EDITORIAL

Bienvenidos lectores.

Welcome readers, at last the local elections are behind us and the shape of the local governments been fi nalised. Hopefully after some of the most acrimonious campaigning for many years, the rivals can now kiss and make up whilst we can look forward to the summer and all that it brings.Well the summer well and truly kicks off this month with a steady stream of ferias and fi estas starting on the 23rd June with Noche de San Juan, the midsummer celebrations, which will be taking place on many of the Coast’s beaches. For most people this heralds the true start of the summer so make sure you note it in your diary.Sabinillas plays host to Manilva’s annual International Festival which this year will be held over three days from the 22nd to 24th July and promises to be a great weekend of entertainment, food and celebration of the municipality’s cultural diversity.Estepona celebrates its Summer Feria from the 5th to the 10th July closely followed by another major festival in the shape of Virgen del Carmen, on the 16th July, when the fi shermen of the region pay homage to their patron

saint. You can fi nd details of these events and more in this month’s issue, as well as on our website www.theresident.esOn a serious note, now that the summer is here, there are just a few things to be careful. Please watch your kids around swimming pools. Every year we suffer the tragedy of fatal pool accidents, often through a moment’s lack of supervision, so make sure someone is keeping an eye on them. The other big problem of the summer is fi re, which this year has been made all the more dangerous by the huge amount of ‘fuel’ which has sprung up as a result of recent wet winters. Apart from the obvious precautions such as not lighting fi res or barbecues in the campo, or carelessly discarding cigarette ends, be careful when pulling your car off the road into long grass or dry vegetation as hot exhaust or brakes have been the cause of many a fi re.Sorry if I sound a bit preachy, but with a little bit of common sense, we can all enjoy the coming summer months with peace of mind.Until next month...

The English Bookshop’s been there forever! Well not quite, but from 1992 when Lynne Mortiboys opened a small shop next to MiSuper supermarket (where the Chinese emporium is today) there has been an English bookshop in Sabinillas, with the shop moving to its present location around 1997.We, Alma and Eddie Borg, have owned the business for 12 years and in that time have met so many lovely people, and hope that we made everyone feel at home in the shop. Twelve years is a long time and now with retirement beckoning and Eddie’s ill-health it’s time to step aside. We will miss the bustle of the shop, it has become a

He says he will not jump in and change things straightaway, so rest assured everyone will still get their copy of The Resident! Please support him as much as you have all supported us.

Manilva SolicitorsTENANCY & RENTAL CONTRACTSOver the past few months, we have received 3 or 4 enquiries on tenancy and rental contracts every week, probably due to the crisis and fi nancial problems people are currently suffering. There are too many tenants not paying their monthly rents and too many landlords desperate with these situations.Unfortunately, more often than not people come to us with no signed rental contract or with tenancy contracts not properly drafted. This is one of the most delicate parts of the Spanish Law, and, therefore, before signing a rental or tenancy document the right guidance and advice is vital. Whether you are a landlord or a tenant, not requesting professional legal advice when you are going to sign a written Rental Contract, or an agreement concerning residential or commercial property, can cause serious problems in the future. For example, a tenant could legally stay in a rental property for up to 5 years.Oral agreements are legally valid in Spain but we strongly recommend you have a written lease that includes appropriate clauses to protect your interests. Although the Spanish Law governs the rights and responsibilities of tenants and landlords, the Law allows them to establish special clauses and terms in these Rental Contracts, so it is advisable to seek professional guidance and draft the contract in such a way that it refl ects perfectly your personal requirements. There are also many points that must be clearly detailed. A part of the contract specifi es the name of the landlord and the

tenant, the location of the property, the duration of the lease and the due date and amount of rental payment. The agreement can also include any other legal provisions to which both parties agree, such as:

Warranty of habitability. A Landlord 1. must provide a safe and sanitary place for tenants. A Landlord can be required to provide fi re extinguishers and other such fi xtures as ovens, refrigerators, sinks, etc.How communications and 2. notifi cations of agreements, problems or understandings between landlord and tenant will be resolved. What happens when repairs legally 3. required are not made by landlord or tenant? When, and how much can the landlord 4. increase the rent?Who has the responsibility for the 5. maintenance?Guidelines for any repairs to the 6. house. Is it possible to sub-let the property?7. Penalties for breaking the lease by 8. the tenant or the landlord. The possibility that landlords or 9. tenants have of passing their rights and obligations on to another person.Who pays; community fees, IBI local 10. property taxes, and home insurance?

It is always better to prevent misunderstandings before signing, please let your solicitor read the lease carefully and suggest deleting or changing any clauses that, in his professional opinion

could severely limit your rights, or could prejudice you in some way in the future.Solicitors know the Spanish Law and can also draw up a new lease proposal that suits your needs. The solicitor will also request and organise that the other party signs the contract. Let your solicitor use his knowledge to protect your interests.

As an indication, normal legal fees for preparing, revising and negotiating normal residential Rental Contracts are around 300 Euros so it is well worth seeking legal advice to get a fi rst-rate rental contract which will protect your legal rights and prevent possible unnecessary expense in the future.Should you already have a rental problem because your tenant does not pay the rent, or because your landlord wants you leave the property, it is also sensible to take legal advice as soon as possible. From our experience the sooner you take legal action the better, as the longer a problem is left; the more diffi cult it is to sort out.

This is held each year on the evening of the 23rd of June and goes on into the early hours of the 24th (Dia de San Juan). It’s the old pagan midsummer celebration which has been ‘Christianifi ed’ by tacking it on to a convenient Saint’s day (if you can’t beat ‘em, join ‘em sort of thing). There are a number of traditional ways of celebrating Saint John’s Night most of which involve a good bonfi re. In many municipalities the central celebration is the ‘Quema de los bigotes de San Juan’ - literally ‘burning of the moustaches’ - where large papier mache fi gures, many of a satirical nature, are paraded through the town before being burnt on the beach. In Sabinillas a huge tableau is constructed on the beach a few days before the event. This work of art is based on a different theme every year, and it is almost a crime

Noche de San Juanwhen, around midnight, the whole thing is set alight. It is also customary at this time to walk into the sea to wash away any bad luck.Another tradition is for the young men of the town to jump or dive over the bonfi res once they have died down a bit, the higher the fl ames, the greater the challenge. The night is usually marked by fi rework displays, live music and dancing until the early hours of the morning.Sabinillas is by no means the only town hosting San Juan celebrations, Estepona holds a competition for the best ‘bigotes’, and Casares enjoys live music, bonfi res and sardines on the beach at Marina de Casares, with other towns worth a visit are San Roque, Taraguilla and Torreguadiaro who all stage celebrations of one sort or another.

The new Mayor of Estepona, José María García Urbano, has set out as his goal the task of restoring the brand and prestige of Estepona, by returning the municipality to democratic normality, and implementing effi cient management of local services and observing strict compliance with regulations and the law.

During his inaugural speech, José María García Urbano pledged to reduce response times by the administrative departments, to honour agreements, commitments, judicial decisions and concessions and to create a return to transparency throughout the administration.

At the fi rst regular council meeting since the elections, the government of Estepona approved the new scale of wages and expenses for the members of the council and those in positions of trust, which will save 328,930 euros per year compared to the scale of remuneration set by the previous administration. These salaries conform to the guidelines set by the Federation of Andalucian Municipalities and Provinces. The purpose is to reduce the costs of government under the policy of austerity that marks the main priority of the new government team led by the Mayor, José María García Urbano. During the last term

the governing body had nine members with a total cost to the Town Hall coffers of 756,000 euros per year.By contrast the new government, which consists of 17 councillors, will have a total salary bill of just 665,000 euros per year. This is just one of the measures introduced to address Estepona’s huge debts and ‘diffi cult’ economic situation which has been inherited from the former government. The number of temporary ‘positions of trust’ has been cut from 21 to 17, just one per councillor. Thus the staff wage bill will be 672,000 euros annually, as opposed to the previous 910,000 euros.

Estepona’s new council reduces by four the number of ‘positions of trust’

Estepona celebrates its annual summer fair next month from the 5th to 10th July. There will be a whole host of activities and entertainment both in the town

The Mayor has sought permission from the Junta de Andalucia for excavations to be carried out as soon as possible so as to move project forward.

CLÍNICA QUIROPRÁCTICA EN ESTEPONA

It’s known that millions of people have benefi ted from this natural health science. Many advances have been made in the 100-year history of chiropractic, but probably the main one has been the public acceptance of the results obtained. In recent years, science has proven what many patients have known for decades, chiropractic is effective.Scientifi c factChiropractic is based on the scien-tifi c fact that the nervous system con-trols the function of virtually every cell, tissue, organ and body system.Multiple studies have compared the treat-ments using drugs or surgery with chiro-practic treatment, they have demonstrated the effectiveness and speed of the latter. The fi rst visit includes a review of your medical history, a comprehensive review of movement (biomechanical analysis), neurological studies, orthopedics and ki-nesiology (study of the muscles).Comprehensive educationThe science of chiropractic requires a special emphasis on anatomy, physiology, pathology, neurology, biomechanics, radiology, as well as spinal and limb adjustment techniques.SpecialtiesThere are specialties within chiropractic after obtaining a doctorate in chiropractic. These are in orthopedics, radiology, neurology, sports medicine, rehabilitation, nutrition, occupational medicine and family medicine.Examinations and Further EducationJust as doctors from other specialties, chiropractic doctors attend educational seminars to keep their licenses current and catch up with technological advances. In addition, they also follow a strict code of ethics.SafetyChiropractic is safe. Chiropractic has an excellent safety record. As the result of

a natural and conservative approach to health, in many cases avoids invasive procedures or the complications of active drugs.Benefi tsChiropractic doctors treat more than just spinal problems. Chiropractic doctors are well known for successfully treating low back pain and related problems. However, many doctors of chiropractic problems also work with neuromusculoskeletal (nerves, muscles, bones) from other parts of the spine (neck and middle back) and extremities (problems of the shoulders, elbows, wrists, hips, knees, ankles, etc.).Chiropractic makes a difference. Most patients report how good it feels to receive a chiropractic adjustment. As treatment progresses, they respond positively, ie fi nd relief from their symptoms.Chiropractic is for all ages.Different treatment techniques are used in accordance with age, poor health and physical condition of the patient. In particular, infants, children and young people respond to chiropractic treatment outstandingly.Although not yet completed the scientifi c evidence reveals a large number of parents reporting that their children, chiropractic patients, have fewer colds, ear infections and other common health conditions in childhood.Women who have received chiropractic care during pregnancy found that childbirth is less cumbersome and faster. The Elderly also benefi t from chiropractic. Similarly, many athletes undergo chiropractic treatment to restore mobility of joints which are sometimes injured while practicing their sport.

The number of pet-friendly hotels has increased by 30 percent in this country. Some 38 percent of Spanish are living with pets. When summer arrives and with it the desire to travel or plan a getaway, but what to do with our pets? Many people leave their animals with family and others want to travel and have them along, but many are unaware of the sites that can be found with suitable accommodations. Each year in Spain there are increases in the number of establishments that accept pets. In order to avoid the stark reality of animal abandonment which occurs both in summer as well as in any other holiday period, the Affi nity Foundation has made a guide for traveling with animals that is intended to help owners to plan holidays with your dog or cat. The guide is available at bookstores and on the website of the Foundation for 12.50 euros. In total there are 7200 hotels, cottages and campsites that accept pets. For the autonomous communities, most hotels that accept animals are found in Catalonia (679 ), followed by Andalusia (542) and Castilla y Leon (293). At the other end of the scale are the Balearic Islands, Galicia and the Canary Islands. The latter has doubled the number of “pet-friendly hotels” since 2001 and throughout all the regions of Spain they have experienced a 30% growth rate. It is important to note that the hotels with more stars, a higher rating, are those that are more permissive. All in all about 21% of hotels in Spain permit dogs and/or cats. With regard to the cottages, the Castilla y León autonomous community will more

readily accepts pets. The Balearics are located in the tail end of the ranking, in just one year, however, the number of establishments with houses available there has passed from 2,200 to 3,000 houses there today. The campsites are a more permissive accommodation, 81% pet friendly. For communities/region, Catalonia, again in the forefront with about 292 campsites. The guide also offers practical advice and information on 1,500 veterinary hospitals and veterinary centres and 240 emergency service and cat kennels where dogs and cats may be boarded. Here are a few additional bits to be conscious about and some tips before you travel:HealthBefore beginning a journey you should visit the veterinarian for a check-up and a review of the pet passport. Passport Dogs, cats and ferrets traveling within Member States of the European Union need a passport.Means of transportThe car is the most simple and convenient means of traveling with animals. When needed, the animal can get out, walk, eat, drink or relieve themselves.Baggage musts to take for the animal Do not forget the collar, leash , food, toys and shampoo. It is important to bring a bottle of fresh water for the journey (not only for them!).

A Simple way to make an appointment with your doctor

When you next need to make a doctor’s appointment, you can consider avoiding the journey to join the long queues at your Centro de Salud (health centre) and or save on the cost of calling a 902 telephone number. If you have access to the internet you will be surprised at how simple it is. All you need is to go to the Junta de Andalucía‘s webpage, link below. Fill in your social security number and NIE and date of birth. This will take you to the following page where you have the option of choosing the date and time to suit you. If there is not an appointment available at the chosen time, you will be given options of additional dates. Once you make your choice click on accept. You will be provided with a printable form with all the details. No printer? Jot down the details or save. The only drawback is for anyone not acquainted with the Spanish language. There is an option for English but not always reliable. It would be worth taking the time and fi nd someone to assist you in your fi rst attempt. For future use you will fi nd this approach is simple and very convenient. http://www.juntadeandalucia.es/salud/sites/csalud/portal/index.jsp

It is a buyer’s market but are you purchasing a bargain?

With properties at an all time low many purchasers have decided to take avail of the many bargains available to purchase one of the many dwellings being offered at extraordinarily competitive prices. Many of these are now being sold by the banks themselves who are even willing to lend considering mortgages at a hundred percent of the asking price. Be cautious and calculate the costs. Nobody seems willing to warn you that even though you may declare the full asking price, legally pay your taxes and costs; you will almost certainly be presented with a further tax bill within the year following your purchase. The reason for this complement is due to two reasons, prices at an all time low and that most of the town halls assessed the valor catastral (the estimated value of your property) when the market was at an all time high. Take these two issues into consideration and you will understand that the price you have paid for your property will be much lower than the value placed on it. If you think the demand for the extra tax is of a considerable amount, it may be worth taking the matter up with the authorities and making a claim.

The Census and further information

I have come across yet another forum where someone relocating to Spain was given incorrect information. I am sure we are all familiar with bar stool experts but this advice came from someone stating that they assisted the expatriate community to

Costa Advice Bureaua NIE or assist with residence applications. Be careful who you employ to carry out these services as there are agents who have no training or suffi cient knowledge to carry these transactions. Spanish bureaucracy is not only complicated and often confusing, take into account that the rules are continually changing so it is essential to understand the system and the differences between obtaining an NIE or Resident status. If you have decided to take up residency in Spain there is no need to obtain an NIE so avoiding the added costs and time involved. Apply for residence and your NIE will be included in the document. Other erroneous information is that to obtain the NIE, one would need to pay a visit to the town hall to register on the padron (census) the latter should only be carried out if you are taking out residency. You may not be planning to live in Spain full time and only need your fi scal number (Numero de identifi cacion extranjeros) so in this case registering on the census may alter your tax liabilities. For those of you who have been on the system for many years remember to renew your and your family’s names on the census. When asked for proof that you are registered in the town hall and for any legal or fi scal transaction, you will be expected to provide an up to date issue of this certifi cate.

Making a Spanish willThere are many websites given information on drawing up a Spanish will. There are two very important matters that are not usually discussed. The fi rst is that when you make Spanish will and any additional testaments in other countries where you have assets, keep the descriptions in these wills totally separate. That is to say do not mention your assets in Spain in for example a British will or vice versa. This will complicate the matter when the will is being executed. The second and equally as important issue to take into account that as though correctly stated on various forums and websites that, the foreign resident has the advantage over his Spanish counterpart allowing the legal right to draw up a will in accordance to the law of their country or origin (A Spanish citizen is guided by the law of this land and does not have the choices the expatriate has) this is what can occur if the will is contested. This probability may occur where there are children from a previous marriage or anyone who feels that they have been disinherited. It is highly likely that a court could supersede your wishes and if so the outcome could be that the court will decide on the side of the Law of Spain, arriving at the conclusion that the assets should be divided accordingly.

When I was young my ambition was to be an architect and although I had done well in my fi nals there seemed to be no vacancies for girls at that time.I took a post at the local Essex Agricultural College in the Biology Department where I was given the task of making teaching materials and large posters of anatomical subjects for use in the lectures. Six years later I went to Teacher Training College and was able to have some experience of craftwork of various kinds as well as studying Biology. When I married the demands of raising a family and teaching kept me busy but I was

John Mayall

Pioneering English blues singer, songwriter, and multi-instrumentalist, John Mayall has enjoyed a musical career spanning over fi fty years, but the most notable episode in it occurred during the late 1960s. He was the founder of John Mayall & the Bluesbreakers and, as a gifted talent-scout, has been infl uential in the careers of many instrumentalists, including Eric Clapton, Jack Bruce, Peter Green, John McVie, Mick Fleetwood, Mick Taylor, Don “Sugarcane” Harris, Harvey Mandel, Larry Taylor, Aynsley Dunbar, Hughie Flint, Jon Hiseman, Dick Heckstall-Smith, Andy

Sunday June 19, 8 pmFraser, Johnny Almond, Walter Trout, Coco Montoya, and Buddy Whittington. After years of touring and recording John Mayall decided to disband the Bluesbreakers in 2008, but after enjoying the freedom of doing his own thing he put together a new band in 2009 and since then has enjoyed touring on a more limited basis. You can see John Mayall at Malaga’s Teatro Cervantes on Sunday June 19 from 8 pm. Tickets are available online at www.generaltickets.com/unicaja/ priced from 15€ to 45€.

THundreds of bikers pitched up earlier this month to celebrate the opening of Manilva’s ‘Ace Cafe’. Like its London namesake the Ace Cafe, near Duquesa, caters to motorcyclists from all walks of life whether weekend riders or the dedicated biker fraternity. Besides the usual bar services, the Ace Cafe also boast an on site motorcycle repair service in the shape of Patriota Motos (www.lapatriotamotos.co.uk).To help the party along there was live music provided by the ever popular Costa Rock who took the stage on Saturday afternoon. On Sunday it was the turn of the Beer Bellys, a slick Spanish Rock’n’Roll/Rockabilly fourpiece, who had the place rocking. The weekend was also organised to celebrate the 1st Anniversary of the formation of the Patriot Nomads Motorcycle Club, a chapter of the Patriot Motorcyle Club.

Rockers hit the CostaDuring the weekend, I took the opportunity to have a chat with MickRik and Wiggie, both members of the Patriots, to fi nd out more about the Patriots MC.The Patriots MC is a motorcycle club, actually motorcycle club doesn’t adequately describe it, more of a brotherhood, comprising of likeminded individuals all of whom share a love of the biker way of life, with the added proviso that to be a member you must have, or currently be, a serving member in the armed forces. The Patriots was founded some 14 years ago and has a number of chapters, membership of which depends on nationality, branch of the forces, etc., with the Nomads being founded a year ago for expat members. Despite the differences all Patriots share the same creed, that of ‘Brothers in Arms’ which they proudly display on their jackets. For more information see the Patriots website at www.patriotsmc.co.uk

Pensar, ser niño en la barca

...El mar actúa de forma increíble, que, de una forma vertiginosa, hace que la ola avance sobre la arena, te llame en la orilla, y busca tus pensamientos para hacerlos navegar.Pensar es importante, declarar razones que sustenten el vivir;fi losofía del hombre,alma del pensamientoy la razón que mide el espíritu por su emoción y su sentir.Pensar, ser niño en la barca,navegar hasta la orilla,encontrar una hoja de agua,una niña de fl ores,un mundo que madura en las olas;

Welcome to The Resident Fitness & Food column written by personal trainer JoJo France and nutritional therapist Claudia Norris. With the weather warming up and lazy afternoons and evenings ahead at the chiringuitos, it’s easy to rack up the calories without even realising. Not many of us would drink a cup of cream, yet we would quite easily knock back a couple of shots of Vodka. This month we’re looking at exactly how many calories are in various drinks and what that equates to in terms of food and exercise. The UK Department of Health carried out research showing a regular beer drinker, who downed fi ve pints a week or 250 over the course of a year, packed away the same number of calories as someone eating 221 doughnuts over the space of 12 months. It also revealed the average wine drinker consumed 2,000 calories each month. Over the course of a year, that is the equivalent of eating an extra 38 roast beef dinners. It’s not just the calories in drinks themselves which can help pile on the kilos, but we’re also more likely to eat fatty foods after a drink or two. So, choose your drinks wisely this summer and keep up with JoJo’s exercise recommendations...

Last month the U17 Andalucia Fencing Championships were held in Maracena, Granada. The International Fencing Club of Estepona once again put in a good performance with Cristina Ocaña taking the Bronze medal, and concluding a very successful season for the Estepona swordswoman. The best result though was reserved for the Club which achieved second place in the Women’s Competition, just losing out in the dying seconds to the Andalucian Champions.

This is good news for the team, and especially for the trainer, Rosibel Vindel, who is achieving excellent results at Andalucian and National level. There were good results also from Gonzalo Toledo, who at only 13 years of age competed with some of the best in the under-17s, achieving a top 15 ranking in the Andalucian Championship. These results point to a good season for the International Fencing Club of Andalucia which looks forward to the Andalucian Championships in Almeria this month.
