1. The Development Plan Amendment entitled ‘Port Pirie Regional Council—Ranges Zone Development Plan Amendment’ (the Plan Amendment) has been finalised in accordance with the provisions of the Development Act 1993.

2. The Minister for Urban Development and Planning has decided to approve the Plan Amendment.

PURSUANT to section 25 of the Development Act 1993, I—

(a) approve the Plan Amendment; and

DEVELOPMENT ACT 1993

PROPOSED CHANGES TO SCHEDULE 1—DEFINITIONS UNDER DEVELOPMENT REGULATIONS 2008

Invitation for Public Submissions

NOTICE is hereby given that the Development Policy Advisory Committee is, pursuant to section 5 of the Development Act 1993, considering changes to Schedule 1 of the Development Regu-lations 2008, which defines terms that are used in Development Plans, in particular as they currently relate to ‘bulky goods retail’.

The proposed changes to Schedule 1 of the Development Regulations 2008 include:

1. Amending the ‘Service Trade Premises’ definition.

2. Introducing a new ‘Bulky Goods Outlet’ definition to replace the current ‘Retail Showroom’ definition.

Note: That the term ‘Retail Showroom’ term will be retained in Schedule 1 for the time being, but will mean the same as ‘Bulky Goods Outlet’. This will enable a gradual transition from the current ‘Retail Showroom’ term to the new ‘Bulky Goods Outlet’ term in Development Plans over time. The term ‘Retail Showroom’ will eventually be phased out.

3. Including ‘Bulky Goods Outlet’ in the ‘Shop’ definition.

These changes to the definitions will be on public consultation from Thursday, 7 May 2009 until Thursday, 18 June 2009.

Copies outlining the specific details of the proposed changes summarised above are available during normal office hours at the Department of Planning and Local Government, Level 5, 136 North Terrace, Adelaide, or can be viewed on the Internet at www.planning.sa.gov.au/go/bulkygoodsdefinition.

Written submissions are invited regarding whether any change should be made to the amendments proposed to the definitions in Schedule 1 of the Development Regulations 2008 and should be received no later than 5 p.m. on Thursday, 18 June 2009. All submissions should be addressed to the Presiding Member, Development Policy Advisory Committee, c/o Department of Planning and Local Government, G.P.O. Box 1815, Adelaide, S.A. 5001 and should clearly indicate whether you wish to be heard in support of your submission at the public hearing. If you wish to lodge your submission electronically, please email the electronic submission to [email protected].

A public hearing will be held on Monday, 6 July 2009 at 7 p.m. at the Glenroy Room, Mercure Grosvenor, 125 North Terrace, Adelaide, S.A. 5000, at which time interested persons may appear to be heard in relation to the proposed changes to the definitions in Schedule 1 and the submissions.

FISHERIES MANAGEMENT ACT 2007: SECTION 79

TAKE note that the notice made under section 79 of the Fisheries Management Act 2007, dated 29 October 2008, published in the South Australian Government Gazette, referring to the Spencer Gulf Prawn Fishery, is hereby varied such that it will be unlawful for a person fishing, pursuant to a Spencer Gulf Prawn Fishery Licence, to use prawn trawl nets in the areas specified in Schedule 1, during the period specified in Schedule 2.

The waters of the Spencer Gulf Prawn Fishery that are:

1. North of the following co-ordinates: Commencing at position latitude 3329.00S, longitude 13716.00E, then to position latitude 3329.00S, longitude 13728.00E, then to position latitude 3334.00S, longitude 13728.00E, then to position latitude 3334.00S, longitude 13731.00E, then to position latitude 3331.50S, longitude 13731.50E, then to position latitude 3331.50S, longitude 13734.00E, then to position latitude 3338.00S, longitude 13734.00E, then to position latitude 3346.00S, longitude 13744.00E.

Fishing is permitted to commence at 1830 hours on every day and must cease by 0600 hours on every day, from 30 April 2009 to 3 May 2009. All fishing must cease by 0600 hours on 3 May 2009.

TAKE note that the notice made under section 79 of the Fisheries Management Act 2007, dated 14 May 2009, referring to the Spencer Gulf Prawn Fishery, is hereby revoked.

Take note that the notice made under section 79 of the Fisheries Management Act 2007, published in the South Australian Government Gazette, dated 5 March 2009, referring to the West Coast Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a West Coast Prawn Fishery Licence to use prawn trawl nets in the waters specified in Schedule 1, under the conditions specified in Schedule 2, during the period specified in Schedule 3.

SCHEDULE 1

The waters of the West Coast Prawn Fishery adjacent to Venus Bay.

SCHEDULE 2

1. Each licence holder must ensure that a representative sample of the catch (a ‘bucket count’) is taken for each trawl shot carried out during the fishing activity.

2. Each ‘bucket count’ sample must be accurately weighed to 7 kg where possible and the total number of prawns contained in the bucket must be recorded on the attached data sheet, marked ‘West Coast Prawn Fishery Bucket Count Data Sheet’.

3. The information recorded on the ‘WCPF Bucket Count Data Sheet’ must be returned to SARDI Aquatic Sciences within 15 days of the fishing activity being completed.

4. Fishing must cease if one or both of the following limits are reached:

(a) the average catch per vessel, per night (for all three vessels) drops below 300 kg for two consecutive nights;

(b) the average prawn ‘bucket count’ for all three vessels exceeds 240 prawns per bucket on any single fishing night.

5. The fleet must nominate a licence holder to provide a daily update by telephone or SMS message to the PIRSA Fisheries Manager, to report the total prawn catch per night and the average prawn ‘bucket count’ information.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Branco Sarunic, 5 Bellwood Avenue, Port Lincoln, S.A. 5606, holder of Marine Scalefish Fishery Licence No. M354, or a master registered on that licence (the ‘exemption holder’), is exempt from Regulation 7 (b) of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder may use a registered sardine net for the purposes of trade or business in the waters described in Schedule 1 (the ‘exempted activity’), subject to the conditions set out in Schedule 2, from 8 May 2009 until 30 April 2010, unless varied or revoked earlier.

SCHEDULE 1 • Waters of Coffin Bay northerly of the geodesic 3431 (Point

Longnose).

• Waters adjacent to Port Lincoln contained within the geodesic from Point Bolingbroke, (latitude 3432.51S and longitude 13605.33E), to Cape Donington (latitude 3443.73S and longitude 13559.63E), excluding those waters adjacent to Port Lincoln bounded as follows: commencing at a point at the high water mark at the shore end of the North Shields Jetty, thence in a generally east-south-east direction to Maria Point on Boston Island, thence following the high water make in a southerly direction to the light at Point Fanny, thence in a direction of 249t to the most northerly part of Billy Lights Point, thence along the high water mark to the point of commencement.

SCHEDULE 2 1. The exemption holder may only undertake fishing activity pursuant to this exemption when fishing from a boat that is registered on Marine Scalefish Fishery Licence No. M354.

2. The exempted activity may only be undertaken using a sardine net with a maximum depth of 100 m.

3. The exemption holder must comply with all conditions of Marine Scalefish Fishery Licence No. M354 while engaged in the exempted activity.

4. While engaged in the exempted activity the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested.

5. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically permitted by this notice. Dated 4 May 2009.

Revocation of Approval of Category B Containers

I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby revoke the approvals of the classes of Category B containers sold in South Australia as identified by reference to the following matters, which are described in the first 4 columns of Schedule 1 of this Notice:

(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers;

(d) the name of the holders of these approvals.

These approvals are revoked as the Authority is satisfied that the waste management arrangement between the approval holder and the party named in Column 5 of Schedule 1 of this Notice has been cancelled.

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:

Approval of Category B Containers

Approve as Category B Containers, subject to the conditions in subclauses (1), (2), (3) and (4) below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:

(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers; and

(d) the name of the holders of these approvals.

(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class.

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Temporary Closure of Coorong National Park

PURSUANT to Regulations 8 (3) (a), 8 (3) (d) and 11 (1) of the National Parks and Wildlife (National Parks) Regulations 2001, I, Edward Gregory Leaman, Director of National Parks and Wildlife, close to vehicular traffic, part of the Coorong National Park from 9 a.m. on Friday, 8 May 2009, until further notice.

The closure applies to the section of the Younghusband Peninsula contained within and bounded by a line traversing the Peninsula from east to west at latitude 361641.6S, longitude 1394119.1E (approximately 3.5 km north of 42 Mile Crossing) and a line traversing the Peninsula from east to west at latitude 361530.9S, longitude 1394048.5E (approximately 7 km south of Tea Tree Crossing).

Visitors may continue to access this part of the reserve on foot.

The purpose of the closure is in the interest of public safety following severe erosion within this part of the reserve due to recent weather events.

Exemption for Licensees under the Fisheries Management (Lakes and Coorong Fishery) Regulations 2006 and Fisheries

Management (Marine Scalefish Fisheries) Regulations 2006

Pursuant to Regulations 8 (4), 11 (1) and 41 of the National Parks and Wildlife (National Parks) Regulations 2001, I, Edward Gregory Leaman, Director of National Parks and Wildlife, grant permission to holders of licences; registered masters of a registered boat used under such a licence and persons engaged on the shore as an agent of the holder of the licence under either the Fisheries Management (Lakes and Coorong Fishery) Regulations 2006 or Fisheries Management (Marine Scalefish Fisheries) Regulations 2006, to continue to use vehicles in the Coorong National Park from 9 a.m. on Friday, 8 May 2009, until further notice, for the purpose of undertaking a fishing activity of a class that constitutes the fishery in accordance with the Regulations.

This permission is conditional upon the observance by each of those persons of the requirements of the National Parks and Wildlife Act 1972, National Parks and Wildlife (National Parks) Regulations 2001, including those requiring compliance with the Director’s requests, requirements and orders of a Warden.

Closure of Cape Torrens Wilderness Protection Area and Western River Wilderness Protection Area

PURSUANT to Regulations 6 (2) (c) of the Wilderness Protection Regulations 2006, I, Edward Gregory Leaman, Director of National Parks and Wildlife close to the public the whole of Cape Torrens Wilderness Protection Area and the whole of Western River Wilderness Protection Area from 6 p.m. on Sunday, 14 June 2009 until 6 a.m. on Saturday, 27 June 2009.

The purpose of the closure is to ensure the safety of the public during an animal control and monitoring program within the reserves during the period indicated.

Use of Firearms Within the Reserves

Pursuant to Regulations 6 (4), 16 (1) and 34 of the Wilderness Protection Regulations 2006, I, Edward Gregory Leaman, Director of National Parks and Wildlife grant permission to staff employed by the Kangaroo Island Natural Resources Management Board in

possession of both a current Hunting Permit and a firearm to enter and remain in the whole of Cape Torrens Wilderness Protection Area and the whole of Western River Wilderness Protection Area from 6 p.m. on Sunday, 14 June 2009, until 6 a.m. on Saturday, 27 June 2009, for the purpose of taking feral animals.

This permission is conditional upon the observance by each of those persons of the requirements of the Wilderness Protection Act 1992, Wilderness Protection Regulations 2006 and the National Parks and Wildlife (Hunting) Regulations 1996, including those requiring compliance with the Director’s requests, requirements and orders of a Warden.

MAXIMUM PRICE FOR THE CARRIAGE OF FREIGHT BY KANGAROO ISLAND SEALINK PTY LTD

Order by Delegate of the Minister for Consumer Affairs

PURSUANT to section 24 of the Prices Act 1948, I, Margaret Thetis Phelps, being a person to whom the Minister for Consumer Affairs has delegated her powers under that section, make the following order.

Citation

1. This order may be cited as Prices Order No. 6731 (S.A.).

Commencement

2. This order will come into operation on 1 May 2009.

Order No. 6730 (S.A.) Superseded

3. This order supersedes Prices Order No. 6730 (S.A.) dated 15 August 2008.

Interpretation

4. (1) In this order:

‘freight’ includes a motor vehicle that is:

(a) carrying freight; or

(b) travelling to a place to collect freight; or

(c) on a return journey from a place to which it has carried freight;

‘GST’ means the tax payable under the GST law;

‘GST law’ means:

(a) A New Tax System (Goods and Services Tax) Act 1999 (Commonwealth); and

(b) the related legislation of the Commonwealth dealing with the imposition of a tax on the supply of goods, services and other things;

‘motor vehicle’ means a motor vehicle as defined in section 5 of the Motor Vehicles Act 1959 (including a trailer as defined in that section).

Declaration of Maximum Price

5. I declare that the maximum price at which the carriage of freight may be supplied by Kangaroo Island Sealink Pty Ltd is $37.05 per linear meter (inclusive of GST component).

RAIL SAFETY ACT 2007

Notice of Appointment of Authorised Officers

I, PHILLIP THOMAS ALLAN, Rail Safety Regulator in the State of South Australia, pursuant to my powers under section 22 of the Rail Safety Act 2007 (‘the Act’) hereby appoint Angela Parry and Justin Brown referred to in the Schedule to be Authorised Officers for the purposes of the Act subject to the following conditions:

1. The appointment of persons referred to in the Schedule as Authorised Officers pursuant to this notice shall be auto-matically revoked without the necessity for a further notice in the event that the persons cease to hold a position in the Rail Safety Section (RSS) or any succeeding section or unit performing similar functions to the RSS.

2. This appointment may be revoked or varied by me at any time by further notice in writing.

ROADS (OPENING AND CLOSING) ACT 1991: SECTION 24

NOTICE OF CONFIRMATION OF ROAD PROCESS ORDER

Road Closure—Jamestown

BY Road Process Order made on 11 December 2008, the Northern Areas Council ordered that:

1. Portion of the un-named public road situate adjoining allotments 5 and 6 in Deposited Plan 65658, more particularly delineated and lettered ‘A’ and ‘B’ (respectively) in Preliminary Plan No. 08/0003 be closed.

2. The whole of the land subject to closure be transferred to Suzlon Energy Australia Pty Ltd in accordance with agreement for transfer dated 24 November 2008 entered into between the Northern Areas Council and Suzlon Energy Australia Pty Ltd.

On 2 April 2009 that order was confirmed by the Minister for Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 80557 being the authority for the new boundaries.

Pursuant to section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.

BY Road Process Order made on 23 February 2009, the City of Burnside ordered that:

1. Portion of Sherwood Terrace on the north-east corner of the intersection of Sherwood Terrace and Caithness Avenue adjoining allotment 92 in Deposited Plan 3863, more particularly delineated and lettered ‘A’ in Preliminary Plan No. 08/0033 be closed.

2. The whole of the land subject to closure be transferred to Maria Rita Snook in accordance with agreement for transfer dated 23 February 2009, entered into between the City of Burnside and M. R. Snook.

South Australia—Gulf St Vincent—Christies Beach Waste Water Treatment Plant Installation of Outfall Pipes

SA WATER has been granted an Activities Licence under section 26 of the Harbors and Navigation Act 1993, for the exclusive use of the waters bounded by the following co-ordinates. The purpose of the licence is for activities associated with the marine installation of an underwater outfall pipeline off the coast of the Christies Beach Waste Water Treatment Plant.

Co-ordinates as follows:

Latitude 350731.56S, longitude 1382742.46E. Latitude 350729.56S, longitude 1382807.98E. Latitude 350735.81S, longitude 1382809.27E. Latitude 350737.97S, longitude 1382743.75E.

A map of the area is to be displayed at O’Sullivan’s Beach boat ramp and at Christies beach.

All vessels are at all times required to keep a distance of at least 100 m from any vessels working within the area of the above co-ordinates on the installation of the outfall pipeline. The work vessels will exhibit day shapes and navigation lights in accordance with the Prevention of Collisions at Sea Regulations (as defined in the Harbors and Navigation Regulations 1994).

Emergency Management Regulations 2009

under the Emergency Management Act 2004

1—Short title

These regulations may be cited as the Emergency Management Regulations 2009.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Interpretation

In these regulations—

Act means the Emergency Management Act 2004.

4—Prescribed powers

For the purposes of section 25(2)(o) of the Act, the State Co-ordinator or an authorised officer may exercise the following prescribed powers:

(a) carry out, or cause to be carried out, excavation or other earthworks;

(b) construct, or cause to be constructed, barriers, buildings or other structures;

(c) remove or destroy, or order the removal or destruction of any thing;

(d) direct a person to remain isolated or segregated from other persons or to take other measures to prevent the transmission of a disease or condition to other persons;

(e) direct a person to undergo medical observation, examination (including diagnostic procedures) or treatment (including preventative treatment);

(f) require a person to furnish such information as may be reasonably required in the circumstances (other than information that may be required to be furnished under section 6 of the Essential Services Act 1981).

5—Confidentiality

If a person, in the course of the administration or enforcement of the Act, obtains—

(a) medical information relating to another; or

(b) information the disclosure of which would involve the disclosure of information relating to the personal affairs of another,

the person must not intentionally disclose that information unless—

(d) the disclosure is made with the consent of the other person; or

(e) the disclosure is required by a court or tribunal constituted by law.

Maximum penalty: $5 000.

1—Short title

These regulations may be cited as the Public and Environmental Health Variation Regulations 2009.

2—Commencement

These regulations come into operation on the day on which they are made.

CITY OF HOLDFAST BAY

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999 AND THE DOG AND CAT MANAGEMENT ACT 1995

By-law No. 50—Cats

FOR the control and management of cats in the Council’s area, to prevent the keeping of cats so as to be a nuisance or injurious to health and to limit the number of cats that may be kept on premises.

1. Definitions

In this by-law:

1.1 ‘boarding kennel’ means a building, structure, premises or area approved by the relevant authority, pursuant to the Development Act 1993, for the keeping of cats on a temporary or permanent basis;

1.2 a ‘cat’ means an animal of the species felis catus over six weeks of age;

1.3 ‘keep’ includes the provision of food or shelter;

1.4 ‘identified cat’ means a cat identified in the manner set out in Regulation 9 of the Dog and Cat Management Regulations 1995;

1.5 ‘premises’ means any aggregation of contiguous land (including any structures erected thereon) subject to the same occupation; and

1.6 ‘unidentified cat’ means a cat that is not identified in the manner set out in Regulation 9 of the Dog and Cat Management Regulations 1995.

2. Cats Not to Be a Nuisance

No person shall keep or allow to remain on any land of which he or she is the owner or occupier, any cat or cats so as to be a nuisance or injurious to health by reason of:

2.1 the noise or odour generated by the presence of the cat or cats;

2.2 the aggressive nature of the cat or cats; or

2.3 the cat or cats being allowed to wander from the land.

3. Limit on Cat Numbers

3.1 No person shall, without permission:

3.1.1 keep a cat of or over the age of three months unless the cat is an identified cat;

3.1.2 keep more than two cats on any premises.

3.2 The limit set out in paragraph 3.1 of this by-law does not apply to a person who is keeping more than two cats on any premises at the time this by-law comes into effect provided that:

3.2.1 all the cats being kept on the premises are desexed;

3.2.2 no insanitary condition is being caused by the cats or the keeping of the cats on the premises; and

3.2.3 no nuisance is being caused by the cats or by the keeping of the cats on the premises.

3.3 Notwithstanding paragraph 3.2 of this by-law, the limit set out in paragraph 3.1 of this by-law will apply where the number of cats kept on any premises increases after the time this by-law comes into effect.

3.4 The limit set out in paragraph 3.1 of this by-law does not apply to veterinary practices and pet shops or boarding kennels in respect of which a development authorisation is in force pursuant to the Development Act 1993.

4. Notice to Remedy

4.1 If the Council is satisfied that any cat kept or allowed to remain on any premises is or is likely to become a nuisance or injurious to health, the Council may by notice in writing require the owner or occupier of those premises, within the time stated in the notice, to take such measures as the Council considers necessary to prevent the cat from being or continuing to be a nuisance or injurious to health.

4.2 Any person to whom notice is given shall comply with the requirements of the notice.

4.3 If any person to whom notice is given fails to comply with the requirements thereof, the Council may carry out the requirements and recover the cost in so doing.

5. Application

This by-law is subject to any Act of Parliament and Regulations made thereunder.

A breach of this by-law may incur penalties as outlined in By-law 1.

The foregoing by-law was duly made and passed at a meeting of the Council of the City of Holdfast Bay held on 28 April 2009, by an absolute majority of the members for the time being constituting the Council, there being at least two-thirds of the members present.

Assignment of a Name for a New Public Road

NOTICE is hereby given that the Council of the City of Port Adelaide Enfield at its meeting held on 14 April 2009, resolved that pursuant to section 219 (1) of the Local Government Act 1999, that a certain new public road in the suburb of Gepps Cross be assigned the street name Matthews Road.

Road Closure, Nangwarry

NOTICE is hereby given that pursuant to section 10 of the Roads (Opening and Closing) Act 1991, the Wattle Range Council hereby gives notice of its intent to implement a Road Process Order to close the whole of the un-named public road adjoining the southern boundaries of sections 41, 42, 44, 45 and 46, Hundred of Nangwarry, more particularly delineated and lettered ‘A’, ‘B’, ‘C’ and ‘D’ in Preliminary Plan No. 01/0710.

Closed road to be merged ‘A’, ‘B’ with allotments 94 and 95 in Filed Plan 214431 (both held in CT 6019/114), ‘C’ with section 44 (held in CT 6019/968) and ‘D’ with section 45 (held in CT 6019/968).
