ACTION: APPROVE COUNTYWIDE PLANNING & DEVELOPMENT PLANNING BENCH CONTRACT

RECOMMENDATION

A. Authorize the Chief Executive Officer to establish Bench Contracts under Request For Interests and Qualifications (RFIQ) PS-4010-2178 to the contractors recommended in Attachment A for a three year period with two one-year options beginning on November 1, 2009 for professional services not to exceed a cumulative total value of $20 million; and

B. Authorize the Chief Executive Officer to execute Task Orders under the individual Bench Contracts for up to $500,000 per contract.

RATIONALE

The Countywide Planning & Development (CP & D) Department requires professional services in planning, environmental, engineering, Intelligent Transportation Systems (ITS), architectural, database technical services, economic and financial analysis, Geographical Information Systems (GIs), demand modeling, community outreach, and air quality analysis and several other disciplines as outlined in Attachment A-I.

Award of Architectural & Engineering Task Orders required by CP & D will be based on the technical superiority of a Contractor's proposal in response to a specific scope of work. Award of non-Architectural & Engineering Task Orders will be made competitively to the highest rated contractor with price being a consideration. Staff will ensure that all task orders are in compliance with any and all Small Business requirements.

The Planning Bench will allow staff to award projects in a shorter time period since the procurement process and qualification reviews have already been completed. In addition, by retaining the CEO's approval authority to award contracts for the Bench at $500,000 this will continue to expedite the procurement of many smaller projects. Many

of the projects listed in the categories are smaller-scale projects that once identified as needed, must be initiated and completed in a relatively short period of time to achieve the maximum benefit of the bench. Some projects might be integral parts of or complimentary work to larger projects that are required to be completed within the schedule constraints of the larger projects.

Background

The current Planning Bench Contract has been utilized over the last five years and has proven to be a very successful method in reducing staff resources expended on the procurement of service contracts and has allowed for projects to be completed in a more efficient manner. The authorized amount under the current contract is approximately $20 million which includes numerous smaller contracts under $500,000 and several larger contracts. The Soundwall Construction Package, New Canopies on the Metro Red Line, and the Multi-County Goods Movement Action Plan are examples of projects that were approved by the Board as they were over $500,000 each. By using the Bench we were able to reduce staff resources needed to expedite the procurement of these service contracts.

The RFlQ offered contractors 20 disciplines to submit proposals on. Overall there were 161 proposals received by 67 contractors with 42 45 of them being recommended for the Bench for the 20 disciplines.

FINANCIAL IMPACT

Funding has been included in the CP & D FYI0 budget in numerous cost centers and projects. Each task order that is assigned to a contractor will be funded with the source of funding for tasks being performed from that project. Since this is a multi-year contract, the cost center manager and the Chief Planning Officer will be responsible for budgeting the cost in future years, including any options exercised.

Impact to Bus and Rail Operating and Capital Budget

The funding for these projects is dependent upon the specific project. Generally Prop A, C, TDA Administration Funds are used for planning activities which are not eligible for bus or rail operating and capital expenditures and therefore, will not impact any future operating costs.

ALTERNATIVE CONSIDERED

The Board could choose not to approve the recommendations; however, award of these task orders would then be pursued as a separate procurement and would have to follow the procurement cycle which could potentially take up to six months. This alternative is not recommended because many of these task orders assist in achieving Metro's initiatives within tight schedule constraints. Also, project costs have increased over the past several years and funding has become limited; therefore, we need to continue to be innovative with administrative processes in order to complete projects in a timely and cost effective manner.

B. Procurement Background

All firms listed that have previously conducted work for Metro have performed satisfactorily.

These Professional Services Bench contracts are anticipated to total $20,000,000 in task orders over the life of the Bench, which is five years inclusive of two one-year options. Task Orders will be issued for each Statement of Work and will be competed only among those Bench contractors qualified for that discipline area.

The Task Order performance period may exceed the Bench Contract Period of performance, which is five years inclusive of two one year options, provided that the Task Order is completely executed and performance started prior to expiration of the Bench Contract."

Any Architect and Engineering Task Order requirement will be competed among bench firms qualified for that skill set, and each of the qualified firms will be sent an RFP for that specific Task Order requirement. After submittal of the technical proposal for evaluation, the most qualified competitor is selected and will be requested to submit a Firm Fixed Price, MTA Form 60 cost proposal. The proposal must be compliant with any small business requirements set forth in the RFP.

For non - Architect and Engineering (A&E) Task Order proposals, the initial procedure is the same as the preceding paragraph. The difference is that the Task Order award will be made competitively, to the lowest evaluated bidder, with price being a consideration.

Price fair and reasonableness determination will be made for each Task Order at the time of release.

Due to unforeseeable circumstances, such as loss of contracted for technical skills, change of ownership, bankruptcy, cessation of business, or similar kind of change of business circumstance, of any of the selected Bench Contractor during the active period of performance of the Bench Contract, Metro reserves the right to replace such Contractor (s ) through a competitive procurement process. Any Contractor replaced as a result of this process shall not be permitted to participate in the replacement solicitation process.

The Diversity and Economic Opportunity Department (DEOD) will determine a Disadvantaged Business Enterprise (DBE) Anticipated Level of Participation (DALP) or Small Business Enterprise (SBE) contract-specific participation goal upon review of each task order issued for the Planning, Architectural, and Engineering Services Bench project. Proposers were requested to form teams that include a sufficient number of DBE and SBE firms to perform the scopes of work identified in the solicitation document. Metro project managers are required to submit to DEOD a Goal Evaluation Form (GEF) for each task order. As such, DEOD will review each GEF for funding source and subcontracting opportunities to determine possible small business participation. A DBE Anticipation Level Participation (DALP) will be recommended based on the scope of work and estimated dollar value for each task order funded with Federal funds. Obtaining the DALP percentage is encouraged but is not a condition of award nor an issue of responsiveness. Notwithstanding, Bidders/Proposers are strongly encouraged to obtain DBE participation at the established percentage. A Small Business Enterprise (SBE) goal will be established based on the scope of work and estimated dollar value for each task order funded with State and or Local funds. Participants on the Bench will be required to meet the SBE contract-specific goal by obtaining enough SBE participation to meet the goal or by successfully demonstrating Good Faith Effort (GFE).

C. Evaluation of Proposals

Competitive qualification statements were sought and reviewed by a Source Selection committee. They were evaluated for qualifications and technical competency to perform the required work in the specific disciplines proposed.

The RFIQ contained neither price nor a specific Statement of Work. Each future contract1Task Order will contain a specific Statement of Work, which will be sent to all Bench consultants qualified in that specific survey area. The Bench contractors will propose according to the requirements of the RFP.

Placement on the Bench will not guarantee an award of any contract1Task Order.
