Abstract

This article assembles a suggested reading list of law books from Argentina for those seekingto explore and delve into the richness of this national legal literature. Although the authors are care-ful to point out that broad conclusions are not supported by their limited methodology, the bookswere chosen for their scholarly authority. The books make up a core of distinctly doctrinal sources(digests, annotated codes, encyclopedias, treatises, and certain monographs) recommended by le-gal practitioners from across the nation.

1. Introduction What is the current state of legal doctrine in Argentina at the point of entry of law and economics? To find out what law books are mainstays of Argentina's legal literature, we conducted a survey—between May and November, 2006—of 1723 practicing Argentinean lawyers listed in the Martindale-Hubble International Law Directory.1 We posed two questions to the group:2 What do you think are the 10 most important books of the Argentinean legal tradition? Would you tell us why you would include these works as part of your national legal canon? On the basis of the answers compiled, the following books were identified as being particularly important to practicing lawyers in law firms large and small from around that nation:

2. Annotated civil codes Llambías, Jorge Joaquín, 1911-. Código civil anotado : doctrina-jurisprudencia / Jorge Joaquín Llambías, con la colaboración de Patricio J. Raffo Benegas ... [et al.]. Buenos Aires : Abeledo Perrot, [1978-<2002 >] <v. 1, 1-A, 1-B, 2-A, 2-B, 3-A, 3-B, 4-A, 5-A, 5-B, 5-C; in 11 > ; 23 cm. It is an undisputed classic and an indispensable item on any practitioner's shelf. Practitioners in Argentina reported that they consult this well-organized

1 Asking practitioners to judge the authoritativeness of scholarly books seems natural, almost self-evident to civil law scholars. This procedure, however, may seem less palatable to scholars accustomed to common law methodologies. In civil law jurisdictions, scholarship is an alternative source of legal authority; practitioners therefore are trained to recognize what scholarship might be highly persuasive on points of law. The writings of the best and most learned minds on any legal subject have an authority of their own. Such writings are “doctrine” in the original sense. ‘Doctrine’ derives from the Latin word ‘docere’, ‘to teach’. In civil law jurisdictions, teachers from the halls of academe are seen as interpreting laws on a par with judges. The best, the most learned legal writings are valuable research tools for practitioners and scholars alike.

2 People generally do not respond to questionnaires truthfully. We provided the survey to the group twice. The first questionnaire was left open ended and only targeted a 10% sample of the group. On the basis of the information provided by the sample group, we compiled a tentative list of books. Subsequently, we resent this list of books to the entire group. By circulating an already existing list of books to the entire group, we may have skewed the results of the survey to those books that appeared on the list. We made a trade-off. The decrease in the amount of time a respondent would have to spend answering the questionnaire, we hoped would increase the number of responses. Even following this procedure, only 5% of lawyers responded to our questionnaire.

and very complete annotated code constantly. It covers the whole civil code in totality, with commentary on all its articles. Conclusion Although the results of the present survey fall far short of offering a comprehensive and complete annotated bibliography of the legal literature of Argentina by any stretch of the imagination, we hope these results may provide at least a tentative reading list for cross-border colleagues to pick up. Latin American and Caribbean legal scholars need to take stock of the rich legal culture they are part of. Despite the overall homogeneity of the legal culture, and despite the increase in cross-border legal interaction as trade crosses borders more readily, legal scholars there remain fragmented into walled-off national academic communities. They may not have heard of, let alone read, the writings of their peers across borders. Making this bibliographical information available for every Latin American and Caribbean nation may be a first step in creating a wider scholarly legal community in the region.4

4 Scholars advance knowledge best in a broad and vibrant community of scholarship and research that reaches across borders, which exists in Europe and Anglo America, but is only now evolving or developing in the Latin America-Caribbean area.
