The pay raise is for full time employees, who are on salary, as well as, hourly employ- ees. The $1 an hour raise will cost the police jury $55,000 extra a year. Then after going over its nances, the police jury voted to give its part-time employees a $1 an hour raise also. They even voted to give their attorney, Paul Moresi III a $1 an hour raise. The building proposal is over 5,000 square feet and it would be used as a meeting place for farmers, and 4-H students. It would also have a large kitchen where 4-Hers can learn how to prepare meals, and it would also have a virtual room for students to take virtual classes. The jurors tossed around ideas and juror Mark Poché proposed rededicating a portion of the Health Unit Tax to help pay for the construction of the building. Poché said, if the parish voters approve, the jury could take $1.2 million from the Health Unit tax and use the money to construct the building. It would be a one time thing, Poché said. Members of the Vermilion Parish Police Jury voted to give all of its employees a $1 an hour pay raise in 2015.

The pay raise is for full time employees, who are on salary, as well as, hourly employ-ees. The $1 an hour raise will cost the police jury $55,000 extra a year. Then after going over its fi nances, the police jury voted to give its part-time employees a $1 an hour raise also.

They even voted to give their attorney, Paul Moresi III a $1 an hour raise.

The extra $1 an hour raise will cost the Po-lice Jury around $75,000 a year.

So, full-time and part-time employees will be making a $1 more an hour when 2015 be-

Christmas should be a joyous occasion, but due to the circum-stances, most of these families would have no Christmas gifts at all without the help of the kind supporters of this program and the kindness of the community.

South Louisiana was thrown into turmoil during the week be-fore Thanksgiving 1914, when the Louisiana Supreme Court ruled that the judge had made a mis-take and the kidnapper of Bobby Dunbar would have to go to trial a second time.

The incident and trial had be-come a topic of national notoriety after itinerant piano tuner William C. Walters had been arrested for the kidnapping of the child from a campground near Swayze Lake in northwest St. Landry Parish in August 1912.

The child was missing for eight months until, on April 19, 1913, a doctor in Columbia, Miss., sent the child’s father, Percy Dunbar, a picture of a young boy who looked like Bobby. The doctor said the boy was traveling in rural Mississippi with Walters.

St. Landry Sheriff Marion Swords telegraphed the sheriff in Columbia, asking him to pick up the child and to arrest Walters. And then things became very complicated. When the boy’s par-ents went to Mississippi to pick him up, he appeared at fi rst not to recognize his mother. Walters, said from the very beginning that the boy was his nephew and that his name was Bruce Anderson

Long after the arrest and trial of Walters, there would be contro-versy over whether the child was Bobby Dunbar or whether he was Bruce Anderson. Some people claimed that the Dunbars wanted their child back so much that they were willing to believe that this boy was their son, even after a woman from North Carolina came forward and said the boy was her son, not Bobby.

But despite those troubling questions about the boy’s iden-tifi cation, the townspeople of Opelousas were convinced that Bobby had been found and Wal-

ters had taken him. Practically every business in town was closed when the reunited family reached Opelousas. Church bells pealed. A brass band turned out at the railroad station.

It took a year of legal wran-gling to extradite Walters and to convict him in one of the most sensational trials ever held in Opelousas.

District Attorney R. Lee Garland handled a meticulous prosecution. E.B. Dubuisson was Walters’ court-appointed attorney. Garland wanted the death penalty for Walters. Dubuisson was able to convince the jury that Walters did not deserve death. But the man was found guilty—a verdict that Dubuisson appealed to the state’s high court on the grounds that the act under which Walters was convicted was unconstitu-tional.

He argued that Act 271 of 1910, the law under which Wal-ters was tried, had been pushed too quickly through the legislature in the wake of another sensational kidnapping. That act was sup-posed to have made kidnapping a crime punishable by death. Du-buisson argued that the legislature had in fact amended the wrong law and that Walters had never been legally indicted, let alone legally tried.

The court agreed, threw out Walters’ conviction, and said a new trial had to be held. That presented a big problem because the parish had nearly gone broke under the expense of the fi rst trial.

The St. Landry Clarion re-

ported the details on Nov. 21, 1914: “The trying of Walters for a second time means that the parish will have to undergo the expense of several thousand dollars in order to give the prisoner, as well as the state, all the chances pos-sible. . . . As the parish treasury is practically depleted it will go hard with St. Landry to hold a special term of criminal court.

“It is not known when the pris-oner will be given another chance at proving his innocence. How-ever, it is thought that it … will not be before the beginning of the new year.”

As Tai McThenia and Marga-ret Dunbar Cutright point out in their recent book, “A Case for Solomon,” St. Landry was “not only lacking money for a retrial but also the appetite.” Custody of the child had been awarded to the Dunbars, and for all practical purposes, justice had been done.

Given the circumstances, the DA chose not to hold a second trial. Walters was freed on the morning of Feb. 27, 1915, and, as it turned out, justice had been done. .

The boy grew to manhood believing himself to be Bobby Dunbar, or at least professing that belief. But long after that trial and after decades of debate, DNA tests were made on Bobby Dunbar, Jr. and another son of the man who lived and died as the kidnap victim. They did not match. They showed that the child that for so long was known as Bobby Dunbar was actually Bruce Anderson, just as Walters had claimed at the time of his arrest, throughout his trial, and to his death.

For many years, Bet-ter Business Bureau® Serving Acadiana has been receiving inquiries concerning unsolicited phone calls. After talking with many consumers, there seems to be much confusion around the Na-tional Do Not Call Regis-try. Does it work or not? When the phone rings at 8:58 p.m. from an un-known caller-most of us think it doesn’t; here’s the real scope.

The National Do Not Call Registry is man-aged by the Federal Trade Commission (FTC). The list gives you an opportu-nity to limit the telemar-keting calls you receive. According to the FTC once you register your phone number, telemar-keters covered by the Na-tional Do Not Call Reg-istry have up to 31 days from the date you register to stop calling you

This includes calls by telemarketers who solicit consumers, often on be-half of third party sellers. It also includes sellers who are paid to provide, offer to provide, or ar-range to provide goods or services to consumers.

The list isn’t a cure

all. Don’t expect all sales call to stop. Placing your number on the National Do Not Call Registry will stop most telemarketing calls, but not all.

Because of limitations in the jurisdiction of the FTC and FCC, calls from or on behalf of political organizations, charities, and telephone surveyors would still be permitted, as would calls from com-panies with which you have an existing business relationship, or those to whom you’ve provided express agreement in writing to receive their calls. However, if you ask a company with which you have an existing busi-ness relationship to place your number on its own do-not-call list, it must honor your request.

Schemers, scammers and crooks ignore the law. Hang up, and report them at www.donotcall.gov. The Better Business Bu-reau advises that consum-ers realize that everyone’s a potential target. Fraud isn’t limited to race, eth-nic back ground, gender, age, education, or income.

The Louisiana Depart-ment of Health and Hos-pitals (DHH) announced a plan to stop billing sexual assault victims for exams and tests. In order to stop billing victims, the plan streamlines the funding source through the Crime Victim’s Reparation Board (CVRB). Through legislation, these changes will prevent direct billing of charges to the victim by allowing hospitals to bill the Crime Victim’s Repa-ration Board directly.

Under current law, the board may not accept bills for additional medical ex-penses directly from the provider, which forces hospitals to treat victims of sexual assault like a normal emergency room patient and bill them for additional services.

Additionally, victims who decide not to fi le a police report are currently ineligible for reimburse-ment from the Crime Vic-tims’ Reparation Board. Victims of sexual assault may not have decided at the time services are ren-dered whether they will fi le a police report. In fact, some victims decide ulti-mately not to fi le a report at all.

First, the Louisiana Commission on Law En-forcement (LCLE) will promulgate rules imme-diately to address two is-sues:

Exclude from the deter-mination of medical com-

pensation or other awards for victims of sexual as-sault the circumstances under which the crime was committed, such as what the victim was wear-ing, marital status and the presence of illegal drugs or alcohol, among other things.

Establish that victims of sexual assault may choose not to seek reim-bursement from private insurance, Medicaid or other collateral sources in order to be eligible for reparations. In some cas-es, victims do not want documentation related to the sexual assault.

Second, the adminis-tration will work with the Legislature to change the law to address two issues:

Prohibit billing victims of sexual assault and au-thorizing hospitals to bill the Board directly.

Remove the require-ment that victims of sex-ual assault fi le a police report to be eligible for reimbursement.

“Over the last few weeks, so many leaders have come to the table ready to discuss how we support sexual assault survivors and how care is provided to them. Mike Bertaut’s message is fright-ening.

Last week, this well-respected health care economist served as the keynote speaker for LABI’s “Busi-ness Solutions Beyond Reform” panel to discuss the impact of Obamacare on Louisiana businesses. He was articulate, well informed and effectively explained a very complex subject in easy-to-understand terms. He, along with other panelists, ham-mered home the point that businesses need to be on red alert for the next phase of Obamacare implementation in 2015.

My takeaway from the discus-sion was clear: employers must do everything they can to prepare in 2015. Next year, the trap gets set so that in 2016 the IRS auditors can come knocking on the door of all these trapped employers looking to assess big fi nes and penalties across the country.

As a result, businesses across Louisiana are starting to ask them-selves some important questions to prepare for this audit trap.

How many full-time employees do I have? Am I a large employer or small employer in the eyes of the IRS? Do I qualify for transitional relief from the new mandates and regulations? How will the IRS defi ne “affordable” health care? What fi nes and penalties await me if I make a mistake complying with this new maze of regulations, mandates, laws and executive orders?

Private businesses are not the only employers starting to feel anxious about this federal tripwire being wrapped around their offi ce. Pub-lic employers are feeling the pinch as well, with local school districts across the state trying to downsize

their employee rolls to prepare for this new em-ployer mandate.

As an exam-ple, The Advocate this week cited Lincoln Parish as a school district that has trimmed weekly hours for 400 substitute

teachers, maintenance workers, food service and other employees to a level below the 30-hour-week man-date required in Obamacare. Other districts are taking a similar ap-proach to reduce their employee rolls in order to comply with Obamacare. In regards to the mandate to provide coverage to part-time employees working more than 30 hours a week, Ascension Parish Superintendent Patrice Pujol said, “Given the cost of benefi ts, that would be an unbeliev-able drain on school systems.”

Unbelievably, Obamacare is in-centivizing private and public sector employers to scale back employ-ment in order to comply with overly expensive and complicated mandates in the law. As we slowly try to pull ourselves out of the grips of the national recession, this is exactly the wrong type of federal mandate at the absolute worst possible time.

So, let’s go back to that sobering advice given by Mike Bertaut.

The fi rst message that stood out was that employers must determine how many full-time employees they have per the IRS. The 30-hour requirement is clearly part of the law, but the defi nition of “employee” is more expansive than some may cur-rently realize. Obamacare says that employers must count any employee

as defi ned by the “common law” rules. This means you must count any worker that you can “control what will be done and how it will be done.” In essence, contractors and other affi liated groups may be a part of your employee count by the IRS for Obamacare purposes, even if traditionally the business has not viewed those workers as employees. Count incorrectly and that 2016 IRS audit will be an expensive one.

Next, if you meet the 50 full-time equivalent threshold and you do not qualify for transitional relief from the law’s onerous requirements, you then have to assume compliance starting next year. This means you must start providing “affordable” health coverage to your employees or risk heavy fi nes for either (a) not covering enough employees or (b) not providing “affordable” coverage. There are a few different compli-cated and bureaucratic formulas to determine what is “affordable,” and you can bet your bottom dollar that provision will be the epicenter of a lawsuit bonanza for years to come.

Why would Washington penalize growth and investment at a time we need it so badly?

When I travel around the state and visit with our business members, they are generally excited about their prospects. They see hope on the horizon that the economy is improv-ing and believe they will fi nally start recovering from the last several years of hardship. They speak of how hard their employees work and how much they contribute to the company culture. They also speak of numerous other job openings available and how they want nothing more than to em-ploy even more young Louisianians.

That hope is in peril thanks to the instability Obamacare is bringing to employers in 2015 and the expen-sive IRS audits waiting for them in 2016. Complying with the maze of mandates and regulations will be diffi cult, especially for those trying to do the right thing and grow their business next year. The more you grow, the more likely you are to be caught in one of the many Obam-acare IRS traps.

A healthy economy leads to healthy wages that produce healthier outcomes for those that need it the most. Instead of embracing this con-cept, Washington has injected a virus in our economy that will weaken job growth and fl at-line economic expan-sion. If this doesn’t scare you, I don’t know what will.

Racial quotapunishment

Supreme Court Justice Oliver Wendell Hol-mes said there were “phrases that serve as an ex-cuse for not thinking.” One of these phrases that substitute for thought today is one that depicts the current problems of blacks in America as “a legacy of slavery.”

New York Times writer Nicholas Kristof asserts that there is “overwhelming evidence that centuries of racial subjugation still shape inequity in the 21st cen-tury” and he mentions “the lingering effects of slavery.” But before we become overwhelmed, that evidence should be checked out.

The evidence offered by Mr. Kristof in the Novem-

ber 16th issue of the New York Times seems considerably short of overwhelming, to put it charitably. He cites a study showing that “coun-ties in America that had a higher proportion of slaves in 1860 are still more unequal today.” Has he never heard statisticians’ repeated warnings that correlation is not causation?

The South long remained a region that blacks fl ed by the millions -- for very good reasons. But, in more recent years, the net migration of blacks has been from the North to the South. No doubt they have good reasons for that as well.

But there is no reason to believe that blacks today are unaware of the history of slavery or of the Jim Crow era in the South. Indeed, there are black “leaders” who seem to talk about noth-ing else. Yet blacks who are moving back to the South seem more concerned with the present and the future than with the past.

Kristof’s other “overwhelming” evidence of the current effects of past slavery is that blacks do not have as much income as whites. But Puerto Ricans do not have as much income as Japanese Americans. Mexican Americans do not have as much income as Cuban Americans. All sorts of people do not have as much income as all sorts of other people, not only in the United States, but in countries around the world. And most of these people were never enslaved.

If we wanted to be serious about evidence, we might compare where blacks stood a hundred years after the end of slavery with where they stood after 30 years of the liberal welfare state. In other words, we could compare hard evidence on “the legacy of slavery” with hard evidence on the legacy of liberals.

Despite the grand myth that black economic progress began or accelerated with the passage of the civil rights laws and “war on poverty” programs of the 1960s, the cold fact is that the poverty rate among blacks fell from 87 percent in 1940 to 47 percent by 1960. This was before any of those programs began.

Over the next 20 years, the poverty rate among blacks fell another 18 percentage points, compared to the 40-point drop in the previous 20 years. This was the continuation of a previous economic trend, at a slower rate of progress, not the economic grand deliverance proclaimed by liberals and self-serving black “leaders.”

Ending the Jim Crow laws was a landmark achievement. But, despite the great proliferation of black political and other “leaders” that resulted from the laws and policies of the 1960s, nothing comparable happened economically. And there were serious retrogressions socially.

Nearly a hundred years of the supposed “legacy of slavery” found most black children being raised in two-parent families in 1960. But thirty years after the liberal welfare state found the great majority of black children being raised by a single parent.

The murder rate among blacks in 1960 was one-half of what it became 20 years later, after a legacy of liberals’ law enforcement policies. Pub-lic housing projects in the fi rst half of the 20th century were clean, safe places, where people slept outside on hot summer nights, when they were too poor to afford air conditioning. That was before admissions standards for public hous-ing projects were lowered or abandoned, in the euphoria of liberal non-judgmental notions. And it was before the toxic message of victimhood was spread by liberals. We all know what hell holes public housing has become in our times. The same toxic message produced similar social results among lower-income people in England, despite an absence of a “legacy of slavery” there.

If we are to go by evidence of social retro-gression, liberals have wreaked more havoc on blacks than the supposed “legacy of slavery” they talk about. Liberals should heed the title of Jason Riley’s insightful new book, “Please Stop Helping Us.”

Mr. Jerry Harding addressed the Governing Authority about is-sues concerning a police incident in which he was involved.

Fire Chief Evans Bourque informed the Governing Authority that the Halloween festivities rolled along smoothly. Chief Bourque also informed the Governing Authority that he had spoken to the engineers and gave preliminary plans that could be used for the renovation to the fi re and police station should the Town of Guey-dan be awarded a grant.

Police Chief Kayla Henry was not in attendance for this meeting.

There being no further business to come before the meeting, thereupon motion by GALE SMITH, seconded by MARILYN CAMPBELL, and carried the meeting thereupon adjourned at 6:12 P.M. on this 4th day of November 2014.

Thanksgiving and Christmas are upon us and people are setting their holiday menus. For those who are “seasoned” cooks you may not have any fears of cooking a tur-key, but for someone who has never cooked a turkey you will have a million questions. A few tips can put your fears aside and help you make the perfect Thanksgiving dinner.

The best way to ensure that your turkey is fully cooked is to use a meat thermometer and it should reach 165ºF internal tem-perature for a fully cooked turkey. All parts of the turkey should be checked. Stuffi ng is safe when cooked to an internal tem-perature of 165°F. Once your turkey is cooked, take it out of the oven and let it stand 20 minutes be-

Frying Your Holiday Turkey

When frying a turkey it is imperative that the bird be completely thawed, or the moisture in the bird will ‘boil’ when it touches the oil – possibly causing injury or fi re. To thaw a turkey in the refrigerator safely, leave it in the origi-nal wrapping and place it on a tray in the refrigera-tor. Allow 5 hours thawing time per pound.

If you choose to inject the turkey with a mari-nade before frying, you

will need an injection kit, which is available at most grocery stores. Marinades also are available at the grocery, and the kit in-cludes instructions on in-jecting the meat properly. Be sure to keep the turkey refrigerated while it is marinating.

The amount of oil needed to fry a whole tur-key will vary, depending on the size of the bird and the size of the pot used to fry it.

Most pots require 3-5 gallons of oil.

Many Louisiana resi-dents use a crawfi sh pot with a butane burner and a clean jambalaya stirrer to fry turkey.

Choose oils with high smoke points such as pea-nut, canola, saffl ower or sunfl ower. Peanut oil is the most popular due to its

abundant fl avor.Heat the oil to a tem-

perature of 350 degrees – the point where it almost is smoking. To reduce spattering, thoroughly dry the interior and exterior of the bird. Ease the bird into the heated oil and cook it for 3-4 minutes per pound.

To make sure a whole turkey has reached a safe minimum internal tem-perature of 165 degrees, insert the thermometer in the thickest part of the in-ner thigh without touching the bone.

Leftover fried turkey should be removed from bones and stored in small, shallow containers in the refrigerator.

While frying may pro-duce a great-tasting bird, safety experts at Under-writer’s Laboratory warn cooks to use caution. If

you use a turkey fryer, here are some of their tips for safer use:

Turkey fryers should always be used outdoors a safe distance from build-ings and any other mate-rial that can burn.

Never use turkey fry-ers on wooden decks or in garages.

Make sure the fryers are used on a fl at surface to reduce accidental tip-ping.

Never leave the fryer unattended. Most units do not have thermostat con-trols. If you don’t watch the fryer carefully, the oil will continue to heat until it catches fi re.

Never let children or pets near the fryer when it’s in use. Even after use, never allow children or pets near the turkey fryer. The oil inside the cooking

pot can remain dangerous-ly hot hours after use.

To avoid oil spillover, do not overfi ll the fryer.

Use well-insulated potholders or oven mitts when touching pot or lid handles. If possible, wear safety goggles to protect your eyes from oil splatter.

Be sure to completely thaw the turkey to prevent splattering.

Keep an all-purpose fi re extinguisher nearby.

However you cook your bird, don’t forget food safety. Be sure to wash hands, utensils and cutting boards thoroughly before and after handling raw meats. Also, never leave turkey – raw or cooked – at room tempera-ture for more than 2 hours.
