1. DISCLAIMER

1. The information contained in this Request for Proposal (RFP) document or subsequently provided to applicants, whether verbally or in written form by or on behalf of Excise, Taxation & Narcotics Control Department or any of their employees or advisors, shall be subject to the terms and conditions set out in this RFP document and any other terms and conditions subject to which such information is provided.

2. Excise, Taxation & Narcotics Control Department may, in their absolute discretion, but without being under any obligation to do so, update, amend, add to any or all of the provisions or supplement the information of this RFP document or cancel the present invitation and call for fresh invitations. Such changes would be intimated to all applicants using this RFP Document.

3. The procuring agency may reject all bids or proposals at any time prior to the acceptance of a bid or proposal as provided in Rule 35 PP Rules 2014

4. Neither Excise, Taxation & Narcotics Control Department nor their employees or representative will have any liability in case of non-receipt of any correspondence from them to the applicant due to the postal delays.

5. Mere submission of proposals or issue of RFP does not vest any right in the applicant for being selected for the assignment. 6. Single Stage Two envelop bidding procedure shall be adopted. 2. ADVERTISMENT

TENDER NOTICE

ADDITIONAL DIRECTOR GENERAL, EXCISE,TAXATION & NARCOTICS CONTROL

DEPARTMENT, PUNJAB

1-Competent Authority(Procurement),Excise, Taxation & Narcotics Control Punjab intends to hire services for testing/ screening of candidates/applicants/Shortlisting for various posts/ cadres throughout Punjab (detail provided in tender document). Competent Authority (Procurement) Excise, Taxation & Narcotics Control Department, Government of the Punjab invites bids / proposals for the procurement of said services from already prequalified testing firms by Directorate General Monitoring & Evaluation , Planning & Development Department, Government of the Punjab for the year 2016-17 vide P&DD letter No.DGM&E/DC/1420 dated 01 December 2016. The Procurement shall be made in accordance with the Punjab Procurement Rules 2014.The bidding procedure will be according to Rule 38(2)(a) i-e Single Stage two envelope. 2- Detailed Scope of work is provided in the bidding document however brief scope of work will be

Services for testing/ screening of candidates/applicants for various posts/ cadres throughout Punjab. Detailed Scope of work along with evaluation criteria has been compiled in the tender document.

3-Single Stage Two envelop bidding procedure shall be adopted .The bid shall be a single package consisting

of two separate envelopes, containing separately the financial and technical proposals. The envelopes shall be

marked as “Financial Proposal” and “Technical Proposal”. The successful bidder will receive the fee for

test / screening directly from the applicants. The procuring agency may reject all bids or proposals at any time

prior to the acceptance of a bid or Proposal.(Rule35(1))PPRA 2014. Bidders are required to submit the bid

The bids must reach the office of Additional Director General/Competent Authority(Procurement), Excise,

Taxation & Narcotics Control Punjab, 847-A,Shadman-I, Lahore Pakistan in sealed envelope on 30 January

2017 by 1200 Hours and will be opened at 1500 Hours on the same day.

4- Interested Parties are required to submit bid amount of Rs.1000/-(Non Refundable), in shape of Bank

Draft, in favor of the Director General, Excise, Taxation & Narcotics Control Punjab at the time of

procuring the tender document. However the tender document can be downloaded from the official website

of PPRA(www.ppra.punjab.gov.pk) as well as the official website of the department (www.excise-

punjab.gov.pk) in this case tender document fee will have to be submitted with the Bids / Proposals. Last

4. SUBJECT: LETTER OF INVITATION

1. Competent Authority (Procurement), Excise, Taxation & Narcotics Control Punjab invites proposals to provide the services for HR Recruitment Firm. Details on the services are provided in the Terms of Reference.

2. The Firm will be selected under procedures described in this RFP in accordance with the

Punjab Procurements Rules 2014 through Least Cost Selection Method.

3. The RFP includes the following additional documents:

4. It is mandatory for proposals to be made using the Standard Forms of the RFP.

Proposals that are not in the prescribed format may be discarded. If any information required in the forms is found missing, or written elsewhere, no credit will be given in the relevant section of the evaluation.

5. Firms should submit:

a. Copy of Registration with Securities & Exchange Commission or Registrar of Firms if applicable.

b. Copy of Registration with Income Tax Department c. Details of 3 of their most relevant assignments. d. List of permanent professional staff indicating firm capability to carry out this assignment e. A certificate / affidavit that the firm is not blacklisted by any Govt./Autonomous

Body at the date of submission of bid.

5. TERM OF REFERENCES

Project: HR Recruitment

Firm

Assignment: To provide recruitment services on the behalf of Excise, Taxation &

Narcotics Control Department for the posts detailed at Annex-A.

BACKGROUND

Competent Authority(Procurement),Excise, Taxation & Narcotics Control Punjab intend

to hire services of company and to outsource recruitment activity on the behalf of

Excise, Taxation & Narcotics Control Department up to the level of CV/Application

collection, initial shortlisting as per criteria and merit generation of all eligible

candidates, through a ‘Recruitment Test’ in order to ensure more transparency in

the system and provide all data with reporting at all stages of the process until

joining of incumbent at Excise, Taxation & Narcotics Control Department .

SCOPE OF WORK

Recruitment Company would be providing following services to the department,

through their expertise with approval of the department, which includes but not

limited to:

2) Gathering of CVs / Job Applications: Collections of CVs/Applications (Hard &

Soft) as per advertisement published by the Excise, Taxation & Narcotics

Control Punjab within due course of time and must have advance system

that save CVs and other application documents in the database.

3) Executive Search / Head Hunting / Shortlisting & Position Statistics: Initial

Shortlisting as per criteria mentioned in job advertisement of Excise, Taxation & Narcotics Control Punjab thus identifying total, eligible and non-eligible candidates against positions.

4) CV Scoring for Test exempted positions: CV analysis / scoring for generating

the merit list of all eligible candidates with respect to their qualifications, overall experience, sector relevant experience, competences / suitability / best fit for the Company for the positions which are test exempted.

5) Recruitment Test: Conducting ‘Recruitment Test’ for all eligible candidates. The test should include relevant technical / professional questions, analytical, factual, theoretical questions with respect to the position as mentioned in the Ad. The service provider shall invigilate the Recruitment Test and ensure proper security measures of examination hall as well as necessary facilities. This will be done in consultation with the department in all Punjab district offices .

6) Communications: Must have ability of fast mode of communication calls

by providing services like couriers, email, mobile and text messages, issuance of roll number slips and necessary intimations to the candidates called for test.

7) Compilation of Result from Test: Results must be compiled in a very

secure/ confidential manner under the supervision of Examination/ Assessment center head/ in charge and to be shared with Excise, Taxation & Narcotics Control Department.

8) Provide data: Provide data of top candidates with merit sheets and test

results for the interview with Excise, Taxation & Narcotics Control Punjab.

9) Career Portal Development: Should have ability to develop design, integrate and hosting of customize career portal according to Excise, Taxation & Narcotics Control Punjab need and requirement 24/7 and service rules.

10) Estimated number of applicants will be 100,000/- however this estimate may vary from the actual applications.

DELIVERABLES:

1) The Firm will provide online Job Posting and testing including client career portal. 2) Sharing of candidates data/profiles/CVs with the client at least 01 Year which includes Profiling/Shortlisting/Screening Reporting. 3) Creation of customize career portal, integration, designing and hosting 24/7

uninterrupted. 4) Physical Recruitment test if arranged and required, the cost will be charged to candidates 5) The services provider shall submit report comprising particulars of all candidates including their personal, educational, experience and contact details along with expected salary and recommendation. 6) List of ‘Shortlisted candidates’ as ‘Eligible’ and ‘Non Eligible’ according to criteria mentioned in the Advertisement and reasons there to.

8) Test Results/ Final Merit Sheet’ and recommending ‘top 5-10 (or as per department requirement) candidates’ for each position to be interviewed by Excise, Taxation & Narcotics Control Punjab 09) Any other report within the scope of work for information of Excise,

Taxation & Narcotics Control Punjab.

development department , government of the Punjab vide letter No.DGM&E/DC/1420 dated 01

December 2016.Details are at Annex-Z.

TIMELINES:

The entire recruitment process as per scope of work i.e., right from last

date of receiving of applications till submission of final results to Excise, Taxation &

Narcotics Control Department should not take more than 60 days.

REPORTING REQUIREMENTS:

The service provider shall be submitting, a soft copy and 3 hard copies of all

reports to the Additional Director General , (competent authority for procurement)

Excise Taxation & Narcotics Control Punjab 847-A,Shadman-I,Lahore as per

‘Deliverables’ mentioned above.

GENERAL CONDITIONS

1. All work by the recruitment company / service provider should be carried

out collaboratively with the Additional Director General, Excise Taxation &

procurement).

2. An agreement/ Contract shall be drawn between Excise Taxation & Narcotics

Control Department Punjab and the Service Provider, before the

commencement of the service.

3. All the data, documents and reports produced by the recruitment

company / service provider for the said services shall be the property of the

Excise Taxation & Narcotics Control Punjab .The service provider shall not share

and use any data, document and reports for any other purpose / job without the

explicit written approval of the department.

6. Instruction to Firms

A. Definition

(a) “Assignment” means the services for HR Recruitment Firm.

(b) “Client” means the Excise Taxation & Narcotics Control Punjab, with which the Selected Service Provider signs the Contract. (c) “Day” means calendar day. (d) “Firms” means any firms/consortiums/joint wish to submit proposal in response

to this RFP.

(e) “Government” means the Government of the Punjab and all its associated departments, agencies, autonomous/semi-autonomous bodies, local governments, boards, universities and similar other organizations.

(f) “Instructions t o Firms” means the document, which provides Firms with Information needed to prepare their Proposals.

(g) “LOI” means the Letter of Invitation included in the RFP.

(h) “Personnel” means professionals and support staff provided by the Firms to perform the Services or any part thereof.

(i) “Proposal” means the Technical Proposal and the Financial Proposal.

(j) “Services” means the Assignment to be performed by the firm pursuant to the Purchase Order.

(k) “Rules” means the Punjab Procurement Rules 2014

(l) “Terms of Reference” (TOR) means the document included in this RFP which explains the objectives, scope of work, activities, tasks to be performed, respective responsibilities of the Client and the Firm, and expected results and deliverables of the assignment.

Instructions to Bidders (Bidding Details)

All bids must be accompanied by 2 % Bid Security (Earnest Money) which is Rs.10,00,000/- i-e as

part of Financial bid and as per provisions of the clause “Bid Security” of this document in favor of

“Director General, Excise, Taxation & Narcotics Control Department, Government of the Punjab”.

The complete bids as per required under this tender document must be delivered into the Tender

Box, placed in the office of Additional Director General, Excise, Taxation & narcotics Control

Department, Government of the Punjab”, not later than 1200 hours on last date of submission of

bids i.e. January 30, 2017, late bids shall not be considered. The Technical bids shall be publicly

opened, at 1500 hours on January 30, 2017. In case the last date of bid submission falls in /

within the official holidays of the Purchaser, the last date for submission of the bids shall be the

next working day.

Single Stage Two envelop bidding procedure shall be adopted. The bid shall be a single package

consisting of two separate envelopes, containing separately the financial and technical proposals.

The envelopes shall be marked as “Financial Proposal” and “Technical Proposal”. 6.1. Submission of Applications

6.1.1. The applications shall be prepared in the English language. Information in any other language shall be accompanied by its translation in English. No supporting document or printed literature shall be submitted with the Proposal unless specifically asked for and in case any of these Documents is in another language, it must be accompanied by an accurate translation of the relevant passages in English, in which case, for all purposes of interpretation of the Proposal, the translation in English shall prevail.

6.1.2. Prospective applicants at least ten (10) days prior to last date of submission of proposal may request in writing for clarification of the tender document. At any time prior to the dead line for submission of applications, the Employer may amend the tender Documents on its own initiative or as consequence of any clarification of the applicant’s query and shall be communicated in writing to all perspective applicants who have obtained the tender Document from the Client.

6.1.3. Applicants must submit the following information:

i. Applicant’s company name, legal status whether incorporated as legal entity or a registered firm, year of establishment (provide copy of incorporation or registration), location of office, contact information, list of board of directors/partners.

ii. Whether Applicant is a member of corporate group/ organization (provide information of core business areas/main business/100% subsidiary/partly owned subsidiary);

iii. Structure of the company and corporate organization chart;

iv. Certificate of membership of concerned recognized trade association, or business chamber as the case may be;

v. In case of foreign Applicants having an operating office in Pakistan, provide proof thereof;

vi. Firm’s tax number information(Income Tax Number & GST) as applicable;

vii. Details of total equity capital of the Firm;

viii. Evidence of previous experience of conducting tests;

ix. An Affidavit to the effect that the principal or his local agent has not been black-listed which subsists as on the date of submission of proposal by any Government department/autonomous body in Pakistan;

6.1.4. Every page of tender document must be initialed by the authorized person bearing company official seal/stamp. Each page should be numbered.

6.1.5. Directorate General Excise, Taxation & Narcotics Control Department Punjab, Pakistan will not reimburse any cost or expenses i n c u r r e d in connection with the preparation or delivery o f the application for visits to any office or site.

6.1.6 Bid Security amounting to Rs.10,00,000/- must be furnished in the shape of pay order/ bank draft / bank guarantee in favor of the Director General, Excise, Taxation & Narcotics Control Punjab Punjab.

The bidder shall submit bids which comply with the Bidding Document. Alternative bids shall not be considered. The attention of bidders is drawn to the provisions of this tender document Clause regarding “Determination of Responsiveness of Bid” and “Rejection / Acceptance of the Tender” for making their bids substantially responsive to the requirements of the Bidding Document.

It will be the responsibility of the Bidder that all factors have been investigated and considered while submitting the Bid and no claim whatsoever including those of financial adjustments to the contract awarded under this Bid Process will be entertained by the Purchaser. Neither any time schedule, nor financial adjustments arising thereof shall be permitted on account of failure by the Bidder.

The Bidder shall be deemed to have satisfied itself fully before Bid as to the correctness and

sufficiency of its Bids for the contract and price/cost quoted in the Bid to cover all obligations

under this Bid Process.

It must be clearly understood that the Terms and Conditions and Specifications are intended to be strictly enforced. No escalation of cost except arising from increase in quantity by the Bidder on the demand and approval of the Purchaser will be permitted throughout the period of completion of the contract.

The Bidder should be fully and completely responsible for all the deliveries and deliverables to the Purchaser.

Only prequalified firms as mentioned above are eligible to participate in this tender.

C. Number of Proposals

Each Firm shall submit only one (1) Proposal in response to this RFP. Any Firm, which submits or

participates in more than one Proposal, will be disqualified. If any such firm applies through a JV or

consortium, the consortium/JV will be disqualified.

D. Preparation Cost

The Firm shall be responsible for all of the costs associated with the preparation of its Proposals

and its participation in the Evaluation process. Excise Taxation & Narcotics Control Department

Punjab will not be responsible or in any way liable for such costs, regardless of the conduct or

outcome of the evaluation process.

E. 1.

Due Diligence

It is desirable that each Firm submits Proposals after due diligence. It would be deemed that by submitting the Proposals, Firm has made a complete and careful

examination of the RFP; and 2. The Excise Taxation & Narcotics Control Department Punjab shall not be liable for any

mistake or error on the part of the Firm in respect of the above.

F.

Right to Accept or Reject any or all Proposals

1. Notwithstanding anything contained in this RFP, The procuring agency may reject all bids or proposals at any time prior to the acceptance of a bid or proposal as provided in Rule 35 PP Rules 2014.

2. The Excise Taxation & Narcotics Control Department Punjab reserves the right to reject any Proposal if:

a. At any time, a material misrepresentation is made or uncovered, or

b. The Firm does not respond promptly and thoroughly to requests for supplemental

information required for the evaluation of the proposals.

Such misrepresentation / improper response would lead to the disqualification of

the Firm.

G. Clarifications

Interested Firms may address their queries relating to the RFP to the Office of the Additional Director General, Excise Taxation & Narcotics Control Department Punjab as given in Schedule for Proposals The Excise Taxation & Narcotics Control Department Punjab would endeavor to respond to the queries. The responses will be sent by fax/ email.

H. Amendment of RFP

1. At any time prior to the deadline for submission of Proposals, Excise Taxation & Narcotics Control Department Punjab may, for any reason, whether at its own initiative or in response to clarifications requested by any Firm, modify the RFP Document by the issuance of an Addendum.

2. Any Addendum thus issued will be sent in writing to all those who have sent queries to the RFP Document.

I. Language

The RFP and all related correspondence and documents should be written in the English

language.

J. Currency

The currency for the purpose of the Proposal shall be the Pak Rupee (PKR).

K. Validity of Proposals

Proposals shall remain valid for a period not less than 90 days from the Proposals

submission Due Date. Excise, Taxation & Narcotics Control Punjab reserves the right to

reject any Proposals, which does not meet this requirement

L. Format and Signing of Proposals

1. The original Proposal; shall contain no interlineations or overwriting, except as necessary to correct errors made by the Firms themselves. The person who signed the Proposal must initial such corrections.

2. An authorized representative of the Firm shall initial all pages of the original

Proposal. The authorization shall be in the form of a written power of attorney accompanying the Proposal or in any other form demonstrating that the representative has been duly authorized to sign. The signed Proposal shall be marked “Original

4. If the envelope is not sealed and marked as instructed above, Excise Taxation & Narcotics Control Punjab assumes no responsibility for the misplacement or premature opening of the contents of the Proposals submitted.

N. Proposals Submission Date

Proposals should be submitted on 30 January 2017 at 12:00 Hrs PST mentioned in the

Schedule for Proposal Process, at the address provided above in the manner and form

as detailed in this RFP. Proposals submitted by either facsimile transmission, telex or e-

mail would not be considered for evaluation. However Excise Taxation & Narcotics

Control Punjab reserves the right to extend the Proposals submission Due Date and

Time, at any time prior to opening of Proposals in response to this RFP.

O. Late Proposals

Proposals received after the Due Date shall not be considered,

P. Modifications/ Substitution/ Withdrawal of Proposals

Firm may modify, substitute or withdraw its Proposals after submission, provided that

written notice of the modification; substitution or withdrawal is received by Excise

Taxation & Narcotics Control Department Punjab before the Proposals submission Due

Date and time. No Proposal shall be modified or substituted by the Firm after the last

date of submission.

Q. Evaluation of Application - Due Date

The Excise Taxation & Narcotics Control Department Punjab would open the Proposals on the opening Date mentioned in the Schedule of Proposal Process

R. Evaluation Criteria

The Excise Taxation & Narcotics Control Department Punjab would subsequently

examine and evaluate Proposals in accordance with the criteria set out in this RFP.

S. Evaluation of Proposals - Supporting Documents

The Excise Taxation & Narcotics Control Department Punjab reserves the right to call for

supporting documentation to verify the data provided by Firm at any time during the

evaluation process. The Firm in such cases would need to provide the requested

clarification / documents promptly and within the stipulated time failing which the Firm

is liable to be disqualified at any stage of the evaluation.

T. Evaluation of Proposals - Right to Reject

The Excise Taxation & Narcotics Control Department Punjab reserves the right to reject any Proposal if:

1. At any time, a material misrepresentation is made or uncovered; or 2. The Firm does not respond promptly and thoroughly to requests for supplemental

information required for the evaluation of the Proposal.

U. Confidentiality

Information relating to the examination, clarification, evaluation, and recommendation

for the Firm’s shall not be disclosed to any person not officially concerned. The Excise

Taxation & Narcotics Control Department Punjab will treat all information submitted as

part of Proposal in confidence and would require all those who have access to such

material to treat the same in confidence. The Excise Taxation & Narcotics Control

Department Punjab will not divulge any such information unless it is ordered to do so by

any authority that has the power under law to require its disclosure.

V. Tests of responsiveness

Prior to evaluation of Proposals, Excise Taxation & Narcotics Control Department Punjab

will determine whether each Proposal is responsive to the requirements of the RFP. The

Excise, Taxation & Narcotics Control Department Punjab reserves the right to reject any

Proposal which is non-responsive and no request for alteration, modification,

substitution or withdrawal shall be entertained by Excise Taxation & Narcotics Control

Department Punjab in respect of such Proposal.

W. Qualification and Notification

After the evaluation of Proposal, Excise Taxation & Narcotics Control Department Punjab

would announce a selected Firm who meet the Qualification Criteria. At the same time,

Excise Taxation & Narcotics Control Department Punjab would notify the other Firms

that their Proposals have been unsuccessful. The selected firm shall then be requested

by the Excise Taxation & Narcotics Control Department Punjab to sign the Contract.

7. CRITERIA FOR EVALUATION

Evaluation and Comparison of Bids The Purchaser will evaluate and compare the bids previously determined to be substantially responsive. Firm would be evaluated according to the following criteria:

Technical Evaluation All the pre qualified bidders are advised in their own interest to provide technical proposal as

mentioned in the tender document which will be completed in all aspects. Failure to furnish any of

the requisite documents will impact on the possibility of success of the bidder. All pre qualified

bidders will submit undertaking for complete scope of work (Annex-A) as well as entire tender

document. All the pre qualified bidders will also submit financial proposal against scope of work

mentioned in the tender document.

Financial Evaluation Financial bids of the successful bidders (Technically Qualified) will be opened publically and purchase order will be issued to the lowest bidder as per the relevant rules & regulations. The bidder offering lowest per candidate fees will be considered lowest bidder. In case, different fees is offered for different cadres, average will be considered as offered bid. The average will be calculated against number of cadre wise posts. Financial bids of the technically disqualified proponents will be returned unopened.

2) Gathering of CVs / Job Applications: Collections of CVs/Applications (Hard & Soft)

as per advertisement published by the Excise, Taxation & Narcotics Control

Punjab within due course of time and must have advance system that save CVs

3) Executive Search / Head Hunting / Shortlisting & Position Statistics: Initial

Shortlisting as per criteria mentioned in job advertisement of Excise, Taxation & Narcotics Control Punjab thus identifying total, eligible and non-eligible candidates against positions.

4) CV Scoring for Test exempted positions: CV analysis / scoring for generating the

merit list of all eligible candidates with respect to their qualifications, overall experience, sector relevant experience, competences / suitability / best fit for the Company for the positions which are test exempted.

5) Recruitment Test: Conducting ‘Recruitment Test’ for all eligible candidates. The

test should include relevant technical / professional questions, analytical, factual, theoretical questions with respect to the position as mentioned in the Ad. The service provider shall invigilate the Recruitment Test and ensure proper security measures of examination hall as well as necessary facilities. This will be done in consultation with the department in all Punjab district offices .

6) Communications: Must have ability of fast mode of communication calls by

providing services like couriers, email, mobile and text messages, issuance of roll number slips and necessary intimations to the candidates called for test.

9) Career Portal Development: Should have ability to develop design, integrate and hosting of customize career portal according to Excise, Taxation & Narcotics Control Punjab need and requirement 24/7 and service rules.

10) Estimated number of applicants will be 100,000/- however this estimate may vary from the actual applications.

BACKGROUND

Excise, Taxation & Narcotics Control Department Punjab intend to hire services for

testing/ screening of candidates/applicants/Shortlisting for various posts/ cadres throughout

Punjab (detail provided in tender document) of company to outsource recruitment activity

on the behalf of the ET&NCDP up to the level of CV/Application collection, initial

shortlisting as per criteria and merit generation of all eligible candidates, through a

‘Recruitment Test’ in order to ensure more transparency in the system and provide all

data with reporting at all stages of the process until joining of incumbent at Excise,

Taxation & Narcotics Control Department Punjab.

REPORTING REQUIREMENTS:

The service provider shall be submitting, a soft copy and 3 hard copies of all reports to

the Additional Director General, Excise, Taxation & Narcotics Control Department Punjab

as per ‘Deliverables’ mentioned above.

GENERAL CONDITIONS

1. All work by the recruitment company / service provider should be carried out

collaboratively with the Additional Director General, Excise, Taxation & Narcotics

Control Department Punjab.

2. An agreement/ Contract shall be drawn between Excise, Taxation & Narcotics

Control Department Punjab and the Service Provider, before the

commencement of the consultancy service.

3. All documents shall be prepared in English and submitted on electronic media

4. All the data, documents and reports produced by the recruitment company /

service provider for the said services shall be the property of the Client .The

service provider shall not share and use any data, document and reports for any

19. PERFORMANCE SECURITY

WHEREAS [Name and Address of the Contractor] (hereinafter called "the Contractor") has agreed to supply the Goods and render the Services against Tender . (hereinafter called "the Contract") for the Contract Value of PKR (in figures

) (in words ) AND WHEREAS it has been stipulated in the Tender Document that the successful Tenderer shall furnish Performance Security, within fourteen working days of the receipt of the Acceptance Letter/PO from the Purchaser, in the form of a Bank Guarantee, issued by a scheduled bank operating in Pakistan, as per the format provided in the Tender Document or in another form acceptable to the Purchaser, for a sum equivalent to 5% of the contract/purchase order value, valid from the date of issue until all obligations have been fulfilled in accordance with the Contract; AND WHEREAS [Name of the Bank] having registered office at [Address of the Bank] (hereinafter called "the Guarantor") has agreed to give the Contractor a Guarantee; THEREFORE the Guarantor hereby affirms to bind himself, his successors and his assigns to the Purchaser, for the sum of PKR (in figures ) (in words ) and undertakes to pay to the Purchaser, upon receipt of his written demand(s), any sum(s) as specified by him, not exceeding the above limit in aggregate, without cavil / argument and without the Purchaser having to substantiate / prove or to show grounds / reasons for such claim(s), on the occurrence of any / all of the following conditions:

1. If the Contractor commits a default under the Contract; 2. If the Contractor fails to fulfill any of the obligations under the Contract; 3. If the Contractor violates any of the provisions of the Contract.

Provided that the Purchaser shall specify the occurred condition(s) owing to which the said sum is due to him. Provided further that any demand(s) / claim(s) from the Purchaser shall reach the Guarantor within thirty working days after the expiry of the Guarantee.
