Whereas, use of High Security Registration Plates (HSRP) has beenmade mandatory as per Rules 50 and 51 of Central Motor Vehicle Rules,1989 and Motor Vehicle (New High Security Registration Plates) Order,2001 of Government of India ;

Whereas, the Hon’ble Supreme Court of India in its decision passedin the case titled Association of Registration Plates V/s. Union of Indiadecided on 31-11-2004 has upheld the constitutional validity of Rule 50 andclause 4 (x) of the Order, 2001 ;

Whereas, the Hon’ble Supreme Court of India in Writ Petition CivilNo. 510 of 2005 titled Maninderjit Singh Bitta V/s. Union of India andothers read with Hon’ble Court order dated 5th May, 2009 has taken aserious view of delay in the issue of replacement of Non-HSRP with HSRPlates in various States ;

Whereas, in compliance to the provisions and orders of the Hon’bleSupreme Court the system for affixing of HSRP in the State of J&Kstands established for all districts ;

Whereas, it has been observed that despite all efforts many vehicleowners are not coming forward for replacing the Non-HSRP with HSRPlates ;

Whereas, on final opportunity was provided to the owners ofvehicles in J&K State to affix HSRP on all Moter Vehicles vide this officeNotice No. TC/JK/MVD/2015/398-II/933-69 dated 10-09-2015published in various newspapers of the State on 12-10-2015 and repeatedon 27-10-2015 ;

Whereas, on the recommendations of the Public Service Commissionmade vide their communication No. PSC/DR/Horti/97/2 dated 19-03-2001,

97 Horticulture Development Officers (HDOs), under the directrecruitment quota, came to be appointed vide GovernmentOrder No. 110-Agri. of 2001 dated 16-04-2001, 136-Agri. of 2001dated 24-05-2001 and 144-Agri of 2001 dated 11-06-2001 ; and

Whereas, due to non-joining of some of the candidates and also onthe directions of the Hon’ble High Court, the recommendations of thePublic Service Commssion were further acted upon and more candidatesappointed as Horticulture Development Officers vide GovernmentOrder No. 99-Agri of 2008 dated 09-04-2008 and Government OrderNo. 296-Agri. of 2008 dated 16-10-2008 ; and

Whereas, instead of issuing the appointment orders on the basis ofthe merit obtained by the candidates in the PSC, these orders were issuedon the basis of the reservation roster, thereby placing less meritoriouscategory candidates selected against reservation quota over and above themeritorious candidates selected against Open Merit ; and

Whereas, after the appointments made in 2001, an initial constitutionof the members of the service, pursuant to the notification of RecruitmentRules of 2001, was notified vide Government Order No. 329-Agri. of 2002dated 13-12-2002 in which among others, the names of HDOs appointedby direct recruitment in 2001 (from S. No. 135 to 239) vide the abovementioned Government Orders were notified in the same order in whichthey figured in the appointment orders, so issued in 2001 ; and

Whereas, vide Government Order No. 257-Agri. of 2003dated 17-09-2003, the final seniority list of the members of the serviceincluding the HDOs appointed in 2001 was also notified, by placing thecategory candidates (HDOs) against the roster points and not in order ofthe merit list/select list provided by the PSC. This seniority list was updatedin 2010 vide Government Order No. 04-Agri. of 2010 dated 08-01-2010 inthe same manner as a consequence whereof the category candidates selectedon the basis of the reservation and with an inferior merit continued to beindicated higher up in the seniority list vis-a-vis the candidates (HDOs)selected in the open category with the superior merit. This seniority list,

however, did not include those appointed after 2001 in 2008 vide GovernmentOrder No. 99-Agri. of 2008 dated 09-04-2008 and Government OrderNo. 296-Agri. of 2008 dated 16-10-2008 ; and

Whereas, during examination of the matter, it has been observed thatthe seniority of the HDOs appointed on the basis of the recommendationsof the PSC in 2001 has been fixed in utter violation of the law and Rule 24of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956which provides for the fixation of the inter-se-seniority of the direct recruitson the basis of the merit obtained in the selection process. Roster maintainedin the department is only for giving effect to the reservation rule which isnot the rule of the seniority as also clarified in Rule 31 of SRO-294 of theJ&K Reservation Rules of 2005 ; and

Whereas, the matter was also taken up with the Law Departmentwho vide their U. O. dated 23-12-2015 who advised as under :––

“Returned. After conclusion of the selection process, the selectionauthority has to draw up the list of selected candidates in order ofmerit. Rule 7 of the Jammu and Kashmir Reservation Rules, 2005illustrates the manner in which a select list is to be prepared. Theappointing authority has to issue the appointment orders of selectedcandidates in order of merit as determined by the selection authority.The roster points indicated in rule 5 of the Reservation Rules arerelevant only for determination of number of vacancies reservedfor different reserved categories. These roster points are notrelevant for determining the seriatum of candidates in which theirnames shall appear in the appointment order nor is it relevant fordetermining the seniority of appointees. In this arrangement, thecategory candidates would appear in the select list/appointmentorders only after the last open merit category candidate. Allreserved category candidates who obtain higher merit than thelast selected open merit candidate would fall in the open meritcategory as per the merit they have obtained. In view of the ruleposition, the action of the department by issuing appointment orderson the basis of reservation roster is in violation of rules and the

law on the subject. There are catena of Apex Court judgmentslaying down law on the subject. The seniority list has to be preparedin accordance with the rule 24 of the Jammu and Kashmir CivilServices (Classification, Control and Appeal) Rules, 1956 whichprovides that the inter-se-seniority of two or more persons appointedto the same service, class, category or grade simultaneously will,in case of those recruited direct, except those who do not jointheir duties when vacancies are offered to them be, determinedaccording to positions attained by them in order of merit at thetime of selection.

The saying that “it is never too late to accept a mistake and rectifyit” applies in this case as well. The department is always at libertyto rectify its mistake and issue afresh seniority list in accordancewith rules governing the field. Wrongful order does not give anyright to the beneficiary to claim perpetual benefits from a wrongfulaction. However, before doing the same, the department shall haveto issue a revised tentative senionty list and call for objectionsfrom persons who are likely to be affected by such reframing ofseniority and pass necessary orders after hearing the objections ifany filed by the likely affected persons.”

Whereas, the matter was also referred to the General AdministrationDepartment vide U. O. dated 15-01-2016 for conveying approval to there-drawal of the seniority in accordance with the rules who vide their U. O.No. GAD (Ser) Genl/09/2016 dated 16-02-2016 conveyed as under :––

“Returned. The General Administration Department conveysapproval of the Hon’ble Governor to the proposal of the AgricultureProduction Department for re-fixing the seniority of theHorticulture Development Officers, on the basis of the meritobtained in the selection process of J&K Public ServiceCommission. The department is advised to proceed accordingly.”

Whereas, in order to correct the mistakes, it has accordingly, beendecided to issue a fresh tentative seniority list of the HDOs appointed in


pursuance of the recommendations of the PSC dated 19-03-2001 strictly inaccordance with the Rule 24 of the Jammu and Kashmir Civil Services(Classification, Control and Appeal) Rules, 1956 and also to notify the

merit obtained by such candidates in the PSC for better appreciation.

Besides, those appointed subsequently in 2008 pursuant to the Hon’ble

High Court Orders etc. vide Government Order No. 99-Agri. of 2008

dated 09-04-2008 and Government Order No. 296-Agri. of 2008

dated 16-10-2008 have also to be included in the seniority list on the basis

of their date of appointment and the merit obtained in the PSC.

Now, therefore, it is hereby ordered that––

(i) the seniority of the direct recruits, appointed on the

recommendations of the J&K Public Service Commission

communication No. PSC/DR/ Horti/97/2 dated 19-03-2001 vide

Government Order No. 110-Agri. of 2001 dated 16-04-2001,

136-Agri. of 2001 dated 24-05-2001 and 144-Agri. of 2001

dated 11-06-2001, respectively and notified vide Government

Order No. 257-Agri. of 2003 dated 17-09-2003 from

S. No. 128 to 210 and subsequently updated vide Government

Order No. 04-Agri. of 2010 dated 08-01-2010 figuring from

S. No. 128 to 211 is hereby recast and is notified as

Annexure-“A” to this Government Order, in accordance with

order of the merit obtained by them in the PSC, as also indicated

against each and in accordance with Rule 24 of the Jammu

and Kashmir Civil Services (Classification, Control and Appeal)

Rules, 1956 ; and

(ii) the tentative seniority of those appointed vide Government

Order No. 99-Agri. of 2008 dated 09-04-2008 and Government

Order No. 296-Agri. of 2008 dated 16-10-2008 is hereby also

notified in accordance with Rule 24 of the Jammu and Kashmir

Civil Services (Classification, Control and Appeal) Rules, 1956

and the merit obtained by them in the PSC/date of substantive

appointment.

The officers aggrieved, if any, with the tentative position assigned tothem in the seniority may, if they choose to do so, make a representationalong with the facts and material in support of their claim to the Governmentwithin a period of 15 days from the date of issuance of this revised senioritylist for consideration and in case of non-receipt of any representation, afinal seniority list of such members of the service shall be notified.

It is further ordered that––

(i) the seniority of Shri Brij Pal Singh appointed as HDO videGovernment Order No. 296-Agri. of 2008 dated 16-10-2008shall be notified separately ;

(ii) the seniority of Horticulture Development Officers(HDOs) appointed in 2010 vide Government OrderNo. 18-Agri. of 2010 dated 08-02-2010 on the recommendationsof the PSC vide their Letter No. PSC/DR/1/05-09/HDOdated 20-01-2010 shall also be notified separately.

The date of birth recorded in the Annexure against the names of theofficers shall not be treated for purposes of service records which shall bepurely as recorded in the service books in accordance with the rules.

This issues without prejudice to the outcome of the writ petitionspending, if any, before any competent court(s) of law.

The Jammu and Kashmir Special Recruitment Rules, 2015 have beennotified vide SRO-202 of 2015 dated 30th June, 2015. Rule 3 of the saidrules provides that these rules shall apply to all the Non-Gazetted postsborne on the establishment of any department or service of the Governmentand such Gazetted posts, as may be notified by the Government from time

to time. With a view to harmonize the service conditions of all the Governmentemployees with respect to SRO-202 of 2015 dated 30-06-2015, it is clarifiedthat,––

i. The provisions of the said SRO shall apply to all the posts forwhich selection is made by the J&K Services Selection Board,Departmental Recruitment Boards or District/Divisional/StateLevel Selection Committees relating to the selection inGovernment Departments ;

ii. In view of (i) above, posts borne on the establishment of anydepartment of the Government, the Police, Prisons, Fire andEmergency Services Department and the Ladakh AutonomousHill Development Councils of Leh and Kargil, shall have to followthe J&K Special Recruitment Rules, 2015 in letter and spirit.

iii. The Managing Directors ofthe State owned Corporations shallplace proposals, in sync with these rules, before their respectiveBoard of Directors for approval so that the appointments, if any,to be made in the PSUs, are in tune with the SRO-202 of 2015.There shall, as such, be no deviation from the Jammu andKashmir Special Recruitment Rules, 2015 issued under SRO-202 of 2015.

It is further clarified that the Non-Gazetted posts and notified Gazettedposts of the Higher Education and School Education Departments, advertisedafter 30th June, 2015, shall be governed by SRO-202 of 2015.

SRO-461.––Whereas, the Management of M/s Friends Gun Works,Ashok Nagar, Satwari, Jammu terminated the services of its workmannamely Rajinder Sah S/o Dhanil Sah R/o Preet Nagar, Jammu ; and

Whereas, the aforesaid workman raised a dispute against theManagement of M/s Friends Gun Works, Ashok Nagar, Satwari, Jammu


before the Conciliation Officer (Assistant Labour Commissioner),Jammu ; and

Whereas, all efforts were made by Conciliation Officer during theconciliation proceedings to settle the dispute but both the parties wereadamant on their stand and not willing to settle the dispute throughnegotiation ; and

Whereas, the Conciliation Officer (Assistant Labour Commissioner),Jammu submitted his failure report recommending the case for its referenceto the Labour Court for adjudication ; and

Whereas, the Government is of the opinion that an industrial disputeexists between the Management of M/s Friends Gun Works, Ashok Nagar,Satwari, Jammu and the aforesaid workman ;

Whereas, the Government considers it desirable to refer the saiddispute to the Labour Court for adjudication.

Now, therefore, in exercise of the powers conferred by clause (c)of sub-section (1) of section 10 of the Industrial Dispute Act, 1947(XIV of 1947), the Government hereby refers the said dispute to theLabour Court for adjudication on the following issues :—

1. Whether the Management of M/s Friends Gun Works, AshokNagar, Satwari, Jammu is legally justified in terminating theservices of its workman namely Rajinder Sah ?

2. If not, to what relief, he is entitled ?
