Public Participation

The Regular Meeting of the Board of Trustees of the Town of Elizabeth was called to order on

Tuesday, March 31, 2020, at 7:13 pm by Mayor Megan Vasquez.

ROLL CALL

Present were by virtual meeting: Mayor Megan Vasquez, Mayor Pro Tem Angela Ternus,

Trustees Steve Gaither, Loren Einspahr, Tammy Payne, Ron Weaver, and Jason Weiss. Mayor

Vasquez stated there was a quorum to conduct business.

Also present were Town Administrator Matt Cohrs, Assistant Town Administrator Grace

Erickson, Town Clerk Michelle Oeser, Police Chief Stephen Hasler, Public Works Director Mike

DeVol, and Town Attorney Corey Hoffmann.

Management Team April 14, 2020 Management Team - Monitoring Report Administration/Town Administrator – Matt Cohrs Staff continues to focus on our response to the COVID-19 pandemic and do everything we can for the health, safety and welfare of our residents. Besides the information we have on our website, coordination continues with Elbert County Health and Human Services, Elbert County Public Information, Elizabeth Fire, and neighboring fire districts. At this stage, the town, as are most local jurisdictions, is partnering to connect people with needed resources and act as a conduit for information. Most regular town services are still available for our residents as well. Town Trail Project – Staff has met onsite with the project team twice over the past week. The team walked the trail easement from SH 86 south to Running Creek Elementary and made some minor design adjustments so that the trail better follows natural contours of the land, which in turn reduces the need and cost for fill material. Subsequently, the project team met at Running Creek Elementary with IREA and their subcontractor to begin coordination on undergrounding of the electrical service and removal of the existing poles in front of the school and Harvest Bible Church, which is where the trail will start. Grading is finished for the trail starting at Evans Park going south the SH 86 underpass for the trail. Concrete work is starting on this section as well as construction of the underpass. Street Paving Project – At the beginning of March, staff had contacted the street captains to coordinate outreach to specific homeowners on each street. The project team wants to engage these homeowners to make sure they understand the alterations or changes that are being made in the ROW next to their properties. This includes the configuration of driveway aprons and drainage. Due to the COVID-19 pandemic, these meetings are on hold until concerns have subsided. CORE Engineering has completed the design work for the project and the necessary bid documents have been prepared to put the project out to bid for construction. Any changes resulting from in-person meetings at each property would be minor at this stage, so the project will go out to bid in the next few weeks to get the response and lock down pricing. Any minor changes to the plans resulting from the in-person meetings will be made prior to construction so the work can go smoothly once it starts. Community/ Economic Development – Grace Erickson The Town has received a site plan application for a project known as “Dairy Queen”. The site is located at 783 Crossroads Circle. The site plan will require hearings with the Planning Commission and Board of Trustees. The Town has received a site plan application for a project known as “Countryside Village”. The site involves the existing Countryside Village Shopping Center at 796-800 East Kiowa Avenue. The site plan will require hearings with the Planning Commission and Board of Trustees. On Wednesday, April 15th, at 12 PM, the Elbert County Public Health Administrator will brief the Elbert County Board of Health on the County's activities and status relating to the COVID-19 emergency. Management Team – Monitoring Report 2

Town Clerk – Michelle Oeser Staff is keeping track of all credits made to water accounts for credit card processing fees incurred by utility account holders for paying water bills online or by phone while we are closed to the public. Staff is continuing to work with the Court Judge, Prosecuting Attorney and Police Department to move cases and encourage plea by mail for traffic offenses. Safety is of the utmost importance to all of us and we are working on processes to make court day as safe as possible once court is back in session. Election day went well and was very successful. There was a large turnout of voters this year. Laura Bauer was the Designated Election Official (DOE) and was very detailed and exact on how the election ran. The Election Judges did an astounding job verifying signatures and counting votes. Due to the checking and double-checking procedures the DEO had in place ballot counting was a long process, but well worth it. The next step in the election process is to have the election judges come back in to count the 20 ballots that were held and any additional UVACOVA ballots received and signature verified ballots. The final step will be to have an appointed election judge come in to complete a canvas of the paperwork from the election. This is not a recount; it is a review of paperwork. Once the canvas is completed the final election results will be posted and filed with the County Clerk. SUBJECT: Public Works Monitoring Report

The Town of Elizabeth Public Works continues to be operating full time with full staff while practicing social distancing

from each other and the public to remain safe and healthy. Public Works has attached the Monthly Water Well

usages and the Gold Creek Waste-Water Treatment Plant (GCWWTP) Effluent flows that are directly returned into

Gold Creek. Flow.

1. Public Works has completed painting the interior of the Bandt Park restrooms.

2. Public Works has CLOSED Larmer and Bandt Park playgrounds during the COVID-19 pandemic. (Open

space is still usable).

3. Public Works will begin removing old playground equipment and installing the New playground equipment at

Larmer Park during the next month.

4. Public Works has completed the Monthly Water Sampling routine and filed the compliance reporting with

Colorado Department of Public Health and Environment (CDPHE).

5. Public Works has completed the Waste-Water compliance sampling and reporting with CDPHE.

6. Public Works is working with JVA Engineering for upgrading Gold Creek Lift Station Pump sizing for

Ritoro/Gold Creek Filings 2 and 3 build out.

7. Public Works continues to work with JVA Engineering and HRS Water Engineering for the drilling of the

New Arapahoe and Denver acquifer wells within the Ritoro/Gold Creek filing 2 property.

8. Public Works continues to work with JVA Engineering to build and equip the New Well house for the water

treatment facility, tank distribution, and Supervisory Control and Data Acquisition (SCADA) communications

systems.

9. County Rd. 13 Realignment Project is on schedule and moving forward with all the Utilities (Century Link,

Black Hills Energy, IREA, ComCast, and Future Fiber Optic lines) relocations and the New Sanitary Sewer

line installation on the West side of the shell station. Once the New Sanitary Sewer line is completed the

New Water line will be installed. Public Works and CORE Engineering are completing daily inspections of

installations.

10. Public Works will be completing the Water Storage Tank cleaning, inspection and disinfection during the

month of April per CDPHE Tank Rules 100 Compliance schedule.

11. Public Works has completed the necessary reporting and data required that enables the Town of Elizabeth

to remain in the TREE CITY U.S.A. program from the 2020 year.

12. Public Works has tentatively placed Town Clean Up Day on hold during the COVID-19 pandemic. This will

be revisited as things settle down.

13. Public Works has placed the Paint Round Up scheduled event on hold during the COVID-19 pandemic. The

tentative new date is for September or October 2020.

14. Public Works will NOT be conducting the High School Student Volunteer Clean-Up as students are out of

school during COVID-19.

15. Public Works has removed 4 large trees within town Right of Way (ROW) due to age, and degradation of

the health of the trees.

16. Public Works will begin the grading and watering for dust suppression on County Rd. 13 South of County

Rd. 136 for the summer season. Public Works believes this will be required less over the next two months

due to no school and less commuter traffic.

17. Street Sweeping will be conducted once the COVID-19 pandemic subsides as to not create excess dust for

the public and staff.

18. Public Works had several snow events for plowing during this past month, which will hopefully turn to rain

and not snow.

SUMMARY

Resolution 20R14 would extend the declaration of Local Disaster Emergency until April 28, 2020. The Town of Elizabeth previously issued an order declaring a Local Disaster Emergency in and for the Town of Elizabeth on March 17, 2020 in response to the COVID-19 pandemic. It was extended at the Board of Trustee meetings on March 24th and March 31st and needs to be extended again. This declaration follows the declarations released by Elbert County on March 16th, 23rd, 30th, and April 7th, 2020. The declaration allows the Town to be furnished aid and assistance through the state and federal governments. STAFF RECOMMENDATION Staff recommends approval of Resolution 20R14, a Resolution Consenting to and Extending the Order Declaring a Local Disaster Emergency in and for the Town of Elizabeth, Colorado until April 28th, 2020. A RESOLUTION CONSENTING TO AND EXTENDING THE ORDER

WHEREAS, the Colorado Disaster Emergency Act, C.R.S. § 24-33.5-701, et seq. (the

"Act"), provides procedures for statewide and local prevention of, preparation for, response to, and

recovery from disasters and emergencies;

WHEREAS, pursuant to the Act, an "emergency" is an unexpected event that places life or

property in danger and requires an immediate response through the use of state and community

resources and procedures, and an "emergency epidemic" is cases of an illness or condition,

communicable or noncommunicable, caused by bioterrorism, pandemic influenza, or novel and

highly fatal infectious agents or biological toxins;

WHEREAS, pursuant to C.R.S. § 24-33.5-709, a local disaster emergency may be declared

"only by the principal executive officer of a political subdivision," here, the Mayor;

WHEREAS, on March 17, 2020, the Mayor did issue an order declaring a local disaster;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), on March 31st, 2020, the declaration of

a local emergency was continued or renewed for a period of 14 days until April 14th, 2020 by the

Elizabeth Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), the declaration of a local emergency

shall not be continued or renewed for a period in excess of 7 days except by or with the consent of

Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), any order declaring, continuing, or

terminating a local disaster emergency shall be given prompt and general publicity and shall be

filed promptly with the Town Clerk, the County Clerk and with the state office of emergency

management; and

WHEREAS, immediately after it was issued, the attached order was given prompt and

general publicity, was filed with the Town Clerk and the Elbert County Clerk and Recorder, and

it was submitted to the Colorado Office of Emergency Management.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE

TOWN OF ELIZABETH, COLORADO AS FOLLOWS:

Section 1. The Board of Trustees hereby consents to and supports the Order Declaring

a Local Disaster Emergency in and for the Town of Elizabeth, Colorado.

Section 2. The Board of Trustees hereby extends the Order Declaring a Local Disaster

Emergency in and for the Town of Elizabeth, Colorado until April 28, 2020, unless sooner

terminated by action of the Board of Trustees, at which time the Order may be extended by action

of Board of Trustees.

Section 3. This Resolution shall be given prompt and general publicity, filed with the

Town Clerk and the Elbert County Clerk and Recorder, and it shall be submitted to the Colorado

Office of Emergency Management
