UT Martin is requesting bids for the purchase of Selectorized Strength Equipment.

Below you will find the specifications for the desired equipment. Bids are due by

December 4, 2015 by 2:00 PM, CST.

Specifications for UT Martin Student Recreation Center Equipment

General Requirements:

1. Item should be quoted FOB UT Martin Student Recreation Center, delivered and installed.

2. Disposal of all packaging to be handled by the vendor. Vendor is responsible for all clean up and should leave equipment in clean, working order. UTM has a recycling center available on campus. All non-recyclable goods to be disposed of by vendor off campus.

3. Vendor must include with their bid the details for the training and maintenance programs (if any) provided to UTM for each item. Vendor must state if the programs are included in the cost or include itemized additional cost.

5. The items on this request for quotations shall be as specified or equal. When the specifications specify a product by name of a manufacturer or vendor, or whenever the terms (similar to) and (equal to), or (approved equal) are used, the terms named are intended to set the standard for such materials or articles. The burden of proof shall rest solely with the supplier to prove that the proposed substitutes are equal to the materials or articles specified. The university shall be the sole judge as to whether the items submitted are equal to those specified.

6. The successful bidder will be held responsible for any damage to the UTM’s property caused by performance under the contract. If any damage is caused by

7. Vendor must supply their own tools, equipment, etc. to do the installation and must coordinate with UTM.

8. UTM reserves the right to purchase one or more pieces in this bid. UTM reserves the right to not award the bid, award to a single vendor, or award multiple to vendors.

9. Contract will be awarded based on adherence to specifications and overall cost including trade in values. Vendors must complete the Trade-In value offered or complete with NA, see page 12.

10. The successful bidder will indemnify and hold harmless the University, its officers, agents and employees from any claims, damages, and actions relating to the performance of the services specified in this Request for Quotation and any resulting contract.

SPECIAL BID CONDITIONS

1. STATE YOUR FEDERAL ID NUMBER:

2. The contractor shall obtain and bear the expense for all permits, licenses, fees etc. as required by the City of Martin, Weakley County, the State of Tennessee and/or the federal government or any of their agencies.

3. Bid should include installation charges.

4. Unrestricted termination: The University may terminate this agreement for any

reason by giving Supplier at least 30 a day written notice.

5. In compliance with the requirements of Tenn. Code Ann. § 12-3-306, the Bidder

hereby attests that the Bidder has registered with the State of Tennessee's

Department of Revenue for the collection of Tennessee sales and use tax. This

registration requirement is a material requirement of this Bid.

6. The University reserves the right to reject any and all proposals, waive all

informalities in the proposals received, and accept any proposal that, in its

opinion, may be in the best interest of the University. The University does not

obligate itself to accept the lowest or any other proposal.

7. Bids will be opened on December 4, 2015 at 2:00 PM, CST, in room 111 of the

Administration Building on the campus of The University of Tennessee at Martin.

It is the bidder's responsibility to assure that his bid is delivered at the proper time

and place indicated on the bid form. Bids which for any reason are not so

delivered will be rejected.

8. Questions concerning the University of Tennessee Bidding Policies and

Procedures should be directed to the Purchasing Department at 731-881-7815.

9. The University does not guarantee that the listed quantities will be purchased.

1O. Certification of Debarment Status - The vendor certifies that he/she is not presently

debarred, proposed for debarment, suspended, or declared ineligible for covered

transactions by any federal agency or department. The vendor also certifies that

within the past three years he/she has not been convicted of or had civil

judgement rendered against them for a fraudulent contract or transaction, violation

of federal or state antitrust laws, or the commission of embezzlement, theft,

forgery, bribery, falsifying or destroying records, receiving stolen property or

making false statements.

11. Drug Free Workplace Program - The successful bidder agrees to comply with the requirements of the drug free workplace program (TCA 50-9-101).

12. Each bid must give the full name and business address of the bidder. The title

of the person signing the bid should be shown, and, if requested by the

Purchasing Department, that person must furnish satisfactory proof of authority

to bind the company in contract. Bids must be written with typewriter, ink or

indelible pencil; otherwise, they may not be considered. A representative or

distributor bidding in the name of a principal should give the name of the firm to

which an order should be issued in the event of an award.

13. If a bidder fails to state a time within which a bid must be accepted, it is understood and agreed that the University shall have sixty (60) days beyond the bid opening to accept.

14. In case of doubt or differences of opinion as to the items or services to be furnished

hereunder, the decision of the University shall be final and binding on both parties.

15. Failure to provide the requested information may be grounds for rejection of your bid.

16. The Contractor shall not assign this Contract or enter into a subcontract for any of the services performed under this Contract without obtaining the prior written approval of the University.

17. The University reserves the right to add items or services as required during the specified bid period by soliciting firm prices from the successful bidders of this request quotation. Award of these additional items will be made in accordance with the terms and conditions as set forth in this request for proposal.
