder and 11 KV Umretha feeder against passed package No. 198, 199 and 201/2015-16 under jurisdiction of Electricity Distribution Division-III Fatehabad which shall be carried out, as per provision of General conditions, Special conditions of the tender. If the successful contractor fails to execute the work at any stage, in that event the work shall be got executed from other outer agency, for which extra actual expenditure plus 15% supervision charges thereon shall be recovered from the contractor and the security shall be forfeited. Letter sent to this effect under Postal Certificate shall be considered enough for this purpose from the supervising engineer/ Superintending Engineer, Electricity Distribution circle, DVVNL, Agra.

SUPERVISING ENGINEER

Executive Engineer, Electricity Distribution Division-III, DVVNL, Fatehabad, shall be responsible for the successful completion of work on behalf of Dakshinanchal Vidhut Vitaran Nigam Limited, in accordance with the terms and conditions thereof .In the event of any conflict between the contractor and the Supervising Engineer, the decision of the Superintending Engineer Electricity Distribution circle, DVVNL, Agra, shall be final and binding upon both the parties.

EARNEST MONEY

The tenderers are required for submit the earnest money amounting to Rs. 5000.00 [Rupees Five Thousand only], in the form of FDR/CDR/ Bank draft, duly pledged in favour of Superintending Engineer, Electricity Distribution Circle, DVVNL, Agra, through the first part of the tender and accordingly the second part of tender shall only be opened only after receiving the proper and adequate Earnest Money through the first part of tender.

VALIDITY OF TENDER

Tenderers are required to submit their tenders valid for Ninety days and the validity certificate shall also be submitted to this effect on the proforma enclosed with the tender specification herewith.

PRICESThe tenderers are required to submit their rates and price as “Firm” and no price variation shall be allowed on any ground, and the tender of the nature of price variation shall be liable to be rejected out rightly.

SECURITY DEPOSIT & REFUND OF SECURITY

The successful contractor shall be required to furnish to the Corporation security deposit and performance guarantee @ 10% of contractual amount of the tender in the form of FDR/ CDR/

Bank draft, duly pledged in favour of the Superintending Engineer, Electricity Distribution Circle, DVVNL, Agra, or in any other terms as deemed fit and proper by the Superintending Engineer, EDC, DVVNL, Agra. Necessary stamp duty shall also be paid by the successful tenderer, which shall be liable to be refundable after receipt of successful completion report from the Supervising engineer of the contract and subject to the conditions that nothing has been found out standing as Misc. against the contractor. However the condition of From “A” of UPPCL, shall prevail in this direction.

INCREASE/ DECREASE IN QUANTITY

The Corporation reserves the right to order to increase or decrease the quantity of work in accordance with the conditions of Form “A” of UPPCL. The quantity mentioned in the Quantity and Price Schedule is tentative, and may vary 10 percent plus or minus, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the Competent Authorities.

ELECTRICITY RULES

The provisions as laid down in Indian Electricity Act 1910 and 1956 and rules made there after shall also be followed.

STAFF AND LABORER

All the staff and laborer required for proper and successful completion of work under this tender shall be arranged/ engaged by the contractor at his own cost, risk and responsibility. The contractor shall also make and provide all necessary arrangements for safety and security of the staff and labourer at the site of work and during the course of execution of work. The Corporation shall not in any way be responsible for any accident fatal or minor to any person, laborer, staff or any thigh what so ever in any manner, if takes place and also simultaneously the contractor shall also be responsible for any damage to the equipments or any other things what so ever in any manner and this shall be the entire responsibility of the successful contractor at his own cost. Staff and laborer insurance if any covered shall also be born by the successful contractor and no payment on this account and ground shall be made.

COMPLETION OF WORK

The work of tender shall be got completed within 30 days from the date of last issue of material but delay at Corporation end shall not be counted in completion period.

CLEARANCE OF SITE OF WORK

Clearance of site of work shall also be given to the contractor by the Supervising Engineer well in advance but any delay in giving the same shall also not be counted in completion period, and the delay on this account shall also be confirmed by the supervising engineer in writing so that relief may be granted accordingly.

PENALTY

A penalty @ ½% per week subject to maximum10%, and penalty as mentioned in the special conditions shall also be applicable and recovered from the contractor. Apart from this penalty as mention in the special condition shall also prevail.

INSPECTION OF CORORATION’S REPRESENTATIVES

The corporation’s representative shall be free to visit the contractor’s site stores and the site of work and the material of the Corporation under the possession of the contractor. The Corporation’s representative shall be given all help by the contractor in respect of inspection of the execution of work and also to inspect/ verify the Corporation’s material in the custody of the contractor.

All other rules and regulations such as Labour Laws, Contract Act, Compensation Act, what so ever related and may be related in any manner what so ever shall also be followed by the contractor.

JURISDICTION

The contract executed shall be governed by the Law of India for the time being in force and shall be subject to the jurisdiction of High Court of Judicature at Allahabad.

Tender in two parts are hereby invited from the reputed and well experienced firms / tenderers by the Superintending Engineer, Electricity Distribution Circle Agra for the work of reconciliation and revenue realization alongwith other associated works, for a period of 5½ month in EDD-IV, Kirawali up to 15:00 hrs of 06.10.2015 which shall be opened after 15:30 hrs. of 06.10.2015. The detailed tender specification can be sold from this office up to a day before of 06.10.2015 on payment of Rs. 220.00 (Rupees Two Hundred Twenty Only).

The First part of tender should contain Earnest Money amounting to Rs. 5,000.00 (Rupees Five Thousand only) in the form of FDR / CDR / Pay Order etc. duly pledged in favor of the Superintending Engineer, EDC, Agra along with other relevant & desired information / Tech. documents and the Second part of tender should contain rates only. Both the part of tender should be superscripted with Tender No., Part No. of Tender and its due date. Second part of tender shall not be opened if the desired information / document / Ernest money are not found intact in the 1st part of tender.

In case the opening day happens to be holiday, in that event tenders shall be opened on next working day at the scheduled time and date and accordingly tenders may be deposited / submitted. The undersigned reserves the right to reject or accept any or all the tenders in full or in part thereof without assigning any reasons thereof.

TERMS & CONDITIONS :-

1- SCOPE OF WORK:The works are to be carried out in EDD-IV, Kirawali on the departmental computers already installed in concerned Division offices. Various entries to prepare reports as mentioned in Annexure-1 are to be ensured after collecting data from records of the Division offices. Works shall be carried out in normal official working hours & even in late hours or and as per need on holidays also.

2- RATES :- Above rates are Firm in all respect.

3- AGREEMENT/CONTRACT PERIOD :The agreement period shall be effective as follows :

i) The Contractor shall start the work w.e.f. 15.10.2015 and complete basic data entry works within 15 days. This period shall be subject to availability of records and computer sets from concerned Division.

ii) Proper date of start of works shall be presumed from the date of completion of basic data entry works i.e. from the month for which required reports are submitted by contractor. Accordingly the period of agreement shall be effective for 5½ months

iii) The period of agreement shall be extendable on mutual consent of both parties.

4- MANPOWER AND MATERIALS TO BE ARRANGED BY THE CONTRACTOR:i) Contractor shall arrange sufficient manpower to carryout the works under consideration and

ensure timely payments to their personnel (if engaged for the works) in accordance with Industrial / Labour Laws / Rules. Such payments shall be released through cheque, and if required by the Executive Engineer of the concerned Division or Superintending Engineer of the concerned Circle, details of such payment made, shall be submitted by the contractor.

ii) For preparing hard copy and soft copy of data entered and reports prepared, all required computer stationary, papers, cartridge ink for printing, CD etc. shall be arranged by the contractor at his own cost.

5- RESPONSIBILITIES OF THE CONTRACTOR:-

i) Works shall be executed under supervision and direction of the Executive Engineer (Distribution) / Executive Engineer (R)/D.A.(R) of the concerned Division.

ii) Works shall be executed as per norms and in formats as prescribed by the department from time to time, as well as mentioned in Annexure-1.

iii) Any associated work, which is implied or necessarily required to be carried out for proper completion of work, shall be carried out by the contractor for which no extra payment shall be

made. iv) Contractor shall be entitled to develop computer software, as convenient to him for proper and

speedy execution of works. In that case the software is developed; it shall be the property of contractor, which may be possessed by the contractor after completion of contract period.

v) One hard copy and one soft copy of all data along with monthly reports shall be prepared and made available to EE(D)/EE( R) of the concerned Division.

vi) Contractor or his personnel shall issue receipt of official records obtained/received by them for data entry work, and obtain receipt of the same while giving back the records, from/to concerned official.

vii)Contractor shall be responsible for safety of records, under his custody and safe use of computer sets.

viii)Contractor shall maintain a register in which time to time entries regarding receipt of records for data entry and giving back if after completion of data entry work shall be made.

ix) Contractor shall be responsible for payments of all legitimate claims of personnel engaged by him for carrying out the works.

6- RESPONSIBILITIES OF DEPARTMENT:i) Computer (PC) set along with printer, on which data entry work is to be carried shall be provided by

the department, free of cost, one No. at each Division office, along with computer table, chair etc., which shall be handed over back in original / working condition, after completion of agreement period.

ii) Electricity for operation of computer shall be provided, free of cost. iii) All daily / weekly / monthly records form which data entry and preparation of reports works are to

be done, shall be made available by the official of the concerned Division office.iv) Repairing and maintenance of computer set, replacement of printer's cartridge shall be ensured by

the department. v) Making available official records within prescribed time period as mentioned in Annexure-2.

7- SECURITY:-The Contractor shall submit a security approximately 10% of contract value in shape of FDR/CDR/TDR/BG, valid at least for one year, duly pledged in favour of SE EDC Agra, within one month from the date of execution of this agreement. The security shall be refunded to the Contractor after satisfactorily completion of works / agreement period.

8- PAYMENT:i) Payment shall be released on monthly basis, by the concerned Division, through a/c payee cheque.

For payment contractor shall submit the pre-receipted bill in triplicate, to respective Division office, duly verified by the concerned officer.

ii) Payment shall be released within 30 days from the date of submission of bill to the Division office, subject to availability of funds in Division office.

9- PENALTY:

In case of not execution of work as per time schedule and in prescribed manner or late submitting the reports a penalty @ 1/2% per week, subject to maximum 10% of contract value shall be imposed and deducted from contractor bill(s).

10- TERMINATION OF AGREEMENT:In case the contractor fails to execute the works satisfactorily and timely, following provision shall be made applicable.i) Works may be got carried out through another agency, for particular month(s), and in that case

prescribed monthly rate plus 15% supervision charges, treating it as penalty amount, shall be recoverable from the contractor.

ii) It the penalty amount crosses 10% of contract value, this agreement shall be liable to be terminated. iii) If any departmental policy comes in force or instructions are received, this agreement shall be

liable to be terminated at any time. In that case any claim for subsidiary amount for the remaining contract period shall not be considered.

11- GOVT. TAXES:-i) Income tax, as applicable under rules shall be deducted from contractor's bills. ii) Service tax, as applicable under rules shall be paid extra, if charged by the contractor. The

contractor shall submit copy of documentary proof of depositing of service tax to concerned Govt. department.

12- OTHER RULES AND REGULATIONS:i) In addition to above terms and conditions, the terms and conditions of departmental Form-A, rules

and regulation of UPPCL/DVVNL, as in force, shall be applicable. ii) All disputes shall be subject to Court of Law at Agra and Hon'ble High Court, Allahabad. iii) In case of any dispute regarding quality, quantity, way or procedure of the work, clarification shall

be asked from the Chief Engineer, Agra Zone, Agra and his decision shall be applicable and binding on both parties.

iv) None of the contractor's personnel shall be entitled for services in regular establishment of the department on the basis of work done against this agreement.

v) Any experience certificate shall not be issued by any officer to any personnel of contractor.

INSTRUCTIONS TO THE TENDERERS

24. Only such firms/contractor need tender who themselves are capable to undertake the job and can produce satisfactory evidence that they have necessary resources and organization set up for the same.

25. The tenderers are requested to submit the price schedule/Annexure “A” duly filled in item by item as required in these specification to facilitate the Board to prepare comparative statement. Failure to do so may prevent the tender from being considered.

26. Tenderers should state the earliest completion period for the work from the date of receipt of full instructions as to enable them to proceed with the work.

27. Any portion of the terms and conditions as laid down in the condition of contract form which is not clear to tenderer should be got clarified before submission of tender. Tenderers are requested to adhere to all clause of the contract form to facilitate finalization of contract.

28. The Price quoted should be after deduction/discount etc. and should be firm during the currency of the contract and no variation should be allowed for any reason whatsoever.

29. The Corporation does not pledge to accept the lowest rates or any tender and reserve the right to accept the whole or any portion of any tender as they may think fit without assigning any reason for non acceptance or selection whatsoever. The Corporation also reserve the right to order to increase or decrease the quantity of work in accordance with the conditions of Form ”A” of UPPCL/DVVNL. The quantity mentioned in the Quantity and Price schedule is tentative, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the competent authorities.

30. The earnest money amounting to Rs. 5,000 /- (Rupees Five Thousand only) in shape of FDR/Call deposit of a scheduled Bank payable at Agra, should be submitted in a separate envelope along with tender in favor of Superintending Engineer, Electricity Dist. Circle, Agra failure to do so may prevent tender from being considered.

31. A security/performance guarantee @ 10% of the value of contract shall have to be deposited by the Tenderer, of the contractual amount in the form of FDR/CDR/Bank Guarantee duly pledged in favor of Superintending Engineer, Electricity Dist. Circle, Agra, otherwise the same shall be deducted from the Contractor’s bill itself. The security and performance guarantee so deposited/deducted, whatsoever or in any manner, as per terms of agreement shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the Contract and subject to the condition that nothing has been found outstanding as Misc. against the contactor. However, the condition of Form ”A” of UPPC/DVVNL shall prevail in this direction.

32. The tender should be made valid for a period of 180 days from the date of opening of tender.

33. The successful tenderer shall be required to pay all legal charges that may have to be incurred for vetting the Contract documents and also the stamps, form etc. for the execution of agreement.

34. Any action on the part of tender to revise the price/prices and or to change the structure of price/prices at his own instance after the opening of tender may result in rejection of

the tender and also debarring him from submission of tender to the Corporation atleast for one year.

35. The tenderers are required to submit the details of their past experience in connection with the execution of such work executed by them in past or in present in UPPCL/DVVNL or in any other similar public works department on the following Performa:-

37. The work tender in question shall be completed within 30 days from the date of last issued of the material

38. Clearance of site shall also be given to the successful contractor by the supervising engineer well in advance but any delay in giving the same shall also not be counted in completion period and the delay on this account shall also be confirmed by the supervising engineer in writing so that relief may be granted accordingly.

39. Any work which may not have been specifically mentioned in the specification, but which in usual or necessary in the efficient working of work shall be deemed to have been included in the scope of work under the specification.

40. All the work shall be carried out as per RESPO specification and in accordance with Indian Electricity Rules 1956 or any revision thereof which may be issued during the currency of the Contract and the requirement of any other regulation in Act in India to which the work may be subjected.

41. The Contractor shall provide and arrange all necessary arrangement for safety of staff / labour /employees employed by him at site of work. The Purchaser Engineer of the Department shall not be in any way responsible for any accident, minor or fatal to any person at the site of work.

SCOPE OF WORK

The Tender is for the work of reconciliation and revenue realization alongwith other associated works, for a period of 5½ month in EDD-IV, Kirawali, which shall be carried out, as per provision of General conditions, Special conditions of the tender. If the successful contractor fails to execute the work at any stage, in that event the work shall be got executed from other outer agency, for which extra actual expenditure plus 15% supervision charges thereon shall be recovered from the contractor and the security shall be forfeited. The tenderers are required to submit their rates and price as “Firm” and no price variation shall be allowed on any ground, and the tender of the nature of price variation shall be liable to be rejected out rightly.

SECURITY DEPOSIT & REFUND OF SECURITY

The successful contractor shall be required to furnish to the Corporation security deposit and performance guarantee @ 10% of contractual amount of the tender in the form of FDR/ CDR/ Bank draft, duly pledged in favour of the Superintending Engineer, Electricity Distribution Circle, DVVNL, Agra, or in any other terms as deemed fit proper by the Superintending Engineer, EDC, DVVNL, Agra. Necessary stamp duty shall also be paid by the successful tenderer, which shall be liable to be refundable after receipt of successful completion report from the Supervising engineer of the contract and subject to the conditions that nothing has been found out standing as Misc. against the contractor. INCREASE/ DECREASE IN QUANTITY

The Corporation reserves the right to order to increase or decrease the quantity of work in accordance with the conditions of Form “A” of UPPCL. The quantity mentioned in the Quantity and Price Schedule is tentative, and may vary 20 percent plus or minus, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the Competent Authorities.

ELECTRICITY RULES

The provisions as laid down in Indian Electricity Act 1910 and 1956 and rules made there after shall also be followed.

STAFF AND LABORER

All the staff and laborer required for proper and successful completion of work under this tender shall be arranged/ engaged by the contractor at his own cost, risk and responsibility. The contractor shall also make and provide all necessary arrangements for safety and security of the staff and labourer at the site of work and during the course of execution of work. The Corporation shall not in any way be responsible for any accident fatal or minor to any person, laborer, staff or any thigh what so ever in any manner, if takes place and also simultaneously the contractor shall also be responsible for any damage to the equipments or any other things what so ever in any manner and this shall be the entire responsibility of the successful contractor at his own cost. Staff and laborer insurance if any covered shall also be born by the successful contractor and no payment on this account and ground shall be made.

COMPLETION OF WORKThe work of tender shall be got completed within 30 days from the date of last issue of material but delay at Corporation end shall not be counted in completion period.

CLEARANCE OF SITE OF WORKClearance of site of work shall also be given to the contractor by the Supervising Engineer well in advance but any delay in giving the same shall also not be counted in completion period, and

PENALTY

A penalty @ ½% per week subject to maximum10%, and penalty as mentioned in the special conditions shall also be applicable and recovered from the contractor. Apart from this penalty as mention in the special condition shall also prevail.

INSPECTION OF CORORATION’S REPRESENTATIVES

The corporation’s representative shall be free to visit the contractor’s site stores and the site of work and the material of the Corporation under the possession of the contractor. The Corporation’s representative shall be given all help by the contractor in respect of inspection of the execution of work and also to inspect/ verify the Corporation’s material in the custody of the contractor.

INSTRUCTIONS TO THE TENDERERS

47. Only such firms/contractor need tender who themselves are capable to undertake the job and can produce satisfactory evidence that they have necessary resources and organization set up for the same.

48. The tenderers are requested to submit the price schedule/Annexure “A” duly filled in item by item as required in these specification to facilitate the Board to prepare comparative statement. Failure to do so may prevent the tender from being considered.

49. Tenderers should state the earliest completion period for the work from the date of receipt of full instructions as to enable them to proceed with the work.

The earnest money amounting to Rs. 5,000 /- (Rupees Five Thousand only) in shape of FDR/Call deposit of a scheduled Bank payable at Agra, should be submitted in a separate envelope along with tender in favor of Superintending Engineer, Electricity Dist. Circle, Agra failure to do so may prevent tender from being considered.

54. A security/performance guarantee @ 10% of the value of contract shall have to be deposited by the Tenderer, of the contractual amount in the form of FDR/CDR/Bank Guarantee duly pledged in favor of Superintending Engineer, Electricity Dist. Circle, Agra, otherwise the same shall be deducted from the Contractor’s bill itself. The security and performance guarantee so deposited/deducted, whatsoever or in any manner, as per terms of agreement shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the Contract and subject to the condition that nothing has been found outstanding as Misc. against the contactor. 9 (B) Earthing of 5 MVA Power transformer and11 KV switchgear by maintenance free Earthing Electrods (Chemical) by digging pits 6" dia upto 3mtr. deep including inserting pipe in pipe technology concept involve two mild steel pipes one inserted inside. One inserted inside the other of size- 1- Inner pipe dia 50mm. 2- Outer pipe dia 100mm and length of the both pipe shall be 3000 mm. The M.S.pipe shall be ISI mark of class B as per IS 1239. Thickness of the pipe shall be 12 SWG. The empty space in the pipe shall be filled with the specially developed crystalline material conductive mixture such as copper and aluminimum powder, conductive carbon and bonding material etc. mixed in diffrent proportions. Conductive mixture contents shall be 70 % carbon powder & 30% metal powder preferably pure copper or aluminum material alongwith the required quantity of bonding materials. Granule size of the carbon & metal powder shall be 100 mesh. The mixture if forced (pressurized) inside the earth electrode in empty space of inner pipe & in empty space between the inner & outer pipe of the earth electrode, in paste form and after soldification of the same the bottom end cap as well as top end cap is provided. The mixture shall be pressed by machine in the pipe. Precaution shall be taken so as no air gap inside the pipe while pressing. The back fill compound (earth enhancment material ) shall be superior conductive material that improves earthing effectiveness especially in areas of poor conductivity such as rocky ground, sandy soil & areas of moisture varation. It may contain conductive cement (20%) graphite carbon powder(50%), hydrous aluminum siliacate (10%), Sodium montmorillonite (20%) etc. it shall be placed around earth electrode in the earth pit to improve the conductive of earth electrode & ground contact area. Mild steel electro galavanized Flat 50x6 mm shall welded to earth electrode pips & connected with Trasnformer netural / body as below with the hlep of steel nut & bolt or through welding as per site requirment to 80mm GI pipe and filling of chemical mixutre around the GI pipe upto 3 mtr. including making of chamber & connecting the top of the inserted pipe and transformer body / neutral through M.S.flat 50x6mm with the help of nut & bolt or through welding and making a main hole of size 2'×2' and covering the same by a stone pad for the purpose of poring water for moisture.

INSTRUCTIONS TO THE TENDERERS

70. Only such firms/contractors shall be eligible to undertake the job who will produce satisfactory evidence such as details of experience, registration in service tax department etc.

71. The tenderers are requested to submit the price schedule/ tender Performa etc. duly filled as required failing which it may prevent the tender from being considered.

72. Tenderers should state the earliest completion period for the work from the date of receipt of full instructions as to enable them to proceed with the work.

73. Any portion of the terms and conditions as laid down in the condition of contract form which is not clear to tenderer should be got clarified before submission of tender. Tenderers are requested to adhere to all clause of the contract form to facilitate finalization of contract.

74. The Price quoted should be after deduction/discount etc. and should be firm during the currency of the contract and no variation should be allowed for any reason whatsoever.

75. The Corporation does not pledge to accept the lowest rates or any tender and reserve the right to accept the whole or any portion of any tender as they may think fit without assigning any reason for non acceptance or selection whatsoever. The Corporation also reserve the right to order to increase or decrease the quantity of work in accordance with the conditions of Form ”A” of UPPCL/DVVNL. The quantity mentioned in the Quantity and Price schedule is tentative, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the competent authorities.

76. The earnest money amounting to Rs. 5,000 /- (Rupees Five Thousand only) in shape of FDR/Call deposit of a scheduled Bank payable at Agra, should be submitted in a separate envelope along with tender in favor of Superintending Engineer, Electricity Dist. Circle, Agra failure to do so may prevent tender from being considered.

77. A security/performance guarantee @ 10% of the value of contract shall have to be deposited by the Tenderer, of the contractual amount in the form of FDR/CDR/Bank Guarantee duly pledged in favor of Superintending Engineer, Electricity Dist. Circle, Agra, otherwise the same shall be deducted from the Contractor’s bill itself. The security and performance guarantee so deposited/deducted, whatsoever or in any manner, as per terms of agreement shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the Contract and subject to the

condition that nothing has been found outstanding as Misc. against the contactor. However, the condition of Form ”A” of UPPC/DVVNL shall prevail in this direction.

78. The tender should be made valid for a period of 90 days from the date of opening of tender.

79. The successful tenderer shall be required to pay all legal charges that may have to be incurred for vetting the Contract documents and also the stamps, form etc. for the execution of agreement.

80. Any action on the part of tender to revise the price/prices and or to change the structure of price/prices at his own instance after the opening of tender may result in rejection of the tender and also debarring him from submission of tender to the Corporation atleast for one year.

81. The tenderers are required to submit the details of their past experience in connection with the execution of such work executed by them in past or in present in UPPCL/DVVNL or in any other similar public works department on the following Performa:-

85. Any work which may not have been specifically mentioned in the specification, but which in usual or necessary in the efficient working of work shall be deemed to have been included in the scope of work under the specification.

86. All the work shall be carried out as per RESPO specification and in accordance with Indian Electricity Rules 1956 or any revision thereof which may be issued during the currency of the Contract and the requirement of any other regulation in Act in India to which the work may be subjected.

87. The Contractor shall provide and arrange all necessary arrangement for safety of staff / labour /employees employed by him at site of work. The Purchaser Engineer of the Department shall not be in any way responsible for any accident, minor or fatal to any person at the site of work.

88. All disputes and claims shall be subject to Agra Court.

89. Payment for the work shall be made in accordance with the provisions as laid down in Form”A” of UPPCL from O&M/ Deposit/Section-5 /System improvement funds, by the Executive Engineer concerned. All the taxes applicable on work contract shall be deducted from the Contractor’s bill itself.

90. In case of delay in completion of work, the penalty @ of ½% per week and maximum 10% of Contracted value of remaining work shall be charged.

SCOPE OF WORK

The Tender is for the work of replacement damaged distribution transformers alongwith other associated works under EDD-II Agra which shall be carried out, as per provision of General conditions, Special conditions of the tender. If the successful contractor fails to execute the work at any stage, in that event the work shall be got executed from other outer agency, for which extra actual expenditure plus 15% supervision charges thereon shall be recovered from the contractor and the security shall be forfeited. Letter sent to this effect under Postal Certificate shall be considered enough for this purpose from the supervising engineer/ Superintending Engineer, Electricity Distribution circle, DVVNL, Agra.

SUPERVISING ENGINEER

Executive Engineer, Electricity Distribution Division-II, DVVNL, Agra, shall be responsible for the successful completion of work on behalf of Dakshinanchal Vidhut Vitaran Nigam Limited, in accordance with the terms and conditions thereof .In the event of any conflict between the contractor and the Supervising Engineer, the decision of the Superintending Engineer Electricity Distribution circle, DVVNL, Agra, shall be final and binding upon both the parties.

EARNEST MONEY

The tenderers are required for submit the earnest money amounting to Rs. 5000.00 [Rupees Five Thousand only], in the form of FDR/CDR/ Bank draft, duly pledged in favour of Superintending Engineer, Electricity Distribution Circle, DVVNL, Agra, through the first part of the tender and accordingly the second part of tender shall only be opened only after receiving the proper and adequate Earnest Money through the first part of tender.

Tenderers are required to submit their tenders valid for Ninety days and the validity certificate shall also be submitted to this effect on the proforma enclosed with the tender specification herewith.

PRICESThe tenderers are required to submit their rates and price as “Firm” and no price variation shall be allowed on any ground, and the tender of the nature of price variation shall be liable to be rejected out rightly.

SECURITY DEPOSIT & REFUND OF SECURITY

The successful contractor shall be required to furnish to the Corporation security deposit and performance guarantee @ 10% of contractual amount of the tender in the form of FDR/ CDR/ Bank draft, duly pledged in favour of the Superintending Engineer, Electricity Distribution Circle, DVVNL, Agra, or in any other terms as deemed fit and proper by the Superintending Engineer, EDC, DVVNL, Agra. Necessary stamp duty shall also be paid by the successful tenderer, which shall be liable to be refundable after receipt of successful completion report from the Supervising engineer of the contract and subject to the conditions that nothing has been found out standing as Misc. against the contractor. However the condition of From “A” of UPPCL, shall prevail in this direction.

INCREASE/ DECREASE IN QUANTITYThe Corporation reserves the right to order to increase or decrease the quantity of work in accordance with the conditions of Form “A” of UPPCL. The quantity mentioned in the Quantity and Price Schedule is tentative, and may vary 10 percent plus or minus, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the Competent Authorities.

ELECTRICITY RULESThe provisions as laid down in Indian Electricity Act 1910 and 1956 and rules made there after shall also be followed.

STAFF AND LABORERAll the staff and laborer required for proper and successful completion of work under this tender shall be arranged/ engaged by the contractor at his own cost, risk and responsibility. The contractor shall also make and provide all necessary arrangements for safety and security of the staff and labourer at the site of work and during the course of execution of work. The Corporation shall not in any way be responsible for any accident fatal or minor to any person, laborer, staff or any thigh what so ever in any manner, if takes place and also simultaneously the contractor shall also be responsible for any damage to the equipments or any other things what so ever in any manner and this shall be the entire responsibility of the successful contractor at his own cost. Staff and laborer insurance if any covered shall also be born by the successful contractor and no payment on this account and ground shall be made.

CLEARANCE OF SITE OF WORK

Clearance of site of work shall also be given to the contractor by the Supervising Engineer well in advance but any delay in giving the same shall also not be counted in completion period, and the delay on this account shall also be confirmed by the supervising engineer in writing so that relief may be granted accordingly.

PENALTY

A penalty @ ½% per week subject to maximum10%, and penalty as mentioned in the special conditions shall also be applicable and recovered from the contractor. Apart from this penalty as mention in the special condition shall also prevail.

INSPECTION OF CORORATION’S REPRESENTATIVES

The corporation’s representative shall be free to visit the contractor’s site stores and the site of work and the material of the Corporation under the possession of the contractor. The Corporation’s representative shall be given all help by the contractor in respect of inspection of the execution of work and also to inspect/ verify the Corporation’s material in the custody of the contractor.

OTHER RULES AND REGULATIONS

All other rules and regulations such as Labour Laws, Contract Act, Compensation Act, what so ever related and may be related in any manner what so ever shall also be followed by the contractor.

The contract executed shall be governed by the Law of India for the time being in force and shall be subject to the jurisdiction of High Court of Judicature at Allahabad.

and the sucessful contractor shall execute the same within two days failing which a penalty of Rs. 100/- (Rupees one hundred per day shall be imposed and deducted from Contractor's bill itself.

3 As and when any repaired transformer become available in the store at Agra, accordingly the Corporation shall issue an indent to the sucessful Contractor to this effect to cartage the transformer as per tender specification at any place in the jurisdiction of under EDD-II Agra and the sucessful contractor shall execute the work within two days from the date of indent, failing which Rs.100/- as penallty per day shall be imposed and deducted from the bills of the contractor itself.

4 All risk and responsibility shall be covered by the Contractor at his own cost.

5 Any accident fatal or minor or any damage to the transformer or any other whatsoever in any manner, if takes place, the same shall be entire responsibilty of the Contractor and the Corporation shall not be least responsible.

6 Any other work not mentioned in the quantity and price schedule, but required essential for the sucessful completion of work, the same shall be got executed through the sucessful contractor without any extra payment from the Corporation.

7 The above work shall be executed within period of six months from the date of agreement or from the date of letter of indent.

8 The cartage of repaired transformer shall be subject to the availability at stroes Agra. As such, cartage of the quantity of repaired transformer may vary but the same shall remain within the amount of agreement executed.

9 Service Tax, as legally applicable, shall be paid, if the firm is registered for the same with the concerning department
