October 7, 2016 TO: Enforcement Committee Members FROM: Maggie Weber, Enforcement Analyst (415/352-3668 [email protected]) Marc Zeppetello, Chief Counsel (415/352-3655 [email protected]) SUBJECT: Staff Recommended Enforcement Decision Regarding Proposed Stipulated Cease and Desist and Civil Penalty Order No. CCD 2016.04; Marina Village Associates, LLC (For BCDC Enforcement Committee consideration on October 20, 2016) Recommendation The BCDC staff recommends that the Enforcement Committee adopt the Recommended Enforcement Decision on proposed Stipulated Cease and Desist and Civil Penalty Order No. CCD 2016.04 (“Stipulated Order”) to Marina Village Associates, LLC (“MVA”), for the reasons stated below. This matter arises out of an enforcement action commenced by BCDC staff on March 14, 2015. The Stipulated Order requires MVA within specified time frames to, among other provisions: (1) cease and desist from all activity in violation of BCDC Permit No. 2006.010.03; (2) remove unauthorized items located in the Bay and shoreline band that cannot be authorized after-the-fact; (3) apply for authorization for unauthorized activities in the Bay and shoreline band that can be authorized after-the-fact; (4) submit an engineering report that evaluates: (a) the frequency, duration, and extent of tidal flooding and post-flooding standing water in the public access area and (b) potential alternatives to reduce tidal flooding and post-tidal standing water in this area; based on consideration of potential alternatives recommended in the report, and obtain authorization to implement the recommended flood control measures; (5) pay a civil penalty of $210,000 to the Bay Fill Clean-up and Abatement Fund; and (6) pay established penalties for late compliance with any term of the Order. All other provisions are described in full within the Order. The BCDC staff has determined that the proposed Stipulated Order is a fair resolution of the alleged violations. Staff Report Background. On September 27, 2007, the Commission issued BCDC Permit No. 2006.010.03, as amended through September 2, 2015 (“the Permit”), to MVA, to authorize the construction of a portion of eight homes in the shoreline band, a grocery store, a two-story mixed use building, a restaurant adjacent to the existing yacht club, and new public access including a 1,500-foot-long public access boardwalk, a kayak boat launch float and ramp, a 33,000-square-foot “Marina Green”, a small park, a six-foot-wide, 2,200-foot-long pathway

Recommendation

StaffReport

Background.OnSeptember27,2007,theCommissionissuedBCDCPermitNo.2006.010.03,asamendedthroughSeptember2,2015(“thePermit”),toMVA,toauthorizetheconstructionofaportionofeighthomesintheshorelineband,agrocerystore,atwo-storymixedusebuilding,arestaurantadjacenttotheexistingyachtclub,andnewpublicaccessincludinga1,500-foot-longpublicaccessboardwalk,akayakboatlaunchfloatandramp,a33,000-square-foot“MarinaGreen”,asmallpark,asix-foot-wide,2,200-foot-longpathway

alongthebreakwaterandachildren’splayareaatexistingLochLomondMarinalocatedinSanRafael,MarinCounty.

OnMarch14,2015,BCDCstaffconductedasitevisitandobservedthatMVAhadplacedrockriprapadjacenttoandbaywardoftheBoardwalk,andthatsomeunknownandprobablyuplandactivityhadcausedalargemudwaveontheedgeoftheBaywestoftheEastSpitbetweenDocksEandF,whichhadsmotheredanareaoftidalmarshhabitatofthesamesize.Stafffurtherobservedthattheslopeoftheriprapappearedtoexceeda2:1slope,andquestionedwhetherthebaseoftheripraphadbeenplacedintheBaybecauseofthepresenceofmarshvegetationgrowingupthroughtheriprapatthetoeoftheslope.

FollowingtheMarch14,2015sitevisit,BCDCstaffreviewedthePermitfileandcommencedanenforcementinvestigationtoassessMVA’scompliancewiththetermsandconditionsofthePermit.BetweenMarch20andOctober20,2015,theBCDCstaffinvestigationinvolvednumerouscommunicationswithMVA’srepresentative,ToddWright.

OnNovember20,2015,BCDCstaffsentMVAaletterthatsummarizedtheallegedviolationsofthePermitandMcAteer-PetrisActandincludedproposedresolutionswithaproposedsettlementagreementattached.OnNovember25,2015,Mr.WrightsentBCDCstaffaletterconfirmingreceiptofBCDC’sNovember20thcorrespondenceandstatingthattheletterwouldbeforwardedtoMVA“whowillrespondtoyoudirectly.”Morethansixweekslater,onJanuary7,2016,BCDCstaffemailedMr.Wright(andmailedacopyoftheemailtoJohnArvin,VicePresident,MVA)statingthatintheabsenceofanyeffortbyMVAtoresolvethismatterthroughtheproposedsettlementagreement,BCDCintendedtoprepareacomplaintforadministrativecivilpenaltiesandaceaseanddesistorder.BetweenJanuary7andMay20,2016,Mr.ArvindidnotcontactBCDC.

OnMay20,2016,theExecutiveDirectorissuedaViolationReportandComplaintfortheImpositionofAdministrativeCivilPenaltiestoexpediteresolutionoftheviolations.AftertheViolationReportwasissued,MVAanditscounselmetwithBCDCstaffmultipletimestodiscusstheviolationsandnegotiatearesolution.OnAugust15,2016,theExecutiveDirectorissuedaSupplementalViolationReportandComplaintfortheImpositionofAdministrativeCivilPenaltiestoeliminatetwooftheoriginallyallegedviolations,modifythescopeofoneoriginallyallegedviolation,andprovidenoticeofsevenadditionalallegedviolationsthathadoccurred,orthatBCDCstaffhadbecomeawareof,sincemailingtheoriginalViolationReportonMay20,2016.

Violations.Insummary,theviolationsofthePermitortheMcAteer-PetrisActallegedbytheExecutiveDirector,intheOriginalViolationReportandasmodifiedandsupplementedbytheSupplementalViolationReport,includethefollowing:

1. TheplacementofriprapadjacenttotheBoardwalkataslopesteeperthantheauthorized2:1gradethatwasnotengineeredandlackedplanapproval.

2. Theunauthorizedstockpilingofconstructionmaterialsintheshorelinebandthatcausedamudwavethatresultedinunauthorizedfill.Themudwave’sdimensionobservedbystaffisroughly.

3. TheunauthorizedworkintheBayandshorelinebandtorepairtheseawall,Boardwalk,andriprapdestroyedbyalargemudwave.

4. TheunauthorizedplacementofriprapintheBayandshorelinebandintwodifferentlocationsontheEastSpit.

5. TheunauthorizedplacementofelectricalpostsandassociatedelectricalwiringintheBayandshorelinebandlocatedadjacenttotheBoardwalk.

6. Theunauthorizedplacementofmanyutilitiesinthededicatedpublicaccessarealocatedintheshorelineband.

7. FailuretosubmittotheExecutiveDirector,gainstaffapprovalof,andrecord,twoinstrumentsthatdedicatetherequiredpublicaccessandopenspaceareastothepublicbyMarch31,2016.

8. Failuretosubmitwrittencertificationofcontractorreviewpriortocommencinganygrading,demolition,orconstruction.

9. FailuretorecordtheamendedPermitonallparcelsaffectedbythePermitwithMarinCountywithin30daysafterexecutionofamendedPermit.

10. ThefailuretoprovideandmakeavailableforpublicaccessusebyMarch,2016,apark,playground,andrestroomontheEastSpit,andastripedpathwayonexistingasphalttoconnecttheparklocatedontheWestSpittotheexistingpublicaccesslocatedontheadjacentproperty,amongotheramenities.

11. Failuretoestablishtwomembershipassociationsthatrecognizetherequirementtomaintainallthepublicaccessimprovements.

12. TheunauthorizedplacementofriprappossiblyintheBayandintheshorelinebandatthenortheasternedgeoftheEastSpit,adjacenttotheunauthorizedswitchgearcabinetlocatedonthelandwardendoftheeastspit.

NegotiationsandSettlementAgreement.AfterreceivingthefirstandsecondViolationReports,MVAanditscounselmetwithBCDCstafftoinitiatesettlementdiscussions.Duringnegotiations,BCDCstaffdeterminedthatanyagreementreachedbetweenthepartiesneededtoaddressandrectifythefrequenttidalfloodingandpost-tidalstandingwaterinthepublicaccessarealocatedbetweentheeastparkinglotandtheheadofthebreakwatertrailbasedonreportsreceivedbyBCDCstafffromthepublicandCityofSanRafaelthatthefloodingofthisareaisanongoingissuethatoccursduringregularhightideevents.Assuch,staffdetermined

thisportionofthepublicaccessarearegularlyfloodsandwillcontinuetocausemaintenanceandaccessibilityissuesunlesscorrectiveactionistaken.

TheViolationReportsproposedatotalpenaltyof$563,500;BCDCstaffultimatelyagreedthattheywouldacceptMVA’sproposedpenaltyof$210,000ifMVAcommittedtoresolvingthefloodingissuebypreparingareportandimplementingitsrecommendations,afterobtainingapermitamendment.Thecostofthereportandimplementationofitsrecommendationsisnotlimitedsolongasitisnotunreasonableandthefloodingissueisrectified.

ThecontentsoftheStipulatedOrderisnotlimitedtoa$210,000penaltyandremediatingthetidalfloodingandpost-floodingstandingwaterissuesinthepublicaccessarea.Insummary,theStipulatedOrderrequiresMVAwithinspecifiedtimeframesto,amongotherprovisions:(1)ceaseanddesistfromallactivityinviolationofBCDCPermitNo.2006.010.03;(2)removeunauthorizeditemslocatedintheBayandshorelinebandthatcannotbeauthorizedafter-the-fact;(3)applyforafter-the-factauthorizationforunauthorizedactivitiesintheBayandshorelinebandthatcanbeauthorizedafter-the-fact;(4)submitproofofrecordationwithMarinCountyofalegalinstrumentthatpermanentlyguaranteesrequiredpublicaccessareas;(5)submitforreviewandconcurrenceproposedCC&Rsforeachandeverymembershipassociationthatmayinthefutureassumeresponsibilitytomaintainpublicaccessimprovements;(6)makeavailableforpublicusepublicaccessamenitiesthatwererequiredtobeopenedbyMarch2016;(7)submitanengineeringreportthatevaluates:(a)thefrequency,duration,andextentoftidalfloodingandpost-floodingstandingwaterinthepublicaccessarealocatedbetweentheeastparkinglotandtheheadofthebreakwatertrailand(b)potentialalternativestoreducetidalfloodingandpost-tidalstandingwaterinthisarea;andobtainauthorizationtoimplementtherecommendedfloodcontrolmeasures;(8)payacivilpenaltyof$210,000totheBayFillClean-upandAbatementFund;and(9)payestablishedpenaltiesforlatecompliancewithanytermoftheStipulatedOrder.

OnSeptember13th,BCDCstaffandMVAreachedasettlementinprincipleonthetermsofanagreement,whichisprovidedintheproposedStipulatedOrder.TheBCDCstaffhasdeterminedthattheproposedStipulatedOrderisafairresolutionoftheallegedviolationsandwillprovideBCDCwithimportantdataregardingtheimpactsofsealevelriseonpublicaccessareasthatwererequiredpriortothe2011adoptionofBCDC’ssealevelrisepolicies.Attachmentstothisstaffrecommendationinclude:(1)TheStipulatedOrder;(2)ThePermit;and(3)aVicinityMapandtwoimagesofthesite.
